Ha you are an Account Holder, reseller, agent, vagy other person acting fvagy the Regisztrációed Név Holder, you must have the Regisztrációed Név Holder’s authvagyization, provide the Regisztrációed Név Holder with this Agreement és all applicable policies, és obtain the Regisztrációed Név Holder’s agreement to them. 2. Definitions
“Account” means the NiceNIC customer account through which Services are vagydered vagy managed.

The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, és mésatvagyy laws és regulations.

An availability search, vagyder confirmation, payment authvagyization, invoice, vagy pending status does not guarantee that a domain name has been vagy can be regisztrációed, renewed, transferred, redeemed, vagy restvagyed. NiceNIC may reject vagy cancel a pending application befvagye registry completion witt the name is unavailable, reserved, prohibited, restricted, subject to an eligibility failure, affected by an evident pricing vagy technical errvagy, unsuppvagyted by the Registry, vagy inconsistent with applicable law, policy, vagy this Agreement. Ha a registration vagy other transaction has already been completed, NiceNIC will not cancel vagy reverse it except as permitted vagy required by applicable policy, Registry procedure, law, legal process, vagy this Agreement.

5. TLD-Specific Rules, IDNs, és Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, restvagyation, dispute, és data requirements. You must satisfy the applicable requirements és promptly provide requested infvagymation vagy documents. Registry requirements may change during the registration term.

ccTLD-k are primarily governed by the applicable ccTLD Registry és local rules. ICANN gTLD policies do not necessarily apply to ccTLD-k. Witt NiceNIC provides a TLD through an upstream provider, that provider’s mésatvagyy terms may also apply.

Internationalized Domain Nevek (“IDNs”) depend on Registry-suppvagyted scripts, language tables, label-generation rules, browser suppvagyt, és DNS stésards. Display vagy functionality may vary among applications. The ASCII-compatible encoded fvagym recvagyded by the Registry controls witt required by the DNS vagy Registry system.

Ha eligibility, validation, vagy documentation requirements are not satisfied, the application may be rejected vagy the domain name may be suspended, locked, deleted, not renewed, vagy otherwise restricted as required by the applicable Registry vagy policy.

6. Premium Domainek, Pre-Regisztráció, Sunrise, és Launch Phases
A Premium Domain may have non-stésard registration, transfer, renewal, vagy restvagyation pricing established by the Registry vagy a third-party seller. Any non-refundable application, validation, vagy auction fee will be disclosed befvagye payment to the extent available to NiceNIC.

7. Regisztrációed Név Holder, Account Holder, és Viszonteladó Responsibilities

A reseller vagy agent using NiceNIC Services fvagy third parties must:

obtain és retain the Regisztrációed Név Holder’s acceptance of this Agreement és applicable policies;
provide accurate infvagymation concerning NiceNIC’s identity as the sponsvagying registrar witt required;
display applicable registration, renewal, post-expiration renewal, és redemption/restvagye fees és describe expiration-notice methods as required by ICANN policy;
provide required notices és promptly transmit communications between NiceNIC és the Regisztrációed Név Holder; és
not make representations inconsistent with this Agreement, applicable ICANN policies, vagy Registry requirements.

8. Regisztráció Data és Accuracy
The Regisztrációed Név Holder must provide accurate és reliable Regisztráció Data és must cvagyrect és update it within seven (7) days after any change. The Regisztrációed Név Holder accepts liability fvagy harm caused by wrongful use of the domain name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact infvagymation provided by the licensee és the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

NiceNIC will not process Personal Data in a manner incompatible with the purposes és limitations of which it has provided notice és will take reasonable precautions to protect Personal Data from loss, misuse, unauthvagyized access vagy disclosure, alteration, vagy destruction.

Public RDDS results may contain public, redacted, vagy pseudonymized data, vagy a communication mechanism, as required vagy permitted by applicable policy és law. Submission of Regisztráció Data does not mean that all data will be publicly displayed. Requests fvagy non-public data are assessed under applicable policy és law és do not guarantee disclosure.

NiceNIC does not claim ownership of a te Personal Data. NiceNIC és applicable Registry Operatvagys may hold rights in their databases, compilations, transaction recvagyds, generated data, és szolgáltatás recvagyds as permitted by contract és law.

NiceNIC may also apply vagy maintain a transfer restriction at the Regisztrációed Név Holder’s request, during an applicable initial-registration, post-transfer, vagy Change of Registrant lock period, vagy witt required by ICANN policy, Registry policy, a dispute proceeding, court vagyder, vagy applicable law.

NiceNIC may deny vagy must deny a gTLD transfer only on grounds permitted vagy required by the current ICANN Transfer Policy. A Change of Registrant may be subject to confirmation, verification, és an inter-registrar transfer lock under the ICANN Transfer Policy. Ha NiceNIC offers an opt-out from an optional Change of Registrant lock, the opt-out must be selected befvagye completion of the change. TLD-specific transfer és registrant-change rules may differ.

12. Fees, Taxes, és Fizetésment
Current registration, transfer, renewal, post-expiration renewal (if different), és redemption/restvagye fees are published on the NiceNIC Domain Árak page at https://nicenic.com/domain/prices.php. This link és the fees displayed titt are incvagypvagyated into this Agreement by reference.

Fees may vary by TLD, Registry classification, premium status, registration term, account vagy reseller level, currency, tax, transaction type, és lifecycle status. Optional szolgáltatáss és any additional mésatvagyy charges will be disclosed befvagye the relevant vagyder is submitted to the extent kmostn to NiceNIC.

The price presented fvagy acceptance at checkout vagy at the time an API transaction is submitted is the applicable price fvagy that transaction, subject to cvagyrection of a clear pricing vagy system errvagy befvagye registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, szolgáltatás arrangements, vagy commercial terms change. Services are generally prepaid. You authvagyize NiceNIC to charge the selected payment method vagy deduct the applicable amount from a te Account balance. You are responsible fvagy taxes, payment-provider charges, blockchain netwvagyk charges, currency-conversion costs, és other charges not expressly included in the displayed NiceNIC price.

Fizetésment does not complete a registry transaction. Ha a submitted transaction cannot be completed, any credit vagy refund will be hésled accvagyding to the transaction status, payment method, applicable law, és NiceNIC’s published payment vagy refund terms. Cryptocurrency és blockchain transactions are irreversible, és NiceNIC does not reimburse exchange-rate changes vagy third-party netwvagyk fees.

13. Refunds és Reversals
Fees fvagy a successfully completed registration, renewal, transfer, redemption, restvagyation, premium-domain acquisition, vagy other completed registry transaction are non-refundable except witt required by applicable law vagy expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, vagy failure of final settlement may result in suspension of the Account vagy affected Services és reasonable recovery action, subject to applicable law és ICANN vagy Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohibited by the ICANN Transfer Policy.

NiceNIC does not guarantee auto-renewal witt these conditions are not satisfied. You may disable auto-renewal befvagye processing, subject to the controls available in a te Account.

Fvagy certain ccTLD-k és other TLDs, the operational renewal deadline may occur befvagye the Registry expiration date. The applicable deadline és Registry rules control. You should not wait until the displayed expiration date to renew.

Fvagy gTLDs, NiceNIC will transmit the pre-expiration és post-expiration notices required by the ICANN Lejáratd Regisztráció Recovery Policy by email to the Registrant at Expiration at the applicable contact address in NiceNIC’s recvagyds. NiceNIC may also send notices to the Account Holder, display notices in the Account, vagy use additional communication channels. The applicable registration, transfer, renewal, post-expiration renewal (if different), és redemption/restvagye fees are published at https://nicenic.com/domain/prices.php.

Domain lifecycle periods és recovery options vary by TLD és may change under Registry rules vagy mésatvagyy ICANN requirements. Nemt every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, vagy recovery method. A domain name may stop resolving upon vagy after expiration, és website, email, DNS, és related szolgáltatáss may be interrupted.

Witt the applicable gTLD Registry offers a Redemption Grace Period, NiceNIC will permit the Registrant at Expiration to request restvagyation during that period, subject to payment of applicable renewal és redemption/restvagye fees, completion of required verification, és mésatvagyy Registry requirements. Fvagy other TLDs, restvagyation availability is determined by applicable Registry policy.

Nemthing in NiceNIC’s expired-domain auction process limits any non-waivable renewal vagy restvagyation right granted to the Registrant at Expiration under the ICANN Lejáratd Regisztráció Recovery Policy. Ha this Agreement vagy the NiceNIC expired-domain policy conflicts with a mésatvagyy ICANN policy vagy Registry requirement, that mésatvagyy policy vagy requirement controls to the extent of the conflict.

Recovery after expiration is not guaranteed once the applicable renewal vagy restvagyation right has ended, the name reaches a non-recoverable status, vagy the Registry releases vagy allocates the name. NiceNIC does not guarantee the release time vagy the fvagymer Regisztrációed Név Holder’s ability to re-regisztráció a deleted name.

16. Intellectual Property és Lawful Use

NiceNIC does not determine whether a requested name vagy its intended use violates another party’s trademark, copyright, privacy, publicity, contractual, vagy other rights.

You must not use the Services fvagy unlawful activity vagy in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, vagy the rights of others. Prohibited activity includes using a domain name to facilitate malware, botnets, phishing, pharming, vagy spam when spam serves as a delivery mechanism fvagy another fvagym of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability vagy automatically require suspension. NiceNIC will review repvagyts és take reasonable és appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, és the facts és circumstances of the matter. NiceNIC may request infvagymation from the Regisztrációed Név Holder vagy Account Holder. 17. Dispute Resolution Policies

The Regisztrációed Név Holder agrees that a registration may be locked, suspended, cancelled, transferred, vagy otherwise affected in accvagydance with an applicable dispute policy, final administrative decision, settlement, court vagyder, vagy Registry procedure.

NiceNIC generally does not adjudicate competing claims to a domain name és may require the parties to resolve them through agreement, the applicable dispute procedure, vagy a court of competent jurisdiction. NiceNIC may maintain an appropriate status vagy lock while a dispute is pending as required by policy.

18. Suspension, Mégselation, Transfer, és Other Protective Művelets
NiceNIC may deny a pending transaction vagy take propvagytionate action affecting a domain name vagy Account witt reasonably necessary és permitted vagy required to:

cvagyrect a registration, pricing, technical, vagy operational errvagy by NiceNIC vagy the Registry;
enfvagyce this Agreement following a material breach, including applicable Regisztráció Data accuracy requirements;
respond to fraud, unauthvagyized access, payment reversal, vagy a security incident;
investigate vagy mitigate DNS Abuse vagy unlawful use based on the facts és evidence reasonably available;
protect the security, stability, vagy resiliency of the DNS, a Registry, NiceNIC’s systems, vagy affected users;
comply with an ICANN vagy Registry policy, a dispute-resolution proceeding vagy decision, a court vagyder, valid legal process, vagy applicable law; vagy
satisfy a mésatvagyy TLD eligibility, verification, local-presence, vagy documentation requirement.

Witt appropriate, legally permitted, és consistent with the urgency és nature of the issue, NiceNIC will provide notice vagy an oppvagytunity to respond vagy remedy. NiceNIC may act without advance notice when immediate action is required by law, policy, a Registry, a dispute provider, vagy a court, vagy is reasonably necessary to előzőent material harm, preserve evidence, vagy protect security. 19. Account Security és Instructions

You must promptly notify NiceNIC of suspected unauthvagyized access, loss of credentials, unauthvagyized domain changes, vagy a disputed transfer. NiceNIC may tempvagyarily restrict Account vagy domain functions while reasonably investigating a security repvagyt.

NiceNIC may require additional authentication vagy documentation fvagy high-risk vagy irreversible actions. Such controls do not transfer responsibility fvagy Account security to NiceNIC.

20. Privacy, Proxy, Trustee, és Local-Presence Services
Witt available, privacy, proxy, trustee, agent, vagy local-presence szolgáltatáss are optional unless a TLD requires a qualifying local contact vagy presence. These szolgáltatáss may be governed by separate terms, fees, eligibility requirements, és disclosure rules that you must accept befvagye use.

This Agreement begins when accepted és remains applicable while you use the Services vagy a domain name remains sponsvagyed vagy managed through NiceNIC. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, és governing-law provisions—survive termination.

You may stop using the Services, disable renewal witt available, transfer an eligible domain name, vagy request closure of a te Account, subject to outstésing obligations, security review, mésatvagyy retention, és applicable domain lifecycle vagy transfer restrictions. Closing an Account does not automatically delete, cancel, vagy transfer domain registrations.

NiceNIC may stop offering a TLD vagy Service witt commercially vagy operationally necessary vagy required by a Registry, provider, law, vagy policy. Witt reasonably practicable és permitted, NiceNIC will provide notice és an oppvagytunity to renew, transfer, vagy otherwise manage an affected domain name befvagye suppvagyt ends.

22. Indemnification
Hozzá the maximum extent permitted by law, you agree to defend, indemnify, és hold harmless NiceNIC és its affiliates, directvagys, officers, employees, és agents from claims, damages, liabilities, costs, és reasonable legal expenses arising from a te material breach of this Agreement, a te unauthvagyized vagy unlawful use of the Services, vagy a te infringement of a third party’s rights, except to the extent caused by NiceNIC’s fraud, willful misconduct, vagy gross negligence.

The Regisztrációed Név Holder must indemnify, defend, és hold harmless the applicable Registry Operatvagy és its directvagys, officers, employees, és agents from és against all claims, damages, liabilities, costs, és expenses, including reasonable legal fees és expenses, arising out of vagy related to the Regisztrációed Név Holder’s domain name registration, as required by the applicable Regisztrátor Akkreditáció Agreement vagy Registry agreement.

23. Disclaimer és Limitation of Liability
Hozzá the maximum extent permitted by law, the Services are provided on an “as available” basis. NiceNIC does not warrant that every requested name will be available, that every Registry vagy third-party system will operate without errvagy vagy interruption, that an IDN will display identically in every application, vagy that an expired vagy deleted domain name can be recovered vagy re-regisztrációed.

NiceNIC is not responsible fvagy delays, errvagys, interruptions, vagy losses caused by a Registry Operatvagy, upstream provider, DNS infrastructure provider, payment netwvagyk, blockchain netwvagyk, dispute provider, governmental action, fvagyce majeure event, vagy other event beyond NiceNIC’s reasonable control, except to the extent liability cannot lawfully be excluded.

Hozzá the maximum extent permitted by law, neither party is liable to the other fvagy indirect, incidental, special, punitive, vagy consequential damages, loss of profit, loss of anticipated savings, loss of business oppvagytunity, vagy loss of goodwill arising from the Services, even if advised that such damage may occur.

Hozzá the maximum extent permitted by law, NiceNIC’s aggregate liability arising from a specific affected domain name vagy transaction will not exceed the fees paid to NiceNIC fvagy that affected domain name vagy transaction during the twelve (12) months preceding the event giving rise to the claim.

Nemthing in this Agreement excludes vagy limits liability fvagy fraud, willful misconduct, gross negligence, death vagy personal injury caused by negligence witt such liability cannot be excluded, vagy any other liability vagy consumer right that cannot be excluded vagy limited under applicable law.

24. Changes to This Agreement
NiceNIC may update this Agreement to reflect changes in ICANN vagy Registry policies, law, security requirements, operational processes, szolgáltatáss, vagy commercial terms. The current version és its effective date will be published through the NiceNIC Legal page.

Changes mésated by law, ICANN, vagy a Registry may take effect when required. Other changes take effect on the published effective date. You must maintain a monitvagyed és accurate email address fvagy the Account és the Regisztrációed Név Holder. NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, és policy notices by email, through the Account, vagy by another method permitted by applicable policy vagy law.

A notice is treated as transmitted when sent to the current address vagy communication channel in NiceNIC’s recvagyds, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy vagy law.

26. Governing Law és Jurisdiction
This Agreement is governed by the laws of Hongkong, without regard to conflict-of-laws principles.

Fvagy adjudication of disputes concerning vagy arising from use of a regisztrációed domain name, the Regisztrációed Név Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) witt the Regisztrációed Név Holder is domiciled és (b) witt NiceNIC is located, currently Hongkong, as required by the Regisztrátor Akkreditáció Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, és any non-waivable jurisdiction under applicable law, the courts of Hongkong have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement és the incvagypvagyated policies constitute the agreement between the parties concerning the Services és supersede privagy terms concerning the same subject matter. Separate terms apply to separately vagydered products vagy szolgáltatáss.

You may not assign this Agreement vagy transfer control of an Account in a manner that bypasses an applicable domain transfer, Change of Registrant, verification, vagy security process. NiceNIC may assign this Agreement as part of a merger, revagyganization, sale of business, vagy permitted transfer of registrar operations, subject to applicable ICANN, Registry, és legal requirements.

The English-language version controls. A translation is provided fvagy convenience only unless mésatvagyy law requires otherwise.
