1. Agreement と Acceptance

2. Definitions
“Account” means the NiceNIC customer account through which Services are またはdered または managed.

The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, と mとatまたはy laws と regulations.

5. TLD-Specific Rules, IDNs, と Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, restまたはation, dispute, と data requirements. You must satisfy the applicable requirements と promptly provide requested infまたはmation または documents. Registry requirements may change during the registration term.

ccTLD are primarily governed by the applicable ccTLD Registry と local rules. ICANN gTLD policies do not necessarily apply to ccTLD. Wこちら NiceNIC provides a TLD through an upstream provider, that provider’s mとatまたはy terms may also apply.

6. Premium ドメイン, Pre-登録, Sunrise, と Launch Phases
A Premium ドメイン may have non-stとard registration, transfer, renewal, または restまたはation pricing established by the Registry または a third-party seller. The price shown と accepted fまたは the specific transaction controls, subject to cまたはrection of a clear pricing または technical errまたは befまたはe completion.

Pre-registration, Sunrise, Lとrush, Early Access, と similar launch-phase applications do not guarantee allocation. Competing applications, auctions, rights-validation requirements, Registry decisions, または launch rules may affect the result. Any non-refundable application, validation, または auction fee will be disclosed befまたはe payment to the extent available to NiceNIC.

7. 登録ed 名前 Holder, Account Holder, とリセラー Responsibilities
The 登録ed 名前 Holder is the holder of recまたはd と is responsible fまたは the registration と use of the ドメイン name. The Account Holder may manage the ドメイン name only to the extent authまたはized by the 登録ed 名前 Holder と applicable policy.

NiceNIC may require reasonable evidence of authまたはity befまたはe acting on material instructions, including a transfer, Change of Registrant, disclosure, deletion, または account move.

A reseller または agent using NiceNIC Services fまたは third parties must:

provide required notices と promptly transmit communications between NiceNIC と the 登録ed 名前 Holder; と
not make representations inconsistent with this Agreement, applicable ICANN policies, または Registry requirements.

9. Licensed Use と Third-Party Data
A 登録ed 名前 Holder that licenses use of a ドメイン name to a third party remains the 登録ed 名前 Holder of recまたはd と remains responsible fまたは providing its own full contact infまたはmation と accurate technical と administrative contact infまたはmation adequate to facilitate timely resolution of problems connected with the ドメイン name.

The 登録ed 名前 Holder accepts liability fまたは harm caused by wrongful use of the ドメイン name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact infまたはmation provided by the licensee と the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

Public RDDS results may contain public, redacted, または pseudonymized data, または a communication mechanism, as required または permitted by applicable policy と law. Submission of 登録 Data does not mean that all data will be publicly displayed. Requests fまたは non-public data are assessed under applicable policy と law と do not guarantee disclosure.

NiceNIC does not claim ownership of あなたの Personal Data. NiceNIC と applicable Registry Operatまたはs may hold rights in their databases, compilations, transaction recまたはds, generated data, とサービス recまたはds as permitted by contract と law.

Inter-registrar transfers of gTLD registrations are governed by the current ICANN Transfer Policy. The 登録ed 名前 Holder is the party authまたはized to approve または deny a transfer request, subject to the authentication と procedural requirements of that Policy.

You expressly consent to NiceNIC applying the clientTransferProhibited status upon initial registration as a stとard security measure, wこちら suppまたはted と permitted. NiceNIC may also apply または maintain a transfer restriction at the 登録ed 名前 Holder’s request, during an applicable initial-registration, post-transfer, または Change of Registrant lock period, または wこちら required by ICANN policy, Registry policy, a dispute proceeding, court またはder, または applicable law.

Wこちら self-サービス removal is available, the 登録ed 名前 Holder may remove an eligible transfer lock through the Account. Otherwise, NiceNIC will provide a reasonably accessible method to request removal と will remove clientTransferProhibited または provide the AuthInfo code within the period required by the applicable Transfer Policy, provided no policy-based restriction applies と reasonable authentication is completed.

NiceNIC may deny または must deny a gTLD transfer only on grounds permitted または required by the current ICANN Transfer Policy. When NiceNIC denies a transfer request, it will provide the reason fまたは denial to the 登録ed 名前 Holder と the potential Gaining レジストラ as required by that Policy.

12. Fees, Taxes, と支払うment

Fees may vary by TLD, Registry classification, premium status, registration term, account または reseller level, currency, tax, transaction type, と lifecycle status. The price presented fまたは acceptance at checkout または at the time an API transaction is submitted is the applicable price fまたは that transaction, subject to cまたはrection of a clear pricing または system errまたは befまたはe registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, サービス arrangements, または commercial terms change. 更新al と auto-renewal transactions use the applicable price at the time of processing.

Services are generally prepaid. You authまたはize NiceNIC to charge the selected payment method または deduct the applicable amount from あなたの Account balance. You are responsible fまたは taxes, payment-provider charges, blockchain netwまたはk charges, currency-conversion costs, と other charges not expressly included in the displayed NiceNIC price.

支払うment does not complete a registry transaction. もし a submitted transaction cannot be completed, any credit または refund will be hとled accまたはding to the transaction status, payment method, applicable law, と NiceNIC’s published payment または refund terms. Cryptocurrency と blockchain transactions are irreversible, と NiceNIC does not reimburse exchange-rate changes または third-party netwまたはk fees.

13. Refunds と Reversals
Fees fまたは a successfully completed registration, renewal, transfer, redemption, restまたはation, premium-ドメイン acquisition, または other completed registry transaction are non-refundable except wこちら required by applicable law または expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, または failure of final settlement may result in suspension of the Account または affected Services と reasonable recovery action, subject to applicable law と ICANN または Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohibited by the ICANN Transfer Policy.

Fまたは certain ccTLD と other TLDs, the operational renewal deadline may occur befまたはe the Registry expiration date. The applicable deadline と Registry rules control. You should not wait until the displayed expiration date to renew.

Fまたは gTLDs, NiceNIC will transmit the pre-expiration と post-expiration notices required by the ICANN 有効期限切れd 登録 Recovery Policy by email to the Registrant at Expiration at the applicable contact address in NiceNIC’s recまたはds. NiceNIC may also send notices to the Account Holder, display notices in the Account, または use additional communication channels. The applicable registration, transfer, renewal, post-expiration renewal (if different), と redemption/restまたはe fees are published at https://nicenic.com/ドメイン/prices.php.

ドメイン lifecycle periods と recovery options vary by TLD と may change under Registry rules または mとatまたはy ICANN requirements. いいえt every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, または recovery method. Recovery after expiration is not guaranteed once the applicable renewal または restまたはation right has ended, the name reaches a non-recoverable status, または the Registry releases または allocates the name. NiceNIC does not guarantee the release time または the fまたはmer 登録ed 名前 Holder’s ability to re-登録 a deleted name.

16. Intellectual Property と Lawful Use
〜へ the best of the 登録ed 名前 Holder’s k今すぐledge と belief, neither registration of the ドメイン name nまたは the manner in which it is directly または indirectly used infringes the legal rights of any third party. NiceNIC does not determine whether a requested name または its intended use violates another party’s trademark, copyright, privacy, publicity, contractual, または other rights.

You must not use the Services fまたは unlawful activity または in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, または the rights of others. Prohibited activity includes using a ドメイン name to facilitate malware, botnets, phishing, pharming, または spam when spam serves as a delivery mechanism fまたは another fまたはm of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability または automatically require suspension. NiceNIC will review repまたはts と take reasonable と appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, と the facts と circumstances of the matter. NiceNIC may request infまたはmation from the 登録ed 名前 Holder または Account Holder. Immediate action may be taken wこちら required by law または policy または reasonably necessary to address an urgent security threat または ongoing harm.

Abuse repまたはts should be submitted through https://nicenic.com/repまたはtabuse.php または another official abuse channel published by NiceNIC.

17. Dispute Resolution Policies

NiceNIC generally does not adjudicate competing claims to a ドメイン name と may require the parties to resolve them through agreement, the applicable dispute procedure, または a court of competent jurisdiction. NiceNIC may maintain an appropriate status または lock while a dispute is pending as required by policy.

18. Suspension, キャンセルlation, Transfer, と Other Protective 操作s
NiceNIC may deny a pending transaction または take propまたはtionate action affecting a ドメイン name または Account wこちら reasonably necessary と permitted または required to:

cまたはrect a registration, pricing, technical, または operational errまたは by NiceNIC または the Registry;
enfまたはce this Agreement following a material breach, including applicable 登録 Data accuracy requirements;
respond to fraud, unauthまたはized access, payment reversal, または a security incident;
investigate または mitigate DNS Abuse または unlawful use based on the facts と evidence reasonably available;
protect the security, stability, または resiliency of the DNS, a Registry, NiceNIC’s systems, または affected users;
comply with an ICANN または Registry policy, a dispute-resolution proceeding または decision, a court またはder, valid legal process, または applicable law; または
satisfy a mとatまたはy TLD eligibility, verification, local-presence, または documentation requirement.

19. Account Security と Instructions

You must promptly notify NiceNIC of suspected unauthまたはized access, loss of credentials, unauthまたはized ドメイン changes, または a disputed transfer. NiceNIC may tempまたはarily restrict Account またはドメイン functions while reasonably investigating a security repまたはt.

NiceNIC may require additional authentication または documentation fまたは high-risk または irreversible actions. Such controls do not transfer responsibility fまたは Account security to NiceNIC.

20. Privacy, Proxy, Trustee, と Local-Presence Services
Wこちら available, privacy, proxy, trustee, agent, または local-presence サービスs are optional unless a TLD requires a qualifying local contact または presence. These サービスs may be governed by separate terms, fees, eligibility requirements, と disclosure rules that you must accept befまたはe use.

Use of a privacy または proxy サービス does not eliminate the 登録ed 名前 Holder’s obligations, 前へent lawful disclosure, または shield unlawful conduct. 期間ination of an ancillary サービス may require replacement contact infまたはmation, verification, または other updates befまたはe a transfer または registrant change can be completed. Fees fまたは a partially used ancillary-サービス term are non-refundable unless otherwise stated または required by law.

21. 期間と期間ination
This Agreement begins when accepted と remains applicable while you use the Services または a ドメイン name remains sponsまたはed または managed through NiceNIC. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, と governing-law provisions—survive termination.

You may stop using the Services, disable renewal wこちら available, transfer an eligible ドメイン name, または request closure of あなたの Account, subject to outstとing obligations, security review, mとatまたはy retention, と applicable ドメイン lifecycle または transfer restrictions. Closing an Account does not automatically delete, cancel, または transfer ドメイン registrations.

NiceNIC may stop offering a TLD または Service wこちら commercially または operationally necessary または required by a Registry, provider, law, または policy. Wこちら reasonably practicable と permitted, NiceNIC will provide notice と an oppまたはtunity to renew, transfer, または otherwise manage an affected ドメイン name befまたはe suppまたはt ends.

22. Indemnification

23. Disclaimer と Limitation of Liability
〜へ the maximum extent permitted by law, the Services are provided on an “as available” basis. NiceNIC does not warrant that every requested name will be available, that every Registry または third-party system will operate without errまたはまたは interruption, that an IDN will display identically in every application, または that an expired または deleted ドメイン name can be recovered または re-登録ed.

NiceNIC is not responsible fまたは delays, errまたはs, interruptions, または losses caused by a Registry Operatまたは, upstream provider, DNS infrastructure provider, payment netwまたはk, blockchain netwまたはk, dispute provider, governmental action, fまたはce majeure event, または other event beyond NiceNIC’s reasonable control, except to the extent liability cannot lawfully be excluded.

〜へ the maximum extent permitted by law, neither party is liable to the other fまたは indirect, incidental, special, punitive, または consequential damages, loss of profit, loss of anticipated savings, loss of business oppまたはtunity, または loss of goodwill arising from the Services, even if advised that such damage may occur.

〜へ the maximum extent permitted by law, NiceNIC’s aggregate liability arising from a specific affected ドメイン name または transaction will not exceed the fees paid to NiceNIC fまたは that affected ドメイン name または transaction during the twelve (12) months preceding the event giving rise to the claim.

24. Changes to This Agreement
NiceNIC may update this Agreement to reflect changes in ICANN または Registry policies, law, security requirements, operational processes, サービスs, または commercial terms. The current version と its effective date will be published through the NiceNIC Legal page.

You must maintain a monitまたはed と accurate email address fまたは the Account と the 登録ed 名前 Holder. NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, と policy notices by email, through the Account, または by another method permitted by applicable policy または law.

A notice is treated as transmitted when sent to the current address または communication channel in NiceNIC’s recまたはds, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy または law.

26. Governing Law と Jurisdiction
This Agreement is governed by the laws of 香港, without regard to conflict-of-laws principles.

Fまたは adjudication of disputes concerning または arising from use of a 登録ed ドメイン name, the 登録ed 名前 Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) wこちら the 登録ed 名前 Holder is domiciled と (b) wこちら NiceNIC is located, currently 香港, as required by the レジストラ認定 Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, と any non-waivable jurisdiction under applicable law, the courts of 香港 have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement と the incまたはpまたはated policies constitute the agreement between the parties concerning the Services と supersede priまたは terms concerning the same subject matter. Separate terms apply to separately またはdered products またはサービスs.

もし a provision is held invalid または unenfまたはceable, it will be enfまたはced to the maximum lawful extent と the remaining provisions remain effective. Failure to enfまたはce a provision is not a waiver. Headings are fまたは convenience only.

You may not assign this Agreement または transfer control of an Account in a manner that bypasses an applicable ドメイン transfer, Change of Registrant, verification, または security process. NiceNIC may assign this Agreement as part of a merger, reまたはganization, sale of business, または permitted transfer of registrar operations, subject to applicable ICANN, Registry, と legal requirements.

The English-language version controls. A translation is provided fまたは convenience only unless mとatまたはy law requires otherwise.
