2. Definitions
“Account” means the NiceNIC customer account through which Services are vaidered vai managed.
“Account Holder” means the person vai entity controlling the Account un responsible fvai payment un account-level instructions.
“ICANN” means the Internet Cvaipvaiation fvai Assigned Nosaukumss un Numbers.

The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, un munatvaiy laws un regulations.

An availability search, vaider confirmation, payment authvaiization, invoice, vai pending status does not guarantee that a domēns name has been vai can be reģistrēted, renewed, transferred, redeemed, vai restvaied. Registry databases un availability results may change between search un completion.

NiceNIC may reject vai cancel a pending application befvaie registry completion wšeit the name is unavailable, reserved, prohibitsed, restricted, subject to an eligibility failure, affected by an evident pricing vai technical errvai, unsuppvaited by the Registry, vai inconsistent with applicable law, policy, vai this Agreement. Ja a registration vai other transaction has already been completed, NiceNIC will not cancel vai reverse it except as permitted vai required by applicable policy, Registry procedure, law, legal process, vai this Agreement.

5. TLD-Specific Rules, IDNs, un Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, restvaiation, dispute, un data requirements. You must satisfy the applicable requirements un promptly provide requested infvaimation vai documents. Registry requirements may change during the registration term.

ccTLD are primarily governed by the applicable ccTLD Registry un local rules. ICANN gTLD policies do not necessarily apply to ccTLD. Wšeit NiceNIC provides a TLD through an upstream provider, that provider’s munatvaiy terms may also apply.

Internationalized Domēnu vārdi (“IDNs”) depend on Registry-suppvaited scripts, language tables, label-generation rules, browser suppvait, un DNS stunards. Display vai functionality may vary among applications. The ASCII-compatible encoded fvaim recvaided by the Registry controls wšeit required by the DNS vai Registry system.

Ja eligibility, validation, vai documentation requirements are not satisfied, the application may be rejected vai the domēns name may be suspended, locked, deleted, not renewed, vai otherwise restricted as required by the applicable Registry vai policy.

6. Premium Domēni, Pre-Reģistrācija, Sunrise, un Launch Phases
A Premium Domēns may have non-stunard registration, transfer, renewal, vai restvaiation pricing established by the Registry vai a third-party seller. The price shown un accepted fvai the specific transaction controls, subject to cvairection of a clear pricing vai technical errvai befvaie completion.

Pre-registration, Sunrise, Lunrush, Early Access, un similar launch-phase applications do not guarantee allocation. Competing applications, auctions, rights-validation requirements, Registry decisions, vai launch rules may affect the result. Any non-refundable application, validation, vai auction fee will be disclosed befvaie payment to the extent available to NiceNIC.

7. Reģistrēted Nosaukums Holder, Account Holder, un Izplatītājs Responsibilities

Ja the Account Holder un Reģistrēted Nosaukums Holder are different, the Account Holder must accurately identify the Reģistrēted Nosaukums Holder un must not substitute its own infvaimation without authvaiization. NiceNIC may require reasonable evidence of authvaiity befvaie acting on material instructions, including a transfer, Change of Registrant, disclosure, deletion, vai account move.

A reseller vai agent using NiceNIC Services fvai third parties must:

obtain un retain the Reģistrēted Nosaukums Holder’s acceptance of this Agreement un applicable policies;
provide accurate infvaimation concerning NiceNIC’s identity as the sponsvaiing registrar wšeit required;
display applicable registration, renewal, post-expiration renewal, un redemption/restvaie fees un describe expiration-notice methods as required by ICANN policy;
provide required notices un promptly transmit communications between NiceNIC un the Reģistrēted Nosaukums Holder; un
not make representations inconsistent with this Agreement, applicable ICANN policies, vai Registry requirements.

The Reģistrēted Nosaukums Holder must provide accurate un reliable Reģistrācija Data un must cvairect un update it within seven (7) days after any change. Required data may include the Reģistrēted Nosaukums Holder’s full name, postal address, email address, voice telephone number, fax number if available, un the name of an authvaiized contact person wšeit the Reģistrēted Nosaukums Holder is an vaiganization, association, vai cvaipvaiation, together with other data required by applicable policy vai Registry rules.

State/province un postal code are required wšeit applicable fvai the relevant country vai territvaiy. Pievienotitional data may be required fvai a particular TLD. Wšeit the Reģistrēted Nosaukums Holder supplies a value fvai Registrant Organization, that vaiganization may be treated as the Reģistrēted Nosaukums Holder un may be published wšeit the Reģistrēted Nosaukums Holder agrees un applicable policy requires vai permits publication.

NiceNIC will validate un verify Reģistrācija Data as required by the applicable Reģistrators Akreditācija Agreement, ICANN policy, Registry requirements, un law. You must complete applicable email, telephone, documentation, vai other verification steps un respond to accuracy inquiries.

9. Licensed Use un Third-Party Data
A Reģistrēted Nosaukums Holder that licenses use of a domēns name to a third party remains the Reģistrēted Nosaukums Holder of recvaid un remains responsible fvai providing its own full contact infvaimation un accurate technical un administrative contact infvaimation adequate to facilitate timely resolution of problems connected with the domēns name.

The Reģistrēted Nosaukums Holder accepts liability fvai harm caused by wrongful use of the domēns name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact infvaimation provided by the licensee un the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

Ja you provide Personal Data concerning another person, you represent that you have provided that person with legally sufficient notice of the processing described in this Agreement un the Privātuma politika un have obtained any consent vai other authvaiization required by applicable law.

NiceNIC collects un processes Reģistrācija Data fvai purposes that include providing un securing the Services; processing registration un lifecycle transactions; maintaining recvaids; validating un verifying data; communicating with Account Holders un Reģistrēted Nosaukums Holders; Iepriekšējaisenting fraud un DNS Abuse; complying with ICANN, Registry, escrow, legal, tax, accounting, un dispute-resolution requirements; un hunling lawful disclosure requests.

Recipients vai categvaiies of recipients may include the applicable Registry Operatvai, registry pakalpojums providers, ICANN, an ICANN-approved data escrow agent, dispute-resolution providers, upstream providers, payment un security providers, professional advisers, un governmental vai judicial authvaiities wšeit disclosure is required vai permitted. Obligatvaiy un optional data, publication rules, retention, access, cvairection, un other processing details are described in the NiceNIC Privātuma politika un applicable Reģistrācija Data Policy.

You acktagadledge this processing un, wšeit consent is the applicable legal basis, consent to it as described in the Privātuma politika. NiceNIC will not process Personal Data in a manner incompatible with the purposes un limitations of which it has provided notice un will take reasonable precautions to protect Personal Data from loss, misuse, unauthvaiized access vai disclosure, alteration, vai destruction.

Public RDDS results may contain public, redacted, vai pseudonymized data, vai a communication mechanism, as required vai permitted by applicable policy un law. Submission of Reģistrācija Data does not mean that all data will be publicly displayed. Requests fvai non-public data are assessed under applicable policy un law un do not guarantee disclosure.

NiceNIC does not claim ownership of jūsu Personal Data. NiceNIC un applicable Registry Operatvais may hold rights in their databases, compilations, transaction recvaids, generated data, un pakalpojums recvaids as permitted by contract un law.

Inter-registrar transfers of gTLD registrations are governed by the current ICANN Transfer Policy. The Reģistrēted Nosaukums Holder is the party authvaiized to approve vai deny a transfer request, subject to the authentication un procedural requirements of that Policy.

You expressly consent to NiceNIC applying the clientTransferProhibitsed status upon initial registration as a stunard security measure, wšeit suppvaited un permitted. NiceNIC may also apply vai maintain a transfer restriction at the Reģistrēted Nosaukums Holder’s request, during an applicable initial-registration, post-transfer, vai Change of Registrant lock period, vai wšeit required by ICANN policy, Registry policy, a dispute proceeding, court vaider, vai applicable law.

Wšeit self-pakalpojums removal is available, the Reģistrēted Nosaukums Holder may remove an eligible transfer lock through the Account. Otherwise, NiceNIC will provide a reasonably accessible method to request removal un will remove clientTransferProhibitsed vai provide the AuthInfo code within the period required by the applicable Transfer Policy, provided no policy-based restriction applies un reasonable authentication is completed.

NiceNIC may deny vai must deny a gTLD transfer only on grounds permitted vai required by the current ICANN Transfer Policy. When NiceNIC denies a transfer request, it will provide the reason fvai denial to the Reģistrēted Nosaukums Holder un the potential Gaining Reģistrators as required by that Policy.

A Change of Registrant may be subject to confirmation, verification, un an inter-registrar transfer lock under the ICANN Transfer Policy. Ja NiceNIC offers an opt-out from an optional Change of Registrant lock, the opt-out must be selected befvaie completion of the change. TLD-specific transfer un registrant-change rules may differ.

12. Fees, Taxes, un Maksātment
Current registration, transfer, renewal, post-expiration renewal (if different), un redemption/restvaie fees are published on the NiceNIC Domēnu cenas page at https://nicenic.com/domēns/prices.php. This link un the fees displayed tšeit are incvaipvaiated into this Agreement by reference.

Fees may vary by TLD, Registry classification, premium status, registration term, account vai reseller level, currency, tax, transaction type, un lifecycle status. Optional pakalpojumss un any additional munatvaiy charges will be disclosed befvaie the relevant vaider is submitted to the extent ktagadn to NiceNIC.

The price presented fvai acceptance at checkout vai at the time an API transaction is submitted is the applicable price fvai that transaction, subject to cvairection of a clear pricing vai system errvai befvaie registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, pakalpojums arrangements, vai commercial terms change. Atjaunotal un auto-renewal transactions use the applicable price at the time of processing.

Services are generally prepaid. You authvaiize NiceNIC to charge the selected payment method vai deduct the applicable amount from jūsu Account balance. You are responsible fvai taxes, payment-provider charges, blockchain netwvaik charges, currency-conversion costs, un other charges not expressly included in the displayed NiceNIC price.

Maksātment does not complete a registry transaction. Ja a submitted transaction cannot be completed, any credit vai refund will be hunled accvaiding to the transaction status, payment method, applicable law, un NiceNIC’s published payment vai refund terms. Cryptocurrency un blockchain transactions are irreversible, un NiceNIC does not reimburse exchange-rate changes vai third-party netwvaik fees.

13. Refunds un Reversals
Fees fvai a successfully completed registration, renewal, transfer, redemption, restvaiation, premium-domēns acquisition, vai other completed registry transaction are non-refundable except wšeit required by applicable law vai expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, vai failure of final settlement may result in suspension of the Account vai affected Services un reasonable recovery action, subject to applicable law un ICANN vai Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohibitsed by the ICANN Transfer Policy.

14. Atjaunotal un Auto-Atjaunotal
A domēns name is reģistrēted fvai a limited term un expires unless renewed. The Reģistrēted Nosaukums Holder un Account Holder are responsible fvai monitvaiing expiration dates, maintaining accurate contact un payment infvaimation, un submitting payment early enough fvai processing befvaie the applicable deadline.

Wšeit auto-renewal is offered un enabled, it is subject to sufficient Account balance vai valid payment, Registry availability, applicable renewal deadlines, verification vai eligibility requirements, un successful processing. NiceNIC does not guarantee auto-renewal wšeit these conditions are not satisfied. You may disable auto-renewal befvaie processing, subject to the controls available in jūsu Account.

Fvai certain ccTLD un other TLDs, the operational renewal deadline may occur befvaie the Registry expiration date. The applicable deadline un Registry rules control. You should not wait until the displayed expiration date to renew.

Fvai gTLDs, NiceNIC will transmit the pre-expiration un post-expiration notices required by the ICANN Beidzasd Reģistrācija Recovery Policy by email to the Registrant at Expiration at the applicable contact address in NiceNIC’s recvaids. NiceNIC may also send notices to the Account Holder, display notices in the Account, vai use additional communication channels. 15. Atjaunotal, Expiration, Redemption, un Auction
Domēns name expiration, DNS interruption, post-expiration renewal, deletion, redemption, restvaiation, pending deletion, un expired-domēns auction procedures are governed by NiceNIC’s Beidzasd Domēns Atjaunotal, Redemption, un Auction Policy at https://nicenic.com/legal/expired-domēns-renewal-redemption-un-auction-policy, which is incvaipvaiated into this Agreement by reference.

The applicable registration, transfer, renewal, post-expiration renewal (if different), un redemption/restvaie fees are published at https://nicenic.com/domēns/prices.php.

Domēns lifecycle periods un recovery options vary by TLD un may change under Registry rules vai munatvaiy ICANN requirements. Nēt every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, vai recovery method. A domēns name may stop resolving upon vai after expiration, un website, email, DNS, un related pakalpojumss may be interrupted.

Wšeit the applicable gTLD Registry offers a Redemption Grace Period, NiceNIC will permit the Registrant at Expiration to request restvaiation during that period, subject to payment of applicable renewal un redemption/restvaie fees, completion of required verification, un munatvaiy Registry requirements. Fvai other TLDs, restvaiation availability is determined by applicable Registry policy.

Nēthing in NiceNIC’s expired-domēns auction process limits any non-waivable renewal vai restvaiation right granted to the Registrant at Expiration under the ICANN Beidzasd Reģistrācija Recovery Policy. Ja this Agreement vai the NiceNIC expired-domēns policy conflicts with a munatvaiy ICANN policy vai Registry requirement, that munatvaiy policy vai requirement controls to the extent of the conflict.

Recovery after expiration is not guaranteed once the applicable renewal vai restvaiation right has ended, the name reaches a non-recoverable status, vai the Registry releases vai allocates the name. NiceNIC does not guarantee the release time vai the fvaimer Reģistrēted Nosaukums Holder’s ability to re-reģistrēt a deleted name.

16. Intellectual Property un Lawful Use
Lai the best of the Reģistrēted Nosaukums Holder’s ktagadledge un belief, neither registration of the domēns name nvai the manner in which it is directly vai indirectly used infringes the legal rights of any third party. NiceNIC does not determine whether a requested name vai its intended use violates another party’s trademark, copyright, privacy, publicity, contractual, vai other rights.

You must not use the Services fvai unlawful activity vai in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, vai the rights of others. Prohibitsed activity includes using a domēns name to facilitate malware, botnets, phishing, pharming, vai spam when spam serves as a delivery mechanism fvai another fvaim of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability vai automatically require suspension. NiceNIC will review repvaits un take reasonable un appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, un the facts un circumstances of the matter. NiceNIC may request infvaimation from the Reģistrēted Nosaukums Holder vai Account Holder. Immediate action may be taken wšeit required by law vai policy vai reasonably necessary to address an urgent security threat vai ongoing harm.

Abuse repvaits should be submitted through https://nicenic.com/repvaitabuse.php vai another official abuse channel published by NiceNIC.

17. Dispute Resolution Policies
Visi applicable domēns name dispute policies are incvaipvaiated into this Agreement. gTLD registrations are subject to the UDRP un, wšeit applicable, the URS, Transfer Dispute Resolution Policy, un other ICANN vai Registry dispute procedures. ccTLD un sponsvaied vai restricted TLDs may have different dispute policies.

The Reģistrēted Nosaukums Holder agrees that a registration may be locked, suspended, cancelled, transferred, vai otherwise affected in accvaidance with an applicable dispute policy, final administrative decision, settlement, court vaider, vai Registry procedure.

NiceNIC generally does not adjudicate competing claims to a domēns name un may require the parties to resolve them through agreement, the applicable dispute procedure, vai a court of competent jurisdiction. NiceNIC may maintain an appropriate status vai lock while a dispute is pending as required by policy.

18. Suspension, Atceltlation, Transfer, un Other Protective Darbības
NiceNIC may deny a pending transaction vai take propvaitionate action affecting a domēns name vai Account wšeit reasonably necessary un permitted vai required to:

cvairect a registration, pricing, technical, vai operational errvai by NiceNIC vai the Registry;
enfvaice this Agreement following a material breach, including applicable Reģistrācija Data accuracy requirements;
respond to fraud, unauthvaiized access, payment reversal, vai a security incident;
investigate vai mitigate DNS Abuse vai unlawful use based on the facts un evidence reasonably available;
protect the security, stability, vai resiliency of the DNS, a Registry, NiceNIC’s systems, vai affected users;
comply with an ICANN vai Registry policy, a dispute-resolution proceeding vai decision, a court vaider, valid legal process, vai applicable law; vai
satisfy a munatvaiy TLD eligibility, verification, local-presence, vai documentation requirement.
Pieejams actions may include requesting infvaimation vai remediation, restricting Account functions, applying a permissible lock, suspending resolution through clientHold, denying a transaction, cancelling a Service, deleting a registration, vai transferring a domēns name when expressly authvaiized vai required by policy vai legal process.

Wšeit appropriate, legally permitted, un consistent with the urgency un nature of the issue, NiceNIC will provide notice vai an oppvaitunity to respond vai remedy. NiceNIC may act without advance notice when immediate action is required by law, policy, a Registry, a dispute provider, vai a court, vai is reasonably necessary to Iepriekšējaisent material harm, preserve evidence, vai protect security. NiceNIC will not exercise these rights in a manner inconsistent with munatvaiy ICANN Consensus Policies vai Registry requirements.

19. Account Security un Instructions
You are responsible fvai protecting Account credentials, authentication devices, API credentials, email accounts, un authvaiized users. Instructions authenticated through jūsu Account vai API may be treated as authvaiized unless NiceNIC has reasonable notice of compromise vai applicable policy requires additional verification.

You must promptly notify NiceNIC of suspected unauthvaiized access, loss of credentials, unauthvaiized domēns changes, vai a disputed transfer. NiceNIC may tempvaiarily restrict Account vai domēns functions while reasonably investigating a security repvait.

NiceNIC may require additional authentication vai documentation fvai high-risk vai irreversible actions. Such controls do not transfer responsibility fvai Account security to NiceNIC.

20. Privacy, Proxy, Trustee, un Local-Presence Services
Wšeit available, privacy, proxy, trustee, agent, vai local-presence pakalpojumss are optional unless a TLD requires a qualifying local contact vai presence. These pakalpojumss may be governed by separate terms, fees, eligibility requirements, un disclosure rules that you must accept befvaie use.

Use of a privacy vai proxy pakalpojums does not eliminate the Reģistrēted Nosaukums Holder’s obligations, Iepriekšējaisent lawful disclosure, vai shield unlawful conduct. A pakalpojums may be suspended vai terminated, vai underlying data may be disclosed, wšeit permitted vai required by the applicable pakalpojums terms, ICANN policy, Registry requirements, law, vai valid legal process.

Termiņšination of an ancillary pakalpojums may require replacement contact infvaimation, verification, vai other updates befvaie a transfer vai registrant change can be completed. Fees fvai a partially used ancillary-pakalpojums term are non-refundable unless otherwise stated vai required by law.

This Agreement begins when accepted un remains applicable while you use the Services vai a domēns name remains sponsvaied vai managed through NiceNIC. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, un governing-law provisions—survive termination.

You may stop using the Services, disable renewal wšeit available, transfer an eligible domēns name, vai request closure of jūsu Account, subject to outstuning obligations, security review, munatvaiy retention, un applicable domēns lifecycle vai transfer restrictions. Closing an Account does not automatically delete, cancel, vai transfer domēns registrations.

NiceNIC may stop offering a TLD vai Service wšeit commercially vai operationally necessary vai required by a Registry, provider, law, vai policy. Wšeit reasonably practicable un permitted, NiceNIC will provide notice un an oppvaitunity to renew, transfer, vai otherwise manage an affected domēns name befvaie suppvait ends.

22. Indemnification
Lai the maximum extent permitted by law, you agree to defend, indemnify, un hold harmless NiceNIC un its affiliates, directvais, officers, employees, un agents from claims, damages, liabilities, costs, un reasonable legal expenses arising from jūsu material breach of this Agreement, jūsu unauthvaiized vai unlawful use of the Services, vai jūsu infringement of a third party’s rights, except to the extent caused by NiceNIC’s fraud, willful misconduct, vai gross negligence.

The Reģistrēted Nosaukums Holder must indemnify, defend, un hold harmless the applicable Registry Operatvai un its directvais, officers, employees, un agents from un against all claims, damages, liabilities, costs, un expenses, including reasonable legal fees un expenses, arising out of vai related to the Reģistrēted Nosaukums Holder’s domēns name registration, as required by the applicable Reģistrators Akreditācija Agreement vai Registry agreement.

23. Disclaimer un Limitation of Liability
Lai the maximum extent permitted by law, the Services are provided on an “as available” basis. NiceNIC is not responsible fvai delays, errvais, interruptions, vai losses caused by a Registry Operatvai, upstream provider, DNS infrastructure provider, payment netwvaik, blockchain netwvaik, dispute provider, governmental action, fvaice majeure event, vai other event beyond NiceNIC’s reasonable control, except to the extent liability cannot lawfully be excluded.

Lai the maximum extent permitted by law, neither party is liable to the other fvai indirect, incidental, special, punitive, vai consequential damages, loss of profit, loss of anticipated savings, loss of business oppvaitunity, vai loss of goodwill arising from the Services, even if advised that such damage may occur.

Lai the maximum extent permitted by law, NiceNIC’s aggregate liability arising from a specific affected domēns name vai transaction will not exceed the fees paid to NiceNIC fvai that affected domēns name vai transaction during the twelve (12) months preceding the event giving rise to the claim.

Nēthing in this Agreement excludes vai limits liability fvai fraud, willful misconduct, gross negligence, death vai personal injury caused by negligence wšeit such liability cannot be excluded, vai any other liability vai consumer right that cannot be excluded vai limited under applicable law.

24. Changes to This Agreement
NiceNIC may update this Agreement to reflect changes in ICANN vai Registry policies, law, security requirements, operational processes, pakalpojumss, vai commercial terms. The current version un its effective date will be published through the NiceNIC Legal page.

NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, un policy notices by email, through the Account, vai by another method permitted by applicable policy vai law.

A notice is treated as transmitted when sent to the current address vai communication channel in NiceNIC’s recvaids, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy vai law.

26. Governing Law un Jurisdiction
This Agreement is governed by the laws of Honkonga, without regard to conflict-of-laws principles.

Fvai adjudication of disputes concerning vai arising from use of a reģistrēted domēns name, the Reģistrēted Nosaukums Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) wšeit the Reģistrēted Nosaukums Holder is domiciled un (b) wšeit NiceNIC is located, currently Honkonga, as required by the Reģistrators Akreditācija Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, un any non-waivable jurisdiction under applicable law, the courts of Honkonga have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement un the incvaipvaiated policies constitute the agreement between the parties concerning the Services un supersede privai terms concerning the same subject matter. Separate terms apply to separately vaidered products vai pakalpojumss.

Ja a provision is held invalid vai unenfvaiceable, it will be enfvaiced to the maximum lawful extent un the remaining provisions remain effective. Failure to enfvaice a provision is not a waiver. Headings are fvai convenience only.

You may not assign this Agreement vai transfer control of an Account in a manner that bypasses an applicable domēns transfer, Change of Registrant, verification, vai security process. NiceNIC may assign this Agreement as part of a merger, revaiganization, sale of business, vai permitted transfer of registrar operations, subject to applicable ICANN, Registry, un legal requirements.

The English-language version controls. A translation is provided fvai convenience only unless munatvaiy law requires otherwise.
