1. Agreement và Acceptance

2. Definitions
“Account” means the NiceNIC customer account through which Services are hoặcdered hoặc managed.

The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, và mvàathoặcy laws và regulations.

Registry databases và availability results may change between search và completion.

NiceNIC may reject hoặc cancel a pending application befhoặce registry completion wtại đây the name is unavailable, reserved, prohibited, restricted, subject to an eligibility failure, affected by an evident pricing hoặc technical errhoặc, unsupphoặcted by the Registry, hoặc inconsistent with applicable law, policy, hoặc this Agreement. 5. TLD-Specific Rules, IDNs, và Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, resthoặcation, dispute, và data requirements. You must satisfy the applicable requirements và promptly provide requested infhoặcmation hoặc documents. Registry requirements may change during the registration term.

ccTLD are primarily governed by the applicable ccTLD Registry và local rules. ICANN gTLD policies do not necessarily apply to ccTLD. Wtại đây NiceNIC provides a TLD through an upstream provider, that provider’s mvàathoặcy terms may also apply.

Internationalized domain names (“IDNs”) depend on Registry-supphoặcted scripts, language tables, label-generation rules, browser supphoặct, và DNS stvàards. Pre-registration, Sunrise, Lvàrush, Early Access, và similar launch-phase applications do not guarantee allocation. Competing applications, auctions, rights-validation requirements, Registry decisions, hoặc launch rules may affect the result. Any non-refundable application, validation, hoặc auction fee will be disclosed befhoặce payment to the extent available to NiceNIC.

A reseller hoặc agent using NiceNIC Services fhoặc third parties must:

9. Licensed Use và Third-Party Data

The Đăng kýed Tên Holder accepts liability fhoặc harm caused by wrongful use of the tên miền name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact infhoặcmation provided by the licensee và the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

Public RDDS results may contain public, redacted, hoặc pseudonymized data, hoặc a communication mechanism, as required hoặc permitted by applicable policy và law. You expressly consent to NiceNIC applying the clientTransferProhibited status upon initial registration as a stvàard security measure, wtại đây supphoặcted và permitted. NiceNIC may deny hoặc must deny a gTLD transfer only on grounds permitted hoặc required by the current ICANN Transfer Policy. When NiceNIC denies a transfer request, it will provide the reason fhoặc denial to the Đăng kýed Tên Holder và the potential Gaining Nhà đăng ký as required by that Policy.

A Change of Registrant may be subject to confirmation, verification, và an inter-registrar transfer lock under the ICANN Transfer Policy. 12. Fees, Taxes, và Thanh toánment

This link và the fees displayed ttại đây are inchoặcphoặcated into this Agreement by reference.

Fees may vary by TLD, Registry classification, premium status, registration term, account hoặc reseller level, currency, tax, transaction type, và lifecycle status. Optional Dịch vụs và any additional mvàathoặcy charges will be disclosed befhoặce the relevant hoặcder is submitted to the extent kngayn to NiceNIC.

The price presented fhoặc acceptance at checkout hoặc at the time an API transaction is submitted is the applicable price fhoặc that transaction, subject to choặcrection of a clear pricing hoặc system errhoặc befhoặce registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, Dịch vụ arrangements, hoặc commercial terms change. Services are generally prepaid. You authhoặcize NiceNIC to charge the selected payment method hoặc deduct the applicable amount from của bạn Account balance. You are responsible fhoặc taxes, payment-provider charges, blockchain netwhoặck charges, currency-conversion costs, và other charges not expressly included in the displayed NiceNIC price.

Thanh toánment does not complete a registry transaction. Cryptocurrency và blockchain transactions are irreversible, và NiceNIC does not reimburse exchange-rate changes hoặc third-party netwhoặck fees.

13. Refunds và Reversals
Fees fhoặc a successfully completed registration, renewal, transfer, redemption, resthoặcation, premium-tên miền acquisition, hoặc other completed registry transaction are non-refundable except wtại đây required by applicable law hoặc expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, hoặc failure of final settlement may result in suspension of the Account hoặc affected Services và reasonable recovery action, subject to applicable law và ICANN hoặc Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohibited by the ICANN Transfer Policy.

Fhoặc certain ccTLD và other TLDs, the operational renewal deadline may occur befhoặce the Registry expiration date. The applicable deadline và Registry rules control. You should not wait until the displayed expiration date to renew.

The applicable registration, transfer, renewal, post-expiration renewal (if different), và redemption/resthoặce fees are published at https://nicenic.com/tên miền/prices.php.

Tên miền lifecycle periods và recovery options vary by TLD và may change under Registry rules hoặc mvàathoặcy ICANN requirements. Khôngt every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, hoặc recovery method. Wtại đây the applicable gTLD Registry offers a Redemption Grace Period, NiceNIC will permit the Registrant at Expiration to request resthoặcation during that period, subject to payment of applicable renewal và redemption/resthoặce fees, completion of required verification, và mvàathoặcy Registry requirements. Fhoặc other TLDs, resthoặcation availability is determined by applicable Registry policy.

Recovery after expiration is not guaranteed once the applicable renewal hoặc resthoặcation right has ended, the name reaches a non-recoverable status, hoặc the Registry releases hoặc allocates the name. NiceNIC does not guarantee the release time hoặc the fhoặcmer Đăng kýed Tên Holder’s ability to re-đăng ký a deleted name.

16. Intellectual Property và Lawful Use
Đến the best of the Đăng kýed Tên Holder’s kngayledge và belief, neither registration of the tên miền name nhoặc the manner in which it is directly hoặc indirectly used infringes the legal rights of any third party. NiceNIC does not determine whether a requested name hoặc its intended use violates another party’s trademark, copyright, privacy, publicity, contractual, hoặc other rights.

You must not use the Services fhoặc unlawful activity hoặc in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, hoặc the rights of others. Prohibited activity includes using a tên miền name to facilitate malware, botnets, phishing, pharming, hoặc spam when spam serves as a delivery mechanism fhoặc another fhoặcm of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability hoặc automatically require suspension. NiceNIC will review rephoặcts và take reasonable và appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, và the facts và circumstances of the matter. NiceNIC may request infhoặcmation from the Đăng kýed Tên Holder hoặc Account Holder. Immediate action may be taken wtại đây required by law hoặc policy hoặc reasonably necessary to address an urgent security threat hoặc ongoing harm.

Abuse rephoặcts should be submitted through https://nicenic.com/rephoặctabuse.php hoặc another official abuse channel published by NiceNIC.

17. Dispute Resolution Policies

NiceNIC generally does not adjudicate competing claims to a tên miền name và may require the parties to resolve them through agreement, the applicable dispute procedure, hoặc a court of competent jurisdiction. NiceNIC may maintain an appropriate status hoặc lock while a dispute is pending as required by policy.

18. Suspension, Hủylation, Transfer, và Other Protective Hành độngs
NiceNIC may deny a pending transaction hoặc take prophoặctionate action affecting a tên miền name hoặc Account wtại đây reasonably necessary và permitted hoặc required to:

choặcrect a registration, pricing, technical, hoặc operational errhoặc by NiceNIC hoặc the Registry;
enfhoặcce this Agreement following a material breach, including applicable Đăng ký Data accuracy requirements;
respond to fraud, unauthhoặcized access, payment reversal, hoặc a security incident;
investigate hoặc mitigate DNS Abuse hoặc unlawful use based on the facts và evidence reasonably available;
protect the security, stability, hoặc resiliency of the DNS, a Registry, NiceNIC’s systems, hoặc affected users;
comply with an ICANN hoặc Registry policy, a dispute-resolution proceeding hoặc decision, a court hoặcder, valid legal process, hoặc applicable law; hoặc
satisfy a mvàathoặcy TLD eligibility, verification, local-presence, hoặc documentation requirement.

NiceNIC will not exercise these rights in a manner inconsistent with mvàathoặcy ICANN Consensus Policies hoặc Registry requirements.

19. Account Security và Instructions
You are responsible fhoặc protecting Account credentials, authentication devices, API credentials, email accounts, và authhoặcized users. Instructions authenticated through của bạn Account hoặc API may be treated as authhoặcized unless NiceNIC has reasonable notice of compromise hoặc applicable policy requires additional verification.

You must promptly notify NiceNIC of suspected unauthhoặcized access, loss of credentials, unauthhoặcized tên miền changes, hoặc a disputed transfer. NiceNIC may temphoặcarily restrict Account hoặc tên miền functions while reasonably investigating a security rephoặct.

NiceNIC may require additional authentication hoặc documentation fhoặc high-risk hoặc irreversible actions. Such controls do not transfer responsibility fhoặc Account security to NiceNIC.

20. Privacy, Proxy, Trustee, và Local-Presence Services

This Agreement begins when accepted và remains applicable while you use the Services hoặc a tên miền name remains sponshoặced hoặc managed through NiceNIC. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, và governing-law provisions—survive termination.

22. Indemnification

23. Disclaimer và Limitation of Liability

NiceNIC is not responsible fhoặc delays, errhoặcs, interruptions, hoặc losses caused by a Registry Operathoặc, upstream provider, DNS infrastructure provider, payment netwhoặck, blockchain netwhoặck, dispute provider, governmental action, fhoặcce majeure event, hoặc other event beyond NiceNIC’s reasonable control, except to the extent liability cannot lawfully be excluded.

Đến the maximum extent permitted by law, neither party is liable to the other fhoặc indirect, incidental, special, punitive, hoặc consequential damages, loss of profit, loss of anticipated savings, loss of business opphoặctunity, hoặc loss of goodwill arising from the Services, even if advised that such damage may occur.

Đến the maximum extent permitted by law, NiceNIC’s aggregate liability arising from a specific affected tên miền name hoặc transaction will not exceed the fees paid to NiceNIC fhoặc that affected tên miền name hoặc transaction during the twelve (12) months preceding the event giving rise to the claim.

24. Changes to This Agreement

NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, và policy notices by email, through the Account, hoặc by another method permitted by applicable policy hoặc law.

A notice is treated as transmitted when sent to the current address hoặc communication channel in NiceNIC’s rechoặcds, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy hoặc law.

26. Governing Law và Jurisdiction
This Agreement is governed by the laws of Hồng Kông, without regard to conflict-of-laws principles.

Fhoặc adjudication of disputes concerning hoặc arising from use of a đăng kýed tên miền name, the Đăng kýed Tên Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) wtại đây the Đăng kýed Tên Holder is domiciled và (b) wtại đây NiceNIC is located, currently Hồng Kông, as required by the Nhà đăng ký Chứng nhận Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, và any non-waivable jurisdiction under applicable law, the courts of Hồng Kông have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement và the inchoặcphoặcated policies constitute the agreement between the parties concerning the Services và supersede prihoặc terms concerning the same subject matter. Separate terms apply to separately hoặcdered products hoặc Dịch vụs.

NiceNIC may assign this Agreement as part of a merger, rehoặcganization, sale of business, hoặc permitted transfer of registrar operations, subject to applicable ICANN, Registry, và legal requirements.
