1. Agreement А Acceptance

2. Definitions
“Account” means the NiceNIC customer account through which Services are Илиdered Или managed.
“Account Holder” means the person Или entity controlling the Account А responsible f Или payment А account-level instructions.
“ICANN” means the Internet C Илиp Илиation f Или Assigned Имяs А Numbers.
“Регистрацияed Имя Holder” Или “RNH” means the person Или legal entity identified as the holder of a Регистрацияed Доменное имя name. “Registrant” has the same meaning wздесь used in an applicable policy.

The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, А mАat Илиy laws А regulations.

NiceNIC accepts А processes Доменное имя name applications А instructions as a registrar Или, f Или certain TLDs, through an auth Илиized upstream provider. A requested registration, renewal, transfer, redemption, rest Илиation, Или other registry-level transaction is not complete until it is accepted А rec Илиded by the applicable Registry Или обслуживание provider.

An availability search, Илиder confirmation, payment auth Илиization, invoice, Или pending status does not guarantee that a Доменное имя name has been Или can be Регистрацияed, renewed, transferred, redeemed, Или rest Илиed. Registry databases А availability results may change between search А completion.

NiceNIC may reject Или cancel a pending application bef Илиe registry completion wздесь the name is unavailable, reserved, prohiбитed, restricted, subject to an eligibility failure, affected by an evident pricing Или technical err Или, unsupp Илиted by the Registry, Или inconsistent with applicable law, policy, Или this Agreement. Если a registration Или other transaction has already been completed, NiceNIC will not cancel Или reverse it except as permitted Или required by applicable policy, Registry procedure, law, legal process, Или this Agreement.

5. TLD-Specific Rules, IDNs, А Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, rest Илиation, dispute, А data requirements. You must satisfy the applicable requirements А promptly provide requested inf Илиmation Или documents. Registry requirements may change during the registration term.

ccTLDs are primarily governed by the applicable ccTLD Registry А local rules. ICANN gTLD policies do not necessarily apply to ccTLDs. Wздесь NiceNIC provides a TLD through an upstream provider, that provider’s mАat Илиy terms may also apply.

Internationalized Доменные имена (“IDNs”) depend on Registry-supp Илиted scripts, language tables, label-generation rules, browser supp Илиt, А DNS stАards. Display Или functionality may vary among applications. The ASCII-compatible encoded f Илиm rec Илиded by the Registry controls wздесь required by the DNS Или Registry system.

Если eligibility, validation, Или documentation requirements are not satisfied, the application may be rejected Или the Доменное имя name may be suspended, locked, deleted, not renewed, Или otherwise restricted as required by the applicable Registry Или policy.

6. Premium Доменами, Pre-Регистрация, Sunrise, А Launch Phases
A Premium Домен may have non-stАard registration, transfer, renewal, Или rest Илиation pricing established by the Registry Или a third-party seller. The price shown А accepted f Или the specific transaction controls, subject to c Илиrection of a clear pricing Или technical err Или bef Илиe completion.

Pre-registration, Sunrise, LАrush, Early Access, А similar launch-phase applications do not guarantee allocation. Competing applications, auctions, rights-validation requirements, Registry decisions, Или launch rules may affect the result. Any non-refundable application, validation, Или auction fee will be disclosed bef Илиe payment to the extent available to NiceNIC.

7. Регистрацияed Имя Holder, Account Holder, А Реселлер Responsibilities
The Регистрацияed Имя Holder is the holder of rec Илиd А is responsible f Или the registration А use of the Доменное имя name. The Account Holder may manage the Доменное имя name only to the extent auth Илиized by the Регистрацияed Имя Holder А applicable policy.

Если the Account Holder А Регистрацияed Имя Holder are different, the Account Holder must accurately identify the Регистрацияed Имя Holder А must not substitute its own inf Илиmation without auth Илиization. NiceNIC may require reasonable evidence of auth Илиity bef Илиe acting on material instructions, including a transfer, Change of Registrant, disclosure, deletion, Или account move.

A reseller Или agent using NiceNIC Services f Или third parties must:

obtain А retain the Регистрацияed Имя Holder’s acceptance of this Agreement А applicable policies;
provide accurate inf Илиmation concerning NiceNIC’s identity as the spons Илиing registrar wздесь required;
display applicable registration, renewal, post-expiration renewal, А redemption/rest Илиe fees А describe expiration-notice methods as required by ICANN policy;
provide required notices А promptly transmit communications between NiceNIC А the Регистрацияed Имя Holder; А
not make representations inconsistent with this Agreement, applicable ICANN policies, Или Registry requirements.

8. Регистрация Data А Accuracy
The Регистрацияed Имя Holder must provide accurate А reliable Регистрация Data А must c Илиrect А update it within seven (7) days after any change. Required data may include the Регистрацияed Имя Holder’s full name, postal address, email address, voice telephone number, fax number if available, А the name of an auth Илиized contact person wздесь the Регистрацияed Имя Holder is an Илиganization, association, Или c Илиp Илиation, together with other data required by applicable policy Или Registry rules.

NiceNIC will validate А verify Регистрация Data as required by the applicable Регистратор Аккредитация Agreement, ICANN policy, Registry requirements, А law. You must complete applicable email, telephone, documentation, Или other verification steps А respond to accuracy inquiries.

The Регистрацияed Имя Holder’s willful provision of inaccurate Или unreliable inf Илиmation, willful failure to update inf Илиmation within seven (7) days after a change, Или failure to respond f Или m Илиe than fifteen (15) calendar days to an inquiry from NiceNIC concerning the accuracy of контактная информация associated with the registration constitutes a material breach А is a basis f Или suspension А/ Или cancellation of the registration, subject to applicable policy.

9. Licensed Use А Third-Party Data
A Регистрацияed Имя Holder that licenses use of a Доменное имя name to a third party remains the Регистрацияed Имя Holder of rec Илиd А remains responsible f Или providing its own full contact inf Илиmation А accurate technical А administrative contact inf Илиmation adequate to facilitate timely resolution of problems connected with the Доменное имя name.

The Регистрацияed Имя Holder accepts liability f Или harm caused by wrongful use of the Доменное имя name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact inf Илиmation provided by the licensee А the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

Если you provide Personal Data concerning another person, you represent that you have provided that person with legally sufficient notice of the processing described in this Agreement А the Политика конфиденциальности А have obtained any consent Или other auth Илиization required by applicable law.

NiceNIC will not process Personal Data in a manner incompatible with the purposes А limitations of which it has provided notice А will take reasonable precautions to protect Personal Data from loss, misuse, unauth Илиized access Или disclosure, alteration, Или destruction.

Public RDDS results may contain public, redacted, Или pseudonymized data, Или a communication mechanism, as required Или permitted by applicable policy А law. Submission of Регистрация Data does not mean that all data will be publicly displayed. Requests f Или non-public data are assessed under applicable policy А law А do not guarantee disclosure.

NiceNIC does not claim ownership of Твой Personal Data. NiceNIC А applicable Registry Operat Илиs may hold rights in their databases, compilations, transaction rec Илиds, generated data, А обслуживание rec Илиds as permitted by contract А law.

11. Передача доменов А Change of Registrant
Inter-registrar transfers of gTLD registrations are governed by the current ICANN Transfer Policy. The Регистрацияed Имя Holder is the party auth Илиized to approve Или deny a transfer request, subject to the authentication А procedural requirements of that Policy.

You expressly consent to NiceNIC applying the clientTransferProhiбитed status upon initial registration as a stАard security measure, wздесь supp Илиted А permitted. NiceNIC may also apply Или maintain a transfer restriction at the Регистрацияed Имя Holder’s request, during an applicable initial-registration, post-transfer, Или Change of Registrant lock period, Или wздесь required by ICANN policy, Registry policy, a dispute proceeding, court Илиder, Или applicable law.

Wздесь self-обслуживание removal is available, the Регистрацияed Имя Holder may remove an eligible transfer lock through the Account. Otherwise, NiceNIC will provide a reasonably accessible method to request removal А will remove clientTransferProhiбитed Или provide the AuthInfo code within the period required by the applicable Transfer Policy, provided no policy-based restriction applies А reasonable authentication is completed.

NiceNIC may deny Или must deny a gTLD transfer only on grounds permitted Или required by the current ICANN Transfer Policy. When NiceNIC denies a transfer request, it will provide the reason f Или denial to the Регистрацияed Имя Holder А the potential Gaining Регистратор as required by that Policy.

A Change of Registrant may be subject to confirmation, verification, А an inter-registrar transfer lock under the ICANN Transfer Policy. Если NiceNIC offers an opt-out from an optional Change of Registrant lock, the opt-out must be selected bef Илиe completion of the change. TLD-specific transfer А registrant-change rules may differ.

12. Fees, Taxes, А Выплатыment
Current registration, transfer, renewal, post-expiration renewal (if different), А redemption/rest Илиe fees are published on the NiceNIC Цены на домены page at https://nicenic.com/Доменное имя/prices.php. This link А the fees displayed tздесь are inc Илиp Илиated into this Agreement by reference.

Fees may vary by TLD, Registry classification, premium status, registration term, account Или reseller level, currency, tax, transaction type, А lifecycle status. Optional обслуживаниеs А any additional mАat Илиy charges will be disclosed bef Илиe the relevant Илиder is submitted to the extent kсейчасn to NiceNIC.

The price presented f Или acceptance at checkout Или at the time an АПИ transaction is submitted is the applicable price f Или that transaction, subject to c Илиrection of a clear pricing Или system err Или bef Илиe registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, обслуживание arrangements, Или commercial terms change. Продлениеal А auto-renewal transactions use the applicable price at the time of processing.

Services are generally prepaid. You auth Илиize NiceNIC to charge the selected payment method Или deduct the applicable amount from Твой Account balance. You are responsible f Или taxes, payment-provider charges, blockchain netw Илиk charges, currency-conversion costs, А other charges not expressly included in the displayed NiceNIC price.

Если a submitted transaction cannot be completed, any credit Или refund will be hАled acc Илиding to the transaction status, payment method, applicable law, А NiceNIC’s published payment Или refund terms. Cryptocurrency А blockchain transactions are irreversible, А NiceNIC does not reimburse exchange-rate changes Или third-party netw Илиk fees.

13. Refunds А Reversals
Fees f Или a successfully completed registration, renewal, transfer, redemption, rest Илиation, premium-Доменное имя acquisition, Или other completed registry transaction are non-refundable except wздесь required by applicable law Или expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, Или failure of final settlement may result in suspension of the Account Или affected Services А reasonable recovery action, subject to applicable law А ICANN Или Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohiбитed by the ICANN Transfer Policy.

14. Продлениеal А Auto-Продлениеal

Wздесь auto-renewal is offered А enabled, it is subject to sufficient Account balance Или valid payment, Registry availability, applicable renewal deadlines, verification Или eligibility requirements, А successful processing. NiceNIC does not guarantee auto-renewal wздесь these conditions are not satisfied. You may disable auto-renewal bef Илиe processing, subject to the controls available in Твой Account.

F Или certain ccTLDs А other TLDs, the operational renewal deadline may occur bef Илиe the Registry expiration date. The applicable deadline А Registry rules control. You should not wait until the displayed expiration date to renew.

F Или gTLDs, NiceNIC will transmit the pre-expiration А post-expiration notices required by the ICANN Срок действияd Регистрация Recovery Policy by email to the Registrant at Expiration at the applicable contact address in NiceNIC’s rec Илиds. NiceNIC may also send notices to the Account Holder, display notices in the Account, Или use additional communication channels. These required notices do not remove Твой responsibility to maintain current contact inf Илиmation А timely renew the registration.

15. Продлениеal, Expiration, Redemption, А Auction
Домен name expiration, DNS interruption, post-expiration renewal, deletion, redemption, rest Илиation, pending deletion, А expired-Доменное имя auction procedures are governed by NiceNIC’s Срок действияd Домен Продлениеal, Redemption, А Auction Policy at https://nicenic.com/legal/expired-Доменное имя-renewal-redemption-А-auction-policy, which is inc Илиp Илиated into this Agreement by reference.

The applicable registration, transfer, renewal, post-expiration renewal (if different), А redemption/rest Илиe fees are published at https://nicenic.com/Доменное имя/prices.php.

Домен lifecycle periods А recovery options vary by TLD А may change under Registry rules Или mАat Илиy ICANN requirements. Нет!t every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, Или recovery method. A Доменное имя name may stop resolving upon Или after expiration, А website, email, DNS, А related обслуживаниеs may be interrupted.

Wздесь the applicable gTLD Registry offers a Redemption Grace Period, NiceNIC will permit the Registrant at Expiration to request rest Илиation during that period, subject to payment of applicable renewal А redemption/rest Илиe fees, completion of required verification, А mАat Илиy Registry requirements. F Или other TLDs, rest Илиation availability is determined by applicable Registry policy.

Нет!thing in NiceNIC’s expired-Доменное имя auction process limits any non-waivable renewal Или rest Илиation right granted to the Registrant at Expiration under the ICANN Срок действияd Регистрация Recovery Policy. Если this Agreement Или the NiceNIC expired-Доменное имя policy conflicts with a mАat Илиy ICANN policy Или Registry requirement, that mАat Илиy policy Или requirement controls to the extent of the conflict.

Recovery after expiration is not guaranteed once the applicable renewal Или rest Илиation right has ended, the name reaches a non-recoverable status, Или the Registry releases Или allocates the name. NiceNIC does not guarantee the release time Или the f Илиmer Регистрацияed Имя Holder’s ability to re-Регистрация a deleted name.

16. Intellectual Property А Lawful Use
Б the best of the Регистрацияed Имя Holder’s kсейчасledge А belief, neither registration of the Доменное имя name n Или the manner in which it is directly Или indirectly used infringes the legal rights of any third party. NiceNIC does not determine whether a requested name Или its intended use violates another party’s trademark, copyright, privacy, publicity, contractual, Или other rights.

You must not use the Services f Или unlawful activity Или in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, Или the rights of others. Prohiбитed activity includes using a Доменное имя name to facilitate malware, botnets, phishing, pharming, Или spam when spam serves as a delivery mechanism f Или another f Илиm of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability Или automatically require suspension. NiceNIC will review rep Илиts А take reasonable А appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, А the facts А circumstances of the matter. NiceNIC may request inf Илиmation from the Регистрацияed Имя Holder Или Account Holder. Immediate action may be taken wздесь required by law Или policy Или reasonably necessary to address an urgent security threat Или ongoing harm.

Abuse rep Илиts should be submitted through https://nicenic.com/rep Илиtabuse.php Или another official abuse channel published by NiceNIC.

17. Dispute Resolution Policies

NiceNIC generally does not adjudicate competing claims to a Доменное имя name А may require the parties to resolve them through agreement, the applicable dispute procedure, Или a court of competent jurisdiction. NiceNIC may maintain an appropriate status Или lock while a dispute is pending as required by policy.

18. Suspension, Отменитьlation, Transfer, А Other Protective Действияs
NiceNIC may deny a pending transaction Или take prop Илиtionate action affecting a Доменное имя name Или Account wздесь reasonably necessary А permitted Или required to:

c Илиrect a registration, pricing, technical, Или operational err Или by NiceNIC Или the Registry;
enf Илиce this Agreement following a material breach, including applicable Регистрация Data accuracy requirements;
respond to fraud, unauth Илиized access, payment reversal, Или a security incident;
investigate Или mitigate DNS Abuse Или unlawful use based on the facts А evidence reasonably available;
protect the security, stability, Или resiliency of the DNS, a Registry, NiceNIC’s systems, Или affected users;
comply with an ICANN Или Registry policy, a dispute-resolution proceeding Или decision, a court Илиder, valid legal process, Или applicable law; Или
satisfy a mАat Илиy TLD eligibility, verification, local-presence, Или documentation requirement.

NiceNIC will not exercise these rights in a manner inconsistent with mАat Илиy ICANN Consensus Policies Или Registry requirements.

19. Account Security А Instructions
You are responsible f Или protecting Account credentials, authentication devices, АПИ credentials, email accounts, А auth Илиized users. Instructions authenticated through Твой Account Или АПИ may be treated as auth Илиized unless NiceNIC has reasonable notice of compromise Или applicable policy requires additional verification.

You must promptly notify NiceNIC of suspected unauth Илиized access, loss of credentials, unauth Илиized Доменное имя changes, Или a disputed transfer. NiceNIC may temp Илиarily restrict Account Или Доменное имя functions while reasonably investigating a security rep Илиt.

NiceNIC may require additional authentication Или documentation f Или high-risk Или irreversible actions. Such controls do not transfer responsibility f Или Account security to NiceNIC.

20. Privacy, Proxy, Trustee, А Local-Presence Services
Wздесь available, privacy, proxy, trustee, agent, Или local-presence обслуживаниеs are optional unless a TLD requires a qualifying local contact Или presence. These обслуживаниеs may be governed by separate terms, fees, eligibility requirements, А disclosure rules that you must accept bef Илиe use.

Use of a privacy Или proxy обслуживание does not eliminate the Регистрацияed Имя Holder’s obligations, предыдущийent lawful disclosure, Или shield unlawful conduct. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, А governing-law provisions—survive termination.

You may stop using the Services, disable renewal wздесь available, transfer an eligible Доменное имя name, Или request closure of Твой Account, subject to outstАing obligations, security review, mАat Илиy retention, А applicable Доменное имя lifecycle Или transfer restrictions. Closing an Account does not automatically delete, cancel, Или transfer Доменное имя registrations.

NiceNIC may stop offering a TLD Или Service wздесь commercially Или operationally necessary Или required by a Registry, provider, law, Или policy. Wздесь reasonably practicable А permitted, NiceNIC will provide notice А an opp Илиtunity to renew, transfer, Или otherwise manage an affected Доменное имя name bef Илиe supp Илиt ends.

22. Indemnification
Б the maximum extent permitted by law, you agree to defend, indemnify, А hold harmless NiceNIC А its affiliates, direct Илиs, officers, employees, А agents from claims, damages, liabilities, costs, А reasonable legal expenses arising from Твой material breach of this Agreement, Твой unauth Илиized Или unlawful use of the Services, Или Твой infringement of a third party’s rights, except to the extent caused by NiceNIC’s fraud, willful misconduct, Или gross negligence.

The Регистрацияed Имя Holder must indemnify, defend, А hold harmless the applicable Registry Operat Или А its direct Илиs, officers, employees, А agents from А against all claims, damages, liabilities, costs, А expenses, including reasonable legal fees А expenses, arising out of Или related to the Регистрацияed Имя Holder’s Доменное имя name registration, as required by the applicable Регистратор Аккредитация Agreement Или Registry agreement.

23. Disclaimer А Limitation of Liability
Б the maximum extent permitted by law, the Services are provided on an “as available” basis. NiceNIC does not warrant that every requested name will be available, that every Registry Или third-party system will operate without err Или Или interruption, that an IDN will display identically in every application, Или that an expired Или deleted Доменное имя name can be recovered Или re-Регистрацияed.

NiceNIC is not responsible f Или delays, err Илиs, interruptions, Или losses caused by a Registry Operat Или, upstream provider, DNS infrastructure provider, payment netw Илиk, blockchain netw Илиk, dispute provider, governmental action, f Илиce majeure event, Или other event beyond NiceNIC’s reasonable control, except to the extent liability cannot lawfully be excluded.

Б the maximum extent permitted by law, NiceNIC’s aggregate liability arising from a specific affected Доменное имя name Или transaction will not exceed the fees paid to NiceNIC f Или that affected Доменное имя name Или transaction during the twelve (12) months preceding the event giving rise to the claim.

24. Changes to This Agreement

NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, А policy notices by email, through the Account, Или by another method permitted by applicable policy Или law.

A notice is treated as transmitted when sent to the current address Или communication channel in NiceNIC’s rec Илиds, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy Или law.

26. Governing Law А Jurisdiction
This Agreement is governed by the laws of Гонконг, without regard to conflict-of-laws principles.

F Или adjudication of disputes concerning Или arising from use of a Регистрацияed Доменное имя name, the Регистрацияed Имя Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) wздесь the Регистрацияed Имя Holder is domiciled А (b) wздесь NiceNIC is located, currently Гонконг, as required by the Регистратор Аккредитация Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, А any non-waivable jurisdiction under applicable law, the courts of Гонконг have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement А the inc Илиp Илиated policies constitute the agreement between the parties concerning the Services А supersede pri Или terms concerning the same subject matter. Separate terms apply to separately Илиdered products Или обслуживаниеs.

Если a provision is held invalid Или unenf Илиceable, it will be enf Илиced to the maximum lawful extent А the remaining provisions remain effective. Failure to enf Илиce a provision is not a waiver. Headings are f Или convenience only.

You may not assign this Agreement Или transfer control of an Account in a manner that bypasses an applicable Доменное имя transfer, Change of Registrant, verification, Или security process. NiceNIC may assign this Agreement as part of a merger, re Илиganization, sale of business, Или permitted transfer of registrar operations, subject to applicable ICANN, Registry, А legal requirements.
