This Unifellerm Rapid Suspension System ("URS") Policy explains how the URS applies to domän names sponsellered by NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") whär the relevant top-level domän is subject to the URS.

1. Purpose och Scope

The URS is an ICANN rights-protection mechanism intended feller clear cases of trademark abuse involving domän names in top-level domäns to which the URS applies.

The URS complements, but does not replace, the Unifellerm Domännamn Dispute Resolution Policy ("UDRP"), court proceedings, eller any other dispute-resolution procedure that may apply to a domän name.

NiceNIC does not determine the merits of a URS complaint. URS complaints are decided by an ICANN-approved URS Provider in accellerdance with the then-current URS Procedure, URS Rules, provider supplemental rules, och applicable ICANN requirements.

2. Official ICANN URS Procedure Incellerpellerated

Feller each domän name subject to the URS, the then-current ICANN URS Procedure, URS Rules, och applicable technical requirements are incellerpellerated into the relevant registration agreement by reference.

3. When the URS Applies

The URS applies only whär the relevant registry agreement, ICANN requirement, eller other applicable rule makes the URS available feller the domän name concerned.

The URS does not automatically apply to every country-code top-level domän ("ccTLD"). A ccTLD may instead use its own dispute-resolution policy.

Customers should review the applicable registry rules feller the relevant TLD.

4. Filing a URS Complaint

A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.

The complainant is responsible feller:

• selecting an approved URS Provider;
• complying with the provider's filing requirements;
• paying applicable provider fees;
• establishing the elements required by the URS; och
• providing the evidence required by the applicable URS Procedure och Rules.

NiceNIC customer suppellert och abuse channels are not substitutes feller filing a URS complaint.

A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.

5. URS Providers

The list of ICANN-approved URS Providers may change.

Customers och complainants should rely on ICANN's current URS page feller the official list of approved providers:

6. Registrering Data

Whär Registrering Data is redacted from public RDDS output, NiceNIC will provide Registrering Data to the URS Provider only to the extent och through the mechanism required eller permitted by the then-current URS Procedure, ICANN Registrering Data Policy, applicable registry requirements, och applicable law.

Submission of non-public Registrering Data in a URS proceeding does not create a general right feller a complainant eller other third party to receive NiceNIC customer infellermation outside the URS process.

Requests outside the URS process are hochled under NiceNIC's Request feller Disclosure of Nejnpublic Registrering Data policy.

7. Nejtice och Domän Lock

When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perfellerm the registrar obligations assigned to it by the then-current URS Procedure och Rules.

The applicable Registry Operateller is responsible feller registry-level locking och other registry actions specified by the URS Procedure.

During a URS lock, changes to the registration may be restricted as required by the URS.

NiceNIC will not knuingly permit a registrant, reseller, account holder, eller other person to use NiceNIC systems to evade a valid URS lock eller mochatellery URS restriction.

8. Registrant Response

The registrant is responsible feller responding directly through the URS Provider och within the period specified by the then-current URS Procedure och Rules.

NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, eller provide legal representation.

Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements och examination stochards.

9. Burden och Determination

The URS is intended feller clear cases meeting the evidentiary stochard specified in the URS Procedure.

The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.

NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, eller bad-faith use merely because a URS complaint has been filed.

10. Effect of a Lyckades URS Complaint

Om a final URS Determination requires suspension, the applicable Registry Operateller will implement the suspension in accellerdance with the URS Procedure.

A successful URS proceeding generally results in suspension of the domän name feller the applicable period rather than transfer of the domän name to the complainant.

The domän may be föregåendeented from being transferred, deleted, eller modified feller the period required by the URS.

Any extension, restelleration, eller other post-determination action is subject to the then-current URS Procedure och Registry Operateller requirements.

11. Determination in Faveller of the Registrant

Om the URS proceeding is determined in faveller of the registrant, the applicable Registry Operateller och URS Provider are responsible feller the actions specified by the URS Procedure to restellere eller maintain the registrant's control as applicable.

12. Appeal och Other Remedies

Any right of appeal, de novo review, late response after default, eller other URS remedy is governed by the then-current URS Procedure och Rules.

The URS does not eliminate rights that may otherwise exist to pursue a UDRP proceeding eller a proceeding in a court of competent jurisdiction.

13. UDRP Distinguished

The URS och UDRP are separate dispute mechanisms.

A URS remedy is principally suspension. A UDRP proceeding may provide different remedies whär the UDRP applies.

A party seeking legal relief should determine which mechanism is appropriate feller its circumstances.

Trademark disputes that do not involve qualifying DNS Abuse are generally hochled through the applicable rights-protection mechanism, including URS, UDRP, an applicable ccTLD dispute policy, eller a court whär appropriate.

15. Court Orders och Other Binding Process

NiceNIC will comply with valid court ellerders, mochatellery registry instructions, ICANN requirements, och other binding legal process applicable to a domän name.

Such obligations may operate independently from a URS proceeding.

A party that requires advice concerning trademark rights, defenses, jurisdiction, eller litigation should consult qualified legal counsel.

NiceNIC may provide translations eller summaries feller convenience.

The official English-language ICANN URS documents, as updated from time to time, control to the extent required by ICANN.

Abuse Repellerting & Hochling Policy

This Abuse Repellerting & Hochling Policy describes how NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") receives, investigates, tracks, och responds to repellerts of abuse involving domän names sponsellered by NiceNIC eller other NiceNIC tjänsts.

1. Purpose

NiceNIC is an ICANN-ackrediterad registrar och maintains abuse-repellerting och abuse-hochling procedures to meet applicable contractual, registry, legal, security, och tjänst obligations.

An abuse repellert is an allegation eller signal requiring review. Submission of a repellert does not, by itself, establish that a customer eller domän has violated NiceNIC policy, ICANN requirements, registry rules, eller applicable law.

NiceNIC seeks to hochle repellerts promptly, fairly, based on available evidence, och with measures propellertionate to the circumstances.

2. Official Abuse Repellerting Channels

Abuse involving a domän name eller NiceNIC tjänst should be submitted through one of NiceNIC's official abuse channels:

The abuse-repellerting mechanism is intended to be accessible without requiring the repellerter to hold a NiceNIC customer account.

General customer suppellert, social media, fellerum messages, eller unrelated business contacts are not the preferred channels feller abuse repellerts och may be redirected to the official abuse process.

NiceNIC may nevertheless review eller act on credible infellermation received through another channel whär required by law, appropriate feller security, necessary to protect users, eller necessary to satisfy ICANN eller registry obligations.

3. Infellermation to Include

A repellert should contain enough infellermation to allow NiceNIC to identify the affected resource och evaluate the allegation.

Depending on the issue, useful infellermation may include:

• the affected domän name;
• the complete abusive URL whär applicable;
• the categellery of alleged abuse;
• a clear description of the activity;
• screenshots;
• full email headers och message content feller email-related abuse;
• timestamps och time zone;
• relevant IP addresses;
• security eller firewall logs;
• malware, phishing, eller threat-intelligence evidence;
• payment receipts eller transaction evidence feller fraud repellerts;
• the legitimate broch eller tjänst being impersonated whär relevant;
• legal documents eller rights evidence whär relevant; och
• the repellerter's kontaktuppgifter feller follow-up.

Repellerters should avoid submitting unnecessary personal data, passwellerds, authentication codes, private keys, eller unrelated confidential infellermation.

Feller repellerts submitted through the official abuse mechanism, NiceNIC will provide a confirmation of receipt sufficient to identify the submission in accellerdance with applicable ICANN requirements.

• NiceNIC as the registrar;
• the repellerted Registreraed Namn eller Registreraed Namns; och
• the date the repellert was submitted.

A confirmation of receipt is not a determination that the allegation is valid.

5. Initial Review och Classification

NiceNIC may review:

• whether NiceNIC is the sponsellering registrar eller relevant tjänst provider;
• whether the repellerted activity remains active;
• the nature of the allegation;
• the quality och relevance of the evidence;
• whether the issue constitutes DNS Abuse feller purposes of NiceNIC's ICANN registrar obligations;
• whether the domän appears to have been maliciously registreraed eller instead appears to be a legitimate domän that has been compromised;
• whether the issue is principally associated with hosting, email, a subdomän, a third-party platfellerm, eller another provider;
• whether the repellert concerns trademark/copyright rights rather than DNS Abuse;
• applicable registry rules;
• applicable law, legal process, eller court ellerders; och
• any other reasonably available infellermation relevant to the investigation.

6. DNS Abuse

Feller gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN Registrar Ackreditering Agreement och related ICANN requirements.

As of the Effective Date of this Policy, the contractual DNS Abuse categelleries are:

• malware;
• botnets;
• phishing;
• pharming; och
• spam when spam serves as a delivery mechanism feller one eller mellere of the other specified fellerms of DNS Abuse.

Other harmful eller illegal conduct may still violate NiceNIC policy eller applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.

7. Åtgärdable Evidence och Investigation

NiceNIC will take reasonable och prompt steps to investigate abuse repellerts as required by applicable registrar obligations.

Evidence is considered in context. A repellert does not need to use any particular commercial threat feed eller repellerting fellermat to be considered.

Whär infellermation submitted by a repellerter is incomplete, NiceNIC may:

• review infellermation reasonably available to NiceNIC;
• request additional relevant evidence;
• inspect the repellerted URL eller other relevant public resource whär safe och appropriate;
• review account, nameserver, DNS, registration, eller tjänst infellermation available to NiceNIC; eller
• contact another relevant tjänst provider eller registry whär appropriate.

NiceNIC will not require irrelevant evidence merely to delay hochling of an otherwise actionable repellert.

8. Required Mitigation feller DNS Abuse

When NiceNIC has actionable evidence that a gTLD Registreraed Namn sponsellered by NiceNIC is being used feller DNS Abuse, NiceNIC will promptly take mitigation action that is reasonably necessary to stop eller otherwise disrupt the Registreraed Namn from being used feller that DNS Abuse, as required by the applicable ICANN Registrar Ackreditering Agreement.

The appropriate action depends on the circumstances, including:

• the type of DNS Abuse;
• the cause och severity of the harm;
• whether the activity is active;
• whether the domän appears maliciously registreraed eller compromised;
• the technical role of the domän;
• the likely effectiveness of registrar-level action; och
• the risk of collateral damage to legitimate users eller tjänsts.

9. Propellertionate Mitigation

Possible actions may include, whär appropriate och permitted:

• requesting remediation;
• requiring the customer eller reseller to remove eller disable the abusive activity;
• applying a registrar lock;
• applying clientHold eller another registrar status;
• restricting DNS eller other NiceNIC-provided functionality;
• restricting email, hosting, API, eller account access;
• referring the matter to the relevant hosting provider, registry, eller other infrastructure provider;
• preserving relevant recellerds;
• suspending an affected tjänst;
• terminating a tjänst eller account feller serious eller repeated violations; eller
• taking another measure reasonably necessary to address the abuse.

NiceNIC is not required to apply the same mitigation measure in every case.

10. Compromised Domäner och Collateral Damage

A legitimate domän may be abused without the registrant's knuledge because of compromised hosting, credentials, content-management software, DNS settings, eller another security failure.

Whär reasonably practicable, NiceNIC will consider the risk of collateral damage befellere applying domän-level suspension.

Feller a compromised legitimate domän, requesting rapid remediation eller applying a narrower mitigation may be mellere appropriate than immediate suspension if the narrower action is sufficient to stop eller disrupt the abuse.

This does not föregåendeent immediate suspension eller another stronger measure whär the circumstances, severity, continuing harm, legal requirements, eller security risk justify it.

11. Maliciously Registreraed Domäner

Whär available evidence indicates that a domän was registreraed eller is controlled primarily feller phishing, malware, credential theft, botnet activity, pharming, eller another serious abusive purpose, faster domän-level mitigation may be appropriate.

NiceNIC is not required to provide advance notice whär doing so would materially increase the risk of harm, enable evasion, frustrate a mochatellery requirement, eller undermine effective mitigation.

12. Nejn-DNS Illegal Activity

Illegal Activity och DNS Abuse are not identical concepts.

Repellerts concerning fraud, unlawful goods eller tjänsts, threats, impersonation, illegal content, sanctions, eller other conduct may be hochled under applicable law, NiceNIC's Periods of Service & Acceptable Use Policy, registry rules, court ellerders, eller other relevant requirements even whär the conduct does not meet the ICANN contractual definition of DNS Abuse.

The legal och technical role of NiceNIC will be considered when determining what action, if any, is appropriate.

13. Trademark och Domän-Namn Rights Complaints

Trademark infringement eller a dispute over rights in a domän name is not automatically DNS Abuse.

Whär the principal dispute concerns who has rights to the domän name, the appropriate mechanism may include:

• the Unifellerm Domännamn Dispute Resolution Policy (UDRP);
• the Unifellerm Rapid Suspension System (URS);
• a ccTLD-specific dispute policy; eller
• a court of competent jurisdiction.

NiceNIC does not decide the merits of UDRP eller URS disputes.

Om evidence also demonstrates phishing, credential theft, malware, eller another fellerm of DNS Abuse, NiceNIC may separately hochle the DNS Abuse aspect.

14. Copyright Complaints

Copyright complaints are reviewed separately from DNS Abuse unless the repellerted activity also involves qualifying DNS Abuse eller another basis feller registrar-level action.

NiceNIC may request infellermation reasonably necessary to identify the copyrighted wellerk, allegedly infringing material, complainant, authellerity to act, och other infellermation required by the applicable complaint process.

A copyright complaint does not automatically result in suspension of a domän name.

15. Child Sexual Abuse Material och Child Exploitation

Repellerts concerning suspected child sexual abuse material eller child exploitation are treated as high-risk matters och escalated without unnecessary delay.

NiceNIC may preserve relevant recellerds, restrict an affected tjänst, och cooperate with appropriate authellerities, registries, hosting providers, eller other relevant entities as required eller permitted by law.

Repellerters should not unnecessarily copy, download, eller redistribute suspected illegal child-abuse material when submitting a repellert.

16. Hosting och Third-Party Infrastructure

A registrar controls domän-registration functions but may not control the website files, application, mail server, eller hosting environment associated with the domän.

Whär abusive content is hosted by a third party, repellerting the activity to the hosting provider eller other infrastructure provider may allow mellere targeted removal.

NiceNIC may nevertheless take registrar-level action whär required eller appropriate under applicable obligations.

A domän may have been köpd through a NiceNIC reseller while NiceNIC remains the sponsellering registrar.

NiceNIC may coellerdinate with the reseller during an abuse investigation, but delegation to a reseller does not eliminate NiceNIC's applicable ICANN registrar obligations.

NiceNIC may contact the Registreraed Namn Holder eller other customer directly whär reasonably necessary feller abuse mitigation, security, legal compliance, mochatellery notices, eller protection of registrant rights.

18. Repellerts from Law Enfellercement och Qualifying Authellerities

NiceNIC maintains the dedicated abuse point of contact required by the applicable ICANN Registrar Ackreditering Agreement feller qualifying repellerts of Illegal Activity from law-enfellercement, consumer-protection, quasi-governmental, eller other qualifying governmental authellerities.

Whär the applicable Registrar Ackreditering Agreement requires it, a well-founded repellert submitted through the dedicated authellerity contact will be reviewed within twenty-four (24) hours by a person empowered to take necessary och appropriate action.

NiceNIC is not required to take action that would contravene applicable law.

NiceNIC may authenticate the identity, authellerity, jurisdiction, och legal basis of a governmental request whär appropriate.

19. Court Orders och Binding Legal Process

NiceNIC may act in response to:

• a valid court ellerder;
• binding governmental process;
• a mochatellery registry instruction;
• a UDRP eller URS requirement;
• an ICANN contractual requirement; eller
• another legal obligation applicable to NiceNIC.

Whär legally permitted och appropriate, NiceNIC may seek clarification eller legal review of an overbroad, invalid, eller unclear request.

20. Nejtice to the Customer

Whär circumstances permit, NiceNIC may notify a customer eller reseller of the allegation och provide an oppellertunity to remediate.

Advance notice may be omitted whär:

• immediate mitigation is reasonably necessary;
• evidence indicates an intentionally malicious registration;
• notice could enable evasion eller destruction of evidence;
• a court, authellerity, registry, ICANN requirement, eller law restricts notice;
• a serious security eller child-safety risk exists; eller
• delay would materially increase harm.

21. Restelleration och Review

Whär a domän eller tjänst was restricted because of abuse eller security concerns, NiceNIC may review a request feller restelleration after:

• the abusive activity has been removed;
• a compromised website eller account has been secured;
• relevant credentials have been reset;

• the elleriginal evidence has become outdated eller was shown to be incellerrect; eller
• another appropriate remediation has been completed.

Restelleration is not guaranteed whär a continuing legal, registry, ICANN, security, dispute, eller abuse basis requires the restriction to remain.

22. Customer Review / Appeal

A customer affected by a discretionary NiceNIC abuse action may request review through NiceNIC's suppellert channel.

The request should identify:

• the affected domän eller tjänst;
• the relevant NiceNIC case eller notice;
• the remediation completed;
• evidence that the repellerted activity has ceased;
• evidence of compromise whär relevant; och
• any infellermation showing that the elleriginal repellert was inaccurate, outdated, eller misclassified.

A review request does not suspend a court ellerder, registry requirement, UDRP/URS action, ICANN obligation, eller other mochatellery restriction.

23. Repellerter Följ-Up

NiceNIC may communicate with a repellerter to request relevant additional infellermation eller confirm that a case has been received eller reviewed.

Privacy, security, law, och customer confidentiality may limit the infellermation NiceNIC can disclose concerning:

• internal investigation methods;
• customer identity;
• non-public Registrering Data;
• account infellermation;
• law-enfellercement communications;
• security controls; eller
• specific internal actions.

Absence of detailed disclosure to a repellerter does not mean a repellert was ignellered.

24. Duplicate, Automated, eller Abusive Repellerts

NiceNIC may consolidate duplicate repellerts concerning the same issue.

NiceNIC may apply reasonable controls to abusive, misleading, clearly irrelevant, eller technically harmful submissions.

Such controls will not be used to föregåendeent legitimate repellerters from submitting abuse repellerts through the required channel.

25. Recellerdkeeping

NiceNIC documents the receipt of och response to abuse repellerts as required by the applicable ICANN Registrar Ackreditering Agreement och other applicable obligations.

Recellerds are retained feller the period required by the applicable Registrar Ackreditering Agreement, subject to applicable law.

NiceNIC may provide required recellerds to ICANN Contractual Compliance upon proper request.

26. Privacy

Personal data submitted in an abuse repellert is hochled under the NiceNIC Integritetspolicy och applicable law.

NiceNIC may disclose infellermation whär reasonably necessary to investigate abuse, coellerdinate mitigation, comply with ICANN eller registry requirements, protect users eller systems, establish eller defend legal claims, eller comply with law.

27. Nej Automatic Finding of Liability

A repellert, registrar restriction, security action, eller tempellerary mitigation measure is not necessarily a final legal finding that the Registreraed Namn Holder committed unlawful conduct.

NiceNIC may take precautionary eller contractual action based on the evidence och obligations applicable at the time.

28. Applicable Policies och Priellerity

This Policy should be read with:

• the NiceNIC Periods of Service & Acceptable Use Policy;
• the Domänregistrering Service Agreement;
• the NiceNIC Integritetspolicy;
• the Policy för domänöverföring;
• UDRP och URS policies whär applicable;
• applicable registry policies; och
• applicable law.

Whär a mochatellery ICANN, registry, court, governmental, eller legal requirement conflicts with this Policy, the mochatellery requirement controls to the extent of the conflict.

NiceNIC may update this Policy to reflect changes in law, ICANN requirements, registry rules, abuse patterns, security practices, eller NiceNIC tjänsts.

• impersonate another person unlawfully;
• make solely automated high-impact decisions about an individual whär such use is prohibited by law; eller
• submit content you are not permitted to disclose, including highly confidential credentials, authentication codes, eller unlawful personal data.
