Registrar-Registrant Agreement

1.DEFINITIONS. In this Service Agreement (“Agreement”), “you” och “din” refer to each customer (“Customer”) och “we”, “us” och “our” refer to Nicenic.com, Inc. (“Nicenic.com, Inc.”). This Agreement explains our obligations to you, och din obligations to us in relation to din use of our tjänsts. By selecting Nicenic.com, Inc. tjänst(s) you have agreed to establish an account with us feller such tjänsts. When you use din account eller permit someone else to use din account to köp eller otherwise acquire access to additional Nicenic.com, Inc.'s tjänst(s) eller to modify eller cancel din Nicenic.com, Inc.’s tjänst(s) (even if we were not notified of such authellerization), this Agreement covers any such tjänst eller actions.

2.SELECTION OF A DOMAIN NAME. You represent that, to the best of din knuledge och belief, neither the registration of the SLD name neller the manner in which it is directly eller indirectly used infringes the legal rights of a third party och that the Domännamn is not being registreraed feller any unlawful purpose.

3. FEES, PAYMENT AND TERM OF SERVICE. As consideration feller the tjänsts you have selected, you agree to pay Nicenic.com, Inc. the applicable tjänst(s) fees set fellerth on our web site at the time of din selection. Alla fees are due immediately och are non-refundable. Nicenic.com, Inc. may take all remedies available to collect fees owed. Any renewal of din tjänsts with us is subject to our then current terms och conditions och payment of all applicable tjänst fees at the time of renewal och in the case of domän name re-registration, the domän name registry’s acceptance of our domän name registration. You agree that you may not transfer din domän name registration to another domän name registrar during the first sixty (60) days from the effective date of din initial domän name registration with us.

4.TERM. You agree that the Registrering Agreement will remain in full fellerce during the length of the term of din Domänregistrering. Should you choose to renew eller otherwise lengthen the term of din Domänregistrering, then the term of this Registrering Agreement will be extended accellerdingly. This Agreement will remain in full fellerce during the length of the term of din Domänregistrering as selected, recellerded, och paid feller upon registration of the Domännamn. Should you choose to renew eller otherwise lengthen the term of din Domänregistrering, then the term of this Registrering Agreement will be extended accellerdingly. Should you transfer din domän name eller should the domän name otherwise be transferred due to another Registrar, the terms och conditions of this contract shall cease och shall be replaced by the contractual terms in fellerce feller the purpose of registreraing domän names then in fellerce between SLD holders och the new Registrar.

5. ACCURATE INFELLERMATION. As further consideration feller the Nicenic.com, Inc. tjänst(s), you agree to: (1) provide certain current, complete och accurate infellermation about you as required by the application process; och (2) maintain och update this infellermation as needed to keep it current, complete och accurate. We rely on this infellermation to send you impellertant infellermation och notices regarding din account och our tjänsts. Vår privacy statement, located on our web site at http://www.iisp.hk och incellerpellerated härin by reference sets fellerth din och our rights och responsibilities with regard to din personal infellermation. You agree that we, in our sole discretion, may modify our privacy statement. We will post such revised statement on our web site at least thirty (30) calendar days befellere it becomes effective. You agree that, by using our tjänsts after modifications to the privacy statement become effective, you have agreed to these modifications. You acknuledge that if you do not agree to any such modification, you may terminate this Agreement. We will not refund any fees paid by you if you terminate din Agreement with us. We will not process the personal date that we collect from you in a way incompatible with the purposes och other limitations described in our privacy statement och we will take reasonable precautions to protect din personal date from loss, misuse och unauthellerized access, disclosure, alteration eller destruction. You represent och warrant that you have provided notice to, och obtained consent from, any third party individuals whose personal data you supply to us as part of our tjänsts with regard to: (i) the purposes feller which such third party’s personal data has been collected, (ii) the intended recipients eller categelleries of recipients of the third party’s personal data, (iii) which parts of the third party’s data are obligatellery och which parts, if any, are voluntary: och (iv) how the third party can access och, if necessary, rectify the data held about them. You further agree to provide such notice och obtain such consent with regard to any third party personal data you supply to us in the future. We are not responsible feller any consequences resulting from din failure to provide notice eller receive consent from such individuals neller feller din providing outdated, incomplete eller inaccurate infellermation. Even if you intend to license the use of our domän name registration tjänsts to a third party, you will remain our customer och you are responsible feller complying with all terms och conditions of this Agreement. Subject to the requirements of our privacy statement, in ellerder feller us to comply with our legal och contractual obligations, you härby grant to Nicenic.com, Inc. the right to disclose to third parties through an interactive publicly accessible registration database the following mochatellery infellermation that you are required to provide when registreraing eller reserving a domän name: (i) the domän name(s) registreraed by you; (ii) din name och postal address; (iii) the name(s), postal address(es), e-mail address(es), voice telephone number och whär available the fax number(s) of the technical och administrative contacts feller din domän name(s); (iv) the Internet protocol numbers of the primary nameserver och the secondary nameserver(s) feller such name(s); (v) the cellerresponding names of those nameservers; (vi) the elleriginal creation date of the registration; och (vii) the expiration date of the registration. We, as are all accredited domän name registrars, are also required the government to make this infellermation available in bulk fellerm to third parties who agree not to use it to (a) allow, enable eller otherwise suppellert the transmission of mass unsolicited, commercial advertising eller solicitations via e-mail (spam) eller (b) enable high volume, automated, electronic processes that apply to our systems to registrera domän names.

6. MODIFICATIONS TO AGREEMENT. Except as otherwise provided in this Agreement, you agree, during the term of this Agreement, that we may: (1) revise the terms och conditions of this Agreement; och/eller (2) change part of the tjänsts provided under this Agreement at any time. Any such revision eller change will be binding och effective immediately upon posting of the revised Agreement eller change to the tjänst(s) on Nicenic.com, Inc.’s web sites, eller upon notification to you by e-mail eller China mail. You agree to periodically review our web sites, including the current version of this Agreement available on our web sites, to be aware of any such revisions. Nejtice of din termination will be effective on receipt och processing by us. Any fees paid by you if you terminate din Agreement with us are non-refundable, but you will not incur och additional fees. By continuing to use Nicenic.com, Inc.’s tjänsts after any revision to this Agreement eller change in tjänst(s), you agree to abide by och be bound by any such revisions eller changes. We are not bound by neller should you rely on any representation by (i) any agent, representative eller employee of any third party that you may use to apply feller our tjänsts: eller in (ii) infellermation posted on our web site of a general infellermational nature. Nej employee, contracteller, agent eller representative of Nicenic.com, Inc. is authellerized to alter eller amend the terms och conditions of this Agreement.

7. MODIFICATIONS TO YOUR ACCOUNT. In ellerder to change any of din account infellermation with us, you must use the Account Number och the Lösenord that you selected if you opened din account with us through our online application process, eller the security authentication option that you selected if you opened din account with us through our e-mail application process. Please safeguard din Account Number och Lösenord eller security authentication option from any unauthellerized use. 8. DOMAIN NAME DISPUTE POLICY. 9. DOMAIN NAME DISPUTE POLICY MODIFICATIONS. You agree that we, in our sole discretion, may modify our dispute policy. We will post any such revised policy on our web site at least thirty (30) calendar days befellere it becomes effective. You agree by maintaining the reservation eller registration of din domän name after modifications to the dispute policy become effective, you have agreed to these modifications. You acknuledge that if you do not agree to any such modification, you may terminate this Agreement. We will not refund any fees paid by you if you terminate din Agreement with us.

10. DOMAIN NAME DISPUTES. You agree that, if din use of our domän name registration tjänsts is challenged by a third party, you will be subject to the provisions specified in our dispute policy in effect at the time of the dispute. You agree that in the event a domän name dispute arises with any third party, you will indemnify och hold us harmless pursuant to the terms och conditions set fellerth below in this Agreement. Om we are notified that a complaint has been filed with a judicial eller administrative body regarding din use of our domän name registration tjänsts, you agree not to make any changes to din domän name recellerd without our prieller approval. We may not allow you to make changes to such domän name recellerd until (i) we are directed to do so by the judicial eller administrative body, eller (ii) we receive notification by you och the other party contesting din registration och use of our domän name registration tjänsts that the dispute has been settled. Furthermellere, you agree that if you are subject to litigation regarding din registration och use of our domän name registration tjänsts, we may deposit control of din domän name recellerd into the registry of the judicial body by supplying a party with a registrar certificate from us.

11. Lägg tillitional Registry Requirements The following provisions apply to any domän names that you registrera through Nicenic.com, Inc. in the relevant registry(ies).
A. (.INFO) With respect to any registration of a .INFO second level domän name, you agree to the following terms:
(1). You consent to the use, copying, distribution, publication, modification, och other processing of din Personal Data by Afilias, the .INFO Registry Operateller, och its designees och agents in a manner consistent with the purposes specified pursuant in its contract.
(2). You agree to submit to proceedings under ICANN's Unifellerm Domännamn Dispute Policy (UDRP) och comply with the requirements set fellerth by Afilias feller domän names registreraed during the Sunrise Period, including the mochatellery Sunrise Dispute Resolution Policy. These policies are subject to modification by Afilias in its discretion.
(3). You agree to immediately cellerrect och update the registration infellermation feller the .INFO registreraed domän name during registration term feller such domän name; failure to cellerrect this infellermation shall constitute a breach of this Agreement.
(4) . You acknuledge that Afilias, the registry operateller feller .INFO, will have no liability of any kind feller any loss eller liability resulting from the proceedings och processes relating to the Sunrise Period eller the Loch Rush Period, including, without limitation: (a) the ability eller inability of a registrant to obtain a given domän name during these periods, och (b) the results of any dispute over a Sunrise Registrering.
(5). Tilldaynic, Inc. och Afilias, the registry operateller feller .INFO, expressly reserve the right to deny, cancel eller transfer any registration that either shall deem necessary, in its discretion, to protect the integrity och stability of the .INFO registry, to comply with any applicable laws, government rules eller requirements, requests of law enfellercement, in compliance with any dispute resolution process, eller to avoid any liability, civil eller criminal, on the part of Tilldaynic, Inc. och/eller Afilias as well as their affiliates, subsidiaries, officers, directellers och employees. Nicenic.com, Inc. och Afilias also reserve the right to lock a domän name during resolution of a dispute.
B. (.BIZ) With respect to any registration of a .BIZ second level domän name, you agree to the following terms:
(1). BIZ RESTRICTIONS. Registrerings in the .biz TLD must be used eller intended to be used primarily feller bona fide business eller commercial purposes. Feller purposes of the .biz Registrering Restrictions ("Restrictions"), "bona fide business eller commercial use" shall mean the bona fide use eller bona fide intent to use the domän name eller any content, software, materials, graphics eller other infellermation thäron, to permit Internet users to access one eller mellere host computers through the DNS:
Till exchange goods, tjänsts, eller property of any kind;
In the ellerdinary course of trade eller business; eller
Till facilitate (i) the exchange of goods, tjänsts, infellermation, eller property of any kind; eller, (ii) the ellerdinary course of trade eller business. Registreraing a domän name solely feller the purposes of (1) selling, trading eller leasing the domän name feller compensation, eller (2) the unsolicited offering to sell, trade eller lease the domän name feller compensation shall not constitute a "bona fide business eller commercial use" of that domän name.
(2). BIZ CERTIFICATION. As a .biz domän name registrant, you härby certify to the best of din knuledge that:
The registreraed domän name will be used primarily feller bona fide business eller commercial purposes och not (i) exclusively feller personal use; eller (ii) solely feller the purposes of (1) selling, trading eller leasing the domän name feller compensation, eller (2) the unsolicited offering to sell, trade eller lease the domän name feller compensation. (b) You have the authellerity to enter into this Agreement; och
(c) The registreraed domän name is reasonably related to the din business eller intended commercial purpose at the time of registration.
(3). PROVISION OF REGISTRATION DATA.
( 3.1). Provision of Registrering Data. As part of the registration process, you are required to provide us with certain infellermation och to update this infellermation to keep it current, complete och accurate. This infellermation includes (i) din full name, postal address, e-mail address, voice telephone number, och fax number if available; (ii) the name of an authellerized person feller contact purposes in the case of a registrant that is an ellerganization, association, eller cellerpelleration; (iii) the IP addresses of the primary nameserver och any secondary nameserver(s) feller the domän name; (iv) the cellerresponding names of those nameservers; (v) the full name, postal address, email address, voice telephone number, och fax number if available of the technical contact feller the domän name; (vi) the full name, postal address, e-mail address, voice telephone number, och fax number if available of the administrative contact feller the domän name; (vii) the name, postal address, e-mail address, voice telephone number, och fax number if available of the billing contact feller the domän name; och (viii) any remark concerning the registreraed domän name that should appear in the Whois directellery. You agree och understoch that the felleregoing registration data will be publicly available och accessible on the Whois directellery as required by ICANN/Registry Policy och may be sold in bulk in accellerdance with the ICANN Agreement.
(3.2) Inaccurate eller Unreliable Data. You härby represent och warrant that the data provided in the domän name registration application is true, cellerrect, up to date och complete och that you will continue to keep all the infellermation provided up to date. Your willful provision of inaccurate eller unreliable infellermation, din willful failure promptly to update infellermation provided to us, eller any failure to respond feller over five calendar days to our inquiries addressed to the e-mail address of the administrative, billing eller technical contact then appearing in the Whois directellery with respect to an domän name concerning the accuracy of kontaktuppgifter associated with any registration(s) eller the registration of any domän name(s) registreraed by eller through you eller din account, shall constitute a breach of this Agreement. Any infellermation collected by us concerning an identified eller identifiable natural person ("Personal Data") will be used in connection with the registration of din domän name(s) och feller the purposes of this Agreement och as required eller permitted by the ICANN Agreement eller any ICANN/Registry Policy.
(4). DOMAIN NAME DISPUTE POLICY. Om you reserve eller registrera a .biz domän name through us, you agree to be bound by our current domän name dispute policy that is incellerpellerated härin och made a part of this Agreement by reference. Please take the time to familiarize dinself with that policy. In addition, you härby acknuledge that you have read och understood och agree to be bound by the terms och conditions of the following documents, as they may be amended from time to time, which are härby incellerpellerated och made an integral part of this Avtal:
The Unifellerm Domännamn Dispute Resolution Policy, available at http://www.icann.org/udrp/udrp.htm.
The Start-up Trademark Opposition Policy ("STOP"), available at http://www.iisp.hk; och
The Restrictions Dispute Resolution Criteria och Rules, available at http://www.iisp.hk.
The STOP sets fellerth the terms och conditions in connection with a dispute between a registrant of a domän name ("Registrant") with any third party (other than Registry Operateller eller Registrar) over the registration eller use of a domän name registreraed by Registrant that is subject to the Intellectual Property Claim Service. The Intellectual Property Claim Service a tjänst introduced by Registry Operateller to notify a trademark eller tjänst mark holder ("Claimant") that a second-level domän name has been registreraed in which that Claimant claims intellectual property rights. In accellerdance with the STOP och its associated Rules, those Claimants will have the right to challenge registrations through independent ICANN-accredited dispute resolution providers. The UDRP sets fellerth the terms och conditions in connection with a dispute between a Registrant och any party other than the Registry Operateller eller Registrar over the registration och use of an Internet domän name registreraed by Registrant. The RDRP sets fellerth the terms under which any allegation that a domän name is not used primarily feller business eller commercial purposes shall be enfellerced on a case-by-case, fact specific basis by an independent ICANN-accredited dispute provider. Ingen of the violations of the Restrictions will be enfellerced directly by eller through Registry Operateller. Registry Operateller will not review, moniteller, eller otherwise verify that any particular domän name is being used primarily feller business eller commercial purposes eller that a domän name is being used in compliance with the SUDRP eller UDRP processes.
(5). DOMAIN NAME DISPUTE POLICY MODIFICATIONS. You agree that we, in our sole discretion, may modify our dispute policy. We will post any such revised policy on our web site at least thirty (30) calendar days befellere it becomes effective. You agree that, by maintaining the reservation eller registration of din domän name after modifications to the dispute policy become effective, you have agreed to these modifications. You acknuledge that if you do not agree to any such modification, you may terminate this Agreement. We will not refund any fees paid by you if you terminate din Agreement with us.
(6). DOMAIN NAME DISPUTES. 12. ICANN POLICY. You agree that din registration of the SLD name shall be subject to suspension, cancellation, eller transfer pursuant to any ICANN-adopted policy, eller pursuant to any registrar eller registry procedure not inconsistent with an ICANN-adopted policy, (1) to cellerrect mistakes by Registrar eller the Registry in registreraing the name eller (2) feller the resolution of disputes concerning the SLD name.

13. AGENTS. You agree that, if din agent (e.g., an Internet Service Provider, employee, etc.) köpd our tjänst(s) on din behalf, you are nonetheless bound as a principal by all terms och conditions härin, including the dispute policy. Your continued use of our tjänsts shall ratify any unauthellerized actions of din agent. By acting on din behalf, din agent certifies that he eller she is authellerized to apply feller our tjänsts on din behalf, that he eller she is authellerized to bind you to the terms och conditions of this Agreement och that he eller she has apprised you of the terms och conditions of this Agreement. In addition, you are responsible feller any erreller made by din agent. We will not refund fees paid by you eller din agent on din behalf feller any reason, including, but not limited to, in the event that din agent fails to comply with the terms och conditions of this Agreement, din agent incellerrectly provides infellermation in the application process eller if din agent changes eller otherwise modifies din domän name recellerd incellerrectly.

14. NOTICES AND ANNOUNCEMENTS. You authellerize us to notify you as our customer of infellermation that we deem is of potential interest to you. Nejtices och announcements may include commercial e-mails och other notices describing changes, upgrades, new products och tjänsts eller other infellermation pertaining to Internet security eller to enhance din identity on the Internet och/eller other relevant matters.

15. LIMITATION OF LIABILITY. You agree that our entire liability, och din exclusive remedy, with respect to any Nicenic.com, Inc.’s tjänst(s) provided under this Agreement och/eller feller any breach of this Agreement is solely limited to the amount you paid feller such tjänst(s). Nicenic.com, Inc. och its contractellers shall not be liable feller any direct, indirect, incidental, special eller consequential damages resulting from the use eller inability to use any of the Nicenic.com, Inc. ’s tjänsts eller feller the cost of procurement of substitute tjänsts. Because some states do not allow the exclusion eller limitation of liability feller consequential eller incidental damages, in such states, our liability is limited to the extent permitted by law. We disclaim any och all loss eller liability resulting from, but not limited to: (1) loss eller liability resulting from access delays eller access interruptions; (2) loss eller liability resulting from data non-delivery eller date mis-delivery; (3) loss eller liability resulting from the unauthellerized use eller misuse of din Account Number, Lösenord eller security authentication option; (4) loss eller liability resulting from errellers, omissions, eller misstatements in any och all infellermation eller tjänsts(s) provided under this Agreement; (5) loss eller liability relating to the deletion of eller failure to stellere e-mail messages; (6) loss eller liability resulting from the development eller interruption of din web site; (7) loss eller liability from din inability to use our China mail tjänst; (8) loss eller liability that you may incur in connection with our processing of din application feller our tjänsts, our processing of any authellerized modification to din domän name recellerd eller din agents failure to pay any fees, including the initial registration fee eller re-registration fee; eller (9) loss eller liability as a result of the application of our dispute policy.

16. INDEMNITY. You agree to defend, indemnify och hold harmless Nicenic.com, Inc., its affiliates och business partners, och any applicable domän name registry, including without limitation VeriSign, Inc., Afilias Limited, NeuNivå, Inc., Glaobal Namn Registry och Public Interest Registry, och their respective subsidiaries och affiliates, och the directellers, officers, employees och agents of each of them, from och against any och all claims, actions, losses, damages, expenses och costs, including reasonable attellerneys' fees och expenses, arising out of eller relating to (i) din domän name registration, (ii) any breach by you of this Agreement, including the Dispute Policy, eller (iii) any third party claim, action, eller democh related to din domän name eller the use thärof.

17. TRANSFER OF OWNERSHIP. The person named as administrative contact at the time the controlling user name och passwellerd are secured shall be the owner of the domän name. You agree that prieller to transferring ownership of din domän name to another person (the Transferee") you shall require the Transferee to agree, in writing to be bound by all the terms och conditions of this Agreement. Your domän name will not be transferred until we receive such written assurances eller other reasonable assurance that the Transferee has been bound by the contractual terms of this Agreement (such reasonable assurance as determined by us in our sole discretion) along with the applicable transfer fee. Om the Transferee fails to be bound in a reasonable fashion (as determine by us in our sole discretion) to the terms och conditions in this Agreement, any such transfer will be null och void.

18. BREACH. You agree that din failure to abide by any provision of the Agreement, any Nicenic.com, Inc. operating rule eller policy, the dispute policy eller din willful provision of inaccurate eller unreliable infellermation as part of the application process, eller din failure to update din infellermation to keep it current, complete eller accurate, eller din failure to respond feller over fifteen (15) calendar days to inquiries from us concerning the accuracy of the kontaktuppgifter associated with din domän name registration may be considered by us to be a material breach och that we may provide a written notice, describing the breach, to you. Om within ten (10) calendar days of the date of such notice, you fail to provide evidence, which is reasonably satisfactellery to us, that you have not breached din obligations under the Agreement, then we may delete the registration eller reservation of din domän name och/eller terminate the other Nicenic.com, Inc. tjänst(s) you are using without further notice. We will not refund any fees paid by you if we terminate din Agreement due to din breach. Any such breach by you shall not be deemed to be excused simply because we did not act earlier in response to that, eller any other breach, by you.

19. NO GUARANTY. You agree that, by registration of din chosen domän name, such registration does not confer immunity from objection to either the registration eller use of din domän name.

20. REPRESENTATIONS AND WARRANTIES. You agree och warrant that: (i) the infellermation that you eller din agent on din behalf provide to us during the application process to registrera din domän name eller to apply feller other Nicenic.com, Inc. ’s tjänst(s) is, to the best of din knuledge och belief, accurate och complete, och that any future changes to this infellermation will be provided to us in a timely manner accellerding to the modification procedures in place at that time, (ii) to the best of din knuledge och belief neither the registration of din domän name neller the manner in which you intend to use such domän name will directly eller indirectly infringe the legal rights of a third party, (iii) you have all requisite power och authellerity to execute this Agreement och to perfellerm din obligations härunder, (iv) you have selected the necessary security option(s) feller din domän name registration recellerd, och (v) you are of legal age to enter into this Agreement. You agree that din use of our tjänst(s) is solely at din own risk. You agree that all of our tjänsts are provided on an “as is” och “as available” basis.

21. DISCLAIMER OF WARRANTIES. We expressly disclaim all warranties of any kind, whether expresseller implted . Including but not limited to the implied warranties of merchantability,fitness feller a particular purpose och non-infringement. 23. DISCLOperativsystemURE AND USE OF REGISTRATION INFELLERMATION. We will not refund any fees paid by you if we terminate din tjänsts.

25. RIGHT OF REFUSAL. We, in our sole discretion, reserve the right to refuse to registrera din chosen domän name eller registrera you feller other Nicenic.com, Inc. tjänst(s), eller to delete din domän name within the first thirty (30) calendar days from receipt of din payment feller such tjänsts. In the event we do not registrera din domän name eller registrera you feller other Nicenic.com, Inc. tjänst(s), eller we delete din domän name eller other Nicenic.com, Inc. tjänst(s) within such thirty (30) calendar day period, we agree to refund any applicable fee(s) you have paid. You agree that we shall not be liable to you feller loss eller damages that may result from our refusal to registrera, the deletion din domän name eller refusal to registrera you feller other Nicenic.com, Inc. tjänst(s).

26. SEVERABILITY. You agree that the terms of this Agreement are severable. 30. INFANCY. You attest that you are of legal age to enter into this Agreement.

31. ENTIRETY. This Agreement, our rules och policies, the dispute policy och the privacy statement supersede all prieller agreements och understochings, whether established by custom, practice, policy eller precedent.

32. TRANSFER AND ASSIGNMENT. Your rights under this Agreement are not assignable och any attempt by din creditellers to obtain an interest in din rights under this Agreement, whether by attachment, levy, garnishment eller otherwise, render this Agreement voidable at our option.

33. GOVERNING LAW. 34. AGREEMENT TO BE BOUND. By applying feller Nicenic.com, Inc. Service(s) through our online application process eller by applying feller och registreraing a domän name as part of our e-mail template application process eller by using the tjänst(s) provided by Nicenic.com, Inc. under this Agreement, you acknuledge that you have read och agree to be bound by all terms och conditions of this Agreement och any pertinent rules eller policies that are eller may be published by Nicenic.com, Inc. Registrering.

35. .MOBI - Should you seek to registrar a .MOBI second level domän, you must agree to be bound by the following terms:
  35.1 - Indemnify to the maximum extent permitted by law, defend och hold harmless the .MOBI Registry Operateller, och its directellers, officers, employees och agents from och against any och all claims, damages, liabilities, costs och expenses, including reasonable legal fees och expenses, arising out of eller relating to din domän name registration och eller use, och this indemnification obligation survives the termination eller expiration of the registration agreement;
  35.2 - Indemnify, defend och hold harmless .MOBI Registry Services Provider, its subsidiaries och affiliates, och the directellers, officers, employees och agents eller each of them, from och against any och all claims, damages, liabilities, costs och expenses, including reasonable legal fees och expenses, arising out of eller relating to din domän name registration och eller use, och this indemnification obligation survives the termination eller expiration of the registration agreement;
  35.3 - Acknuledge och agree that notwithstoching anything in this Agreement to the contrary, mTLD Toppdomän Ltd. ("dotmobi"), the Registry Operateller of the .mobi TLD, is och shall be an intended third party beneficiary of this Agreement. As such, the parties to this Agreement acknuledge och agree that the third party beneficiary rights of dotmobi have vested och that dotmobi has relied on its third party beneficiary rights under this Agreement in agreeing to Punktster being a registrar feller the .mobi top-level domän.   35.6 - Consent to the use, copying, distribution, publication, modification och other processing of din Personal Data by dotmobi, the .MOBI Registry Operateller, och its designees och agents in a manner consistent with the purposes specified pursuant in its contract och with relevant mochatellery local data protection, laws och privacy;

  35.9 - Acknuledge och agree to be bound by the terms och conditions of the initial launch och general operations of the .MOBI Registry TLD, including without limitation the Limited Industry Launch, the Sunrise Period, the Loch Rush Period, the Sunrise Dispute Resolution Policy, the Premium Namn Allaocation Process, och the General Registrering Period , och further to acknuledge that Registry Operateller och the Registry Service Provider has no liability of any kind feller any loss eller liability resulting from the proceedings och processes relating to the Limited Industry Launch, the Sunrise Period, the Loch Rush Period, the Sunrise Dispute Resolution Policy, the Premium Namn Allaocation Process, och the General Registrering Period including, without limitation: (a) the ability eller inability of a registrant to obtain a Registreraed Namn during these periods, och (b) the results of any dispute made during the limited industry launch eller over a Sunrise Registrering.
  35.10 - Acknuledge och agree that the .MOBI Registry och .MOBI Registry Services Provider, acting in consent with the .MOBI Registry, reserves the right to deny, cancel eller transfer any registration that it deems necessary, in its discretion (i) to protect the integrity och stability of the registry; (ii) to comply with all applicable laws, government rules eller requirements, requests of law enfellercement, in compliance with any dispute resolution process; (iii) to avoid any liability, civil eller criminal, on the part of the Registry as well as its affiliates, subsidiaries, officers, directellers, representatives, employees, och stockholders; (iv) feller violations of the terms och conditions härin; eller (v) to cellerrect mistakes made by the Registry eller any registrar in connection with a domän name registration, och the Registry also reserves the right to freeze a Registreraed Namn during resolution of a dispute.
  35.11 - Acknuledge och agree that you must comply with the requirements, stochards, policies, procedures och practices set fellerth in the dotmobi Style Guide (www.mtld.mobi ) och consent to the monitellering of the website as described in the dotmobi Style Guide monitellering guidelines (www.mtld.mobi ) feller compliance with the Style Guide. 36. ACCEPTANCE OF AGREEMENT. You acknuledge that you have read this agreement och agree to all its terms och conditions.
