Regisztrátor-Registrant Agreement

1.DEFINITIONS. In this Service Agreement (“Agreement”), “you” és “a te” refer to each customer (“Customer”) és “we”, “us” és “our” refer to Nicenic.com, Inc. (“Nicenic.com, Inc.”). 3. FEES, PAYMENT AND TERM OF SERVICE. Should you transfer a te domain name vagy should the domain name otherwise be transferred due to another Regisztrátor, the terms és conditions of this contract shall cease és shall be replaced by the contractual terms in fvagyce fvagy the purpose of regisztrációing domain names then in fvagyce between SLD holders és the new Regisztrátor.

5. ACCURATE INFVAGYMATION. As further consideration fvagy the Nicenic.com, Inc. szolgáltatás(s), you agree to: (1) provide certain current, complete és accurate infvagymation about you as required by the application process; és (2) maintain és update this infvagymation as needed to keep it current, complete és accurate. We rely on this infvagymation to send you impvagytant infvagymation és notices regarding a te account és our szolgáltatáss. Even if you intend to license the use of our domain name registration szolgáltatáss to a third party, you will remain our customer és you are responsible fvagy complying with all terms és conditions of this Agreement. Subject to the requirements of our privacy statement, in vagyder fvagy us to comply with our legal és contractual obligations, you ittby grant to Nicenic.com, Inc. the right to disclose to third parties through an interactive publicly accessible registration database the following mésatvagyy infvagymation that you are required to provide when regisztrációing vagy reserving a domain name: (i) the domain name(s) regisztrációed by you; (ii) a te name és postal address; (iii) the name(s), postal address(es), e-mail address(es), voice telephone number és witt available the fax number(s) of the technical és administrative contacts fvagy a te domain name(s); (iv) the Internet protocol numbers of the primary nameserver és the secondary nameserver(s) fvagy such name(s); (v) the cvagyresponding names of those nameservers; (vi) the vagyiginal creation date of the registration; és (vii) the expiration date of the registration. We, as are all accredited domain name registrars, are also required the government to make this infvagymation available in bulk fvagym to third parties who agree not to use it to (a) allow, enable vagy otherwise suppvagyt the transmission of mass unsolicited, commercial advertising vagy solicitations via e-mail (spam) vagy (b) enable high volume, automated, electronic processes that apply to our systems to regisztráció domain names.

6. MODIFICATIONS TO AGREEMENT. Except as otherwise provided in this Agreement, you agree, during the term of this Agreement, that we may: (1) revise the terms és conditions of this Agreement; és/vagy (2) change part of the szolgáltatáss provided under this Agreement at any time. 7. MODIFICATIONS TO YOUR ACCOUNT. 8. DOMAIN NAME DISPUTE POLICY. 9. DOMAIN NAME DISPUTE POLICY MODIFICATIONS. You agree that we, in our sole discretion, may modify our dispute policy. We will post any such revised policy on our web site at least thirty (30) calendar days befvagye it becomes effective. You agree by maintaining the reservation vagy registration of a te domain name after modifications to the dispute policy become effective, you have agreed to these modifications. You ackmostledge that if you do not agree to any such modification, you may terminate this Agreement. We will not refund any fees paid by you if you terminate a te Agreement with us.

10. DOMAIN NAME DISPUTES. You agree that, if a te use of our domain name registration szolgáltatáss is challenged by a third party, you will be subject to the provisions specified in our dispute policy in effect at the time of the dispute. You agree that in the event a domain name dispute arises with any third party, you will indemnify és hold us harmless pursuant to the terms és conditions set fvagyth below in this Agreement. Ha we are notified that a complaint has been filed with a judicial vagy administrative body regarding a te use of our domain name registration szolgáltatáss, you agree not to make any changes to a te domain name recvagyd without our privagy approval. We may not allow you to make changes to such domain name recvagyd until (i) we are directed to do so by the judicial vagy administrative body, vagy (ii) we receive notification by you és the other party contesting a te registration és use of our domain name registration szolgáltatáss that the dispute has been settled. Furthermvagye, you agree that if you are subject to litigation regarding a te registration és use of our domain name registration szolgáltatáss, we may deposit control of a te domain name recvagyd into the registry of the judicial body by supplying a party with a registrar certificate from us.

A. (.INFO) With respect to any registration of a .INFO second level domain name, you agree to the following terms:
(1). You consent to the use, copying, distribution, publication, modification, és other processing of a te Personal Data by Afilias, the .INFO Registry Operatvagy, és its designees és agents in a manner consistent with the purposes specified pursuant in its contract.
(2). You agree to submit to proceedings under ICANN's Unifvagym Domain név Dispute Policy (UDRP) és comply with the requirements set fvagyth by Afilias fvagy domain names regisztrációed during the Sunrise Period, including the mésatvagyy Sunrise Dispute Resolution Policy. These policies are subject to modification by Afilias in its discretion.
(3). You agree to immediately cvagyrect és update the registration infvagymation fvagy the .INFO regisztrációed domain name during registration term fvagy such domain name; failure to cvagyrect this infvagymation shall constitute a breach of this Agreement.
(4) . You ackmostledge that Afilias, the registry operatvagy fvagy .INFO, will have no liability of any kind fvagy any loss vagy liability resulting from the proceedings és processes relating to the Sunrise Period vagy the Lés Rush Period, including, without limitation: (a) the ability vagy inability of a registrant to obtain a given domain name during these periods, és (b) the results of any dispute over a Sunrise Regisztráció.
(5). Hozzádaynic, Inc. és Afilias, the registry operatvagy fvagy .INFO, expressly reserve the right to deny, cancel vagy transfer any registration that either shall deem necessary, in its discretion, to protect the integrity és stability of the .INFO registry, to comply with any applicable laws, government rules vagy requirements, requests of law enfvagycement, in compliance with any dispute resolution process, vagy to avoid any liability, civil vagy criminal, on the part of Hozzádaynic, Inc. és/vagy Afilias as well as their affiliates, subsidiaries, officers, directvagys és employees. Nicenic.com, Inc. és Afilias also reserve the right to lock a domain name during resolution of a dispute.
B. (.BIZ) With respect to any registration of a .BIZ second level domain name, you agree to the following terms:
(1). BIZ RESTRICTIONS. Regisztrációs in the .biz TLD must be used vagy intended to be used primarily fvagy bona fide business vagy commercial purposes. Fvagy purposes of the .biz Regisztráció Restrictions ("Restrictions"), "bona fide business vagy commercial use" shall mean the bona fide use vagy bona fide intent to use the domain name vagy any content, software, materials, graphics vagy other infvagymation titton, to permit Internet users to access one vagy mvagye host computers through the DNS:
Hozzá exchange goods, szolgáltatáss, vagy property of any kind;
In the vagydinary course of trade vagy business; vagy
Hozzá facilitate (i) the exchange of goods, szolgáltatáss, infvagymation, vagy property of any kind; vagy, (ii) the vagydinary course of trade vagy business. Regisztrációing a domain name solely fvagy the purposes of (1) selling, trading vagy leasing the domain name fvagy compensation, vagy (2) the unsolicited offering to sell, trade vagy lease the domain name fvagy compensation shall not constitute a "bona fide business vagy commercial use" of that domain name.
(2). BIZ CERTIFICATION. As a .biz domain name registrant, you ittby certify to the best of a te kmostledge that:
The regisztrációed domain name will be used primarily fvagy bona fide business vagy commercial purposes és not (i) exclusively fvagy personal use; vagy (ii) solely fvagy the purposes of (1) selling, trading vagy leasing the domain name fvagy compensation, vagy (2) the unsolicited offering to sell, trade vagy lease the domain name fvagy compensation. (b) You have the authvagyity to enter into this Agreement; és
(c) The regisztrációed domain name is reasonably related to the a te business vagy intended commercial purpose at the time of registration.
(3). PROVISION OF REGISTRATION DATA.
( 3.1). Provision of Regisztráció Data. As part of the registration process, you are required to provide us with certain infvagymation és to update this infvagymation to keep it current, complete és accurate. This infvagymation includes (i) a te full name, postal address, e-mail address, voice telephone number, és fax number if available; (ii) the name of an authvagyized person fvagy contact purposes in the case of a registrant that is an vagyganization, association, vagy cvagypvagyation; (iii) the IP addresses of the primary nameserver és any secondary nameserver(s) fvagy the domain name; (iv) the cvagyresponding names of those nameservers; (v) the full name, postal address, email address, voice telephone number, és fax number if available of the technical contact fvagy the domain name; (vi) the full name, postal address, e-mail address, voice telephone number, és fax number if available of the administrative contact fvagy the domain name; (vii) the name, postal address, e-mail address, voice telephone number, és fax number if available of the billing contact fvagy the domain name; és (viii) any remark concerning the regisztrációed domain name that should appear in the Whois directvagyy. You agree és understés that the fvagyegoing registration data will be publicly available és accessible on the Whois directvagyy as required by ICANN/Registry Policy és may be sold in bulk in accvagydance with the ICANN Agreement.
(3.2) Inaccurate vagy Unreliable Data. You ittby represent és warrant that the data provided in the domain name registration application is true, cvagyrect, up to date és complete és that you will continue to keep all the infvagymation provided up to date. Your willful provision of inaccurate vagy unreliable infvagymation, a te willful failure promptly to update infvagymation provided to us, vagy any failure to respond fvagy over five calendar days to our inquiries addressed to the e-mail address of the administrative, billing vagy technical contact then appearing in the Whois directvagyy with respect to an domain name concerning the accuracy of Kapcsolattartási adatok associated with any registration(s) vagy the registration of any domain name(s) regisztrációed by vagy through you vagy a te account, shall constitute a breach of this Agreement. Any infvagymation collected by us concerning an identified vagy identifiable natural person ("Personal Data") will be used in connection with the registration of a te domain name(s) és fvagy the purposes of this Agreement és as required vagy permitted by the ICANN Agreement vagy any ICANN/Registry Policy.
(4). DOMAIN NAME DISPUTE POLICY. Ha you reserve vagy regisztráció a .biz domain name through us, you agree to be bound by our current domain name dispute policy that is incvagypvagyated ittin és made a part of this Agreement by reference. Please take the time to familiarize a teself with that policy. In addition, you ittby ackmostledge that you have read és understood és agree to be bound by the terms és conditions of the following documents, as they may be amended from time to time, which are ittby incvagypvagyated és made an integral part of this Megállapodás:

The STOP sets fvagyth the terms és conditions in connection with a dispute between a registrant of a domain name ("Registrant") with any third party (other than Registry Operatvagy vagy Regisztrátor) over the registration vagy use of a domain name regisztrációed by Registrant that is subject to the Intellectual Property Claim Service. The Intellectual Property Claim Service a szolgáltatás introduced by Registry Operatvagy to notify a trademark vagy szolgáltatás mark holder ("Claimant") that a second-level domain name has been regisztrációed in which that Claimant claims intellectual property rights. Nincs of the violations of the Restrictions will be enfvagyced directly by vagy through Registry Operatvagy. Registry Operatvagy will not review, monitvagy, vagy otherwise verify that any particular domain name is being used primarily fvagy business vagy commercial purposes vagy that a domain name is being used in compliance with the SUDRP vagy UDRP processes.
(5). DOMAIN NAME DISPUTE POLICY MODIFICATIONS. You agree that we, in our sole discretion, may modify our dispute policy. We will post any such revised policy on our web site at least thirty (30) calendar days befvagye it becomes effective. You agree that, by maintaining the reservation vagy registration of a te domain name after modifications to the dispute policy become effective, you have agreed to these modifications. You ackmostledge that if you do not agree to any such modification, you may terminate this Agreement. We will not refund any fees paid by you if you terminate a te Agreement with us.
(6). DOMAIN NAME DISPUTES. 12. ICANN POLICY. You agree that a te registration of the SLD name shall be subject to suspension, cancellation, vagy transfer pursuant to any ICANN-adopted policy, vagy pursuant to any registrar vagy registry procedure not inconsistent with an ICANN-adopted policy, (1) to cvagyrect mistakes by Regisztrátor vagy the Registry in regisztrációing the name vagy (2) fvagy the resolution of disputes concerning the SLD name.

13. AGENTS. You agree that, if a te agent (e.g., an Internet Service Provider, employee, etc.) vásárlásd our szolgáltatás(s) on a te behalf, you are nonetheless bound as a principal by all terms és conditions ittin, including the dispute policy. We will not refund fees paid by you vagy a te agent on a te behalf fvagy any reason, including, but not limited to, in the event that a te agent fails to comply with the terms és conditions of this Agreement, a te agent incvagyrectly provides infvagymation in the application process vagy if a te agent changes vagy otherwise modifies a te domain name recvagyd incvagyrectly.

14. NOTICES AND ANNOUNCEMENTS. You authvagyize us to notify you as our customer of infvagymation that we deem is of potential interest to you. Nemtices és announcements may include commercial e-mails és other notices describing changes, upgrades, new products és szolgáltatáss vagy other infvagymation pertaining to Internet security vagy to enhance a te identity on the Internet és/vagy other relevant matters.

15. LIMITATION OF LIABILITY. You agree that our entire liability, és a te exclusive remedy, with respect to any Nicenic.com, Inc.’s szolgáltatás(s) provided under this Agreement és/vagy fvagy any breach of this Agreement is solely limited to the amount you paid fvagy such szolgáltatás(s). Nicenic.com, Inc. és its contractvagys shall not be liable fvagy any direct, indirect, incidental, special vagy consequential damages resulting from the use vagy inability to use any of the Nicenic.com, Inc. ’s szolgáltatáss vagy fvagy the cost of procurement of substitute szolgáltatáss. Because some states do not allow the exclusion vagy limitation of liability fvagy consequential vagy incidental damages, in such states, our liability is limited to the extent permitted by law. We disclaim any és all loss vagy liability resulting from, but not limited to: (1) loss vagy liability resulting from access delays vagy access interruptions; (2) loss vagy liability resulting from data non-delivery vagy date mis-delivery; (3) loss vagy liability resulting from the unauthvagyized use vagy misuse of a te Account Number, Jelszó vagy security authentication option; (4) loss vagy liability resulting from errvagys, omissions, vagy misstatements in any és all infvagymation vagy szolgáltatáss(s) provided under this Agreement; (5) loss vagy liability relating to the deletion of vagy failure to stvagye e-mail messages; (6) loss vagy liability resulting from the development vagy interruption of a te web site; (7) loss vagy liability from a te inability to use our China mail szolgáltatás; (8) loss vagy liability that you may incur in connection with our processing of a te application fvagy our szolgáltatáss, our processing of any authvagyized modification to a te domain name recvagyd vagy a te agents failure to pay any fees, including the initial registration fee vagy re-registration fee; vagy (9) loss vagy liability as a result of the application of our dispute policy.

16. INDEMNITY. You agree to defend, indemnify és hold harmless Nicenic.com, Inc., its affiliates és business partners, és any applicable domain name registry, including without limitation VeriSign, Inc., Afilias Limited, NeuSzint, Inc., Glaobal Név Registry és Public Interest Registry, és their respective subsidiaries és affiliates, és the directvagys, officers, employees és agents of each of them, from és against any és all claims, actions, losses, damages, expenses és costs, including reasonable attvagyneys' fees és expenses, arising out of vagy relating to (i) a te domain name registration, (ii) any breach by you of this Agreement, including the Dispute Policy, vagy (iii) any third party claim, action, vagy demés related to a te domain name vagy the use tittof.

17. TRANSFER OF OWNERSHIP. The person named as administrative contact at the time the controlling user name és passwvagyd are secured shall be the owner of the domain name. You agree that privagy to transferring ownership of a te domain name to another person (the Transferee") you shall require the Transferee to agree, in writing to be bound by all the terms és conditions of this Agreement. Your domain name will not be transferred until we receive such written assurances vagy other reasonable assurance that the Transferee has been bound by the contractual terms of this Agreement (such reasonable assurance as determined by us in our sole discretion) along with the applicable transfer fee. Ha the Transferee fails to be bound in a reasonable fashion (as determine by us in our sole discretion) to the terms és conditions in this Agreement, any such transfer will be null és void.

18. BREACH. You agree that a te failure to abide by any provision of the Agreement, any Nicenic.com, Inc. operating rule vagy policy, the dispute policy vagy a te willful provision of inaccurate vagy unreliable infvagymation as part of the application process, vagy a te failure to update a te infvagymation to keep it current, complete vagy accurate, vagy a te failure to respond fvagy over fifteen (15) calendar days to inquiries from us concerning the accuracy of the Kapcsolattartási adatok associated with a te domain name registration may be considered by us to be a material breach és that we may provide a written notice, describing the breach, to you. Ha within ten (10) calendar days of the date of such notice, you fail to provide evidence, which is reasonably satisfactvagyy to us, that you have not breached a te obligations under the Agreement, then we may delete the registration vagy reservation of a te domain name és/vagy terminate the other Nicenic.com, Inc. szolgáltatás(s) you are using without further notice. We will not refund any fees paid by you if we terminate a te Agreement due to a te breach. 20. REPRESENTATIONS AND WARRANTIES. In the case of e-mail, valid notice shall only have been deemed to have been given when an electronic confirmation of delivery has been obtained by the sender. In the case of e-mail notification to [email protected] vagy, in the case of notice to you, at the e-mail address provided by you in a te WHOIS recvagyd. 31. ENTIRETY. 34. AGREEMENT TO BE BOUND. By applying fvagy Nicenic.com, Inc. Service(s) through our online application process vagy by applying fvagy és regisztrációing a domain name as part of our e-mail template application process vagy by using the szolgáltatás(s) provided by Nicenic.com, Inc. under this Agreement, you ackmostledge that you have read és agree to be bound by all terms és conditions of this Agreement és any pertinent rules vagy policies that are vagy may be published by Nicenic.com, Inc. 35. .MOBI - Should you seek to registrar a .MOBI second level domain, you must agree to be bound by the following terms:

  35.6 - Consent to the use, copying, distribution, publication, modification és other processing of a te Personal Data by dotmobi, the .MOBI Registry Operatvagy, és its designees és agents in a manner consistent with the purposes specified pursuant in its contract és with relevant mésatvagyy local data protection, laws és privacy;
