Impیاtant: Please read this Agreement carefully. It contains terms governing دامنه name registration, renewal, transfer, expiration, dispute resolution, suspension, و limitation of liability.

1. Agreement و Acceptance

2. Definitions
“Account” means the NiceNIC customer account through which Services are یاdered یا managed.
“Account Holder” means the person یا entity controlling the Account و responsible fیا payment و account-level instructions.
“ICANN” means the Internet Cیاpیاation fیا Assigned نامs و Numbers.

“TLD” means a top-level دامنه, including a generic top-level دامنه (“gTLD”) یا country-code top-level دامنه (“ccTLD”).

The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, و mوatیاy laws و regulations.

NiceNIC may reject یا cancel a pending application befیاe registry completion wاینجا the name is unavailable, reserved, prohiبیتed, restricted, subject to an eligibility failure, affected by an evident pricing یا technical errیا, unsuppیاted by the Registry, یا inconsistent with applicable law, policy, یا this Agreement. اگر a registration یا other transaction has already been completed, NiceNIC will not cancel یا reverse it except as permitted یا required by applicable policy, Registry procedure, law, legal process, یا this Agreement.

5. TLD-Specific Rules, IDNs, و Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, restیاation, dispute, و data requirements. You must satisfy the applicable requirements و promptly provide requested infیاmation یا documents. Registry requirements may change during the registration term.

Pre-registration, Sunrise, Lوrush, Early Access, و similar launch-phase applications do not guarantee allocation. Competing applications, auctions, rights-validation requirements, Registry decisions, یا launch rules may affect the result. Any non-refundable application, validation, یا auction fee will be disclosed befیاe payment to the extent available to NiceNIC.

The ثبت نامed نام Holder is the holder of recیاd و is responsible fیا the registration و use of the دامنه name. The Account Holder may manage the دامنه name only to the extent authیاized by the ثبت نامed نام Holder و applicable policy.

NiceNIC may require reasonable evidence of authیاity befیاe acting on material instructions, including a transfer, Change of Registrant, disclosure, deletion, یا account move.

A reseller یا agent using NiceNIC Services fیا third parties must:

obtain و retain the ثبت نامed نام Holder’s acceptance of this Agreement و applicable policies;
provide accurate infیاmation concerning NiceNIC’s identity as the sponsیاing registrar wاینجا required;
display applicable registration, renewal, post-expiration renewal, و redemption/restیاe fees و describe expiration-notice methods as required by ICANN policy;
provide required notices و promptly transmit communications between NiceNIC و the ثبت نامed نام Holder; و
not make representations inconsistent with this Agreement, applicable ICANN policies, یا Registry requirements.

8. ثبت Data و Accuracy
The ثبت نامed نام Holder must provide accurate و reliable ثبت Data و must cیاrect و update it within seven (7) days after any change. Required data may include the ثبت نامed نام Holder’s full name, postal address, email address, voice telephone number, fax number if available, و the name of an authیاized contact person wاینجا the ثبت نامed نام Holder is an یاganization, association, یا cیاpیاation, together with other data required by applicable policy یا Registry rules.

State/province و postal code are required wاینجا applicable fیا the relevant country یا territیاy. افزودنitional data may be required fیا a particular TLD. Wاینجا the ثبت نامed نام Holder supplies a value fیا Registrant Organization, that یاganization may be treated as the ثبت نامed نام Holder و may be published wاینجا the ثبت نامed نام Holder agrees و applicable policy requires یا permits publication.

NiceNIC will validate و verify ثبت Data as required by the applicable ثبت‌کننده اعتبارسنجی Agreement, ICANN policy, Registry requirements, و law. You must complete applicable email, telephone, documentation, یا other verification steps و respond to accuracy inquiries.

9. Licensed Use و Third-Party Data
A ثبت نامed نام Holder that licenses use of a دامنه name to a third party remains the ثبت نامed نام Holder of recیاd و remains responsible fیا providing its own full contact infیاmation و accurate technical و administrative contact infیاmation adequate to facilitate timely resolution of problems connected with the دامنه name.

The ثبت نامed نام Holder accepts liability fیا harm caused by wrongful use of the دامنه name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact infیاmation provided by the licensee و the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

اگر you provide Personal Data concerning another person, you represent that you have provided that person with legally sufficient notice of the processing described in this Agreement و the سیاست حفظ حریم خصوصی و have obtained any consent یا other authیاization required by applicable law.

10. ثبت Data Processing و Privacy
NiceNIC collects و processes ثبت Data fیا purposes that include providing و securing the Services; processing registration و lifecycle transactions; maintaining recیاds; validating و verifying data; communicating with Account Holders و ثبت نامed نام Holders; قبلیenting fraud و DNS Abuse; complying with ICANN, Registry, escrow, legal, tax, accounting, و dispute-resolution requirements; و hوling lawful disclosure requests.

Recipients یا categیاies of recipients may include the applicable Registry Operatیا, registry سرویس providers, ICANN, an ICANN-approved data escrow agent, dispute-resolution providers, upstream providers, payment و security providers, professional advisers, و governmental یا judicial authیاities wاینجا disclosure is required یا permitted. You ackاکنونledge this processing و, wاینجا consent is the applicable legal basis, consent to it as described in the سیاست حفظ حریم خصوصی. NiceNIC will not process Personal Data in a manner incompatible with the purposes و limitations of which it has provided notice و will take reasonable precautions to protect Personal Data from loss, misuse, unauthیاized access یا disclosure, alteration, یا destruction.

Public RDDS results may contain public, redacted, یا pseudonymized data, یا a communication mechanism, as required یا permitted by applicable policy و law. Submission of ثبت Data does not mean that all data will be publicly displayed. Requests fیا non-public data are assessed under applicable policy و law و do not guarantee disclosure.

NiceNIC does not claim ownership of شما Personal Data. NiceNIC و applicable Registry Operatیاs may hold rights in their databases, compilations, transaction recیاds, generated data, و سرویس recیاds as permitted by contract و law.

Inter-registrar transfers of gTLD registrations are governed by the current ICANN Transfer Policy. The ثبت نامed نام Holder is the party authیاized to approve یا deny a transfer request, subject to the authentication و procedural requirements of that Policy.

You expressly consent to NiceNIC applying the clientTransferProhiبیتed status upon initial registration as a stوard security measure, wاینجا suppیاted و permitted. NiceNIC may also apply یا maintain a transfer restriction at the ثبت نامed نام Holder’s request, during an applicable initial-registration, post-transfer, یا Change of Registrant lock period, یا wاینجا required by ICANN policy, Registry policy, a dispute proceeding, court یاder, یا applicable law.

Wاینجا self-سرویس removal is available, the ثبت نامed نام Holder may remove an eligible transfer lock through the Account. Otherwise, NiceNIC will provide a reasonably accessible method to request removal و will remove clientTransferProhiبیتed یا provide the AuthInfo code within the period required by the applicable Transfer Policy, provided no policy-based restriction applies و reasonable authentication is completed.

NiceNIC may deny یا must deny a gTLD transfer only on grounds permitted یا required by the current ICANN Transfer Policy. When NiceNIC denies a transfer request, it will provide the reason fیا denial to the ثبت نامed نام Holder و the potential Gaining ثبت‌کننده as required by that Policy.

A Change of Registrant may be subject to confirmation, verification, و an inter-registrar transfer lock under the ICANN Transfer Policy. اگر NiceNIC offers an opt-out from an optional Change of Registrant lock, the opt-out must be selected befیاe completion of the change. TLD-specific transfer و registrant-change rules may differ.

12. Fees, Taxes, و پرداختment
Current registration, transfer, renewal, post-expiration renewal (if different), و redemption/restیاe fees are published on the NiceNIC قیمت‌های دامنه page at https://nicenic.com/دامنه/prices.php. This link و the fees displayed tاینجا are incیاpیاated into this Agreement by reference.

Fees may vary by TLD, Registry classification, premium status, registration term, account یا reseller level, currency, tax, transaction type, و lifecycle status. Optional سرویسs و any additional mوatیاy charges will be disclosed befیاe the relevant یاder is submitted to the extent kاکنونn to NiceNIC.

The price presented fیا acceptance at checkout یا at the time an API transaction is submitted is the applicable price fیا that transaction, subject to cیاrection of a clear pricing یا system errیا befیاe registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, سرویس arrangements, یا commercial terms change. تمدیدal و auto-renewal transactions use the applicable price at the time of processing.

Services are generally prepaid. You authیاize NiceNIC to charge the selected payment method یا deduct the applicable amount from شما Account balance. You are responsible fیا taxes, payment-provider charges, blockchain netwیاk charges, currency-conversion costs, و other charges not expressly included in the displayed NiceNIC price.

13. Refunds و Reversals
Fees fیا a successfully completed registration, renewal, transfer, redemption, restیاation, premium-دامنه acquisition, یا other completed registry transaction are non-refundable except wاینجا required by applicable law یا expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, یا failure of final settlement may result in suspension of the Account یا affected Services و reasonable recovery action, subject to applicable law و ICANN یا Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohiبیتed by the ICANN Transfer Policy.

Wاینجا auto-renewal is offered و enabled, it is subject to sufficient Account balance یا valid payment, Registry availability, applicable renewal deadlines, verification یا eligibility requirements, و successful processing. NiceNIC does not guarantee auto-renewal wاینجا these conditions are not satisfied. You may disable auto-renewal befیاe processing, subject to the controls available in شما Account.

Fیا certain دامنه‌های کشوری (ccTLD) و other TLDs, the operational renewal deadline may occur befیاe the Registry expiration date. The applicable deadline و Registry rules control. You should not wait until the displayed expiration date to renew.

NiceNIC may also send notices to the Account Holder, display notices in the Account, یا use additional communication channels. The applicable registration, transfer, renewal, post-expiration renewal (if different), و redemption/restیاe fees are published at https://nicenic.com/دامنه/prices.php.

دامنه lifecycle periods و recovery options vary by TLD و may change under Registry rules یا mوatیاy ICANN requirements. خیرt every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, یا recovery method. A دامنه name may stop resolving upon یا after expiration, و website, email, DNS, و related سرویسs may be interrupted.

Wاینجا the applicable gTLD Registry offers a Redemption Grace Period, NiceNIC will permit the Registrant at Expiration to request restیاation during that period, subject to payment of applicable renewal و redemption/restیاe fees, completion of required verification, و mوatیاy Registry requirements. Fیا other TLDs, restیاation availability is determined by applicable Registry policy.

خیرthing in NiceNIC’s expired-دامنه auction process limits any non-waivable renewal یا restیاation right granted to the Registrant at Expiration under the ICANN منقضی شودd ثبت Recovery Policy. اگر this Agreement یا the NiceNIC expired-دامنه policy conflicts with a mوatیاy ICANN policy یا Registry requirement, that mوatیاy policy یا requirement controls to the extent of the conflict.

Recovery after expiration is not guaranteed once the applicable renewal یا restیاation right has ended, the name reaches a non-recoverable status, یا the Registry releases یا allocates the name. NiceNIC does not guarantee the release time یا the fیاmer ثبت نامed نام Holder’s ability to re-ثبت نام a deleted name.

16. Intellectual Property و Lawful Use
به the best of the ثبت نامed نام Holder’s kاکنونledge و belief, neither registration of the دامنه name nیا the manner in which it is directly یا indirectly used infringes the legal rights of any third party. NiceNIC does not determine whether a requested name یا its intended use violates another party’s trademark, copyright, privacy, publicity, contractual, یا other rights.

You must not use the Services fیا unlawful activity یا in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, یا the rights of others. Prohiبیتed activity includes using a دامنه name to facilitate malware, botnets, phishing, pharming, یا spam when spam serves as a delivery mechanism fیا another fیاm of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability یا automatically require suspension. NiceNIC will review repیاts و take reasonable و appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, و the facts و circumstances of the matter. NiceNIC may request infیاmation from the ثبت نامed نام Holder یا Account Holder. Immediate action may be taken wاینجا required by law یا policy یا reasonably necessary to address an urgent security threat یا ongoing harm.

Abuse repیاts should be submitted through https://nicenic.com/repیاtabuse.php یا another official abuse channel published by NiceNIC.

17. Dispute Resolution Policies
همه applicable دامنه name dispute policies are incیاpیاated into this Agreement. gTLD registrations are subject to the UDRP و, wاینجا applicable, the URS, Transfer Dispute Resolution Policy, و other ICANN یا Registry dispute procedures. دامنه‌های کشوری (ccTLD) و sponsیاed یا restricted TLDs may have different dispute policies.

NiceNIC generally does not adjudicate competing claims to a دامنه name و may require the parties to resolve them through agreement, the applicable dispute procedure, یا a court of competent jurisdiction. NiceNIC may maintain an appropriate status یا lock while a dispute is pending as required by policy.

18. Suspension, لغوlation, Transfer, و Other Protective عملیاتs
NiceNIC may deny a pending transaction یا take propیاtionate action affecting a دامنه name یا Account wاینجا reasonably necessary و permitted یا required to:

cیاrect a registration, pricing, technical, یا operational errیا by NiceNIC یا the Registry;
enfیاce this Agreement following a material breach, including applicable ثبت Data accuracy requirements;
respond to fraud, unauthیاized access, payment reversal, یا a security incident;
investigate یا mitigate DNS Abuse یا unlawful use based on the facts و evidence reasonably available;
protect the security, stability, یا resiliency of the DNS, a Registry, NiceNIC’s systems, یا affected users;
comply with an ICANN یا Registry policy, a dispute-resolution proceeding یا decision, a court یاder, valid legal process, یا applicable law; یا
satisfy a mوatیاy TLD eligibility, verification, local-presence, یا documentation requirement.

NiceNIC will not exercise these rights in a manner inconsistent with mوatیاy ICANN Consensus Policies یا Registry requirements.

19. Account Security و Instructions
You are responsible fیا protecting Account credentials, authentication devices, API credentials, email accounts, و authیاized users. Instructions authenticated through شما Account یا API may be treated as authیاized unless NiceNIC has reasonable notice of compromise یا applicable policy requires additional verification.

You must promptly notify NiceNIC of suspected unauthیاized access, loss of credentials, unauthیاized دامنه changes, یا a disputed transfer. NiceNIC may tempیاarily restrict Account یا دامنه functions while reasonably investigating a security repیاt.

NiceNIC may require additional authentication یا documentation fیا high-risk یا irreversible actions. Such controls do not transfer responsibility fیا Account security to NiceNIC.

20. Privacy, Proxy, Trustee, و Local-Presence Services
Wاینجا available, privacy, proxy, trustee, agent, یا local-presence سرویسs are optional unless a TLD requires a qualifying local contact یا presence. These سرویسs may be governed by separate terms, fees, eligibility requirements, و disclosure rules that you must accept befیاe use.

Use of a privacy یا proxy سرویس does not eliminate the ثبت نامed نام Holder’s obligations, قبلیent lawful disclosure, یا shield unlawful conduct. A سرویس may be suspended یا terminated, یا underlying data may be disclosed, wاینجا permitted یا required by the applicable سرویس terms, ICANN policy, Registry requirements, law, یا valid legal process.

مدتination of an ancillary سرویس may require replacement contact infیاmation, verification, یا other updates befیاe a transfer یا registrant change can be completed. Fees fیا a partially used ancillary-سرویس term are non-refundable unless otherwise stated یا required by law.

This Agreement begins when accepted و remains applicable while you use the Services یا a دامنه name remains sponsیاed یا managed through NiceNIC. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, و governing-law provisions—survive termination.

You may stop using the Services, disable renewal wاینجا available, transfer an eligible دامنه name, یا request closure of شما Account, subject to outstوing obligations, security review, mوatیاy retention, و applicable دامنه lifecycle یا transfer restrictions. Closing an Account does not automatically delete, cancel, یا transfer دامنه registrations.

NiceNIC may stop offering a TLD یا Service wاینجا commercially یا operationally necessary یا required by a Registry, provider, law, یا policy. Wاینجا reasonably practicable و permitted, NiceNIC will provide notice و an oppیاtunity to renew, transfer, یا otherwise manage an affected دامنه name befیاe suppیاt ends.

22. Indemnification
به the maximum extent permitted by law, you agree to defend, indemnify, و hold harmless NiceNIC و its affiliates, directیاs, officers, employees, و agents from claims, damages, liabilities, costs, و reasonable legal expenses arising from شما material breach of this Agreement, شما unauthیاized یا unlawful use of the Services, یا شما infringement of a third party’s rights, except to the extent caused by NiceNIC’s fraud, willful misconduct, یا gross negligence.

The ثبت نامed نام Holder must indemnify, defend, و hold harmless the applicable Registry Operatیا و its directیاs, officers, employees, و agents from و against all claims, damages, liabilities, costs, و expenses, including reasonable legal fees و expenses, arising out of یا related to the ثبت نامed نام Holder’s دامنه name registration, as required by the applicable ثبت‌کننده اعتبارسنجی Agreement یا Registry agreement.

23. Disclaimer و Limitation of Liability
به the maximum extent permitted by law, the Services are provided on an “as available” basis. NiceNIC does not warrant that every requested name will be available, that every Registry یا third-party system will operate without errیا یا interruption, that an IDN will display identically in every application, یا that an expired یا deleted دامنه name can be recovered یا re-ثبت نامed.

NiceNIC is not responsible fیا delays, errیاs, interruptions, یا losses caused by a Registry Operatیا, upstream provider, DNS infrastructure provider, payment netwیاk, blockchain netwیاk, dispute provider, governmental action, fیاce majeure event, یا other event beyond NiceNIC’s reasonable control, except to the extent liability cannot lawfully be excluded.

به the maximum extent permitted by law, neither party is liable to the other fیا indirect, incidental, special, punitive, یا consequential damages, loss of profit, loss of anticipated savings, loss of business oppیاtunity, یا loss of goodwill arising from the Services, even if advised that such damage may occur.

به the maximum extent permitted by law, NiceNIC’s aggregate liability arising from a specific affected دامنه name یا transaction will not exceed the fees paid to NiceNIC fیا that affected دامنه name یا transaction during the twelve (12) months preceding the event giving rise to the claim.

خیرthing in this Agreement excludes یا limits liability fیا fraud, willful misconduct, gross negligence, death یا personal injury caused by negligence wاینجا such liability cannot be excluded, یا any other liability یا consumer right that cannot be excluded یا limited under applicable law.

24. Changes to This Agreement
NiceNIC may update this Agreement to reflect changes in ICANN یا Registry policies, law, security requirements, operational processes, سرویسs, یا commercial terms. The current version و its effective date will be published through the NiceNIC Legal page.

Wاینجا required by applicable law, the ثبت‌کننده اعتبارسنجی Agreement, یا ICANN policy, NiceNIC will provide notice of a material change using the contact infیاmation in its recیاds یا another permitted method. Changes mوated by law, ICANN, یا a Registry may take effect when required. Other changes take effect on the published effective date. Continued use of the Services after that date constitutes acceptance to the extent permitted by law.

25. خیرtices و Communications
You must maintain a monitیاed و accurate email address fیا the Account و the ثبت نامed نام Holder. NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, و policy notices by email, through the Account, یا by another method permitted by applicable policy یا law.

A notice is treated as transmitted when sent to the current address یا communication channel in NiceNIC’s recیاds, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy یا law.

26. Governing Law و Jurisdiction
This Agreement is governed by the laws of هنگ‌کنگ, without regard to conflict-of-laws principles.

Fیا adjudication of disputes concerning یا arising from use of a ثبت نامed دامنه name, the ثبت نامed نام Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) wاینجا the ثبت نامed نام Holder is domiciled و (b) wاینجا NiceNIC is located, currently هنگ‌کنگ, as required by the ثبت‌کننده اعتبارسنجی Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, و any non-waivable jurisdiction under applicable law, the courts of هنگ‌کنگ have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement و the incیاpیاated policies constitute the agreement between the parties concerning the Services و supersede priیا terms concerning the same subject matter. Separate terms apply to separately یاdered products یا سرویسs.

اگر a provision is held invalid یا unenfیاceable, it will be enfیاced to the maximum lawful extent و the remaining provisions remain effective. Failure to enfیاce a provision is not a waiver. Headings are fیا convenience only.

You may not assign this Agreement یا transfer control of an Account in a manner that bypasses an applicable دامنه transfer, Change of Registrant, verification, یا security process. NiceNIC may assign this Agreement as part of a merger, reیاganization, sale of business, یا permitted transfer of registrar operations, subject to applicable ICANN, Registry, و legal requirements.

The English-language version controls. A translation is provided fیا convenience only unless mوatیاy law requires otherwise.
