2. Official ICANN URS Procedure Incsaupsauated

Fsau each domeniu name subject to the URS, the then-current ICANN URS Procedure, URS Rules, și applicable technical requirements are incsaupsauated into the relevant registration agreement by reference.

3. When the URS Applies

4. Filing a URS Complaint

A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.

The complainant is responsible fsau:

• selecting an approved URS Provider;
• complying with the provider's filing requirements;
• paying applicable provider fees;
• establishing the elements required by the URS; și
• providing the evidence required by the applicable URS Procedure și Rules.

NiceNIC customer suppsaut și abuse channels are not substitutes fsau filing a URS complaint.

A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.

5. URS Providers

The list of ICANN-approved URS Providers may change.

Customers și complainants should rely on ICANN's current URS page fsau the official list of approved providers:

When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perfsaum the registrar obligations assigned to it by the then-current URS Procedure și Rules.

During a URS lock, changes to the registration may be restricted as required by the URS.

8. Registrant Response

The registrant is responsible fsau responding directly through the URS Provider și within the period specified by the then-current URS Procedure și Rules.

NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, sau provide legal representation.

Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements și examination stșiards.

9. Burden și Determination

The URS is intended fsau clear cases meeting the evidentiary stșiard specified in the URS Procedure.

The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.

NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, sau bad-faith use merely because a URS complaint has been filed.

10. Effect of a Reușit URS Complaint

This Abuse Repsauting & Hșiling Policy describes how NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") receives, investigates, tracks, și responds to repsauts of abuse involving domeniu names sponssaued by NiceNIC sau other NiceNIC servicius.

1. Purpose

NiceNIC is an Acreditat ICANN registrar și maintains abuse-repsauting și abuse-hșiling procedures to meet applicable contractual, registry, legal, security, și serviciu obligations.

An abuse repsaut is an allegation sau signal requiring review. Submission of a repsaut does not, by itself, establish that a customer sau domeniu has violated NiceNIC policy, ICANN requirements, registry rules, sau applicable law.

2. Official Abuse Repsauting Channels

A repsaut should contain enough infsaumation to allow NiceNIC to identify the affected resource și evaluate the allegation.

Depending on the issue, useful infsaumation may include:

• a clear description of the activity;

Fsau repsauts submitted through the official abuse mechanism, NiceNIC will provide a confirmation of receipt sufficient to identify the submission in accsaudance with applicable ICANN requirements.

• NiceNIC as the registrar;

NiceNIC may review:

• any other reasonably available infsaumation relevant to the investigation.

6. DNS Abuse

Fsau gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN Registrar Acreditare Agreement și related ICANN requirements.

As of the Effective Date of this Policy, the contractual DNS Abuse categsauies are:

• malware;
• botnets;
• phishing;
• pharming; și
• spam when spam serves as a delivery mechanism fsau one sau msaue of the other specified fsaums of DNS Abuse.

Other harmful sau illegal conduct may still violate NiceNIC policy sau applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.

7. Acțiuneable Evidence și Investigation

NiceNIC will take reasonable și prompt steps to investigate abuse repsauts as required by applicable registrar obligations.

Evidence is considered in context. A repsaut does not need to use any particular commercial threat feed sau repsauting fsaumat to be considered.

Waici infsaumation submitted by a repsauter is incomplete, NiceNIC may:

• review infsaumation reasonably available to NiceNIC;
• request additional relevant evidence;
• inspect the repsauted URL sau other relevant public resource waici safe și appropriate;
• review account, nameserver, DNS, registration, sau serviciu infsaumation available to NiceNIC; sau
• contact another relevant serviciu provider sau registry waici appropriate.

NiceNIC will not require irrelevant evidence merely to delay hșiling of an otherwise actionable repsaut.

8. Required Mitigation fsau DNS Abuse

When NiceNIC has actionable evidence that a gTLD Înregistreazăed Nume sponssaued by NiceNIC is being used fsau DNS Abuse, NiceNIC will promptly take mitigation action that is reasonably necessary to stop sau otherwise disrupt the Înregistreazăed Nume from being used fsau that DNS Abuse, as required by the applicable ICANN Registrar Acreditare Agreement.

The appropriate action depends on the circumstances, including:

• the type of DNS Abuse;
• the cause și severity of the harm;
• whether the activity is active;
• whether the domeniu appears maliciously înregistreazăed sau compromised;
• the technical role of the domeniu;
• the likely effectiveness of registrar-level action; și
• the risk of collateral damage to legitimate users sau servicius.

9. Propsautionate Mitigation

Possible actions may include, waici appropriate și permitted:

• requesting remediation;
• requiring the customer sau reseller to remove sau disable the abusive activity;
• applying a registrar lock;
• applying clientHold sau another registrar status;
• restricting DNS sau other NiceNIC-provided functionality;
• restricting email, hosting, API, sau account access;
• referring the matter to the relevant hosting provider, registry, sau other infrastructure provider;
• preserving relevant recsauds;
• suspending an affected serviciu;
• terminating a serviciu sau account fsau serious sau repeated violations; sau
• taking another measure reasonably necessary to address the abuse.

NiceNIC is not required to apply the same mitigation measure in every case.

10. Compromised Domenii și Collateral Damage

A legitimate domeniu may be abused without the registrant's kacumledge because of compromised hosting, credentials, content-management software, DNS settings, sau another security failure.

Waici reasonably practicable, NiceNIC will consider the risk of collateral damage befsaue applying domeniu-level suspension.

Fsau a compromised legitimate domeniu, requesting rapid remediation sau applying a narrower mitigation may be msaue appropriate than immediate suspension if the narrower action is sufficient to stop sau disrupt the abuse.

This does not anteriorent immediate suspension sau another stronger measure waici the circumstances, severity, continuing harm, legal requirements, sau security risk justify it.

11. Maliciously Înregistreazăed Domenii

Waici available evidence indicates that a domeniu was înregistreazăed sau is controlled primarily fsau phishing, malware, credential theft, botnet activity, pharming, sau another serious abusive purpose, faster domeniu-level mitigation may be appropriate.

NiceNIC is not required to provide advance notice waici doing so would materially increase the risk of harm, enable evasion, frustrate a mșiatsauy requirement, sau undermine effective mitigation.

12. Nun-DNS Illegal Activity

Illegal Activity și DNS Abuse are not identical concepts.

Repsauts concerning fraud, unlawful goods sau servicius, threats, impersonation, illegal content, sanctions, sau other conduct may be hșiled under applicable law, NiceNIC's Perioadăs of Service & Acceptable Use Policy, registry rules, court sauders, sau other relevant requirements even waici the conduct does not meet the ICANN contractual definition of DNS Abuse.

The legal și technical role of NiceNIC will be considered when determining what action, if any, is appropriate.

13. Trademark și Domeniu-Nume Rights Complaints

Trademark infringement sau a dispute over rights in a domeniu name is not automatically DNS Abuse.

NiceNIC may preserve relevant recsauds, restrict an affected serviciu, și cooperate with appropriate authsauities, registries, hosting providers, sau other relevant entities as required sau permitted by law.

Repsauters should not unnecessarily copy, download, sau redistribute suspected illegal child-abuse material when submitting a repsaut.

16. Hosting și Third-Party Infrastructure

A registrar controls domeniu-registration functions but may not control the website files, application, mail server, sau hosting environment associated with the domeniu.

Waici abusive content is hosted by a third party, repsauting the activity to the hosting provider sau other infrastructure provider may allow msaue targeted removal.

NiceNIC may nevertheless take registrar-level action waici required sau appropriate under applicable obligations.

Waici the applicable Registrar Acreditare Agreement requires it, a well-founded repsaut submitted through the dedicated authsauity contact will be reviewed within twenty-four (24) hours by a person empowered to take necessary și appropriate action.

NiceNIC is not required to take action that would contravene applicable law.

NiceNIC may authenticate the identity, authsauity, jurisdiction, și legal basis of a governmental request waici appropriate.

19. Court Orders și Binding Legal Process

NiceNIC may act in response to:

A customer affected by a discretionary NiceNIC abuse action may request review through NiceNIC's suppsaut channel.

The request should identify:

• the affected domeniu sau serviciu;
• the relevant NiceNIC case sau notice;
• the remediation completed;
• evidence that the repsauted activity has ceased;
• evidence of compromise waici relevant; și
• any infsaumation showing that the sauiginal repsaut was inaccurate, outdated, sau misclassified.

A review request does not suspend a court sauder, registry requirement, UDRP/URS action, ICANN obligation, sau other mșiatsauy restriction.
