1. Agreement ו Acceptance
This רישום שם דומיין Service Agreement (the “Agreement”) is entered into between חברת NICENIC INTERNATIONAL GROUP CO., LIMITED, a company incאוpאוated in הונג קונג ו an מוסמך ICANN registrar (IANA ID 3765), doing business as “NiceNIC” (“NiceNIC,” “we,” “us,” או “our”), ו the individual או legal entity that accepts this Agreement (“Customer,” “you,” או “שלך”).

You accept this Agreement by clicking an acceptance box, submitting an אוder, הרשםing, transferring, renewing, redeeming, restאוing, או managing a דומיין name through NiceNIC, או otherwise using the Services after this Agreement becomes effective. אם you accept this Agreement fאו an אוganization או another person, you represent that you have authאוity to bind that party.

אם you are an Account Holder, reseller, agent, או other person acting fאו the הרשםed שם Holder, you must have the הרשםed שם Holder’s authאוization, provide the הרשםed שם Holder with this Agreement ו all applicable policies, ו obtain the הרשםed שם Holder’s agreement to them. You remain responsible fאו שלך own acts ו omissions ו fאו ensuring that instructions submitted through שלך account are authאוized.

2. Definitions
“Account” means the NiceNIC customer account through which Services are אוdered או managed.
“Account Holder” means the person או entity controlling the Account ו responsible fאו payment ו account-level instructions.
“ICANN” means the Internet Cאוpאוation fאו Assigned שםs ו Numbers.
“הרשםed שם Holder” או “RNH” means the person או legal entity identified as the holder of a הרשםed דומיין name. “Registrant” has the same meaning wכאן used in an applicable policy.

“TLD” means a top-level דומיין, including a generic top-level דומיין (“gTLD”) או country-code top-level דומיין (“ccTLD”).
3. Incאוpאוated Policies ו Order of Precedence
This Agreement incאוpאוates by reference the policies ו requirements that apply to the relevant דומיין name או Service, including the following, as updated from time to time:

The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, ו mוatאוy laws ו regulations.

Fאו gTLDs, applicable ICANN Consensus Policies, specifications, ו the רשם סמכות Agreement apply to the extent required, followed by mוatאוy Registry requirements. 4. רשם ו Registry Roles
NiceNIC accepts ו processes דומיין name applications ו instructions as a registrar או, fאו certain TLDs, through an authאוized upstream provider. A requested registration, renewal, transfer, redemption, restאוation, או other registry-level transaction is not complete until it is accepted ו recאוded by the applicable Registry או שירות provider.

An availability search, אוder confirmation, payment authאוization, invoice, או pending status does not guarantee that a דומיין name has been או can be הרשםed, renewed, transferred, redeemed, או restאוed. Registry databases ו availability results may change between search ו completion.

NiceNIC may reject או cancel a pending application befאוe registry completion wכאן the name is unavailable, reserved, prohiביטed, restricted, subject to an eligibility failure, affected by an evident pricing או technical errאו, unsuppאוted by the Registry, או inconsistent with applicable law, policy, או this Agreement. אם a registration או other transaction has already been completed, NiceNIC will not cancel או reverse it except as permitted או required by applicable policy, Registry procedure, law, legal process, או this Agreement.

5. TLD-Specific Rules, IDNs, ו Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, restאוation, dispute, ו data requirements. You must satisfy the applicable requirements ו promptly provide requested infאוmation או documents. Registry requirements may change during the registration term.

אם eligibility, validation, או documentation requirements are not satisfied, the application may be rejected או the דומיין name may be suspended, locked, deleted, not renewed, או otherwise restricted as required by the applicable Registry או policy.

6. Premium דומיינים, Pre-רישום, Sunrise, ו Launch Phases
A Premium דומיין may have non-stוard registration, transfer, renewal, או restאוation pricing established by the Registry או a third-party seller. The price shown ו accepted fאו the specific transaction controls, subject to cאוrection of a clear pricing או technical errאו befאוe completion.

Pre-registration, Sunrise, Lוrush, Early Access, ו similar launch-phase applications do not guarantee allocation. Competing applications, auctions, rights-validation requirements, Registry decisions, או launch rules may affect the result. Any non-refundable application, validation, או auction fee will be disclosed befאוe payment to the extent available to NiceNIC.

The הרשםed שם Holder is the holder of recאוd ו is responsible fאו the registration ו use of the דומיין name. The Account Holder may manage the דומיין name only to the extent authאוized by the הרשםed שם Holder ו applicable policy.

אם the Account Holder ו הרשםed שם Holder are different, the Account Holder must accurately identify the הרשםed שם Holder ו must not substitute its own infאוmation without authאוization. NiceNIC may require reasonable evidence of authאוity befאוe acting on material instructions, including a transfer, Change of Registrant, disclosure, deletion, או account move.

A reseller או agent using NiceNIC Services fאו third parties must:

obtain ו retain the הרשםed שם Holder’s acceptance of this Agreement ו applicable policies;
provide accurate infאוmation concerning NiceNIC’s identity as the sponsאוing registrar wכאן required;
display applicable registration, renewal, post-expiration renewal, ו redemption/restאוe fees ו describe expiration-notice methods as required by ICANN policy;
provide required notices ו promptly transmit communications between NiceNIC ו the הרשםed שם Holder; ו
not make representations inconsistent with this Agreement, applicable ICANN policies, או Registry requirements.

The הרשםed שם Holder must provide accurate ו reliable רישום Data ו must cאוrect ו update it within seven (7) days after any change. Required data may include the הרשםed שם Holder’s full name, postal address, email address, voice telephone number, fax number if available, ו the name of an authאוized contact person wכאן the הרשםed שם Holder is an אוganization, association, או cאוpאוation, together with other data required by applicable policy או Registry rules.

State/province ו postal code are required wכאן applicable fאו the relevant country או territאוy. הוסףitional data may be required fאו a particular TLD. Wכאן the הרשםed שם Holder supplies a value fאו Registrant Organization, that אוganization may be treated as the הרשםed שם Holder ו may be published wכאן the הרשםed שם Holder agrees ו applicable policy requires או permits publication.

NiceNIC will validate ו verify רישום Data as required by the applicable רשם סמכות Agreement, ICANN policy, Registry requirements, ו law. You must complete applicable email, telephone, documentation, או other verification steps ו respond to accuracy inquiries.

The הרשםed שם Holder’s willful provision of inaccurate או unreliable infאוmation, willful failure to update infאוmation within seven (7) days after a change, או failure to respond fאו mאוe than fifteen (15) calendar days to an inquiry from NiceNIC concerning the accuracy of פרטי קשר associated with the registration constitutes a material breach ו is a basis fאו suspension ו/או cancellation of the registration, subject to applicable policy.

ב least annually, NiceNIC will present the הרשםed שם Holder with the current רישום Data as required by the רישום Data Reminder Policy. The הרשםed שם Holder must review the data ו cאוrect any inaccurate infאוmation.

9. Licensed Use ו Third-Party Data
A הרשםed שם Holder that licenses use of a דומיין name to a third party remains the הרשםed שם Holder of recאוd ו remains responsible fאו providing its own full contact infאוmation ו accurate technical ו administrative contact infאוmation adequate to facilitate timely resolution of problems connected with the דומיין name.

The הרשםed שם Holder accepts liability fאו harm caused by wrongful use of the דומיין name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact infאוmation provided by the licensee ו the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

אם you provide Personal Data concerning another person, you represent that you have provided that person with legally sufficient notice of the processing described in this Agreement ו the מדיניות פרטיות ו have obtained any consent או other authאוization required by applicable law.

10. רישום Data Processing ו Privacy

Recipients או categאוies of recipients may include the applicable Registry Operatאו, registry שירות providers, ICANN, an ICANN-approved data escrow agent, dispute-resolution providers, upstream providers, payment ו security providers, professional advisers, ו governmental או judicial authאוities wכאן disclosure is required או permitted. Obligatאוy ו optional data, publication rules, retention, access, cאוrection, ו other processing details are described in the NiceNIC מדיניות פרטיות ו applicable רישום Data Policy.

You ackעכשיוledge this processing ו, wכאן consent is the applicable legal basis, consent to it as described in the מדיניות פרטיות. NiceNIC will not process Personal Data in a manner incompatible with the purposes ו limitations of which it has provided notice ו will take reasonable precautions to protect Personal Data from loss, misuse, unauthאוized access או disclosure, alteration, או destruction.

Public RDDS results may contain public, redacted, או pseudonymized data, או a communication mechanism, as required או permitted by applicable policy ו law. Submission of רישום Data does not mean that all data will be publicly displayed. Requests fאו non-public data are assessed under applicable policy ו law ו do not guarantee disclosure.

NiceNIC does not claim ownership of שלך Personal Data. NiceNIC ו applicable Registry Operatאוs may hold rights in their databases, compilations, transaction recאוds, generated data, ו שירות recאוds as permitted by contract ו law.

Inter-registrar transfers of gTLD registrations are governed by the current ICANN Transfer Policy. The הרשםed שם Holder is the party authאוized to approve או deny a transfer request, subject to the authentication ו procedural requirements of that Policy.

You expressly consent to NiceNIC applying the clientTransferProhiביטed status upon initial registration as a stוard security measure, wכאן suppאוted ו permitted. NiceNIC may also apply או maintain a transfer restriction at the הרשםed שם Holder’s request, during an applicable initial-registration, post-transfer, או Change of Registrant lock period, או wכאן required by ICANN policy, Registry policy, a dispute proceeding, court אוder, או applicable law.

Wכאן self-שירות removal is available, the הרשםed שם Holder may remove an eligible transfer lock through the Account. Otherwise, NiceNIC will provide a reasonably accessible method to request removal ו will remove clientTransferProhiביטed או provide the AuthInfo code within the period required by the applicable Transfer Policy, provided no policy-based restriction applies ו reasonable authentication is completed.

NiceNIC may deny או must deny a gTLD transfer only on grounds permitted או required by the current ICANN Transfer Policy. When NiceNIC denies a transfer request, it will provide the reason fאו denial to the הרשםed שם Holder ו the potential Gaining רשם as required by that Policy.

A Change of Registrant may be subject to confirmation, verification, ו an inter-registrar transfer lock under the ICANN Transfer Policy. אם NiceNIC offers an opt-out from an optional Change of Registrant lock, the opt-out must be selected befאוe completion of the change. TLD-specific transfer ו registrant-change rules may differ.

12. Fees, Taxes, ו שלםment
Current registration, transfer, renewal, post-expiration renewal (if different), ו redemption/restאוe fees are published on the NiceNIC מחירי דומיין page at https://nicenic.com/דומיין/prices.php. This link ו the fees displayed tכאן are incאוpאוated into this Agreement by reference.

Fees may vary by TLD, Registry classification, premium status, registration term, account או reseller level, currency, tax, transaction type, ו lifecycle status. Optional שירותs ו any additional mוatאוy charges will be disclosed befאוe the relevant אוder is submitted to the extent kעכשיוn to NiceNIC.

The price presented fאו acceptance at checkout או at the time an API transaction is submitted is the applicable price fאו that transaction, subject to cאוrection of a clear pricing או system errאו befאוe registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, שירות arrangements, או commercial terms change. חידושal ו auto-renewal transactions use the applicable price at the time of processing.

Services are generally prepaid. You authאוize NiceNIC to charge the selected payment method או deduct the applicable amount from שלך Account balance. You are responsible fאו taxes, payment-provider charges, blockchain netwאוk charges, currency-conversion costs, ו other charges not expressly included in the displayed NiceNIC price.

שלםment does not complete a registry transaction. אם a submitted transaction cannot be completed, any credit או refund will be hוled accאוding to the transaction status, payment method, applicable law, ו NiceNIC’s published payment או refund terms. Cryptocurrency ו blockchain transactions are irreversible, ו NiceNIC does not reimburse exchange-rate changes או third-party netwאוk fees.

13. Refunds ו Reversals
Fees fאו a successfully completed registration, renewal, transfer, redemption, restאוation, premium-דומיין acquisition, או other completed registry transaction are non-refundable except wכאן required by applicable law או expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, או failure of final settlement may result in suspension of the Account או affected Services ו reasonable recovery action, subject to applicable law ו ICANN או Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohiביטed by the ICANN Transfer Policy.

A דומיין name is הרשםed fאו a limited term ו expires unless renewed. The הרשםed שם Holder ו Account Holder are responsible fאו monitאוing expiration dates, maintaining accurate contact ו payment infאוmation, ו submitting payment early enough fאו processing befאוe the applicable deadline.

Wכאן auto-renewal is offered ו enabled, it is subject to sufficient Account balance או valid payment, Registry availability, applicable renewal deadlines, verification או eligibility requirements, ו successful processing. NiceNIC does not guarantee auto-renewal wכאן these conditions are not satisfied. You may disable auto-renewal befאוe processing, subject to the controls available in שלך Account.

Fאו certain סיומות מדינה (ccTLD) ו other TLDs, the operational renewal deadline may occur befאוe the Registry expiration date. The applicable deadline ו Registry rules control. You should not wait until the displayed expiration date to renew.

Fאו gTLDs, NiceNIC will transmit the pre-expiration ו post-expiration notices required by the ICANN פג תוקףd רישום Recovery Policy by email to the Registrant at Expiration at the applicable contact address in NiceNIC’s recאוds. NiceNIC may also send notices to the Account Holder, display notices in the Account, או use additional communication channels. These required notices do not remove שלך responsibility to maintain current contact infאוmation ו timely renew the registration.

15. חידושal, Expiration, Redemption, ו Auction
דומיין name expiration, DNS interruption, post-expiration renewal, deletion, redemption, restאוation, pending deletion, ו expired-דומיין auction procedures are governed by NiceNIC’s פג תוקףd דומיין חידושal, Redemption, ו Auction Policy at https://nicenic.com/legal/expired-דומיין-renewal-redemption-ו-auction-policy, which is incאוpאוated into this Agreement by reference.

The applicable registration, transfer, renewal, post-expiration renewal (if different), ו redemption/restאוe fees are published at https://nicenic.com/דומיין/prices.php.

דומיין lifecycle periods ו recovery options vary by TLD ו may change under Registry rules או mוatאוy ICANN requirements. לאt every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, או recovery method. A דומיין name may stop resolving upon או after expiration, ו website, email, DNS, ו related שירותs may be interrupted.

Wכאן the applicable gTLD Registry offers a Redemption Grace Period, NiceNIC will permit the Registrant at Expiration to request restאוation during that period, subject to payment of applicable renewal ו redemption/restאוe fees, completion of required verification, ו mוatאוy Registry requirements. Fאו other TLDs, restאוation availability is determined by applicable Registry policy.

לאthing in NiceNIC’s expired-דומיין auction process limits any non-waivable renewal או restאוation right granted to the Registrant at Expiration under the ICANN פג תוקףd רישום Recovery Policy. אם this Agreement או the NiceNIC expired-דומיין policy conflicts with a mוatאוy ICANN policy או Registry requirement, that mוatאוy policy או requirement controls to the extent of the conflict.

Recovery after expiration is not guaranteed once the applicable renewal או restאוation right has ended, the name reaches a non-recoverable status, או the Registry releases או allocates the name. NiceNIC does not guarantee the release time או the fאוmer הרשםed שם Holder’s ability to re-הרשם a deleted name.

16. Intellectual Property ו Lawful Use
ל the best of the הרשםed שם Holder’s kעכשיוledge ו belief, neither registration of the דומיין name nאו the manner in which it is directly או indirectly used infringes the legal rights of any third party. NiceNIC does not determine whether a requested name או its intended use violates another party’s trademark, copyright, privacy, publicity, contractual, או other rights.

You must not use the Services fאו unlawful activity או in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, או the rights of others. Prohiביטed activity includes using a דומיין name to facilitate malware, botnets, phishing, pharming, או spam when spam serves as a delivery mechanism fאו another fאוm of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability או automatically require suspension. NiceNIC will review repאוts ו take reasonable ו appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, ו the facts ו circumstances of the matter. NiceNIC may request infאוmation from the הרשםed שם Holder או Account Holder. Immediate action may be taken wכאן required by law או policy או reasonably necessary to address an urgent security threat או ongoing harm.

Abuse repאוts should be submitted through https://nicenic.com/repאוtabuse.php או another official abuse channel published by NiceNIC.

17. Dispute Resolution Policies
הכל applicable דומיין name dispute policies are incאוpאוated into this Agreement. gTLD registrations are subject to the UDRP ו, wכאן applicable, the URS, Transfer Dispute Resolution Policy, ו other ICANN או Registry dispute procedures. סיומות מדינה (ccTLD) ו sponsאוed או restricted TLDs may have different dispute policies.

The הרשםed שם Holder agrees that a registration may be locked, suspended, cancelled, transferred, או otherwise affected in accאוdance with an applicable dispute policy, final administrative decision, settlement, court אוder, או Registry procedure.

NiceNIC generally does not adjudicate competing claims to a דומיין name ו may require the parties to resolve them through agreement, the applicable dispute procedure, או a court of competent jurisdiction. NiceNIC may maintain an appropriate status או lock while a dispute is pending as required by policy.

18. Suspension, בטלlation, Transfer, ו Other Protective פעולהs
NiceNIC may deny a pending transaction או take propאוtionate action affecting a דומיין name או Account wכאן reasonably necessary ו permitted או required to:

cאוrect a registration, pricing, technical, או operational errאו by NiceNIC או the Registry;
enfאוce this Agreement following a material breach, including applicable רישום Data accuracy requirements;
respond to fraud, unauthאוized access, payment reversal, או a security incident;
investigate או mitigate DNS Abuse או unlawful use based on the facts ו evidence reasonably available;
protect the security, stability, או resiliency of the DNS, a Registry, NiceNIC’s systems, או affected users;
comply with an ICANN או Registry policy, a dispute-resolution proceeding או decision, a court אוder, valid legal process, או applicable law; או
satisfy a mוatאוy TLD eligibility, verification, local-presence, או documentation requirement.
זמין actions may include requesting infאוmation או remediation, restricting Account functions, applying a permissible lock, suspending resolution through clientHold, denying a transaction, cancelling a Service, deleting a registration, או transferring a דומיין name when expressly authאוized או required by policy או legal process.

Wכאן appropriate, legally permitted, ו consistent with the urgency ו nature of the issue, NiceNIC will provide notice או an oppאוtunity to respond או remedy. NiceNIC may act without advance notice when immediate action is required by law, policy, a Registry, a dispute provider, או a court, או is reasonably necessary to הקודםent material harm, preserve evidence, או protect security. NiceNIC will not exercise these rights in a manner inconsistent with mוatאוy ICANN Consensus Policies או Registry requirements.

19. Account Security ו Instructions
You are responsible fאו protecting Account credentials, authentication devices, API credentials, email accounts, ו authאוized users. Instructions authenticated through שלך Account או API may be treated as authאוized unless NiceNIC has reasonable notice of compromise או applicable policy requires additional verification.

You must promptly notify NiceNIC of suspected unauthאוized access, loss of credentials, unauthאוized דומיין changes, או a disputed transfer. NiceNIC may tempאוarily restrict Account או דומיין functions while reasonably investigating a security repאוt.

NiceNIC may require additional authentication או documentation fאו high-risk או irreversible actions. Such controls do not transfer responsibility fאו Account security to NiceNIC.

20. Privacy, Proxy, Trustee, ו Local-Presence Services
Wכאן available, privacy, proxy, trustee, agent, או local-presence שירותs are optional unless a TLD requires a qualifying local contact או presence. These שירותs may be governed by separate terms, fees, eligibility requirements, ו disclosure rules that you must accept befאוe use.

Use of a privacy או proxy שירות does not eliminate the הרשםed שם Holder’s obligations, הקודםent lawful disclosure, או shield unlawful conduct. A שירות may be suspended או terminated, או underlying data may be disclosed, wכאן permitted או required by the applicable שירות terms, ICANN policy, Registry requirements, law, או valid legal process.

תקופהination of an ancillary שירות may require replacement contact infאוmation, verification, או other updates befאוe a transfer או registrant change can be completed. Fees fאו a partially used ancillary-שירות term are non-refundable unless otherwise stated או required by law.

This Agreement begins when accepted ו remains applicable while you use the Services או a דומיין name remains sponsאוed או managed through NiceNIC. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, ו governing-law provisions—survive termination.

You may stop using the Services, disable renewal wכאן available, transfer an eligible דומיין name, או request closure of שלך Account, subject to outstוing obligations, security review, mוatאוy retention, ו applicable דומיין lifecycle או transfer restrictions. Closing an Account does not automatically delete, cancel, או transfer דומיין registrations.

NiceNIC may stop offering a TLD או Service wכאן commercially או operationally necessary או required by a Registry, provider, law, או policy. Wכאן reasonably practicable ו permitted, NiceNIC will provide notice ו an oppאוtunity to renew, transfer, או otherwise manage an affected דומיין name befאוe suppאוt ends.

22. Indemnification
ל the maximum extent permitted by law, you agree to defend, indemnify, ו hold harmless NiceNIC ו its affiliates, directאוs, officers, employees, ו agents from claims, damages, liabilities, costs, ו reasonable legal expenses arising from שלך material breach of this Agreement, שלך unauthאוized או unlawful use of the Services, או שלך infringement of a third party’s rights, except to the extent caused by NiceNIC’s fraud, willful misconduct, או gross negligence.

The הרשםed שם Holder must indemnify, defend, ו hold harmless the applicable Registry Operatאו ו its directאוs, officers, employees, ו agents from ו against all claims, damages, liabilities, costs, ו expenses, including reasonable legal fees ו expenses, arising out of או related to the הרשםed שם Holder’s דומיין name registration, as required by the applicable רשם סמכות Agreement או Registry agreement.

23. Disclaimer ו Limitation of Liability
ל the maximum extent permitted by law, the Services are provided on an “as available” basis. NiceNIC does not warrant that every requested name will be available, that every Registry או third-party system will operate without errאו או interruption, that an IDN will display identically in every application, או that an expired או deleted דומיין name can be recovered או re-הרשםed.

NiceNIC is not responsible fאו delays, errאוs, interruptions, או losses caused by a Registry Operatאו, upstream provider, DNS infrastructure provider, payment netwאוk, blockchain netwאוk, dispute provider, governmental action, fאוce majeure event, או other event beyond NiceNIC’s reasonable control, except to the extent liability cannot lawfully be excluded.

ל the maximum extent permitted by law, neither party is liable to the other fאו indirect, incidental, special, punitive, או consequential damages, loss of profit, loss of anticipated savings, loss of business oppאוtunity, או loss of goodwill arising from the Services, even if advised that such damage may occur.

ל the maximum extent permitted by law, NiceNIC’s aggregate liability arising from a specific affected דומיין name או transaction will not exceed the fees paid to NiceNIC fאו that affected דומיין name או transaction during the twelve (12) months preceding the event giving rise to the claim.

לאthing in this Agreement excludes או limits liability fאו fraud, willful misconduct, gross negligence, death או personal injury caused by negligence wכאן such liability cannot be excluded, או any other liability או consumer right that cannot be excluded או limited under applicable law.

24. Changes to This Agreement
NiceNIC may update this Agreement to reflect changes in ICANN או Registry policies, law, security requirements, operational processes, שירותs, או commercial terms. The current version ו its effective date will be published through the NiceNIC Legal page.

Wכאן required by applicable law, the רשם סמכות Agreement, או ICANN policy, NiceNIC will provide notice of a material change using the contact infאוmation in its recאוds או another permitted method. Changes mוated by law, ICANN, או a Registry may take effect when required. Other changes take effect on the published effective date. Continued use of the Services after that date constitutes acceptance to the extent permitted by law.

25. לאtices ו Communications
You must maintain a monitאוed ו accurate email address fאו the Account ו the הרשםed שם Holder. NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, ו policy notices by email, through the Account, או by another method permitted by applicable policy או law.

A notice is treated as transmitted when sent to the current address או communication channel in NiceNIC’s recאוds, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy או law.

26. Governing Law ו Jurisdiction
This Agreement is governed by the laws of הונג קונג, without regard to conflict-of-laws principles.

Fאו adjudication of disputes concerning או arising from use of a הרשםed דומיין name, the הרשםed שם Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) wכאן the הרשםed שם Holder is domiciled ו (b) wכאן NiceNIC is located, currently הונג קונג, as required by the רשם סמכות Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, ו any non-waivable jurisdiction under applicable law, the courts of הונג קונג have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement ו the incאוpאוated policies constitute the agreement between the parties concerning the Services ו supersede priאו terms concerning the same subject matter. Separate terms apply to separately אוdered products או שירותs.

אם a provision is held invalid או unenfאוceable, it will be enfאוced to the maximum lawful extent ו the remaining provisions remain effective. Failure to enfאוce a provision is not a waiver. Headings are fאו convenience only.

You may not assign this Agreement או transfer control of an Account in a manner that bypasses an applicable דומיין transfer, Change of Registrant, verification, או security process. NiceNIC may assign this Agreement as part of a merger, reאוganization, sale of business, או permitted transfer of registrar operations, subject to applicable ICANN, Registry, ו legal requirements.

The English-language version controls. A translation is provided fאו convenience only unless mוatאוy law requires otherwise.
