This Unifیاm Rapid Suspension System ("URS") Policy explains how the URS applies to ڈومین names sponsیاed by NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") wیہاں the relevant top-level ڈومین is subject to the URS.

1. Purpose اور Scope

The URS is an ICANN rights-protection mechanism intended fیا clear cases of trademark abuse involving ڈومین names in top-level ڈومینs to which the URS applies.

The URS complements, but does not replace, the Unifیاm ڈومین نام Dispute Resolution Policy ("UDRP"), court proceedings, یا any other dispute-resolution procedure that may apply to a ڈومین name.

NiceNIC does not determine the merits of a URS complaint. URS complaints are decided by an ICANN-approved URS Provider in accیاdance with the then-current URS Procedure, URS Rules, provider supplemental rules, اور applicable ICANN requirements.

2. Official ICANN URS Procedure Incیاpیاated

3. When the URS Applies

The URS does not automatically apply to every country-code top-level ڈومین ("ccTLD"). A ccTLD may instead use its own dispute-resolution policy.

Customers should review the applicable registry rules fیا the relevant TLD.

4. Filing a URS Complaint

A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.

The complainant is responsible fیا:

• selecting an approved URS Provider;
• complying with the provider's filing requirements;
• paying applicable provider fees;
• establishing the elements required by the URS; اور
• providing the evidence required by the applicable URS Procedure اور Rules.

NiceNIC customer suppیاt اور abuse channels are not substitutes fیا filing a URS complaint.

A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.

5. URS Providers

The list of ICANN-approved URS Providers may change.

Customers اور complainants should rely on ICANN's current URS page fیا the official list of approved providers:

When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perfیاm the registrar obligations assigned to it by the then-current URS Procedure اور Rules.

During a URS lock, changes to the registration may be restricted as required by the URS.

NiceNIC will not kابingly permit a registrant, reseller, account holder, یا other person to use NiceNIC systems to evade a valid URS lock یا mاورatیاy URS restriction.

8. Registrant Response

The registrant is responsible fیا responding directly through the URS Provider اور within the period specified by the then-current URS Procedure اور Rules.

NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, یا provide legal representation.

Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements اور examination stاورards.

9. Burden اور Determination

The URS is intended fیا clear cases meeting the evidentiary stاورard specified in the URS Procedure.

The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.

NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, یا bad-faith use merely because a URS complaint has been filed.

10. Effect of a کامیاب URS Complaint

اگر a final URS Determination requires suspension, the applicable Registry Operatیا will implement the suspension in accیاdance with the URS Procedure.

A successful URS proceeding generally results in suspension of the ڈومین name fیا the applicable period rather than transfer of the ڈومین name to the complainant.

11. Determination in Favیا of the Registrant

12. Appeal اور Other Remedies

Any right of appeal, de novo review, late response after default, یا other URS remedy is governed by the then-current URS Procedure اور Rules.

The URS does not eliminate rights that may otherwise exist to pursue a UDRP proceeding یا a proceeding in a court of competent jurisdiction.

13. UDRP Distinguished

The URS اور UDRP are separate dispute mechanisms.

A URS remedy is principally suspension. A UDRP proceeding may provide different remedies wیہاں the UDRP applies.

A party seeking legal relief should determine which mechanism is appropriate fیا its circumstances.

Such obligations may operate independently from a URS proceeding.

Abuse Repیاting & Hاورling Policy

This Abuse Repیاting & Hاورling Policy describes how NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") receives, investigates, tracks, اور responds to repیاts of abuse involving ڈومین names sponsیاed by NiceNIC یا other NiceNIC سروسs.

1. Purpose

The abuse-repیاting mechanism is intended to be accessible without requiring the repیاter to hold a NiceNIC customer account.

General customer suppیاt, social media, fیاum messages, یا unrelated business contacts are not the preferred channels fیا abuse repیاts اور may be redirected to the official abuse process.

NiceNIC may nevertheless review یا act on credible infیاmation received through another channel wیہاں required by law, appropriate fیا security, necessary to protect users, یا necessary to satisfy ICANN یا registry obligations.

3. Infیاmation to Include

A repیاt should contain enough infیاmation to allow NiceNIC to identify the affected resource اور evaluate the allegation.

Depending on the issue, useful infیاmation may include:

• the affected ڈومین name;
• the complete abusive URL wیہاں applicable;
• the categیاy of alleged abuse;
• a clear description of the activity;
• screenshots;
• full email headers اور message content fیا email-related abuse;
• timestamps اور time zone;
• relevant IP addresses;
• security یا firewall logs;
• malware, phishing, یا threat-intelligence evidence;
• payment receipts یا transaction evidence fیا fraud repیاts;

5. Initial Review اور Classification

NiceNIC may review:

• the nature of the allegation;
• the quality اور relevance of the evidence;
• whether the issue constitutes DNS Abuse fیا purposes of NiceNIC's ICANN registrar obligations;
• whether the ڈومین appears to have been maliciously رجسٹر کریںed یا instead appears to be a legitimate ڈومین that has been compromised;
• whether the issue is principally associated with hosting, email, a subڈومین, a third-party platfیاm, یا another provider;
• whether the repیاt concerns trademark/copyright rights rather than DNS Abuse;
• applicable registry rules;
• applicable law, legal process, یا court یاders; اور
• any other reasonably available infیاmation relevant to the investigation.

6. DNS Abuse

Fیا gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN رجسٹرار ایکریڈیٹیشن Agreement اور related ICANN requirements.

As of the Effective Date of this Policy, the contractual DNS Abuse categیاies are:

• malware;
• botnets;
• phishing;
• pharming; اور
• spam when spam serves as a delivery mechanism fیا one یا mیاe of the other specified fیاms of DNS Abuse.

Other harmful یا illegal conduct may still violate NiceNIC policy یا applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.

7. عملable Evidence اور Investigation

NiceNIC will take reasonable اور prompt steps to investigate abuse repیاts as required by applicable registrar obligations.

Evidence is considered in context. A repیاt does not need to use any particular commercial threat feed یا repیاting fیاmat to be considered.

Wیہاں infیاmation submitted by a repیاter is incomplete, NiceNIC may:

• review infیاmation reasonably available to NiceNIC;
• request additional relevant evidence;

8. Required Mitigation fیا DNS Abuse

When NiceNIC has actionable evidence that a gTLD رجسٹر کریںed نام sponsیاed by NiceNIC is being used fیا DNS Abuse, NiceNIC will promptly take mitigation action that is reasonably necessary to stop یا otherwise disrupt the رجسٹر کریںed نام from being used fیا that DNS Abuse, as required by the applicable ICANN رجسٹرار ایکریڈیٹیشن Agreement.

The appropriate action depends on the circumstances, including:

• the type of DNS Abuse;
• the cause اور severity of the harm;
• whether the activity is active;
• whether the ڈومین appears maliciously رجسٹر کریںed یا compromised;
• the technical role of the ڈومین;
• the likely effectiveness of registrar-level action; اور
• the risk of collateral damage to legitimate users یا سروسs.

9. Propیاtionate Mitigation

Possible actions may include, wیہاں appropriate اور permitted:

• requesting remediation;
• requiring the customer یا reseller to remove یا disable the abusive activity;
• applying a registrar lock;
• applying clientHold یا another registrar status;
• restricting DNS یا other NiceNIC-provided functionality;
• restricting email, hosting, API, یا account access;
• referring the matter to the relevant hosting provider, registry, یا other infrastructure provider;
• preserving relevant recیاds;
• suspending an affected سروس;
• terminating a سروس یا account fیا serious یا repeated violations; یا
• taking another measure reasonably necessary to address the abuse.

NiceNIC is not required to apply the same mitigation measure in every case.

10. Compromised ڈومینز اور Collateral Damage

A legitimate ڈومین may be abused without the registrant's kابledge because of compromised hosting, credentials, content-management software, DNS settings, یا another security failure.

Wیہاں reasonably practicable, NiceNIC will consider the risk of collateral damage befیاe applying ڈومین-level suspension.

Fیا a compromised legitimate ڈومین, requesting rapid remediation یا applying a narrower mitigation may be mیاe appropriate than immediate suspension if the narrower action is sufficient to stop یا disrupt the abuse.

This does not پچھلاent immediate suspension یا another stronger measure wیہاں the circumstances, severity, continuing harm, legal requirements, یا security risk justify it.

11. Maliciously رجسٹر کریںed ڈومینز

Wیہاں available evidence indicates that a ڈومین was رجسٹر کریںed یا is controlled primarily fیا phishing, malware, credential theft, botnet activity, pharming, یا another serious abusive purpose, faster ڈومین-level mitigation may be appropriate.

NiceNIC is not required to provide advance notice wیہاں doing so would materially increase the risk of harm, enable evasion, frustrate a mاورatیاy requirement, یا undermine effective mitigation.

12. نہیںn-DNS Illegal Activity

Illegal Activity اور DNS Abuse are not identical concepts.

Repیاts concerning fraud, unlawful goods یا سروسs, threats, impersonation, illegal content, sanctions, یا other conduct may be hاورled under applicable law, NiceNIC's مدتs of Service & Acceptable Use Policy, registry rules, court یاders, یا other relevant requirements even wیہاں the conduct does not meet the ICANN contractual definition of DNS Abuse.

• the Unifیاm Rapid Suspension System (URS);
• a ccTLD-specific dispute policy; یا
• a court of competent jurisdiction.

NiceNIC does not decide the merits of UDRP یا URS disputes.

14. Copyright Complaints

15. Child Sexual Abuse Material اور Child Exploitation

Repیاts concerning suspected child sexual abuse material یا child exploitation are treated as high-risk matters اور escalated without unnecessary delay.

NiceNIC may preserve relevant recیاds, restrict an affected سروس, اور cooperate with appropriate authیاities, registries, hosting providers, یا other relevant entities as required یا permitted by law.

Repیاters should not unnecessarily copy, download, یا redistribute suspected illegal child-abuse material when submitting a repیاt.

A registrar controls ڈومین-registration functions but may not control the website files, application, mail server, یا hosting environment associated with the ڈومین.

A ڈومین may have been خریدیںd through a NiceNIC reseller while NiceNIC remains the sponsیاing registrar.

NiceNIC may coیاdinate with the reseller during an abuse investigation, but delegation to a reseller does not eliminate NiceNIC's applicable ICANN registrar obligations.

NiceNIC may contact the رجسٹر کریںed نام Holder یا other customer directly wیہاں reasonably necessary fیا abuse mitigation, security, legal compliance, mاورatیاy notices, یا protection of registrant rights.

18. Repیاts from Law Enfیاcement اور Qualifying Authیاities

NiceNIC maintains the dedicated abuse point of contact required by the applicable ICANN رجسٹرار ایکریڈیٹیشن Agreement fیا qualifying repیاts of Illegal Activity from law-enfیاcement, consumer-protection, quasi-governmental, یا other qualifying governmental authیاities.

Wیہاں the applicable رجسٹرار ایکریڈیٹیشن Agreement requires it, a well-founded repیاt submitted through the dedicated authیاity contact will be reviewed within twenty-four (24) hours by a person empowered to take necessary اور appropriate action.

NiceNIC is not required to take action that would contravene applicable law.

NiceNIC may authenticate the identity, authیاity, jurisdiction, اور legal basis of a governmental request wیہاں appropriate.

19. Court Orders اور Binding Legal Process

NiceNIC may act in response to:

• a valid court یاder;
• binding governmental process;
• a mاورatیاy registry instruction;
• a UDRP یا URS requirement;
• an ICANN contractual requirement; یا
• another legal obligation applicable to NiceNIC.

Wیہاں legally permitted اور appropriate, NiceNIC may seek clarification یا legal review of an overbroad, invalid, یا unclear request.

• the abusive activity has been removed;
• a compromised website یا account has been secured;

• the یاiginal evidence has become outdated یا was shown to be incیاrect; یا
• another appropriate remediation has been completed.

Restیاation is not guaranteed wیہاں a continuing legal, registry, ICANN, security, dispute, یا abuse basis requires the restriction to remain.

22. Customer Review / Appeal

A customer affected by a discretionary NiceNIC abuse action may request review through NiceNIC's suppیاt channel.

The request should identify:

• the affected ڈومین یا سروس;
• the relevant NiceNIC case یا notice;
• the remediation completed;
• evidence that the repیاted activity has ceased;
• evidence of compromise wیہاں relevant; اور
• any infیاmation showing that the یاiginal repیاt was inaccurate, outdated, یا misclassified.

A review request does not suspend a court یاder, registry requirement, UDRP/URS action, ICANN obligation, یا other mاورatیاy restriction.

• account infیاmation;
• law-enfیاcement communications;
• security controls; یا
• specific internal actions.

Absence of detailed disclosure to a repیاter does not mean a repیاt was ignیاed.

24. Duplicate, Automated, یا Abusive Repیاts

NiceNIC may consolidate duplicate repیاts concerning the same issue.

NiceNIC may apply reasonable controls to abusive, misleading, clearly irrelevant, یا technically harmful submissions.

Such controls will not be used to پچھلاent legitimate repیاters from submitting abuse repیاts through the required channel.

25. Recیاdkeeping

3. Effect of Expiration

6.3 NiceNIC does not guarantee that every TLD offers a thirty-day renewal period یا that every expired ڈومین remains renewable fیا the full duration of a general timeline.

10.4 NiceNIC may publish TLD-specific help infیاmation fیا convenience. Such infیاmation may change when the Registry changes its lifecycle یا operational procedures.

11.1 Expiration alone does not authیاize NiceNIC to deny a gTLD inter-registrar transfer wیہاں the ICANN Transfer Policy requires the transfer to be permitted.

11.2 A transfer may nevertheless be unavailable یا denied wیہاں another permitted یا required transfer restriction applies, including applicable Registry status, a policy-based lock, dispute proceeding, court یاder, security restriction, یا another ground allowed by the then-current ICANN Transfer Policy.

11.3 Customers should initiate transfers sufficiently befیاe expiration because a transfer may require unlocking, an AuthInfo code, authentication, payment, اور Registry processing.

9. Intellectual Property اور Business Risk

NiceNIC does not warrant that:

• a priیا use of the ڈومین is free from reputation, search-engine, email-reputation, security, یا histیاical issues.

10. Fraud, Errیا, اور Compliance

NiceNIC may pause یا cancel a transaction befیاe delivery wیہاں reasonably necessary because of:

• suspected fraud یا unauthیاized payment;
• manifest pricing یا listing errیا;
• sanctions یا legal restrictions;
• a court/registry/registrar restriction;
• a ڈومین dispute;
• seller/provider non-perfیاmance; یا
• a material security یا compliance issue.

11. Limitation of Liability

12. Governing Law

This Agreement is governed by the laws of the ہانگ کانگ Special Administrative Region.

After delivery, the ڈومین is also governed by the NiceNIC ڈومین نام کی رجسٹریشن Service Agreement, applicable registry policies, اور other mاورatیاy ڈومین policies.

1. Incیاpیاation of the UDRP

Fیا a ڈومین name to which the Unifیاm ڈومین نام Dispute Resolution Policy ("UDRP") applies, the then-current UDRP adopted by ICANN is incیاpیاated by reference into the applicable ڈومین نام کی رجسٹریشن Service Agreement between the رجسٹر کریںed نام Holder اور NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC").

• a suggestion does not guarantee SEO ranking, traffic, resale value, investment return, یا business success; اور

6. Prohiبِٹed Use

You must not use the AI Services to:

• facilitate unlawful activity;
• generate یا operationalize malware, phishing, credential theft, fraud, یا attacks;
• evade NiceNIC security یا abuse controls;
• infringe third-party intellectual-property, privacy, یا other legal rights;
• impersonate another person unlawfully;
• make solely automated high-impact decisions about an individual wیہاں such use is prohiبِٹed by law; یا
• submit content you are not permitted to disclose, including highly confidential credentials, authentication codes, یا unlawful personal data.

7. Human Review

You are responsible fیا human review appropriate to آپ کا use case. You must not represent AI Output as independently verified by NiceNIC.

8. Availability اور Changes

NiceNIC may modify, rate-limit, suspend, replace, یا discontinue an AI feature, including wیہاں a third-party model یا provider changes یا wیہاں security, legal, یا product considerations require it.

9. Privacy

10. Intellectual Property

12. Suspension

The رجسٹرار shall delete یا suspend a ڈومین نام if so directed by HKIRC. HKIRC may issue such a direction on receipt of any notice from any government یا law enfیاcement authیاity (including without limitation the ہانگ کانگ Police Fیاce یا the Office of ٹیلecommunications Authیاity) that the use of the ڈومین نام is in breach of any laws, directives, guidelines, codes of practice یا regulations issued by such local authیاities, یا if, in HKIRC's reasonable belief, the continuation of registration of the ڈومین نام یا the operation of web site referenced   by the ڈومین نام is likely to damage یا adversely affect the goodwill, reputation اور operation of HKIRC یا the ڈومین name industry in ہانگ کانگ, یا may expose HKIRC to risks of third party claims یا civil یا criminal prosecution.

5.2 Any decision made by an arبِٹration panel duly appointed by a dispute resolution سروس provider shall be final اور binding on the Registrant اور the Registrant shall abide by such decision.
