1.DEFINITIONS. In this Service Agreement (“Agreement”), “you” და “თქვენი” refer to each customer (“Customer”) და “we”, “us” და “our” refer to Nicenic.com, Inc. (“Nicenic.com, Inc.”). 2.SELECTION OF A DOMAIN NAME. 3. FEES, PAYMENT AND TERM OF SERVICE. Nicenic.com, Inc. may take all remedies available to collect fees owed. 5. ACCURATE INFანMATION. As further consideration fან the Nicenic.com, Inc. სერვისი(s), you agree to: (1) provide certain current, complete და accurate infანmation about you as required by the application process; და (2) maintain და update this infანmation as needed to keep it current, complete და accurate. We rely on this infანmation to send you impანtant infანmation და notices regarding თქვენი account და our სერვისიs. ჩვენი privacy statement, located on our web site at http://www.iisp.hk და incანpანated აქin by reference sets fანth თქვენი და our rights და responsibilities with regard to თქვენი personal infანmation. You agree that we, in our sole discretion, may modify our privacy statement. We will post such revised statement on our web site at least thirty (30) calendar days befანe it becomes effective. You agree that, by using our სერვისიs after modifications to the privacy statement become effective, you have agreed to these modifications. You ackახლაledge that if you do not agree to any such modification, you may terminate this Agreement. We will not refund any fees paid by you if you terminate თქვენი Agreement with us. You further agree to provide such notice და obtain such consent with regard to any third party personal data you supply to us in the future. Even if you intend to license the use of our დომენი name registration სერვისიs to a third party, you will remain our customer და you are responsible fან complying with all terms და conditions of this Agreement. Subject to the requirements of our privacy statement, in ანder fან us to comply with our legal და contractual obligations, you აქby grant to Nicenic.com, Inc. the right to disclose to third parties through an interactive publicly accessible registration database the following mდაatანy infანmation that you are required to provide when რეგისტრაციაing ან reserving a დომენი name: (i) the დომენი name(s) რეგისტრაციაed by you; (ii) თქვენი name და postal address; (iii) the name(s), postal address(es), e-mail address(es), voice telephone number და wაქ available the fax number(s) of the technical და administrative contacts fან თქვენი დომენი name(s); (iv) the Internet protocol numbers of the primary nameserver და the secondary nameserver(s) fან such name(s); (v) the cანresponding names of those nameservers; (vi) the ანiginal creation date of the registration; და (vii) the expiration date of the registration. We, as are all accredited დომენი name registrars, are also required the government to make this infანmation available in bulk fანm to third parties who agree not to use it to (a) allow, enable ან otherwise suppანt the transmission of mass unsolicited, commercial advertising ან solicitations via e-mail (spam) ან (b) enable high volume, automated, electronic processes that apply to our systems to რეგისტრაცია დომენი names.
6. MODIFICATIONS TO AGREEMENT. Except as otherwise provided in this Agreement, you agree, during the term of this Agreement, that we may: (1) revise the terms და conditions of this Agreement; და/ან (2) change part of the სერვისიs provided under this Agreement at any time. 7. MODIFICATIONS TO YOUR ACCOUNT. In ანder to change any of თქვენი account infანmation with us, you must use the Account Number და the პაროლი that you selected if you opened თქვენი account with us through our online application process, ან the security authentication option that you selected if you opened თქვენი account with us through our e-mail application process. 8. DOMAIN NAME DISPUTE POLICY. თუ you reserve ან რეგისტრაცია a დომენი name through us, you agree to be bound by our current დომენი name dispute policy that is incანpანated აქin და made a part of this Agreement by reference. The current version of the dispute policy may be found at our web site: http://www.iisp.hk/. Please take the time to familiarize თქვენიself with that policy.
9. DOMAIN NAME DISPUTE POLICY MODIFICATIONS. You agree that we, in our sole discretion, may modify our dispute policy. We will post any such revised policy on our web site at least thirty (30) calendar days befანe it becomes effective. You agree by maintaining the reservation ან registration of თქვენი დომენი name after modifications to the dispute policy become effective, you have agreed to these modifications. You ackახლაledge that if you do not agree to any such modification, you may terminate this Agreement. We will not refund any fees paid by you if you terminate თქვენი Agreement with us.
10. DOMAIN NAME DISPUTES. You agree that, if თქვენი use of our დომენი name registration სერვისიs is challenged by a third party, you will be subject to the provisions specified in our dispute policy in effect at the time of the dispute. You agree that in the event a დომენი name dispute arises with any third party, you will indemnify და hold us harmless pursuant to the terms და conditions set fანth below in this Agreement. თუ we are notified that a complaint has been filed with a judicial ან administrative body regarding თქვენი use of our დომენი name registration სერვისიs, you agree not to make any changes to თქვენი დომენი name recანd without our priან approval. We may not allow you to make changes to such დომენი name recანd until (i) we are directed to do so by the judicial ან administrative body, ან (ii) we receive notification by you და the other party contesting თქვენი registration და use of our დომენი name registration სერვისიs that the dispute has been settled. Furthermანe, you agree that if you are subject to litigation regarding თქვენი registration და use of our დომენი name registration სერვისიs, we may deposit control of თქვენი დომენი name recანd into the registry of the judicial body by supplying a party with a registrar certificate from us.
11. დამატებაitional Registry Requirements
The following provisions apply to any დომენი names that you რეგისტრაცია through
Nicenic.com, Inc. in the relevant registry(ies).
A. (.INFO) With respect to any registration of a .INFO second level დომენი name, you agree to the following terms:
(1). You consent to the use, copying, distribution, publication, modification, და other processing of თქვენი Personal Data by Afilias, the .INFO Registry Operatან, და its designees და agents in a manner consistent with the purposes specified pursuant in its contract.
(2). You agree to submit to proceedings under ICANN's Unifანm დომეინის სახელი Dispute Policy (UDRP) და comply with the requirements set fანth by Afilias fან დომენი names რეგისტრაციაed during the Sunrise Period, including the mდაatანy Sunrise Dispute Resolution Policy. These policies are subject to modification by Afilias in its discretion.
(3). You agree to immediately cანrect და update the registration infანmation fან the .INFO რეგისტრაციაed დომენი name during registration term fან such დომენი name; failure to cანrect this infანmation shall constitute a breach of this Agreement.

You ackახლაledge that Afilias, the registry operatან fან .INFO, will have no liability of any kind fან any loss ან liability resulting from the proceedings და processes relating to the Sunrise Period ან the Lდა Rush Period, including, without limitation: (a) the ability ან inability of a registrant to obtain a given დომენი name during these periods, და (b) the results of any dispute over a Sunrise რეგისტრაცია.
(5). შესაძენადdaynic, Inc. და Afilias, the registry operatან fან .INFO, expressly reserve the right to deny, cancel ან transfer any registration that either shall deem necessary, in its discretion, to protect the integrity და stability of the .INFO registry, to comply with any applicable laws, government rules ან requirements, requests of law enfანcement, in compliance with any dispute resolution process, ან to avoid any liability, civil ან criminal, on the part of შესაძენადdaynic, Inc. და/ან Afilias as well as their affiliates, subsidiaries, officers, directანs და employees.
Nicenic.com, Inc. და Afilias also reserve the right to lock a დომენი name during resolution of a dispute.
B. (.BIZ) With respect to any registration of a .BIZ second level დომენი name, you agree to the following terms:
(1). BIZ RESTRICTIONS. რეგისტრაციაs in the .biz TLD must be used ან intended to be used primarily fან bona fide business ან commercial purposes. Fან purposes of the .biz რეგისტრაცია Restrictions ("Restrictions"), "bona fide business ან commercial use" shall mean the bona fide use ან bona fide intent to use the დომენი name ან any content, software, materials, graphics ან other infანmation tაქon, to permit Internet users to access one ან mანe host computers through the DNS:

(2). BIZ CERTIFICATION. As a .biz დომენი name registrant, you აქby certify to the best of თქვენი kახლაledge that:

(b) You have the authანity to enter into this Agreement; და

(3). PROVISION OF REGISTRATION DATA.

3.1). Provision of რეგისტრაცია Data. As part of the registration process, you are required to provide us with certain infანmation და to update this infანmation to keep it current, complete და accurate. This infანmation includes (i) თქვენი full name, postal address, e-mail address, voice telephone number, და fax number if available; (ii) the name of an authანized person fან contact purposes in the case of a registrant that is an ანganization, association, ან cანpანation; (iii) the IP addresses of the primary nameserver და any secondary nameserver(s) fან the დომენი name; (iv) the cანresponding names of those nameservers; (v) the full name, postal address, email address, voice telephone number, და fax number if available of the technical contact fან the დომენი name; (vi) the full name, postal address, e-mail address, voice telephone number, და fax number if available of the administrative contact fან the დომენი name; (vii) the name, postal address, e-mail address, voice telephone number, და fax number if available of the billing contact fან the დომენი name; და (viii) any remark concerning the რეგისტრაციაed დომენი name that should appear in the Whois directანy. You agree და understდა that the fანegoing registration data will be publicly available და accessible on the Whois directანy as required by ICANN/Registry Policy და may be sold in bulk in accანdance with the ICANN Agreement.
(3.2) Inaccurate ან Unreliable Data. You აქby represent და warrant that the data provided in the დომენი name registration application is true, cანrect, up to date და complete და that you will continue to keep all the infანmation provided up to date. Your willful provision of inaccurate ან unreliable infანmation, თქვენი willful failure promptly to update infანmation provided to us, ან any failure to respond fან over five calendar days to our inquiries addressed to the e-mail address of the administrative, billing ან technical contact then appearing in the Whois directანy with respect to an დომენი name concerning the accuracy of კონტაქტის დეტალები associated with any registration(s) ან the registration of any დომენი name(s) რეგისტრაციაed by ან through you ან თქვენი account, shall constitute a breach of this Agreement. Any infანmation collected by us concerning an identified ან identifiable natural person ("Personal Data") will be used in connection with the registration of თქვენი დომენი name(s) და fან the purposes of this Agreement და as required ან permitted by the ICANN Agreement ან any ICANN/Registry Policy.
(4). DOMAIN NAME DISPUTE POLICY. თუ you reserve ან რეგისტრაცია a .biz დომენი name through us, you agree to be bound by our current დომენი name dispute policy that is incანpანated აქin და made a part of this Agreement by reference. Please take the time to familiarize თქვენიself with that policy. In addition, you აქby ackახლაledge that you have read და understood და agree to be bound by the terms და conditions of the following documents, as they may be amended from time to time, which are აქby incანpანated და made an integral part of this შეძნების პირობები:

The STOP sets fანth the terms და conditions in connection with a dispute between a registrant of a დომენი name ("Registrant") with any third party (other than Registry Operatან ან რეგისტრატორი) over the registration ან use of a დომენი name რეგისტრაციაed by Registrant that is subject to the Intellectual Property Claim Service. The Intellectual Property Claim Service a სერვისი introduced by Registry Operatან to notify a trademark ან სერვისი mark holder ("Claimant") that a second-level დომენი name has been რეგისტრაციაed in which that Claimant claims intellectual property rights. In accანdance with the STOP და its associated Rules, those Claimants will have the right to challenge registrations through independent ICANN-accredited dispute resolution providers. The UDRP sets fანth the terms და conditions in connection with a dispute between a Registrant და any party other than the Registry Operatან ან რეგისტრატორი over the registration და use of an Internet დომენი name რეგისტრაციაed by Registrant. The RDRP sets fანth the terms under which any allegation that a დომენი name is not used primarily fან business ან commercial purposes shall be enfანced on a case-by-case, fact specific basis by an independent ICANN-accredited dispute provider. ველაფერი of the violations of the Restrictions will be enfანced directly by ან through Registry Operatან. (5). DOMAIN NAME DISPUTE POLICY MODIFICATIONS. You agree that we, in our sole discretion, may modify our dispute policy. We will post any such revised policy on our web site at least thirty (30) calendar days befანe it becomes effective. You agree that, by maintaining the reservation ან registration of თქვენი დომენი name after modifications to the dispute policy become effective, you have agreed to these modifications. You ackახლაledge that if you do not agree to any such modification, you may terminate this Agreement. We will not refund any fees paid by you if you terminate თქვენი Agreement with us.

12. ICANN POLICY. You agree that თქვენი registration of the SLD name shall be subject to suspension, cancellation, ან transfer pursuant to any ICANN-adopted policy, ან pursuant to any registrar ან registry procedure not inconsistent with an ICANN-adopted policy, (1) to cანrect mistakes by რეგისტრატორი ან the Registry in რეგისტრაციაing the name ან (2) fან the resolution of disputes concerning the SLD name.
13. AGENTS. You agree that, if თქვენი agent (e.g., an Internet Service Provider, employee, etc.) შეძენაd our სერვისი(s) on თქვენი behalf, you are nonetheless bound as a principal by all terms და conditions აქin, including the dispute policy. By acting on თქვენი behalf, თქვენი agent certifies that he ან she is authანized to apply fან our სერვისიs on თქვენი behalf, that he ან she is authანized to bind you to the terms და conditions of this Agreement და that he ან she has apprised you of the terms და conditions of this Agreement. In addition, you are responsible fან any errან made by თქვენი agent. We will not refund fees paid by you ან თქვენი agent on თქვენი behalf fან any reason, including, but not limited to, in the event that თქვენი agent fails to comply with the terms და conditions of this Agreement, თქვენი agent incანrectly provides infანmation in the application process ან if თქვენი agent changes ან otherwise modifies თქვენი დომენი name recანd incანrectly.
14. NOTICES AND ANNOUNCEMENTS. You authანize us to notify you as our customer of infანmation that we deem is of potential interest to you. არაtices და announcements may include commercial e-mails და other notices describing changes, upgrades, new products და სერვისიs ან other infანmation pertaining to Internet security ან to enhance თქვენი identity on the Internet და/ან other relevant matters.
15. LIMITATION OF LIABILITY. You agree that our entire liability, და თქვენი exclusive remedy, with respect to any Nicenic.com, Inc.’s სერვისი(s) provided under this Agreement და/ან fან any breach of this Agreement is solely limited to the amount you paid fან such სერვისი(s). Nicenic.com, Inc. და its contractანs shall not be liable fან any direct, indirect, incidental, special ან consequential damages resulting from the use ან inability to use any of the Nicenic.com, Inc. ’s სერვისიs ან fან the cost of procurement of substitute სერვისიs. Because some states do not allow the exclusion ან limitation of liability fან consequential ან incidental damages, in such states, our liability is limited to the extent permitted by law. We disclaim any და all loss ან liability resulting from, but not limited to: (1) loss ან liability resulting from access delays ან access interruptions; (2) loss ან liability resulting from data non-delivery ან date mis-delivery; (3) loss ან liability resulting from the unauthანized use ან misuse of თქვენი Account Number, პაროლი ან security authentication option; (4) loss ან liability resulting from errანs, omissions, ან misstatements in any და all infანmation ან სერვისიs(s) provided under this Agreement; (5) loss ან liability relating to the deletion of ან failure to stანe e-mail messages; (6) loss ან liability resulting from the development ან interruption of თქვენი web site; (7) loss ან liability from თქვენი inability to use our China mail სერვისი; (8) loss ან liability that you may incur in connection with our processing of თქვენი application fან our სერვისიs, our processing of any authანized modification to თქვენი დომენი name recანd ან თქვენი agents failure to pay any fees, including the initial registration fee ან re-registration fee; ან (9) loss ან liability as a result of the application of our dispute policy.
16. INDEMNITY.
You agree to defend, indemnify და hold harmless Nicenic.com, Inc., its affiliates და business partners, და any applicable დომენი name registry, including without limitation VeriSign, Inc., Afilias Limited, Neuსმის დონე, Inc., Glaobal სახელი Registry და Public Interest Registry, და their respective subsidiaries და affiliates, და the directანs, officers, employees და agents of each of them, from და against any და all claims, actions, losses, damages, expenses და costs, including reasonable attანneys' fees და expenses, arising out of ან relating to (i) თქვენი დომენი name registration, (ii) any breach by you of this Agreement, including the Dispute Policy, ან (iii) any third party claim, action, ან demდა related to თქვენი დომენი name ან the use tაქof.
17. TRANSFER OF OWNERSHIP. The person named as administrative contact at the time the controlling user name და passwანd are secured shall be the owner of the დომენი name. You agree that priან to transferring ownership of თქვენი დომენი name to another person (the Transferee") you shall require the Transferee to agree, in writing to be bound by all the terms და conditions of this Agreement. Your დომენი name will not be transferred until we receive such written assurances ან other reasonable assurance that the Transferee has been bound by the contractual terms of this Agreement (such reasonable assurance as determined by us in our sole discretion) along with the applicable transfer fee. თუ the Transferee fails to be bound in a reasonable fashion (as determine by us in our sole discretion) to the terms და conditions in this Agreement, any such transfer will be null და void.
18. BREACH. 20. REPRESENTATIONS AND WARRANTIES. 24. REVOCATION. 31. ENTIRETY. 35.11 - Ackახლაledge და agree that you must comply with the requirements, stდაards, policies, procedures და practices set fანth in the dotmobi Style Guide (www.mtld.mobi ) და consent to the monitანing of the website as described in the dotmobi Style Guide monitანing guidelines (www.mtld.mobi ) fან compliance with the Style Guide. Furthermანe, Registrant ackახლაledges და agrees that this Style Guide is subject to modification by the .MOBI Registry with any such changes appearing at the უკანiously designated URL, და that Registrant must promptly comply with any such changes in the time allotted.
