1. Agreement және Acceptance

2. Definitions
“Account” means the NiceNIC customer account through which Services are немесеdered немесе managed.

The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, және mжәнеatнемесеy laws және regulations.

NiceNIC may reject немесе cancel a pending application befнемесеe registry completion wмұнда the name is unavailable, reserved, prohiбитed, restricted, subject to an eligibility failure, affected by an evident pricing немесе technical errнемесе, unsuppнемесеted by the Registry, немесе inconsistent with applicable law, policy, немесе this Agreement. 5. TLD-Specific Rules, IDNs, және Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, restнемесеation, dispute, және data requirements. You must satisfy the applicable requirements және promptly provide requested infнемесеmation немесе documents. Registry requirements may change during the registration term.

ccTLD-тер are primarily governed by the applicable ccTLD Registry және local rules. ICANN gTLD policies do not necessarily apply to ccTLD-тер. Wмұнда NiceNIC provides a TLD through an upstream provider, that provider’s mжәнеatнемесеy terms may also apply.

Pre-registration, Sunrise, Lжәнеrush, Early Access, және similar launch-phase applications do not guarantee allocation. Competing applications, auctions, rights-validation requirements, Registry decisions, немесе launch rules may affect the result. Any non-refundable application, validation, немесе auction fee will be disclosed befнемесеe payment to the extent available to NiceNIC.

9. Licensed Use және Third-Party Data

The Тіркелуed Аты Holder accepts liability fнемесе harm caused by wrongful use of the домен name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact infнемесеmation provided by the licensee және the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

Public RDDS results may contain public, redacted, немесе pseudonymized data, немесе a communication mechanism, as required немесе permitted by applicable policy және law. You expressly consent to NiceNIC applying the clientTransferProhiбитed status upon initial registration as a stжәнеard security measure, wмұнда suppнемесеted және permitted. NiceNIC may deny немесе must deny a gTLD transfer only on grounds permitted немесе required by the current ICANN Transfer Policy. A Change of Registrant may be subject to confirmation, verification, және an inter-registrar transfer lock under the ICANN Transfer Policy. TLD-specific transfer және registrant-change rules may differ.

12. Fees, Taxes, және Төлеуment

This link және the fees displayed tмұнда are incнемесеpнемесеated into this Agreement by reference.

Fees may vary by TLD, Registry classification, premium status, registration term, account немесе reseller level, currency, tax, transaction type, және lifecycle status. Optional қызметs және any additional mжәнеatнемесеy charges will be disclosed befнемесеe the relevant немесеder is submitted to the extent kқазірn to NiceNIC.

The price presented fнемесе acceptance at checkout немесе at the time an API transaction is submitted is the applicable price fнемесе that transaction, subject to cнемесеrection of a clear pricing немесе system errнемесе befнемесеe registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, қызмет arrangements, немесе commercial terms change. Services are generally prepaid. You authнемесеize NiceNIC to charge the selected payment method немесе deduct the applicable amount from сіздің Account balance. You are responsible fнемесе taxes, payment-provider charges, blockchain netwнемесеk charges, currency-conversion costs, және other charges not expressly included in the displayed NiceNIC price.

Төлеуment does not complete a registry transaction. 13. Refunds және Reversals
Fees fнемесе a successfully completed registration, renewal, transfer, redemption, restнемесеation, premium-домен acquisition, немесе other completed registry transaction are non-refundable except wмұнда required by applicable law немесе expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, немесе failure of final settlement may result in suspension of the Account немесе affected Services және reasonable recovery action, subject to applicable law және ICANN немесе Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohiбитed by the ICANN Transfer Policy.

Wмұнда auto-renewal is offered және enabled, it is subject to sufficient Account balance немесе valid payment, Registry availability, applicable renewal deadlines, verification немесе eligibility requirements, және successful processing. NiceNIC does not guarantee auto-renewal wмұнда these conditions are not satisfied. You may disable auto-renewal befнемесеe processing, subject to the controls available in сіздің Account.

Fнемесе certain ccTLD-тер және other TLDs, the operational renewal deadline may occur befнемесеe the Registry expiration date. The applicable deadline және Registry rules control. You should not wait until the displayed expiration date to renew.

The applicable registration, transfer, renewal, post-expiration renewal (if different), және redemption/restнемесеe fees are published at https://nicenic.com/домен/prices.php.

Домен lifecycle periods және recovery options vary by TLD және may change under Registry rules немесе mжәнеatнемесеy ICANN requirements. Жоқt every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, немесе recovery method. Wмұнда the applicable gTLD Registry offers a Redemption Grace Period, NiceNIC will permit the Registrant at Expiration to request restнемесеation during that period, subject to payment of applicable renewal және redemption/restнемесеe fees, completion of required verification, және mжәнеatнемесеy Registry requirements. Fнемесе other TLDs, restнемесеation availability is determined by applicable Registry policy.

Recovery after expiration is not guaranteed once the applicable renewal немесе restнемесеation right has ended, the name reaches a non-recoverable status, немесе the Registry releases немесе allocates the name. NiceNIC does not guarantee the release time немесе the fнемесеmer Тіркелуed Аты Holder’s ability to re-тіркеу a deleted name.

16. Intellectual Property және Lawful Use

You must not use the Services fнемесе unlawful activity немесе in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, немесе the rights of others. Prohiбитed activity includes using a домен name to facilitate malware, botnets, phishing, pharming, немесе spam when spam serves as a delivery mechanism fнемесе another fнемесеm of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability немесе automatically require suspension. NiceNIC will review repнемесеts және take reasonable және appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, және the facts және circumstances of the matter. 17. Dispute Resolution Policies

NiceNIC generally does not adjudicate competing claims to a домен name және may require the parties to resolve them through agreement, the applicable dispute procedure, немесе a court of competent jurisdiction. NiceNIC may maintain an appropriate status немесе lock while a dispute is pending as required by policy.

18. Suspension, Бас тартуlation, Transfer, және Other Protective Әрекетs
NiceNIC may deny a pending transaction немесе take propнемесеtionate action affecting a домен name немесе Account wмұнда reasonably necessary және permitted немесе required to:

cнемесеrect a registration, pricing, technical, немесе operational errнемесе by NiceNIC немесе the Registry;
enfнемесеce this Agreement following a material breach, including applicable Тіркеу Data accuracy requirements;
respond to fraud, unauthнемесеized access, payment reversal, немесе a security incident;
investigate немесе mitigate DNS Abuse немесе unlawful use based on the facts және evidence reasonably available;
protect the security, stability, немесе resiliency of the DNS, a Registry, NiceNIC’s systems, немесе affected users;
comply with an ICANN немесе Registry policy, a dispute-resolution proceeding немесе decision, a court немесеder, valid legal process, немесе applicable law; немесе
satisfy a mжәнеatнемесеy TLD eligibility, verification, local-presence, немесе documentation requirement.

19. Account Security және Instructions
You are responsible fнемесе protecting Account credentials, authentication devices, API credentials, email accounts, және authнемесеized users. Instructions authenticated through сіздің Account немесе API may be treated as authнемесеized unless NiceNIC has reasonable notice of compromise немесе applicable policy requires additional verification.

You must promptly notify NiceNIC of suspected unauthнемесеized access, loss of credentials, unauthнемесеized домен changes, немесе a disputed transfer. NiceNIC may tempнемесеarily restrict Account немесе домен functions while reasonably investigating a security repнемесеt.

NiceNIC may require additional authentication немесе documentation fнемесе high-risk немесе irreversible actions. Such controls do not transfer responsibility fнемесе Account security to NiceNIC.

20. Privacy, Proxy, Trustee, және Local-Presence Services
Wмұнда available, privacy, proxy, trustee, agent, немесе local-presence қызметs are optional unless a TLD requires a qualifying local contact немесе presence. These қызметs may be governed by separate terms, fees, eligibility requirements, және disclosure rules that you must accept befнемесеe use.

This Agreement begins when accepted және remains applicable while you use the Services немесе a домен name remains sponsнемесеed немесе managed through NiceNIC. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, және governing-law provisions—survive termination.

You may stop using the Services, disable renewal wмұнда available, transfer an eligible домен name, немесе request closure of сіздің Account, subject to outstжәнеing obligations, security review, mжәнеatнемесеy retention, және applicable домен lifecycle немесе transfer restrictions. Closing an Account does not automatically delete, cancel, немесе transfer домен registrations.

22. Indemnification

23. Disclaimer және Limitation of Liability

24. Changes to This Agreement
NiceNIC may update this Agreement to reflect changes in ICANN немесе Registry policies, law, security requirements, operational processes, қызметs, немесе commercial terms. The current version және its effective date will be published through the NiceNIC Legal page.

NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, және policy notices by email, through the Account, немесе by another method permitted by applicable policy немесе law.

A notice is treated as transmitted when sent to the current address немесе communication channel in NiceNIC’s recнемесеds, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy немесе law.

26. Governing Law және Jurisdiction
This Agreement is governed by the laws of Гонконг, without regard to conflict-of-laws principles.

Fнемесе adjudication of disputes concerning немесе arising from use of a тіркеуed домен name, the Тіркелуed Аты Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) wмұнда the Тіркелуed Аты Holder is domiciled және (b) wмұнда NiceNIC is located, currently Гонконг, as required by the Тіркеуші Аккредиттеу Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, және any non-waivable jurisdiction under applicable law, the courts of Гонконг have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement және the incнемесеpнемесеated policies constitute the agreement between the parties concerning the Services және supersede priнемесе terms concerning the same subject matter. Separate terms apply to separately немесеdered products немесе қызметs.

Егер a provision is held invalid немесе unenfнемесеceable, it will be enfнемесеced to the maximum lawful extent және the remaining provisions remain effective. Failure to enfнемесеce a provision is not a waiver. Headings are fнемесе convenience only.

You may not assign this Agreement немесе transfer control of an Account in a manner that bypasses an applicable домен transfer, Change of Registrant, verification, немесе security process. NiceNIC may assign this Agreement as part of a merger, reнемесеganization, sale of business, немесе permitted transfer of registrar operations, subject to applicable ICANN, Registry, және legal requirements.
