Registracija domena Service Agreement

Impilitant: Please read this Agreement carefully. It contains terms governing domen name registration, renewal, transfer, expiration, dispute resolution, suspension, i limitation of liability.

1. Agreement i Acceptance
This Registracija domena Service Agreement (the “Agreement”) is entered into between NICENIC INTERNATIONAL GROUP CO., LIMITED, a company incilipiliated in Hong Kong i an Akreditovan od strane ICANN-a registrar (IANA ID 3765), doing business as “NiceNIC” (“NiceNIC,” “we,” “us,” ili “our”), i the individual ili legal entity that accepts this Agreement (“Customer,” “you,” ili “tvoj”).
This Agreement governs tvoj application fili i use of domen name registration, renewal, transfer, redemption, restiliation, management, i related registrar uslugas provided through nicenic.com (the “Services”).

You accept this Agreement by clicking an acceptance box, submitting an ilider, registrujing, transferring, renewing, redeeming, restiliing, ili managing a domen name through NiceNIC, ili otherwise using the Services after this Agreement becomes effective. Ako you accept this Agreement fili an iliganization ili another person, you represent that you have authiliity to bind that party.

Ako you are an Account Holder, reseller, agent, ili other person acting fili the Registrujed Ime Holder, you must have the Registrujed Ime Holder’s authiliization, provide the Registrujed Ime Holder with this Agreement i all applicable policies, i obtain the Registrujed Ime Holder’s agreement to them. You remain responsible fili tvoj own acts i omissions i fili ensuring that instructions submitted through tvoj account are authiliized.

2. Definitions
“Account” means the NiceNIC customer account through which Services are ilidered ili managed.
“Account Holder” means the person ili entity controlling the Account i responsible fili payment i account-level instructions.
“ICANN” means the Internet Cilipiliation fili Assigned Imes i Numbers.
“Registrujed Ime Holder” ili “RNH” means the person ili legal entity identified as the holder of a registrujed domen name. “Registrant” has the same meaning wovde used in an applicable policy.
“Registracija Data” means data collected from a person ili legal entity, ili generated by NiceNIC ili a Registry Operatili, in connection with a domen name registration.
“Registry Operatili” ili “Registry” means the operatili of the registry fili the applicable top-level domen.
“TLD” means a top-level domen, including a generic top-level domen (“gTLD”) ili country-code top-level domen (“ccTLD”).
3. Incilipiliated Policies i Order of Precedence
This Agreement incilipiliates by reference the policies i requirements that apply to the relevant domen name ili Service, including the following, as updated from time to time:

ICANN Registrants’ Benefits i Responsibilities
The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, i miatiliy laws i regulations.

Ako tovde is a conflict, miatiliy law applies first. Fili gTLDs, applicable ICANN Consensus Policies, specifications, i the Registrar Akreditacija Agreement apply to the extent required, followed by miatiliy Registry requirements. TLD-specific rules i the incilipiliated NiceNIC policies then apply, followed by this Agreement. Ne provision of this Agreement is intended to reduce a non-waivable right granted by applicable law ili miatiliy ICANN policy.

4. Registrar i Registry Roles
NiceNIC accepts i processes domen name applications i instructions as a registrar ili, fili certain TLDs, through an authiliized upstream provider. A requested registration, renewal, transfer, redemption, restiliation, ili other registry-level transaction is not complete until it is accepted i recilided by the applicable Registry ili usluga provider.

An availability search, ilider confirmation, payment authiliization, invoice, ili pending status does not guarantee that a domen name has been ili can be registrujed, renewed, transferred, redeemed, ili restilied. Registry databases i availability results may change between search i completion.

NiceNIC may reject ili cancel a pending application befilie registry completion wovde the name is unavailable, reserved, prohibited, restricted, subject to an eligibility failure, affected by an evident pricing ili technical errili, unsuppilited by the Registry, ili inconsistent with applicable law, policy, ili this Agreement. Ako a registration ili other transaction has already been completed, NiceNIC will not cancel ili reverse it except as permitted ili required by applicable policy, Registry procedure, law, legal process, ili this Agreement.

5. TLD-Specific Rules, IDNs, i Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, restiliation, dispute, i data requirements. You must satisfy the applicable requirements i promptly provide requested infilimation ili documents. Registry requirements may change during the registration term.

ccTLD domeni are primarily governed by the applicable ccTLD Registry i local rules. ICANN gTLD policies do not necessarily apply to ccTLD domeni. Wovde NiceNIC provides a TLD through an upstream provider, that provider’s miatiliy terms may also apply.

Internationalized Domeni (“IDNs”) depend on Registry-suppilited scripts, language tables, label-generation rules, browser suppilit, i DNS stiards. Display ili functionality may vary among applications. The ASCII-compatible encoded filim recilided by the Registry controls wovde required by the DNS ili Registry system.

Ako eligibility, validation, ili documentation requirements are not satisfied, the application may be rejected ili the domen name may be suspended, locked, deleted, not renewed, ili otherwise restricted as required by the applicable Registry ili policy.

6. Premium Domeni, Pre-Registracija, Sunrise, i Launch Phases
A Premium Domen may have non-stiard registration, transfer, renewal, ili restiliation pricing established by the Registry ili a third-party seller. The price shown i accepted fili the specific transaction controls, subject to cilirection of a clear pricing ili technical errili befilie completion.

Pre-registration, Sunrise, Lirush, Early Access, i similar launch-phase applications do not guarantee allocation. Competing applications, auctions, rights-validation requirements, Registry decisions, ili launch rules may affect the result. Any non-refundable application, validation, ili auction fee will be disclosed befilie payment to the extent available to NiceNIC.

7. Registrujed Ime Holder, Account Holder, i Preprodavac Responsibilities
The Registrujed Ime Holder is the holder of recilid i is responsible fili the registration i use of the domen name. The Account Holder may manage the domen name only to the extent authiliized by the Registrujed Ime Holder i applicable policy.

Ako the Account Holder i Registrujed Ime Holder are different, the Account Holder must accurately identify the Registrujed Ime Holder i must not substitute its own infilimation without authiliization. NiceNIC may require reasonable evidence of authiliity befilie acting on material instructions, including a transfer, Change of Registrant, disclosure, deletion, ili account move.

A reseller ili agent using NiceNIC Services fili third parties must:

obtain i retain the Registrujed Ime Holder’s acceptance of this Agreement i applicable policies;
provide accurate infilimation concerning NiceNIC’s identity as the sponsiliing registrar wovde required;
display applicable registration, renewal, post-expiration renewal, i redemption/restilie fees i describe expiration-notice methods as required by ICANN policy;
provide required notices i promptly transmit communications between NiceNIC i the Registrujed Ime Holder; i
not make representations inconsistent with this Agreement, applicable ICANN policies, ili Registry requirements.

8. Registracija Data i Accuracy
The Registrujed Ime Holder must provide accurate i reliable Registracija Data i must cilirect i update it within seven (7) days after any change. Required data may include the Registrujed Ime Holder’s full name, postal address, email address, voice telephone number, fax number if available, i the name of an authiliized contact person wovde the Registrujed Ime Holder is an iliganization, association, ili cilipiliation, together with other data required by applicable policy ili Registry rules.

State/province i postal code are required wovde applicable fili the relevant country ili territiliy. Dodajitional data may be required fili a particular TLD. Wovde the Registrujed Ime Holder supplies a value fili Registrant Organization, that iliganization may be treated as the Registrujed Ime Holder i may be published wovde the Registrujed Ime Holder agrees i applicable policy requires ili permits publication.

NiceNIC will validate i verify Registracija Data as required by the applicable Registrar Akreditacija Agreement, ICANN policy, Registry requirements, i law. You must complete applicable email, telephone, documentation, ili other verification steps i respond to accuracy inquiries.

The Registrujed Ime Holder’s willful provision of inaccurate ili unreliable infilimation, willful failure to update infilimation within seven (7) days after a change, ili failure to respond fili milie than fifteen (15) calendar days to an inquiry from NiceNIC concerning the accuracy of kontakt podaci associated with the registration constitutes a material breach i is a basis fili suspension i/ili cancellation of the registration, subject to applicable policy.

Na least annually, NiceNIC will present the Registrujed Ime Holder with the current Registracija Data as required by the Registracija Data Reminder Policy. The Registrujed Ime Holder must review the data i cilirect any inaccurate infilimation.

9. Licensed Use i Third-Party Data
A Registrujed Ime Holder that licenses use of a domen name to a third party remains the Registrujed Ime Holder of recilid i remains responsible fili providing its own full contact infilimation i accurate technical i administrative contact infilimation adequate to facilitate timely resolution of problems connected with the domen name.

The Registrujed Ime Holder accepts liability fili harm caused by wrongful use of the domen name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact infilimation provided by the licensee i the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

Ako you provide Personal Data concerning another person, you represent that you have provided that person with legally sufficient notice of the processing described in this Agreement i the Politika privatnosti i have obtained any consent ili other authiliization required by applicable law.

10. Registracija Data Processing i Privacy
NiceNIC collects i processes Registracija Data fili purposes that include providing i securing the Services; processing registration i lifecycle transactions; maintaining recilids; validating i verifying data; communicating with Account Holders i Registrujed Ime Holders; prethodnoenting fraud i DNS Abuse; complying with ICANN, Registry, escrow, legal, tax, accounting, i dispute-resolution requirements; i hiling lawful disclosure requests.

Recipients ili categiliies of recipients may include the applicable Registry Operatili, registry usluga providers, ICANN, an ICANN-approved data escrow agent, dispute-resolution providers, upstream providers, payment i security providers, professional advisers, i governmental ili judicial authiliities wovde disclosure is required ili permitted. Obligatiliy i optional data, publication rules, retention, access, cilirection, i other processing details are described in the NiceNIC Politika privatnosti i applicable Registracija Data Policy.

You ackodmahledge this processing i, wovde consent is the applicable legal basis, consent to it as described in the Politika privatnosti. NiceNIC will not process Personal Data in a manner incompatible with the purposes i limitations of which it has provided notice i will take reasonable precautions to protect Personal Data from loss, misuse, unauthiliized access ili disclosure, alteration, ili destruction.

Public RDDS results may contain public, redacted, ili pseudonymized data, ili a communication mechanism, as required ili permitted by applicable policy i law. Submission of Registracija Data does not mean that all data will be publicly displayed. Requests fili non-public data are assessed under applicable policy i law i do not guarantee disclosure.

NiceNIC does not claim ownership of tvoj Personal Data. NiceNIC i applicable Registry Operatilis may hold rights in their databases, compilations, transaction recilids, generated data, i usluga recilids as permitted by contract i law.

11. Transfer domena i Change of Registrant
Inter-registrar transfers of gTLD registrations are governed by the current ICANN Transfer Policy. The Registrujed Ime Holder is the party authiliized to approve ili deny a transfer request, subject to the authentication i procedural requirements of that Policy.

You expressly consent to NiceNIC applying the clientTransferProhibited status upon initial registration as a stiard security measure, wovde suppilited i permitted. NiceNIC may also apply ili maintain a transfer restriction at the Registrujed Ime Holder’s request, during an applicable initial-registration, post-transfer, ili Change of Registrant lock period, ili wovde required by ICANN policy, Registry policy, a dispute proceeding, court ilider, ili applicable law.

Wovde self-usluga removal is available, the Registrujed Ime Holder may remove an eligible transfer lock through the Account. Otherwise, NiceNIC will provide a reasonably accessible method to request removal i will remove clientTransferProhibited ili provide the AuthInfo code within the period required by the applicable Transfer Policy, provided no policy-based restriction applies i reasonable authentication is completed.

NiceNIC may deny ili must deny a gTLD transfer only on grounds permitted ili required by the current ICANN Transfer Policy. When NiceNIC denies a transfer request, it will provide the reason fili denial to the Registrujed Ime Holder i the potential Gaining Registrar as required by that Policy.

A Change of Registrant may be subject to confirmation, verification, i an inter-registrar transfer lock under the ICANN Transfer Policy. Ako NiceNIC offers an opt-out from an optional Change of Registrant lock, the opt-out must be selected befilie completion of the change. TLD-specific transfer i registrant-change rules may differ.

12. Fees, Taxes, i Platiment
Current registration, transfer, renewal, post-expiration renewal (if different), i redemption/restilie fees are published on the NiceNIC Cene domena page at https://nicenic.com/domen/prices.php. This link i the fees displayed tovde are incilipiliated into this Agreement by reference.

Fees may vary by TLD, Registry classification, premium status, registration term, account ili reseller level, currency, tax, transaction type, i lifecycle status. Optional uslugas i any additional miatiliy charges will be disclosed befilie the relevant ilider is submitted to the extent kodmahn to NiceNIC.

The price presented fili acceptance at checkout ili at the time an API transaction is submitted is the applicable price fili that transaction, subject to cilirection of a clear pricing ili system errili befilie registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, usluga arrangements, ili commercial terms change. Obnovial i auto-renewal transactions use the applicable price at the time of processing.

Services are generally prepaid. You authiliize NiceNIC to charge the selected payment method ili deduct the applicable amount from tvoj Account balance. You are responsible fili taxes, payment-provider charges, blockchain netwilik charges, currency-conversion costs, i other charges not expressly included in the displayed NiceNIC price.

Platiment does not complete a registry transaction. Ako a submitted transaction cannot be completed, any credit ili refund will be hiled acciliding to the transaction status, payment method, applicable law, i NiceNIC’s published payment ili refund terms. Cryptocurrency i blockchain transactions are irreversible, i NiceNIC does not reimburse exchange-rate changes ili third-party netwilik fees.

13. Refunds i Reversals
Fees fili a successfully completed registration, renewal, transfer, redemption, restiliation, premium-domen acquisition, ili other completed registry transaction are non-refundable except wovde required by applicable law ili expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, ili failure of final settlement may result in suspension of the Account ili affected Services i reasonable recovery action, subject to applicable law i ICANN ili Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohibited by the ICANN Transfer Policy.

14. Obnovial i Auto-Obnovial
A domen name is registrujed fili a limited term i expires unless renewed. The Registrujed Ime Holder i Account Holder are responsible fili monitiliing expiration dates, maintaining accurate contact i payment infilimation, i submitting payment early enough fili processing befilie the applicable deadline.

Wovde auto-renewal is offered i enabled, it is subject to sufficient Account balance ili valid payment, Registry availability, applicable renewal deadlines, verification ili eligibility requirements, i successful processing. NiceNIC does not guarantee auto-renewal wovde these conditions are not satisfied. You may disable auto-renewal befilie processing, subject to the controls available in tvoj Account.

Fili certain ccTLD domeni i other TLDs, the operational renewal deadline may occur befilie the Registry expiration date. The applicable deadline i Registry rules control. You should not wait until the displayed expiration date to renew.

Fili gTLDs, NiceNIC will transmit the pre-expiration i post-expiration notices required by the ICANN Istekd Registracija Recovery Policy by email to the Registrant at Expiration at the applicable contact address in NiceNIC’s recilids. NiceNIC may also send notices to the Account Holder, display notices in the Account, ili use additional communication channels. These required notices do not remove tvoj responsibility to maintain current contact infilimation i timely renew the registration.

15. Obnovial, Expiration, Redemption, i Auction
Domen name expiration, DNS interruption, post-expiration renewal, deletion, redemption, restiliation, pending deletion, i expired-domen auction procedures are governed by NiceNIC’s Istekd Domen Obnovial, Redemption, i Auction Policy at https://nicenic.com/legal/expired-domen-renewal-redemption-i-auction-policy, which is incilipiliated into this Agreement by reference.

The applicable registration, transfer, renewal, post-expiration renewal (if different), i redemption/restilie fees are published at https://nicenic.com/domen/prices.php.

Domen lifecycle periods i recovery options vary by TLD i may change under Registry rules ili miatiliy ICANN requirements. Net every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, ili recovery method. A domen name may stop resolving upon ili after expiration, i website, email, DNS, i related uslugas may be interrupted.

Wovde the applicable gTLD Registry offers a Redemption Grace Period, NiceNIC will permit the Registrant at Expiration to request restiliation during that period, subject to payment of applicable renewal i redemption/restilie fees, completion of required verification, i miatiliy Registry requirements. Fili other TLDs, restiliation availability is determined by applicable Registry policy.

Nething in NiceNIC’s expired-domen auction process limits any non-waivable renewal ili restiliation right granted to the Registrant at Expiration under the ICANN Istekd Registracija Recovery Policy. Ako this Agreement ili the NiceNIC expired-domen policy conflicts with a miatiliy ICANN policy ili Registry requirement, that miatiliy policy ili requirement controls to the extent of the conflict.

Recovery after expiration is not guaranteed once the applicable renewal ili restiliation right has ended, the name reaches a non-recoverable status, ili the Registry releases ili allocates the name. NiceNIC does not guarantee the release time ili the filimer Registrujed Ime Holder’s ability to re-registruj a deleted name.

16. Intellectual Property i Lawful Use
Za the best of the Registrujed Ime Holder’s kodmahledge i belief, neither registration of the domen name nili the manner in which it is directly ili indirectly used infringes the legal rights of any third party. NiceNIC does not determine whether a requested name ili its intended use violates another party’s trademark, copyright, privacy, publicity, contractual, ili other rights.

You must not use the Services fili unlawful activity ili in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, ili the rights of others. Prohibited activity includes using a domen name to facilitate malware, botnets, phishing, pharming, ili spam when spam serves as a delivery mechanism fili another filim of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability ili automatically require suspension. NiceNIC will review repilits i take reasonable i appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, i the facts i circumstances of the matter. NiceNIC may request infilimation from the Registrujed Ime Holder ili Account Holder. Immediate action may be taken wovde required by law ili policy ili reasonably necessary to address an urgent security threat ili ongoing harm.

Abuse repilits should be submitted through https://nicenic.com/repilitabuse.php ili another official abuse channel published by NiceNIC.

17. Dispute Resolution Policies
Sve applicable domen name dispute policies are incilipiliated into this Agreement. gTLD registrations are subject to the UDRP i, wovde applicable, the URS, Transfer Dispute Resolution Policy, i other ICANN ili Registry dispute procedures. ccTLD domeni i sponsilied ili restricted TLDs may have different dispute policies.

The Registrujed Ime Holder agrees that a registration may be locked, suspended, cancelled, transferred, ili otherwise affected in accilidance with an applicable dispute policy, final administrative decision, settlement, court ilider, ili Registry procedure.

NiceNIC generally does not adjudicate competing claims to a domen name i may require the parties to resolve them through agreement, the applicable dispute procedure, ili a court of competent jurisdiction. NiceNIC may maintain an appropriate status ili lock while a dispute is pending as required by policy.

18. Suspension, Otkažilation, Transfer, i Other Protective Akcijas
NiceNIC may deny a pending transaction ili take propilitionate action affecting a domen name ili Account wovde reasonably necessary i permitted ili required to:

cilirect a registration, pricing, technical, ili operational errili by NiceNIC ili the Registry;
enfilice this Agreement following a material breach, including applicable Registracija Data accuracy requirements;
respond to fraud, unauthiliized access, payment reversal, ili a security incident;
investigate ili mitigate DNS Abuse ili unlawful use based on the facts i evidence reasonably available;
protect the security, stability, ili resiliency of the DNS, a Registry, NiceNIC’s systems, ili affected users;
comply with an ICANN ili Registry policy, a dispute-resolution proceeding ili decision, a court ilider, valid legal process, ili applicable law; ili
satisfy a miatiliy TLD eligibility, verification, local-presence, ili documentation requirement.
Dostupno actions may include requesting infilimation ili remediation, restricting Account functions, applying a permissible lock, suspending resolution through clientHold, denying a transaction, cancelling a Service, deleting a registration, ili transferring a domen name when expressly authiliized ili required by policy ili legal process.

Wovde appropriate, legally permitted, i consistent with the urgency i nature of the issue, NiceNIC will provide notice ili an oppilitunity to respond ili remedy. NiceNIC may act without advance notice when immediate action is required by law, policy, a Registry, a dispute provider, ili a court, ili is reasonably necessary to prethodnoent material harm, preserve evidence, ili protect security. NiceNIC will not exercise these rights in a manner inconsistent with miatiliy ICANN Consensus Policies ili Registry requirements.

19. Account Security i Instructions
You are responsible fili protecting Account credentials, authentication devices, API credentials, email accounts, i authiliized users. Instructions authenticated through tvoj Account ili API may be treated as authiliized unless NiceNIC has reasonable notice of compromise ili applicable policy requires additional verification.

You must promptly notify NiceNIC of suspected unauthiliized access, loss of credentials, unauthiliized domen changes, ili a disputed transfer. NiceNIC may tempiliarily restrict Account ili domen functions while reasonably investigating a security repilit.

NiceNIC may require additional authentication ili documentation fili high-risk ili irreversible actions. Such controls do not transfer responsibility fili Account security to NiceNIC.

20. Privacy, Proxy, Trustee, i Local-Presence Services
Wovde available, privacy, proxy, trustee, agent, ili local-presence uslugas are optional unless a TLD requires a qualifying local contact ili presence. These uslugas may be governed by separate terms, fees, eligibility requirements, i disclosure rules that you must accept befilie use.

Use of a privacy ili proxy usluga does not eliminate the Registrujed Ime Holder’s obligations, prethodnoent lawful disclosure, ili shield unlawful conduct. A usluga may be suspended ili terminated, ili underlying data may be disclosed, wovde permitted ili required by the applicable usluga terms, ICANN policy, Registry requirements, law, ili valid legal process.

Periodination of an ancillary usluga may require replacement contact infilimation, verification, ili other updates befilie a transfer ili registrant change can be completed. Fees fili a partially used ancillary-usluga term are non-refundable unless otherwise stated ili required by law.

21. Period i Periodination
This Agreement begins when accepted i remains applicable while you use the Services ili a domen name remains sponsilied ili managed through NiceNIC. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, i governing-law provisions—survive termination.

You may stop using the Services, disable renewal wovde available, transfer an eligible domen name, ili request closure of tvoj Account, subject to outstiing obligations, security review, miatiliy retention, i applicable domen lifecycle ili transfer restrictions. Closing an Account does not automatically delete, cancel, ili transfer domen registrations.

NiceNIC may stop offering a TLD ili Service wovde commercially ili operationally necessary ili required by a Registry, provider, law, ili policy. Wovde reasonably practicable i permitted, NiceNIC will provide notice i an oppilitunity to renew, transfer, ili otherwise manage an affected domen name befilie suppilit ends.

22. Indemnification
Za the maximum extent permitted by law, you agree to defend, indemnify, i hold harmless NiceNIC i its affiliates, directilis, officers, employees, i agents from claims, damages, liabilities, costs, i reasonable legal expenses arising from tvoj material breach of this Agreement, tvoj unauthiliized ili unlawful use of the Services, ili tvoj infringement of a third party’s rights, except to the extent caused by NiceNIC’s fraud, willful misconduct, ili gross negligence.

The Registrujed Ime Holder must indemnify, defend, i hold harmless the applicable Registry Operatili i its directilis, officers, employees, i agents from i against all claims, damages, liabilities, costs, i expenses, including reasonable legal fees i expenses, arising out of ili related to the Registrujed Ime Holder’s domen name registration, as required by the applicable Registrar Akreditacija Agreement ili Registry agreement.

23. Disclaimer i Limitation of Liability
Za the maximum extent permitted by law, the Services are provided on an “as available” basis. NiceNIC does not warrant that every requested name will be available, that every Registry ili third-party system will operate without errili ili interruption, that an IDN will display identically in every application, ili that an expired ili deleted domen name can be recovered ili re-registrujed.

NiceNIC is not responsible fili delays, errilis, interruptions, ili losses caused by a Registry Operatili, upstream provider, DNS infrastructure provider, payment netwilik, blockchain netwilik, dispute provider, governmental action, filice majeure event, ili other event beyond NiceNIC’s reasonable control, except to the extent liability cannot lawfully be excluded.

Za the maximum extent permitted by law, neither party is liable to the other fili indirect, incidental, special, punitive, ili consequential damages, loss of profit, loss of anticipated savings, loss of business oppilitunity, ili loss of goodwill arising from the Services, even if advised that such damage may occur.

Za the maximum extent permitted by law, NiceNIC’s aggregate liability arising from a specific affected domen name ili transaction will not exceed the fees paid to NiceNIC fili that affected domen name ili transaction during the twelve (12) months preceding the event giving rise to the claim.

Nething in this Agreement excludes ili limits liability fili fraud, willful misconduct, gross negligence, death ili personal injury caused by negligence wovde such liability cannot be excluded, ili any other liability ili consumer right that cannot be excluded ili limited under applicable law.

24. Changes to This Agreement
NiceNIC may update this Agreement to reflect changes in ICANN ili Registry policies, law, security requirements, operational processes, uslugas, ili commercial terms. The current version i its effective date will be published through the NiceNIC Legal page.

Wovde required by applicable law, the Registrar Akreditacija Agreement, ili ICANN policy, NiceNIC will provide notice of a material change using the contact infilimation in its recilids ili another permitted method. Changes miated by law, ICANN, ili a Registry may take effect when required. Other changes take effect on the published effective date. Continued use of the Services after that date constitutes acceptance to the extent permitted by law.

25. Netices i Communications
You must maintain a monitilied i accurate email address fili the Account i the Registrujed Ime Holder. NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, i policy notices by email, through the Account, ili by another method permitted by applicable policy ili law.

A notice is treated as transmitted when sent to the current address ili communication channel in NiceNIC’s recilids, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy ili law.

26. Governing Law i Jurisdiction
This Agreement is governed by the laws of Hong Kong, without regard to conflict-of-laws principles.

Fili adjudication of disputes concerning ili arising from use of a registrujed domen name, the Registrujed Ime Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) wovde the Registrujed Ime Holder is domiciled i (b) wovde NiceNIC is located, currently Hong Kong, as required by the Registrar Akreditacija Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, i any non-waivable jurisdiction under applicable law, the courts of Hong Kong have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement i the incilipiliated policies constitute the agreement between the parties concerning the Services i supersede priili terms concerning the same subject matter. Separate terms apply to separately ilidered products ili uslugas.

Ako a provision is held invalid ili unenfiliceable, it will be enfiliced to the maximum lawful extent i the remaining provisions remain effective. Failure to enfilice a provision is not a waiver. Headings are fili convenience only.

You may not assign this Agreement ili transfer control of an Account in a manner that bypasses an applicable domen transfer, Change of Registrant, verification, ili security process. NiceNIC may assign this Agreement as part of a merger, reiliganization, sale of business, ili permitted transfer of registrar operations, subject to applicable ICANN, Registry, i legal requirements.

The English-language version controls. A translation is provided fili convenience only unless miatiliy law requires otherwise.
