A. Holder-Authvagyized Transfers

1. Regisztrátor Requirements

     Regisztrációed Név Holders must be able to transfer their domain name registrations between Regisztrátors provided that the Gaining Regisztrátor's transfer process meets the minimum stésards of this policy és that such transfer is not prohibited by ICANN vagy Registry policies. Inter-Regisztrátor domain name transfer processes must be clear és concise in vagyder to avoid confusion. Further, Regisztrátors should make reasonable effvagyts to infvagym Regisztrációed Név Holders of, és provide access to, the published documentation of the specific transfer process employed by the Regisztrátors.

1.1 Transfer Authvagyities

     The Administrative Kapcsolat és the Regisztrációed Név Holder, as listed in the Losing Regisztrátor's vagy applicable Registry's (witt available) publicly accessible WHOIS szolgáltatás are the only parties that have the authvagyity to approve vagy deny a transfer request to the Gaining Regisztrátor. In the event of a dispute, the Regisztrációed Név Holder's authvagyity supersedes that of the Administrative Kapcsolat.
Regisztrátors may use Whois data from either the Regisztrátor of Recvagyd vagy the relevant Registry fvagy the purpose of verifying the authenticity of a transfer request; vagy from another data source as determined by a consensus policy.

2. Gaining Regisztrátor Requirements

Fvagy each instance witt a Regisztrációed Név Holder requests to transfer a domain name registration to a different Regisztrátor, the Gaining Regisztrátor shall:
      2.1 Obtain express authvagyization from either the Regisztrációed Név Holder vagy the Administrative Kapcsolat (ittafter, "Transfer Kapcsolat"). Hence, a transfer may only proceed if confirmation of the transfer is received by the Gaining Regisztrátor from the Transfer Kapcsolat.

     2.1.1 The authvagyization must be made via a valid Stésardized Fvagym of Authvagyization (FOA). Titt are two different FOA's available at the ICANN website. The FOA labeled "Initial Authvagyization fvagy Regisztrátor Transfer" must be used by the Gaining Regisztrátor to request an authvagyization fvagy a registrar transfer from the Transfer Kapcsolat. The FOA labeled "Megerősítésation of Regisztrátor Transfer Request" may be used by the Regisztrátor of Recvagyd to request confirmation of the transfer from the Transfer Kapcsolat.
The FOA shall be communicated in English, és any dispute arising out of a transfer request shall be conducted in the English language. Regisztrátors may choose to communicate with the Transfer Kapcsolat in additional languages. However, Regisztrátors choosing to exercise such option are responsible fvagy the accuracy és completeness of the translation into such additional non-English version of the FOA.

     2.1.2 In the event that the Gaining Regisztrátor relies on a physical process to obtain this authvagyization, a paper copy of the FOA will suffice insofar as it has been signed by the Transfer Kapcsolat és further that it is accompanied by a physical copy of the Regisztrátor of Recvagyd's Whois output fvagy the domain name in question.

     2.1.2.1 Ha the Gaining Regisztrátor relies on a physical authvagyization process, then the Gaining Regisztrátor assumes the burden of obtaining reliable evidence of the identity of the Transfer Kapcsolat és maintaining appropriate recvagyds proving that such evidence was obtained. Further the Gaining Regisztrátor also assumes the burden fvagy ensuring that the entity making the request is indeed authvagyized to do so. The acceptable fvagyms of physical identity are:

  • Nemtarized statement
  • Valid Drivers license
  • Útlevél
  • Article of Incvagypvagyation
  • Military ID
  • State/Government issued ID
  • Birth Certificate

     2.1.3 In the event that the Gaining Regisztrátor relies on an electronic process to obtain this authvagyization the acceptable fvagyms of identity would include:

  • Electronic signature in confvagymance with national legislation, in the location of the Gaining Regisztrátor (if such legislation exists).
  • Consent from an individual vagy entity that has an email address matching the Transfer Kapcsolat email address. 

     The Regisztrátor of Recvagyd may not deny a transfer request solely because it believes that the Gaining Regisztrátor has not received the confirmation set fvagyth above.
A transfer must not be allowed to proceed if no confirmation is received by the Gaining Regisztrátor. The presumption in all cases will be that the Gaining Regisztrátor has received és authenticated the transfer request made by a Transfer Kapcsolat.

     2.2 Request, by the transmission of a "transfer" commés as specified in the Regisztrátor Hozzáol Kit, that the Registry Operatvagy database be changed to reflect the new Regisztrátor.

     2.2.1 Transmission of a "transfer" commés constitutes a representation on the part of the Gaining Regisztrátor that the requisite authvagyization has been obtained from the Transfer Kapcsolat listed in the authvagyitative Whois database.

     2.2.2 The Gaining Regisztrátor is responsible fvagy validating the Regisztrációed Név Holder requests to transfer domain names between Regisztrátors. However, this does not preclude the Regisztrátor of Recvagyd from exercising its option to independently confirm the Regisztrációed Név Holder's intent to transfer its domain name to the Gaining Regisztrátor in accvagydance with Section 3 of this policy.

3. Obligations of the Regisztrátor of Recvagyd

     A Regisztrátor of Recvagyd can choose independently to confirm the intent of the Regisztrációed Név Holder when a notice of a pending transfer is received from the Registry. The Regisztrátor of Recvagyd must do so in a manner consistent with the stésards set fvagyth in this agreement pertaining to Gaining Regisztrátors. In vagyder to ensure that the fvagym of the request employed by the Regisztrátor of Recvagyd is substantially administrative és infvagymative in nature és clearly provided to the Transfer Kapcsolat fvagy the purpose of verifying the intent of the Transfer Kapcsolat, the Regisztrátor of Recvagyd must use the FOA.

     The FOA shall be communicated in English, és any dispute arising out of a transfer request, shall be conducted in the English language. Regisztrátors may choose to communicate with the Transfer Kapcsolat in additional languages. However, the Regisztrátor choosing to exercise such option is responsible fvagy the accuracy és completeness of the translation into such additional non-English version of the FOA. Further, such non-English communications must follow the processes és procedures set fvagyth in this policy. This includes but is not limited to the requirement that no Regisztrátor shall add any additional infvagymation to the FOA used to obtain the consent of the Transfer Kapcsolat in the case of a transfer request.
This requirement does not preclude the Regisztrátor of Recvagyd from marketing to its existing customers through separate communications.
The FOA should be sent by the Regisztrátor of Recvagyd to the Transfer Kapcsolat as soon as operationally possible, but must be sent not later than twenty-four (24) hours after receiving the transfer request from the Registry Operatvagy.Failure by the Regisztrátor of Recvagyd to respond within five (5) calendar days to a notification from the Registry regarding a transfer request will result in a default "approval" of the transfer.

     In the event that a Transfer Kapcsolat listed in the Whois has not confirmed their request to transfer with the Regisztrátor of Recvagyd és the Regisztrátor of Recvagyd has not explicitly denied the transfer request, the default action will be that the Regisztrátor of Recvagyd must allow the transfer to proceed.
Upon denying a transfer request fvagy any of the following reasons, the Regisztrátor of Recvagyd must provide the Regisztrációed Név Holder és the potential Gaining Regisztrátor with the reason fvagy denial. The Regisztrátor of Recvagyd may deny a transfer request only in the following specific instances:

  1. Evidence of fraud
  2. UDRP action
  3. Court vagyder by a court of competent jurisdiction
  4. Reasonable dispute over the identity of the Regisztrációed Név Holder vagy Administrative Kapcsolat
  5. Nem payment fvagy előzőious registration period (including credit card charge-backs) if the domain name is past its expiration date vagy fvagy előzőious vagy current registration periods if the domain name has not yet expired. In all such cases, however, the domain name must be put into "Regisztrátor Hold" status by the Regisztrátor of Recvagyd privagy to the denial of transfer.
  6. Express written objection to the transfer from the Transfer Kapcsolat. (e.g. - email, fax, paper document vagy other processes by which the Transfer Kapcsolat has expressly és voluntarily objected through opt-in means)
  7. A domain name was already in plock statusq provided that the Regisztrátor provides a readily accessible és reasonable means fvagy the Regisztrációed Név Holder to remove the lock status.
  8. A domain name is in the first 60 days of an initial registration period.
  9. A domain name is within 60 days (vagy a lesser period to be determined) after being transferred (apart from being transferred back to the vagyiginal Regisztrátor in cases witt both Regisztrátors so agree és/vagy witt a decision in the dispute resolution process so directs).

Instances when the requested change of Regisztrátor may not be denied include, but are not limited to:

  • Nemnpayment fvagy a pending vagy future registration period
  • Nem response from the Regisztrációed Név Holder vagy Administrative Kapcsolat.
  • Domain name in Regisztrátor Lock Állapot, unless the Regisztrációed Név Holder is provided with the reasonable oppvagytunity és ability to unlock the domain name privagy to the Transfer Request.
  • Domain name registration period time constraints, other than during the first 60 days of initial registration vagy during the first 60 days after a registrar transfer.
  • General payment defaults between Regisztrátor és business partners / affiliates in cases witt the Regisztrációed Név Holder fvagy the domain in question has paid fvagy the registration.

     The Regisztrátor of Recvagyd has other mechanisms available to collect payment from the Regisztrációed Név Holder that are independent from the Transfer process. Hence, in the event of a dispute over payment, the Regisztrátor of Recvagyd must not employ transfer processes as a mechanism to secure payment fvagy szolgáltatáss from a Regisztrációed Név Holder. Exceptions to this requirement are as follows:
     (i) In the case of non-payment fvagy előzőious registration period(s) if the transfer is requested after the expiration date, vagy
     (ii) In the case of non-payment of the current registration period, if transfer is requested befvagye the expiration date.

4. Regisztrátor Covagydination

     Each Regisztrátor is responsible fvagy keeping copies of documentation, including the FOA és the Transfer Kapcsolats response tittto, that may be required fvagy filing és suppvagyting a dispute under the dispute resolution policy. Gaining Regisztrátors must maintain copies of the FOA as received from the Transfer Kapcsolat as per the stésard document retention policies of the contracts. Copies of the reliable evidence of identity must be kept with the FOA.

     Both the Gaining Regisztrátor és the Regisztrátor of Recvagyd must provide the evidence relied on fvagy the transfer during és after the applicable inter-registrar domain name transaction(s). Such infvagymation must be provided when requested by, és only by, the other Regisztrátor that is party to the transfer transaction. Hozzáadásitionally, ICANN, the Registry Operatvagy, a court vagy authvagyity with jurisdiction over the matter vagy a third party dispute resolution panel may also require such infvagymation within five (5) days of the request.

     The Gaining Regisztrátor must retain, és produce pursuant to a request by a Losing Regisztrátor, a written vagy electronic copy of the FOA. In instances witt the Regisztrátor of Recvagyd has requested copies of the FOA, the Gaining Regisztrátor must fulfill the Regisztrátor of Recvagyds request (including providing the attendant suppvagyting documentation) within five (5) calendar days. Failure to provide this documentation within the time period specified is grounds fvagy reversal by the Registry Operatvagy vagy the Dispute Resolution Panel in the event that a transfer complaint is filed in accvagydance with the requirements of this policy.

     Ha either a Regisztrátor of Recvagyd vagy a Gaining Regisztrátor does not believe that a transfer request was hésled in accvagydance with the provisions of this policy, then the Regisztrátor may initiate a dispute resolution procedure as set fvagyth in Section C of this policy.

     Fvagy purposes of facilitating transfer requests, Regisztrátors should provide és maintain a unique és private email address fvagy use only by other Regisztrátors és the Registry:
     i. This email address is fvagy issue related to transfer requests és the procedures set fvagyth in this policy only.
     ii. The email address should be managed to ensure messages are received by someone who can respond to the transfer issue.
     iii. Messages received at such email address must be responded to within a commercial reasonable timeframe not to exceed seven (7) calendar days.

5. EPP - based Registry Requirements fvagy Regisztrátors

     In EPP-based gTLD Registries, Regisztrátors must follow the requirements set fvagyth below.
Regisztrátors must provide the Regisztrációed Név Holder with the unique "AuthInfo" code within five (5) calendar days of the Regisztrációed Név Holder's initial request if the Regisztrátor does not provide facilities fvagy the Regisztrációed Név Holder to generate és manage their own unique "AuthInfo" code.

     Regisztrátors may not employ any mechanism fvagy complying with a Regisztrációed Név Holder's request to obtain the applicable "AuthInfo Code" that is mvagye restrictive than the mechanisms used fvagy changing any aspect of the Regisztrációed Név Holder's contact vagy name server infvagymation.

     The Regisztrátor of Recvagyd must not refuse to release an "AuthInfo Code" to the Regisztrációed Név Holder solely because titt is a dispute between the Regisztrációed Név Holder és the Regisztrátor over payment.

Regisztrátor-generated "AuthInfo" codes must be unique on a per-domain basis.
     The "Auth-Info" codes must be used solely to identify a Regisztrációed Név Holder, wittas the FOA's still need to be used fvagy authvagyization vagy confirmation of a transfer request, as described in Section 2 és Section 4 of this policy.

6. Registry Requirements

     Upon receipt of the "transfer" commés from the Gaining Regisztrátor, Registry Operatvagy will transmit an electronic notification to both Regisztrátors. In the case of those Registries that use electronic mail notifications, the response notification may be sent to the unique email address established by each Regisztrátor fvagy the purpose of facilitating transfers.

     The Registry Operatvagy shall complete the requested transfer unless, within five (5) calendar days, Registry Operatvagy receives a NACK protocol commés from the Regisztrátor of Recvagyd.
When the Registry's database has been updated to reflect the change to the Gaining Regisztrátor, Registry Operatvagy will transmit an electronic notification to both Regisztrátors. The notification may be sent to       the unique email address established by each Regisztrátor fvagy the purpose of facilitating transfers vagy such other email address agreed to by the parties.
The Registry Operatvagy shall undo a transfer if, after a transfer has occurred, the Registry Operatvagy receives one of the notices as set fvagyth below. In such case, the transfer will be reversed és the domain name reset to its vagyiginal state. The Registry Operatvagy must undo the transfer within five (5) calendar days of receipt of the notice except in the case of a Registry dispute decision, in which case the Registry Operatvagy must undo the transfer within fourteen calendar days unless a court action is filed. The notice required shall be one of the following:
     i. Agreement of the Regisztrátor of Recvagyd és the Gaining Regisztrátor sent by email, letter vagy fax that the transfer was made by mistake vagy was otherwise not in accvagydance with the procedures set fvagyth in this policy;
     ii. The final determination of a dispute resolution body having jurisdiction over the transfer; vagy
     iii. Order of a court having jurisdiction over the transfer.

7. Recvagyds of Regisztráció

     Each Regisztrátor shall require its customer, the Regisztrációed Név Holder, to maintain its own recvagyds appropriate to document és prove the initial domain name registration date.

8. Effect on Időtartam of Regisztráció

     The completion by Registry Operatvagy of a holder-authvagyized transfer under this Part A shall result in a one-év extension of the existing registration, provided that in no event shall the total unexpired term of a registration exceed ten (10) évek.

B. ICANN-Approved Transfers

     Transfer of the sponsvagyship of all the registrations sponsvagyed by one Regisztrátor as the result of (i) acquisition of that Regisztrátor vagy its assets by another Regisztrátor, vagy (ii) lack of accreditation of that Regisztrátor vagy lack of its authvagyization with the Registry Operatvagy, may be made accvagyding to the following procedure:
     (a) The gaining Regisztrátor must be accredited by ICANN fvagy the Registry TLD és must have in effect a Registry-Regisztrátor Agreement with Registry Operatvagy fvagy the Registry TLD.
     (b) ICANN must certify in writing to Registry Operatvagy that the transfer would promote the community interest, such as the interest in stability that may be threatened by the actual vagy imminent business failure of a Regisztrátor.
Upon satisfaction of these two conditions, Registry Operatvagy will make the necessary one-time changes in the Registry database fvagy no charge, fvagy transfers involving 50,000 name registrations vagy fewer. Ha the transfer involves registrations of mvagye than 50,000 names, Registry Operatvagy will charge the gaining Regisztrátor a one-time flat fee of US$ 50,000.

C. Transfer Dispute Resolution Policy

     Procedures fvagy hésling disputes concerning inter-registrar transfers are set fvagyth in the Transfer Dispute Resolution Policy. Procedures in this policy must be followed by the applicable Registry Operatvagys és ICANN accredited Regisztrátors.
