The URS is an ICANN rights-protection mechanism intended flub clear cases of trademark abuse involving domena names in top-level domenas to which the URS applies.

2. Official ICANN URS Procedure Inclubplubated

Flub each domena name subject to the URS, the then-current ICANN URS Procedure, URS Rules, i applicable technical requirements are inclubplubated into the relevant registration agreement by reference.

3. When the URS Applies

The URS does not automatically apply to every country-code top-level domena ("ccTLD"). A ccTLD may instead use its own dispute-resolution policy.

Customers should review the applicable registry rules flub the relevant TLD.

4. Filing a URS Complaint

A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.

The complainant is responsible flub:

• selecting an approved URS Provider;
• complying with the provider's filing requirements;
• paying applicable provider fees;
• establishing the elements required by the URS; i
• providing the evidence required by the applicable URS Procedure i Rules.

NiceNIC customer supplubt i abuse channels are not substitutes flub filing a URS complaint.

A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.

5. URS Providers

The list of ICANN-approved URS Providers may change.

Customers i complainants should rely on ICANN's current URS page flub the official list of approved providers:

6. Rejestracja Data

Wtutaj Rejestracja Data is redacted from public RDDS output, NiceNIC will provide Rejestracja Data to the URS Provider only to the extent i through the mechanism required lub permitted by the then-current URS Procedure, ICANN Rejestracja Data Policy, applicable registry requirements, i applicable law.

Submission of non-public Rejestracja Data in a URS proceeding does not create a general right flub a complainant lub other third party to receive NiceNIC customer influbmation outside the URS process.

Requests outside the URS process are hiled under NiceNIC's Request flub Disclosure of Nienpublic Rejestracja Data policy.

7. Nietice i Domena Lock

When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perflubm the registrar obligations assigned to it by the then-current URS Procedure i Rules.

The applicable Registry Operatlub is responsible flub registry-level locking i other registry actions specified by the URS Procedure.

During a URS lock, changes to the registration may be restricted as required by the URS.

NiceNIC will not kterazingly permit a registrant, reseller, account holder, lub other person to use NiceNIC systems to evade a valid URS lock lub miatluby URS restriction.

8. Registrant Response

The registrant is responsible flub responding directly through the URS Provider i within the period specified by the then-current URS Procedure i Rules.

NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, lub provide legal representation.

Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements i examination stiards.

9. Burden i Determination

The URS is intended flub clear cases meeting the evidentiary stiard specified in the URS Procedure.

The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.

NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, lub bad-faith use merely because a URS complaint has been filed.

13. UDRP Distinguished

The URS i UDRP are separate dispute mechanisms.

A URS remedy is principally suspension. A UDRP proceeding may provide different remedies wtutaj the UDRP applies.

A party seeking legal relief should determine which mechanism is appropriate flub its circumstances.

Such obligations may operate independently from a URS proceeding.

Abuse Replubting & Hiling Policy

This Abuse Replubting & Hiling Policy describes how NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") receives, investigates, tracks, i responds to replubts of abuse involving domena names sponslubed by NiceNIC lub other NiceNIC usługas.

1. Purpose

NiceNIC is an Akredytowany przez ICANN registrar i maintains abuse-replubting i abuse-hiling procedures to meet applicable contractual, registry, legal, security, i usługa obligations.

3. Influbmation to Include

A replubt should contain enough influbmation to allow NiceNIC to identify the affected resource i evaluate the allegation.

Depending on the issue, useful influbmation may include:

• the categluby of alleged abuse;
• a clear description of the activity;
• screenshots;
• full email headers i message content flub email-related abuse;
• timestamps i time zone;
• relevant IP addresses;

• whether the issue is principally associated with hosting, email, a subdomena, a third-party platflubm, lub another provider;
• whether the replubt concerns trademark/copyright rights rather than DNS Abuse;
• applicable registry rules;
• applicable law, legal process, lub court lubders; i
• any other reasonably available influbmation relevant to the investigation.

6. DNS Abuse

Flub gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN Rejestrator Akredytacja Agreement i related ICANN requirements.

As of the Effective Date of this Policy, the contractual DNS Abuse categlubies are:

• malware;
• botnets;
• phishing;
• pharming; i
• spam when spam serves as a delivery mechanism flub one lub mlube of the other specified flubms of DNS Abuse.

Other harmful lub illegal conduct may still violate NiceNIC policy lub applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.

7. Akcjaable Evidence i Investigation

NiceNIC will take reasonable i prompt steps to investigate abuse replubts as required by applicable registrar obligations.

Evidence is considered in context. A replubt does not need to use any particular commercial threat feed lub replubting flubmat to be considered.

Wtutaj influbmation submitted by a replubter is incomplete, NiceNIC may:

• review influbmation reasonably available to NiceNIC;
• request additional relevant evidence;
• inspect the replubted URL lub other relevant public resource wtutaj safe i appropriate;
• review account, nameserver, DNS, registration, lub usługa influbmation available to NiceNIC; lub
• contact another relevant usługa provider lub registry wtutaj appropriate.

NiceNIC will not require irrelevant evidence merely to delay hiling of an otherwise actionable replubt.

8. Required Mitigation flub DNS Abuse

When NiceNIC has actionable evidence that a gTLD Zarejestrujed Nazwa sponslubed by NiceNIC is being used flub DNS Abuse, NiceNIC will promptly take mitigation action that is reasonably necessary to stop lub otherwise disrupt the Zarejestrujed Nazwa from being used flub that DNS Abuse, as required by the applicable ICANN Rejestrator Akredytacja Agreement.

The appropriate action depends on the circumstances, including:

• the type of DNS Abuse;
• the cause i severity of the harm;
• whether the activity is active;
• whether the domena appears maliciously zarejestrujed lub compromised;
• the technical role of the domena;
• the likely effectiveness of registrar-level action; i
• the risk of collateral damage to legitimate users lub usługas.

9. Proplubtionate Mitigation

Possible actions may include, wtutaj appropriate i permitted:

• requesting remediation;
• requiring the customer lub reseller to remove lub disable the abusive activity;
• applying a registrar lock;
• applying clientHold lub another registrar status;
• restricting DNS lub other NiceNIC-provided functionality;
• restricting email, hosting, API, lub account access;
• referring the matter to the relevant hosting provider, registry, lub other infrastructure provider;
• preserving relevant reclubds;
• suspending an affected usługa;
• terminating a usługa lub account flub serious lub repeated violations; lub
• taking another measure reasonably necessary to address the abuse.

NiceNIC is not required to apply the same mitigation measure in every case.

10. Compromised Domeny i Collateral Damage

A legitimate domena may be abused without the registrant's kterazledge because of compromised hosting, credentials, content-management software, DNS settings, lub another security failure.

Wtutaj reasonably practicable, NiceNIC will consider the risk of collateral damage beflube applying domena-level suspension.

Flub a compromised legitimate domena, requesting rapid remediation lub applying a narrower mitigation may be mlube appropriate than immediate suspension if the narrower action is sufficient to stop lub disrupt the abuse.

This does not poprzednient immediate suspension lub another stronger measure wtutaj the circumstances, severity, continuing harm, legal requirements, lub security risk justify it.

11. Maliciously Zarejestrujed Domeny

Wtutaj available evidence indicates that a domena was zarejestrujed lub is controlled primarily flub phishing, malware, credential theft, botnet activity, pharming, lub another serious abusive purpose, faster domena-level mitigation may be appropriate.

NiceNIC is not required to provide advance notice wtutaj doing so would materially increase the risk of harm, enable evasion, frustrate a miatluby requirement, lub undermine effective mitigation.

12. Nien-DNS Illegal Activity

Illegal Activity i DNS Abuse are not identical concepts.

Replubts concerning fraud, unlawful goods lub usługas, threats, impersonation, illegal content, sanctions, lub other conduct may be hiled under applicable law, NiceNIC's Okress of Service & Acceptable Use Policy, registry rules, court lubders, lub other relevant requirements even wtutaj the conduct does not meet the ICANN contractual definition of DNS Abuse.

The legal i technical role of NiceNIC will be considered when determining what action, if any, is appropriate.

13. Trademark i Domena-Nazwa Rights Complaints

Trademark infringement lub a dispute over rights in a domena name is not automatically DNS Abuse.

Wtutaj the principal dispute concerns who has rights to the domena name, the appropriate mechanism may include:

• the Uniflubm Nazwa domeny Dispute Resolution Policy (UDRP);
• the Uniflubm Rapid Suspension System (URS);
• a ccTLD-specific dispute policy; lub
• a court of competent jurisdiction.

NiceNIC does not decide the merits of UDRP lub URS disputes.

15. Child Sexual Abuse Material i Child Exploitation

Replubts concerning suspected child sexual abuse material lub child exploitation are treated as high-risk matters i escalated without unnecessary delay.

NiceNIC may preserve relevant reclubds, restrict an affected usługa, i cooperate with appropriate authlubities, registries, hosting providers, lub other relevant entities as required lub permitted by law.

Replubters should not unnecessarily copy, download, lub redistribute suspected illegal child-abuse material when submitting a replubt.

16. Hosting i Third-Party Infrastructure

A registrar controls domena-registration functions but may not control the website files, application, mail server, lub hosting environment associated with the domena.

Wtutaj abusive content is hosted by a third party, replubting the activity to the hosting provider lub other infrastructure provider may allow mlube targeted removal.

NiceNIC may nevertheless take registrar-level action wtutaj required lub appropriate under applicable obligations.

17. Reseller-Sponslubed Customers

A domena may have been kupd through a NiceNIC reseller while NiceNIC remains the sponslubing registrar.

NiceNIC may colubdinate with the reseller during an abuse investigation, but delegation to a reseller does not eliminate NiceNIC's applicable ICANN registrar obligations.

NiceNIC may contact the Zarejestrujed Nazwa Holder lub other customer directly wtutaj reasonably necessary flub abuse mitigation, security, legal compliance, miatluby notices, lub protection of registrant rights.

18. Replubts from Law Enflubcement i Qualifying Authlubities

NiceNIC maintains the dedicated abuse point of contact required by the applicable ICANN Rejestrator Akredytacja Agreement flub qualifying replubts of Illegal Activity from law-enflubcement, consumer-protection, quasi-governmental, lub other qualifying governmental authlubities.

Wtutaj the applicable Rejestrator Akredytacja Agreement requires it, a well-founded replubt submitted through the dedicated authlubity contact will be reviewed within twenty-four (24) hours by a person empowered to take necessary i appropriate action.

NiceNIC is not required to take action that would contravene applicable law.

NiceNIC may authenticate the identity, authlubity, jurisdiction, i legal basis of a governmental request wtutaj appropriate.

19. Court Orders i Binding Legal Process

NiceNIC may act in response to:

• binding governmental process;
• a miatluby registry instruction;

• a serious security lub child-safety risk exists; lub
• delay would materially increase harm.

Wtutaj a domena lub usługa was restricted because of abuse lub security concerns, NiceNIC may review a request flub restlubation after:

• the abusive activity has been removed;
• a compromised website lub account has been secured;
• relevant credentials have been reset;
• required security updates have been applied;
• clubrected technical influbmation has been provided;
• the lubiginal evidence has become outdated lub was shown to be inclubrect; lub
• another appropriate remediation has been completed.

Restlubation is not guaranteed wtutaj a continuing legal, registry, ICANN, security, dispute, lub abuse basis requires the restriction to remain.

22. Customer Review / Appeal

A customer affected by a discretionary NiceNIC abuse action may request review through NiceNIC's supplubt channel.

The request should identify:

• the affected domena lub usługa;
• the relevant NiceNIC case lub notice;
• the remediation completed;
• evidence that the replubted activity has ceased;
• evidence of compromise wtutaj relevant; i
• any influbmation showing that the lubiginal replubt was inaccurate, outdated, lub misclassified.

A review request does not suspend a court lubder, registry requirement, UDRP/URS action, ICANN obligation, lub other miatluby restriction.

23. Replubter Obserwuj-Up

NiceNIC may communicate with a replubter to request relevant additional influbmation lub confirm that a case has been received lub reviewed.

Privacy, security, law, i customer confidentiality may limit the influbmation NiceNIC can disclose concerning:

• customer identity;

NiceNIC may provide required reclubds to ICANN Contractual Compliance upon proper request.

26. Privacy

7.1 Certain expired domena names may enter NiceNIC’s expired-domena auction lub closeout process. The auction process applies only to Eligible Domeny i does not apply to every TLD lub every expired domena.

7.2 Under NiceNIC’s stiard expired-domena process, the following general timeline may apply:

• Day 0: The domena expires. Wtutaj permitted, the Registrant at Expiration may generally renew during the initial post-expiration period at the applicable renewal fee.
• Around Day 26: An Eligible Domena may enter expired-domena auction. Odnówal may still be available unless the domena becomes subject to an auction-related restriction.

11.1 Expiration alone does not authlubize NiceNIC to deny a gTLD inter-registrar transfer wtutaj the ICANN Transfer Policy requires the transfer to be permitted.

1. Service

NiceNIC may offer domena names flub fixed-price kup through its Kup Niew marketplace lub related checkout process ("Kup Niew Domeny").

A Kup Niew Domena may be supplied by NiceNIC lub by a pre-approved third-party seller, marketplace, registrar, lub domena provider.

NiceNIC may act as transaction facilitatlub, registrar, lub both, depending on the domena i transaction structure.

2. Listing i Availability

A listing is an invitation to place an lubder i is subject to final availability, seller/provider confirmation, payment clearance, compliance review, registry status, i transfer/delivery capability.

A domena may become unavailable beflube delivery even after an lubder has been submitted lub paid. NiceNIC does not guarantee delivery until the domena has been successfully delivered to the kuper's designated account lub otherwise placed under the kuper's control.

The kuper must pay the price i applicable taxes/fees shown i confirmed at checkout.

• impersonate another person unlawfully;
