A. Holder-Authঅথবাized Transfers

1. রেজিস্ট্রার Requirements

     নিবন্ধন করুনed নাম Holders must be able to transfer their ডোমেইন name registrations between রেজিস্ট্রারs provided that the Gaining রেজিস্ট্রার's transfer process meets the minimum stএবংards of this policy এবং that such transfer is not prohiবিটed by ICANN অথবা Registry policies. Inter-রেজিস্ট্রার ডোমেইন name transfer processes must be clear এবং concise in অথবাder to avoid confusion. Further, রেজিস্ট্রারs should make reasonable effঅথবাts to infঅথবাm নিবন্ধন করুনed নাম Holders of, এবং provide access to, the published documentation of the specific transfer process employed by the রেজিস্ট্রারs.

1.1 Transfer Authঅথবাities

     The Administrative যোগাযোগ এবং the নিবন্ধন করুনed নাম Holder, as listed in the Losing রেজিস্ট্রার's অথবা applicable Registry's (wএখানে available) publicly accessible WHOIS সেবা are the only parties that have the authঅথবাity to approve অথবা deny a transfer request to the Gaining রেজিস্ট্রার. In the event of a dispute, the নিবন্ধন করুনed নাম Holder's authঅথবাity supersedes that of the Administrative যোগাযোগ.
রেজিস্ট্রারs may use Whois data from either the রেজিস্ট্রার of Recঅথবাd অথবা the relevant Registry fঅথবা the purpose of verifying the authenticity of a transfer request; অথবা from another data source as determined by a consensus policy.

2. Gaining রেজিস্ট্রার Requirements

Fঅথবা each instance wএখানে a নিবন্ধন করুনed নাম Holder requests to transfer a ডোমেইন name registration to a different রেজিস্ট্রার, the Gaining রেজিস্ট্রার shall:
      2.1 Obtain express authঅথবাization from either the নিবন্ধন করুনed নাম Holder অথবা the Administrative যোগাযোগ (এখানেafter, "Transfer যোগাযোগ"). Hence, a transfer may only proceed if confirmation of the transfer is received by the Gaining রেজিস্ট্রার from the Transfer যোগাযোগ.

     2.1.1 The authঅথবাization must be made via a valid Stএবংardized Fঅথবাm of Authঅথবাization (FOA). Tএখানে are two different FOA's available at the ICANN website. The FOA labeled "Initial Authঅথবাization fঅথবা রেজিস্ট্রার Transfer" must be used by the Gaining রেজিস্ট্রার to request an authঅথবাization fঅথবা a registrar transfer from the Transfer যোগাযোগ. The FOA labeled "নিশ্চিত করুনation of রেজিস্ট্রার Transfer Request" may be used by the রেজিস্ট্রার of Recঅথবাd to request confirmation of the transfer from the Transfer যোগাযোগ.
The FOA shall be communicated in English, এবং any dispute arising out of a transfer request shall be conducted in the English language. রেজিস্ট্রারs may choose to communicate with the Transfer যোগাযোগ in additional languages. However, রেজিস্ট্রারs choosing to exercise such option are responsible fঅথবা the accuracy এবং completeness of the translation into such additional non-English version of the FOA.

     2.1.2 In the event that the Gaining রেজিস্ট্রার relies on a physical process to obtain this authঅথবাization, a paper copy of the FOA will suffice insofar as it has been signed by the Transfer যোগাযোগ এবং further that it is accompanied by a physical copy of the রেজিস্ট্রার of Recঅথবাd's Whois output fঅথবা the ডোমেইন name in question.

     2.1.2.1 যদি the Gaining রেজিস্ট্রার relies on a physical authঅথবাization process, then the Gaining রেজিস্ট্রার assumes the burden of obtaining reliable evidence of the identity of the Transfer যোগাযোগ এবং maintaining appropriate recঅথবাds proving that such evidence was obtained. Further the Gaining রেজিস্ট্রার also assumes the burden fঅথবা ensuring that the entity making the request is indeed authঅথবাized to do so. The acceptable fঅথবাms of physical identity are:

• নাtarized statement
• Valid Drivers license
• পাসপোর্ট
• Article of Incঅথবাpঅথবাation
• Military ID
• State/Government issued ID
• Birth Certificate

     2.1.3 In the event that the Gaining রেজিস্ট্রার relies on an electronic process to obtain this authঅথবাization the acceptable fঅথবাms of identity would include:

• Electronic signature in confঅথবাmance with national legislation, in the location of the Gaining রেজিস্ট্রার (if such legislation exists).
• Consent from an individual অথবা entity that has an email address matching the Transfer যোগাযোগ email address. 

     The রেজিস্ট্রার of Recঅথবাd may not deny a transfer request solely because it believes that the Gaining রেজিস্ট্রার has not received the confirmation set fঅথবাth above.
A transfer must not be allowed to proceed if no confirmation is received by the Gaining রেজিস্ট্রার. The presumption in all cases will be that the Gaining রেজিস্ট্রার has received এবং authenticated the transfer request made by a Transfer যোগাযোগ.

     2.2 Request, by the transmission of a "transfer" commএবং as specified in the রেজিস্ট্রার করতেol Kit, that the Registry Operatঅথবা database be changed to reflect the new রেজিস্ট্রার.

     2.2.1 Transmission of a "transfer" commএবং constitutes a representation on the part of the Gaining রেজিস্ট্রার that the requisite authঅথবাization has been obtained from the Transfer যোগাযোগ listed in the authঅথবাitative Whois database.

     2.2.2 The Gaining রেজিস্ট্রার is responsible fঅথবা validating the নিবন্ধন করুনed নাম Holder requests to transfer ডোমেইন names between রেজিস্ট্রারs. However, this does not preclude the রেজিস্ট্রার of Recঅথবাd from exercising its option to independently confirm the নিবন্ধন করুনed নাম Holder's intent to transfer its ডোমেইন name to the Gaining রেজিস্ট্রার in accঅথবাdance with Section 3 of this policy.

3. Obligations of the রেজিস্ট্রার of Recঅথবাd

     A রেজিস্ট্রার of Recঅথবাd can choose independently to confirm the intent of the নিবন্ধন করুনed নাম Holder when a notice of a pending transfer is received from the Registry. The রেজিস্ট্রার of Recঅথবাd must do so in a manner consistent with the stএবংards set fঅথবাth in this agreement pertaining to Gaining রেজিস্ট্রারs. In অথবাder to ensure that the fঅথবাm of the request employed by the রেজিস্ট্রার of Recঅথবাd is substantially administrative এবং infঅথবাmative in nature এবং clearly provided to the Transfer যোগাযোগ fঅথবা the purpose of verifying the intent of the Transfer যোগাযোগ, the রেজিস্ট্রার of Recঅথবাd must use the FOA.

     The FOA shall be communicated in English, এবং any dispute arising out of a transfer request, shall be conducted in the English language. রেজিস্ট্রারs may choose to communicate with the Transfer যোগাযোগ in additional languages. However, the রেজিস্ট্রার choosing to exercise such option is responsible fঅথবা the accuracy এবং completeness of the translation into such additional non-English version of the FOA. Further, such non-English communications must follow the processes এবং procedures set fঅথবাth in this policy. This includes but is not limited to the requirement that no রেজিস্ট্রার shall add any additional infঅথবাmation to the FOA used to obtain the consent of the Transfer যোগাযোগ in the case of a transfer request.
This requirement does not preclude the রেজিস্ট্রার of Recঅথবাd from marketing to its existing customers through separate communications.
The FOA should be sent by the রেজিস্ট্রার of Recঅথবাd to the Transfer যোগাযোগ as soon as operationally possible, but must be sent not later than twenty-four (24) hours after receiving the transfer request from the Registry Operatঅথবা.Failure by the রেজিস্ট্রার of Recঅথবাd to respond within five (5) calendar days to a notification from the Registry regarding a transfer request will result in a default "approval" of the transfer.

     In the event that a Transfer যোগাযোগ listed in the Whois has not confirmed their request to transfer with the রেজিস্ট্রার of Recঅথবাd এবং the রেজিস্ট্রার of Recঅথবাd has not explicitly denied the transfer request, the default action will be that the রেজিস্ট্রার of Recঅথবাd must allow the transfer to proceed.
Upon denying a transfer request fঅথবা any of the following reasons, the রেজিস্ট্রার of Recঅথবাd must provide the নিবন্ধন করুনed নাম Holder এবং the potential Gaining রেজিস্ট্রার with the reason fঅথবা denial. The রেজিস্ট্রার of Recঅথবাd may deny a transfer request only in the following specific instances:

1. Evidence of fraud
2. UDRP action
3. Court অথবাder by a court of competent jurisdiction
4. Reasonable dispute over the identity of the নিবন্ধন করুনed নাম Holder অথবা Administrative যোগাযোগ
5. না payment fঅথবা আগেরious registration period (including credit card charge-backs) if the ডোমেইন name is past its expiration date অথবা fঅথবা আগেরious অথবা current registration periods if the ডোমেইন name has not yet expired. In all such cases, however, the ডোমেইন name must be put into "রেজিস্ট্রার Hold" status by the রেজিস্ট্রার of Recঅথবাd priঅথবা to the denial of transfer.
6. Express written objection to the transfer from the Transfer যোগাযোগ. (e.g. - email, fax, paper document অথবা other processes by which the Transfer যোগাযোগ has expressly এবং voluntarily objected through opt-in means)
7. A ডোমেইন name was already in plock statusq provided that the রেজিস্ট্রার provides a readily accessible এবং reasonable means fঅথবা the নিবন্ধন করুনed নাম Holder to remove the lock status.
8. A ডোমেইন name is in the first 60 days of an initial registration period.
9. A ডোমেইন name is within 60 days (অথবা a lesser period to be determined) after being transferred (apart from being transferred back to the অথবাiginal রেজিস্ট্রার in cases wএখানে both রেজিস্ট্রারs so agree এবং/অথবা wএখানে a decision in the dispute resolution process so directs).

Instances when the requested change of রেজিস্ট্রার may not be denied include, but are not limited to:

• নাnpayment fঅথবা a pending অথবা future registration period
• না response from the নিবন্ধন করুনed নাম Holder অথবা Administrative যোগাযোগ.
• ডোমেইন name in রেজিস্ট্রার Lock স্ট্যাটাস, unless the নিবন্ধন করুনed নাম Holder is provided with the reasonable oppঅথবাtunity এবং ability to unlock the ডোমেইন name priঅথবা to the Transfer Request.
• ডোমেইন name registration period time constraints, other than during the first 60 days of initial registration অথবা during the first 60 days after a registrar transfer.
• General payment defaults between রেজিস্ট্রার এবং business partners / affiliates in cases wএখানে the নিবন্ধন করুনed নাম Holder fঅথবা the ডোমেইন in question has paid fঅথবা the registration.

     The রেজিস্ট্রার of Recঅথবাd has other mechanisms available to collect payment from the নিবন্ধন করুনed নাম Holder that are independent from the Transfer process. Hence, in the event of a dispute over payment, the রেজিস্ট্রার of Recঅথবাd must not employ transfer processes as a mechanism to secure payment fঅথবা সেবাs from a নিবন্ধন করুনed নাম Holder. Exceptions to this requirement are as follows:
     (i) In the case of non-payment fঅথবা আগেরious registration period(s) if the transfer is requested after the expiration date, অথবা
     (ii) In the case of non-payment of the current registration period, if transfer is requested befঅথবাe the expiration date.

4. রেজিস্ট্রার Coঅথবাdination

     Each রেজিস্ট্রার is responsible fঅথবা keeping copies of documentation, including the FOA এবং the Transfer যোগাযোগs response tএখানেto, that may be required fঅথবা filing এবং suppঅথবাting a dispute under the dispute resolution policy. Gaining রেজিস্ট্রারs must maintain copies of the FOA as received from the Transfer যোগাযোগ as per the stএবংard document retention policies of the contracts. Copies of the reliable evidence of identity must be kept with the FOA.

     Both the Gaining রেজিস্ট্রার এবং the রেজিস্ট্রার of Recঅথবাd must provide the evidence relied on fঅথবা the transfer during এবং after the applicable inter-registrar ডোমেইন name transaction(s). Such infঅথবাmation must be provided when requested by, এবং only by, the other রেজিস্ট্রার that is party to the transfer transaction. যোগ করুনitionally, ICANN, the Registry Operatঅথবা, a court অথবা authঅথবাity with jurisdiction over the matter অথবা a third party dispute resolution panel may also require such infঅথবাmation within five (5) days of the request.

     The Gaining রেজিস্ট্রার must retain, এবং produce pursuant to a request by a Losing রেজিস্ট্রার, a written অথবা electronic copy of the FOA. In instances wএখানে the রেজিস্ট্রার of Recঅথবাd has requested copies of the FOA, the Gaining রেজিস্ট্রার must fulfill the রেজিস্ট্রার of Recঅথবাds request (including providing the attendant suppঅথবাting documentation) within five (5) calendar days. Failure to provide this documentation within the time period specified is grounds fঅথবা reversal by the Registry Operatঅথবা অথবা the Dispute Resolution Panel in the event that a transfer complaint is filed in accঅথবাdance with the requirements of this policy.

     যদি either a রেজিস্ট্রার of Recঅথবাd অথবা a Gaining রেজিস্ট্রার does not believe that a transfer request was hএবংled in accঅথবাdance with the provisions of this policy, then the রেজিস্ট্রার may initiate a dispute resolution procedure as set fঅথবাth in Section C of this policy.

     Fঅথবা purposes of facilitating transfer requests, রেজিস্ট্রারs should provide এবং maintain a unique এবং private email address fঅথবা use only by other রেজিস্ট্রারs এবং the Registry:
     i. This email address is fঅথবা issue related to transfer requests এবং the procedures set fঅথবাth in this policy only.
     ii. The email address should be managed to ensure messages are received by someone who can respond to the transfer issue.
     iii. Messages received at such email address must be responded to within a commercial reasonable timeframe not to exceed seven (7) calendar days.

5. EPP - based Registry Requirements fঅথবা রেজিস্ট্রারs

     In EPP-based gTLD Registries, রেজিস্ট্রারs must follow the requirements set fঅথবাth below.
রেজিস্ট্রারs must provide the নিবন্ধন করুনed নাম Holder with the unique "AuthInfo" code within five (5) calendar days of the নিবন্ধন করুনed নাম Holder's initial request if the রেজিস্ট্রার does not provide facilities fঅথবা the নিবন্ধন করুনed নাম Holder to generate এবং manage their own unique "AuthInfo" code.

     রেজিস্ট্রারs may not employ any mechanism fঅথবা complying with a নিবন্ধন করুনed নাম Holder's request to obtain the applicable "AuthInfo Code" that is mঅথবাe restrictive than the mechanisms used fঅথবা changing any aspect of the নিবন্ধন করুনed নাম Holder's contact অথবা name server infঅথবাmation.

     The রেজিস্ট্রার of Recঅথবাd must not refuse to release an "AuthInfo Code" to the নিবন্ধন করুনed নাম Holder solely because tএখানে is a dispute between the নিবন্ধন করুনed নাম Holder এবং the রেজিস্ট্রার over payment.

রেজিস্ট্রার-generated "AuthInfo" codes must be unique on a per-ডোমেইন basis.
     The "Auth-Info" codes must be used solely to identify a নিবন্ধন করুনed নাম Holder, wএখানেas the FOA's still need to be used fঅথবা authঅথবাization অথবা confirmation of a transfer request, as described in Section 2 এবং Section 4 of this policy.

6. Registry Requirements

     Upon receipt of the "transfer" commএবং from the Gaining রেজিস্ট্রার, Registry Operatঅথবা will transmit an electronic notification to both রেজিস্ট্রারs. In the case of those Registries that use electronic mail notifications, the response notification may be sent to the unique email address established by each রেজিস্ট্রার fঅথবা the purpose of facilitating transfers.

     The Registry Operatঅথবা shall complete the requested transfer unless, within five (5) calendar days, Registry Operatঅথবা receives a NACK protocol commএবং from the রেজিস্ট্রার of Recঅথবাd.
When the Registry's database has been updated to reflect the change to the Gaining রেজিস্ট্রার, Registry Operatঅথবা will transmit an electronic notification to both রেজিস্ট্রারs. The notification may be sent to       the unique email address established by each রেজিস্ট্রার fঅথবা the purpose of facilitating transfers অথবা such other email address agreed to by the parties.
The Registry Operatঅথবা shall undo a transfer if, after a transfer has occurred, the Registry Operatঅথবা receives one of the notices as set fঅথবাth below. In such case, the transfer will be reversed এবং the ডোমেইন name reset to its অথবাiginal state. The Registry Operatঅথবা must undo the transfer within five (5) calendar days of receipt of the notice except in the case of a Registry dispute decision, in which case the Registry Operatঅথবা must undo the transfer within fourteen calendar days unless a court action is filed. The notice required shall be one of the following:
     i. Agreement of the রেজিস্ট্রার of Recঅথবাd এবং the Gaining রেজিস্ট্রার sent by email, letter অথবা fax that the transfer was made by mistake অথবা was otherwise not in accঅথবাdance with the procedures set fঅথবাth in this policy;
     ii. The final determination of a dispute resolution body having jurisdiction over the transfer; অথবা
     iii. Order of a court having jurisdiction over the transfer.

7. Recঅথবাds of নিবন্ধন

     Each রেজিস্ট্রার shall require its customer, the নিবন্ধন করুনed নাম Holder, to maintain its own recঅথবাds appropriate to document এবং prove the initial ডোমেইন name registration date.

8. Effect on মেয়াদ of নিবন্ধন

     The completion by Registry Operatঅথবা of a holder-authঅথবাized transfer under this Part A shall result in a one-বছর extension of the existing registration, provided that in no event shall the total unexpired term of a registration exceed ten (10) বছর.

B. ICANN-Approved Transfers

     Transfer of the sponsঅথবাship of all the registrations sponsঅথবাed by one রেজিস্ট্রার as the result of (i) acquisition of that রেজিস্ট্রার অথবা its assets by another রেজিস্ট্রার, অথবা (ii) lack of accreditation of that রেজিস্ট্রার অথবা lack of its authঅথবাization with the Registry Operatঅথবা, may be made accঅথবাding to the following procedure:
     (a) The gaining রেজিস্ট্রার must be accredited by ICANN fঅথবা the Registry TLD এবং must have in effect a Registry-রেজিস্ট্রার Agreement with Registry Operatঅথবা fঅথবা the Registry TLD.
     (b) ICANN must certify in writing to Registry Operatঅথবা that the transfer would promote the community interest, such as the interest in stability that may be threatened by the actual অথবা imminent business failure of a রেজিস্ট্রার.
Upon satisfaction of these two conditions, Registry Operatঅথবা will make the necessary one-time changes in the Registry database fঅথবা no charge, fঅথবা transfers involving 50,000 name registrations অথবা fewer. যদি the transfer involves registrations of mঅথবাe than 50,000 names, Registry Operatঅথবা will charge the gaining রেজিস্ট্রার a one-time flat fee of US$ 50,000.

C. Transfer Dispute Resolution Policy

     Procedures fঅথবা hএবংling disputes concerning inter-registrar transfers are set fঅথবাth in the Transfer Dispute Resolution Policy. Procedures in this policy must be followed by the applicable Registry Operatঅথবাs এবং ICANN accredited রেজিস্ট্রারs.
