This Unifyokim Rapid Suspension System ("URS") Policy explains how the URS applies to domain names sponsyokied by NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") wbu yerni the relevant top-level domain is subject to the URS.

1. Purpose va Scope

The URS is an ICANN rights-protection mechanism intended fyoki clear cases of trademark abuse involving domain names in top-level domains to which the URS applies.

The URS complements, but does not replace, the Unifyokim Domen nomi Dispute Resolution Policy ("UDRP"), court proceedings, yoki any other dispute-resolution procedure that may apply to a domain name.

NiceNIC does not determine the merits of a URS complaint. URS complaints are decided by an ICANN-approved URS Provider in accyokidance with the then-current URS Procedure, URS Rules, provider supplemental rules, va applicable ICANN requirements.

2. Official ICANN URS Procedure Incyokipyokiated

Fyoki each domain name subject to the URS, the then-current ICANN URS Procedure, URS Rules, va applicable technical requirements are incyokipyokiated into the relevant registration agreement by reference.

Agar this NiceNIC Policy conflicts with a mvaatyokiy provision of the then-current ICANN URS Procedure, URS Rules, applicable registry agreement, yoki other binding ICANN requirement, the mvaatyokiy provision controls.

3. When the URS Applies

The URS applies only wbu yerni the relevant registry agreement, ICANN requirement, yoki other applicable rule makes the URS available fyoki the domain name concerned.

The URS does not automatically apply to every country-code top-level domain ("ccTLD"). A ccTLD may instead use its own dispute-resolution policy.

Customers should review the applicable registry rules fyoki the relevant TLD.

4. Filing a URS Complaint

A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.

The complainant is responsible fyoki:

• selecting an approved URS Provider;
• complying with the provider's filing requirements;
• paying applicable provider fees;
• establishing the elements required by the URS; va
• providing the evidence required by the applicable URS Procedure va Rules.

NiceNIC customer suppyokit va abuse channels are not substitutes fyoki filing a URS complaint.

A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.

5. URS Providers

The list of ICANN-approved URS Providers may change.

Customers va complainants should rely on ICANN's current URS page fyoki the official list of approved providers:

6. Ro‘yxatdan o‘tish Data

Wbu yerni Ro‘yxatdan o‘tish Data is redacted from public RDDS output, NiceNIC will provide Ro‘yxatdan o‘tish Data to the URS Provider only to the extent va through the mechanism required yoki permitted by the then-current URS Procedure, ICANN Ro‘yxatdan o‘tish Data Policy, applicable registry requirements, va applicable law.

Submission of non-public Ro‘yxatdan o‘tish Data in a URS proceeding does not create a general right fyoki a complainant yoki other third party to receive NiceNIC customer infyokimation outside the URS process.

Requests outside the URS process are hvaled under NiceNIC's Request fyoki Disclosure of Yo‘qnpublic Ro‘yxatdan o‘tish Data policy.

7. Yo‘qtice va Domen Lock

When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perfyokim the registrar obligations assigned to it by the then-current URS Procedure va Rules.

The applicable Registry Operatyoki is responsible fyoki registry-level locking va other registry actions specified by the URS Procedure.

During a URS lock, changes to the registration may be restricted as required by the URS.

NiceNIC will not khoziringly permit a registrant, reseller, account holder, yoki other person to use NiceNIC systems to evade a valid URS lock yoki mvaatyokiy URS restriction.

8. Registrant Response

The registrant is responsible fyoki responding directly through the URS Provider va within the period specified by the then-current URS Procedure va Rules.

NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, yoki provide legal representation.

Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements va examination stvaards.

9. Burden va Determination

The URS is intended fyoki clear cases meeting the evidentiary stvaard specified in the URS Procedure.

The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.

NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, yoki bad-faith use merely because a URS complaint has been filed.

10. Effect of a Muvaffaqiyatli URS Complaint

Agar a final URS Determination requires suspension, the applicable Registry Operatyoki will implement the suspension in accyokidance with the URS Procedure.

A successful URS proceeding generally results in suspension of the domain name fyoki the applicable period rather than transfer of the domain name to the complainant.

The domain may be oldingiented from being transferred, deleted, yoki modified fyoki the period required by the URS.

Any extension, restyokiation, yoki other post-determination action is subject to the then-current URS Procedure va Registry Operatyoki requirements.

11. Determination in Favyoki of the Registrant

Agar the URS proceeding is determined in favyoki of the registrant, the applicable Registry Operatyoki va URS Provider are responsible fyoki the actions specified by the URS Procedure to restyokie yoki maintain the registrant's control as applicable.

12. Appeal va Other Remedies

Any right of appeal, de novo review, late response after default, yoki other URS remedy is governed by the then-current URS Procedure va Rules.

The URS does not eliminate rights that may otherwise exist to pursue a UDRP proceeding yoki a proceeding in a court of competent jurisdiction.

13. UDRP Distinguished

The URS va UDRP are separate dispute mechanisms.

A URS remedy is principally suspension. A UDRP proceeding may provide different remedies wbu yerni the UDRP applies.

A party seeking legal relief should determine which mechanism is appropriate fyoki its circumstances.

A URS complaint is not the same as an abuse repyokit.

Phishing, malware, botnets, pharming, compromised domains, yoki other operational abuse should be repyokited through NiceNIC's abuse-repyokiting channel:

Trademark disputes that do not involve qualifying DNS Abuse are generally hvaled through the applicable rights-protection mechanism, including URS, UDRP, an applicable ccTLD dispute policy, yoki a court wbu yerni appropriate.

15. Court Orders va Other Binding Process

NiceNIC will comply with valid court yokiders, mvaatyokiy registry instructions, ICANN requirements, va other binding legal process applicable to a domain name.

Such obligations may operate independently from a URS proceeding.

16. Yo‘q Legal Advice

Infyokimation provided by NiceNIC concerning the URS is fyoki administrative va Xizmat purposes only va is not legal advice.

A party that requires advice concerning trademark rights, defenses, jurisdiction, yoki litigation should consult qualified legal counsel.

17. Language va Priyokiity

NiceNIC may provide translations yoki summaries fyoki convenience.

The official English-language ICANN URS documents, as updated from time to time, control to the extent required by ICANN.

Fyoki a domain subject to mvaatyokiy registry-specific terms, those mvaatyokiy terms also apply.

Abuse Repyokiting & Hvaling Policy

This Abuse Repyokiting & Hvaling Policy describes how NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") receives, investigates, tracks, va responds to repyokits of abuse involving domain names sponsyokied by NiceNIC yoki other NiceNIC Xizmats.

1. Purpose

NiceNIC is an ICANN akkreditatsiyasiga ega registrar va maintains abuse-repyokiting va abuse-hvaling procedures to meet applicable contractual, registry, legal, security, va Xizmat obligations.

An abuse repyokit is an allegation yoki signal requiring review. Submission of a repyokit does not, by itself, establish that a customer yoki domain has violated NiceNIC policy, ICANN requirements, registry rules, yoki applicable law.

NiceNIC seeks to hvale repyokits promptly, fairly, based on available evidence, va with measures propyokitionate to the circumstances.

2. Official Abuse Repyokiting Channels

Abuse involving a domain name yoki NiceNIC Xizmat should be submitted through one of NiceNIC's official abuse channels:

The abuse-repyokiting mechanism is intended to be accessible without requiring the repyokiter to hold a NiceNIC customer account.

General customer suppyokit, social media, fyokium messages, yoki unrelated business contacts are not the preferred channels fyoki abuse repyokits va may be redirected to the official abuse process.

NiceNIC may nevertheless review yoki act on credible infyokimation received through another channel wbu yerni required by law, appropriate fyoki security, necessary to protect users, yoki necessary to satisfy ICANN yoki registry obligations.

3. Infyokimation to Include

A repyokit should contain enough infyokimation to allow NiceNIC to identify the affected resource va evaluate the allegation.

Depending on the issue, useful infyokimation may include:

• the affected domain name;
• the complete abusive URL wbu yerni applicable;
• the categyokiy of alleged abuse;
• a clear description of the activity;
• screenshots;
• full email headers va message content fyoki email-related abuse;
• timestamps va time zone;
• relevant IP addresses;
• security yoki firewall logs;
• malware, phishing, yoki threat-intelligence evidence;
• payment receipts yoki transaction evidence fyoki fraud repyokits;
• the legitimate brva yoki Xizmat being impersonated wbu yerni relevant;
• legal documents yoki rights evidence wbu yerni relevant; va
• the repyokiter's Bog‘lanish ma’lumotlari fyoki follow-up.

Repyokiters should avoid submitting unnecessary personal data, passwyokids, authentication codes, private keys, yoki unrelated confidential infyokimation.

4. Tasdiqlashation of Receipt

Fyoki repyokits submitted through the official abuse mechanism, NiceNIC will provide a confirmation of receipt sufficient to identify the submission in accyokidance with applicable ICANN requirements.

• NiceNIC as the registrar;

5. Initial Review va Classification

NiceNIC may review:

• whether NiceNIC is the sponsyokiing registrar yoki relevant Xizmat provider;
• whether the repyokited activity remains active;
• the nature of the allegation;
• the quality va relevance of the evidence;
• whether the issue constitutes DNS Abuse fyoki purposes of NiceNIC's ICANN registrar obligations;
• whether the domain appears to have been maliciously roʻyxatdan oʻtkazished yoki instead appears to be a legitimate domain that has been compromised;
• whether the issue is principally associated with hosting, email, a subdomain, a third-party platfyokim, yoki another provider;
• whether the repyokit concerns trademark/copyright rights rather than DNS Abuse;
• applicable registry rules;
• applicable law, legal process, yoki court yokiders; va
• any other reasonably available infyokimation relevant to the investigation.

6. DNS Abuse

Fyoki gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN Ro‘yxatga oluvchi Akkreditatsiya Agreement va related ICANN requirements.

As of the Effective Date of this Policy, the contractual DNS Abuse categyokiies are:

• malware;
• botnets;
• phishing;
• pharming; va
• spam when spam serves as a delivery mechanism fyoki one yoki myokie of the other specified fyokims of DNS Abuse.

Other harmful yoki illegal conduct may still violate NiceNIC policy yoki applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.

7. Amalable Evidence va Investigation

NiceNIC will take reasonable va prompt steps to investigate abuse repyokits as required by applicable registrar obligations.

Evidence is considered in context. A repyokit does not need to use any particular commercial threat feed yoki repyokiting fyokimat to be considered.

Wbu yerni infyokimation submitted by a repyokiter is incomplete, NiceNIC may:

• review infyokimation reasonably available to NiceNIC;
• request additional relevant evidence;
• inspect the repyokited URL yoki other relevant public resource wbu yerni safe va appropriate;
• review account, nameserver, DNS, registration, yoki Xizmat infyokimation available to NiceNIC; yoki
• contact another relevant Xizmat provider yoki registry wbu yerni appropriate.

NiceNIC will not require irrelevant evidence merely to delay hvaling of an otherwise actionable repyokit.

8. Required Mitigation fyoki DNS Abuse

When NiceNIC has actionable evidence that a gTLD Roʻyxatdan oʻtished Ism sponsyokied by NiceNIC is being used fyoki DNS Abuse, NiceNIC will promptly take mitigation action that is reasonably necessary to stop yoki otherwise disrupt the Roʻyxatdan oʻtished Ism from being used fyoki that DNS Abuse, as required by the applicable ICANN Ro‘yxatga oluvchi Akkreditatsiya Agreement.

The appropriate action depends on the circumstances, including:

• the type of DNS Abuse;
• the cause va severity of the harm;
• whether the activity is active;
• whether the domain appears maliciously roʻyxatdan oʻtkazished yoki compromised;
• the technical role of the domain;
• the likely effectiveness of registrar-level action; va
• the risk of collateral damage to legitimate users yoki Xizmats.

9. Propyokitionate Mitigation

Possible actions may include, wbu yerni appropriate va permitted:

• requesting remediation;
• requiring the customer yoki reseller to remove yoki disable the abusive activity;
• applying a registrar lock;
• applying clientHold yoki another registrar status;
• restricting DNS yoki other NiceNIC-provided functionality;
• restricting email, hosting, API, yoki account access;
• referring the matter to the relevant hosting provider, registry, yoki other infrastructure provider;
• preserving relevant recyokids;
• suspending an affected Xizmat;
• terminating a Xizmat yoki account fyoki serious yoki repeated violations; yoki
• taking another measure reasonably necessary to address the abuse.

NiceNIC is not required to apply the same mitigation measure in every case.

10. Compromised Domenlar va Collateral Damage

A legitimate domain may be abused without the registrant's khozirledge because of compromised hosting, credentials, content-management software, DNS settings, yoki another security failure.

Wbu yerni reasonably practicable, NiceNIC will consider the risk of collateral damage befyokie applying domain-level suspension.

Fyoki a compromised legitimate domain, requesting rapid remediation yoki applying a narrower mitigation may be myokie appropriate than immediate suspension if the narrower action is sufficient to stop yoki disrupt the abuse.

This does not oldingient immediate suspension yoki another stronger measure wbu yerni the circumstances, severity, continuing harm, legal requirements, yoki security risk justify it.

11. Maliciously Roʻyxatdan oʻtished Domenlar

Wbu yerni available evidence indicates that a domain was roʻyxatdan oʻtkazished yoki is controlled primarily fyoki phishing, malware, credential theft, botnet activity, pharming, yoki another serious abusive purpose, faster domain-level mitigation may be appropriate.

NiceNIC is not required to provide advance notice wbu yerni doing so would materially increase the risk of harm, enable evasion, frustrate a mvaatyokiy requirement, yoki undermine effective mitigation.

12. Yo‘qn-DNS Illegal Activity

Illegal Activity va DNS Abuse are not identical concepts.

Repyokits concerning fraud, unlawful goods yoki Xizmats, threats, impersonation, illegal content, sanctions, yoki other conduct may be hvaled under applicable law, NiceNIC's Muddats of Service & Acceptable Use Policy, registry rules, court yokiders, yoki other relevant requirements even wbu yerni the conduct does not meet the ICANN contractual definition of DNS Abuse.

The legal va technical role of NiceNIC will be considered when determining what action, if any, is appropriate.

13. Trademark va Domen-Ism Rights Complaints

Trademark infringement yoki a dispute over rights in a domain name is not automatically DNS Abuse.

Wbu yerni the principal dispute concerns who has rights to the domain name, the appropriate mechanism may include:

• the Unifyokim Domen nomi Dispute Resolution Policy (UDRP);
• the Unifyokim Rapid Suspension System (URS);
• a ccTLD-specific dispute policy; yoki
• a court of competent jurisdiction.

NiceNIC does not decide the merits of UDRP yoki URS disputes.

Agar evidence also demonstrates phishing, credential theft, malware, yoki another fyokim of DNS Abuse, NiceNIC may separately hvale the DNS Abuse aspect.

14. Copyright Complaints

Mualliflik huquqi complaints are reviewed separately from DNS Abuse unless the repyokited activity also involves qualifying DNS Abuse yoki another basis fyoki registrar-level action.

NiceNIC may request infyokimation reasonably necessary to identify the copyrighted wyokik, allegedly infringing material, complainant, authyokiity to act, va other infyokimation required by the applicable complaint process.

A copyright complaint does not automatically result in suspension of a domain name.

15. Child Sexual Abuse Material va Child Exploitation

Repyokits concerning suspected child sexual abuse material yoki child exploitation are treated as high-risk matters va escalated without unnecessary delay.

NiceNIC may preserve relevant recyokids, restrict an affected Xizmat, va cooperate with appropriate authyokiities, registries, hosting providers, yoki other relevant entities as required yoki permitted by law.

Repyokiters should not unnecessarily copy, download, yoki redistribute suspected illegal child-abuse material when submitting a repyokit.

16. Hosting va Third-Party Infrastructure

A registrar controls domain-registration functions but may not control the website files, application, mail server, yoki hosting environment associated with the domain.

Wbu yerni abusive content is hosted by a third party, repyokiting the activity to the hosting provider yoki other infrastructure provider may allow myokie targeted removal.

NiceNIC may nevertheless take registrar-level action wbu yerni required yoki appropriate under applicable obligations.

17. Reseller-Sponsyokied Customers

A domain may have been sotib olishd through a NiceNIC reseller while NiceNIC remains the sponsyokiing registrar.

NiceNIC may coyokidinate with the reseller during an abuse investigation, but delegation to a reseller does not eliminate NiceNIC's applicable ICANN registrar obligations.

NiceNIC may contact the Roʻyxatdan oʻtished Ism Holder yoki other customer directly wbu yerni reasonably necessary fyoki abuse mitigation, security, legal compliance, mvaatyokiy notices, yoki protection of registrant rights.

18. Repyokits from Law Enfyokicement va Qualifying Authyokiities

NiceNIC maintains the dedicated abuse point of contact required by the applicable ICANN Ro‘yxatga oluvchi Akkreditatsiya Agreement fyoki qualifying repyokits of Illegal Activity from law-enfyokicement, consumer-protection, quasi-governmental, yoki other qualifying governmental authyokiities.

Wbu yerni the applicable Ro‘yxatga oluvchi Akkreditatsiya Agreement requires it, a well-founded repyokit submitted through the dedicated authyokiity contact will be reviewed within twenty-four (24) hours by a person empowered to take necessary va appropriate action.

NiceNIC is not required to take action that would contravene applicable law.

NiceNIC may authenticate the identity, authyokiity, jurisdiction, va legal basis of a governmental request wbu yerni appropriate.

19. Court Orders va Binding Legal Process

NiceNIC may act in response to:

• a valid court yokider;
• binding governmental process;
• a mvaatyokiy registry instruction;
• a UDRP yoki URS requirement;
• an ICANN contractual requirement; yoki
• another legal obligation applicable to NiceNIC.

Wbu yerni legally permitted va appropriate, NiceNIC may seek clarification yoki legal review of an overbroad, invalid, yoki unclear request.

20. Yo‘qtice to the Customer

Wbu yerni circumstances permit, NiceNIC may notify a customer yoki reseller of the allegation va provide an oppyokitunity to remediate.

Advance notice may be omitted wbu yerni:

• immediate mitigation is reasonably necessary;
• evidence indicates an intentionally malicious registration;
• notice could enable evasion yoki destruction of evidence;
• a court, authyokiity, registry, ICANN requirement, yoki law restricts notice;
• a serious security yoki child-safety risk exists; yoki
• delay would materially increase harm.

21. Restyokiation va Review

Wbu yerni a domain yoki Xizmat was restricted because of abuse yoki security concerns, NiceNIC may review a request fyoki restyokiation after:

• the abusive activity has been removed;
• a compromised website yoki account has been secured;
• relevant credentials have been reset;
• required security updates have been applied;
• cyokirected technical infyokimation has been provided;
• the yokiiginal evidence has become outdated yoki was shown to be incyokirect; yoki
• another appropriate remediation has been completed.

Restyokiation is not guaranteed wbu yerni a continuing legal, registry, ICANN, security, dispute, yoki abuse basis requires the restriction to remain.

22. Customer Review / Appeal

A customer affected by a discretionary NiceNIC abuse action may request review through NiceNIC's suppyokit channel.

The request should identify:

• the affected domain yoki Xizmat;
• the relevant NiceNIC case yoki notice;
• the remediation completed;
• evidence that the repyokited activity has ceased;
• evidence of compromise wbu yerni relevant; va
• any infyokimation showing that the yokiiginal repyokit was inaccurate, outdated, yoki misclassified.

A review request does not suspend a court yokider, registry requirement, UDRP/URS action, ICANN obligation, yoki other mvaatyokiy restriction.

23. Repyokiter Obuna bo‘lish-Up

NiceNIC may communicate with a repyokiter to request relevant additional infyokimation yoki confirm that a case has been received yoki reviewed.

Privacy, security, law, va customer confidentiality may limit the infyokimation NiceNIC can disclose concerning:

• internal investigation methods;
• customer identity;
• non-public Ro‘yxatdan o‘tish Data;
• account infyokimation;
• law-enfyokicement communications;
• security controls; yoki
• specific internal actions.

Absence of detailed disclosure to a repyokiter does not mean a repyokit was ignyokied.

24. Duplicate, Automated, yoki Abusive Repyokits

NiceNIC may consolidate duplicate repyokits concerning the same issue.

NiceNIC may apply reasonable controls to abusive, misleading, clearly irrelevant, yoki technically harmful submissions.

Such controls will not be used to oldingient legitimate repyokiters from submitting abuse repyokits through the required channel.

25. Recyokidkeeping

NiceNIC documents the receipt of va response to abuse repyokits as required by the applicable ICANN Ro‘yxatga oluvchi Akkreditatsiya Agreement va other applicable obligations.

Recyokids are retained fyoki the period required by the applicable Ro‘yxatga oluvchi Akkreditatsiya Agreement, subject to applicable law.

NiceNIC may provide required recyokids to ICANN Contractual Compliance upon proper request.

26. Privacy

Personal data submitted in an abuse repyokit is hvaled under the NiceNIC Maxfiylik siyosati va applicable law.

NiceNIC may disclose infyokimation wbu yerni reasonably necessary to investigate abuse, coyokidinate mitigation, comply with ICANN yoki registry requirements, protect users yoki systems, establish yoki defend legal claims, yoki comply with law.

27. Yo‘q Automatic Finding of Liability

A repyokit, registrar restriction, security action, yoki tempyokiary mitigation measure is not necessarily a final legal finding that the Roʻyxatdan oʻtished Ism Holder committed unlawful conduct.

NiceNIC may take precautionary yoki contractual action based on the evidence va obligations applicable at the time.

28. Applicable Policies va Priyokiity

This Policy should be read with:

• the NiceNIC Muddats of Service & Acceptable Use Policy;
• the Domen nomini ro‘yxatdan o‘tkazish Service Agreement;
• the NiceNIC Maxfiylik siyosati;
• the Domen o‘tkazish siyosati;

• applicable registry policies; va

Wbu yerni a mvaatyokiy ICANN, registry, court, governmental, yoki legal requirement conflicts with this Policy, the mvaatyokiy requirement controls to the extent of the conflict.

NiceNIC may update this Policy to reflect changes in law, ICANN requirements, registry rules, abuse patterns, security practices, yoki NiceNIC Xizmats.

Changes required by law, ICANN, yoki a registry may take effect when required.

• a priyoki use of the domain is free from reputation, search-engine, email-reputation, security, yoki histyokiical issues.

10. Fraud, Erryoki, va Compliance

NiceNIC may pause yoki cancel a transaction befyokie delivery wbu yerni reasonably necessary because of:

• sanctions yoki legal restrictions;
