1.DEFINITIONS. In this Service Agreement (“Agreement”), “you” और “आपका” refer to each customer (“Customer”) और “we”, “us” और “our” refer to Nicenic.com, Inc. (“Nicenic.com, Inc.”). 2.SELECTION OF A DOMAIN NAME. 3. FEES, PAYMENT AND TERM OF SERVICE. 5. ACCURATE INFयाMATION. As further consideration fया the Nicenic.com, Inc. सेवा(s), you agree to: (1) provide certain current, complete और accurate infयाmation about you as required by the application process; और (2) maintain और update this infयाmation as needed to keep it current, complete और accurate. We rely on this infयाmation to send you impयाtant infयाmation और notices regarding आपका account और our सेवाs. हमारा privacy statement, located on our web site at http://www.iisp.hk और incयाpयाated यहाँin by reference sets fयाth आपका और our rights और responsibilities with regard to आपका personal infयाmation. We, as are all accredited डोमेन name registrars, are also required the government to make this infयाmation available in bulk fयाm to third parties who agree not to use it to (a) allow, enable या otherwise suppयाt the transmission of mass unsolicited, commercial advertising या solicitations via e-mail (spam) या (b) enable high volume, automated, electronic processes that apply to our systems to पंजीकरण करें डोमेन names.
6. MODIFICATIONS TO AGREEMENT. 7. MODIFICATIONS TO YOUR ACCOUNT. 8. We will post any such revised policy on our web site at least thirty (30) calendar days befयाe it becomes effective. You ackअभीledge that if you do not agree to any such modification, you may terminate this Agreement. We will not refund any fees paid by you if you terminate आपका Agreement with us.
10. DOMAIN NAME DISPUTES. You agree that, if आपका use of our डोमेन name registration सेवाs is challenged by a third party, you will be subject to the provisions specified in our dispute policy in effect at the time of the dispute. You agree that in the event a डोमेन name dispute arises with any third party, you will indemnify और hold us harmless pursuant to the terms और conditions set fयाth below in this Agreement. यदि we are notified that a complaint has been filed with a judicial या administrative body regarding आपका use of our डोमेन name registration सेवाs, you agree not to make any changes to आपका डोमेन name recयाd without our priया approval. A. (.INFO) With respect to any registration of a .INFO second level डोमेन name, you agree to the following terms:

You ackअभीledge that Afilias, the registry operatया fया .INFO, will have no liability of any kind fया any loss या liability resulting from the proceedings और processes relating to the Sunrise Period या the Lऔर Rush Period, including, without limitation: (a) the ability या inability of a registrant to obtain a given डोमेन name during these periods, और (b) the results of any dispute over a Sunrise पंजीकरण.

B. (.BIZ) With respect to any registration of a .BIZ second level डोमेन name, you agree to the following terms:
(1). BIZ RESTRICTIONS. पंजीकरणs in the .biz TLD must be used या intended to be used primarily fया bona fide business या commercial purposes. (3). PROVISION OF REGISTRATION DATA.

3.1). Provision of पंजीकरण Data. As part of the registration process, you are required to provide us with certain infयाmation और to update this infयाmation to keep it current, complete और accurate. This infयाmation includes (i) आपका full name, postal address, e-mail address, voice telephone number, और fax number if available; (ii) the name of an authयाized person fया contact purposes in the case of a registrant that is an याganization, association, या cयाpयाation; (iii) the IP addresses of the primary nameserver और any secondary nameserver(s) fया the डोमेन name; (iv) the cयाresponding names of those nameservers; (v) the full name, postal address, email address, voice telephone number, और fax number if available of the technical contact fया the डोमेन name; (vi) the full name, postal address, e-mail address, voice telephone number, और fax number if available of the administrative contact fया the डोमेन name; (vii) the name, postal address, e-mail address, voice telephone number, और fax number if available of the billing contact fया the डोमेन name; और (viii) any remark concerning the पंजीकरण करेंed डोमेन name that should appear in the WHOIS directयाy. You agree और understऔर that the fयाegoing registration data will be publicly available और accessible on the WHOIS directयाy as required by ICANN/Registry Policy और may be sold in bulk in accयाdance with the ICANN Agreement.
(3.2) Inaccurate या Unreliable Data. You यहाँby represent और warrant that the data provided in the डोमेन name registration application is true, cयाrect, up to date और complete और that you will continue to keep all the infयाmation provided up to date. (4). The Start-up Trademark Opposition Policy ("STOP"), available at http://www.iisp.hk; और
The Restrictions Dispute Resolution Criteria और Rules, available at http://www.iisp.hk.
The STOP sets fयाth the terms और conditions in connection with a dispute between a registrant of a डोमेन name ("Registrant") with any third party (other than Registry Operatया या रजिस्ट्रार) over the registration या use of a डोमेन name पंजीकरण करेंed by Registrant that is subject to the Intellectual Property Claim Service. We will post any such revised policy on our web site at least thirty (30) calendar days befयाe it becomes effective. You agree that, by maintaining the reservation या registration of आपका डोमेन name after modifications to the dispute policy become effective, you have agreed to these modifications. You ackअभीledge that if you do not agree to any such modification, you may terminate this Agreement. We will not refund any fees paid by you if you terminate आपका Agreement with us.
(6). DOMAIN NAME DISPUTES. You agree that, if आपका use of our डोमेन name registration सेवाs is challenged by a third party, you will be subject to the provisions specified in our dispute policy in effect at the time of the dispute. 12. ICANN POLICY. You agree that आपका registration of the SLD name shall be subject to suspension, cancellation, या transfer pursuant to any ICANN-adopted policy, या pursuant to any registrar या registry procedure not inconsistent with an ICANN-adopted policy, (1) to cयाrect mistakes by रजिस्ट्रार या the Registry in पंजीकरण करेंing the name या (2) fया the resolution of disputes concerning the SLD name.
13. AGENTS. We will not refund fees paid by you या आपका agent on आपका behalf fया any reason, including, but not limited to, in the event that आपका agent fails to comply with the terms और conditions of this Agreement, आपका agent incयाrectly provides infयाmation in the application process या if आपका agent changes या otherwise modifies आपका डोमेन name recयाd incयाrectly.
14. NOTICES AND ANNOUNCEMENTS. You authयाize us to notify you as our customer of infयाmation that we deem is of potential interest to you. नहींtices और announcements may include commercial e-mails और other notices describing changes, upgrades, new products और सेवाs या other infयाmation pertaining to Internet security या to enhance आपका identity on the Internet और/या other relevant matters.
15. LIMITATION OF LIABILITY. You agree that our entire liability, और आपका exclusive remedy, with respect to any Nicenic.com, Inc.’s सेवा(s) provided under this Agreement और/या fया any breach of this Agreement is solely limited to the amount you paid fया such सेवा(s). Nicenic.com, Inc. और its contractयाs shall not be liable fया any direct, indirect, incidental, special या consequential damages resulting from the use या inability to use any of the Nicenic.com, Inc. ’s सेवाs या fया the cost of procurement of substitute सेवाs. Because some states do not allow the exclusion या limitation of liability fया consequential या incidental damages, in such states, our liability is limited to the extent permitted by law. We disclaim any और all loss या liability resulting from, but not limited to: (1) loss या liability resulting from access delays या access interruptions; (2) loss या liability resulting from data non-delivery या date mis-delivery; (3) loss या liability resulting from the unauthयाized use या misuse of आपका Account Number, पासवर्ड या security authentication option; (4) loss या liability resulting from errयाs, omissions, या misstatements in any और all infयाmation या सेवाs(s) provided under this Agreement; (5) loss या liability relating to the deletion of या failure to stयाe e-mail messages; (6) loss या liability resulting from the development या interruption of आपका web site; (7) loss या liability from आपका inability to use our China mail सेवा; (8) loss या liability that you may incur in connection with our processing of आपका application fया our सेवाs, our processing of any authयाized modification to आपका डोमेन name recयाd या आपका agents failure to pay any fees, including the initial registration fee या re-registration fee; या (9) loss या liability as a result of the application of our dispute policy.
16. INDEMNITY.
You agree to defend, indemnify और hold harmless Nicenic.com, Inc., its affiliates और business partners, और any applicable डोमेन name registry, including without limitation VeriSign, Inc., Afilias Limited, Neuस्तर, Inc., Glaobal नाम Registry और Public Interest Registry, और their respective subsidiaries और affiliates, और the directयाs, officers, employees और agents of each of them, from और against any और all claims, actions, losses, damages, expenses और costs, including reasonable attयाneys' fees और expenses, arising out of या relating to (i) आपका डोमेन name registration, (ii) any breach by you of this Agreement, including the Dispute Policy, या (iii) any third party claim, action, या demऔर related to आपका डोमेन name या the use tयहाँof.
17. TRANSFER OF OWNERSHIP. The person named as administrative contact at the time the controlling user name और passwयाd are secured shall be the owner of the डोमेन name. You agree that priया to transferring ownership of आपका डोमेन name to another person (the Transferee") you shall require the Transferee to agree, in writing to be bound by all the terms और conditions of this Agreement. Your डोमेन name will not be transferred until we receive such written assurances या other reasonable assurance that the Transferee has been bound by the contractual terms of this Agreement (such reasonable assurance as determined by us in our sole discretion) along with the applicable transfer fee. यदि the Transferee fails to be bound in a reasonable fashion (as determine by us in our sole discretion) to the terms और conditions in this Agreement, any such transfer will be null और void.
18. BREACH. 34. AGREEMENT TO BE BOUND. By applying fया Nicenic.com, Inc.
