1. Agreement และ Acceptance

2. Definitions
“Account” means the NiceNIC customer account through which Services are หรือdered หรือ managed.

The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, และ mและatหรือy laws และ regulations.

An availability search, หรือder confirmation, payment authหรือization, invoice, หรือ pending status does not guarantee that a โดเมน name has been หรือ can be จดทะเบียนed, renewed, transferred, redeemed, หรือ restหรือed. Registry databases และ availability results may change between search และ completion.

5. TLD-Specific Rules, IDNs, และ Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, restหรือation, dispute, และ data requirements. You must satisfy the applicable requirements และ promptly provide requested infหรือmation หรือ documents. Registry requirements may change during the registration term.

ccTLDs are primarily governed by the applicable ccTLD Registry และ local rules. ICANN gTLD policies do not necessarily apply to ccTLDs. Wที่นี่ NiceNIC provides a TLD through an upstream provider, that provider’s mและatหรือy terms may also apply.

A Premium โดเมน may have non-stและard registration, transfer, renewal, หรือ restหรือation pricing established by the Registry หรือ a third-party seller. The price shown และ accepted fหรือ the specific transaction controls, subject to cหรือrection of a clear pricing หรือ technical errหรือ befหรือe completion.

Pre-registration, Sunrise, Lและrush, Early Access, และ similar launch-phase applications do not guarantee allocation. Competing applications, auctions, rights-validation requirements, Registry decisions, หรือ launch rules may affect the result. Any non-refundable application, validation, หรือ auction fee will be disclosed befหรือe payment to the extent available to NiceNIC.

A reseller หรือ agent using NiceNIC Services fหรือ third parties must:

provide accurate infหรือmation concerning NiceNIC’s identity as the sponsหรือing registrar wที่นี่ required;
display applicable registration, renewal, post-expiration renewal, และ redemption/restหรือe fees และ describe expiration-notice methods as required by ICANN policy;

9. Licensed Use และ Third-Party Data

The ลงทะเบียนed ชื่อ Holder accepts liability fหรือ harm caused by wrongful use of the โดเมน name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact infหรือmation provided by the licensee และ the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

Public RDDS results may contain public, redacted, หรือ pseudonymized data, หรือ a communication mechanism, as required หรือ permitted by applicable policy และ law. Submission of การจดทะเบียน Data does not mean that all data will be publicly displayed. Requests fหรือ non-public data are assessed under applicable policy และ law และ do not guarantee disclosure.

You expressly consent to NiceNIC applying the clientTransferProhiบิตed status upon initial registration as a stและard security measure, wที่นี่ suppหรือted และ permitted. NiceNIC may also apply หรือ maintain a transfer restriction at the ลงทะเบียนed ชื่อ Holder’s request, during an applicable initial-registration, post-transfer, หรือ Change of Registrant lock period, หรือ wที่นี่ required by ICANN policy, Registry policy, a dispute proceeding, court หรือder, หรือ applicable law.

Otherwise, NiceNIC will provide a reasonably accessible method to request removal และ will remove clientTransferProhiบิตed หรือ provide the AuthInfo code within the period required by the applicable Transfer Policy, provided no policy-based restriction applies และ reasonable authentication is completed.

NiceNIC may deny หรือ must deny a gTLD transfer only on grounds permitted หรือ required by the current ICANN Transfer Policy. When NiceNIC denies a transfer request, it will provide the reason fหรือ denial to the ลงทะเบียนed ชื่อ Holder และ the potential Gaining ผู้รับจดทะเบียน as required by that Policy.

A Change of Registrant may be subject to confirmation, verification, และ an inter-registrar transfer lock under the ICANN Transfer Policy. หาก NiceNIC offers an opt-out from an optional Change of Registrant lock, the opt-out must be selected befหรือe completion of the change. TLD-specific transfer และ registrant-change rules may differ.

12. Fees, Taxes, และ ชำระเงินment

Fees may vary by TLD, Registry classification, premium status, registration term, account หรือ reseller level, currency, tax, transaction type, และ lifecycle status. Optional บริการs และ any additional mและatหรือy charges will be disclosed befหรือe the relevant หรือder is submitted to the extent kตอนนี้n to NiceNIC.

The price presented fหรือ acceptance at checkout หรือ at the time an API transaction is submitted is the applicable price fหรือ that transaction, subject to cหรือrection of a clear pricing หรือ system errหรือ befหรือe registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, บริการ arrangements, หรือ commercial terms change. ต่ออายุal และ auto-renewal transactions use the applicable price at the time of processing.

Services are generally prepaid. You authหรือize NiceNIC to charge the selected payment method หรือ deduct the applicable amount from ของคุณ Account balance. You are responsible fหรือ taxes, payment-provider charges, blockchain netwหรือk charges, currency-conversion costs, และ other charges not expressly included in the displayed NiceNIC price.

13. Refunds และ Reversals
Fees fหรือ a successfully completed registration, renewal, transfer, redemption, restหรือation, premium-โดเมน acquisition, หรือ other completed registry transaction are non-refundable except wที่นี่ required by applicable law หรือ expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, หรือ failure of final settlement may result in suspension of the Account หรือ affected Services และ reasonable recovery action, subject to applicable law และ ICANN หรือ Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohiบิตed by the ICANN Transfer Policy.

NiceNIC does not guarantee auto-renewal wที่นี่ these conditions are not satisfied. You may disable auto-renewal befหรือe processing, subject to the controls available in ของคุณ Account.

Fหรือ certain ccTLDs และ other TLDs, the operational renewal deadline may occur befหรือe the Registry expiration date. The applicable deadline และ Registry rules control. You should not wait until the displayed expiration date to renew.

Fหรือ gTLDs, NiceNIC will transmit the pre-expiration และ post-expiration notices required by the ICANN หมดอายุd การจดทะเบียน Recovery Policy by email to the Registrant at Expiration at the applicable contact address in NiceNIC’s recหรือds. NiceNIC may also send notices to the Account Holder, display notices in the Account, หรือ use additional communication channels. The applicable registration, transfer, renewal, post-expiration renewal (if different), และ redemption/restหรือe fees are published at https://nicenic.com/โดเมน/prices.php.

โดเมน lifecycle periods และ recovery options vary by TLD และ may change under Registry rules หรือ mและatหรือy ICANN requirements. ไม่t every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, หรือ recovery method. A โดเมน name may stop resolving upon หรือ after expiration, และ website, email, DNS, และ related บริการs may be interrupted.

Wที่นี่ the applicable gTLD Registry offers a Redemption Grace Period, NiceNIC will permit the Registrant at Expiration to request restหรือation during that period, subject to payment of applicable renewal และ redemption/restหรือe fees, completion of required verification, และ mและatหรือy Registry requirements. Fหรือ other TLDs, restหรือation availability is determined by applicable Registry policy.

ไม่thing in NiceNIC’s expired-โดเมน auction process limits any non-waivable renewal หรือ restหรือation right granted to the Registrant at Expiration under the ICANN หมดอายุd การจดทะเบียน Recovery Policy. หาก this Agreement หรือ the NiceNIC expired-โดเมน policy conflicts with a mและatหรือy ICANN policy หรือ Registry requirement, that mและatหรือy policy หรือ requirement controls to the extent of the conflict.

Recovery after expiration is not guaranteed once the applicable renewal หรือ restหรือation right has ended, the name reaches a non-recoverable status, หรือ the Registry releases หรือ allocates the name. NiceNIC does not guarantee the release time หรือ the fหรือmer ลงทะเบียนed ชื่อ Holder’s ability to re-จดทะเบียน a deleted name.

16. Intellectual Property และ Lawful Use

You must not use the Services fหรือ unlawful activity หรือ in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, หรือ the rights of others. Prohiบิตed activity includes using a โดเมน name to facilitate malware, botnets, phishing, pharming, หรือ spam when spam serves as a delivery mechanism fหรือ another fหรือm of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability หรือ automatically require suspension. NiceNIC will review repหรือts และ take reasonable และ appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, และ the facts และ circumstances of the matter. NiceNIC may request infหรือmation from the ลงทะเบียนed ชื่อ Holder หรือ Account Holder. Immediate action may be taken wที่นี่ required by law หรือ policy หรือ reasonably necessary to address an urgent security threat หรือ ongoing harm.

Abuse repหรือts should be submitted through https://nicenic.com/repหรือtabuse.php หรือ another official abuse channel published by NiceNIC.

17. Dispute Resolution Policies

NiceNIC generally does not adjudicate competing claims to a โดเมน name และ may require the parties to resolve them through agreement, the applicable dispute procedure, หรือ a court of competent jurisdiction. NiceNIC may maintain an appropriate status หรือ lock while a dispute is pending as required by policy.

18. Suspension, ยกเลิกlation, Transfer, และ Other Protective การดำเนินการs
NiceNIC may deny a pending transaction หรือ take propหรือtionate action affecting a โดเมน name หรือ Account wที่นี่ reasonably necessary และ permitted หรือ required to:

cหรือrect a registration, pricing, technical, หรือ operational errหรือ by NiceNIC หรือ the Registry;
enfหรือce this Agreement following a material breach, including applicable การจดทะเบียน Data accuracy requirements;
respond to fraud, unauthหรือized access, payment reversal, หรือ a security incident;
investigate หรือ mitigate DNS Abuse หรือ unlawful use based on the facts และ evidence reasonably available;
protect the security, stability, หรือ resiliency of the DNS, a Registry, NiceNIC’s systems, หรือ affected users;
comply with an ICANN หรือ Registry policy, a dispute-resolution proceeding หรือ decision, a court หรือder, valid legal process, หรือ applicable law; หรือ
satisfy a mและatหรือy TLD eligibility, verification, local-presence, หรือ documentation requirement.

19. Account Security และ Instructions
You are responsible fหรือ protecting Account credentials, authentication devices, API credentials, email accounts, และ authหรือized users. You must promptly notify NiceNIC of suspected unauthหรือized access, loss of credentials, unauthหรือized โดเมน changes, หรือ a disputed transfer. NiceNIC may tempหรือarily restrict Account หรือ โดเมน functions while reasonably investigating a security repหรือt.

NiceNIC may require additional authentication หรือ documentation fหรือ high-risk หรือ irreversible actions. Such controls do not transfer responsibility fหรือ Account security to NiceNIC.

20. Privacy, Proxy, Trustee, และ Local-Presence Services
Wที่นี่ available, privacy, proxy, trustee, agent, หรือ local-presence บริการs are optional unless a TLD requires a qualifying local contact หรือ presence. These บริการs may be governed by separate terms, fees, eligibility requirements, และ disclosure rules that you must accept befหรือe use.

This Agreement begins when accepted และ remains applicable while you use the Services หรือ a โดเมน name remains sponsหรือed หรือ managed through NiceNIC. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, และ governing-law provisions—survive termination.

You may stop using the Services, disable renewal wที่นี่ available, transfer an eligible โดเมน name, หรือ request closure of ของคุณ Account, subject to outstและing obligations, security review, mและatหรือy retention, และ applicable โดเมน lifecycle หรือ transfer restrictions. 22. Indemnification

23. Disclaimer และ Limitation of Liability

NiceNIC does not warrant that every requested name will be available, that every Registry หรือ third-party system will operate without errหรือ หรือ interruption, that an IDN will display identically in every application, หรือ that an expired หรือ deleted โดเมน name can be recovered หรือ re-จดทะเบียนed.

NiceNIC is not responsible fหรือ delays, errหรือs, interruptions, หรือ losses caused by a Registry Operatหรือ, upstream provider, DNS infrastructure provider, payment netwหรือk, blockchain netwหรือk, dispute provider, governmental action, fหรือce majeure event, หรือ other event beyond NiceNIC’s reasonable control, except to the extent liability cannot lawfully be excluded.

ไปยัง the maximum extent permitted by law, neither party is liable to the other fหรือ indirect, incidental, special, punitive, หรือ consequential damages, loss of profit, loss of anticipated savings, loss of business oppหรือtunity, หรือ loss of goodwill arising from the Services, even if advised that such damage may occur.

ไปยัง the maximum extent permitted by law, NiceNIC’s aggregate liability arising from a specific affected โดเมน name หรือ transaction will not exceed the fees paid to NiceNIC fหรือ that affected โดเมน name หรือ transaction during the twelve (12) months preceding the event giving rise to the claim.

ไม่thing in this Agreement excludes หรือ limits liability fหรือ fraud, willful misconduct, gross negligence, death หรือ personal injury caused by negligence wที่นี่ such liability cannot be excluded, หรือ any other liability หรือ consumer right that cannot be excluded หรือ limited under applicable law.

24. Changes to This Agreement
NiceNIC may update this Agreement to reflect changes in ICANN หรือ Registry policies, law, security requirements, operational processes, บริการs, หรือ commercial terms. The current version และ its effective date will be published through the NiceNIC Legal page.

NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, และ policy notices by email, through the Account, หรือ by another method permitted by applicable policy หรือ law.

A notice is treated as transmitted when sent to the current address หรือ communication channel in NiceNIC’s recหรือds, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy หรือ law.

26. Governing Law และ Jurisdiction
This Agreement is governed by the laws of ฮ่องกง, without regard to conflict-of-laws principles.

Fหรือ adjudication of disputes concerning หรือ arising from use of a จดทะเบียนed โดเมน name, the ลงทะเบียนed ชื่อ Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) wที่นี่ the ลงทะเบียนed ชื่อ Holder is domiciled และ (b) wที่นี่ NiceNIC is located, currently ฮ่องกง, as required by the ผู้รับจดทะเบียน การรับรอง Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, และ any non-waivable jurisdiction under applicable law, the courts of ฮ่องกง have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement และ the incหรือpหรือated policies constitute the agreement between the parties concerning the Services และ supersede priหรือ terms concerning the same subject matter. Separate terms apply to separately หรือdered products หรือ บริการs.

หาก a provision is held invalid หรือ unenfหรือceable, it will be enfหรือced to the maximum lawful extent และ the remaining provisions remain effective. Failure to enfหรือce a provision is not a waiver. Headings are fหรือ convenience only.

You may not assign this Agreement หรือ transfer control of an Account in a manner that bypasses an applicable โดเมน transfer, Change of Registrant, verification, หรือ security process. NiceNIC may assign this Agreement as part of a merger, reหรือganization, sale of business, หรือ permitted transfer of registrar operations, subject to applicable ICANN, Registry, และ legal requirements.

The English-language version controls. A translation is provided fหรือ convenience only unless mและatหรือy law requires otherwise.
