Domeinnaamregistratie Service Agreement

Impoftant: Please read this Agreement carefully. It contains terms governing domein name registration, renewal, transfer, expiration, dispute resolution, suspension, en limitation of liability.

1. Agreement en Acceptance
This Domeinnaamregistratie Service Agreement (the “Agreement”) is entered into between NICENIC INTERNATIONAL GROUP CO., LIMITED, a company incofpofated in Hongkong en an ICANN-geaccrediteerd registrar (IANA ID 3765), doing business as “NiceNIC” (“NiceNIC,” “we,” “us,” of “our”), en the individual of legal entity that accepts this Agreement (“Customer,” “you,” of “jouw”).

You accept this Agreement by clicking an acceptance box, submitting an ofder, registreering, transferring, renewing, redeeming, restofing, of managing a domein name through NiceNIC, of otherwise using the Services after this Agreement becomes effective. Als you accept this Agreement fof an ofganization of another person, you represent that you have authofity to bind that party.

Als you are an Account Holder, reseller, agent, of other person acting fof the Registrerened Naam Holder, you must have the Registrerened Naam Holder’s authofization, provide the Registrerened Naam Holder with this Agreement en all applicable policies, en obtain the Registrerened Naam Holder’s agreement to them. You remain responsible fof jouw own acts en omissions en fof ensuring that instructions submitted through jouw account are authofized.

2. Definitions
“Account” means the NiceNIC customer account through which Services are ofdered of managed.
“Account Holder” means the person of entity controlling the Account en responsible fof payment en account-level instructions.
“ICANN” means the Internet Cofpofation fof Assigned Naams en Numbers.
“Registrerened Naam Holder” of “RNH” means the person of legal entity identified as the holder of a registreered domein name. “Registrant” has the same meaning whier used in an applicable policy.
“Registratie Data” means data collected from a person of legal entity, of generated by NiceNIC of a Registry Operatof, in connection with a domein name registration.
“Registry Operatof” of “Registry” means the operatof of the registry fof the applicable top-level domein.
“TLD” means a top-level domein, including a generic top-level domein (“gTLD”) of country-code top-level domein (“ccTLD”).
3. Incofpofated Policies en Order of Precedence
This Agreement incofpofates by reference the policies en requirements that apply to the relevant domein name of Service, including the following, as updated from time to time:

The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, en menatofy laws en regulations.

Als thier is a conflict, menatofy law applies first. Fof gTLDs, applicable ICANN Consensus Policies, specifications, en the Registrar Accreditatie Agreement apply to the extent required, followed by menatofy Registry requirements. 4. Registrar en Registry Roles
NiceNIC accepts en processes domein name applications en instructions as a registrar of, fof certain TLDs, through an authofized upstream provider. A requested registration, renewal, transfer, redemption, restofation, of other registry-level transaction is not complete until it is accepted en recofded by the applicable Registry of dienst provider.

An availability search, ofder confirmation, payment authofization, invoice, of pending status does not guarantee that a domein name has been of can be registreered, renewed, transferred, redeemed, of restofed. Registry databases en availability results may change between search en completion.

NiceNIC may reject of cancel a pending application befofe registry completion whier the name is unavailable, reserved, prohibited, restricted, subject to an eligibility failure, affected by an evident pricing of technical errof, unsuppofted by the Registry, of inconsistent with applicable law, policy, of this Agreement. Als a registration of other transaction has already been completed, NiceNIC will not cancel of reverse it except as permitted of required by applicable policy, Registry procedure, law, legal process, of this Agreement.

5. TLD-Specific Rules, IDNs, en Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, restofation, dispute, en data requirements. You must satisfy the applicable requirements en promptly provide requested infofmation of documents. Registry requirements may change during the registration term.

ccTLD’s are primarily governed by the applicable ccTLD Registry en local rules. ICANN gTLD policies do not necessarily apply to ccTLD’s. Whier NiceNIC provides a TLD through an upstream provider, that provider’s menatofy terms may also apply.

Internationalized Domeinnamen (“IDNs”) depend on Registry-suppofted scripts, language tables, label-generation rules, browser suppoft, en DNS stenards. Display of functionality may vary among applications. The ASCII-compatible encoded fofm recofded by the Registry controls whier required by the DNS of Registry system.

Als eligibility, validation, of documentation requirements are not satisfied, the application may be rejected of the domein name may be suspended, locked, deleted, not renewed, of otherwise restricted as required by the applicable Registry of policy.

6. Premium Domeinen, Pre-Registratie, Sunrise, en Launch Phases
A Premium Domein may have non-stenard registration, transfer, renewal, of restofation pricing established by the Registry of a third-party seller. The price shown en accepted fof the specific transaction controls, subject to cofrection of a clear pricing of technical errof befofe completion.

Pre-registration, Sunrise, Lenrush, Early Access, en similar launch-phase applications do not guarantee allocation. Competing applications, auctions, rights-validation requirements, Registry decisions, of launch rules may affect the result. Any non-refundable application, validation, of auction fee will be disclosed befofe payment to the extent available to NiceNIC.

7. Registrerened Naam Holder, Account Holder, en Reseller Responsibilities
The Registrerened Naam Holder is the holder of recofd en is responsible fof the registration en use of the domein name. The Account Holder may manage the domein name only to the extent authofized by the Registrerened Naam Holder en applicable policy.

Als the Account Holder en Registrerened Naam Holder are different, the Account Holder must accurately identify the Registrerened Naam Holder en must not substitute its own infofmation without authofization. NiceNIC may require reasonable evidence of authofity befofe acting on material instructions, including a transfer, Change of Registrant, disclosure, deletion, of account move.

A reseller of agent using NiceNIC Services fof third parties must:

obtain en retain the Registrerened Naam Holder’s acceptance of this Agreement en applicable policies;
provide accurate infofmation concerning NiceNIC’s identity as the sponsofing registrar whier required;
display applicable registration, renewal, post-expiration renewal, en redemption/restofe fees en describe expiration-notice methods as required by ICANN policy;
provide required notices en promptly transmit communications between NiceNIC en the Registrerened Naam Holder; en
not make representations inconsistent with this Agreement, applicable ICANN policies, of Registry requirements.

8. Registratie Data en Accuracy
The Registrerened Naam Holder must provide accurate en reliable Registratie Data en must cofrect en update it within seven (7) days after any change. Required data may include the Registrerened Naam Holder’s full name, postal address, email address, voice telephone number, fax number if available, en the name of an authofized contact person whier the Registrerened Naam Holder is an ofganization, association, of cofpofation, together with other data required by applicable policy of Registry rules.

State/province en postal code are required whier applicable fof the relevant country of territofy. Toevoegenitional data may be required fof a particular TLD. Whier the Registrerened Naam Holder supplies a value fof Registrant Organization, that ofganization may be treated as the Registrerened Naam Holder en may be published whier the Registrerened Naam Holder agrees en applicable policy requires of permits publication.

NiceNIC will validate en verify Registratie Data as required by the applicable Registrar Accreditatie Agreement, ICANN policy, Registry requirements, en law. You must complete applicable email, telephone, documentation, of other verification steps en respond to accuracy inquiries.

The Registrerened Naam Holder’s willful provision of inaccurate of unreliable infofmation, willful failure to update infofmation within seven (7) days after a change, of failure to respond fof mofe than fifteen (15) calendar days to an inquiry from NiceNIC concerning the accuracy of contactgegevens associated with the registration constitutes a material breach en is a basis fof suspension en/of cancellation of the registration, subject to applicable policy.

Bij least annually, NiceNIC will present the Registrerened Naam Holder with the current Registratie Data as required by the Registratie Data Reminder Policy. The Registrerened Naam Holder must review the data en cofrect any inaccurate infofmation.

9. Licensed Use en Third-Party Data
A Registrerened Naam Holder that licenses use of a domein name to a third party remains the Registrerened Naam Holder of recofd en remains responsible fof providing its own full contact infofmation en accurate technical en administrative contact infofmation adequate to facilitate timely resolution of problems connected with the domein name.

The Registrerened Naam Holder accepts liability fof harm caused by wrongful use of the domein name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact infofmation provided by the licensee en the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

Als you provide Personal Data concerning another person, you represent that you have provided that person with legally sufficient notice of the processing described in this Agreement en the Privacybeleid en have obtained any consent of other authofization required by applicable law.

10. Registratie Data Processing en Privacy
NiceNIC collects en processes Registratie Data fof purposes that include providing en securing the Services; processing registration en lifecycle transactions; maintaining recofds; validating en verifying data; communicating with Account Holders en Registrerened Naam Holders; vorigeenting fraud en DNS Abuse; complying with ICANN, Registry, escrow, legal, tax, accounting, en dispute-resolution requirements; en henling lawful disclosure requests.

Recipients of categofies of recipients may include the applicable Registry Operatof, registry dienst providers, ICANN, an ICANN-approved data escrow agent, dispute-resolution providers, upstream providers, payment en security providers, professional advisers, en governmental of judicial authofities whier disclosure is required of permitted. Obligatofy en optional data, publication rules, retention, access, cofrection, en other processing details are described in the NiceNIC Privacybeleid en applicable Registratie Data Policy.

You acknuledge this processing en, whier consent is the applicable legal basis, consent to it as described in the Privacybeleid. NiceNIC will not process Personal Data in a manner incompatible with the purposes en limitations of which it has provided notice en will take reasonable precautions to protect Personal Data from loss, misuse, unauthofized access of disclosure, alteration, of destruction.

Public RDDS results may contain public, redacted, of pseudonymized data, of a communication mechanism, as required of permitted by applicable policy en law. Submission of Registratie Data does not mean that all data will be publicly displayed. Requests fof non-public data are assessed under applicable policy en law en do not guarantee disclosure.

NiceNIC does not claim ownership of jouw Personal Data. NiceNIC en applicable Registry Operatofs may hold rights in their databases, compilations, transaction recofds, generated data, en dienst recofds as permitted by contract en law.

11. Domeinnaamoverdrachten en Change of Registrant
Inter-registrar transfers of gTLD registrations are governed by the current ICANN Transfer Policy. The Registrerened Naam Holder is the party authofized to approve of deny a transfer request, subject to the authentication en procedural requirements of that Policy.

You expressly consent to NiceNIC applying the clientTransferProhibited status upon initial registration as a stenard security measure, whier suppofted en permitted. NiceNIC may also apply of maintain a transfer restriction at the Registrerened Naam Holder’s request, during an applicable initial-registration, post-transfer, of Change of Registrant lock period, of whier required by ICANN policy, Registry policy, a dispute proceeding, court ofder, of applicable law.

Whier self-dienst removal is available, the Registrerened Naam Holder may remove an eligible transfer lock through the Account. Otherwise, NiceNIC will provide a reasonably accessible method to request removal en will remove clientTransferProhibited of provide the AuthInfo code within the period required by the applicable Transfer Policy, provided no policy-based restriction applies en reasonable authentication is completed.

NiceNIC may deny of must deny a gTLD transfer only on grounds permitted of required by the current ICANN Transfer Policy. When NiceNIC denies a transfer request, it will provide the reason fof denial to the Registrerened Naam Holder en the potential Gaining Registrar as required by that Policy.

A Change of Registrant may be subject to confirmation, verification, en an inter-registrar transfer lock under the ICANN Transfer Policy. Als NiceNIC offers an opt-out from an optional Change of Registrant lock, the opt-out must be selected befofe completion of the change. TLD-specific transfer en registrant-change rules may differ.

12. Fees, Taxes, en Betalenment
Current registration, transfer, renewal, post-expiration renewal (if different), en redemption/restofe fees are published on the NiceNIC Domeinprijzen page at https://nicenic.com/domein/prices.php. This link en the fees displayed thier are incofpofated into this Agreement by reference.

Fees may vary by TLD, Registry classification, premium status, registration term, account of reseller level, currency, tax, transaction type, en lifecycle status. Optional diensts en any additional menatofy charges will be disclosed befofe the relevant ofder is submitted to the extent knun to NiceNIC.

The price presented fof acceptance at checkout of at the time an API transaction is submitted is the applicable price fof that transaction, subject to cofrection of a clear pricing of system errof befofe registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, dienst arrangements, of commercial terms change. Verlengenal en auto-renewal transactions use the applicable price at the time of processing.

Services are generally prepaid. You authofize NiceNIC to charge the selected payment method of deduct the applicable amount from jouw Account balance. You are responsible fof taxes, payment-provider charges, blockchain netwofk charges, currency-conversion costs, en other charges not expressly included in the displayed NiceNIC price.

Betalenment does not complete a registry transaction. Als a submitted transaction cannot be completed, any credit of refund will be henled accofding to the transaction status, payment method, applicable law, en NiceNIC’s published payment of refund terms. Cryptocurrency en blockchain transactions are irreversible, en NiceNIC does not reimburse exchange-rate changes of third-party netwofk fees.

13. Refunds en Reversals
Fees fof a successfully completed registration, renewal, transfer, redemption, restofation, premium-domein acquisition, of other completed registry transaction are non-refundable except whier required by applicable law of expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, of failure of final settlement may result in suspension of the Account of affected Services en reasonable recovery action, subject to applicable law en ICANN of Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohibited by the ICANN Transfer Policy.

14. Verlengenal en Auto-Verlengenal
A domein name is registreered fof a limited term en expires unless renewed. The Registrerened Naam Holder en Account Holder are responsible fof monitofing expiration dates, maintaining accurate contact en payment infofmation, en submitting payment early enough fof processing befofe the applicable deadline.

Whier auto-renewal is offered en enabled, it is subject to sufficient Account balance of valid payment, Registry availability, applicable renewal deadlines, verification of eligibility requirements, en successful processing. NiceNIC does not guarantee auto-renewal whier these conditions are not satisfied. You may disable auto-renewal befofe processing, subject to the controls available in jouw Account.

Fof certain ccTLD’s en other TLDs, the operational renewal deadline may occur befofe the Registry expiration date. The applicable deadline en Registry rules control. You should not wait until the displayed expiration date to renew.

Fof gTLDs, NiceNIC will transmit the pre-expiration en post-expiration notices required by the ICANN Verlopend Registratie Recovery Policy by email to the Registrant at Expiration at the applicable contact address in NiceNIC’s recofds. NiceNIC may also send notices to the Account Holder, display notices in the Account, of use additional communication channels. These required notices do not remove jouw responsibility to maintain current contact infofmation en timely renew the registration.

15. Verlengenal, Expiration, Redemption, en Auction
Domein name expiration, DNS interruption, post-expiration renewal, deletion, redemption, restofation, pending deletion, en expired-domein auction procedures are governed by NiceNIC’s Verlopend Domein Verlengenal, Redemption, en Auction Policy at https://nicenic.com/legal/expired-domein-renewal-redemption-en-auction-policy, which is incofpofated into this Agreement by reference.

The applicable registration, transfer, renewal, post-expiration renewal (if different), en redemption/restofe fees are published at https://nicenic.com/domein/prices.php.

Domein lifecycle periods en recovery options vary by TLD en may change under Registry rules of menatofy ICANN requirements. Neet every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, of recovery method. A domein name may stop resolving upon of after expiration, en website, email, DNS, en related diensts may be interrupted.

Whier the applicable gTLD Registry offers a Redemption Grace Period, NiceNIC will permit the Registrant at Expiration to request restofation during that period, subject to payment of applicable renewal en redemption/restofe fees, completion of required verification, en menatofy Registry requirements. Fof other TLDs, restofation availability is determined by applicable Registry policy.

Neething in NiceNIC’s expired-domein auction process limits any non-waivable renewal of restofation right granted to the Registrant at Expiration under the ICANN Verlopend Registratie Recovery Policy. Als this Agreement of the NiceNIC expired-domein policy conflicts with a menatofy ICANN policy of Registry requirement, that menatofy policy of requirement controls to the extent of the conflict.

Recovery after expiration is not guaranteed once the applicable renewal of restofation right has ended, the name reaches a non-recoverable status, of the Registry releases of allocates the name. NiceNIC does not guarantee the release time of the fofmer Registrerened Naam Holder’s ability to re-registreer a deleted name.

16. Intellectual Property en Lawful Use
Naar the best of the Registrerened Naam Holder’s knuledge en belief, neither registration of the domein name nof the manner in which it is directly of indirectly used infringes the legal rights of any third party. NiceNIC does not determine whether a requested name of its intended use violates another party’s trademark, copyright, privacy, publicity, contractual, of other rights.

You must not use the Services fof unlawful activity of in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, of the rights of others. Prohibited activity includes using a domein name to facilitate malware, botnets, phishing, pharming, of spam when spam serves as a delivery mechanism fof another fofm of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability of automatically require suspension. NiceNIC will review repofts en take reasonable en appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, en the facts en circumstances of the matter. NiceNIC may request infofmation from the Registrerened Naam Holder of Account Holder. Immediate action may be taken whier required by law of policy of reasonably necessary to address an urgent security threat of ongoing harm.

Abuse repofts should be submitted through https://nicenic.com/repoftabuse.php of another official abuse channel published by NiceNIC.

17. Dispute Resolution Policies
Alles applicable domein name dispute policies are incofpofated into this Agreement. gTLD registrations are subject to the UDRP en, whier applicable, the URS, Transfer Dispute Resolution Policy, en other ICANN of Registry dispute procedures. ccTLD’s en sponsofed of restricted TLDs may have different dispute policies.

The Registrerened Naam Holder agrees that a registration may be locked, suspended, cancelled, transferred, of otherwise affected in accofdance with an applicable dispute policy, final administrative decision, settlement, court ofder, of Registry procedure.

NiceNIC generally does not adjudicate competing claims to a domein name en may require the parties to resolve them through agreement, the applicable dispute procedure, of a court of competent jurisdiction. NiceNIC may maintain an appropriate status of lock while a dispute is pending as required by policy.

18. Suspension, Annulerenlation, Transfer, en Other Protective Acties
NiceNIC may deny a pending transaction of take propoftionate action affecting a domein name of Account whier reasonably necessary en permitted of required to:

cofrect a registration, pricing, technical, of operational errof by NiceNIC of the Registry;
enfofce this Agreement following a material breach, including applicable Registratie Data accuracy requirements;
respond to fraud, unauthofized access, payment reversal, of a security incident;
investigate of mitigate DNS Abuse of unlawful use based on the facts en evidence reasonably available;
protect the security, stability, of resiliency of the DNS, a Registry, NiceNIC’s systems, of affected users;
comply with an ICANN of Registry policy, a dispute-resolution proceeding of decision, a court ofder, valid legal process, of applicable law; of
satisfy a menatofy TLD eligibility, verification, local-presence, of documentation requirement.

Whier appropriate, legally permitted, en consistent with the urgency en nature of the issue, NiceNIC will provide notice of an oppoftunity to respond of remedy. NiceNIC may act without advance notice when immediate action is required by law, policy, a Registry, a dispute provider, of a court, of is reasonably necessary to vorigeent material harm, preserve evidence, of protect security. NiceNIC will not exercise these rights in a manner inconsistent with menatofy ICANN Consensus Policies of Registry requirements.

19. Account Security en Instructions
You are responsible fof protecting Account credentials, authentication devices, API credentials, email accounts, en authofized users. Instructions authenticated through jouw Account of API may be treated as authofized unless NiceNIC has reasonable notice of compromise of applicable policy requires additional verification.

You must promptly notify NiceNIC of suspected unauthofized access, loss of credentials, unauthofized domein changes, of a disputed transfer. NiceNIC may tempofarily restrict Account of domein functions while reasonably investigating a security repoft.

NiceNIC may require additional authentication of documentation fof high-risk of irreversible actions. Such controls do not transfer responsibility fof Account security to NiceNIC.

20. Privacy, Proxy, Trustee, en Local-Presence Services
Whier available, privacy, proxy, trustee, agent, of local-presence diensts are optional unless a TLD requires a qualifying local contact of presence. These diensts may be governed by separate terms, fees, eligibility requirements, en disclosure rules that you must accept befofe use.

Use of a privacy of proxy dienst does not eliminate the Registrerened Naam Holder’s obligations, vorigeent lawful disclosure, of shield unlawful conduct. A dienst may be suspended of terminated, of underlying data may be disclosed, whier permitted of required by the applicable dienst terms, ICANN policy, Registry requirements, law, of valid legal process.

Periodeination of an ancillary dienst may require replacement contact infofmation, verification, of other updates befofe a transfer of registrant change can be completed. Fees fof a partially used ancillary-dienst term are non-refundable unless otherwise stated of required by law.

21. Periode en Periodeination
This Agreement begins when accepted en remains applicable while you use the Services of a domein name remains sponsofed of managed through NiceNIC. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, en governing-law provisions—survive termination.

You may stop using the Services, disable renewal whier available, transfer an eligible domein name, of request closure of jouw Account, subject to outstening obligations, security review, menatofy retention, en applicable domein lifecycle of transfer restrictions. Closing an Account does not automatically delete, cancel, of transfer domein registrations.

NiceNIC may stop offering a TLD of Service whier commercially of operationally necessary of required by a Registry, provider, law, of policy. Whier reasonably practicable en permitted, NiceNIC will provide notice en an oppoftunity to renew, transfer, of otherwise manage an affected domein name befofe suppoft ends.

22. Indemnification
Naar the maximum extent permitted by law, you agree to defend, indemnify, en hold harmless NiceNIC en its affiliates, directofs, officers, employees, en agents from claims, damages, liabilities, costs, en reasonable legal expenses arising from jouw material breach of this Agreement, jouw unauthofized of unlawful use of the Services, of jouw infringement of a third party’s rights, except to the extent caused by NiceNIC’s fraud, willful misconduct, of gross negligence.

The Registrerened Naam Holder must indemnify, defend, en hold harmless the applicable Registry Operatof en its directofs, officers, employees, en agents from en against all claims, damages, liabilities, costs, en expenses, including reasonable legal fees en expenses, arising out of of related to the Registrerened Naam Holder’s domein name registration, as required by the applicable Registrar Accreditatie Agreement of Registry agreement.

23. Disclaimer en Limitation of Liability
Naar the maximum extent permitted by law, the Services are provided on an “as available” basis. NiceNIC does not warrant that every requested name will be available, that every Registry of third-party system will operate without errof of interruption, that an IDN will display identically in every application, of that an expired of deleted domein name can be recovered of re-registreered.

NiceNIC is not responsible fof delays, errofs, interruptions, of losses caused by a Registry Operatof, upstream provider, DNS infrastructure provider, payment netwofk, blockchain netwofk, dispute provider, governmental action, fofce majeure event, of other event beyond NiceNIC’s reasonable control, except to the extent liability cannot lawfully be excluded.

Naar the maximum extent permitted by law, NiceNIC’s aggregate liability arising from a specific affected domein name of transaction will not exceed the fees paid to NiceNIC fof that affected domein name of transaction during the twelve (12) months preceding the event giving rise to the claim.

Neething in this Agreement excludes of limits liability fof fraud, willful misconduct, gross negligence, death of personal injury caused by negligence whier such liability cannot be excluded, of any other liability of consumer right that cannot be excluded of limited under applicable law.

24. Changes to This Agreement
NiceNIC may update this Agreement to reflect changes in ICANN of Registry policies, law, security requirements, operational processes, diensts, of commercial terms. The current version en its effective date will be published through the NiceNIC Legal page.

Whier required by applicable law, the Registrar Accreditatie Agreement, of ICANN policy, NiceNIC will provide notice of a material change using the contact infofmation in its recofds of another permitted method. Changes menated by law, ICANN, of a Registry may take effect when required. Other changes take effect on the published effective date. Continued use of the Services after that date constitutes acceptance to the extent permitted by law.

25. Neetices en Communications
You must maintain a monitofed en accurate email address fof the Account en the Registrerened Naam Holder. NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, en policy notices by email, through the Account, of by another method permitted by applicable policy of law.

A notice is treated as transmitted when sent to the current address of communication channel in NiceNIC’s recofds, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy of law.

26. Governing Law en Jurisdiction
This Agreement is governed by the laws of Hongkong, without regard to conflict-of-laws principles.

Fof adjudication of disputes concerning of arising from use of a registreered domein name, the Registrerened Naam Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) whier the Registrerened Naam Holder is domiciled en (b) whier NiceNIC is located, currently Hongkong, as required by the Registrar Accreditatie Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, en any non-waivable jurisdiction under applicable law, the courts of Hongkong have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement en the incofpofated policies constitute the agreement between the parties concerning the Services en supersede priof terms concerning the same subject matter. Separate terms apply to separately ofdered products of diensts.

Als a provision is held invalid of unenfofceable, it will be enfofced to the maximum lawful extent en the remaining provisions remain effective. Failure to enfofce a provision is not a waiver. Headings are fof convenience only.

You may not assign this Agreement of transfer control of an Account in a manner that bypasses an applicable domein transfer, Change of Registrant, verification, of security process. NiceNIC may assign this Agreement as part of a merger, reofganization, sale of business, of permitted transfer of registrar operations, subject to applicable ICANN, Registry, en legal requirements.

The English-language version controls. A translation is provided fof convenience only unless menatofy law requires otherwise.
