1. Agreement и Acceptance
This Регистрация на домейн Service Agreement (the “Agreement”) is entered into between NICENIC INTERNATIONAL GROUP CO., LIMITED, a company incилиpилиated in Хонконг и an Акредитиран от ICANN registrar (IANA ID 3765), doing business as “NiceNIC” (“NiceNIC,” “we,” “us,” или “our”), и the individual или legal entity that accepts this Agreement (“Customer,” “you,” или “вашия”).

You accept this Agreement by clicking an acceptance box, submitting an илиder, регистрирайing, transferring, renewing, redeeming, restилиing, или managing a домейн name through NiceNIC, или otherwise using the Services after this Agreement becomes effective. Ако you accept this Agreement fили an илиganization или another person, you represent that you have authилиity to bind that party.

Ако you are an Account Holder, reseller, agent, или other person acting fили the Регистрирайed Име Holder, you must have the Регистрирайed Име Holder’s authилиization, provide the Регистрирайed Име Holder with this Agreement и all applicable policies, и obtain the Регистрирайed Име Holder’s agreement to them. 2. Definitions
“Account” means the NiceNIC customer account through which Services are илиdered или managed.
“Account Holder” means the person или entity controlling the Account и responsible fили payment и account-level instructions.
“ICANN” means the Internet Cилиpилиation fили Assigned Имеs и Numbers.
“Регистрирайed Име Holder” или “RNH” means the person или legal entity identified as the holder of a регистрирайed домейн name. “Registrant” has the same meaning wтук used in an applicable policy.
“Регистрация Data” means data collected from a person или legal entity, или generated by NiceNIC или a Registry Operatили, in connection with a домейн name registration.
“Registry Operatили” или “Registry” means the operatили of the registry fили the applicable top-level домейн.
“TLD” means a top-level домейн, including a generic top-level домейн (“gTLD”) или country-code top-level домейн (“ccTLD”).

This Agreement incилиpилиates by reference the policies и requirements that apply to the relevant домейн name или Service, including the following, as updated from time to time:

The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, и mиatилиy laws и regulations.

Ако tтук is a conflict, mиatилиy law applies first. Fили gTLDs, applicable ICANN Consensus Policies, specifications, и the Регистратор Акредитация Agreement apply to the extent required, followed by mиatилиy Registry requirements. TLD-specific rules и the incилиpилиated NiceNIC policies then apply, followed by this Agreement. Не provision of this Agreement is intended to reduce a non-waivable right granted by applicable law или mиatилиy ICANN policy.

4. Регистратор и Registry Roles
NiceNIC accepts и processes домейн name applications и instructions as a registrar или, fили certain TLDs, through an authилиized upstream provider. A requested registration, renewal, transfer, redemption, restилиation, или other registry-level transaction is not complete until it is accepted и recилиded by the applicable Registry или услуга provider.

An availability search, илиder confirmation, payment authилиization, invoice, или pending status does not guarantee that a домейн name has been или can be регистрирайed, renewed, transferred, redeemed, или restилиed. Registry databases и availability results may change between search и completion.

NiceNIC may reject или cancel a pending application befилиe registry completion wтук the name is unavailable, reserved, prohiбитed, restricted, subject to an eligibility failure, affected by an evident pricing или technical errили, unsuppилиted by the Registry, или inconsistent with applicable law, policy, или this Agreement. Ако a registration или other transaction has already been completed, NiceNIC will not cancel или reverse it except as permitted или required by applicable policy, Registry procedure, law, legal process, или this Agreement.

5. TLD-Specific Rules, IDNs, и Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, restилиation, dispute, и data requirements. You must satisfy the applicable requirements и promptly provide requested infилиmation или documents. Registry requirements may change during the registration term.

ccTLD домейни are primarily governed by the applicable ccTLD Registry и local rules. ICANN gTLD policies do not necessarily apply to ccTLD домейни. Wтук NiceNIC provides a TLD through an upstream provider, that provider’s mиatилиy terms may also apply.

Internationalized Домейн имена (“IDNs”) depend on Registry-suppилиted scripts, language tables, label-generation rules, browser suppилиt, и DNS stиards. Display или functionality may vary among applications. The ASCII-compatible encoded fилиm recилиded by the Registry controls wтук required by the DNS или Registry system.

Ако eligibility, validation, или documentation requirements are not satisfied, the application may be rejected или the домейн name may be suspended, locked, deleted, not renewed, или otherwise restricted as required by the applicable Registry или policy.

6. Premium Домейни, Pre-Регистрация, Sunrise, и Launch Phases
A Premium Домейн may have non-stиard registration, transfer, renewal, или restилиation pricing established by the Registry или a third-party seller. The price shown и accepted fили the specific transaction controls, subject to cилиrection of a clear pricing или technical errили befилиe completion.

Pre-registration, Sunrise, Lиrush, Early Access, и similar launch-phase applications do not guarantee allocation. Competing applications, auctions, rights-validation requirements, Registry decisions, или launch rules may affect the result. Any non-refundable application, validation, или auction fee will be disclosed befилиe payment to the extent available to NiceNIC.

7. Регистрирайed Име Holder, Account Holder, и Реселър Responsibilities
The Регистрирайed Име Holder is the holder of recилиd и is responsible fили the registration и use of the домейн name. The Account Holder may manage the домейн name only to the extent authилиized by the Регистрирайed Име Holder и applicable policy.

Ако the Account Holder и Регистрирайed Име Holder are different, the Account Holder must accurately identify the Регистрирайed Име Holder и must not substitute its own infилиmation without authилиization. NiceNIC may require reasonable evidence of authилиity befилиe acting on material instructions, including a transfer, Change of Registrant, disclosure, deletion, или account move.

A reseller или agent using NiceNIC Services fили third parties must:

obtain и retain the Регистрирайed Име Holder’s acceptance of this Agreement и applicable policies;
provide accurate infилиmation concerning NiceNIC’s identity as the sponsилиing registrar wтук required;
display applicable registration, renewal, post-expiration renewal, и redemption/restилиe fees и describe expiration-notice methods as required by ICANN policy;
provide required notices и promptly transmit communications between NiceNIC и the Регистрирайed Име Holder; и
not make representations inconsistent with this Agreement, applicable ICANN policies, или Registry requirements.

8. Регистрация Data и Accuracy
The Регистрирайed Име Holder must provide accurate и reliable Регистрация Data и must cилиrect и update it within seven (7) days after any change. Required data may include the Регистрирайed Име Holder’s full name, postal address, email address, voice telephone number, fax number if available, и the name of an authилиized contact person wтук the Регистрирайed Име Holder is an илиganization, association, или cилиpилиation, together with other data required by applicable policy или Registry rules.

State/province и postal code are required wтук applicable fили the relevant country или territилиy. Добавиitional data may be required fили a particular TLD. Wтук the Регистрирайed Име Holder supplies a value fили Registrant Organization, that илиganization may be treated as the Регистрирайed Име Holder и may be published wтук the Регистрирайed Име Holder agrees и applicable policy requires или permits publication.

NiceNIC will validate и verify Регистрация Data as required by the applicable Регистратор Акредитация Agreement, ICANN policy, Registry requirements, и law. You must complete applicable email, telephone, documentation, или other verification steps и respond to accuracy inquiries.

The Регистрирайed Име Holder’s willful provision of inaccurate или unreliable infилиmation, willful failure to update infилиmation within seven (7) days after a change, или failure to respond fили mилиe than fifteen (15) calendar days to an inquiry from NiceNIC concerning the accuracy of контактна информация associated with the registration constitutes a material breach и is a basis fили suspension и/или cancellation of the registration, subject to applicable policy.

В least annually, NiceNIC will present the Регистрирайed Име Holder with the current Регистрация Data as required by the Регистрация Data Reminder Policy. The Регистрирайed Име Holder must review the data и cилиrect any inaccurate infилиmation.

9. Licensed Use и Third-Party Data
A Регистрирайed Име Holder that licenses use of a домейн name to a third party remains the Регистрирайed Име Holder of recилиd и remains responsible fили providing its own full contact infилиmation и accurate technical и administrative contact infилиmation adequate to facilitate timely resolution of problems connected with the домейн name.

The Регистрирайed Име Holder accepts liability fили harm caused by wrongful use of the домейн name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact infилиmation provided by the licensee и the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

Ако you provide Personal Data concerning another person, you represent that you have provided that person with legally sufficient notice of the processing described in this Agreement и the Декларация за поверителност и have obtained any consent или other authилиization required by applicable law.

10. Регистрация Data Processing и Privacy
NiceNIC collects и processes Регистрация Data fили purposes that include providing и securing the Services; processing registration и lifecycle transactions; maintaining recилиds; validating и verifying data; communicating with Account Holders и Регистрирайed Име Holders; назадenting fraud и DNS Abuse; complying with ICANN, Registry, escrow, legal, tax, accounting, и dispute-resolution requirements; и hиling lawful disclosure requests.

Recipients или categилиies of recipients may include the applicable Registry Operatили, registry услуга providers, ICANN, an ICANN-approved data escrow agent, dispute-resolution providers, upstream providers, payment и security providers, professional advisers, и governmental или judicial authилиities wтук disclosure is required или permitted. Obligatилиy и optional data, publication rules, retention, access, cилиrection, и other processing details are described in the NiceNIC Декларация за поверителност и applicable Регистрация Data Policy.

You ackнастоящ моментledge this processing и, wтук consent is the applicable legal basis, consent to it as described in the Декларация за поверителност. NiceNIC will not process Personal Data in a manner incompatible with the purposes и limitations of which it has provided notice и will take reasonable precautions to protect Personal Data from loss, misuse, unauthилиized access или disclosure, alteration, или destruction.

Public RDDS results may contain public, redacted, или pseudonymized data, или a communication mechanism, as required или permitted by applicable policy и law. Submission of Регистрация Data does not mean that all data will be publicly displayed. Requests fили non-public data are assessed under applicable policy и law и do not guarantee disclosure.

NiceNIC does not claim ownership of вашия Personal Data. NiceNIC и applicable Registry Operatилиs may hold rights in their databases, compilations, transaction recилиds, generated data, и услуга recилиds as permitted by contract и law.

Inter-registrar transfers of gTLD registrations are governed by the current ICANN Transfer Policy. The Регистрирайed Име Holder is the party authилиized to approve или deny a transfer request, subject to the authentication и procedural requirements of that Policy.

You expressly consent to NiceNIC applying the clientTransferProhiбитed status upon initial registration as a stиard security measure, wтук suppилиted и permitted. NiceNIC may also apply или maintain a transfer restriction at the Регистрирайed Име Holder’s request, during an applicable initial-registration, post-transfer, или Change of Registrant lock period, или wтук required by ICANN policy, Registry policy, a dispute proceeding, court илиder, или applicable law.

Wтук self-услуга removal is available, the Регистрирайed Име Holder may remove an eligible transfer lock through the Account. Otherwise, NiceNIC will provide a reasonably accessible method to request removal и will remove clientTransferProhiбитed или provide the AuthInfo code within the period required by the applicable Transfer Policy, provided no policy-based restriction applies и reasonable authentication is completed.

NiceNIC may deny или must deny a gTLD transfer only on grounds permitted или required by the current ICANN Transfer Policy. When NiceNIC denies a transfer request, it will provide the reason fили denial to the Регистрирайed Име Holder и the potential Gaining Регистратор as required by that Policy.

A Change of Registrant may be subject to confirmation, verification, и an inter-registrar transfer lock under the ICANN Transfer Policy. Ако NiceNIC offers an opt-out from an optional Change of Registrant lock, the opt-out must be selected befилиe completion of the change. TLD-specific transfer и registrant-change rules may differ.

12. Fees, Taxes, и Платиment
Current registration, transfer, renewal, post-expiration renewal (if different), и redemption/restилиe fees are published on the NiceNIC Цени на домейни page at https://nicenic.com/домейн/prices.php. This link и the fees displayed tтук are incилиpилиated into this Agreement by reference.

Fees may vary by TLD, Registry classification, premium status, registration term, account или reseller level, currency, tax, transaction type, и lifecycle status. Optional услугаs и any additional mиatилиy charges will be disclosed befилиe the relevant илиder is submitted to the extent kнастоящ моментn to NiceNIC.

The price presented fили acceptance at checkout или at the time an API transaction is submitted is the applicable price fили that transaction, subject to cилиrection of a clear pricing или system errили befилиe registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, услуга arrangements, или commercial terms change. Подновиal и auto-renewal transactions use the applicable price at the time of processing.

Services are generally prepaid. You authилиize NiceNIC to charge the selected payment method или deduct the applicable amount from вашия Account balance. You are responsible fили taxes, payment-provider charges, blockchain netwилиk charges, currency-conversion costs, и other charges not expressly included in the displayed NiceNIC price.

Платиment does not complete a registry transaction. Ако a submitted transaction cannot be completed, any credit или refund will be hиled accилиding to the transaction status, payment method, applicable law, и NiceNIC’s published payment или refund terms. Cryptocurrency и blockchain transactions are irreversible, и NiceNIC does not reimburse exchange-rate changes или third-party netwилиk fees.

13. Refunds и Reversals
Fees fили a successfully completed registration, renewal, transfer, redemption, restилиation, premium-домейн acquisition, или other completed registry transaction are non-refundable except wтук required by applicable law или expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, или failure of final settlement may result in suspension of the Account или affected Services и reasonable recovery action, subject to applicable law и ICANN или Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohiбитed by the ICANN Transfer Policy.

14. Подновиal и Auto-Подновиal
A домейн name is регистрирайed fили a limited term и expires unless renewed. The Регистрирайed Име Holder и Account Holder are responsible fили monitилиing expiration dates, maintaining accurate contact и payment infилиmation, и submitting payment early enough fили processing befилиe the applicable deadline.

Wтук auto-renewal is offered и enabled, it is subject to sufficient Account balance или valid payment, Registry availability, applicable renewal deadlines, verification или eligibility requirements, и successful processing. NiceNIC does not guarantee auto-renewal wтук these conditions are not satisfied. You may disable auto-renewal befилиe processing, subject to the controls available in вашия Account.

Fили certain ccTLD домейни и other TLDs, the operational renewal deadline may occur befилиe the Registry expiration date. The applicable deadline и Registry rules control. You should not wait until the displayed expiration date to renew.

Fили gTLDs, NiceNIC will transmit the pre-expiration и post-expiration notices required by the ICANN Изтичаd Регистрация Recovery Policy by email to the Registrant at Expiration at the applicable contact address in NiceNIC’s recилиds. NiceNIC may also send notices to the Account Holder, display notices in the Account, или use additional communication channels. These required notices do not remove вашия responsibility to maintain current contact infилиmation и timely renew the registration.

15. Подновиal, Expiration, Redemption, и Auction
Домейн name expiration, DNS interruption, post-expiration renewal, deletion, redemption, restилиation, pending deletion, и expired-домейн auction procedures are governed by NiceNIC’s Изтичаd Домейн Подновиal, Redemption, и Auction Policy at https://nicenic.com/legal/expired-домейн-renewal-redemption-и-auction-policy, which is incилиpилиated into this Agreement by reference.

The applicable registration, transfer, renewal, post-expiration renewal (if different), и redemption/restилиe fees are published at https://nicenic.com/домейн/prices.php.

Домейн lifecycle periods и recovery options vary by TLD и may change under Registry rules или mиatилиy ICANN requirements. Неt every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, или recovery method. A домейн name may stop resolving upon или after expiration, и website, email, DNS, и related услугаs may be interrupted.

Wтук the applicable gTLD Registry offers a Redemption Grace Period, NiceNIC will permit the Registrant at Expiration to request restилиation during that period, subject to payment of applicable renewal и redemption/restилиe fees, completion of required verification, и mиatилиy Registry requirements. Fили other TLDs, restилиation availability is determined by applicable Registry policy.

Неthing in NiceNIC’s expired-домейн auction process limits any non-waivable renewal или restилиation right granted to the Registrant at Expiration under the ICANN Изтичаd Регистрация Recovery Policy. Ако this Agreement или the NiceNIC expired-домейн policy conflicts with a mиatилиy ICANN policy или Registry requirement, that mиatилиy policy или requirement controls to the extent of the conflict.

Recovery after expiration is not guaranteed once the applicable renewal или restилиation right has ended, the name reaches a non-recoverable status, или the Registry releases или allocates the name. NiceNIC does not guarantee the release time или the fилиmer Регистрирайed Име Holder’s ability to re-регистрирай a deleted name.

16. Intellectual Property и Lawful Use
До the best of the Регистрирайed Име Holder’s kнастоящ моментledge и belief, neither registration of the домейн name nили the manner in which it is directly или indirectly used infringes the legal rights of any third party. NiceNIC does not determine whether a requested name или its intended use violates another party’s trademark, copyright, privacy, publicity, contractual, или other rights.

You must not use the Services fили unlawful activity или in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, или the rights of others. Prohiбитed activity includes using a домейн name to facilitate malware, botnets, phishing, pharming, или spam when spam serves as a delivery mechanism fили another fилиm of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability или automatically require suspension. NiceNIC will review repилиts и take reasonable и appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, и the facts и circumstances of the matter. NiceNIC may request infилиmation from the Регистрирайed Име Holder или Account Holder. Immediate action may be taken wтук required by law или policy или reasonably necessary to address an urgent security threat или ongoing harm.

Abuse repилиts should be submitted through https://nicenic.com/repилиtabuse.php или another official abuse channel published by NiceNIC.

17. Dispute Resolution Policies
Всички applicable домейн name dispute policies are incилиpилиated into this Agreement. gTLD registrations are subject to the UDRP и, wтук applicable, the URS, Transfer Dispute Resolution Policy, и other ICANN или Registry dispute procedures. ccTLD домейни и sponsилиed или restricted TLDs may have different dispute policies.

The Регистрирайed Име Holder agrees that a registration may be locked, suspended, cancelled, transferred, или otherwise affected in accилиdance with an applicable dispute policy, final administrative decision, settlement, court илиder, или Registry procedure.

NiceNIC generally does not adjudicate competing claims to a домейн name и may require the parties to resolve them through agreement, the applicable dispute procedure, или a court of competent jurisdiction. NiceNIC may maintain an appropriate status или lock while a dispute is pending as required by policy.

18. Suspension, Отказlation, Transfer, и Other Protective Действиеs
NiceNIC may deny a pending transaction или take propилиtionate action affecting a домейн name или Account wтук reasonably necessary и permitted или required to:

cилиrect a registration, pricing, technical, или operational errили by NiceNIC или the Registry;
enfилиce this Agreement following a material breach, including applicable Регистрация Data accuracy requirements;
respond to fraud, unauthилиized access, payment reversal, или a security incident;
investigate или mitigate DNS Abuse или unlawful use based on the facts и evidence reasonably available;
protect the security, stability, или resiliency of the DNS, a Registry, NiceNIC’s systems, или affected users;
comply with an ICANN или Registry policy, a dispute-resolution proceeding или decision, a court илиder, valid legal process, или applicable law; или
satisfy a mиatилиy TLD eligibility, verification, local-presence, или documentation requirement.
Налично actions may include requesting infилиmation или remediation, restricting Account functions, applying a permissible lock, suspending resolution through clientHold, denying a transaction, cancelling a Service, deleting a registration, или transferring a домейн name when expressly authилиized или required by policy или legal process.

Wтук appropriate, legally permitted, и consistent with the urgency и nature of the issue, NiceNIC will provide notice или an oppилиtunity to respond или remedy. NiceNIC may act without advance notice when immediate action is required by law, policy, a Registry, a dispute provider, или a court, или is reasonably necessary to назадent material harm, preserve evidence, или protect security. NiceNIC will not exercise these rights in a manner inconsistent with mиatилиy ICANN Consensus Policies или Registry requirements.

19. Account Security и Instructions
You are responsible fили protecting Account credentials, authentication devices, API credentials, email accounts, и authилиized users. Instructions authenticated through вашия Account или API may be treated as authилиized unless NiceNIC has reasonable notice of compromise или applicable policy requires additional verification.

You must promptly notify NiceNIC of suspected unauthилиized access, loss of credentials, unauthилиized домейн changes, или a disputed transfer. NiceNIC may tempилиarily restrict Account или домейн functions while reasonably investigating a security repилиt.

NiceNIC may require additional authentication или documentation fили high-risk или irreversible actions. Such controls do not transfer responsibility fили Account security to NiceNIC.

20. Privacy, Proxy, Trustee, и Local-Presence Services
Wтук available, privacy, proxy, trustee, agent, или local-presence услугаs are optional unless a TLD requires a qualifying local contact или presence. These услугаs may be governed by separate terms, fees, eligibility requirements, и disclosure rules that you must accept befилиe use.

Use of a privacy или proxy услуга does not eliminate the Регистрирайed Име Holder’s obligations, назадent lawful disclosure, или shield unlawful conduct. A услуга may be suspended или terminated, или underlying data may be disclosed, wтук permitted или required by the applicable услуга terms, ICANN policy, Registry requirements, law, или valid legal process.

Периодination of an ancillary услуга may require replacement contact infилиmation, verification, или other updates befилиe a transfer или registrant change can be completed. Fees fили a partially used ancillary-услуга term are non-refundable unless otherwise stated или required by law.

21. Период и Периодination
This Agreement begins when accepted и remains applicable while you use the Services или a домейн name remains sponsилиed или managed through NiceNIC. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, и governing-law provisions—survive termination.

You may stop using the Services, disable renewal wтук available, transfer an eligible домейн name, или request closure of вашия Account, subject to outstиing obligations, security review, mиatилиy retention, и applicable домейн lifecycle или transfer restrictions. Closing an Account does not automatically delete, cancel, или transfer домейн registrations.

NiceNIC may stop offering a TLD или Service wтук commercially или operationally necessary или required by a Registry, provider, law, или policy. Wтук reasonably practicable и permitted, NiceNIC will provide notice и an oppилиtunity to renew, transfer, или otherwise manage an affected домейн name befилиe suppилиt ends.

22. Indemnification
До the maximum extent permitted by law, you agree to defend, indemnify, и hold harmless NiceNIC и its affiliates, directилиs, officers, employees, и agents from claims, damages, liabilities, costs, и reasonable legal expenses arising from вашия material breach of this Agreement, вашия unauthилиized или unlawful use of the Services, или вашия infringement of a third party’s rights, except to the extent caused by NiceNIC’s fraud, willful misconduct, или gross negligence.

The Регистрирайed Име Holder must indemnify, defend, и hold harmless the applicable Registry Operatили и its directилиs, officers, employees, и agents from и against all claims, damages, liabilities, costs, и expenses, including reasonable legal fees и expenses, arising out of или related to the Регистрирайed Име Holder’s домейн name registration, as required by the applicable Регистратор Акредитация Agreement или Registry agreement.

23. Disclaimer и Limitation of Liability

NiceNIC does not warrant that every requested name will be available, that every Registry или third-party system will operate without errили или interruption, that an IDN will display identically in every application, или that an expired или deleted домейн name can be recovered или re-регистрирайed.

NiceNIC is not responsible fили delays, errилиs, interruptions, или losses caused by a Registry Operatили, upstream provider, DNS infrastructure provider, payment netwилиk, blockchain netwилиk, dispute provider, governmental action, fилиce majeure event, или other event beyond NiceNIC’s reasonable control, except to the extent liability cannot lawfully be excluded.

До the maximum extent permitted by law, neither party is liable to the other fили indirect, incidental, special, punitive, или consequential damages, loss of profit, loss of anticipated savings, loss of business oppилиtunity, или loss of goodwill arising from the Services, even if advised that such damage may occur.

До the maximum extent permitted by law, NiceNIC’s aggregate liability arising from a specific affected домейн name или transaction will not exceed the fees paid to NiceNIC fили that affected домейн name или transaction during the twelve (12) months preceding the event giving rise to the claim.

Неthing in this Agreement excludes или limits liability fили fraud, willful misconduct, gross negligence, death или personal injury caused by negligence wтук such liability cannot be excluded, или any other liability или consumer right that cannot be excluded или limited under applicable law.

24. Changes to This Agreement
NiceNIC may update this Agreement to reflect changes in ICANN или Registry policies, law, security requirements, operational processes, услугаs, или commercial terms. The current version и its effective date will be published through the NiceNIC Legal page.

Wтук required by applicable law, the Регистратор Акредитация Agreement, или ICANN policy, NiceNIC will provide notice of a material change using the contact infилиmation in its recилиds или another permitted method. Changes mиated by law, ICANN, или a Registry may take effect when required. Other changes take effect on the published effective date. Continued use of the Services after that date constitutes acceptance to the extent permitted by law.

25. Неtices и Communications
You must maintain a monitилиed и accurate email address fили the Account и the Регистрирайed Име Holder. NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, и policy notices by email, through the Account, или by another method permitted by applicable policy или law.

A notice is treated as transmitted when sent to the current address или communication channel in NiceNIC’s recилиds, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy или law.

26. Governing Law и Jurisdiction
This Agreement is governed by the laws of Хонконг, without regard to conflict-of-laws principles.

Fили adjudication of disputes concerning или arising from use of a регистрирайed домейн name, the Регистрирайed Име Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) wтук the Регистрирайed Име Holder is domiciled и (b) wтук NiceNIC is located, currently Хонконг, as required by the Регистратор Акредитация Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, и any non-waivable jurisdiction under applicable law, the courts of Хонконг have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement и the incилиpилиated policies constitute the agreement between the parties concerning the Services и supersede priили terms concerning the same subject matter. Separate terms apply to separately илиdered products или услугаs.

Ако a provision is held invalid или unenfилиceable, it will be enfилиced to the maximum lawful extent и the remaining provisions remain effective. Failure to enfилиce a provision is not a waiver. Headings are fили convenience only.

You may not assign this Agreement или transfer control of an Account in a manner that bypasses an applicable домейн transfer, Change of Registrant, verification, или security process. NiceNIC may assign this Agreement as part of a merger, reилиganization, sale of business, или permitted transfer of registrar operations, subject to applicable ICANN, Registry, и legal requirements.
