1. Scope اور Purpose

1.1 This Policy explains the general post-expiration process that may apply to ڈومین names managed through NiceNIC, including expiration, renewal, redemption, expired ڈومین auction, pending delete status, اور release of a ڈومین name back to the public registration pool.

1.2 ڈومین lifecycle timing may vary depending on the top-level ڈومین (“TLD”), registry rules, registry operatیا practices, applicable ICANN requirements, اور other governing policies. نہیںt all TLDs follow the same expiration, redemption, auction, یا deletion process.

2. Definitions

2.1 “Expiration Date” means the date on which a ڈومین name registration term ends.

2.2 “Grace Period” means any post-expiration period during which renewal may still be possible at the stاورard renewal fee, subject to the applicable TLD اور registry rules.

2.3 “Redemption Grace Period” یا “RGP” means the post-deletion recovery period, wیہاں available, during which an expired ڈومین name may still be restیاable fیا an additional redemption fee plus the applicable renewal fee.

2.4 “Pending Delete” means the final pre-release stage, wیہاں applicable, during which the ڈومین name can no longer be renewed, restیاed, modified, یا transferred.

2.5 “Eligible ڈومین” means a ڈومین name that is subject to NiceNIC’s expired ڈومین auction process. نہیںt all TLDs یا expired ڈومین names are eligible fیا auction.

3. Effect of Expiration

3.1 Upon expiration, a ڈومین name may stop resolving, اور any website, email سروس, یا other سروس associated with the ڈومین name may cease functioning immediately یا shیاtly tیہاںafter.

3.2 فالو کریںing expiration, NiceNIC may restrict changes to the ڈومین name, including DNS changes, contact updates, transfers, یا other account-level actions, in accیاdance with registry rules, security measures, operational requirements, یا the expired-ڈومین process then in effect.

3.3 Expiration does not mean that the ڈومین name immediately becomes available to the public. Depending on the applicable TLD اور registry rules, the ڈومین name may pass through one یا mیاe stages, including grace period, auction, redemption, pending delete, اور eventual release.

4.4 اگر auto-renewal is enabled, successful renewal remains subject to valid payment, operational processing, اور the applicable registry rules. NiceNIC does not guarantee successful auto-renewal in every case.

5.1 Fیا many generic TLDs, an expired ڈومین name may remain renewable fیا approximately thirty (30) days after the Expiration Date at the stاورard renewal fee. This is a general reference only اور may vary by TLD.

6.2 Fیا Eligible ڈومینز under NiceNIC’s stاورard expired-ڈومین process, the following general timeline may apply:

Day 0 after expiration

The ڈومین name expires. The registrant may generally renew the ڈومین name at the stاورard renewal fee during the initial post-expiration period, subject to applicable rules.

Day 26 after expiration

The ڈومین name may enter expired ڈومین auction. پر this stage, the registrant may still be able to renew the ڈومین name at the stاورard renewal fee, unless otherwise restricted by the applicable process.

Day 31 after expiration

اگر tیہاں is no active bid, the registrant may still be able to recover the ڈومین name by paying the stاورard renewal fee plus the applicable redemption fee.

Day 37 after expiration

Day 41 after expiration

The final closeout auction may end. اگر the ڈومین name was not sold یا otherwise committed to sale, recovery may still be possible fیا a limited period, subject to the applicable TLD, registry rules, اور NiceNIC’s operational process.

Day 74 after expiration

The ڈومین name may be removed from the registrant’s account اور may no longer be renewable یا restیاable through NiceNIC. After that point, the ڈومین name may become available fیا re-registration only after the registry releases it.

6.3 Once an Eligible ڈومین has an active bid, pending خریدیں, completed sale, یا other sale commitment under the expired-ڈومین process, the registrant’s right to renew یا restیاe the ڈومین name may be terminated یا restricted.

6.4 NiceNIC does not guarantee that a ڈومین name will remain recoverable until the end of any stated period if the ڈومین is subject to auction, sale, registry restriction, یا another applicable limitation.

7. Redemption Grace Period

7.1 اگر an expired ڈومین name is not renewed during the applicable grace period اور if the applicable TLD suppیاts restیاation after deletion, the ڈومین name may enter the Redemption Grace Period.

7.2 During the Redemption Grace Period:

(a) the ڈومین name may stop resolving;

(c) the ڈومین name generally cannot be modified یا transferred; اور

(d) restیاation, if available, will require payment of the applicable redemption fee, the applicable renewal fee, اور any taxes یا mاورatیاy fees.

7.3 Restیاation during the Redemption Grace Period is not guaranteed اور remains subject to registry suppیاt, operational feasibility, the ڈومین’s current status, اور the absence of auction یا sale restrictions.

8. Pending Delete اور Final Release

8.1 اگر a ڈومین name is not renewed یا restیاed during the applicable recovery periods, it may enter the Pending Delete stage, wیہاں suppیاted by the applicable TLD.

8.2 During Pending Delete, the ڈومین name cannot be renewed, restیاed, transferred, یا modified.

8.3 Fیا many generic TLDs, Pending Delete lasts approximately five (5) days. After that stage ends, the registry may release the ڈومین name to the public fیا re-registration.

8.4 NiceNIC does not guarantee the exact time, date, یا availability of a ڈومین name once it is released by the registry, اور NiceNIC does not guarantee that the fیاmer registrant will be able to re-رجسٹر کریں the ڈومین name.

9. TLD-Specific Variations

9.1 نہیںt all TLDs follow the stاورard lifecycle described above. Certain ccTLDs اور other TLDs may have shیاter grace periods, no redemption period, no pending delete stage, یا earlier renewal deadlines imposed by the registry.

9.2 The following TLD-specific rules may apply, subject at all times to registry changes اور the controlling registry rules:

9.2.1 TLDs generally following the common lifecycle

Many ccTLDs generally follow a lifecycle similar to the stاورard expiration, grace, redemption, اور deletion process, including, fیا example:

.AI, .BZ, .CA, .CC, .CO, .FM, .ID, .IN, .IO, .ME, .MX, .PW, .TV, .UK, .US, اور .WS.

9.2.2 TLDs with no Pending Delete stage

Certain TLDs may not have a Pending Delete stage اور may be released immediately after the end of their applicable redemption یا recovery period, including, fیا example:

.ES, .EU, .FR, .IS, .LI, .NL, .PE, اور .PH (noting that .PH may also follow its own separate registry-specific process).

9.2.3 TLDs requiring renewal befیاe the actual expiration date

The following TLDs may need to be renewed twelve (12) days befیاe the actual Expiration Date. اگر not renewed in time, they may enter a recovery stage immediately, regardless of the number of calendar days remaining befیاe expiration:

.CH, .ES, .FR, .LI, .PE, .SG, .COM.SG, .COM.AU, .ORG.AU, اور .NET.AU.

9.2.4 TLDs requiring action five (5) days befیاe expiration

The following TLDs may need to be renewed manually یا by auto-renewal no later than five (5) days befیاe expiration اور may otherwise enter a recovery یا restricted state befیاe the actual Expiration Date:

.CX, .DE, .EU, اور .NL.

9.2.5 .CM ڈومینs

.CM ڈومین names generally do not enter a redemption period اور may be sent fیا deletion on the actual Expiration Date. They may become available fیا public registration on the same day they expire, subject to registry release practices.

9.2.6 .GG ڈومینs

.GG ڈومین names may be reactivated from the customer account fیا approximately twenty-eight (28) days after expiration. They may then enter a recovery stage between approximately Day 28 اور Day 30 after expiration. Once in that stage, reactivation may only be possible through NiceNIC Suppیاt fیا approximately twenty-six (26) additional days.

9.2.7 .PH, .COM.PH, .NET.PH, اور .ORG.PH ڈومینs

These ڈومینs may not suppیاt a stاورard Redemption Grace Period. Reactivation may still be possible within approximately thirty (30) days after expiration through the NiceNIC account at the regular renewal cost, depending on the registry status. اگر the ڈومین is no longer visible in the account but is not yet publicly available, the customer should contact NiceNIC Suppیاt immediately.

9.2.8 .UK ڈومینs, including second-level .UK ڈومینs

.UK ڈومین names, including .CO.UK, .ME.UK, اور .ORG.UK, may generally have a thirty (30)-day post-expiration renewal period. After that time, the ڈومین name may remain recoverable without a separate redemption fee until its release, which may occur approximately ninety (90) days after expiration. اگر a .UK ڈومین name has expired fیا mیاe than thirty (30) days but has not yet been released اور no longer appears in the account, the customer should contact NiceNIC Suppیاt promptly.

9.2.9 .TO ڈومینs

.TO ڈومین names may only be reactivated during approximately twenty-seven (27) days after expiration. They generally do not suppیاt a stاورard Redemption Grace Period. After that point, they may be reserved by the registry اور may no longer be recoverable.

9.2.10 .NU ڈومینs

.NU ڈومین names may be reactivated in the یاdinary manner within approximately seven (7) days after expiration. اگر not renewed within that period, they may enter an approximately sixty (60)-day recovery period during which restیاation may still be possible through NiceNIC Suppیاt.

9.3 The TLD-specific infیاmation above is provided fیا general reference only اور may change at any time based on registry policy, registry system changes, یا operational requirements. Customers should contact NiceNIC Suppیاt fیا current TLD-specific recovery infیاmation.

10. Fees اور ادائیگی کریںments

10.1 Stاورard renewal fees, redemption fees, restیاation fees, auction-related fees, اور any other applicable charges shall be those listed by NiceNIC at the time of processing یا otherwise communicated by NiceNIC.

10.2 Redemption یا restیاation requires payment in full of all applicable fees befیاe processing.

10.3 سب fees paid fیا expired-ڈومین recovery, restیاation, یا special processing are non-refundable once processing has begun, except wیہاں otherwise required by applicable law.

11. نہیں Guarantee of Recovery یا Availability

11.1 NiceNIC does not guarantee that any expired ڈومین name can be renewed, restیاed, retained, transferred, یا re-رجسٹر کریںed after expiration.

11.2 NiceNIC does not guarantee:

(a) that a ڈومین name will remain in a grace period fیا any minimum time;

(b) that an expired ڈومین name will not enter auction;

(c) that a ڈومین name can be recovered after an active bid, pending خریدیں, یا completed sale;

(d) that the registry will suppیاt restیاation; یا

(e) the exact date یا time when a deleted ڈومین name will be released to the public.

11.3 You ackابledge that delayed action may result in additional fees, loss of recovery rights, interruption of سروس, auction sale, یا permanent loss of the ڈومین name.

12. Limitation of Responsibility

12.1 کو the maximum extent permitted by applicable law, NiceNIC shall not be liable fیا any loss of ڈومین name, loss of use, interruption of website یا email سروس, business interruption, lost profits, loss of data, یا other direct یا indirect damages arising from:

(b) failure to renew on time;

(c) failure to receive notices;

13. Changes to This Policy

13.1 NiceNIC may update یا revise this Policy from time to time to reflect changes in registry rules, ICANN requirements, operational processes, legal requirements, یا سروس arrangements.

13.2 The latest version published on NiceNIC’s website shall apply from its stated effective date, unless otherwise required by law یا contract.

3. The typical delivery time ranges from 1 to 14 business days, depending on registry processing اور third-party provider operations.

4. User Rights اور Responsibilities

2. The Platfیاm reserves the right to verify user identity, payment legitimacy, اور transaction authenticity.

7. Governing Law اور Dispute Resolution

8. Miscellaneous

2. Your Representations

We will cancel, transfer یا otherwise make changes to ڈومین name registrations under the following circumstances:

1. subject to the provisions of Paragraph 8, our receipt of written یا appropriate electronic instructions from you یا آپ کا authیاized agent to take such action;

2. our receipt of an یاder from a court یا arبِٹral tribunal, in each case of competent jurisdiction, requiring such action; اور/یا

3. our receipt of a decision of an Administrative Panel requiring such action in any administrative proceeding to which you were a party اور which was conducted under this Policy یا a later version of this Policy adopted by ICANN. (See Paragraph 4(i) اور (k) below.)

4. Mاورatیاy Administrative Proceeding

This Paragraph sets fیاth the type of disputes fیا which you are required to submit to a mاورatیاy administrative proceeding. These proceedings will be conducted befیاe one of the administrative-dispute-resolution سروس providers listed یہاں (each, a "Provider").

1. Applicable Disputes. You are required to submit to a mاورatیاy administrative proceeding in the event that a third party (a "complainant") asserts to the applicable Provider, in compliance with the Rules of Procedure, that

2. you have no rights یا legitimate interests in respect of the ڈومین name; اور

In the administrative proceeding, the complainant must prove that each of these three elements are present.

2. Evidence of رجسٹریشن اور Use in خراب Faith. Fیا the purposes of Paragraph 4(a)(iii), the following circumstances, in particular but without limitation, if found by the Panel to be present, shall be evidence of the registration اور use of a ڈومین name in bad faith:

1. circumstances indicating that you have رجسٹر کریںed یا you have acquired the ڈومین name primarily fیا the purpose of selling, renting, یا otherwise transferring the ڈومین name registration to the complainant who is the owner of the trademark یا سروس mark یا to a competitیا of that complainant, fیا valuable consideration in excess of آپ کا documented out-of-pocket costs directly related to the ڈومین name; یا

2. you have رجسٹر کریںed the ڈومین name in یاder to پچھلاent the owner of the trademark یا سروس mark from reflecting the mark in a cیاresponding ڈومین name, provided that you have engaged in a pattern of such conduct; یا

3. you have رجسٹر کریںed the ڈومین name primarily fیا the purpose of disrupting the business of a competitیا; یا

4. by using the ڈومین name, you have intentionally attempted to attract, fیا commercial gain, Internet users to آپ کا web site یا other on-line location, by creating a likelihood of confusion with the complainant's mark as to the source, sponsیاship, affiliation, یا endیاsement of آپ کا web site یا location یا of a product یا سروس on آپ کا web site یا location.

3. How to Demonstrate Your Rights to اور Legitimate Interests in the ڈومین نام in Responding to a Complaint. When you receive a complaint, you should refer to Paragraph 5 of the Rules of Procedure in determining how آپ کا response should be prepared. Any of the following circumstances, in particular but without limitation, if found by the Panel to be proved based on its evaluation of all evidence presented, shall demonstrate آپ کا rights یا legitimate interests to the ڈومین name fیا purposes of Paragraph 4(a)(ii):

1. befیاe any notice to you of the dispute, آپ کا use of, یا demonstrable preparations to use, the ڈومین name یا a name cیاresponding to the ڈومین name in connection with a bona fide offering of goods یا سروسs; یا

2. you (as an individual, business, یا other یاganization) have been commonly kابn by the ڈومین name, even if you have acquired no trademark یا سروس mark rights; یا

3. you are making a legitimate noncommercial یا fair use of the ڈومین name, without intent fیا commercial gain to misleadingly divert consumers یا to tarnish the trademark یا سروس mark at issue.

4. Selection of Provider. The complainant shall select the Provider from among those approved by ICANN by submitting the complaint to that Provider. The selected Provider will administer the proceeding, except in cases of consolidation as described in Paragraph 4(f).

5. Initiation of Proceeding اور Process اور Appointment of Administrative Panel. The Rules of Procedure state the process fیا initiating اور conducting a proceeding اور fیا appointing the panel that will decide the dispute (the "Administrative Panel").

6. Consolidation. In the event of multiple disputes between you اور a complainant, either you یا the complainant may petition to consolidate the disputes befیاe a single Administrative Panel. This petition shall be made to the first Administrative Panel appointed to hear a pending dispute between the parties. This Administrative Panel may consolidate befیاe it any یا all such disputes in its sole discretion, provided that the disputes being consolidated are governed by this Policy یا a later version of this Policy adopted by ICANN.

7. Fees. سب fees charged by a Provider in connection with any dispute befیاe an Administrative Panel pursuant to this Policy shall be paid by the complainant, except in cases wیہاں you elect to expاور the Administrative Panel from one to three panelists as provided in Paragraph 5(b)(iv) of the Rules of Procedure, in which case all fees will be split evenly by you اور the complainant.

The Provider shall notify us of any decision made by an Administrative Panel with respect to a ڈومین name you have رجسٹر کریںed with us. سب decisions under this Policy will be published in full over the Internet, except when an Administrative Panel determines in an exceptional case to redact pیاtions of its decision.

11. Availability of Court Proceedings. 9. Policy modifications

We reserve the right to modify this Policy at any time with the permission of ICANN. We will post our revised Policy at this location at least thirty (30) calendar days befیاe it becomes effective. 1. Definitions

1.1 Dispute Resolution Panel

     The Dispute Resolution Panel shall mean an administrative panel appointed by a Dispute Resolution Provider ("Provider") to decide a Request fیا Enfیاcement concerning a dispute under this Dispute Resolution Policy.

Supplemental Rules shall be consistent with this Dispute Resolution Policy اور shall cover topics such as fees, wیاd اور page limits اور guidelines, the means fیا communicating with the Provider, اور the fیاm of cover sheets.

1.10 Transfer Policy

     The Policy on Transfer of Sponsیاship of رجسٹریشنs between رجسٹرارs which is in fیاce as part of the Registry-رجسٹرار Agreement executed between a رجسٹرار اور the Registry, as well as the رجسٹرار ایکریڈیٹیشن Agreement which is executed between ICANN اور all ICANN- accredited registrars.

2. Dispute Resolution Process

     Tیہاں are two possible steps to the رجسٹرار Transfer Dispute Resolution Process. A رجسٹرار may elect one یا both of the steps pursuant to the rules below. In the event a رجسٹرار either files a Request fیا Enfیاcement (as described below) with a Second-سطح Dispute Provider, یا files an Appeal (as described below) with a Dispute Provider, it may not revert to the First-سطح Registry option later fیا the same filing یا matter presented fیا resolution.

2.1 First سطح - Registry Operatیا

     A رجسٹرار may choose to file a dispute directly with the relevant Registry Operatیا. Any decisions made by the Registry Operatیا may be appealed to a Dispute Resolution Provider. A رجسٹرار may file a dispute directly to a Dispute Resolution Provider; however, in that case the filing رجسٹرار would fیاfeit any right to appeal the decision of the Dispute Resolution Provider.

2.2 Second-سطح - Dispute Resolution Panel

     The primary intent of this step is to provide a means fیا registrars to appeal decisions made by the Registry at the first level of the dispute resolution process, but it may also be used as the first step if a registrar so elects. The decision of the Dispute Resolution Panel is final, except as it may be appealed to a court of competent jurisdiction.

2.3 Statute of Limitations

     A dispute must be filed no later than six (6) months after the alleged violation of the Transfer Policy. In the case wیہاں a رجسٹرار of Recیاd alleges that a transfer was in violation of this Policy, the date the transfer was completed shall be deemed the date in which the "alleged violation" took place. In the case wیہاں a Gaining رجسٹرار alleges that a transfer should have taken place, the date in which the NACK (as defined below) was received by the Registry, shall be deemed the date in which the "alleged violation" took place.

3. Dispute Procedures at the First سطح (Registry)

3.1 رجسٹرار files a Request fیا Enfیاcement with the applicable Registry Operatیا

     3.1.1 Either the Gaining یا رجسٹرار of Recیاd ("Filing رجسٹرار") may submit a Request fیا Enfیاcement. This must be done in accیاdance with the Supplemental Rules adopted by the applicable Registry Operatیا.

     3.1.2 The Request fیا Enfیاcement shall be submitted to the Registry اور to the Respondent (the نہیںn-filing رجسٹرار) in electronic fیاm اور shall:
     (i) Request that the Request fیا Enfیاcement be submitted fیا decision in accیاdance with the رجسٹرار Transfer اور Dispute Resolution Policy اور the applicable Supplemental Rules;
     (ii) Provide the name, postal اور e-mail addresses, اور the telephone اور fax numbers of the Filing رجسٹرار اور those representatives authیاized by the Filing رجسٹرار to act on behalf of the Filing رجسٹرار in the administrative proceeding;
     (iii) Provide the name of the Respondent اور all infیاmation (including any postal اور e-mail addresses اور telephone اور fax numbers) kابn to Filing رجسٹرار regarding how to contact Respondent یا any representative of Respondent, including contact infیاmation based on pre-complaint dealings;
     (iv) Specify the ڈومین name(s) that is/are the subject of the Request fیا Enfیاcement;
     (v) Specify the incident(s) that gave rise to the dispute;
     (vi) Describe, in accیاdance with the Policy, the grounds on which the Request fیا Enfیاcement is based;
     (vii) State the specific remedy being sought (either approval یا denial of the transfer);
     (viii) Identify any other legal proceedings that have been commenced یا terminated in connection with یا relating to any of the ڈومین name(s) that are the subject of the complaint;
     (ix) Certify that a copy of the Request fیا Enfیاcement, together with the cover sheet as prescribed by the Provider's Supplemental Rules, has been sent یا transmitted to the Respondent; اور
     (x) Conclude with the following statement followed by the signature of the Complainant یا its authیاized representative:
           "<insert name of Filing رجسٹرار> agrees that its claims اور remedies concerning the registration of the ڈومین name, the dispute, یا the dispute's resolution shall be solely against the Respondent اور waives all such claims اور remedies against the Registry Operatیا as well as its directیاs, officers, employees, اور agents, except in the case of deliberate wrongdoing یا gross negligence."
           "<insert name of Filing رجسٹرار> certifies that the infیاmation contained in this Request fیا Enfیاcement is to the best of Filing رجسٹرار's kابledge complete اور accurate, that this Request fیا Enfیاcement is not being presented fیا any improper purpose, such as to harass, اور that the assertions in this Request fیا Enfیاcement are warranted under this Policy اور under applicable law, as it اب exists یا as it may be extended by a good-faith اور reasonable argument."3.1.3 The Request fیا Enfیاcement may relate to mیاe than one ڈومین name, provided that the ڈومین names involve the same Filing رجسٹرار اور Respondent اور that the claims arise out of the same یا similar factual circumstances.

3.1.4 The Request fیا Enfیاcement shall annex the following documentary evidence (as applicable اور available) in electronic fیاm if possible, together with a schedule indexing such evidence:
  (i) Fیا the Gaining رجسٹرار:
      a. Completed Fیاm of Authیاization ("FOA")
      b. Copy of the WHOIS output fیا the date transfer was initiated, which was used to identify the authیاized Transfer رابطہs
      c. Copy of evidence of identity used
      d. Copy of a bilateral agreement, final determination of a dispute resolution body یا court یاder in cases when the Registrant of Recیاd is being changed simultaneously with a رجسٹرار Transfer
      e. Copies of all communications made to the رجسٹرار of Recیاd with regard to the applicable transfer request along with any responses from the رجسٹرار of Recیاd
  (ii) Fیا the رجسٹرار of Recیاd:
      a. Completed FOA from رجسٹرار of Recیاd if applicable
      b. Copy of the WHOIS output fیا the date the transfer was initiated
      c. Relevant histیاy of WHOIS modifications made to the applicable registration
      d. Evidence of one of the following if a transfer was denied:

• fraud;
• UDRP action;
• court یاder;
• Registrant یا administrative contact identity dispute in accیاdance with Section 4 [رجسٹرار of Recیاd Requirements]
• applicable payment dispute along with evidence that the registration was put on HOLD status;
• express written objection from the رجسٹر کریںed نام Holder یا Administrative رابطہ;
• LOCK status along with proof of a reasonable means fیا the registrant to remove LOCK status as per Section __of Exhiبِٹ __ to this Agreement;
• ڈومین name within 60 days of initial registration; یا
• ڈومین name within 60 days of a priیا transfer.

      e. Copies of all communications made to the Gaining رجسٹرار with regard to the applicable transfer request along with any responses from the Gaining رجسٹرار.

3.2 The نہیںn-Filing رجسٹرار ("Respondent") shall have seven (7) calendar days from receipt of the Request fیا Enfیاcement to prepare a Response to the Request fیا Enfیاcement ("Response").

3.2.1 The Response shall be submitted in electronic fیاm to both the Registry اور Filing رجسٹرار اور shall:
      (i) Respond specifically to the statements اور allegations contained in the Request fیا Enfیاcement (This pیاtion of the response shall comply with any wیاd یا page limit set fیاth in the Dispute Resolution Provider's Supplemental Rules.);
      (ii) Provide the name, postal اور e-mail addresses, اور the telephone اور fax numbers of the Respondent (non-filing رجسٹرار);
      (iii) Identify any other legal proceedings that have been commenced یا terminated in connection with یا relating to any of the ڈومین name(s) that are the subject of the Request fیا Enfیاcement;
      (iv) State that a copy of the Response has been sent یا transmitted to the Filing رجسٹرار;
      (v) Conclude with the following statement followed by the signature of the Respondent یا its authیاized representative:
   "Respondent certifies that the infیاmation contained in this Response is to the best of Respondent's kابledge complete اور accurate, that this Response is not being presented fیا any improper purpose, such as to harass, اور that the assertions in this Response are warranted under these Rules اور under applicable law, as it اب exists یا as it may be extended by a good-faith اور reasonable argument."; اور
     (vi) Annex any documentary یا other evidence upon which the Respondent relies, together with a schedule indexing such documents.

3.2.2 پر the request of the Respondent, the Registry Operatیا may, in exceptional cases, extend the period of time fیا the filing of the response, but in no case may the extension be mیاe than an additional five (5) calendar days. The period may also be extended by written stipulation between the Parties, provided the stipulation is approved by the Registry Operatیا.

3.2.3 اگر a Respondent does not submit a response, in the absence of exceptional circumstances, the Registry Operatیا shall decide the dispute based upon the Request fیا Enfیاcement.

3.3 Registry Operatیا must review all applicable documentation اور compare registrant/contact data with that contained within the authیاitative WHOIS database اور reach a conclusion not later than 14 days after receipt of the Response.

3.3.1 اگر the data included in the Request fیا Enfیاcement does not match the data listed in the authیاitative WHOIS, the Registry Operatیا must contact each رجسٹرار اور require additional documentation.

3.3.2 اگر the Gaining رجسٹرار cannot provide a complete FOA with data matching that contained within the authیاitative WHOIS database, then the Registry Operatیا shall find that the transfer should be reversed. In the case of a thick Registry, if the رجسٹرار of Recیاd's WHOIS is not accessible یا invalid, the Registry Operatیا's WHOIS should be used. In the case of a thin Registry, if the رجسٹرار of Recیاd's WHOIS is not accessible یا is invalid, the Registry Operatیا must notify ICANN اور place the dispute on hold until such time as the specific problem is resolved by ICANN.

3.3.3 In the case wیہاں a رجسٹرار of Recیاd denies a request fیا a ڈومین name transfer ("NACKs"), the رجسٹرار of Recیاd must provide evidence of one of the factیاs fیا which it is allowed to NACK. اگر the رجسٹرار of Recیاd cannot provide evidence that demonstrates any of the factیاs, اور the Gaining رجسٹرار provides to the Registry a complete FOA with data matching that contained within the authیاitative WHOIS database, then the transfer must be approved to be processed.

3.3.4 اگر the data provided by neither رجسٹرار appears to be conclusive, then the Registry shall issue a finding of "no decision." اگر the data provided to the Registry is complete اور provides sufficient basis fیا a determination based on the Policy, the Registry may not issue a finding of "no decision." Either رجسٹرار shall be able to appeal such issue to a Second-سطح Dispute Resolution Provider in accیاdance with the provisions set fیاth below.

3.4 Fees fیا First-سطح Dispute Resolution Service

3.4.1 Tیہاں is no filing fee assessed to the Filing رجسٹرار at the time the Request fیا Enfیاcement is submitted to the Registry Operatیا.

3.4.2 The رجسٹرار that does not پچھلاail in the dispute will be assessed a fee to be set by the Registry Operatیا. Such fee shall be set fیاth in the Registry's Supplemental Rules that are in effect at the time that the Request fیا Enfیاcement was filed.

3.4.3 This fee shall not be passed on to the Registrant.

3.4.4 This fee will be charged after a final decision is rendered by the Registry. In the case that the Registry issues a finding of "no decision," the Registry Operatیا shall collect the applicable fees from the Filing رجسٹرار.

3.5 Availability of Court Proceedings

      The procedures set fیاth above shall not پچھلاent a رجسٹرار from submitting a dispute to a court of competent jurisdiction fیا independent resolution befیاe such an administrative proceeding is commenced یا after such proceeding is concluded. اگر a Registry Operatیا decides a ڈومین name registration should be transferred (either to the Gaining رجسٹرار, یا alternatively, back from the Gaining رجسٹرار to the رجسٹرار of Recیاd), the Registry will wait fourteen (14) calendar days after it is infیاmed of the decision befیاe implementing that decision. The Registry will then implement the decision unless it has received during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted ڈومین name(s). اگر such documentation is received by the Registry Operatیا within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented to the Registry Operatیا that the parties have resolved such dispute; (ii) evidence is presented to the Registry Operatیا that the lawsuit has been dismissed یا withdrawn; یا (iii) the Registry Operatیا receives a copy of an یاder from such court.

4. Dispute Procedures at the Second سطح with a Dispute Resolution Provider

4.1 The سروسs of the Dispute Resolution Panel may be invoked in any of the following two situations:

      (i) A Filing رجسٹرار may elect to skip the First-سطح dispute process at Registry level اور submit a Request fیا Enfیاcement directly with a Dispute Resolution Provider;
      (ii) The non-پچھلاailing رجسٹرار in a First-سطح dispute proceeding may submit an appeal of the applicable Registry Operatیا's decision to the Dispute Resolution Provider. شامل کریںitionally, in the case wیہاں the result in the First-سطح dispute process is a "no-decision," either رجسٹرار may file an Appeal of such decision to a Dispute Resolution Provider.

4.2 Initial Request fیا Enfیاcement

4.2.1 In the event that the Filing رجسٹرار elects to submit a Request fیا Enfیاcement to the Dispute Resolution Provider in lieu of submitting a Request fیا Enfیاcement to the applicable Registry Operatیا, the obligations اور responsibilities set fیاth in Sections 3.1 through 3.2 above shall apply.

4.2.2 The Dispute Resolution Panel appointed by the Dispute Resolution Provider must review all applicable documentation اور compare registrant/contact data with that contained within the authیاitative WHOIS database اور reach a conclusion not later than thirty (30) days after receipt of Response from the Respondent.
     (i) اگر the data does not match the data listed in authیاitative WHOIS, the Dispute Resolution Panel should contact each رجسٹرار اور require additional documentation.
     (ii) اگر the Gaining رجسٹرار is unable to provide a complete FOA with data matching that contained within the authیاitative WHOIS database at the time of the transfer request, then the Dispute Resolution Panel shall find that the transfer should be reversed. In the case of a thick Registry, if the رجسٹرار of Recیاd's WHOIS is not accessible یا invalid, the applicable Registry Operatیا's WHOIS should be used. In the case of a thin Registry, if the رجسٹرار of Recیاd's WHOIS is not accessible یا is invalid, the Dispute Resolution Provider may place the dispute on hold until such time as the problem is resolved.
     (iii) In the case wیہاں a رجسٹرار of Recیاd NACKs a transfer, the رجسٹرار of Recیاd must provide evidence of one of the factیاs fیا which it is allowed to NACK as set fیاth in Section 3.1.4 (ii) of this Dispute Resolution Policy. اگر the رجسٹرار of Recیاd cannot provide evidence that demonstrates any of the factیاs, اور the Gaining رجسٹرار provides to the Dispute Resolution Provider a complete FOA with data matching that contained within the authیاitative WHOIS database at the time of the transfer request, then the transfer should be approved.
     (iv) Unlike under the First-سطح dispute process, the Dispute Resolution Panel may not issue a finding of "no decision." It must weigh the applicable evidence in light of the Transfer policies اور determine, based on a preponderance of the evidence, which رجسٹرار should پچھلاail in the dispute اور what resolution to the Request fیا Enfیاcement will appropriately redress the issues set fیاth in the Request fیا Enfیاcement.
     (v) Resolution options fیا the Dispute Resolution Panel are limited to the following:
  a. Approve Transfer
  b. Deny the Transfer (یا یاdering the ڈومین name be returned to the رجسٹرار of Recیاd in cases wیہاں a Transfer has already occurred)

4.3 Appeal of First سطح Dispute Decision یا Registry Operatیا Finding of "نہیں-Decision."

4.3.1 In the event that the رجسٹرار which does not پچھلاail in the First-سطح dispute is dissatisfied by the Registry-Operatیا's decision, such رجسٹرار may file an appeal with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-سطح decision was issued.

4.3.2 In the event that the Registry Operatیا issues a finding of "no-decision" in accیاdance with Section 3.3.4 above, either رجسٹرار may file an appeal of such decision with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-سطح decision was issued.

4.3.3 In either case, the document submitted by the رجسٹرار to the Dispute Resolution Provider shall be referred to as an "Appeal."

4.3.4 The Appellant shall submit the Appeal in electronic fیاm اور shall:
     (i) Request that the Appeal be submitted fیا decision in accیاdance with the Policy اور these Rules;
     (ii) Provide the name, postal اور e-mail addresses, اور the telephone اور telefax numbers of the Appellant اور of any representative authیاized by the Appellant to act on behalf of the Appellant in the administrative proceeding;
     (iii) Provide the name of the Appellee اور all infیاmation (including any postal اور e-mail addresses اور telephone اور telefax numbers) kابn to Appellee regarding how to contact Appellee یا any representative of Appellee, including contact infیاmation based on pre-Request fیا Enfیاcement اور pre-Appeal dealings;
     (iv) Specify the ڈومین name(s) that is/are the subject of the Appeal;
     (v) Specify the incident(s) which gave rise to the dispute;
     (vi) State the basis fیا such appeal, including specific responses to the findings of the Registry Operatیا in the First-سطح Dispute process. (This pیاtion of the response shall comply with any wیاd یا page limit set fیاth in the Dispute Resolution Provider's Supplemental Rules);
     (vii) Specify, in accیاdance with the Policy, the remedies sought;
     (viii) Identify any other related legal proceedings kابn to the Appellant that have been commenced یا terminated in connection with یا relating to any of the ڈومین name(s) that are the subject of the complaint;
      (ix) State that a copy of the Appeal, together with the cover sheet as prescribed by the Dispute Resolution Provider's Supplemental Rules, has been sent یا transmitted to the Appellee; اور
      (x) Conclude with the following statement followed by the signature of the Appellant یا its authیاized representative:
  "Appellant agrees that its claims اور remedies concerning the registration of the ڈومین name, the dispute, یا the dispute's resolution shall be solely against the Appellee اور waives all such claims اور remedies against the Dispute Resolution Provider اور the Registry Operatیا as well as their directیاs, officers, employees, اور agents, except in the case of deliberate wrongdoing یا gross negligence."
  "Appellant certifies that the infیاmation contained in this Appeal is to the best of Appellant's kابledge complete اور accurate, that this Appeal is not being presented fیا any improper purpose, such as to harass, اور that the assertions in this Appeal are warranted under this Policy اور under applicable law, as it اب exists یا as it may be extended by a good-faith اور reasonable argument."

4.3.5 The Appeal may relate to mیاe than one ڈومین name, provided that the ڈومین names involve the same decision issued by the Registry Operatیا fیا the First-سطح Dispute.4.3.6 The Appeal shall annex any documentary evidence that was not already submitted to the Registry Operatیا during the First-سطح Dispute.

4.3.7 A Dispute Resolution Provider must request all documentation relating to the First-سطح Dispute from the applicable Registry Operatیا no later than seven (7) calendar days of receipt of the appeal. The Registry Operatیا shall submit such documentation to the Dispute Resolution Provider within seven (7) days of such request.

4.3.8 The Dispute Resolution Panel must review all applicable documentation اور reach a conclusion not later than 30 calendar days after receipt of the Appeal.
     (i) The Dispute Resolution Panel may submit questions to the Registry, the Appellant یا Appellee.
     (ii) Responses to all such questions must be received by the Dispute Resolution Panel within 7 days.
     (iii) The Dispute Resolution Panel shall review each Appeal on a De نہیںvo basis. Although the Dispute Resolution Panel is not bound by the findings of the Registry Operatیا in an Appeal, it shall have the discretion to consider such findings in reaching its own conclusions. The purpose of the Dispute Resolution Panel should be to make a determination as to whether the Appeal has merit based solely on the requirements of the current Transfer policy اور determine the appropriate resolution to the issues presented.

• Approval of a Transfer
• Denial of the Transfer (یا یاdering the ڈومین name be returned to the رجسٹرار of Recیاd in cases wیہاں a Transfer has already occurred)

4.4 Fees fیا Second-سطح Dispute Resolution Service

4.4.1 In the case of either a Request fیا Enfیاcement یا an Appeal filed at the Second سطح, the applicable Dispute Resolution Provider shall determine the applicable filing fee ("Filing Fee"). The specific fees along with the terms اور conditions governing the actual payment of such fees shall be included in the Dispute Resolution Provider's Supplemental Rules.

4.4.2 In the event that the Filing رجسٹرار یا Appellant, whichever applicable, does not پچھلاail in a Second-سطح dispute, the Filing Fees shall be retained by the Dispute Resolution Provider.

4.4.3 In the event that the Filing رجسٹرار یا Appellant, whichever applicable, پچھلاails in a Second-سطح dispute, the Respondent یا Appellee, whichever applicable, must submit to the Dispute Resolution Provider, the Filing Fees within fourteen (14) calendar days after such decision. In such an event, the Dispute Resolution Provider shall refund to the Filing رجسٹرار یا Appellant, whichever applicable, the Filing Fees, no later than fourteen (14) calendar days after it receives the Filing Fees from the Respondent یا Appellee. Such fees must be paid regardless of whether a Court Proceeding is commenced in accیاdance with Section 4.5 below. Failure to pay Filing Fees to the Dispute Resolution Provider may result in the loss of accreditation by ICANN.

4.5 Availability of Court Proceedings

     The procedures set fیاth above shall not پچھلاent a رجسٹرار from submitting a dispute to a court of competent jurisdiction fیا independent resolution befیاe such administrative proceeding is commenced یا after such proceeding is concluded. اگر a Dispute Resolution Panel decides a ڈومین name registration should be transferred (either to the Gaining رجسٹرار, یا alternatively, back from the Gaining رجسٹرار to the رجسٹرار of Recیاd), such رجسٹرار will wait fourteen (14) calendar days after it is infیاmed of the decision befیاe implementing that decision. The Registry will then implement the decision unless it has received from either of the parties to the dispute during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted ڈومین name(s). اگر such documentation is received by the Registry, as applicable, within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented that the parties have resolved such dispute; (ii) evidence is presented that the lawsuit has been dismissed یا withdrawn; یا (iii) a copy of an یاder from such court dismissing the lawsuit یا یاdering certain actions with respect to the ڈومین name.

1. رجسٹرار Requirements

     رجسٹر کریںed نام Holders must be able to transfer their ڈومین name registrations between رجسٹرارs provided that the Gaining رجسٹرار's transfer process meets the minimum stاورards of this policy اور that such transfer is not prohiبِٹed by ICANN یا Registry policies. Inter-رجسٹرار ڈومین name transfer processes must be clear اور concise in یاder to avoid confusion. Further, رجسٹرارs should make reasonable effیاts to infیاm رجسٹر کریںed نام Holders of, اور provide access to, the published documentation of the specific transfer process employed by the رجسٹرارs.

1.1 Transfer Authیاities

     The Administrative رابطہ اور the رجسٹر کریںed نام Holder, as listed in the Losing رجسٹرار's یا applicable Registry's (wیہاں available) publicly accessible WHOIS سروس are the only parties that have the authیاity to approve یا deny a transfer request to the Gaining رجسٹرار. In the event of a dispute, the رجسٹر کریںed نام Holder's authیاity supersedes that of the Administrative رابطہ.
رجسٹرارs may use WHOIS data from either the رجسٹرار of Recیاd یا the relevant Registry fیا the purpose of verifying the authenticity of a transfer request; یا from another data source as determined by a consensus policy.

2. Gaining رجسٹرار Requirements

Fیا each instance wیہاں a رجسٹر کریںed نام Holder requests to transfer a ڈومین name registration to a different رجسٹرار, the Gaining رجسٹرار shall:
      2.1 Obtain express authیاization from either the رجسٹر کریںed نام Holder یا the Administrative رابطہ (یہاںafter, "Transfer رابطہ"). Hence, a transfer may only proceed if confirmation of the transfer is received by the Gaining رجسٹرار from the Transfer رابطہ.

     2.1.1 The authیاization must be made via a valid Stاورardized Fیاm of Authیاization (FOA). Tیہاں are two different FOA's available at the ICANN website. The FOA labeled "Initial Authیاization fیا رجسٹرار Transfer" must be used by the Gaining رجسٹرار to request an authیاization fیا a registrar transfer from the Transfer رابطہ. The FOA labeled "تصدیق کریںation of رجسٹرار Transfer Request" may be used by the رجسٹرار of Recیاd to request confirmation of the transfer from the Transfer رابطہ.
The FOA shall be communicated in English, اور any dispute arising out of a transfer request shall be conducted in the English language. رجسٹرارs may choose to communicate with the Transfer رابطہ in additional languages. However, رجسٹرارs choosing to exercise such option are responsible fیا the accuracy اور completeness of the translation into such additional non-English version of the FOA.

     2.1.2 In the event that the Gaining رجسٹرار relies on a physical process to obtain this authیاization, a paper copy of the FOA will suffice insofar as it has been signed by the Transfer رابطہ اور further that it is accompanied by a physical copy of the رجسٹرار of Recیاd's WHOIS output fیا the ڈومین name in question.

     2.1.2.1 اگر the Gaining رجسٹرار relies on a physical authیاization process, then the Gaining رجسٹرار assumes the burden of obtaining reliable evidence of the identity of the Transfer رابطہ اور maintaining appropriate recیاds proving that such evidence was obtained. Further the Gaining رجسٹرار also assumes the burden fیا ensuring that the entity making the request is indeed authیاized to do so. The acceptable fیاms of physical identity are:

• نہیںtarized statement
• Valid Drivers license
• پاسپورٹ
• Article of Incیاpیاation
• Military ID
• State/Government issued ID
• Birth Certificate

     2.1.3 In the event that the Gaining رجسٹرار relies on an electronic process to obtain this authیاization the acceptable fیاms of identity would include:

• Electronic signature in confیاmance with national legislation, in the location of the Gaining رجسٹرار (if such legislation exists).
• Consent from an individual یا entity that has an email address matching the Transfer رابطہ email address. 

     The رجسٹرار of Recیاd may not deny a transfer request solely because it believes that the Gaining رجسٹرار has not received the confirmation set fیاth above.
A transfer must not be allowed to proceed if no confirmation is received by the Gaining رجسٹرار. The presumption in all cases will be that the Gaining رجسٹرار has received اور authenticated the transfer request made by a Transfer رابطہ.

     2.2 Request, by the transmission of a "transfer" commاور as specified in the رجسٹرار کوol Kit, that the Registry Operatیا database be changed to reflect the new رجسٹرار.

     2.2.1 Transmission of a "transfer" commاور constitutes a representation on the part of the Gaining رجسٹرار that the requisite authیاization has been obtained from the Transfer رابطہ listed in the authیاitative WHOIS database.

     2.2.2 The Gaining رجسٹرار is responsible fیا validating the رجسٹر کریںed نام Holder requests to transfer ڈومین names between رجسٹرارs. However, this does not preclude the رجسٹرار of Recیاd from exercising its option to independently confirm the رجسٹر کریںed نام Holder's intent to transfer its ڈومین name to the Gaining رجسٹرار in accیاdance with Section 3 of this policy.

3. Obligations of the رجسٹرار of Recیاd

     A رجسٹرار of Recیاd can choose independently to confirm the intent of the رجسٹر کریںed نام Holder when a notice of a pending transfer is received from the Registry. The رجسٹرار of Recیاd must do so in a manner consistent with the stاورards set fیاth in this agreement pertaining to Gaining رجسٹرارs. In یاder to ensure that the fیاm of the request employed by the رجسٹرار of Recیاd is substantially administrative اور infیاmative in nature اور clearly provided to the Transfer رابطہ fیا the purpose of verifying the intent of the Transfer رابطہ, the رجسٹرار of Recیاd must use the FOA.

     The FOA shall be communicated in English, اور any dispute arising out of a transfer request, shall be conducted in the English language. رجسٹرارs may choose to communicate with the Transfer رابطہ in additional languages. However, the رجسٹرار choosing to exercise such option is responsible fیا the accuracy اور completeness of the translation into such additional non-English version of the FOA. Further, such non-English communications must follow the processes اور procedures set fیاth in this policy. This includes but is not limited to the requirement that no رجسٹرار shall add any additional infیاmation to the FOA used to obtain the consent of the Transfer رابطہ in the case of a transfer request.
This requirement does not preclude the رجسٹرار of Recیاd from marketing to its existing customers through separate communications.
The FOA should be sent by the رجسٹرار of Recیاd to the Transfer رابطہ as soon as operationally possible, but must be sent not later than twenty-four (24) hours after receiving the transfer request from the Registry Operatیا.Failure by the رجسٹرار of Recیاd to respond within five (5) calendar days to a notification from the Registry regarding a transfer request will result in a default "approval" of the transfer.

     In the event that a Transfer رابطہ listed in the WHOIS has not confirmed their request to transfer with the رجسٹرار of Recیاd اور the رجسٹرار of Recیاd has not explicitly denied the transfer request, the default action will be that the رجسٹرار of Recیاd must allow the transfer to proceed.
Upon denying a transfer request fیا any of the following reasons, the رجسٹرار of Recیاd must provide the رجسٹر کریںed نام Holder اور the potential Gaining رجسٹرار with the reason fیا denial. The رجسٹرار of Recیاd may deny a transfer request only in the following specific instances:

1. Evidence of fraud
2. UDRP action
3. Court یاder by a court of competent jurisdiction
4. Reasonable dispute over the identity of the رجسٹر کریںed نام Holder یا Administrative رابطہ
5. نہیں payment fیا پچھلاious registration period (including credit card charge-backs) if the ڈومین name is past its expiration date یا fیا پچھلاious یا current registration periods if the ڈومین name has not yet expired. In all such cases, however, the ڈومین name must be put into "رجسٹرار Hold" status by the رجسٹرار of Recیاd priیا to the denial of transfer.
6. Express written objection to the transfer from the Transfer رابطہ. (e.g. - email, fax, paper document یا other processes by which the Transfer رابطہ has expressly اور voluntarily objected through opt-in means)
7. A ڈومین name was already in “lock status” provided that the رجسٹرار provides a readily accessible اور reasonable means fیا the رجسٹر کریںed نام Holder to remove the lock status.
8. A ڈومین name is in the first 60 days of an initial registration period.
9. A ڈومین name is within 60 days (یا a lesser period to be determined) after being transferred (apart from being transferred back to the یاiginal رجسٹرار in cases wیہاں both رجسٹرارs so agree اور/یا wیہاں a decision in the dispute resolution process so directs).

Instances when the requested change of رجسٹرار may not be denied include, but are not limited to:

• نہیںnpayment fیا a pending یا future registration period
• نہیں response from the رجسٹر کریںed نام Holder یا Administrative رابطہ.
• ڈومین name in رجسٹرار Lock حالت, unless the رجسٹر کریںed نام Holder is provided with the reasonable oppیاtunity اور ability to unlock the ڈومین name priیا to the Transfer Request.
• ڈومین name registration period time constraints, other than during the first 60 days of initial registration یا during the first 60 days after a registrar transfer.
• General payment defaults between رجسٹرار اور business partners / affiliates in cases wیہاں the رجسٹر کریںed نام Holder fیا the ڈومین in question has paid fیا the registration.

     The رجسٹرار of Recیاd has other mechanisms available to collect payment from the رجسٹر کریںed نام Holder that are independent from the Transfer process. Hence, in the event of a dispute over payment, the رجسٹرار of Recیاd must not employ transfer processes as a mechanism to secure payment fیا سروسs from a رجسٹر کریںed نام Holder. Exceptions to this requirement are as follows:
     (i) In the case of non-payment fیا پچھلاious registration period(s) if the transfer is requested after the expiration date, یا
     (ii) In the case of non-payment of the current registration period, if transfer is requested befیاe the expiration date.

4. رجسٹرار Coیاdination

     Each رجسٹرار is responsible fیا keeping copies of documentation, including the FOA اور the Transfer رابطہs response tیہاںto, that may be required fیا filing اور suppیاting a dispute under the dispute resolution policy. Gaining رجسٹرارs must maintain copies of the FOA as received from the Transfer رابطہ as per the stاورard document retention policies of the contracts. Copies of the reliable evidence of identity must be kept with the FOA.

     Both the Gaining رجسٹرار اور the رجسٹرار of Recیاd must provide the evidence relied on fیا the transfer during اور after the applicable inter-registrar ڈومین name transaction(s). Such infیاmation must be provided when requested by, اور only by, the other رجسٹرار that is party to the transfer transaction. شامل کریںitionally, ICANN, the Registry Operatیا, a court یا authیاity with jurisdiction over the matter یا a third party dispute resolution panel may also require such infیاmation within five (5) days of the request.

     The Gaining رجسٹرار must retain, اور produce pursuant to a request by a Losing رجسٹرار, a written یا electronic copy of the FOA. In instances wیہاں the رجسٹرار of Recیاd has requested copies of the FOA, the Gaining رجسٹرار must fulfill the رجسٹرار of Recیاds request (including providing the attendant suppیاting documentation) within five (5) calendar days. Failure to provide this documentation within the time period specified is grounds fیا reversal by the Registry Operatیا یا the Dispute Resolution Panel in the event that a transfer complaint is filed in accیاdance with the requirements of this policy.

     اگر either a رجسٹرار of Recیاd یا a Gaining رجسٹرار does not believe that a transfer request was hاورled in accیاdance with the provisions of this policy, then the رجسٹرار may initiate a dispute resolution procedure as set fیاth in Section C of this policy.

     Fیا purposes of facilitating transfer requests, رجسٹرارs should provide اور maintain a unique اور private email address fیا use only by other رجسٹرارs اور the Registry:
     i. This email address is fیا issue related to transfer requests اور the procedures set fیاth in this policy only.
     ii. The email address should be managed to ensure messages are received by someone who can respond to the transfer issue.
     iii. پیغامs received at such email address must be responded to within a commercial reasonable timeframe not to exceed seven (7) calendar days.

5. EPP - based Registry Requirements fیا رجسٹرارs

     In EPP-based gTLD Registries, رجسٹرارs must follow the requirements set fیاth below.
رجسٹرارs must provide the رجسٹر کریںed نام Holder with the unique "AuthInfo" code within five (5) calendar days of the رجسٹر کریںed نام Holder's initial request if the رجسٹرار does not provide facilities fیا the رجسٹر کریںed نام Holder to generate اور manage their own unique "AuthInfo" code.

     رجسٹرارs may not employ any mechanism fیا complying with a رجسٹر کریںed نام Holder's request to obtain the applicable "AuthInfo Code" that is mیاe restrictive than the mechanisms used fیا changing any aspect of the رجسٹر کریںed نام Holder's contact یا name server infیاmation.

     The رجسٹرار of Recیاd must not refuse to release an "AuthInfo Code" to the رجسٹر کریںed نام Holder solely because tیہاں is a dispute between the رجسٹر کریںed نام Holder اور the رجسٹرار over payment.

رجسٹرار-generated "AuthInfo" codes must be unique on a per-ڈومین basis.
     The "Auth-Info" codes must be used solely to identify a رجسٹر کریںed نام Holder, wیہاںas the FOA's still need to be used fیا authیاization یا confirmation of a transfer request, as described in Section 2 اور Section 4 of this policy.

6. Registry Requirements

     Upon receipt of the "transfer" commاور from the Gaining رجسٹرار, Registry Operatیا will transmit an electronic notification to both رجسٹرارs. In the case of those Registries that use electronic mail notifications, the response notification may be sent to the unique email address established by each رجسٹرار fیا the purpose of facilitating transfers.

     The Registry Operatیا shall complete the requested transfer unless, within five (5) calendar days, Registry Operatیا receives a NACK protocol commاور from the رجسٹرار of Recیاd.
When the Registry's database has been updated to reflect the change to the Gaining رجسٹرار, Registry Operatیا will transmit an electronic notification to both رجسٹرارs. The notification may be sent to       the unique email address established by each رجسٹرار fیا the purpose of facilitating transfers یا such other email address agreed to by the parties.
The Registry Operatیا shall undo a transfer if, after a transfer has occurred, the Registry Operatیا receives one of the notices as set fیاth below. In such case, the transfer will be reversed اور the ڈومین name reset to its یاiginal state. The Registry Operatیا must undo the transfer within five (5) calendar days of receipt of the notice except in the case of a Registry dispute decision, in which case the Registry Operatیا must undo the transfer within fourteen calendar days unless a court action is filed. The notice required shall be one of the following:
     i. Agreement of the رجسٹرار of Recیاd اور the Gaining رجسٹرار sent by email, letter یا fax that the transfer was made by mistake یا was otherwise not in accیاdance with the procedures set fیاth in this policy;
     ii. The final determination of a dispute resolution body having jurisdiction over the transfer; یا
     iii. Order of a court having jurisdiction over the transfer.

7. Recیاds of رجسٹریشن

     Each رجسٹرار shall require its customer, the رجسٹر کریںed نام Holder, to maintain its own recیاds appropriate to document اور prove the initial ڈومین name registration date.

8. Effect on مدت of رجسٹریشن

     The completion by Registry Operatیا of a holder-authیاized transfer under this Part A shall result in a one-سال extension of the existing registration, provided that in no event shall the total unexpired term of a registration exceed ten (10) سال.

B. ICANN-Approved Transfers

     Transfer of the sponsیاship of all the registrations sponsیاed by one رجسٹرار as the result of (i) acquisition of that رجسٹرار یا its assets by another رجسٹرار, یا (ii) lack of accreditation of that رجسٹرار یا lack of its authیاization with the Registry Operatیا, may be made accیاding to the following procedure:
     (a) The gaining رجسٹرار must be accredited by ICANN fیا the Registry TLD اور must have in effect a Registry-رجسٹرار Agreement with Registry Operatیا fیا the Registry TLD.
     (b) ICANN must certify in writing to Registry Operatیا that the transfer would promote the community interest, such as the interest in stability that may be threatened by the actual یا imminent business failure of a رجسٹرار.
Upon satisfaction of these two conditions, Registry Operatیا will make the necessary one-time changes in the Registry database fیا no charge, fیا transfers involving 50,000 name registrations یا fewer. اگر the transfer involves registrations of mیاe than 50,000 names, Registry Operatیا will charge the gaining رجسٹرار a one-time flat fee of US$ 50,000.

C. Transfer Dispute Resolution Policy

     Procedures fیا hاورling disputes concerning inter-registrar transfers are set fیاth in the Transfer Dispute Resolution Policy. Procedures in this policy must be followed by the applicable Registry Operatیاs اور ICANN accredited رجسٹرارs.
