Kanzler-Registrant Agreement

1.DEFINITIONS. In this Service Agreement (“Agreement”), “you” und “Ihr” refer to each customer (“Customer”) und “we”, “us” und “our” refer to Nicenic.com, Inc. (“Nicenic.com, Inc.”). This Agreement explains our obligations to you, und Ihr obligations to us in relation to Ihr use of our Dienstleistungs. By selecting Nicenic.com, Inc. Dienstleistung(s) you have agreed to establish an account with us foder such Dienstleistungs. When you use Ihr account oder permit someone else to use Ihr account to Kauf oder otherwise acquire access to additional Nicenic.com, Inc.'s Dienstleistung(s) oder to modify oder cancel Ihr Nicenic.com, Inc.’s Dienstleistung(s) (even if we were not notified of such authoderization), this Agreement covers any such Dienstleistung oder actions.

2.SELECTION OF A DOMAIN NAME. You represent that, to the best of Ihr kjetztledge und belief, neither the registration of the SLD name noder the manner in which it is directly oder indirectly used infringes the legal rights of a third party und that the Domain Name is not being registrierened foder any unlawful purpose.

3. FEES, PAYMENT AND TERM OF SERVICE. As consideration foder the Dienstleistungs you have selected, you agree to pay Nicenic.com, Inc. the applicable Dienstleistung(s) fees set foderth on our web site at the time of Ihr selection. Alle fees are due immediately und are non-refundable. Nicenic.com, Inc. may take all remedies available to collect fees owed. Any renewal of Ihr Dienstleistungs with us is subject to our then current terms und conditions und payment of all applicable Dienstleistung fees at the time of renewal und in the case of Domain name re-registration, the Domain name registry’s acceptance of our Domain name registration. You agree that you may not transfer Ihr Domain name registration to another Domain name registrar during the first sixty (60) days from the effective date of Ihr initial Domain name registration with us.

4.TERM. You agree that the Registrierung Agreement will remain in full foderce during the length of the term of Ihr Registrierung von Domainnamen. Should you choose to renew oder otherwise lengthen the term of Ihr Registrierung von Domainnamen, then the term of this Registrierung Agreement will be extended accoderdingly. This Agreement will remain in full foderce during the length of the term of Ihr Registrierung von Domainnamen as selected, recoderded, und paid foder upon registration of the Domain Name. Should you choose to renew oder otherwise lengthen the term of Ihr Registrierung von Domainnamen, then the term of this Registrierung Agreement will be extended accoderdingly. Should you transfer Ihr Domain name oder should the Domain name otherwise be transferred due to another Kanzler, the terms und conditions of this contract shall cease und shall be replaced by the contractual terms in foderce foder the purpose of registrierening Domain names then in foderce between SLD holders und the new Kanzler.

5. ACCURATE INFODERMATION. As further consideration foder the Nicenic.com, Inc. Dienstleistung(s), you agree to: (1) provide certain current, complete und accurate infodermation about you as required by the application process; und (2) maintain und update this infodermation as needed to keep it current, complete und accurate. We rely on this infodermation to send you impodertant infodermation und notices regarding Ihr account und our Dienstleistungs. Unsere privacy statement, located on our web site at http://www.iisp.hk und incoderpoderated hierin by reference sets foderth Ihr und our rights und responsibilities with regard to Ihr personal infodermation. You agree that we, in our sole discretion, may modify our privacy statement. We will post such revised statement on our web site at least thirty (30) calendar days befodere it becomes effective. You agree that, by using our Dienstleistungs after modifications to the privacy statement become effective, you have agreed to these modifications. You ackjetztledge that if you do not agree to any such modification, you may terminate this Agreement. We will not refund any fees paid by you if you terminate Ihr Agreement with us. We will not process the personal date that we collect from you in a way incompatible with the purposes und other limitations described in our privacy statement und we will take reasonable precautions to protect Ihr personal date from loss, misuse und unauthoderized access, disclosure, alteration oder destruction. You represent und warrant that you have provided notice to, und obtained consent from, any third party individuals whose personal data you supply to us as part of our Dienstleistungs with regard to: (i) the purposes foder which such third party’s personal data has been collected, (ii) the intended recipients oder categoderies of recipients of the third party’s personal data, (iii) which parts of the third party’s data are obligatodery und which parts, if any, are voluntary: und (iv) how the third party can access und, if necessary, rectify the data held about them. You further agree to provide such notice und obtain such consent with regard to any third party personal data you supply to us in the future. We are not responsible foder any consequences resulting from Ihr failure to provide notice oder receive consent from such individuals noder foder Ihr providing outdated, incomplete oder inaccurate infodermation. Even if you intend to license the use of our Domain name registration Dienstleistungs to a third party, you will remain our customer und you are responsible foder complying with all terms und conditions of this Agreement. Subject to the requirements of our privacy statement, in oderder foder us to comply with our legal und contractual obligations, you hierby grant to Nicenic.com, Inc. the right to disclose to third parties through an interactive publicly accessible registration database the following mundatodery infodermation that you are required to provide when registrierening oder reserving a Domain name: (i) the Domain name(s) registrierened by you; (ii) Ihr name und postal address; (iii) the name(s), postal address(es), e-mail address(es), voice telephone number und whier available the fax number(s) of the technical und administrative contacts foder Ihr Domain name(s); (iv) the Internet protocol numbers of the primary nameserver und the secondary nameserver(s) foder such name(s); (v) the coderresponding names of those nameservers; (vi) the oderiginal creation date of the registration; und (vii) the expiration date of the registration. We, as are all accredited Domain name registrars, are also required the government to make this infodermation available in bulk foderm to third parties who agree not to use it to (a) allow, enable oder otherwise suppodert the transmission of mass unsolicited, commercial advertising oder solicitations via e-mail (spam) oder (b) enable high volume, automated, electronic processes that apply to our systems to registrieren Domain names.

6. MODIFICATIONS TO AGREEMENT. Except as otherwise provided in this Agreement, you agree, during the term of this Agreement, that we may: (1) revise the terms und conditions of this Agreement; und/oder (2) change part of the Dienstleistungs provided under this Agreement at any time. Any such revision oder change will be binding und effective immediately upon posting of the revised Agreement oder change to the Dienstleistung(s) on Nicenic.com, Inc.’s web sites, oder upon notification to you by e-mail oder China mail. You agree to periodically review our web sites, including the current version of this Agreement available on our web sites, to be aware of any such revisions. Wenn you do not agree with any revision to the Agreement, you may terminate this Agreement at any time by providing us with notice by e-mail oder P.R.C. mail addressed as follows, Beitention: Kanzler Business Affairs, Nicenic.com, Inc. 6B, Xihai Building, Nein.221 Remin E Road, Zhuhai City, Guangdong Province,China ,519000. Neintice of Ihr termination will be effective on receipt und processing by us. Any fees paid by you if you terminate Ihr Agreement with us are non-refundable, but you will not incur und additional fees. By continuing to use Nicenic.com, Inc.’s Dienstleistungs after any revision to this Agreement oder change in Dienstleistung(s), you agree to abide by und be bound by any such revisions oder changes. We are not bound by noder should you rely on any representation by (i) any agent, representative oder employee of any third party that you may use to apply foder our Dienstleistungs: oder in (ii) infodermation posted on our web site of a general infodermational nature. Nein employee, contractoder, agent oder representative of Nicenic.com, Inc. is authoderized to alter oder amend the terms und conditions of this Agreement.

7. MODIFICATIONS TO YOUR ACCOUNT. In oderder to change any of Ihr account infodermation with us, you must use the Account Number und the Passwort that you selected if you opened Ihr account with us through our online application process, oder the security authentication option that you selected if you opened Ihr account with us through our e-mail application process. Please safeguard Ihr Account Number und Passwort oder security authentication option from any unauthoderized use. In no event will we be liable foder the unauthoderized use oder misuse of Ihr Account Number oder Passwort oder security authentication option.

8. DOMAIN NAME DISPUTE POLICY. Wenn you reserve oder registrieren a Domain name through us, you agree to be bound by our current Domain name dispute policy that is incoderpoderated hierin und made a part of this Agreement by reference. The current version of the dispute policy may be found at our web site: http://www.iisp.hk/. Please take the time to familiarize Ihrself with that policy.

9. DOMAIN NAME DISPUTE POLICY MODIFICATIONS. You agree that we, in our sole discretion, may modify our dispute policy. We will post any such revised policy on our web site at least thirty (30) calendar days befodere it becomes effective. You agree by maintaining the reservation oder registration of Ihr Domain name after modifications to the dispute policy become effective, you have agreed to these modifications. You ackjetztledge that if you do not agree to any such modification, you may terminate this Agreement. We will not refund any fees paid by you if you terminate Ihr Agreement with us.

10. DOMAIN NAME DISPUTES. You agree that, if Ihr use of our Domain name registration Dienstleistungs is challenged by a third party, you will be subject to the provisions specified in our dispute policy in effect at the time of the dispute. You agree that in the event a Domain name dispute arises with any third party, you will indemnify und hold us harmless pursuant to the terms und conditions set foderth below in this Agreement. Wenn we are notified that a complaint has been filed with a judicial oder administrative body regarding Ihr use of our Domain name registration Dienstleistungs, you agree not to make any changes to Ihr Domain name recoderd without our prioder approval. We may not allow you to make changes to such Domain name recoderd until (i) we are directed to do so by the judicial oder administrative body, oder (ii) we receive notification by you und the other party contesting Ihr registration und use of our Domain name registration Dienstleistungs that the dispute has been settled. Furthermodere, you agree that if you are subject to litigation regarding Ihr registration und use of our Domain name registration Dienstleistungs, we may deposit control of Ihr Domain name recoderd into the registry of the judicial body by supplying a party with a registrar certificate from us.

11. Hinzufügenitional Registry Requirements The following provisions apply to any Domain names that you registrieren through Nicenic.com, Inc. in the relevant registry(ies).
A. (.INFO) With respect to any registration of a .INFO second level Domain name, you agree to the following terms:
(1). You consent to the use, copying, distribution, publication, modification, und other processing of Ihr Personal Data by Afilias, the .INFO Registry Operatoder, und its designees und agents in a manner consistent with the purposes specified pursuant in its contract.
(2). You agree to submit to proceedings under ICANN's Unifoderm Domain Name Dispute Policy (UDRP) und comply with the requirements set foderth by Afilias foder Domain names registrierened during the Sunrise Period, including the mundatodery Sunrise Dispute Resolution Policy. These policies are subject to modification by Afilias in its discretion.
(3). You agree to immediately coderrect und update the registration infodermation foder the .INFO registrierened Domain name during registration term foder such Domain name; failure to coderrect this infodermation shall constitute a breach of this Agreement.
(4) . You ackjetztledge that Afilias, the registry operatoder foder .INFO, will have no liability of any kind foder any loss oder liability resulting from the proceedings und processes relating to the Sunrise Period oder the Lund Rush Period, including, without limitation: (a) the ability oder inability of a registrant to obtain a given Domain name during these periods, und (b) the results of any dispute over a Sunrise Registrierung.
(5). Andaynic, Inc. und Afilias, the registry operatoder foder .INFO, expressly reserve the right to deny, cancel oder transfer any registration that either shall deem necessary, in its discretion, to protect the integrity und stability of the .INFO registry, to comply with any applicable laws, government rules oder requirements, requests of law enfodercement, in compliance with any dispute resolution process, oder to avoid any liability, civil oder criminal, on the part of Andaynic, Inc. und/oder Afilias as well as their affiliates, subsidiaries, officers, directoders und employees. Nicenic.com, Inc. und Afilias also reserve the right to lock a Domain name during resolution of a dispute.
B. (.BIZ) With respect to any registration of a .BIZ second level Domain name, you agree to the following terms:
(1). BIZ RESTRICTIONS. Registrierungs in the .biz TLD must be used oder intended to be used primarily foder bona fide business oder commercial purposes. Foder purposes of the .biz Registrierung Restrictions ("Restrictions"), "bona fide business oder commercial use" shall mean the bona fide use oder bona fide intent to use the Domain name oder any content, software, materials, graphics oder other infodermation thieron, to permit Internet users to access one oder modere host computers through the DNS:
An exchange goods, Dienstleistungs, oder property of any kind;
In the oderdinary course of trade oder business; oder
An facilitate (i) the exchange of goods, Dienstleistungs, infodermation, oder property of any kind; oder, (ii) the oderdinary course of trade oder business. Registrierening a Domain name solely foder the purposes of (1) selling, trading oder leasing the Domain name foder compensation, oder (2) the unsolicited offering to sell, trade oder lease the Domain name foder compensation shall not constitute a "bona fide business oder commercial use" of that Domain name.
(2). BIZ CERTIFICATION. As a .biz Domain name registrant, you hierby certify to the best of Ihr kjetztledge that:
The registrierened Domain name will be used primarily foder bona fide business oder commercial purposes und not (i) exclusively foder personal use; oder (ii) solely foder the purposes of (1) selling, trading oder leasing the Domain name foder compensation, oder (2) the unsolicited offering to sell, trade oder lease the Domain name foder compensation. (b) You have the authoderity to enter into this Agreement; und
(c) The registrierened Domain name is reasonably related to the Ihr business oder intended commercial purpose at the time of registration.
(3). PROVISION OF REGISTRATION DATA.
( 3.1). Provision of Registrierung Data. As part of the registration process, you are required to provide us with certain infodermation und to update this infodermation to keep it current, complete und accurate. This infodermation includes (i) Ihr full name, postal address, e-mail address, voice telephone number, und fax number if available; (ii) the name of an authoderized person foder contact purposes in the case of a registrant that is an oderganization, association, oder coderpoderation; (iii) the IP addresses of the primary nameserver und any secondary nameserver(s) foder the Domain name; (iv) the coderresponding names of those nameservers; (v) the full name, postal address, email address, voice telephone number, und fax number if available of the technical contact foder the Domain name; (vi) the full name, postal address, e-mail address, voice telephone number, und fax number if available of the administrative contact foder the Domain name; (vii) the name, postal address, e-mail address, voice telephone number, und fax number if available of the billing contact foder the Domain name; und (viii) any remark concerning the registrierened Domain name that should appear in the Whois directodery. You agree und understund that the foderegoing registration data will be publicly available und accessible on the Whois directodery as required by ICANN/Registry Policy und may be sold in bulk in accoderdance with the ICANN Agreement.
(3.2) Inaccurate oder Unreliable Data. You hierby represent und warrant that the data provided in the Domain name registration application is true, coderrect, up to date und complete und that you will continue to keep all the infodermation provided up to date. Your willful provision of inaccurate oder unreliable infodermation, Ihr willful failure promptly to update infodermation provided to us, oder any failure to respond foder over five calendar days to our inquiries addressed to the e-mail address of the administrative, billing oder technical contact then appearing in the Whois directodery with respect to an Domain name concerning the accuracy of Kontaktinformationen associated with any registration(s) oder the registration of any Domain name(s) registrierened by oder through you oder Ihr account, shall constitute a breach of this Agreement. Any infodermation collected by us concerning an identified oder identifiable natural person ("Personal Data") will be used in connection with the registration of Ihr Domain name(s) und foder the purposes of this Agreement und as required oder permitted by the ICANN Agreement oder any ICANN/Registry Policy.
(4). DOMAIN NAME DISPUTE POLICY. Wenn you reserve oder registrieren a .biz Domain name through us, you agree to be bound by our current Domain name dispute policy that is incoderpoderated hierin und made a part of this Agreement by reference. Please take the time to familiarize Ihrself with that policy. In addition, you hierby ackjetztledge that you have read und understood und agree to be bound by the terms und conditions of the following documents, as they may be amended from time to time, which are hierby incoderpoderated und made an integral part of this Vereinbarung:
The Unifoderm Domain Name Dispute Resolution Policy, available at http://www.icann.org/udrp/udrp.htm.
The Start-up Trademark Opposition Policy ("STOP"), available at http://www.iisp.hk; und
The Restrictions Dispute Resolution Criteria und Rules, available at http://www.iisp.hk.
The STOP sets foderth the terms und conditions in connection with a dispute between a registrant of a Domain name ("Registrant") with any third party (other than Registry Operatoder oder Kanzler) over the registration oder use of a Domain name registrierened by Registrant that is subject to the Intellectual Property Claim Service. The Intellectual Property Claim Service a Dienstleistung introduced by Registry Operatoder to notify a trademark oder Dienstleistung mark holder ("Claimant") that a second-level Domain name has been registrierened in which that Claimant claims intellectual property rights. In accoderdance with the STOP und its associated Rules, those Claimants will have the right to challenge registrations through independent ICANN-accredited dispute resolution providers. The UDRP sets foderth the terms und conditions in connection with a dispute between a Registrant und any party other than the Registry Operatoder oder Kanzler over the registration und use of an Internet Domain name registrierened by Registrant. The RDRP sets foderth the terms under which any allegation that a Domain name is not used primarily foder business oder commercial purposes shall be enfoderced on a case-by-case, fact specific basis by an independent ICANN-accredited dispute provider. Keine of the violations of the Restrictions will be enfoderced directly by oder through Registry Operatoder. Registry Operatoder will not review, monitoder, oder otherwise verify that any particular Domain name is being used primarily foder business oder commercial purposes oder that a Domain name is being used in compliance with the SUDRP oder UDRP processes.
(5). DOMAIN NAME DISPUTE POLICY MODIFICATIONS. You agree that we, in our sole discretion, may modify our dispute policy. We will post any such revised policy on our web site at least thirty (30) calendar days befodere it becomes effective. You agree that, by maintaining the reservation oder registration of Ihr Domain name after modifications to the dispute policy become effective, you have agreed to these modifications. You ackjetztledge that if you do not agree to any such modification, you may terminate this Agreement. We will not refund any fees paid by you if you terminate Ihr Agreement with us.
(6). DOMAIN NAME DISPUTES. You agree that, if Ihr use of our Domain name registration Dienstleistungs is challenged by a third party, you will be subject to the provisions specified in our dispute policy in effect at the time of the dispute. You agree that in the event a Domain name dispute arises with any third party, you will indemnify und hold us harmless pursuant to the terms und conditions set foderth below in this Agreement. Wenn we are notified that a complaint has been filed with a judicial oder administrative body regarding Ihr use of our Domain name registration Dienstleistungs, you agree not to make any changes to Ihr Domain name recoderd without our prioder approval. We may not allow you to make changes to such Domain name recoderd until (i) we are directed to do so by the judicial oder administrative body, oder (ii) we receive notification by you und the other party contesting Ihr registration und use of our Domain name registration Dienstleistungs that the dispute has been settled. Furthermodere, you agree that if you are subject to litigation regarding Ihr registration und use of our Domain name registration Dienstleistungs, we may deposit control of Ihr Domain name recoderd into the registry of the judicial body by supplying a party with a registrar certificate from us.

12. ICANN POLICY. You agree that Ihr registration of the SLD name shall be subject to suspension, cancellation, oder transfer pursuant to any ICANN-adopted policy, oder pursuant to any registrar oder registry procedure not inconsistent with an ICANN-adopted policy, (1) to coderrect mistakes by Kanzler oder the Registry in registrierening the name oder (2) foder the resolution of disputes concerning the SLD name.

13. AGENTS. You agree that, if Ihr agent (e.g., an Internet Service Provider, employee, etc.) Kaufd our Dienstleistung(s) on Ihr behalf, you are nonetheless bound as a principal by all terms und conditions hierin, including the dispute policy. Your continued use of our Dienstleistungs shall ratify any unauthoderized actions of Ihr agent. By acting on Ihr behalf, Ihr agent certifies that he oder she is authoderized to apply foder our Dienstleistungs on Ihr behalf, that he oder she is authoderized to bind you to the terms und conditions of this Agreement und that he oder she has apprised you of the terms und conditions of this Agreement. In addition, you are responsible foder any erroder made by Ihr agent. We will not refund fees paid by you oder Ihr agent on Ihr behalf foder any reason, including, but not limited to, in the event that Ihr agent fails to comply with the terms und conditions of this Agreement, Ihr agent incoderrectly provides infodermation in the application process oder if Ihr agent changes oder otherwise modifies Ihr Domain name recoderd incoderrectly.

14. NOTICES AND ANNOUNCEMENTS. You authoderize us to notify you as our customer of infodermation that we deem is of potential interest to you. Neintices und announcements may include commercial e-mails und other notices describing changes, upgrades, new products und Dienstleistungs oder other infodermation pertaining to Internet security oder to enhance Ihr identity on the Internet und/oder other relevant matters.

15. LIMITATION OF LIABILITY. You agree that our entire liability, und Ihr exclusive remedy, with respect to any Nicenic.com, Inc.’s Dienstleistung(s) provided under this Agreement und/oder foder any breach of this Agreement is solely limited to the amount you paid foder such Dienstleistung(s). Nicenic.com, Inc. und its contractoders shall not be liable foder any direct, indirect, incidental, special oder consequential damages resulting from the use oder inability to use any of the Nicenic.com, Inc. ’s Dienstleistungs oder foder the cost of procurement of substitute Dienstleistungs. Because some states do not allow the exclusion oder limitation of liability foder consequential oder incidental damages, in such states, our liability is limited to the extent permitted by law. We disclaim any und all loss oder liability resulting from, but not limited to: (1) loss oder liability resulting from access delays oder access interruptions; (2) loss oder liability resulting from data non-delivery oder date mis-delivery; (3) loss oder liability resulting from the unauthoderized use oder misuse of Ihr Account Number, Passwort oder security authentication option; (4) loss oder liability resulting from erroders, omissions, oder misstatements in any und all infodermation oder Dienstleistungs(s) provided under this Agreement; (5) loss oder liability relating to the deletion of oder failure to stodere e-mail messages; (6) loss oder liability resulting from the development oder interruption of Ihr web site; (7) loss oder liability from Ihr inability to use our China mail Dienstleistung; (8) loss oder liability that you may incur in connection with our processing of Ihr application foder our Dienstleistungs, our processing of any authoderized modification to Ihr Domain name recoderd oder Ihr agents failure to pay any fees, including the initial registration fee oder re-registration fee; oder (9) loss oder liability as a result of the application of our dispute policy.

16. INDEMNITY. You agree to defend, indemnify und hold harmless Nicenic.com, Inc., its affiliates und business partners, und any applicable Domain name registry, including without limitation VeriSign, Inc., Afilias Limited, NeuNiveau, Inc., Glaobal Name Registry und Public Interest Registry, und their respective subsidiaries und affiliates, und the directoders, officers, employees und agents of each of them, from und against any und all claims, actions, losses, damages, expenses und costs, including reasonable attoderneys' fees und expenses, arising out of oder relating to (i) Ihr Domain name registration, (ii) any breach by you of this Agreement, including the Dispute Policy, oder (iii) any third party claim, action, oder demund related to Ihr Domain name oder the use thierof.

17. TRANSFER OF OWNERSHIP. The person named as administrative contact at the time the controlling user name und passwoderd are secured shall be the owner of the Domain name. You agree that prioder to transferring ownership of Ihr Domain name to another person (the Transferee") you shall require the Transferee to agree, in writing to be bound by all the terms und conditions of this Agreement. Your Domain name will not be transferred until we receive such written assurances oder other reasonable assurance that the Transferee has been bound by the contractual terms of this Agreement (such reasonable assurance as determined by us in our sole discretion) along with the applicable transfer fee. Wenn the Transferee fails to be bound in a reasonable fashion (as determine by us in our sole discretion) to the terms und conditions in this Agreement, any such transfer will be null und void.

18. BREACH. You agree that Ihr failure to abide by any provision of the Agreement, any Nicenic.com, Inc. operating rule oder policy, the dispute policy oder Ihr willful provision of inaccurate oder unreliable infodermation as part of the application process, oder Ihr failure to update Ihr infodermation to keep it current, complete oder accurate, oder Ihr failure to respond foder over fifteen (15) calendar days to inquiries from us concerning the accuracy of the Kontaktinformationen associated with Ihr Domain name registration may be considered by us to be a material breach und that we may provide a written notice, describing the breach, to you. Wenn within ten (10) calendar days of the date of such notice, you fail to provide evidence, which is reasonably satisfactodery to us, that you have not breached Ihr obligations under the Agreement, then we may delete the registration oder reservation of Ihr Domain name und/oder terminate the other Nicenic.com, Inc. Dienstleistung(s) you are using without further notice. We will not refund any fees paid by you if we terminate Ihr Agreement due to Ihr breach. Any such breach by you shall not be deemed to be excused simply because we did not act earlier in response to that, oder any other breach, by you.

19. NO GUARANTY. You agree that, by registration of Ihr chosen Domain name, such registration does not confer immunity from objection to either the registration oder use of Ihr Domain name.

20. REPRESENTATIONS AND WARRANTIES. You agree und warrant that: (i) the infodermation that you oder Ihr agent on Ihr behalf provide to us during the application process to registrieren Ihr Domain name oder to apply foder other Nicenic.com, Inc. ’s Dienstleistung(s) is, to the best of Ihr kjetztledge und belief, accurate und complete, und that any future changes to this infodermation will be provided to us in a timely manner accoderding to the modification procedures in place at that time, (ii) to the best of Ihr kjetztledge und belief neither the registration of Ihr Domain name noder the manner in which you intend to use such Domain name will directly oder indirectly infringe the legal rights of a third party, (iii) you have all requisite power und authoderity to execute this Agreement und to perfoderm Ihr obligations hierunder, (iv) you have selected the necessary security option(s) foder Ihr Domain name registration recoderd, und (v) you are of legal age to enter into this Agreement. You agree that Ihr use of our Dienstleistung(s) is solely at Ihr own risk. You agree that all of our Dienstleistungs are provided on an “as is” und “as available” basis.

21. DISCLAIMER OF WARRANTIES. We expressly disclaim all warranties of any kind, whether expressoder implted . Including but not limited to the implied warranties of merchantability,fitness foder a particular purpose und non-infringement. We make no warranty that our Dienstleistung(s) will be uninterrupted, timely, secure, oder erroder free: noder do we make any warranty as to the results that by may be obtained from the use of the Dienstleistung(s). you understund und agree that any material und/oder date downloaded oder otherwise obtained through the use of our china mail Dienstleistung is done at Ihr own discretion und risk und that you will be solely responsible foder any damage to Ihr computer system oder loss of data that results from the download of such material und/oder data. we make no warranty regarding any goods oder Dienstleistungs Kaufd oder obtained through any of our Dienstleistungs oder any transactions entered into through such Dienstleistungs. Nein advice oder infodermation, whether oderal oder written, obtained by you from us oder through our china mail Dienstleistung shall create any waranty not expressly made hierin. to the extent juridictions do not allow the exclusion of certain warranites, some of the above exclusions may not apply to you

22. INFODERMATION. As part of the registration process, you are required to provide us certain infodermation und to update us promptly as such infodermation changes such that our recoderds are current, complete und accurate. You are obliged to provide us the following infodermation:
i) Your name und postal address (oder, if different, that of the Domain name holder);
ii) The Domain name being registrierened
iii) The name, postal address, e-mail address, und voice und fax (if available) telephone numbers of the administrative contact foder the Domain name.
iv) The name, postal address, e-mail address, und voice und fax (if available) telephone numbers of the billing contact foder the Domain name.

23. DISCLBetriebssystemURE AND USE OF REGISTRATION INFODERMATION. You agree und ackjetztledge that we will make Domain name registration infodermation you provide available to ICANN, to the registry administratoders, und to other third parties as ICANN und applicable laws may require oder permit. You further agree und ackjetztledge that we may make publicly available, oder directly available to third party vendoders, some, oder all, of the Domain name registration infodermation you provide, foder purposes of inspection (such as through our WHOIS Dienstleistung) oder other purposes as required oder permitted by ICANN und the applicable laws.

24. REVOCATION. Dienstleistung(s), oder that you subsequently modify, contains false oder misleading infodermation, oder conceals oder omits any infodermation we would likely consider material to our decision to registrieren Ihr Domain name oder to continue to provide you Domain name registration Dienstleistungs. Furthermodere, you agree that we may suspend, cancel oder transfer Ihr Domain name registration Dienstleistungs in oderder to: (i) coderrect mistakes made by us oder the registry in registrierening Ihr chosen Domain name, oder (ii) to resolve a dispute under our dispute policy. We will not refund any fees paid by you if we terminate Ihr Dienstleistungs.

25. RIGHT OF REFUSAL. We, in our sole discretion, reserve the right to refuse to registrieren Ihr chosen Domain name oder registrieren you foder other Nicenic.com, Inc. Dienstleistung(s), oder to delete Ihr Domain name within the first thirty (30) calendar days from receipt of Ihr payment foder such Dienstleistungs. In the event we do not registrieren Ihr Domain name oder registrieren you foder other Nicenic.com, Inc. Dienstleistung(s), oder we delete Ihr Domain name oder other Nicenic.com, Inc. Dienstleistung(s) within such thirty (30) calendar day period, we agree to refund any applicable fee(s) you have paid. You agree that we shall not be liable to you foder loss oder damages that may result from our refusal to registrieren, the deletion Ihr Domain name oder refusal to registrieren you foder other Nicenic.com, Inc. Dienstleistung(s).

26. SEVERABILITY. You agree that the terms of this Agreement are severable. Wenn any term oder provision is declared invalid oder unenfoderceable, that term oder provision will be construed consistent with applicable law as nearly as possible to reflect the oderiginal intentions of the parties, und the remaining terms und provisions will remain in full foderce und effect.

27. NON-AGENCY. Neinthing contained in this Agreement oder the Dispute Policy shall be construed as creating any agency, partnership, oder other foderm of joint enterprise between the parties.

28. NON-WAIVER. Unsere failure to require perfodermance by you of any provision hierof shall not affect the full right to require such perfodermance at any time thierafter; noder shall the waiver by us of a breach of any provision hierof be taken oder held to be a waiver of the provision itself.

29. NOTICES. Any notice, direction oder other communication given under this Agreement shall be in writing und given by sending it via e-mail oder via regular mail. In the case of e-mail, valid notice shall only have been deemed to have been given when an electronic confirmation of delivery has been obtained by the sender. 30. INFANCY. You attest that you are of legal age to enter into this Agreement.

31. ENTIRETY. You agree that this Agreement, the rules und policies published by us, the dispute policy und the privacy statement are the complete und exclusive agreement between you und us regarding our Dienstleistungs. This Agreement, our rules und policies, the dispute policy und the privacy statement supersede all prioder agreements und understundings, whether established by custom, practice, policy oder precedent.

32. TRANSFER AND ASSIGNMENT. You may transfer Ihr Domain name registration to a third party of Ihr choice, subject to the procedures und conditions found at: http://www.iisp.hk (This policy will be updated in this Neinvermber), incoderpoderated hierin by reference. Your rights under this Agreement are not assignable und any attempt by Ihr creditoders to obtain an interest in Ihr rights under this Agreement, whether by attachment, levy, garnishment oder otherwise, render this Agreement voidable at our option.

33. GOVERNING LAW. You agree that this Agreement und any disputes hierunder shall be governed in all respects by und construed in accoderdance with the laws of the China Internet Domain Name Regulations, Procedural Rules foder Domain Name Dispute Resolution of Domain Name Dispute Resolution Center of China International Economic und Trade ArBitration Commission, Detailed Implementation Rules foder Registrierung of Domänennamen in China, Chinese Domänennamen Dispute Resolution Policy, Provisional Administrative Rules foder Registrierung of Domänennamen in China, Internet Keywoderd Registrierung Measure.

34. AGREEMENT TO BE BOUND. By applying foder Nicenic.com, Inc. Service(s) through our online application process oder by applying foder und registrierening a Domain name as part of our e-mail template application process oder by using the Dienstleistung(s) provided by Nicenic.com, Inc. under this Agreement, you ackjetztledge that you have read und agree to be bound by all terms und conditions of this Agreement und any pertinent rules oder policies that are oder may be published by Nicenic.com, Inc. Registrierung.

35. .MOBI - Should you seek to registrar a .MOBI second level Domain, you must agree to be bound by the following terms:
  35.1 - Indemnify to the maximum extent permitted by law, defend und hold harmless the .MOBI Registry Operatoder, und its directoders, officers, employees und agents from und against any und all claims, damages, liabilities, costs und expenses, including reasonable legal fees und expenses, arising out of oder relating to Ihr Domain name registration und oder use, und this indemnification obligation survives the termination oder expiration of the registration agreement;
  35.2 - Indemnify, defend und hold harmless .MOBI Registry Services Provider, its subsidiaries und affiliates, und the directoders, officers, employees und agents oder each of them, from und against any und all claims, damages, liabilities, costs und expenses, including reasonable legal fees und expenses, arising out of oder relating to Ihr Domain name registration und oder use, und this indemnification obligation survives the termination oder expiration of the registration agreement;
  35.3 - Ackjetztledge und agree that notwithstunding anything in this Agreement to the contrary, mTLD Top Level Domain Ltd. ("dotmobi"), the Registry Operatoder of the .mobi TLD, is und shall be an intended third party beneficiary of this Agreement. As such, the parties to this Agreement ackjetztledge und agree that the third party beneficiary rights of dotmobi have vested und that dotmobi has relied on its third party beneficiary rights under this Agreement in agreeing to Punktster being a registrar foder the .mobi top-level Domain. Hinzufügenitionally, the third party beneficiary rights of dotmobi shall survive any termination oder expiration of this Agreement.
  35.4 - Comply with ICANN requirements, stundards, policies, procedures, und practices foder which the .MOBI Registry Operatoder has monitodering responsibility in accoderdance with the Registry Agreement oder other arrangement with ICANN;
  35.5 - Comply with operational stundards, policies, procedures, und practices foder the Registry TLD established from time to time by the .MOBI Registry Operatoder in a non-arBitrary manner as Registry Policies, applicable to all registrars und/oder Domain registrants, und consistent with the Registry Agreement shall be effective upon thirty days notice by Registry Operatoder to Kanzler;
  35.6 - Consent to the use, copying, distribution, publication, modification und other processing of Ihr Personal Data by dotmobi, the .MOBI Registry Operatoder, und its designees und agents in a manner consistent with the purposes specified pursuant in its contract und with relevant mundatodery local data protection, laws und privacy;
  35.7 - Einreichen to proceedings commenced under ICANN's Unifoderm Domain Name Dispute Resolution Policy ("UDRP");
  35.8 - Immediately coderrect und update the registration infodermation foder the registrierened .MOBI Name during the registration term foder the .MOBI Registrierened Name;
  35.9 - Ackjetztledge und agree to be bound by the terms und conditions of the initial launch und general operations of the .MOBI Registry TLD, including without limitation the Limited Industry Launch, the Sunrise Period, the Lund Rush Period, the Sunrise Dispute Resolution Policy, the Premium Name Alleocation Process, und the General Registrierung Period , und further to ackjetztledge that Registry Operatoder und the Registry Service Provider has no liability of any kind foder any loss oder liability resulting from the proceedings und processes relating to the Limited Industry Launch, the Sunrise Period, the Lund Rush Period, the Sunrise Dispute Resolution Policy, the Premium Name Alleocation Process, und the General Registrierung Period including, without limitation: (a) the ability oder inability of a registrant to obtain a Registrierened Name during these periods, und (b) the results of any dispute made during the limited industry launch oder over a Sunrise Registrierung.
  35.10 - Ackjetztledge und agree that the .MOBI Registry und .MOBI Registry Services Provider, acting in consent with the .MOBI Registry, reserves the right to deny, cancel oder transfer any registration that it deems necessary, in its discretion (i) to protect the integrity und stability of the registry; (ii) to comply with all applicable laws, government rules oder requirements, requests of law enfodercement, in compliance with any dispute resolution process; (iii) to avoid any liability, civil oder criminal, on the part of the Registry as well as its affiliates, subsidiaries, officers, directoders, representatives, employees, und stockholders; (iv) foder violations of the terms und conditions hierin; oder (v) to coderrect mistakes made by the Registry oder any registrar in connection with a Domain name registration, und the Registry also reserves the right to freeze a Registrierened Name during resolution of a dispute.
  35.11 - Ackjetztledge und agree that you must comply with the requirements, stundards, policies, procedures und practices set foderth in the dotmobi Style Guide (www.mtld.mobi ) und consent to the monitodering of the website as described in the dotmobi Style Guide monitodering guidelines (www.mtld.mobi ) foder compliance with the Style Guide. Furthermodere, Registrant ackjetztledges und agrees that this Style Guide is subject to modification by the .MOBI Registry with any such changes appearing at the zurückiously designated URL, und that Registrant must promptly comply with any such changes in the time allotted.
  35.12 - Ackjetztledge und agree that Proxy oder Proxy Registrierungs will not be allowed during the Sunrise Period, the Limited Industry Launch und the Premium Name Alleocation und Auction Period, und in such an instance will constitute a material breach to this contract.

36. ACCEPTANCE OF AGREEMENT. You ackjetztledge that you have read this agreement und agree to all its terms und conditions. You have independently evaluated the desirability of the Dienstleistung und are not relying on any representation agreement.Guarantee oder statement other than as set foderth in this agreement.
