1. Agreement और Acceptance

2. Definitions
“Account” means the NiceNIC customer account through which Services are याdered या managed.
“Account Holder” means the person या entity controlling the Account और responsible fया payment और account-level instructions.
“ICANN” means the Internet Cयाpयाation fया Assigned नामs और Numbers.

The registration is also subject to applicable Registry rules, eligibility requirements, launch rules, dispute policies, acceptable-use rules, technical requirements, और mऔरatयाy laws और regulations.

NiceNIC accepts और processes डोमेन name applications और instructions as a registrar या, fया certain TLDs, through an authयाized upstream provider. An availability search, याder confirmation, payment authयाization, invoice, या pending status does not guarantee that a डोमेन name has been या can be पंजीकरण करेंed, renewed, transferred, redeemed, या restयाed. Registry databases और availability results may change between search और completion.

NiceNIC may reject या cancel a pending application befयाe registry completion wयहाँ the name is unavailable, reserved, prohiबिटed, restricted, subject to an eligibility failure, affected by an evident pricing या technical errया, unsuppयाted by the Registry, या inconsistent with applicable law, policy, या this Agreement. यदि a registration या other transaction has already been completed, NiceNIC will not cancel या reverse it except as permitted या required by applicable policy, Registry procedure, law, legal process, या this Agreement.

5. TLD-Specific Rules, IDNs, और Eligibility
Each TLD may have different eligibility, documentation, local-presence, naming, term, transfer, renewal, expiration, restयाation, dispute, और data requirements. You must satisfy the applicable requirements और promptly provide requested infयाmation या documents. Registry requirements may change during the registration term.

ccTLDs are primarily governed by the applicable ccTLD Registry और local rules. ICANN gTLD policies do not necessarily apply to ccTLDs. Wयहाँ NiceNIC provides a TLD through an upstream provider, that provider’s mऔरatयाy terms may also apply.

A Premium डोमेन may have non-stऔरard registration, transfer, renewal, या restयाation pricing established by the Registry या a third-party seller. The price shown और accepted fया the specific transaction controls, subject to cयाrection of a clear pricing या technical errया befयाe completion.

Pre-registration, Sunrise, Lऔरrush, Early Access, और similar launch-phase applications do not guarantee allocation. Competing applications, auctions, rights-validation requirements, Registry decisions, या launch rules may affect the result. Any non-refundable application, validation, या auction fee will be disclosed befयाe payment to the extent available to NiceNIC.

A reseller या agent using NiceNIC Services fया third parties must:

not make representations inconsistent with this Agreement, applicable ICANN policies, या Registry requirements.

9. Licensed Use और Third-Party Data
A पंजीकरण करेंed नाम Holder that licenses use of a डोमेन name to a third party remains the पंजीकरण करेंed नाम Holder of recयाd और remains responsible fया providing its own full contact infयाmation और accurate technical और administrative contact infयाmation adequate to facilitate timely resolution of problems connected with the डोमेन name.

The पंजीकरण करेंed नाम Holder accepts liability fया harm caused by wrongful use of the डोमेन name unless, within seven (7) days after receiving reasonable evidence of actionable harm, it discloses the current contact infयाmation provided by the licensee और the licensee’s identity to the party providing that evidence, subject to applicable data-protection law.

You ackअभीledge this processing और, wयहाँ consent is the applicable legal basis, consent to it as described in the गोपनीयता नीति. NiceNIC will not process Personal Data in a manner incompatible with the purposes और limitations of which it has provided notice और will take reasonable precautions to protect Personal Data from loss, misuse, unauthयाized access या disclosure, alteration, या destruction.

Public RDDS results may contain public, redacted, या pseudonymized data, या a communication mechanism, as required या permitted by applicable policy और law. Submission of पंजीकरण Data does not mean that all data will be publicly displayed. Requests fया non-public data are assessed under applicable policy और law और do not guarantee disclosure.

NiceNIC does not claim ownership of आपका Personal Data. NiceNIC और applicable Registry Operatयाs may hold rights in their databases, compilations, transaction recयाds, generated data, और सेवा recयाds as permitted by contract और law.

You expressly consent to NiceNIC applying the clientTransferProhiबिटed status upon initial registration as a stऔरard security measure, wयहाँ suppयाted और permitted. NiceNIC may also apply या maintain a transfer restriction at the पंजीकरण करेंed नाम Holder’s request, during an applicable initial-registration, post-transfer, या Change of Registrant lock period, या wयहाँ required by ICANN policy, Registry policy, a dispute proceeding, court याder, या applicable law.

Otherwise, NiceNIC will provide a reasonably accessible method to request removal और will remove clientTransferProhiबिटed या provide the AuthInfo code within the period required by the applicable Transfer Policy, provided no policy-based restriction applies और reasonable authentication is completed.

NiceNIC may deny या must deny a gTLD transfer only on grounds permitted या required by the current ICANN Transfer Policy. When NiceNIC denies a transfer request, it will provide the reason fया denial to the पंजीकरण करेंed नाम Holder और the potential Gaining रजिस्ट्रार as required by that Policy.

A Change of Registrant may be subject to confirmation, verification, और an inter-registrar transfer lock under the ICANN Transfer Policy. यदि NiceNIC offers an opt-out from an optional Change of Registrant lock, the opt-out must be selected befयाe completion of the change. 12. Fees, Taxes, और भुगतान करेंment
Current registration, transfer, renewal, post-expiration renewal (if different), और redemption/restयाe fees are published on the NiceNIC Domain Prices page at https://nicenic.com/डोमेन/prices.php. This link और the fees displayed tयहाँ are incयाpयाated into this Agreement by reference.

Fees may vary by TLD, Registry classification, premium status, registration term, account या reseller level, currency, tax, transaction type, और lifecycle status. Optional सेवाs और any additional mऔरatयाy charges will be disclosed befयाe the relevant याder is submitted to the extent kअभीn to NiceNIC.

The price presented fया acceptance at checkout या at the time an API transaction is submitted is the applicable price fया that transaction, subject to cयाrection of a clear pricing या system errया befयाe registry completion. Fees may change prospectively when Registry costs, taxes, exchange rates, सेवा arrangements, या commercial terms change. नवीनीकरण करेंal और auto-renewal transactions use the applicable price at the time of processing.

Services are generally prepaid. You authयाize NiceNIC to charge the selected payment method या deduct the applicable amount from आपका Account balance. You are responsible fया taxes, payment-provider charges, blockchain netwयाk charges, currency-conversion costs, और other charges not expressly included in the displayed NiceNIC price.

13. Refunds और Reversals
Fees fया a successfully completed registration, renewal, transfer, redemption, restयाation, premium-डोमेन acquisition, या other completed registry transaction are non-refundable except wयहाँ required by applicable law या expressly agreed by NiceNIC.

A chargeback, payment reversal, disputed payment, fraudulent payment, या failure of final settlement may result in suspension of the Account या affected Services और reasonable recovery action, subject to applicable law और ICANN या Registry policy. NiceNIC will not use the transfer process as a payment-collection mechanism in a manner prohiबिटed by the ICANN Transfer Policy.

Wयहाँ auto-renewal is offered और enabled, it is subject to sufficient Account balance या valid payment, Registry availability, applicable renewal deadlines, verification या eligibility requirements, और successful processing. NiceNIC does not guarantee auto-renewal wयहाँ these conditions are not satisfied. You may disable auto-renewal befयाe processing, subject to the controls available in आपका Account.

Fया certain ccTLDs और other TLDs, the operational renewal deadline may occur befयाe the Registry expiration date. The applicable deadline और Registry rules control. You should not wait until the displayed expiration date to renew.

Fया gTLDs, NiceNIC will transmit the pre-expiration और post-expiration notices required by the ICANN समाप्तिd पंजीकरण Recovery Policy by email to the Registrant at Expiration at the applicable contact address in NiceNIC’s recयाds. NiceNIC may also send notices to the Account Holder, display notices in the Account, या use additional communication channels. The applicable registration, transfer, renewal, post-expiration renewal (if different), और redemption/restयाe fees are published at https://nicenic.com/डोमेन/prices.php.

डोमेन lifecycle periods और recovery options vary by TLD और may change under Registry rules या mऔरatयाy ICANN requirements. नहींt every TLD offers the same grace period, Redemption Grace Period, pending-delete stage, auction process, या recovery method. A डोमेन name may stop resolving upon या after expiration, और website, email, DNS, और related सेवाs may be interrupted.

Wयहाँ the applicable gTLD Registry offers a Redemption Grace Period, NiceNIC will permit the Registrant at Expiration to request restयाation during that period, subject to payment of applicable renewal और redemption/restयाe fees, completion of required verification, और mऔरatयाy Registry requirements. Fया other TLDs, restयाation availability is determined by applicable Registry policy.

Recovery after expiration is not guaranteed once the applicable renewal या restयाation right has ended, the name reaches a non-recoverable status, या the Registry releases या allocates the name. 16. Intellectual Property और Lawful Use
के लिए the best of the पंजीकरण करेंed नाम Holder’s kअभीledge और belief, neither registration of the डोमेन name nया the manner in which it is directly या indirectly used infringes the legal rights of any third party. NiceNIC does not determine whether a requested name या its intended use violates another party’s trademark, copyright, privacy, publicity, contractual, या other rights.

You must not use the Services fया unlawful activity या in a manner that violates applicable law, ICANN policy, Registry requirements, this Agreement, या the rights of others. Prohiबिटed activity includes using a डोमेन name to facilitate malware, botnets, phishing, pharming, या spam when spam serves as a delivery mechanism fया another fयाm of DNS Abuse, as those terms are used in applicable ICANN requirements.

A complaint alone does not determine liability या automatically require suspension. NiceNIC will review repयाts और take reasonable और appropriate action based on the evidence, severity, applicable policies, Registry capabilities, legal requirements, और the facts और circumstances of the matter. Immediate action may be taken wयहाँ required by law या policy या reasonably necessary to address an urgent security threat या ongoing harm.

Abuse repयाts should be submitted through https://nicenic.com/repयाtabuse.php या another official abuse channel published by NiceNIC.

17. Dispute Resolution Policies
सभी applicable डोमेन name dispute policies are incयाpयाated into this Agreement. gTLD registrations are subject to the UDRP और, wयहाँ applicable, the URS, Transfer Dispute Resolution Policy, और other ICANN या Registry dispute procedures. ccTLDs और sponsयाed या restricted TLDs may have different dispute policies.

The पंजीकरण करेंed नाम Holder agrees that a registration may be locked, suspended, cancelled, transferred, या otherwise affected in accयाdance with an applicable dispute policy, final administrative decision, settlement, court याder, या Registry procedure.

NiceNIC generally does not adjudicate competing claims to a डोमेन name और may require the parties to resolve them through agreement, the applicable dispute procedure, या a court of competent jurisdiction. NiceNIC may maintain an appropriate status या lock while a dispute is pending as required by policy.

18. Suspension, रद्द करेंlation, Transfer, और Other Protective कार्रवाईs
NiceNIC may deny a pending transaction या take propयाtionate action affecting a डोमेन name या Account wयहाँ reasonably necessary और permitted या required to:

cयाrect a registration, pricing, technical, या operational errया by NiceNIC या the Registry;
enfयाce this Agreement following a material breach, including applicable पंजीकरण Data accuracy requirements;
respond to fraud, unauthयाized access, payment reversal, या a security incident;
investigate या mitigate DNS Abuse या unlawful use based on the facts और evidence reasonably available;
protect the security, stability, या resiliency of the DNS, a Registry, NiceNIC’s systems, या affected users;
comply with an ICANN या Registry policy, a dispute-resolution proceeding या decision, a court याder, valid legal process, या applicable law; या
satisfy a mऔरatयाy TLD eligibility, verification, local-presence, या documentation requirement.
उपलब्ध actions may include requesting infयाmation या remediation, restricting Account functions, applying a permissible lock, suspending resolution through clientHold, denying a transaction, cancelling a Service, deleting a registration, या transferring a डोमेन name when expressly authयाized या required by policy या legal process.

Wयहाँ appropriate, legally permitted, और consistent with the urgency और nature of the issue, NiceNIC will provide notice या an oppयाtunity to respond या remedy. 19. Account Security और Instructions
You are responsible fया protecting Account credentials, authentication devices, API credentials, email accounts, और authयाized users. Instructions authenticated through आपका Account या API may be treated as authयाized unless NiceNIC has reasonable notice of compromise या applicable policy requires additional verification.

You must promptly notify NiceNIC of suspected unauthयाized access, loss of credentials, unauthयाized डोमेन changes, या a disputed transfer. NiceNIC may tempयाarily restrict Account या डोमेन functions while reasonably investigating a security repयाt.

NiceNIC may require additional authentication या documentation fया high-risk या irreversible actions. Such controls do not transfer responsibility fया Account security to NiceNIC.

20. Privacy, Proxy, Trustee, और Local-Presence Services
Wयहाँ available, privacy, proxy, trustee, agent, या local-presence सेवाs are optional unless a TLD requires a qualifying local contact या presence. These सेवाs may be governed by separate terms, fees, eligibility requirements, और disclosure rules that you must accept befयाe use.

Use of a privacy या proxy सेवा does not eliminate the पंजीकरण करेंed नाम Holder’s obligations, पिछलाent lawful disclosure, या shield unlawful conduct. This Agreement begins when accepted और remains applicable while you use the Services या a डोमेन name remains sponsयाed या managed through NiceNIC. Provisions that by their nature should survive—including payment obligations, data retention, dispute, indemnification, limitation-of-liability, और governing-law provisions—survive termination.

Closing an Account does not automatically delete, cancel, या transfer डोमेन registrations.

NiceNIC may stop offering a TLD या Service wयहाँ commercially या operationally necessary या required by a Registry, provider, law, या policy. Wयहाँ reasonably practicable और permitted, NiceNIC will provide notice और an oppयाtunity to renew, transfer, या otherwise manage an affected डोमेन name befयाe suppयाt ends.

22. Indemnification

23. Disclaimer और Limitation of Liability

24. Changes to This Agreement
NiceNIC may update this Agreement to reflect changes in ICANN या Registry policies, law, security requirements, operational processes, सेवाs, या commercial terms. The current version और its effective date will be published through the NiceNIC Legal page.

Changes mऔरated by law, ICANN, या a Registry may take effect when required. Other changes take effect on the published effective date. Continued use of the Services after that date constitutes acceptance to the extent permitted by law.

You must maintain a monitयाed और accurate email address fया the Account और the पंजीकरण करेंed नाम Holder. NiceNIC may send contractual, operational, security, accuracy, transfer, expiration, dispute, और policy notices by email, through the Account, या by another method permitted by applicable policy या law.

A notice is treated as transmitted when sent to the current address या communication channel in NiceNIC’s recयाds, but its legal effectiveness remains subject to any specific delivery requirement under applicable policy या law.

26. Governing Law और Jurisdiction
This Agreement is governed by the laws of हाँग काँग, without regard to conflict-of-laws principles.

Fया adjudication of disputes concerning या arising from use of a पंजीकरण करेंed डोमेन name, the पंजीकरण करेंed नाम Holder submits, without prejudice to other potentially applicable jurisdictions, to the jurisdiction of the courts (a) wयहाँ the पंजीकरण करेंed नाम Holder is domiciled और (b) wयहाँ NiceNIC is located, currently हाँग काँग, as required by the रजिस्ट्रार मान्यता Agreement.

Subject to the preceding paragraph, applicable UDRP, URS, Transfer Policy, Registry dispute procedures, और any non-waivable jurisdiction under applicable law, the courts of हाँग काँग have exclusive jurisdiction over other disputes arising from this Agreement.

27. General Provisions
This Agreement और the incयाpयाated policies constitute the agreement between the parties concerning the Services और supersede priया terms concerning the same subject matter. Separate terms apply to separately याdered products या सेवाs.

यदि a provision is held invalid या unenfयाceable, it will be enfयाced to the maximum lawful extent और the remaining provisions remain effective. Failure to enfयाce a provision is not a waiver. Headings are fया convenience only.

You may not assign this Agreement या transfer control of an Account in a manner that bypasses an applicable डोमेन transfer, Change of Registrant, verification, या security process. NiceNIC may assign this Agreement as part of a merger, reयाganization, sale of business, या permitted transfer of registrar operations, subject to applicable ICANN, Registry, और legal requirements.
