Impartant: Please read this Agreement carefully. It contains terms governing domenas name registration, renewal, transfer, expiration, dispute resolution, suspension, ir limitation of liability.

1. Agreement ir Acceptance
This Domeno vardo registracija Service Agreement (the “Agreement”) is entered into between NICENIC INTERNATIONAL GROUP CO., LIMITED, a company incarparated in Honkongas ir an ICANN akredituotas registrar (IANA ID 3765), doing business as “NiceNIC” (“NiceNIC,” “we,” “us,” ar “our”), ir the individual ar legal entity that accepts this Agreement (“Customer,” “you,” ar “jūsų”).
This Agreement governs jūsų application far ir use of domenas name registration, renewal, transfer, redemption, restaration, management, ir related registrar paslaugas provided through nicenic.com (the “Services”).

You accept this Agreement by clicking an acceptance box, submitting an arder, registruotiing, transferring, renewing, redeeming, restaring, ar managing a domenas name through NiceNIC, ar otherwise using the Services after this Agreement becomes effective. Jei you accept this Agreement far an arganization ar another person, you represent that you have autharity to bind that party.

Jei you are an Account Holder, reseller, agent, ar other person acting far the Registruotised Vardas Holder, you must have the Registruotised Vardas Holder’s autharization, provide the Registruotised Vardas Holder with this Agreement ir all applicable policies, ir obtain the Registruotised Vardas Holder’s agreement to them. You remain responsible far jūsų own acts ir omissions ir far ensuring that instructions submitted through jūsų account are autharized.

2. Definitions
“Account” means the NiceNIC customer account through which Services are ardered ar managed.
“Account Holder” means the person ar entity controlling the Account ir responsible far payment ir account-level instructions.
“ICANN” means the Internet Carparation far Assigned Vardass ir Numbers.
“Registruotised Vardas Holder” ar “RNH” means the person ar legal entity identified as the holder of a registruotied domenas name. “Registrant” has the same meaning wčia used in an applicable policy.
“Registracija Data” means data collected from a person ar legal entity, ar generated by NiceNIC ar a Registry Operatar, in connection with a domenas name registration.
“Registry Operatar” ar “Registry” means the operatar of the registry far the applicable top-level domenas.
“TLD” means a top-level domenas, including a generic top-level domenas (“gTLD”) ar country-code top-level domenas (“ccTLD”).
3. Incarparated Policies ir Order of Precedence
This Agreement incarparates by reference the policies ir requirements that apply to the relevant domenas name ar Service, including the following, as updated from time to time:

The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, ir miratary laws ir regulations.

Jei tčia is a conflict, miratary law applies first. Far gTLDs, applicable ICANN Consensus Policies, specifications, ir the Registratorius Akreditacija Agreement apply to the extent required, followed by miratary Registry requirements. TLD-specific rules ir the incarparated NiceNIC policies then apply, followed by this Agreement. Ne provision of this Agreement is intended to reduce a non-waivable right granted by applicable law ar miratary ICANN policy.

4. Registratorius ir Registry Roles
NiceNIC accepts ir processes domenas name applications ir instructions as a registrar ar, far certain TLDs, through an autharized upstream provider. A requested registration, renewal, transfer, redemption, restaration, ar other registry-level transaction is not complete until it is accepted ir recarded by the applicable Registry ar paslauga provider.

An availability search, arder confirmation, payment autharization, invoice, ar pending status does not guarantee that a domenas name has been ar can be registruotied, renewed, transferred, redeemed, ar restared. Registry databases ir availability results may change between search ir completion.

NiceNIC may reject ar cancel a pending application befare registry completion wčia the name is unavailable, reserved, prohibitased, restricted, subject to an eligibility failure, affected by an evident pricing ar technical errar, unsupparted by the Registry, ar inconsistent with applicable law, policy, ar this Agreement. Jei a registration ar other transaction has already been completed, NiceNIC will not cancel ar reverse it except as permitted ar required by applicable policy, Registry procedure, law, legal process, ar this Agreement.

5. TLD-Specific Rules, IDNs, ir Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, restaration, dispute, ir data requirements. You must satisfy the applicable requirements ir promptly provide requested infarmation ar documents. Registry requirements may change during the registration term.

Šalies domenai (ccTLD) are primarily governed by the applicable ccTLD Registry ir local rules. ICANN gTLD policies do not necessarily apply to Šalies domenai (ccTLD). Wčia NiceNIC provides a TLD through an upstream provider, that provider’s miratary terms may also apply.

Internationalized Domenų vardai (“IDNs”) depend on Registry-supparted scripts, language tables, label-generation rules, browser suppart, ir DNS stirards. Display ar functionality may vary among applications. The ASCII-compatible encoded farm recarded by the Registry controls wčia required by the DNS ar Registry system.

Jei eligibility, validation, ar documentation requirements are not satisfied, the application may be rejected ar the domenas name may be suspended, locked, deleted, not renewed, ar otherwise restricted as required by the applicable Registry ar policy.

6. Premium Domenai, Pre-Registracija, Sunrise, ir Launch Phases
A Premium Domenas may have non-stirard registration, transfer, renewal, ar restaration pricing established by the Registry ar a third-party seller. The price shown ir accepted far the specific transaction controls, subject to carrection of a clear pricing ar technical errar befare completion.

Pre-registration, Sunrise, Lirrush, Early Access, ir similar launch-phase applications do not guarantee allocation. Competing applications, auctions, rights-validation requirements, Registry decisions, ar launch rules may affect the result. Any non-refundable application, validation, ar auction fee will be disclosed befare payment to the extent available to NiceNIC.

7. Registruotised Vardas Holder, Account Holder, ir Platintojas Responsibilities
The Registruotised Vardas Holder is the holder of recard ir is responsible far the registration ir use of the domenas name. The Account Holder may manage the domenas name only to the extent autharized by the Registruotised Vardas Holder ir applicable policy.

Jei the Account Holder ir Registruotised Vardas Holder are different, the Account Holder must accurately identify the Registruotised Vardas Holder ir must not substitute its own infarmation without autharization. NiceNIC may require reasonable evidence of autharity befare acting on material instructions, including a transfer, Change of Registrant, disclosure, deletion, ar account move.

A reseller ar agent using NiceNIC Services far third parties must:

obtain ir retain the Registruotised Vardas Holder’s acceptance of this Agreement ir applicable policies;
provide accurate infarmation concerning NiceNIC’s identity as the sponsaring registrar wčia required;
display applicable registration, renewal, post-expiration renewal, ir redemption/restare fees ir describe expiration-notice methods as required by ICANN policy;
provide required notices ir promptly transmit communications between NiceNIC ir the Registruotised Vardas Holder; ir
not make representations inconsistent with this Agreement, applicable ICANN policies, ar Registry requirements.

8. Registracija Data ir Accuracy
The Registruotised Vardas Holder must provide accurate ir reliable Registracija Data ir must carrect ir update it within seven (7) days after any change. Required data may include the Registruotised Vardas Holder’s full name, postal address, email address, voice telephone number, fax number if available, ir the name of an autharized contact person wčia the Registruotised Vardas Holder is an arganization, association, ar carparation, together with other data required by applicable policy ar Registry rules.

State/province ir postal code are required wčia applicable far the relevant country ar territary. Pridėtiitional data may be required far a particular TLD. Wčia the Registruotised Vardas Holder supplies a value far Registrant Organization, that arganization may be treated as the Registruotised Vardas Holder ir may be published wčia the Registruotised Vardas Holder agrees ir applicable policy requires ar permits publication.

NiceNIC will validate ir verify Registracija Data as required by the applicable Registratorius Akreditacija Agreement, ICANN policy, Registry requirements, ir law. You must complete applicable email, telephone, documentation, ar other verification steps ir respond to accuracy inquiries.

The Registruotised Vardas Holder’s willful provision of inaccurate ar unreliable infarmation, willful failure to update infarmation within seven (7) days after a change, ar failure to respond far mare than fifteen (15) calendar days to an inquiry from NiceNIC concerning the accuracy of kontaktinė informacija associated with the registration constitutes a material breach ir is a basis far suspension ir/ar cancellation of the registration, subject to applicable policy.

Pas least annually, NiceNIC will present the Registruotised Vardas Holder with the current Registracija Data as required by the Registracija Data Reminder Policy. The Registruotised Vardas Holder must review the data ir carrect any inaccurate infarmation.

9. Licensed Use ir Third-Party Data
A Registruotised Vardas Holder that licenses use of a domenas name to a third party remains the Registruotised Vardas Holder of recard ir remains responsible far providing its own full contact infarmation ir accurate technical ir administrative contact infarmation adequate to facilitate timely resolution of problems connected with the domenas name.

The Registruotised Vardas Holder accepts liability far harm caused by wrongful use of the domenas name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact infarmation provided by the licensee ir the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

Jei you provide Personal Data concerning another person, you represent that you have provided that person with legally sufficient notice of the processing described in this Agreement ir the Privatumo politika ir have obtained any consent ar other autharization required by applicable law.

10. Registracija Data Processing ir Privacy
NiceNIC collects ir processes Registracija Data far purposes that include providing ir securing the Services; processing registration ir lifecycle transactions; maintaining recards; validating ir verifying data; communicating with Account Holders ir Registruotised Vardas Holders; atgalenting fraud ir DNS Abuse; complying with ICANN, Registry, escrow, legal, tax, accounting, ir dispute-resolution requirements; ir hirling lawful disclosure requests.

Recipients ar categaries of recipients may include the applicable Registry Operatar, registry paslauga providers, ICANN, an ICANN-approved data escrow agent, dispute-resolution providers, upstream providers, payment ir security providers, professional advisers, ir governmental ar judicial autharities wčia disclosure is required ar permitted. Obligatary ir optional data, publication rules, retention, access, carrection, ir other processing details are described in the NiceNIC Privatumo politika ir applicable Registracija Data Policy.

You ackdabarledge this processing ir, wčia consent is the applicable legal basis, consent to it as described in the Privatumo politika. NiceNIC will not process Personal Data in a manner incompatible with the purposes ir limitations of which it has provided notice ir will take reasonable precautions to protect Personal Data from loss, misuse, unautharized access ar disclosure, alteration, ar destruction.

Public RDDS results may contain public, redacted, ar pseudonymized data, ar a communication mechanism, as required ar permitted by applicable policy ir law. Submission of Registracija Data does not mean that all data will be publicly displayed. Requests far non-public data are assessed under applicable policy ir law ir do not guarantee disclosure.

NiceNIC does not claim ownership of jūsų Personal Data. NiceNIC ir applicable Registry Operatars may hold rights in their databases, compilations, transaction recards, generated data, ir paslauga recards as permitted by contract ir law.

11. Domenų pervedimai ir Change of Registrant
Inter-registrar transfers of gTLD registrations are governed by the current ICANN Transfer Policy. The Registruotised Vardas Holder is the party autharized to approve ar deny a transfer request, subject to the authentication ir procedural requirements of that Policy.

You expressly consent to NiceNIC applying the clientTransferProhibitased status upon initial registration as a stirard security measure, wčia supparted ir permitted. NiceNIC may also apply ar maintain a transfer restriction at the Registruotised Vardas Holder’s request, during an applicable initial-registration, post-transfer, ar Change of Registrant lock period, ar wčia required by ICANN policy, Registry policy, a dispute proceeding, court arder, ar applicable law.

Wčia self-paslauga removal is available, the Registruotised Vardas Holder may remove an eligible transfer lock through the Account. Otherwise, NiceNIC will provide a reasonably accessible method to request removal ir will remove clientTransferProhibitased ar provide the AuthInfo code within the period required by the applicable Transfer Policy, provided no policy-based restriction applies ir reasonable authentication is completed.

NiceNIC may deny ar must deny a gTLD transfer only on grounds permitted ar required by the current ICANN Transfer Policy. When NiceNIC denies a transfer request, it will provide the reason far denial to the Registruotised Vardas Holder ir the potential Gaining Registratorius as required by that Policy.

A Change of Registrant may be subject to confirmation, verification, ir an inter-registrar transfer lock under the ICANN Transfer Policy. Jei NiceNIC offers an opt-out from an optional Change of Registrant lock, the opt-out must be selected befare completion of the change. TLD-specific transfer ir registrant-change rules may differ.

12. Fees, Taxes, ir Mokėtiment
Current registration, transfer, renewal, post-expiration renewal (if different), ir redemption/restare fees are published on the NiceNIC Domenų kainos page at https://nicenic.com/domenas/prices.php. This link ir the fees displayed tčia are incarparated into this Agreement by reference.

Fees may vary by TLD, Registry classification, premium status, registration term, account ar reseller level, currency, tax, transaction type, ir lifecycle status. Optional paslaugas ir any additional miratary charges will be disclosed befare the relevant arder is submitted to the extent kdabarn to NiceNIC.

The price presented far acceptance at checkout ar at the time an API transaction is submitted is the applicable price far that transaction, subject to carrection of a clear pricing ar system errar befare registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, paslauga arrangements, ar commercial terms change. Atnaujintial ir auto-renewal transactions use the applicable price at the time of processing.

Services are generally prepaid. You autharize NiceNIC to charge the selected payment method ar deduct the applicable amount from jūsų Account balance. You are responsible far taxes, payment-provider charges, blockchain netwark charges, currency-conversion costs, ir other charges not expressly included in the displayed NiceNIC price.

Mokėtiment does not complete a registry transaction. Jei a submitted transaction cannot be completed, any credit ar refund will be hirled accarding to the transaction status, payment method, applicable law, ir NiceNIC’s published payment ar refund terms. Cryptocurrency ir blockchain transactions are irreversible, ir NiceNIC does not reimburse exchange-rate changes ar third-party netwark fees.

13. Refunds ir Reversals
Fees far a successfully completed registration, renewal, transfer, redemption, restaration, premium-domenas acquisition, ar other completed registry transaction are non-refundable except wčia required by applicable law ar expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, ar failure of final settlement may result in suspension of the Account ar affected Services ir reasonable recovery action, subject to applicable law ir ICANN ar Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohibitased by the ICANN Transfer Policy.

14. Atnaujintial ir Auto-Atnaujintial
A domenas name is registruotied far a limited term ir expires unless renewed. The Registruotised Vardas Holder ir Account Holder are responsible far monitaring expiration dates, maintaining accurate contact ir payment infarmation, ir submitting payment early enough far processing befare the applicable deadline.

Wčia auto-renewal is offered ir enabled, it is subject to sufficient Account balance ar valid payment, Registry availability, applicable renewal deadlines, verification ar eligibility requirements, ir successful processing. NiceNIC does not guarantee auto-renewal wčia these conditions are not satisfied. You may disable auto-renewal befare processing, subject to the controls available in jūsų Account.

Far certain Šalies domenai (ccTLD) ir other TLDs, the operational renewal deadline may occur befare the Registry expiration date. The applicable deadline ir Registry rules control. You should not wait until the displayed expiration date to renew.

Far gTLDs, NiceNIC will transmit the pre-expiration ir post-expiration notices required by the ICANN Baigiasid Registracija Recovery Policy by email to the Registrant at Expiration at the applicable contact address in NiceNIC’s recards. NiceNIC may also send notices to the Account Holder, display notices in the Account, ar use additional communication channels. These required notices do not remove jūsų responsibility to maintain current contact infarmation ir timely renew the registration.

15. Atnaujintial, Expiration, Redemption, ir Auction
Domenas name expiration, DNS interruption, post-expiration renewal, deletion, redemption, restaration, pending deletion, ir expired-domenas auction procedures are governed by NiceNIC’s Baigiasid Domenas Atnaujintial, Redemption, ir Auction Policy at https://nicenic.com/legal/expired-domenas-renewal-redemption-ir-auction-policy, which is incarparated into this Agreement by reference.

The applicable registration, transfer, renewal, post-expiration renewal (if different), ir redemption/restare fees are published at https://nicenic.com/domenas/prices.php.

Domenas lifecycle periods ir recovery options vary by TLD ir may change under Registry rules ar miratary ICANN requirements. Net every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, ar recovery method. A domenas name may stop resolving upon ar after expiration, ir website, email, DNS, ir related paslaugas may be interrupted.

Wčia the applicable gTLD Registry offers a Redemption Grace Period, NiceNIC will permit the Registrant at Expiration to request restaration during that period, subject to payment of applicable renewal ir redemption/restare fees, completion of required verification, ir miratary Registry requirements. Far other TLDs, restaration availability is determined by applicable Registry policy.

Nething in NiceNIC’s expired-domenas auction process limits any non-waivable renewal ar restaration right granted to the Registrant at Expiration under the ICANN Baigiasid Registracija Recovery Policy. Jei this Agreement ar the NiceNIC expired-domenas policy conflicts with a miratary ICANN policy ar Registry requirement, that miratary policy ar requirement controls to the extent of the conflict.

Recovery after expiration is not guaranteed once the applicable renewal ar restaration right has ended, the name reaches a non-recoverable status, ar the Registry releases ar allocates the name. NiceNIC does not guarantee the release time ar the farmer Registruotised Vardas Holder’s ability to re-registruoti a deleted name.

16. Intellectual Property ir Lawful Use
Į the best of the Registruotised Vardas Holder’s kdabarledge ir belief, neither registration of the domenas name nar the manner in which it is directly ar indirectly used infringes the legal rights of any third party. NiceNIC does not determine whether a requested name ar its intended use violates another party’s trademark, copyright, privacy, publicity, contractual, ar other rights.

You must not use the Services far unlawful activity ar in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, ar the rights of others. Prohibitased activity includes using a domenas name to facilitate malware, botnets, phishing, pharming, ar spam when spam serves as a delivery mechanism far another farm of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability ar automatically require suspension. NiceNIC will review reparts ir take reasonable ir appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, ir the facts ir circumstances of the matter. NiceNIC may request infarmation from the Registruotised Vardas Holder ar Account Holder. Immediate action may be taken wčia required by law ar policy ar reasonably necessary to address an urgent security threat ar ongoing harm.

Abuse reparts should be submitted through https://nicenic.com/repartabuse.php ar another official abuse channel published by NiceNIC.

17. Dispute Resolution Policies
Visi applicable domenas name dispute policies are incarparated into this Agreement. gTLD registrations are subject to the UDRP ir, wčia applicable, the URS, Transfer Dispute Resolution Policy, ir other ICANN ar Registry dispute procedures. Šalies domenai (ccTLD) ir sponsared ar restricted TLDs may have different dispute policies.

The Registruotised Vardas Holder agrees that a registration may be locked, suspended, cancelled, transferred, ar otherwise affected in accardance with an applicable dispute policy, final administrative decision, settlement, court arder, ar Registry procedure.

NiceNIC generally does not adjudicate competing claims to a domenas name ir may require the parties to resolve them through agreement, the applicable dispute procedure, ar a court of competent jurisdiction. NiceNIC may maintain an appropriate status ar lock while a dispute is pending as required by policy.

18. Suspension, Atšauktilation, Transfer, ir Other Protective Veiksmass
NiceNIC may deny a pending transaction ar take propartionate action affecting a domenas name ar Account wčia reasonably necessary ir permitted ar required to:

carrect a registration, pricing, technical, ar operational errar by NiceNIC ar the Registry;
enfarce this Agreement following a material breach, including applicable Registracija Data accuracy requirements;
respond to fraud, unautharized access, payment reversal, ar a security incident;
investigate ar mitigate DNS Abuse ar unlawful use based on the facts ir evidence reasonably available;
protect the security, stability, ar resiliency of the DNS, a Registry, NiceNIC’s systems, ar affected users;
comply with an ICANN ar Registry policy, a dispute-resolution proceeding ar decision, a court arder, valid legal process, ar applicable law; ar
satisfy a miratary TLD eligibility, verification, local-presence, ar documentation requirement.

Wčia appropriate, legally permitted, ir consistent with the urgency ir nature of the issue, NiceNIC will provide notice ar an oppartunity to respond ar remedy. NiceNIC may act without advance notice when immediate action is required by law, policy, a Registry, a dispute provider, ar a court, ar is reasonably necessary to atgalent material harm, preserve evidence, ar protect security. NiceNIC will not exercise these rights in a manner inconsistent with miratary ICANN Consensus Policies ar Registry requirements.

19. Account Security ir Instructions
You are responsible far protecting Account credentials, authentication devices, API credentials, email accounts, ir autharized users. Instructions authenticated through jūsų Account ar API may be treated as autharized unless NiceNIC has reasonable notice of compromise ar applicable policy requires additional verification.

You must promptly notify NiceNIC of suspected unautharized access, loss of credentials, unautharized domenas changes, ar a disputed transfer. NiceNIC may tempararily restrict Account ar domenas functions while reasonably investigating a security repart.

NiceNIC may require additional authentication ar documentation far high-risk ar irreversible actions. Such controls do not transfer responsibility far Account security to NiceNIC.

20. Privacy, Proxy, Trustee, ir Local-Presence Services
Wčia available, privacy, proxy, trustee, agent, ar local-presence paslaugas are optional unless a TLD requires a qualifying local contact ar presence. These paslaugas may be governed by separate terms, fees, eligibility requirements, ir disclosure rules that you must accept befare use.

Use of a privacy ar proxy paslauga does not eliminate the Registruotised Vardas Holder’s obligations, atgalent lawful disclosure, ar shield unlawful conduct. A paslauga may be suspended ar terminated, ar underlying data may be disclosed, wčia permitted ar required by the applicable paslauga terms, ICANN policy, Registry requirements, law, ar valid legal process.

Terminaiination of an ancillary paslauga may require replacement contact infarmation, verification, ar other updates befare a transfer ar registrant change can be completed. Fees far a partially used ancillary-paslauga term are non-refundable unless otherwise stated ar required by law.

21. Terminai ir Terminaiination
This Agreement begins when accepted ir remains applicable while you use the Services ar a domenas name remains sponsared ar managed through NiceNIC. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, ir governing-law provisions—survive termination.

You may stop using the Services, disable renewal wčia available, transfer an eligible domenas name, ar request closure of jūsų Account, subject to outstiring obligations, security review, miratary retention, ir applicable domenas lifecycle ar transfer restrictions. Closing an Account does not automatically delete, cancel, ar transfer domenas registrations.

NiceNIC may stop offering a TLD ar Service wčia commercially ar operationally necessary ar required by a Registry, provider, law, ar policy. Wčia reasonably practicable ir permitted, NiceNIC will provide notice ir an oppartunity to renew, transfer, ar otherwise manage an affected domenas name befare suppart ends.

22. Indemnification
Į the maximum extent permitted by law, you agree to defend, indemnify, ir hold harmless NiceNIC ir its affiliates, directars, officers, employees, ir agents from claims, damages, liabilities, costs, ir reasonable legal expenses arising from jūsų material breach of this Agreement, jūsų unautharized ar unlawful use of the Services, ar jūsų infringement of a third party’s rights, except to the extent caused by NiceNIC’s fraud, willful misconduct, ar gross negligence.

The Registruotised Vardas Holder must indemnify, defend, ir hold harmless the applicable Registry Operatar ir its directars, officers, employees, ir agents from ir against all claims, damages, liabilities, costs, ir expenses, including reasonable legal fees ir expenses, arising out of ar related to the Registruotised Vardas Holder’s domenas name registration, as required by the applicable Registratorius Akreditacija Agreement ar Registry agreement.

23. Disclaimer ir Limitation of Liability
Į the maximum extent permitted by law, the Services are provided on an “as available” basis. NiceNIC does not warrant that every requested name will be available, that every Registry ar third-party system will operate without errar ar interruption, that an IDN will display identically in every application, ar that an expired ar deleted domenas name can be recovered ar re-registruotied.

NiceNIC is not responsible far delays, errars, interruptions, ar losses caused by a Registry Operatar, upstream provider, DNS infrastructure provider, payment netwark, blockchain netwark, dispute provider, governmental action, farce majeure event, ar other event beyond NiceNIC’s reasonable control, except to the extent liability cannot lawfully be excluded.

Į the maximum extent permitted by law, neither party is liable to the other far indirect, incidental, special, punitive, ar consequential damages, loss of profit, loss of anticipated savings, loss of business oppartunity, ar loss of goodwill arising from the Services, even if advised that such damage may occur.

Į the maximum extent permitted by law, NiceNIC’s aggregate liability arising from a specific affected domenas name ar transaction will not exceed the fees paid to NiceNIC far that affected domenas name ar transaction during the twelve (12) months preceding the event giving rise to the claim.

Nething in this Agreement excludes ar limits liability far fraud, willful misconduct, gross negligence, death ar personal injury caused by negligence wčia such liability cannot be excluded, ar any other liability ar consumer right that cannot be excluded ar limited under applicable law.

24. Changes to This Agreement
NiceNIC may update this Agreement to reflect changes in ICANN ar Registry policies, law, security requirements, operational processes, paslaugas, ar commercial terms. The current version ir its effective date will be published through the NiceNIC Legal page.

Wčia required by applicable law, the Registratorius Akreditacija Agreement, ar ICANN policy, NiceNIC will provide notice of a material change using the contact infarmation in its recards ar another permitted method. Changes mirated by law, ICANN, ar a Registry may take effect when required. Other changes take effect on the published effective date. Continued use of the Services after that date constitutes acceptance to the extent permitted by law.

25. Netices ir Communications
You must maintain a monitared ir accurate email address far the Account ir the Registruotised Vardas Holder. NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, ir policy notices by email, through the Account, ar by another method permitted by applicable policy ar law.

A notice is treated as transmitted when sent to the current address ar communication channel in NiceNIC’s recards, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy ar law.

26. Governing Law ir Jurisdiction
This Agreement is governed by the laws of Honkongas, without regard to conflict-of-laws principles.

Far adjudication of disputes concerning ar arising from use of a registruotied domenas name, the Registruotised Vardas Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) wčia the Registruotised Vardas Holder is domiciled ir (b) wčia NiceNIC is located, currently Honkongas, as required by the Registratorius Akreditacija Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, ir any non-waivable jurisdiction under applicable law, the courts of Honkongas have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement ir the incarparated policies constitute the agreement between the parties concerning the Services ir supersede priar terms concerning the same subject matter. Separate terms apply to separately ardered products ar paslaugas.

Jei a provision is held invalid ar unenfarceable, it will be enfarced to the maximum lawful extent ir the remaining provisions remain effective. Failure to enfarce a provision is not a waiver. Headings are far convenience only.

You may not assign this Agreement ar transfer control of an Account in a manner that bypasses an applicable domenas transfer, Change of Registrant, verification, ar security process. NiceNIC may assign this Agreement as part of a merger, rearganization, sale of business, ar permitted transfer of registrar operations, subject to applicable ICANN, Registry, ir legal requirements.

The English-language version controls. A translation is provided far convenience only unless miratary law requires otherwise.
