Qeydiyyatçı-Registrant Agreement

1.DEFINITIONS. In this Service Agreement (“Agreement”), “you” və “sizin” refer to each customer (“Customer”) və “we”, “us” və “our” refer to Nicenic.com, Inc. (“Nicenic.com, Inc.”). 2.SELECTION OF A DOMAIN NAME. You represent that, to the best of sizin kindiledge və belief, neither the registration of the SLD name nvə ya the manner in which it is directly və ya indirectly used infringes the legal rights of a third party və that the Domen Adı is not being qeydiyyated fvə ya any unlawful purpose.

3. FEES, PAYMENT AND TERM OF SERVICE. As consideration fvə ya the Xidməts you have selected, you agree to pay Nicenic.com, Inc. the applicable Xidmət(s) fees set fvə yath on our web site at the time of sizin selection. Hamısı fees are due immediately və are non-refundable. Nicenic.com, Inc. may take all remedies available to collect fees owed. Should you choose to renew və ya otherwise lengthen the term of sizin Domen adı qeydiyyatı, then the term of this Qeydiyyat Agreement will be extended accvə yadingly. This Agreement will remain in full fvə yace during the length of the term of sizin Domen adı qeydiyyatı as selected, recvə yaded, və paid fvə ya upon registration of the Domen Adı. Should you choose to renew və ya otherwise lengthen the term of sizin Domen adı qeydiyyatı, then the term of this Qeydiyyat Agreement will be extended accvə yadingly. Should you transfer sizin domen name və ya should the domen name otherwise be transferred due to another Qeydiyyatçı, the terms və conditions of this contract shall cease və shall be replaced by the contractual terms in fvə yace fvə ya the purpose of qeydiyyating domen names then in fvə yace between SLD holders və the new Qeydiyyatçı.

5. ACCURATE INFVƏ YAMATION. As further consideration fvə ya the Nicenic.com, Inc. Xidmət(s), you agree to: (1) provide certain current, complete və accurate infvə yamation about you as required by the application process; və (2) maintain və update this infvə yamation as needed to keep it current, complete və accurate. We rely on this infvə yamation to send you impvə yatant infvə yamation və notices regarding sizin account və our Xidməts. We will not process the personal date that we collect from you in a way incompatible with the purposes və other limitations described in our privacy statement və we will take reasonable precautions to protect sizin personal date from loss, misuse və unauthvə yaized access, disclosure, alteration və ya destruction. You represent və warrant that you have provided notice to, və obtained consent from, any third party individuals whose personal data you supply to us as part of our Xidməts with regard to: (i) the purposes fvə ya which such third party’s personal data has been collected, (ii) the intended recipients və ya categvə yaies of recipients of the third party’s personal data, (iii) which parts of the third party’s data are obligatvə yay və which parts, if any, are voluntary: və (iv) how the third party can access və, if necessary, rectify the data held about them. You further agree to provide such notice və obtain such consent with regard to any third party personal data you supply to us in the future. We are not responsible fvə ya any consequences resulting from sizin failure to provide notice və ya receive consent from such individuals nvə ya fvə ya sizin providing outdated, incomplete və ya inaccurate infvə yamation. Even if you intend to license the use of our domen name registration Xidməts to a third party, you will remain our customer və you are responsible fvə ya complying with all terms və conditions of this Agreement. Subject to the requirements of our privacy statement, in və yader fvə ya us to comply with our legal və contractual obligations, you buradaby grant to Nicenic.com, Inc. the right to disclose to third parties through an interactive publicly accessible registration database the following mvəatvə yay infvə yamation that you are required to provide when qeydiyyating və ya reserving a domen name: (i) the domen name(s) qeydiyyated by you; (ii) sizin name və postal address; (iii) the name(s), postal address(es), e-mail address(es), voice telephone number və wburada available the fax number(s) of the technical və administrative contacts fvə ya sizin domen name(s); (iv) the Internet protocol numbers of the primary nameserver və the secondary nameserver(s) fvə ya such name(s); (v) the cvə yaresponding names of those nameservers; (vi) the və yaiginal creation date of the registration; və (vii) the expiration date of the registration. We, as are all accredited domen name registrars, are also required the government to make this infvə yamation available in bulk fvə yam to third parties who agree not to use it to (a) allow, enable və ya otherwise suppvə yat the transmission of mass unsolicited, commercial advertising və ya solicitations via e-mail (spam) və ya (b) enable high volume, automated, electronic processes that apply to our systems to qeydiyyat domen names.

6. MODIFICATIONS TO AGREEMENT. Except as otherwise provided in this Agreement, you agree, during the term of this Agreement, that we may: (1) revise the terms və conditions of this Agreement; və/və ya (2) change part of the Xidməts provided under this Agreement at any time. Any such revision və ya change will be binding və effective immediately upon posting of the revised Agreement və ya change to the Xidmət(s) on Nicenic.com, Inc.’s web sites, və ya upon notification to you by e-mail və ya China mail. You agree to periodically review our web sites, including the current version of this Agreement available on our web sites, to be aware of any such revisions. By continuing to use Nicenic.com, Inc.’s Xidməts after any revision to this Agreement və ya change in Xidmət(s), you agree to abide by və be bound by any such revisions və ya changes. We are not bound by nvə ya should you rely on any representation by (i) any agent, representative və ya employee of any third party that you may use to apply fvə ya our Xidməts: və ya in (ii) infvə yamation posted on our web site of a general infvə yamational nature. Xeyr employee, contractvə ya, agent və ya representative of Nicenic.com, Inc. is authvə yaized to alter və ya amend the terms və conditions of this Agreement.

7. MODIFICATIONS TO YOUR ACCOUNT. In və yader to change any of sizin account infvə yamation with us, you must use the Account Number və the Şifrə that you selected if you opened sizin account with us through our online application process, və ya the security authentication option that you selected if you opened sizin account with us through our e-mail application process. 9. DOMAIN NAME DISPUTE POLICY MODIFICATIONS. You agree that we, in our sole discretion, may modify our dispute policy. We will post any such revised policy on our web site at least thirty (30) calendar days befvə yae it becomes effective. You agree by maintaining the reservation və ya registration of sizin domen name after modifications to the dispute policy become effective, you have agreed to these modifications. You ackindiledge that if you do not agree to any such modification, you may terminate this Agreement. We will not refund any fees paid by you if you terminate sizin Agreement with us.

10. DOMAIN NAME DISPUTES. You agree that, if sizin use of our domen name registration Xidməts is challenged by a third party, you will be subject to the provisions specified in our dispute policy in effect at the time of the dispute. You agree that in the event a domen name dispute arises with any third party, you will indemnify və hold us harmless pursuant to the terms və conditions set fvə yath below in this Agreement. Əgər we are notified that a complaint has been filed with a judicial və ya administrative body regarding sizin use of our domen name registration Xidməts, you agree not to make any changes to sizin domen name recvə yad without our privə ya approval. We may not allow you to make changes to such domen name recvə yad until (i) we are directed to do so by the judicial və ya administrative body, və ya (ii) we receive notification by you və the other party contesting sizin registration və use of our domen name registration Xidməts that the dispute has been settled. Furthermvə yae, you agree that if you are subject to litigation regarding sizin registration və use of our domen name registration Xidməts, we may deposit control of sizin domen name recvə yad into the registry of the judicial body by supplying a party with a registrar certificate from us.

A. (.INFO) With respect to any registration of a .INFO second level domen name, you agree to the following terms:
(1). You consent to the use, copying, distribution, publication, modification, və other processing of sizin Personal Data by Afilias, the .INFO Registry Operatvə ya, və its designees və agents in a manner consistent with the purposes specified pursuant in its contract.
(2). You agree to submit to proceedings under ICANN's Unifvə yam Domen Adı Dispute Policy (UDRP) və comply with the requirements set fvə yath by Afilias fvə ya domen names qeydiyyated during the Sunrise Period, including the mvəatvə yay Sunrise Dispute Resolution Policy. These policies are subject to modification by Afilias in its discretion.
(3). You agree to immediately cvə yarect və update the registration infvə yamation fvə ya the .INFO qeydiyyated domen name during registration term fvə ya such domen name; failure to cvə yarect this infvə yamation shall constitute a breach of this Agreement.
(4) . You ackindiledge that Afilias, the registry operatvə ya fvə ya .INFO, will have no liability of any kind fvə ya any loss və ya liability resulting from the proceedings və processes relating to the Sunrise Period və ya the Lvə Rush Period, including, without limitation: (a) the ability və ya inability of a registrant to obtain a given domen name during these periods, və (b) the results of any dispute over a Sunrise Qeydiyyat.
(5). B. (.BIZ) With respect to any registration of a .BIZ second level domen name, you agree to the following terms:
(1). BIZ RESTRICTIONS. Qeydiyyats in the .biz TLD must be used və ya intended to be used primarily fvə ya bona fide business və ya commercial purposes. Fvə ya purposes of the .biz Qeydiyyat Restrictions ("Restrictions"), "bona fide business və ya commercial use" shall mean the bona fide use və ya bona fide intent to use the domen name və ya any content, software, materials, graphics və ya other infvə yamation tburadaon, to permit Internet users to access one və ya mvə yae host computers through the DNS:

(2). BIZ CERTIFICATION. As a .biz domen name registrant, you buradaby certify to the best of sizin kindiledge that:
The qeydiyyated domen name will be used primarily fvə ya bona fide business və ya commercial purposes və not (i) exclusively fvə ya personal use; və ya (ii) solely fvə ya the purposes of (1) selling, trading və ya leasing the domen name fvə ya compensation, və ya (2) the unsolicited offering to sell, trade və ya lease the domen name fvə ya compensation. (b) You have the authvə yaity to enter into this Agreement; və
(c) The qeydiyyated domen name is reasonably related to the sizin business və ya intended commercial purpose at the time of registration.
(3). PROVISION OF REGISTRATION DATA.
( 3.1). Provision of Qeydiyyat Data. As part of the registration process, you are required to provide us with certain infvə yamation və to update this infvə yamation to keep it current, complete və accurate. This infvə yamation includes (i) sizin full name, postal address, e-mail address, voice telephone number, və fax number if available; (ii) the name of an authvə yaized person fvə ya contact purposes in the case of a registrant that is an və yaganization, association, və ya cvə yapvə yaation; (iii) the IP addresses of the primary nameserver və any secondary nameserver(s) fvə ya the domen name; (iv) the cvə yaresponding names of those nameservers; (v) the full name, postal address, email address, voice telephone number, və fax number if available of the technical contact fvə ya the domen name; (vi) the full name, postal address, e-mail address, voice telephone number, və fax number if available of the administrative contact fvə ya the domen name; (vii) the name, postal address, e-mail address, voice telephone number, və fax number if available of the billing contact fvə ya the domen name; və (viii) any remark concerning the qeydiyyated domen name that should appear in the Whois directvə yay. You agree və understvə that the fvə yaegoing registration data will be publicly available və accessible on the Whois directvə yay as required by ICANN/Registry Policy və may be sold in bulk in accvə yadance with the ICANN Agreement.
(3.2) Inaccurate və ya Unreliable Data. You buradaby represent və warrant that the data provided in the domen name registration application is true, cvə yarect, up to date və complete və that you will continue to keep all the infvə yamation provided up to date. Your willful provision of inaccurate və ya unreliable infvə yamation, sizin willful failure promptly to update infvə yamation provided to us, və ya any failure to respond fvə ya over five calendar days to our inquiries addressed to the e-mail address of the administrative, billing və ya technical contact then appearing in the Whois directvə yay with respect to an domen name concerning the accuracy of əlaqə məlumatları associated with any registration(s) və ya the registration of any domen name(s) qeydiyyated by və ya through you və ya sizin account, shall constitute a breach of this Agreement. Any infvə yamation collected by us concerning an identified və ya identifiable natural person ("Personal Data") will be used in connection with the registration of sizin domen name(s) və fvə ya the purposes of this Agreement və as required və ya permitted by the ICANN Agreement və ya any ICANN/Registry Policy.
(4). DOMAIN NAME DISPUTE POLICY. Əgər you reserve və ya qeydiyyat a .biz domen name through us, you agree to be bound by our current domen name dispute policy that is incvə yapvə yaated buradain və made a part of this Agreement by reference. Please take the time to familiarize sizinself with that policy. In addition, you buradaby ackindiledge that you have read və understood və agree to be bound by the terms və conditions of the following documents, as they may be amended from time to time, which are buradaby incvə yapvə yaated və made an integral part of this Razılaşma:

The STOP sets fvə yath the terms və conditions in connection with a dispute between a registrant of a domen name ("Registrant") with any third party (other than Registry Operatvə ya və ya Qeydiyyatçı) over the registration və ya use of a domen name qeydiyyated by Registrant that is subject to the Intellectual Property Claim Service. The Intellectual Property Claim Service a Xidmət introduced by Registry Operatvə ya to notify a trademark və ya Xidmət mark holder ("Claimant") that a second-level domen name has been qeydiyyated in which that Claimant claims intellectual property rights. The RDRP sets fvə yath the terms under which any allegation that a domen name is not used primarily fvə ya business və ya commercial purposes shall be enfvə yaced on a case-by-case, fact specific basis by an independent ICANN-accredited dispute provider. 12. ICANN POLICY. You agree that sizin registration of the SLD name shall be subject to suspension, cancellation, və ya transfer pursuant to any ICANN-adopted policy, və ya pursuant to any registrar və ya registry procedure not inconsistent with an ICANN-adopted policy, (1) to cvə yarect mistakes by Qeydiyyatçı və ya the Registry in qeydiyyating the name və ya (2) fvə ya the resolution of disputes concerning the SLD name.

13. AGENTS. You agree that, if sizin agent (e.g., an Internet Service Provider, employee, etc.) ald our Xidmət(s) on sizin behalf, you are nonetheless bound as a principal by all terms və conditions buradain, including the dispute policy. Your continued use of our Xidməts shall ratify any unauthvə yaized actions of sizin agent. By acting on sizin behalf, sizin agent certifies that he və ya she is authvə yaized to apply fvə ya our Xidməts on sizin behalf, that he və ya she is authvə yaized to bind you to the terms və conditions of this Agreement və that he və ya she has apprised you of the terms və conditions of this Agreement. In addition, you are responsible fvə ya any errvə ya made by sizin agent. We will not refund fees paid by you və ya sizin agent on sizin behalf fvə ya any reason, including, but not limited to, in the event that sizin agent fails to comply with the terms və conditions of this Agreement, sizin agent incvə yarectly provides infvə yamation in the application process və ya if sizin agent changes və ya otherwise modifies sizin domen name recvə yad incvə yarectly.

14. NOTICES AND ANNOUNCEMENTS. You authvə yaize us to notify you as our customer of infvə yamation that we deem is of potential interest to you. Xeyrtices və announcements may include commercial e-mails və other notices describing changes, upgrades, new products və Xidməts və ya other infvə yamation pertaining to Internet security və ya to enhance sizin identity on the Internet və/və ya other relevant matters.

15. LIMITATION OF LIABILITY. You agree that our entire liability, və sizin exclusive remedy, with respect to any Nicenic.com, Inc.’s Xidmət(s) provided under this Agreement və/və ya fvə ya any breach of this Agreement is solely limited to the amount you paid fvə ya such Xidmət(s). Nicenic.com, Inc. və its contractvə yas shall not be liable fvə ya any direct, indirect, incidental, special və ya consequential damages resulting from the use və ya inability to use any of the Nicenic.com, Inc. ’s Xidməts və ya fvə ya the cost of procurement of substitute Xidməts. Because some states do not allow the exclusion və ya limitation of liability fvə ya consequential və ya incidental damages, in such states, our liability is limited to the extent permitted by law. We disclaim any və all loss və ya liability resulting from, but not limited to: (1) loss və ya liability resulting from access delays və ya access interruptions; (2) loss və ya liability resulting from data non-delivery və ya date mis-delivery; (3) loss və ya liability resulting from the unauthvə yaized use və ya misuse of sizin Account Number, Şifrə və ya security authentication option; (4) loss və ya liability resulting from errvə yas, omissions, və ya misstatements in any və all infvə yamation və ya Xidməts(s) provided under this Agreement; (5) loss və ya liability relating to the deletion of və ya failure to stvə yae e-mail messages; (6) loss və ya liability resulting from the development və ya interruption of sizin web site; (7) loss və ya liability from sizin inability to use our China mail Xidmət; (8) loss və ya liability that you may incur in connection with our processing of sizin application fvə ya our Xidməts, our processing of any authvə yaized modification to sizin domen name recvə yad və ya sizin agents failure to pay any fees, including the initial registration fee və ya re-registration fee; və ya (9) loss və ya liability as a result of the application of our dispute policy.

16. INDEMNITY. You agree to defend, indemnify və hold harmless Nicenic.com, Inc., its affiliates və business partners, və any applicable domen name registry, including without limitation VeriSign, Inc., Afilias Limited, NeuSəviyyə, Inc., Glaobal Ad Registry və Public Interest Registry, və their respective subsidiaries və affiliates, və the directvə yas, officers, employees və agents of each of them, from və against any və all claims, actions, losses, damages, expenses və costs, including reasonable attvə yaneys' fees və expenses, arising out of və ya relating to (i) sizin domen name registration, (ii) any breach by you of this Agreement, including the Dispute Policy, və ya (iii) any third party claim, action, və ya demvə related to sizin domen name və ya the use tburadaof.

17. TRANSFER OF OWNERSHIP. The person named as administrative contact at the time the controlling user name və passwvə yad are secured shall be the owner of the domen name. You agree that privə ya to transferring ownership of sizin domen name to another person (the Transferee") you shall require the Transferee to agree, in writing to be bound by all the terms və conditions of this Agreement. Your domen name will not be transferred until we receive such written assurances və ya other reasonable assurance that the Transferee has been bound by the contractual terms of this Agreement (such reasonable assurance as determined by us in our sole discretion) along with the applicable transfer fee. Əgər the Transferee fails to be bound in a reasonable fashion (as determine by us in our sole discretion) to the terms və conditions in this Agreement, any such transfer will be null və void.

18. BREACH. 26. SEVERABILITY. You agree that the terms of this Agreement are severable. 31. ENTIRETY. Service(s) through our online application process və ya by applying fvə ya və qeydiyyating a domen name as part of our e-mail template application process və ya by using the Xidmət(s) provided by Nicenic.com, Inc. under this Agreement, you ackindiledge that you have read və agree to be bound by all terms və conditions of this Agreement və any pertinent rules və ya policies that are və ya may be published by Nicenic.com, Inc. Qeydiyyat.

35. .MOBI - Should you seek to registrar a .MOBI second level domen, you must agree to be bound by the following terms:
  35.1 - Indemnify to the maximum extent permitted by law, defend və hold harmless the .MOBI Registry Operatvə ya, və its directvə yas, officers, employees və agents from və against any və all claims, damages, liabilities, costs və expenses, including reasonable legal fees və expenses, arising out of və ya relating to sizin domen name registration və və ya use, və this indemnification obligation survives the termination və ya expiration of the registration agreement;

  35.6 - Consent to the use, copying, distribution, publication, modification və other processing of sizin Personal Data by dotmobi, the .MOBI Registry Operatvə ya, və its designees və agents in a manner consistent with the purposes specified pursuant in its contract və with relevant mvəatvə yay local data protection, laws və privacy;

  35.9 - Ackindiledge və agree to be bound by the terms və conditions of the initial launch və general operations of the .MOBI Registry TLD, including without limitation the Limited Industry Launch, the Sunrise Period, the Lvə Rush Period, the Sunrise Dispute Resolution Policy, the Premium Ad Hamısıocation Process, və the General Qeydiyyat Period , və further to ackindiledge that Registry Operatvə ya və the Registry Service Provider has no liability of any kind fvə ya any loss və ya liability resulting from the proceedings və processes relating to the Limited Industry Launch, the Sunrise Period, the Lvə Rush Period, the Sunrise Dispute Resolution Policy, the Premium Ad Hamısıocation Process, və the General Qeydiyyat Period including, without limitation: (a) the ability və ya inability of a registrant to obtain a Qeydiyyated Ad during these periods, və (b) the results of any dispute made during the limited industry launch və ya over a Sunrise Qeydiyyat.
  35.10 - Ackindiledge və agree that the .MOBI Registry və .MOBI Registry Services Provider, acting in consent with the .MOBI Registry, reserves the right to deny, cancel və ya transfer any registration that it deems necessary, in its discretion (i) to protect the integrity və stability of the registry; (ii) to comply with all applicable laws, government rules və ya requirements, requests of law enfvə yacement, in compliance with any dispute resolution process; (iii) to avoid any liability, civil və ya criminal, on the part of the Registry as well as its affiliates, subsidiaries, officers, directvə yas, representatives, employees, və stockholders; (iv) fvə ya violations of the terms və conditions buradain; və ya (v) to cvə yarect mistakes made by the Registry və ya any registrar in connection with a domen name registration, və the Registry also reserves the right to freeze a Qeydiyyated Ad during resolution of a dispute.
  35.11 - Ackindiledge və agree that you must comply with the requirements, stvəards, policies, procedures və practices set fvə yath in the dotmobi Style Guide (www.mtld.mobi ) və consent to the monitvə yaing of the website as described in the dotmobi Style Guide monitvə yaing guidelines (www.mtld.mobi ) fvə ya compliance with the Style Guide. Furthermvə yae, Registrant ackindiledges və agrees that this Style Guide is subject to modification by the .MOBI Registry with any such changes appearing at the geriiously designated URL, və that Registrant must promptly comply with any such changes in the time allotted.
  35.12 - Ackindiledge və agree that Proxy və ya Proxy Qeydiyyats will not be allowed during the Sunrise Period, the Limited Industry Launch və the Premium Ad Hamısıocation və Auction Period, və in such an instance will constitute a material breach to this contract.

36. ACCEPTANCE OF AGREEMENT. You ackindiledge that you have read this agreement və agree to all its terms və conditions.
