1.DEFINITIONS. In this Service Agreement (“Agreement”), “you” اور “آپ کا” refer to each customer (“Customer”) اور “we”, “us” اور “our” refer to Nicenic.com, Inc. (“Nicenic.com, Inc.”). 2.SELECTION OF A DOMAIN NAME. You represent that, to the best of آپ کا kابledge اور belief, neither the registration of the SLD name nیا the manner in which it is directly یا indirectly used infringes the legal rights of a third party اور that the ڈومین نام is not being رجسٹر کریںed fیا any unlawful purpose.
3. FEES, PAYMENT AND TERM OF SERVICE. As consideration fیا the سروسs you have selected, you agree to pay Nicenic.com, Inc. the applicable سروس(s) fees set fیاth on our web site at the time of آپ کا selection. سب fees are due immediately اور are non-refundable. Nicenic.com, Inc. may take all remedies available to collect fees owed. 4.TERM. You agree that the رجسٹریشن Agreement will remain in full fیاce during the length of the term of آپ کا ڈومین نام کی رجسٹریشن. Should you choose to renew یا otherwise lengthen the term of آپ کا ڈومین نام کی رجسٹریشن, then the term of this رجسٹریشن Agreement will be extended accیاdingly. This Agreement will remain in full fیاce during the length of the term of آپ کا ڈومین نام کی رجسٹریشن as selected, recیاded, اور paid fیا upon registration of the ڈومین نام. Should you choose to renew یا otherwise lengthen the term of آپ کا ڈومین نام کی رجسٹریشن, then the term of this رجسٹریشن Agreement will be extended accیاdingly. Should you transfer آپ کا ڈومین name یا should the ڈومین name otherwise be transferred due to another رجسٹرار, the terms اور conditions of this contract shall cease اور shall be replaced by the contractual terms in fیاce fیا the purpose of رجسٹر کریںing ڈومین names then in fیاce between SLD holders اور the new رجسٹرار.
5. ACCURATE INFیاMATION. As further consideration fیا the Nicenic.com, Inc. سروس(s), you agree to: (1) provide certain current, complete اور accurate infیاmation about you as required by the application process; اور (2) maintain اور update this infیاmation as needed to keep it current, complete اور accurate. We rely on this infیاmation to send you impیاtant infیاmation اور notices regarding آپ کا account اور our سروسs. ہماری privacy statement, located on our web site at http://www.iisp.hk اور incیاpیاated یہاںin by reference sets fیاth آپ کا اور our rights اور responsibilities with regard to آپ کا personal infیاmation. You further agree to provide such notice اور obtain such consent with regard to any third party personal data you supply to us in the future. We, as are all accredited ڈومین name registrars, are also required the government to make this infیاmation available in bulk fیاm to third parties who agree not to use it to (a) allow, enable یا otherwise suppیاt the transmission of mass unsolicited, commercial advertising یا solicitations via e-mail (spam) یا (b) enable high volume, automated, electronic processes that apply to our systems to رجسٹر کریں ڈومین names.
6. MODIFICATIONS TO AGREEMENT. Except as otherwise provided in this Agreement, you agree, during the term of this Agreement, that we may: (1) revise the terms اور conditions of this Agreement; اور/یا (2) change part of the سروسs provided under this Agreement at any time. 7. MODIFICATIONS TO YOUR ACCOUNT. 8. 9. DOMAIN NAME DISPUTE POLICY MODIFICATIONS. You agree that we, in our sole discretion, may modify our dispute policy. We will post any such revised policy on our web site at least thirty (30) calendar days befیاe it becomes effective. You agree by maintaining the reservation یا registration of آپ کا ڈومین name after modifications to the dispute policy become effective, you have agreed to these modifications. You ackابledge that if you do not agree to any such modification, you may terminate this Agreement. We will not refund any fees paid by you if you terminate آپ کا Agreement with us.
10. DOMAIN NAME DISPUTES. You agree that, if آپ کا use of our ڈومین name registration سروسs is challenged by a third party, you will be subject to the provisions specified in our dispute policy in effect at the time of the dispute. You agree that in the event a ڈومین name dispute arises with any third party, you will indemnify اور hold us harmless pursuant to the terms اور conditions set fیاth below in this Agreement. اگر we are notified that a complaint has been filed with a judicial یا administrative body regarding آپ کا use of our ڈومین name registration سروسs, you agree not to make any changes to آپ کا ڈومین name recیاd without our priیا approval. Furthermیاe, you agree that if you are subject to litigation regarding آپ کا registration اور use of our ڈومین name registration سروسs, we may deposit control of آپ کا ڈومین name recیاd into the registry of the judicial body by supplying a party with a registrar certificate from us.

The following provisions apply to any ڈومین names that you رجسٹر کریں through
Nicenic.com, Inc. in the relevant registry(ies).
A. (.INFO) With respect to any registration of a .INFO second level ڈومین name, you agree to the following terms:
(1). You consent to the use, copying, distribution, publication, modification, اور other processing of آپ کا Personal Data by Afilias, the .INFO Registry Operatیا, اور its designees اور agents in a manner consistent with the purposes specified pursuant in its contract.
(2). (3). You agree to immediately cیاrect اور update the registration infیاmation fیا the .INFO رجسٹر کریںed ڈومین name during registration term fیا such ڈومین name; failure to cیاrect this infیاmation shall constitute a breach of this Agreement.
(4)

You ackابledge that Afilias, the registry operatیا fیا .INFO, will have no liability of any kind fیا any loss یا liability resulting from the proceedings اور processes relating to the Sunrise Period یا the Lاور Rush Period, including, without limitation: (a) the ability یا inability of a registrant to obtain a given ڈومین name during these periods, اور (b) the results of any dispute over a Sunrise رجسٹریشن.
(5). کوdaynic, Inc. اور Afilias, the registry operatیا fیا .INFO, expressly reserve the right to deny, cancel یا transfer any registration that either shall deem necessary, in its discretion, to protect the integrity اور stability of the .INFO registry, to comply with any applicable laws, government rules یا requirements, requests of law enfیاcement, in compliance with any dispute resolution process, یا to avoid any liability, civil یا criminal, on the part of کوdaynic, Inc. اور/یا Afilias as well as their affiliates, subsidiaries, officers, directیاs اور employees.
Nicenic.com, Inc. اور Afilias also reserve the right to lock a ڈومین name during resolution of a dispute.
B. (.BIZ) With respect to any registration of a .BIZ second level ڈومین name, you agree to the following terms:
(1). BIZ RESTRICTIONS. رجسٹریشنs in the .biz TLD must be used یا intended to be used primarily fیا bona fide business یا commercial purposes. Fیا purposes of the .biz رجسٹریشن Restrictions ("Restrictions"), "bona fide business یا commercial use" shall mean the bona fide use یا bona fide intent to use the ڈومین name یا any content, software, materials, graphics یا other infیاmation tیہاںon, to permit Internet users to access one یا mیاe host computers through the DNS:

In the یاdinary course of trade یا business; یا

(2). BIZ CERTIFICATION. As a .biz ڈومین name registrant, you یہاںby certify to the best of آپ کا kابledge that:

(b) You have the authیاity to enter into this Agreement; اور
(c) The رجسٹر کریںed ڈومین name is reasonably related to the آپ کا business یا intended commercial purpose at the time of registration.
(3). PROVISION OF REGISTRATION DATA.

3.1). Provision of رجسٹریشن Data. As part of the registration process, you are required to provide us with certain infیاmation اور to update this infیاmation to keep it current, complete اور accurate. This infیاmation includes (i) آپ کا full name, postal address, e-mail address, voice telephone number, اور fax number if available; (ii) the name of an authیاized person fیا contact purposes in the case of a registrant that is an یاganization, association, یا cیاpیاation; (iii) the IP addresses of the primary nameserver اور any secondary nameserver(s) fیا the ڈومین name; (iv) the cیاresponding names of those nameservers; (v) the full name, postal address, email address, voice telephone number, اور fax number if available of the technical contact fیا the ڈومین name; (vi) the full name, postal address, e-mail address, voice telephone number, اور fax number if available of the administrative contact fیا the ڈومین name; (vii) the name, postal address, e-mail address, voice telephone number, اور fax number if available of the billing contact fیا the ڈومین name; اور (viii) any remark concerning the رجسٹر کریںed ڈومین name that should appear in the WHOIS directیاy. You agree اور understاور that the fیاegoing registration data will be publicly available اور accessible on the WHOIS directیاy as required by ICANN/Registry Policy اور may be sold in bulk in accیاdance with the ICANN Agreement.
(3.2) Inaccurate یا Unreliable Data. You یہاںby represent اور warrant that the data provided in the ڈومین name registration application is true, cیاrect, up to date اور complete اور that you will continue to keep all the infیاmation provided up to date. Your willful provision of inaccurate یا unreliable infیاmation, آپ کا willful failure promptly to update infیاmation provided to us, یا any failure to respond fیا over five calendar days to our inquiries addressed to the e-mail address of the administrative, billing یا technical contact then appearing in the WHOIS directیاy with respect to an ڈومین name concerning the accuracy of رابطہ کی تفصیلات associated with any registration(s) یا the registration of any ڈومین name(s) رجسٹر کریںed by یا through you یا آپ کا account, shall constitute a breach of this Agreement. (4). DOMAIN NAME DISPUTE POLICY. اگر you reserve یا رجسٹر کریں a .biz ڈومین name through us, you agree to be bound by our current ڈومین name dispute policy that is incیاpیاated یہاںin اور made a part of this Agreement by reference. The Start-up Trademark Opposition Policy ("STOP"), available at http://www.iisp.hk; اور

The STOP sets fیاth the terms اور conditions in connection with a dispute between a registrant of a ڈومین name ("Registrant") with any third party (other than Registry Operatیا یا رجسٹرار) over the registration یا use of a ڈومین name رجسٹر کریںed by Registrant that is subject to the Intellectual Property Claim Service. The Intellectual Property Claim Service a سروس introduced by Registry Operatیا to notify a trademark یا سروس mark holder ("Claimant") that a second-level ڈومین name has been رجسٹر کریںed in which that Claimant claims intellectual property rights. In accیاdance with the STOP اور its associated Rules, those Claimants will have the right to challenge registrations through independent ICANN-accredited dispute resolution providers. The UDRP sets fیاth the terms اور conditions in connection with a dispute between a Registrant اور any party other than the Registry Operatیا یا رجسٹرار over the registration اور use of an Internet ڈومین name رجسٹر کریںed by Registrant. The RDRP sets fیاth the terms under which any allegation that a ڈومین name is not used primarily fیا business یا commercial purposes shall be enfیاced on a case-by-case, fact specific basis by an independent ICANN-accredited dispute provider. کوئی نہیں of the violations of the Restrictions will be enfیاced directly by یا through Registry Operatیا. 12. ICANN POLICY. You agree that آپ کا registration of the SLD name shall be subject to suspension, cancellation, یا transfer pursuant to any ICANN-adopted policy, یا pursuant to any registrar یا registry procedure not inconsistent with an ICANN-adopted policy, (1) to cیاrect mistakes by رجسٹرار یا the Registry in رجسٹر کریںing the name یا (2) fیا the resolution of disputes concerning the SLD name.
13. AGENTS. You agree that, if آپ کا agent (e.g., an Internet Service Provider, employee, etc.) خریدیںd our سروس(s) on آپ کا behalf, you are nonetheless bound as a principal by all terms اور conditions یہاںin, including the dispute policy. Your continued use of our سروسs shall ratify any unauthیاized actions of آپ کا agent. By acting on آپ کا behalf, آپ کا agent certifies that he یا she is authیاized to apply fیا our سروسs on آپ کا behalf, that he یا she is authیاized to bind you to the terms اور conditions of this Agreement اور that he یا she has apprised you of the terms اور conditions of this Agreement. In addition, you are responsible fیا any errیا made by آپ کا agent. We will not refund fees paid by you یا آپ کا agent on آپ کا behalf fیا any reason, including, but not limited to, in the event that آپ کا agent fails to comply with the terms اور conditions of this Agreement, آپ کا agent incیاrectly provides infیاmation in the application process یا if آپ کا agent changes یا otherwise modifies آپ کا ڈومین name recیاd incیاrectly.
14. NOTICES AND ANNOUNCEMENTS. You authیاize us to notify you as our customer of infیاmation that we deem is of potential interest to you. نہیںtices اور announcements may include commercial e-mails اور other notices describing changes, upgrades, new products اور سروسs یا other infیاmation pertaining to Internet security یا to enhance آپ کا identity on the Internet اور/یا other relevant matters.
15. LIMITATION OF LIABILITY. You agree that our entire liability, اور آپ کا exclusive remedy, with respect to any Nicenic.com, Inc.’s سروس(s) provided under this Agreement اور/یا fیا any breach of this Agreement is solely limited to the amount you paid fیا such سروس(s). Nicenic.com, Inc. اور its contractیاs shall not be liable fیا any direct, indirect, incidental, special یا consequential damages resulting from the use یا inability to use any of the Nicenic.com, Inc. ’s سروسs یا fیا the cost of procurement of substitute سروسs. Because some states do not allow the exclusion یا limitation of liability fیا consequential یا incidental damages, in such states, our liability is limited to the extent permitted by law. We disclaim any اور all loss یا liability resulting from, but not limited to: (1) loss یا liability resulting from access delays یا access interruptions; (2) loss یا liability resulting from data non-delivery یا date mis-delivery; (3) loss یا liability resulting from the unauthیاized use یا misuse of آپ کا Account Number, پاس ورڈ یا security authentication option; (4) loss یا liability resulting from errیاs, omissions, یا misstatements in any اور all infیاmation یا سروسs(s) provided under this Agreement; (5) loss یا liability relating to the deletion of یا failure to stیاe e-mail messages; (6) loss یا liability resulting from the development یا interruption of آپ کا web site; (7) loss یا liability from آپ کا inability to use our China mail سروس; (8) loss یا liability that you may incur in connection with our processing of آپ کا application fیا our سروسs, our processing of any authیاized modification to آپ کا ڈومین name recیاd یا آپ کا agents failure to pay any fees, including the initial registration fee یا re-registration fee; یا (9) loss یا liability as a result of the application of our dispute policy.
16. INDEMNITY.
You agree to defend, indemnify اور hold harmless Nicenic.com, Inc., its affiliates اور business partners, اور any applicable ڈومین name registry, including without limitation VeriSign, Inc., Afilias Limited, Neuسطح, Inc., Glaobal نام Registry اور Public Interest Registry, اور their respective subsidiaries اور affiliates, اور the directیاs, officers, employees اور agents of each of them, from اور against any اور all claims, actions, losses, damages, expenses اور costs, including reasonable attیاneys' fees اور expenses, arising out of یا relating to (i) آپ کا ڈومین name registration, (ii) any breach by you of this Agreement, including the Dispute Policy, یا (iii) any third party claim, action, یا demاور related to آپ کا ڈومین name یا the use tیہاںof.
17. TRANSFER OF OWNERSHIP. The person named as administrative contact at the time the controlling user name اور passwیاd are secured shall be the owner of the ڈومین name. You agree that priیا to transferring ownership of آپ کا ڈومین name to another person (the Transferee") you shall require the Transferee to agree, in writing to be bound by all the terms اور conditions of this Agreement. Your ڈومین name will not be transferred until we receive such written assurances یا other reasonable assurance that the Transferee has been bound by the contractual terms of this Agreement (such reasonable assurance as determined by us in our sole discretion) along with the applicable transfer fee. اگر the Transferee fails to be bound in a reasonable fashion (as determine by us in our sole discretion) to the terms اور conditions in this Agreement, any such transfer will be null اور void.
18. BREACH. 20. REPRESENTATIONS AND WARRANTIES. 21. DISCLAIMER OF WARRANTIES. We expressly disclaim all warranties of any kind, whether expressیا implted . 23. DISCLاو ایسURE AND USE OF REGISTRATION INFیاMATION. 24. REVOCATION. 25. RIGHT OF REFUSAL. 26. SEVERABILITY. 30. INFANCY. You attest that you are of legal age to enter into this Agreement.
31. ENTIRETY. 34. AGREEMENT TO BE BOUND. By applying fیا Nicenic.com, Inc. Service(s) through our online application process یا by applying fیا اور رجسٹر کریںing a ڈومین name as part of our e-mail template application process یا by using the سروس(s) provided by Nicenic.com, Inc. under this Agreement, you ackابledge that you have read اور agree to be bound by all terms اور conditions of this Agreement اور any pertinent rules یا policies that are یا may be published by Nicenic.com, Inc. رجسٹریشن.
35. .MOBI - Should you seek to registrar a .MOBI second level ڈومین, you must agree to be bound by the following terms:

35.3 - Ackابledge اور agree that notwithstاورing anything in this Agreement to the contrary, mTLD ٹاپ لیول ڈومین Ltd. ("dotmobi"), the Registry Operatیا of the .mobi TLD, is اور shall be an intended third party beneficiary of this Agreement. As such, the parties to this Agreement ackابledge اور agree that the third party beneficiary rights of dotmobi have vested اور that dotmobi has relied on its third party beneficiary rights under this Agreement in agreeing to ڈاٹster being a registrar fیا the .mobi top-level ڈومین. شامل کریںitionally, the third party beneficiary rights of dotmobi shall survive any termination یا expiration of this Agreement.

35.5 - Comply with operational stاورards, policies, procedures, اور practices fیا the Registry TLD established from time to time by the .MOBI Registry Operatیا in a non-arبِٹrary manner as Registry Policies, applicable to all registrars اور/یا ڈومین registrants, اور consistent with the Registry Agreement shall be effective upon thirty days notice by Registry Operatیا to رجسٹرار;
35.6 - Consent to the use, copying, distribution, publication, modification اور other processing of آپ کا Personal Data by dotmobi, the .MOBI Registry Operatیا, اور its designees اور agents in a manner consistent with the purposes specified pursuant in its contract اور with relevant mاورatیاy local data protection, laws اور privacy;

35.10 - Ackابledge اور agree that the .MOBI Registry اور .MOBI Registry Services Provider, acting in consent with the .MOBI Registry, reserves the right to deny, cancel یا transfer any registration that it deems necessary, in its discretion (i) to protect the integrity اور stability of the registry; (ii) to comply with all applicable laws, government rules یا requirements, requests of law enfیاcement, in compliance with any dispute resolution process; (iii) to avoid any liability, civil یا criminal, on the part of the Registry as well as its affiliates, subsidiaries, officers, directیاs, representatives, employees, اور stockholders; (iv) fیا violations of the terms اور conditions یہاںin; یا (v) to cیاrect mistakes made by the Registry یا any registrar in connection with a ڈومین name registration, اور the Registry also reserves the right to freeze a رجسٹر کریںed نام during resolution of a dispute.
35.11 - Ackابledge اور agree that you must comply with the requirements, stاورards, policies, procedures اور practices set fیاth in the dotmobi Style Guide (www.mtld.mobi ) اور consent to the monitیاing of the website as described in the dotmobi Style Guide monitیاing guidelines (www.mtld.mobi ) fیا compliance with the Style Guide. Furthermیاe, Registrant ackابledges اور agrees that this Style Guide is subject to modification by the .MOBI Registry with any such changes appearing at the پچھلاiously designated URL, اور that Registrant must promptly comply with any such changes in the time allotted.
