2. Definitions
“Account” means the NiceNIC customer account through which Services are ataudered atau managed.
“Account Holder” means the person atau entity controlling the Account dan responsible fatau payment dan account-level instructions.
“ICANN” means the Internet Cataupatauation fatau Assigned Namas dan Numbers.
“Daftared Nama Holder” atau “RNH” means the person atau legal entity identified as the holder of a daftared domain name. “Registrant” has the same meaning wdi sini used in an applicable policy.
“Pendaftaran Data” means data collected from a person atau legal entity, atau generated by NiceNIC atau a Registry Operatatau, in connection with a domain name registration.
“Registry Operatatau” atau “Registry” means the operatatau of the registry fatau the applicable top-level domain.
“TLD” means a top-level domain, including a generic top-level domain (“gTLD”) atau country-code top-level domain (“ccTLD”).

The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, dan mdanatatauy laws dan regulations.

Registry databases dan availability results may change between search dan completion.

NiceNIC may reject atau cancel a pending application befataue registry completion wdi sini the name is unavailable, reserved, prohibited, restricted, subject to an eligibility failure, affected by an evident pricing atau technical erratau, unsuppatauted by the Registry, atau inconsistent with applicable law, policy, atau this Agreement. Jika a registration atau other transaction has already been completed, NiceNIC will not cancel atau reverse it except as permitted atau required by applicable policy, Registry procedure, law, legal process, atau this Agreement.

5. TLD-Specific Rules, IDNs, dan Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, restatauation, dispute, dan data requirements. You must satisfy the applicable requirements dan promptly provide requested infataumation atau documents. Registry requirements may change during the registration term.

ccTLD are primarily governed by the applicable ccTLD Registry dan local rules. ICANN gTLD policies do not necessarily apply to ccTLD. Wdi sini NiceNIC provides a TLD through an upstream provider, that provider’s mdanatatauy terms may also apply.

Internationalized Nama Domain (“IDNs”) depend on Registry-suppatauted scripts, language tables, label-generation rules, browser suppataut, dan DNS stdanards. Display atau functionality may vary among applications. The ASCII-compatible encoded fataum recatauded by the Registry controls wdi sini required by the DNS atau Registry system.

Jika eligibility, validation, atau documentation requirements are not satisfied, the application may be rejected atau the domain name may be suspended, locked, deleted, not renewed, atau otherwise restricted as required by the applicable Registry atau policy.

6. Premium Domain, Pre-Pendaftaran, Sunrise, dan Launch Phases
A Premium Domain may have non-stdanard registration, transfer, renewal, atau restatauation pricing established by the Registry atau a third-party seller. Pre-registration, Sunrise, Ldanrush, Early Access, dan similar launch-phase applications do not guarantee allocation. Competing applications, auctions, rights-validation requirements, Registry decisions, atau launch rules may affect the result. Any non-refundable application, validation, atau auction fee will be disclosed befataue payment to the extent available to NiceNIC.

7. Daftared Nama Holder, Account Holder, dan Penjual Semula Responsibilities
The Daftared Nama Holder is the holder of recataud dan is responsible fatau the registration dan use of the domain name. The Account Holder may manage the domain name only to the extent authatauized by the Daftared Nama Holder dan applicable policy.

obtain dan retain the Daftared Nama Holder’s acceptance of this Agreement dan applicable policies;
provide accurate infataumation concerning NiceNIC’s identity as the sponsatauing registrar wdi sini required;
display applicable registration, renewal, post-expiration renewal, dan redemption/restataue fees dan describe expiration-notice methods as required by ICANN policy;
provide required notices dan promptly transmit communications between NiceNIC dan the Daftared Nama Holder; dan
not make representations inconsistent with this Agreement, applicable ICANN policies, atau Registry requirements.

8. Pendaftaran Data dan Accuracy
The Daftared Nama Holder must provide accurate dan reliable Pendaftaran Data dan must cataurect dan update it within seven (7) days after any change. Required data may include the Daftared Nama Holder’s full name, postal address, email address, voice telephone number, fax number if available, dan the name of an authatauized contact person wdi sini the Daftared Nama Holder is an atauganization, association, atau cataupatauation, together with other data required by applicable policy atau Registry rules.

NiceNIC will validate dan verify Pendaftaran Data as required by the applicable Pendaftar Akreditasi Agreement, ICANN policy, Registry requirements, dan law. You must complete applicable email, telephone, documentation, atau other verification steps dan respond to accuracy inquiries.

The Daftared Nama Holder’s willful provision of inaccurate atau unreliable infataumation, willful failure to update infataumation within seven (7) days after a change, atau failure to respond fatau mataue than fifteen (15) calendar days to an inquiry from NiceNIC concerning the accuracy of Butiran Perhubungan associated with the registration constitutes a material breach dan is a basis fatau suspension dan/atau cancellation of the registration, subject to applicable policy.

9. Licensed Use dan Third-Party Data

The Daftared Nama Holder accepts liability fatau harm caused by wrongful use of the domain name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact infataumation provided by the licensee dan the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

Obligatatauy dan optional data, publication rules, retention, access, cataurection, dan other processing details are described in the NiceNIC Dasar Privasi dan applicable Pendaftaran Data Policy.

You acksekarangledge this processing dan, wdi sini consent is the applicable legal basis, consent to it as described in the Dasar Privasi. NiceNIC will not process Personal Data in a manner incompatible with the purposes dan limitations of which it has provided notice dan will take reasonable precautions to protect Personal Data from loss, misuse, unauthatauized access atau disclosure, alteration, atau destruction.

Public RDDS results may contain public, redacted, atau pseudonymized data, atau a communication mechanism, as required atau permitted by applicable policy dan law. Submission of Pendaftaran Data does not mean that all data will be publicly displayed. Requests fatau non-public data are assessed under applicable policy dan law dan do not guarantee disclosure.

NiceNIC does not claim ownership of anda Personal Data. NiceNIC dan applicable Registry Operatataus may hold rights in their databases, compilations, transaction recatauds, generated data, dan Perkhidmatan recatauds as permitted by contract dan law.

11. Pemindahan Domain dan Change of Registrant
Inter-registrar transfers of gTLD registrations are governed by the current ICANN Transfer Policy. The Daftared Nama Holder is the party authatauized to approve atau deny a transfer request, subject to the authentication dan procedural requirements of that Policy.

You expressly consent to NiceNIC applying the clientTransferProhibited status upon initial registration as a stdanard security measure, wdi sini suppatauted dan permitted. NiceNIC may also apply atau maintain a transfer restriction at the Daftared Nama Holder’s request, during an applicable initial-registration, post-transfer, atau Change of Registrant lock period, atau wdi sini required by ICANN policy, Registry policy, a dispute proceeding, court atauder, atau applicable law.

Wdi sini self-Perkhidmatan removal is available, the Daftared Nama Holder may remove an eligible transfer lock through the Account. Otherwise, NiceNIC will provide a reasonably accessible method to request removal dan will remove clientTransferProhibited atau provide the AuthInfo code within the period required by the applicable Transfer Policy, provided no policy-based restriction applies dan reasonable authentication is completed.

NiceNIC may deny atau must deny a gTLD transfer only on grounds permitted atau required by the current ICANN Transfer Policy. When NiceNIC denies a transfer request, it will provide the reason fatau denial to the Daftared Nama Holder dan the potential Gaining Pendaftar as required by that Policy.

A Change of Registrant may be subject to confirmation, verification, dan an inter-registrar transfer lock under the ICANN Transfer Policy. Jika NiceNIC offers an opt-out from an optional Change of Registrant lock, the opt-out must be selected befataue completion of the change. TLD-specific transfer dan registrant-change rules may differ.

12. Fees, Taxes, dan Bayarment
Current registration, transfer, renewal, post-expiration renewal (if different), dan redemption/restataue fees are published on the NiceNIC Harga Domain page at https://nicenic.com/domain/prices.php. This link dan the fees displayed tdi sini are incataupatauated into this Agreement by reference.

Fees may vary by TLD, Registry classification, premium status, registration term, account atau reseller level, currency, tax, transaction type, dan lifecycle status. Optional Perkhidmatans dan any additional mdanatatauy charges will be disclosed befataue the relevant atauder is submitted to the extent ksekarangn to NiceNIC.

The price presented fatau acceptance at checkout atau at the time an API transaction is submitted is the applicable price fatau that transaction, subject to cataurection of a clear pricing atau system erratau befataue registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, Perkhidmatan arrangements, atau commercial terms change. Perbaharuial dan auto-renewal transactions use the applicable price at the time of processing.

Services are generally prepaid. You authatauize NiceNIC to charge the selected payment method atau deduct the applicable amount from anda Account balance. You are responsible fatau taxes, payment-provider charges, blockchain netwatauk charges, currency-conversion costs, dan other charges not expressly included in the displayed NiceNIC price.

Bayarment does not complete a registry transaction. Jika a submitted transaction cannot be completed, any credit atau refund will be hdanled accatauding to the transaction status, payment method, applicable law, dan NiceNIC’s published payment atau refund terms. Cryptocurrency dan blockchain transactions are irreversible, dan NiceNIC does not reimburse exchange-rate changes atau third-party netwatauk fees.

13. Refunds dan Reversals
Fees fatau a successfully completed registration, renewal, transfer, redemption, restatauation, premium-domain acquisition, atau other completed registry transaction are non-refundable except wdi sini required by applicable law atau expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, atau failure of final settlement may result in suspension of the Account atau affected Services dan reasonable recovery action, subject to applicable law dan ICANN atau Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohibited by the ICANN Transfer Policy.

A domain name is daftared fatau a limited term dan expires unless renewed. The Daftared Nama Holder dan Account Holder are responsible fatau monitatauing expiration dates, maintaining accurate contact dan payment infataumation, dan submitting payment early enough fatau processing befataue the applicable deadline.

Wdi sini auto-renewal is offered dan enabled, it is subject to sufficient Account balance atau valid payment, Registry availability, applicable renewal deadlines, verification atau eligibility requirements, dan successful processing. NiceNIC does not guarantee auto-renewal wdi sini these conditions are not satisfied. You may disable auto-renewal befataue processing, subject to the controls available in anda Account.

Fatau certain ccTLD dan other TLDs, the operational renewal deadline may occur befataue the Registry expiration date. The applicable deadline dan Registry rules control. You should not wait until the displayed expiration date to renew.

Fatau gTLDs, NiceNIC will transmit the pre-expiration dan post-expiration notices required by the ICANN Luputd Pendaftaran Recovery Policy by email to the Registrant at Expiration at the applicable contact address in NiceNIC’s recatauds. NiceNIC may also send notices to the Account Holder, display notices in the Account, atau use additional communication channels. These required notices do not remove anda responsibility to maintain current contact infataumation dan timely renew the registration.

15. Perbaharuial, Expiration, Redemption, dan Auction
Domain name expiration, DNS interruption, post-expiration renewal, deletion, redemption, restatauation, pending deletion, dan expired-domain auction procedures are governed by NiceNIC’s Luputd Domain Perbaharuial, Redemption, dan Auction Policy at https://nicenic.com/legal/expired-domain-renewal-redemption-dan-auction-policy, which is incataupatauated into this Agreement by reference.

The applicable registration, transfer, renewal, post-expiration renewal (if different), dan redemption/restataue fees are published at https://nicenic.com/domain/prices.php.

Domain lifecycle periods dan recovery options vary by TLD dan may change under Registry rules atau mdanatatauy ICANN requirements. Tidakt every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, atau recovery method. A domain name may stop resolving upon atau after expiration, dan website, email, DNS, dan related Perkhidmatans may be interrupted.

Wdi sini the applicable gTLD Registry offers a Redemption Grace Period, NiceNIC will permit the Registrant at Expiration to request restatauation during that period, subject to payment of applicable renewal dan redemption/restataue fees, completion of required verification, dan mdanatatauy Registry requirements. Fatau other TLDs, restatauation availability is determined by applicable Registry policy.

Tidakthing in NiceNIC’s expired-domain auction process limits any non-waivable renewal atau restatauation right granted to the Registrant at Expiration under the ICANN Luputd Pendaftaran Recovery Policy. NiceNIC does not guarantee the release time atau the fataumer Daftared Nama Holder’s ability to re-daftar a deleted name.

16. Intellectual Property dan Lawful Use

You must not use the Services fatau unlawful activity atau in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, atau the rights of others. Prohibited activity includes using a domain name to facilitate malware, botnets, phishing, pharming, atau spam when spam serves as a delivery mechanism fatau another fataum of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability atau automatically require suspension. NiceNIC will review repatauts dan take reasonable dan appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, dan the facts dan circumstances of the matter. NiceNIC may request infataumation from the Daftared Nama Holder atau Account Holder. Immediate action may be taken wdi sini required by law atau policy atau reasonably necessary to address an urgent security threat atau ongoing harm.

Abuse repatauts should be submitted through https://nicenic.com/repatautabuse.php atau another official abuse channel published by NiceNIC.

17. Dispute Resolution Policies
Semua applicable domain name dispute policies are incataupatauated into this Agreement. gTLD registrations are subject to the UDRP dan, wdi sini applicable, the URS, Transfer Dispute Resolution Policy, dan other ICANN atau Registry dispute procedures. ccTLD dan sponsataued atau restricted TLDs may have different dispute policies.

The Daftared Nama Holder agrees that a registration may be locked, suspended, cancelled, transferred, atau otherwise affected in accataudance with an applicable dispute policy, final administrative decision, settlement, court atauder, atau Registry procedure.

NiceNIC generally does not adjudicate competing claims to a domain name dan may require the parties to resolve them through agreement, the applicable dispute procedure, atau a court of competent jurisdiction. NiceNIC may maintain an appropriate status atau lock while a dispute is pending as required by policy.

18. Suspension, Batallation, Transfer, dan Other Protective Tindakans
NiceNIC may deny a pending transaction atau take propatautionate action affecting a domain name atau Account wdi sini reasonably necessary dan permitted atau required to:

cataurect a registration, pricing, technical, atau operational erratau by NiceNIC atau the Registry;
enfatauce this Agreement following a material breach, including applicable Pendaftaran Data accuracy requirements;
respond to fraud, unauthatauized access, payment reversal, atau a security incident;
investigate atau mitigate DNS Abuse atau unlawful use based on the facts dan evidence reasonably available;
protect the security, stability, atau resiliency of the DNS, a Registry, NiceNIC’s systems, atau affected users;
comply with an ICANN atau Registry policy, a dispute-resolution proceeding atau decision, a court atauder, valid legal process, atau applicable law; atau
satisfy a mdanatatauy TLD eligibility, verification, local-presence, atau documentation requirement.
Tersedia actions may include requesting infataumation atau remediation, restricting Account functions, applying a permissible lock, suspending resolution through clientHold, denying a transaction, cancelling a Service, deleting a registration, atau transferring a domain name when expressly authatauized atau required by policy atau legal process.

Wdi sini appropriate, legally permitted, dan consistent with the urgency dan nature of the issue, NiceNIC will provide notice atau an oppatautunity to respond atau remedy. NiceNIC may act without advance notice when immediate action is required by law, policy, a Registry, a dispute provider, atau a court, atau is reasonably necessary to sebelument material harm, preserve evidence, atau protect security. NiceNIC will not exercise these rights in a manner inconsistent with mdanatatauy ICANN Consensus Policies atau Registry requirements.

19. Account Security dan Instructions
You are responsible fatau protecting Account credentials, authentication devices, API credentials, email accounts, dan authatauized users. Instructions authenticated through anda Account atau API may be treated as authatauized unless NiceNIC has reasonable notice of compromise atau applicable policy requires additional verification.

You must promptly notify NiceNIC of suspected unauthatauized access, loss of credentials, unauthatauized domain changes, atau a disputed transfer. NiceNIC may tempatauarily restrict Account atau domain functions while reasonably investigating a security repataut.

NiceNIC may require additional authentication atau documentation fatau high-risk atau irreversible actions. Such controls do not transfer responsibility fatau Account security to NiceNIC.

20. Privacy, Proxy, Trustee, dan Local-Presence Services
Wdi sini available, privacy, proxy, trustee, agent, atau local-presence Perkhidmatans are optional unless a TLD requires a qualifying local contact atau presence. These Perkhidmatans may be governed by separate terms, fees, eligibility requirements, dan disclosure rules that you must accept befataue use.

Use of a privacy atau proxy Perkhidmatan does not eliminate the Daftared Nama Holder’s obligations, sebelument lawful disclosure, atau shield unlawful conduct. A Perkhidmatan may be suspended atau terminated, atau underlying data may be disclosed, wdi sini permitted atau required by the applicable Perkhidmatan terms, ICANN policy, Registry requirements, law, atau valid legal process.

Tempohination of an ancillary Perkhidmatan may require replacement contact infataumation, verification, atau other updates befataue a transfer atau registrant change can be completed. Fees fatau a partially used ancillary-Perkhidmatan term are non-refundable unless otherwise stated atau required by law.

21. Tempoh dan Tempohination
This Agreement begins when accepted dan remains applicable while you use the Services atau a domain name remains sponsataued atau managed through NiceNIC. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, dan governing-law provisions—survive termination.

You may stop using the Services, disable renewal wdi sini available, transfer an eligible domain name, atau request closure of anda Account, subject to outstdaning obligations, security review, mdanatatauy retention, dan applicable domain lifecycle atau transfer restrictions. Closing an Account does not automatically delete, cancel, atau transfer domain registrations.

NiceNIC may stop offering a TLD atau Service wdi sini commercially atau operationally necessary atau required by a Registry, provider, law, atau policy. Wdi sini reasonably practicable dan permitted, NiceNIC will provide notice dan an oppatautunity to renew, transfer, atau otherwise manage an affected domain name befataue suppataut ends.

22. Indemnification
Untuk the maximum extent permitted by law, you agree to defend, indemnify, dan hold harmless NiceNIC dan its affiliates, directataus, officers, employees, dan agents from claims, damages, liabilities, costs, dan reasonable legal expenses arising from anda material breach of this Agreement, anda unauthatauized atau unlawful use of the Services, atau anda infringement of a third party’s rights, except to the extent caused by NiceNIC’s fraud, willful misconduct, atau gross negligence.

The Daftared Nama Holder must indemnify, defend, dan hold harmless the applicable Registry Operatatau dan its directataus, officers, employees, dan agents from dan against all claims, damages, liabilities, costs, dan expenses, including reasonable legal fees dan expenses, arising out of atau related to the Daftared Nama Holder’s domain name registration, as required by the applicable Pendaftar Akreditasi Agreement atau Registry agreement.

23. Disclaimer dan Limitation of Liability
Untuk the maximum extent permitted by law, the Services are provided on an “as available” basis. NiceNIC does not warrant that every requested name will be available, that every Registry atau third-party system will operate without erratau atau interruption, that an IDN will display identically in every application, atau that an expired atau deleted domain name can be recovered atau re-daftared.

NiceNIC is not responsible fatau delays, errataus, interruptions, atau losses caused by a Registry Operatatau, upstream provider, DNS infrastructure provider, payment netwatauk, blockchain netwatauk, dispute provider, governmental action, fatauce majeure event, atau other event beyond NiceNIC’s reasonable control, except to the extent liability cannot lawfully be excluded.

Untuk the maximum extent permitted by law, neither party is liable to the other fatau indirect, incidental, special, punitive, atau consequential damages, loss of profit, loss of anticipated savings, loss of business oppatautunity, atau loss of goodwill arising from the Services, even if advised that such damage may occur.

Untuk the maximum extent permitted by law, NiceNIC’s aggregate liability arising from a specific affected domain name atau transaction will not exceed the fees paid to NiceNIC fatau that affected domain name atau transaction during the twelve (12) months preceding the event giving rise to the claim.

Tidakthing in this Agreement excludes atau limits liability fatau fraud, willful misconduct, gross negligence, death atau personal injury caused by negligence wdi sini such liability cannot be excluded, atau any other liability atau consumer right that cannot be excluded atau limited under applicable law.

24. Changes to This Agreement
NiceNIC may update this Agreement to reflect changes in ICANN atau Registry policies, law, security requirements, operational processes, Perkhidmatans, atau commercial terms. The current version dan its effective date will be published through the NiceNIC Legal page.

Wdi sini required by applicable law, the Pendaftar Akreditasi Agreement, atau ICANN policy, NiceNIC will provide notice of a material change using the contact infataumation in its recatauds atau another permitted method. Changes mdanated by law, ICANN, atau a Registry may take effect when required. Other changes take effect on the published effective date. Continued use of the Services after that date constitutes acceptance to the extent permitted by law.

25. Tidaktices dan Communications
You must maintain a monitataued dan accurate email address fatau the Account dan the Daftared Nama Holder. NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, dan policy notices by email, through the Account, atau by another method permitted by applicable policy atau law.

A notice is treated as transmitted when sent to the current address atau communication channel in NiceNIC’s recatauds, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy atau law.

26. Governing Law dan Jurisdiction
This Agreement is governed by the laws of Hong Kong, without regard to conflict-of-laws principles.

Fatau adjudication of disputes concerning atau arising from use of a daftared domain name, the Daftared Nama Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) wdi sini the Daftared Nama Holder is domiciled dan (b) wdi sini NiceNIC is located, currently Hong Kong, as required by the Pendaftar Akreditasi Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, dan any non-waivable jurisdiction under applicable law, the courts of Hong Kong have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement dan the incataupatauated policies constitute the agreement between the parties concerning the Services dan supersede priatau terms concerning the same subject matter. Separate terms apply to separately ataudered products atau Perkhidmatans.

Jika a provision is held invalid atau unenfatauceable, it will be enfatauced to the maximum lawful extent dan the remaining provisions remain effective. Failure to enfatauce a provision is not a waiver. Headings are fatau convenience only.

You may not assign this Agreement atau transfer control of an Account in a manner that bypasses an applicable domain transfer, Change of Registrant, verification, atau security process. NiceNIC may assign this Agreement as part of a merger, reatauganization, sale of business, atau permitted transfer of registrar operations, subject to applicable ICANN, Registry, dan legal requirements.

The English-language version controls. A translation is provided fatau convenience only unless mdanatatauy law requires otherwise.
