Registro de Nombre de Dominio Service Agreement

Impotant: Please read this Agreement carefully. It contains terms governing dominio name registration, renewal, transfer, expiration, dispute resolution, suspension, y limitation of liability.

1. Agreement y Acceptance
This Registro de Nombre de Dominio Service Agreement (the “Agreement”) is entered into between NICENIC INTERNATIONAL GROUP CO., LIMITED, a company incopoated in Hong Kong y an Acreditado por ICANN registrar (IANA ID 3765), doing business as “NiceNIC” (“NiceNIC,” “we,” “us,” o “our”), y the individual o legal entity that accepts this Agreement (“Customer,” “you,” o “tu/tus/su/sus”).
This Agreement governs tu/tus/su/sus application fo y use of dominio name registration, renewal, transfer, redemption, restoation, management, y related registrar servicios provided through nicenic.com (the “Services”).

You accept this Agreement by clicking an acceptance box, submitting an oder, registraring, transferring, renewing, redeeming, restoing, o managing a dominio name through NiceNIC, o otherwise using the Services after this Agreement becomes effective. Si you accept this Agreement fo an oganization o another person, you represent that you have authoity to bind that party.

Si you are an Account Holder, reseller, agent, o other person acting fo the Registrared Nombre Holder, you must have the Registrared Nombre Holder’s authoization, provide the Registrared Nombre Holder with this Agreement y all applicable policies, y obtain the Registrared Nombre Holder’s agreement to them. You remain responsible fo tu/tus/su/sus own acts y omissions y fo ensuring that instructions submitted through tu/tus/su/sus account are authoized.

2. Definitions
“Account” means the NiceNIC customer account through which Services are odered o managed.
“Account Holder” means the person o entity controlling the Account y responsible fo payment y account-level instructions.
“ICANN” means the Internet Copoation fo Assigned Nombres y Numbers.
“Registrared Nombre Holder” o “RNH” means the person o legal entity identified as the holder of a registrared dominio name. “Registrant” has the same meaning waquí used in an applicable policy.
“Registro Data” means data collected from a person o legal entity, o generated by NiceNIC o a Registry Operato, in connection with a dominio name registration.
“Registry Operato” o “Registry” means the operato of the registry fo the applicable top-level dominio.
“TLD” means a top-level dominio, including a generic top-level dominio (“gTLD”) o country-code top-level dominio (“ccTLD”).
3. Incopoated Policies y Order of Precedence
This Agreement incopoates by reference the policies y requirements that apply to the relevant dominio name o Service, including the following, as updated from time to time:

The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, y myatoy laws y regulations.

Si taquí is a conflict, myatoy law applies first. Fo gTLDs, applicable ICANN Consensus Policies, specifications, y the Registrador Acreditación Agreement apply to the extent required, followed by myatoy Registry requirements. TLD-specific rules y the incopoated NiceNIC policies then apply, followed by this Agreement. No provision of this Agreement is intended to reduce a non-waivable right granted by applicable law o myatoy ICANN policy.

4. Registrador y Registry Roles
NiceNIC accepts y processes dominio name applications y instructions as a registrar o, fo certain TLDs, through an authoized upstream provider. A requested registration, renewal, transfer, redemption, restoation, o other registry-level transaction is not complete until it is accepted y recoded by the applicable Registry o servicio provider.

An availability search, oder confirmation, payment authoization, invoice, o pending status does not guarantee that a dominio name has been o can be registrared, renewed, transferred, redeemed, o restoed. Registry databases y availability results may change between search y completion.

NiceNIC may reject o cancel a pending application befoe registry completion waquí the name is unavailable, reserved, prohibited, restricted, subject to an eligibility failure, affected by an evident pricing o technical erro, unsuppoted by the Registry, o inconsistent with applicable law, policy, o this Agreement. Si a registration o other transaction has already been completed, NiceNIC will not cancel o reverse it except as permitted o required by applicable policy, Registry procedure, law, legal process, o this Agreement.

5. TLD-Specific Rules, IDNs, y Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, restoation, dispute, y data requirements. You must satisfy the applicable requirements y promptly provide requested infomation o documents. Registry requirements may change during the registration term.

ccTLD are primarily governed by the applicable ccTLD Registry y local rules. ICANN gTLD policies do not necessarily apply to ccTLD. Waquí NiceNIC provides a TLD through an upstream provider, that provider’s myatoy terms may also apply.

Internationalized Nombres de Dominio (“IDNs”) depend on Registry-suppoted scripts, language tables, label-generation rules, browser suppot, y DNS styards. Display o functionality may vary among applications. The ASCII-compatible encoded fom recoded by the Registry controls waquí required by the DNS o Registry system.

Si eligibility, validation, o documentation requirements are not satisfied, the application may be rejected o the dominio name may be suspended, locked, deleted, not renewed, o otherwise restricted as required by the applicable Registry o policy.

6. Premium Dominios, Pre-Registro, Sunrise, y Launch Phases
A Premium Dominio may have non-styard registration, transfer, renewal, o restoation pricing established by the Registry o a third-party seller. The price shown y accepted fo the specific transaction controls, subject to corection of a clear pricing o technical erro befoe completion.

Pre-registration, Sunrise, Lyrush, Early Access, y similar launch-phase applications do not guarantee allocation. Competing applications, auctions, rights-validation requirements, Registry decisions, o launch rules may affect the result. Any non-refundable application, validation, o auction fee will be disclosed befoe payment to the extent available to NiceNIC.

7. Registrared Nombre Holder, Account Holder, y Revendedor Responsibilities
The Registrared Nombre Holder is the holder of recod y is responsible fo the registration y use of the dominio name. The Account Holder may manage the dominio name only to the extent authoized by the Registrared Nombre Holder y applicable policy.

Si the Account Holder y Registrared Nombre Holder are different, the Account Holder must accurately identify the Registrared Nombre Holder y must not substitute its own infomation without authoization. NiceNIC may require reasonable evidence of authoity befoe acting on material instructions, including a transfer, Change of Registrant, disclosure, deletion, o account move.

A reseller o agent using NiceNIC Services fo third parties must:

obtain y retain the Registrared Nombre Holder’s acceptance of this Agreement y applicable policies;
provide accurate infomation concerning NiceNIC’s identity as the sponsoing registrar waquí required;
display applicable registration, renewal, post-expiration renewal, y redemption/restoe fees y describe expiration-notice methods as required by ICANN policy;
provide required notices y promptly transmit communications between NiceNIC y the Registrared Nombre Holder; y
not make representations inconsistent with this Agreement, applicable ICANN policies, o Registry requirements.

8. Registro Data y Accuracy
The Registrared Nombre Holder must provide accurate y reliable Registro Data y must corect y update it within seven (7) days after any change. Required data may include the Registrared Nombre Holder’s full name, postal address, email address, voice telephone number, fax number if available, y the name of an authoized contact person waquí the Registrared Nombre Holder is an oganization, association, o copoation, together with other data required by applicable policy o Registry rules.

State/province y postal code are required waquí applicable fo the relevant country o territoy. Agregaritional data may be required fo a particular TLD. Waquí the Registrared Nombre Holder supplies a value fo Registrant Organization, that oganization may be treated as the Registrared Nombre Holder y may be published waquí the Registrared Nombre Holder agrees y applicable policy requires o permits publication.

NiceNIC will validate y verify Registro Data as required by the applicable Registrador Acreditación Agreement, ICANN policy, Registry requirements, y law. You must complete applicable email, telephone, documentation, o other verification steps y respond to accuracy inquiries.

The Registrared Nombre Holder’s willful provision of inaccurate o unreliable infomation, willful failure to update infomation within seven (7) days after a change, o failure to respond fo moe than fifteen (15) calendar days to an inquiry from NiceNIC concerning the accuracy of datos de contacto associated with the registration constitutes a material breach y is a basis fo suspension y/o cancellation of the registration, subject to applicable policy.

En least annually, NiceNIC will present the Registrared Nombre Holder with the current Registro Data as required by the Registro Data Reminder Policy. The Registrared Nombre Holder must review the data y corect any inaccurate infomation.

9. Licensed Use y Third-Party Data
A Registrared Nombre Holder that licenses use of a dominio name to a third party remains the Registrared Nombre Holder of recod y remains responsible fo providing its own full contact infomation y accurate technical y administrative contact infomation adequate to facilitate timely resolution of problems connected with the dominio name.

The Registrared Nombre Holder accepts liability fo harm caused by wrongful use of the dominio name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact infomation provided by the licensee y the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

Si you provide Personal Data concerning another person, you represent that you have provided that person with legally sufficient notice of the processing described in this Agreement y the Política de Privacidad y have obtained any consent o other authoization required by applicable law.

10. Registro Data Processing y Privacy
NiceNIC collects y processes Registro Data fo purposes that include providing y securing the Services; processing registration y lifecycle transactions; maintaining recods; validating y verifying data; communicating with Account Holders y Registrared Nombre Holders; anteriorenting fraud y DNS Abuse; complying with ICANN, Registry, escrow, legal, tax, accounting, y dispute-resolution requirements; y hyling lawful disclosure requests.

Recipients o categoies of recipients may include the applicable Registry Operato, registry servicio providers, ICANN, an ICANN-approved data escrow agent, dispute-resolution providers, upstream providers, payment y security providers, professional advisers, y governmental o judicial authoities waquí disclosure is required o permitted. Obligatoy y optional data, publication rules, retention, access, corection, y other processing details are described in the NiceNIC Política de Privacidad y applicable Registro Data Policy.

You ackahoraledge this processing y, waquí consent is the applicable legal basis, consent to it as described in the Política de Privacidad. NiceNIC will not process Personal Data in a manner incompatible with the purposes y limitations of which it has provided notice y will take reasonable precautions to protect Personal Data from loss, misuse, unauthoized access o disclosure, alteration, o destruction.

Public RDDS results may contain public, redacted, o pseudonymized data, o a communication mechanism, as required o permitted by applicable policy y law. Submission of Registro Data does not mean that all data will be publicly displayed. Requests fo non-public data are assessed under applicable policy y law y do not guarantee disclosure.

NiceNIC does not claim ownership of tu/tus/su/sus Personal Data. NiceNIC y applicable Registry Operatos may hold rights in their databases, compilations, transaction recods, generated data, y servicio recods as permitted by contract y law.

11. Transferencias de Dominio y Change of Registrant
Inter-registrar transfers of gTLD registrations are governed by the current ICANN Transfer Policy. The Registrared Nombre Holder is the party authoized to approve o deny a transfer request, subject to the authentication y procedural requirements of that Policy.

You expressly consent to NiceNIC applying the clientTransferProhibited status upon initial registration as a styard security measure, waquí suppoted y permitted. NiceNIC may also apply o maintain a transfer restriction at the Registrared Nombre Holder’s request, during an applicable initial-registration, post-transfer, o Change of Registrant lock period, o waquí required by ICANN policy, Registry policy, a dispute proceeding, court oder, o applicable law.

Waquí self-servicio removal is available, the Registrared Nombre Holder may remove an eligible transfer lock through the Account. Otherwise, NiceNIC will provide a reasonably accessible method to request removal y will remove clientTransferProhibited o provide the AuthInfo code within the period required by the applicable Transfer Policy, provided no policy-based restriction applies y reasonable authentication is completed.

NiceNIC may deny o must deny a gTLD transfer only on grounds permitted o required by the current ICANN Transfer Policy. When NiceNIC denies a transfer request, it will provide the reason fo denial to the Registrared Nombre Holder y the potential Gaining Registrador as required by that Policy.

A Change of Registrant may be subject to confirmation, verification, y an inter-registrar transfer lock under the ICANN Transfer Policy. Si NiceNIC offers an opt-out from an optional Change of Registrant lock, the opt-out must be selected befoe completion of the change. TLD-specific transfer y registrant-change rules may differ.

12. Fees, Taxes, y Pagarment
Current registration, transfer, renewal, post-expiration renewal (if different), y redemption/restoe fees are published on the NiceNIC Precios de Dominios page at https://nicenic.com/dominio/prices.php. This link y the fees displayed taquí are incopoated into this Agreement by reference.

Fees may vary by TLD, Registry classification, premium status, registration term, account o reseller level, currency, tax, transaction type, y lifecycle status. Optional servicios y any additional myatoy charges will be disclosed befoe the relevant oder is submitted to the extent kahoran to NiceNIC.

The price presented fo acceptance at checkout o at the time an API transaction is submitted is the applicable price fo that transaction, subject to corection of a clear pricing o system erro befoe registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, servicio arrangements, o commercial terms change. Renovaral y auto-renewal transactions use the applicable price at the time of processing.

Services are generally prepaid. You authoize NiceNIC to charge the selected payment method o deduct the applicable amount from tu/tus/su/sus Account balance. You are responsible fo taxes, payment-provider charges, blockchain netwok charges, currency-conversion costs, y other charges not expressly included in the displayed NiceNIC price.

Pagarment does not complete a registry transaction. Si a submitted transaction cannot be completed, any credit o refund will be hyled accoding to the transaction status, payment method, applicable law, y NiceNIC’s published payment o refund terms. Cryptocurrency y blockchain transactions are irreversible, y NiceNIC does not reimburse exchange-rate changes o third-party netwok fees.

13. Refunds y Reversals
Fees fo a successfully completed registration, renewal, transfer, redemption, restoation, premium-dominio acquisition, o other completed registry transaction are non-refundable except waquí required by applicable law o expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, o failure of final settlement may result in suspension of the Account o affected Services y reasonable recovery action, subject to applicable law y ICANN o Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohibited by the ICANN Transfer Policy.

14. Renovaral y Auto-Renovaral
A dominio name is registrared fo a limited term y expires unless renewed. The Registrared Nombre Holder y Account Holder are responsible fo monitoing expiration dates, maintaining accurate contact y payment infomation, y submitting payment early enough fo processing befoe the applicable deadline.

Waquí auto-renewal is offered y enabled, it is subject to sufficient Account balance o valid payment, Registry availability, applicable renewal deadlines, verification o eligibility requirements, y successful processing. NiceNIC does not guarantee auto-renewal waquí these conditions are not satisfied. You may disable auto-renewal befoe processing, subject to the controls available in tu/tus/su/sus Account.

Fo certain ccTLD y other TLDs, the operational renewal deadline may occur befoe the Registry expiration date. The applicable deadline y Registry rules control. You should not wait until the displayed expiration date to renew.

Fo gTLDs, NiceNIC will transmit the pre-expiration y post-expiration notices required by the ICANN Expirard Registro Recovery Policy by email to the Registrant at Expiration at the applicable contact address in NiceNIC’s recods. NiceNIC may also send notices to the Account Holder, display notices in the Account, o use additional communication channels. These required notices do not remove tu/tus/su/sus responsibility to maintain current contact infomation y timely renew the registration.

15. Renovaral, Expiration, Redemption, y Auction
Dominio name expiration, DNS interruption, post-expiration renewal, deletion, redemption, restoation, pending deletion, y expired-dominio auction procedures are governed by NiceNIC’s Expirard Dominio Renovaral, Redemption, y Auction Policy at https://nicenic.com/legal/expired-dominio-renewal-redemption-y-auction-policy, which is incopoated into this Agreement by reference.

The applicable registration, transfer, renewal, post-expiration renewal (if different), y redemption/restoe fees are published at https://nicenic.com/dominio/prices.php.

Dominio lifecycle periods y recovery options vary by TLD y may change under Registry rules o myatoy ICANN requirements. Not every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, o recovery method. A dominio name may stop resolving upon o after expiration, y website, email, DNS, y related servicios may be interrupted.

Waquí the applicable gTLD Registry offers a Redemption Grace Period, NiceNIC will permit the Registrant at Expiration to request restoation during that period, subject to payment of applicable renewal y redemption/restoe fees, completion of required verification, y myatoy Registry requirements. Fo other TLDs, restoation availability is determined by applicable Registry policy.

Nothing in NiceNIC’s expired-dominio auction process limits any non-waivable renewal o restoation right granted to the Registrant at Expiration under the ICANN Expirard Registro Recovery Policy. Si this Agreement o the NiceNIC expired-dominio policy conflicts with a myatoy ICANN policy o Registry requirement, that myatoy policy o requirement controls to the extent of the conflict.

Recovery after expiration is not guaranteed once the applicable renewal o restoation right has ended, the name reaches a non-recoverable status, o the Registry releases o allocates the name. NiceNIC does not guarantee the release time o the fomer Registrared Nombre Holder’s ability to re-registrar a deleted name.

16. Intellectual Property y Lawful Use
Para the best of the Registrared Nombre Holder’s kahoraledge y belief, neither registration of the dominio name no the manner in which it is directly o indirectly used infringes the legal rights of any third party. NiceNIC does not determine whether a requested name o its intended use violates another party’s trademark, copyright, privacy, publicity, contractual, o other rights.

You must not use the Services fo unlawful activity o in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, o the rights of others. Prohibited activity includes using a dominio name to facilitate malware, botnets, phishing, pharming, o spam when spam serves as a delivery mechanism fo another fom of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability o automatically require suspension. NiceNIC will review repots y take reasonable y appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, y the facts y circumstances of the matter. NiceNIC may request infomation from the Registrared Nombre Holder o Account Holder. Immediate action may be taken waquí required by law o policy o reasonably necessary to address an urgent security threat o ongoing harm.

Abuse repots should be submitted through https://nicenic.com/repotabuse.php o another official abuse channel published by NiceNIC.

17. Dispute Resolution Policies
Todos applicable dominio name dispute policies are incopoated into this Agreement. gTLD registrations are subject to the UDRP y, waquí applicable, the URS, Transfer Dispute Resolution Policy, y other ICANN o Registry dispute procedures. ccTLD y sponsoed o restricted TLDs may have different dispute policies.

The Registrared Nombre Holder agrees that a registration may be locked, suspended, cancelled, transferred, o otherwise affected in accodance with an applicable dispute policy, final administrative decision, settlement, court oder, o Registry procedure.

NiceNIC generally does not adjudicate competing claims to a dominio name y may require the parties to resolve them through agreement, the applicable dispute procedure, o a court of competent jurisdiction. NiceNIC may maintain an appropriate status o lock while a dispute is pending as required by policy.

18. Suspension, Cancelarlation, Transfer, y Other Protective Accións
NiceNIC may deny a pending transaction o take propotionate action affecting a dominio name o Account waquí reasonably necessary y permitted o required to:

corect a registration, pricing, technical, o operational erro by NiceNIC o the Registry;
enfoce this Agreement following a material breach, including applicable Registro Data accuracy requirements;
respond to fraud, unauthoized access, payment reversal, o a security incident;
investigate o mitigate DNS Abuse o unlawful use based on the facts y evidence reasonably available;
protect the security, stability, o resiliency of the DNS, a Registry, NiceNIC’s systems, o affected users;
comply with an ICANN o Registry policy, a dispute-resolution proceeding o decision, a court oder, valid legal process, o applicable law; o
satisfy a myatoy TLD eligibility, verification, local-presence, o documentation requirement.
Disponible actions may include requesting infomation o remediation, restricting Account functions, applying a permissible lock, suspending resolution through clientHold, denying a transaction, cancelling a Service, deleting a registration, o transferring a dominio name when expressly authoized o required by policy o legal process.

Waquí appropriate, legally permitted, y consistent with the urgency y nature of the issue, NiceNIC will provide notice o an oppotunity to respond o remedy. NiceNIC may act without advance notice when immediate action is required by law, policy, a Registry, a dispute provider, o a court, o is reasonably necessary to anteriorent material harm, preserve evidence, o protect security. NiceNIC will not exercise these rights in a manner inconsistent with myatoy ICANN Consensus Policies o Registry requirements.

19. Account Security y Instructions
You are responsible fo protecting Account credentials, authentication devices, API credentials, email accounts, y authoized users. Instructions authenticated through tu/tus/su/sus Account o API may be treated as authoized unless NiceNIC has reasonable notice of compromise o applicable policy requires additional verification.

You must promptly notify NiceNIC of suspected unauthoized access, loss of credentials, unauthoized dominio changes, o a disputed transfer. NiceNIC may tempoarily restrict Account o dominio functions while reasonably investigating a security repot.

NiceNIC may require additional authentication o documentation fo high-risk o irreversible actions. Such controls do not transfer responsibility fo Account security to NiceNIC.

20. Privacy, Proxy, Trustee, y Local-Presence Services
Waquí available, privacy, proxy, trustee, agent, o local-presence servicios are optional unless a TLD requires a qualifying local contact o presence. These servicios may be governed by separate terms, fees, eligibility requirements, y disclosure rules that you must accept befoe use.

Use of a privacy o proxy servicio does not eliminate the Registrared Nombre Holder’s obligations, anteriorent lawful disclosure, o shield unlawful conduct. A servicio may be suspended o terminated, o underlying data may be disclosed, waquí permitted o required by the applicable servicio terms, ICANN policy, Registry requirements, law, o valid legal process.

Plazoination of an ancillary servicio may require replacement contact infomation, verification, o other updates befoe a transfer o registrant change can be completed. Fees fo a partially used ancillary-servicio term are non-refundable unless otherwise stated o required by law.

21. Plazo y Plazoination
This Agreement begins when accepted y remains applicable while you use the Services o a dominio name remains sponsoed o managed through NiceNIC. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, y governing-law provisions—survive termination.

You may stop using the Services, disable renewal waquí available, transfer an eligible dominio name, o request closure of tu/tus/su/sus Account, subject to outstying obligations, security review, myatoy retention, y applicable dominio lifecycle o transfer restrictions. Closing an Account does not automatically delete, cancel, o transfer dominio registrations.

NiceNIC may stop offering a TLD o Service waquí commercially o operationally necessary o required by a Registry, provider, law, o policy. Waquí reasonably practicable y permitted, NiceNIC will provide notice y an oppotunity to renew, transfer, o otherwise manage an affected dominio name befoe suppot ends.

22. Indemnification
Para the maximum extent permitted by law, you agree to defend, indemnify, y hold harmless NiceNIC y its affiliates, directos, officers, employees, y agents from claims, damages, liabilities, costs, y reasonable legal expenses arising from tu/tus/su/sus material breach of this Agreement, tu/tus/su/sus unauthoized o unlawful use of the Services, o tu/tus/su/sus infringement of a third party’s rights, except to the extent caused by NiceNIC’s fraud, willful misconduct, o gross negligence.

The Registrared Nombre Holder must indemnify, defend, y hold harmless the applicable Registry Operato y its directos, officers, employees, y agents from y against all claims, damages, liabilities, costs, y expenses, including reasonable legal fees y expenses, arising out of o related to the Registrared Nombre Holder’s dominio name registration, as required by the applicable Registrador Acreditación Agreement o Registry agreement.

23. Disclaimer y Limitation of Liability
Para the maximum extent permitted by law, the Services are provided on an “as available” basis. NiceNIC does not warrant that every requested name will be available, that every Registry o third-party system will operate without erro o interruption, that an IDN will display identically in every application, o that an expired o deleted dominio name can be recovered o re-registrared.

NiceNIC is not responsible fo delays, erros, interruptions, o losses caused by a Registry Operato, upstream provider, DNS infrastructure provider, payment netwok, blockchain netwok, dispute provider, governmental action, foce majeure event, o other event beyond NiceNIC’s reasonable control, except to the extent liability cannot lawfully be excluded.

Para the maximum extent permitted by law, neither party is liable to the other fo indirect, incidental, special, punitive, o consequential damages, loss of profit, loss of anticipated savings, loss of business oppotunity, o loss of goodwill arising from the Services, even if advised that such damage may occur.

Para the maximum extent permitted by law, NiceNIC’s aggregate liability arising from a specific affected dominio name o transaction will not exceed the fees paid to NiceNIC fo that affected dominio name o transaction during the twelve (12) months preceding the event giving rise to the claim.

Nothing in this Agreement excludes o limits liability fo fraud, willful misconduct, gross negligence, death o personal injury caused by negligence waquí such liability cannot be excluded, o any other liability o consumer right that cannot be excluded o limited under applicable law.

24. Changes to This Agreement
NiceNIC may update this Agreement to reflect changes in ICANN o Registry policies, law, security requirements, operational processes, servicios, o commercial terms. The current version y its effective date will be published through the NiceNIC Legal page.

Waquí required by applicable law, the Registrador Acreditación Agreement, o ICANN policy, NiceNIC will provide notice of a material change using the contact infomation in its recods o another permitted method. Changes myated by law, ICANN, o a Registry may take effect when required. Other changes take effect on the published effective date. Continued use of the Services after that date constitutes acceptance to the extent permitted by law.

25. Notices y Communications
You must maintain a monitoed y accurate email address fo the Account y the Registrared Nombre Holder. NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, y policy notices by email, through the Account, o by another method permitted by applicable policy o law.

A notice is treated as transmitted when sent to the current address o communication channel in NiceNIC’s recods, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy o law.

26. Governing Law y Jurisdiction
This Agreement is governed by the laws of Hong Kong, without regard to conflict-of-laws principles.

Fo adjudication of disputes concerning o arising from use of a registrared dominio name, the Registrared Nombre Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) waquí the Registrared Nombre Holder is domiciled y (b) waquí NiceNIC is located, currently Hong Kong, as required by the Registrador Acreditación Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, y any non-waivable jurisdiction under applicable law, the courts of Hong Kong have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement y the incopoated policies constitute the agreement between the parties concerning the Services y supersede prio terms concerning the same subject matter. Separate terms apply to separately odered products o servicios.

Si a provision is held invalid o unenfoceable, it will be enfoced to the maximum lawful extent y the remaining provisions remain effective. Failure to enfoce a provision is not a waiver. Headings are fo convenience only.

You may not assign this Agreement o transfer control of an Account in a manner that bypasses an applicable dominio transfer, Change of Registrant, verification, o security process. NiceNIC may assign this Agreement as part of a merger, reoganization, sale of business, o permitted transfer of registrar operations, subject to applicable ICANN, Registry, y legal requirements.

The English-language version controls. A translation is provided fo convenience only unless myatoy law requires otherwise.
