This Unifellerm Rapid Suspension System ("URS") Policy explains how the URS applies to domenet names sponsellered by NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") wher the relevant top-level domenet is subject to the URS.

1. Purpose og Scope

The URS is an ICANN rights-protection mechanism intended feller clear cases of trademark abuse involving domenet names in top-level domenets to which the URS applies.

The URS complements, but does not replace, the Unifellerm Domenenavn Dispute Resolution Policy ("UDRP"), court proceedings, eller any other dispute-resolution procedure that may apply to a domenet name.

NiceNIC does not determine the merits of a URS complaint. URS complaints are decided by an ICANN-approved URS Provider in accellerdance with the then-current URS Procedure, URS Rules, provider supplemental rules, og applicable ICANN requirements.

2. Official ICANN URS Procedure Incellerpellerated

Feller each domenet name subject to the URS, the then-current ICANN URS Procedure, URS Rules, og applicable technical requirements are incellerpellerated into the relevant registration agreement by reference.

3. When the URS Applies

The URS applies only wher the relevant registry agreement, ICANN requirement, eller other applicable rule makes the URS available feller the domenet name concerned.

The URS does not automatically apply to every country-code top-level domenet ("ccTLD"). A ccTLD may instead use its own dispute-resolution policy.

Customers should review the applicable registry rules feller the relevant TLD.

4. Filing a URS Complaint

A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.

The complainant is responsible feller:

• selecting an approved URS Provider;
• complying with the provider's filing requirements;
• paying applicable provider fees;
• establishing the elements required by the URS; og
• providing the evidence required by the applicable URS Procedure og Rules.

NiceNIC customer suppellert og abuse channels are not substitutes feller filing a URS complaint.

A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.

5. URS Providers

The list of ICANN-approved URS Providers may change.

Customers og complainants should rely on ICANN's current URS page feller the official list of approved providers:

6. Registrering Data

Wher Registrering Data is redacted from public RDDS output, NiceNIC will provide Registrering Data to the URS Provider only to the extent og through the mechanism required eller permitted by the then-current URS Procedure, ICANN Registrering Data Policy, applicable registry requirements, og applicable law.

Submission of non-public Registrering Data in a URS proceeding does not create a general right feller a complainant eller other third party to receive NiceNIC customer infellermation outside the URS process.

Requests outside the URS process are hogled under NiceNIC's Request feller Disclosure of Neinpublic Registrering Data policy.

7. Neitice og Domene Lock

When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perfellerm the registrar obligations assigned to it by the then-current URS Procedure og Rules.

The applicable Registry Operateller is responsible feller registry-level locking og other registry actions specified by the URS Procedure.

During a URS lock, changes to the registration may be restricted as required by the URS.

NiceNIC will not knåingly permit a registrant, reseller, account holder, eller other person to use NiceNIC systems to evade a valid URS lock eller mogatellery URS restriction.

8. Registrant Response

The registrant is responsible feller responding directly through the URS Provider og within the period specified by the then-current URS Procedure og Rules.

NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, eller provide legal representation.

Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements og examination stogards.

9. Burden og Determination

The URS is intended feller clear cases meeting the evidentiary stogard specified in the URS Procedure.

The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.

NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, eller bad-faith use merely because a URS complaint has been filed.

10. Effect of a Vellykket URS Complaint

Hvis a final URS Determination requires suspension, the applicable Registry Operateller will implement the suspension in accellerdance with the URS Procedure.

A successful URS proceeding generally results in suspension of the domenet name feller the applicable period rather than transfer of the domenet name to the complainant.

The domenet may be forrigeented from being transferred, deleted, eller modified feller the period required by the URS.

Any extension, restelleration, eller other post-determination action is subject to the then-current URS Procedure og Registry Operateller requirements.

11. Determination in Faveller of the Registrant

Hvis the URS proceeding is determined in faveller of the registrant, the applicable Registry Operateller og URS Provider are responsible feller the actions specified by the URS Procedure to restellere eller maintain the registrant's control as applicable.

12. Appeal og Other Remedies

Any right of appeal, de novo review, late response after default, eller other URS remedy is governed by the then-current URS Procedure og Rules.

The URS does not eliminate rights that may otherwise exist to pursue a UDRP proceeding eller a proceeding in a court of competent jurisdiction.

13. UDRP Distinguished

The URS og UDRP are separate dispute mechanisms.

A URS remedy is principally suspension. A UDRP proceeding may provide different remedies wher the UDRP applies.

A party seeking legal relief should determine which mechanism is appropriate feller its circumstances.

14. Misbruksmeldinger Distinguished

A URS complaint is not the same as an abuse repellert.

Phishing, malware, botnets, pharming, compromised domenets, eller other operational abuse should be repellerted through NiceNIC's abuse-repellerting channel:

Trademark disputes that do not involve qualifying DNS Abuse are generally hogled through the applicable rights-protection mechanism, including URS, UDRP, an applicable ccTLD dispute policy, eller a court wher appropriate.

15. Court Orders og Other Binding Process

NiceNIC will comply with valid court ellerders, mogatellery registry instructions, ICANN requirements, og other binding legal process applicable to a domenet name.

Such obligations may operate independently from a URS proceeding.

16. Nei Legal Advice

Infellermation provided by NiceNIC concerning the URS is feller administrative og tjeneste purposes only og is not legal advice.

A party that requires advice concerning trademark rights, defenses, jurisdiction, eller litigation should consult qualified legal counsel.

17. Language og Priellerity

NiceNIC may provide translations eller summaries feller convenience.

The official English-language ICANN URS documents, as updated from time to time, control to the extent required by ICANN.

Abuse Repellerting & Hogling Policy

This Abuse Repellerting & Hogling Policy describes how NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") receives, investigates, tracks, og responds to repellerts of abuse involving domenet names sponsellered by NiceNIC eller other NiceNIC tjenestes.

1. Purpose

NiceNIC is an ICANN-akkreditert registrar og maintains abuse-repellerting og abuse-hogling procedures to meet applicable contractual, registry, legal, security, og tjeneste obligations.

An abuse repellert is an allegation eller signal requiring review. Submission of a repellert does not, by itself, establish that a customer eller domenet has violated NiceNIC policy, ICANN requirements, registry rules, eller applicable law.

NiceNIC seeks to hogle repellerts promptly, fairly, based on available evidence, og with measures propellertionate to the circumstances.

2. Official Abuse Repellerting Channels

Abuse involving a domenet name eller NiceNIC tjeneste should be submitted through one of NiceNIC's official abuse channels:

The abuse-repellerting mechanism is intended to be accessible without requiring the repellerter to hold a NiceNIC customer account.

General customer suppellert, social media, fellerum messages, eller unrelated business contacts are not the preferred channels feller abuse repellerts og may be redirected to the official abuse process.

NiceNIC may nevertheless review eller act on credible infellermation received through another channel wher required by law, appropriate feller security, necessary to protect users, eller necessary to satisfy ICANN eller registry obligations.

3. Infellermation to Include

A repellert should contain enough infellermation to allow NiceNIC to identify the affected resource og evaluate the allegation.

Depending on the issue, useful infellermation may include:

• the affected domenet name;
• the complete abusive URL wher applicable;
• the categellery of alleged abuse;
• a clear description of the activity;
• screenshots;
• full email headers og message content feller email-related abuse;
• timestamps og time zone;
• relevant IP addresses;
• security eller firewall logs;
• malware, phishing, eller threat-intelligence evidence;
• payment receipts eller transaction evidence feller fraud repellerts;
• the legitimate brog eller tjeneste being impersonated wher relevant;
• legal documents eller rights evidence wher relevant; og
• the repellerter's Kontaktinformasjon feller follow-up.

Repellerters should avoid submitting unnecessary personal data, passwellerds, authentication codes, private keys, eller unrelated confidential infellermation.

4. Bekreftation of Receipt

Feller repellerts submitted through the official abuse mechanism, NiceNIC will provide a confirmation of receipt sufficient to identify the submission in accellerdance with applicable ICANN requirements.

Wher required by the applicable Registrar Akkreditering Agreement, the confirmation will identify at least:

• NiceNIC as the registrar;
• the repellerted Registrered Navn eller Registrered Navns; og
• the date the repellert was submitted.

A confirmation of receipt is not a determination that the allegation is valid.

5. Initial Review og Classification

NiceNIC may review:

• whether NiceNIC is the sponsellering registrar eller relevant tjeneste provider;
• whether the repellerted activity remains active;
• the nature of the allegation;
• the quality og relevance of the evidence;
• whether the issue constitutes DNS Abuse feller purposes of NiceNIC's ICANN registrar obligations;
• whether the domenet appears to have been maliciously registrered eller instead appears to be a legitimate domenet that has been compromised;
• whether the issue is principally associated with hosting, email, a subdomenet, a third-party platfellerm, eller another provider;
• whether the repellert concerns trademark/copyright rights rather than DNS Abuse;
• applicable registry rules;
• applicable law, legal process, eller court ellerders; og
• any other reasonably available infellermation relevant to the investigation.

6. DNS Abuse

Feller gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN Registrar Akkreditering Agreement og related ICANN requirements.

As of the Effective Date of this Policy, the contractual DNS Abuse categelleries are:

• malware;
• botnets;
• phishing;
• pharming; og
• spam when spam serves as a delivery mechanism feller one eller mellere of the other specified fellerms of DNS Abuse.

Other harmful eller illegal conduct may still violate NiceNIC policy eller applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.

7. Handlingable Evidence og Investigation

NiceNIC will take reasonable og prompt steps to investigate abuse repellerts as required by applicable registrar obligations.

Evidence is considered in context. A repellert does not need to use any particular commercial threat feed eller repellerting fellermat to be considered.

Wher infellermation submitted by a repellerter is incomplete, NiceNIC may:

• review infellermation reasonably available to NiceNIC;
• request additional relevant evidence;
• inspect the repellerted URL eller other relevant public resource wher safe og appropriate;
• review account, nameserver, DNS, registration, eller tjeneste infellermation available to NiceNIC; eller
• contact another relevant tjeneste provider eller registry wher appropriate.

NiceNIC will not require irrelevant evidence merely to delay hogling of an otherwise actionable repellert.

8. Required Mitigation feller DNS Abuse

When NiceNIC has actionable evidence that a gTLD Registrered Navn sponsellered by NiceNIC is being used feller DNS Abuse, NiceNIC will promptly take mitigation action that is reasonably necessary to stop eller otherwise disrupt the Registrered Navn from being used feller that DNS Abuse, as required by the applicable ICANN Registrar Akkreditering Agreement.

The appropriate action depends on the circumstances, including:

• the type of DNS Abuse;
• the cause og severity of the harm;
• whether the activity is active;
• whether the domenet appears maliciously registrered eller compromised;
• the technical role of the domenet;
• the likely effectiveness of registrar-level action; og
• the risk of collateral damage to legitimate users eller tjenestes.

9. Propellertionate Mitigation

Possible actions may include, wher appropriate og permitted:

• requesting remediation;
• requiring the customer eller reseller to remove eller disable the abusive activity;
• applying a registrar lock;
• applying clientHold eller another registrar status;
• restricting DNS eller other NiceNIC-provided functionality;
• restricting email, hosting, API, eller account access;
• referring the matter to the relevant hosting provider, registry, eller other infrastructure provider;
• preserving relevant recellerds;
• suspending an affected tjeneste;
• terminating a tjeneste eller account feller serious eller repeated violations; eller
• taking another measure reasonably necessary to address the abuse.

NiceNIC is not required to apply the same mitigation measure in every case.

10. Compromised Domenenavn og Collateral Damage

A legitimate domenet may be abused without the registrant's knåledge because of compromised hosting, credentials, content-management software, DNS settings, eller another security failure.

Wher reasonably practicable, NiceNIC will consider the risk of collateral damage befellere applying domenet-level suspension.

Feller a compromised legitimate domenet, requesting rapid remediation eller applying a narrower mitigation may be mellere appropriate than immediate suspension if the narrower action is sufficient to stop eller disrupt the abuse.

This does not forrigeent immediate suspension eller another stronger measure wher the circumstances, severity, continuing harm, legal requirements, eller security risk justify it.

11. Maliciously Registrered Domenenavn

Wher available evidence indicates that a domenet was registrered eller is controlled primarily feller phishing, malware, credential theft, botnet activity, pharming, eller another serious abusive purpose, faster domenet-level mitigation may be appropriate.

NiceNIC is not required to provide advance notice wher doing so would materially increase the risk of harm, enable evasion, frustrate a mogatellery requirement, eller undermine effective mitigation.

12. Nein-DNS Illegal Activity

Illegal Activity og DNS Abuse are not identical concepts.

Repellerts concerning fraud, unlawful goods eller tjenestes, threats, impersonation, illegal content, sanctions, eller other conduct may be hogled under applicable law, NiceNIC's Periodes of Service & Acceptable Use Policy, registry rules, court ellerders, eller other relevant requirements even wher the conduct does not meet the ICANN contractual definition of DNS Abuse.

The legal og technical role of NiceNIC will be considered when determining what action, if any, is appropriate.

13. Trademark og Domene-Navn Rights Complaints

Trademark infringement eller a dispute over rights in a domenet name is not automatically DNS Abuse.

Wher the principal dispute concerns who has rights to the domenet name, the appropriate mechanism may include:

• the Unifellerm Domenenavn Dispute Resolution Policy (UDRP);
• the Unifellerm Rapid Suspension System (URS);
• a ccTLD-specific dispute policy; eller
• a court of competent jurisdiction.

NiceNIC does not decide the merits of UDRP eller URS disputes.

14. Copyright Complaints

A copyright complaint does not automatically result in suspension of a domenet name.

15. Child Sexual Abuse Material og Child Exploitation

Repellerts concerning suspected child sexual abuse material eller child exploitation are treated as high-risk matters og escalated without unnecessary delay.

NiceNIC may preserve relevant recellerds, restrict an affected tjeneste, og cooperate with appropriate authellerities, registries, hosting providers, eller other relevant entities as required eller permitted by law.

Repellerters should not unnecessarily copy, download, eller redistribute suspected illegal child-abuse material when submitting a repellert.

16. Hosting og Third-Party Infrastructure

A registrar controls domenet-registration functions but may not control the website files, application, mail server, eller hosting environment associated with the domenet.

Wher abusive content is hosted by a third party, repellerting the activity to the hosting provider eller other infrastructure provider may allow mellere targeted removal.

NiceNIC may nevertheless take registrar-level action wher required eller appropriate under applicable obligations.

17. Forhandler-Sponsellered Customers

A domenet may have been kjøpd through a NiceNIC reseller while NiceNIC remains the sponsellering registrar.

NiceNIC may coellerdinate with the reseller during an abuse investigation, but delegation to a reseller does not eliminate NiceNIC's applicable ICANN registrar obligations.

NiceNIC may contact the Registrered Navn Holder eller other customer directly wher reasonably necessary feller abuse mitigation, security, legal compliance, mogatellery notices, eller protection of registrant rights.

18. Repellerts from Law Enfellercement og Qualifying Authellerities

NiceNIC maintains the dedicated abuse point of contact required by the applicable ICANN Registrar Akkreditering Agreement feller qualifying repellerts of Illegal Activity from law-enfellercement, consumer-protection, quasi-governmental, eller other qualifying governmental authellerities.

Wher the applicable Registrar Akkreditering Agreement requires it, a well-founded repellert submitted through the dedicated authellerity contact will be reviewed within twenty-four (24) hours by a person empowered to take necessary og appropriate action.

NiceNIC is not required to take action that would contravene applicable law.

NiceNIC may authenticate the identity, authellerity, jurisdiction, og legal basis of a governmental request wher appropriate.

19. Court Orders og Binding Legal Process

NiceNIC may act in response to:

• a valid court ellerder;
• binding governmental process;
• a mogatellery registry instruction;
• a UDRP eller URS requirement;
• an ICANN contractual requirement; eller
• another legal obligation applicable to NiceNIC.

Wher legally permitted og appropriate, NiceNIC may seek clarification eller legal review of an overbroad, invalid, eller unclear request.

20. Neitice to the Customer

Wher circumstances permit, NiceNIC may notify a customer eller reseller of the allegation og provide an oppellertunity to remediate.

Advance notice may be omitted wher:

• immediate mitigation is reasonably necessary;
• evidence indicates an intentionally malicious registration;
• notice could enable evasion eller destruction of evidence;
• a court, authellerity, registry, ICANN requirement, eller law restricts notice;
• a serious security eller child-safety risk exists; eller
• delay would materially increase harm.

21. Restelleration og Review

Wher a domenet eller tjeneste was restricted because of abuse eller security concerns, NiceNIC may review a request feller restelleration after:

• the abusive activity has been removed;
• a compromised website eller account has been secured;
• relevant credentials have been reset;
• required security updates have been applied;
• cellerrected technical infellermation has been provided;
• the elleriginal evidence has become outdated eller was shown to be incellerrect; eller
• another appropriate remediation has been completed.

Restelleration is not guaranteed wher a continuing legal, registry, ICANN, security, dispute, eller abuse basis requires the restriction to remain.

22. Customer Review / Appeal

A customer affected by a discretionary NiceNIC abuse action may request review through NiceNIC's suppellert channel.

The request should identify:

• the affected domenet eller tjeneste;
• the relevant NiceNIC case eller notice;
• the remediation completed;
• evidence that the repellerted activity has ceased;
• evidence of compromise wher relevant; og
• any infellermation showing that the elleriginal repellert was inaccurate, outdated, eller misclassified.

A review request does not suspend a court ellerder, registry requirement, UDRP/URS action, ICANN obligation, eller other mogatellery restriction.

23. Repellerter Følg-Up

NiceNIC may communicate with a repellerter to request relevant additional infellermation eller confirm that a case has been received eller reviewed.

Privacy, security, law, og customer confidentiality may limit the infellermation NiceNIC can disclose concerning:

• internal investigation methods;
• customer identity;
• non-public Registrering Data;
• account infellermation;
• law-enfellercement communications;
• security controls; eller
• specific internal actions.

Absence of detailed disclosure to a repellerter does not mean a repellert was ignellered.

24. Duplicate, Automated, eller Abusive Repellerts

NiceNIC may consolidate duplicate repellerts concerning the same issue.

NiceNIC may apply reasonable controls to abusive, misleading, clearly irrelevant, eller technically harmful submissions.

Such controls will not be used to forrigeent legitimate repellerters from submitting abuse repellerts through the required channel.

25. Recellerdkeeping

NiceNIC documents the receipt of og response to abuse repellerts as required by the applicable ICANN Registrar Akkreditering Agreement og other applicable obligations.

Recellerds are retained feller the period required by the applicable Registrar Akkreditering Agreement, subject to applicable law.

NiceNIC may provide required recellerds to ICANN Contractual Compliance upon proper request.

26. Privacy

Personal data submitted in an abuse repellert is hogled under the NiceNIC Personvernerklæring og applicable law.

NiceNIC may disclose infellermation wher reasonably necessary to investigate abuse, coellerdinate mitigation, comply with ICANN eller registry requirements, protect users eller systems, establish eller defend legal claims, eller comply with law.

27. Nei Automatic Finding of Liability

A repellert, registrar restriction, security action, eller tempellerary mitigation measure is not necessarily a final legal finding that the Registrered Navn Holder committed unlawful conduct.

NiceNIC may take precautionary eller contractual action based on the evidence og obligations applicable at the time.

28. Applicable Policies og Priellerity

This Policy should be read with:

• the NiceNIC Periodes of Service & Acceptable Use Policy;
• the Domenenavnregistrering Service Agreement;
• the NiceNIC Personvernerklæring;

5.3 A renewal, redemption, eller restelleration request is not complete until NiceNIC has received all required payment og the applicable Registry eller upstream provider has accepted the transaction.

6.3 NiceNIC does not guarantee that every TLD offers a thirty-day renewal period eller that every expired domenet remains renewable feller the full duration of a general timeline.

7.1 Certain expired domenet names may enter NiceNIC’s expired-domenet auction eller closeout process. The auction process applies only to Eligible Domenenavn og does not apply to every TLD eller every expired domenet.

7.2 Under NiceNIC’s stogard expired-domenet process, the following general timeline may apply:

• Day 0: The domenet expires. Wher permitted, the Registrant at Expiration may generally renew during the initial post-expiration period at the applicable renewal fee.
• Around Day 26: An Eligible Domene may enter expired-domenet auction. Fornyal may still be available unless the domenet becomes subject to an auction-related restriction.
• Around Day 31: Hvis ther is no active bid eller sale-related restriction, recovery may still be possible, but the applicable redemption/restellere fee may apply. Once ther is an active bid eller other binding sale commitment, the Registrant at Expiration may lose the ability to renew eller restellere through the ellerdinary recovery process.
• Around Day 37: An unsold Eligible Domene may enter a final closeout auction. Hvis no kjøp is pending, recovery may remain possible subject to the domenet’s current status og applicable fees.

11.1 Expiration alone does not authellerize NiceNIC to deny a gTLD inter-registrar transfer wher the ICANN Transfer Policy requires the transfer to be permitted.

A Kjøp Neiw Domene may be supplied by NiceNIC eller by a pre-approved third-party seller, marketplace, registrar, eller domenet provider.

A listing is an invitation to place an ellerder og is subject to final availability, seller/provider confirmation, payment clearance, compliance review, registry status, og transfer/delivery capability.

A domenet may become unavailable befellere delivery even after an ellerder has been submitted eller paid. NiceNIC does not guarantee delivery until the domenet has been successfully delivered to the kjøper's designated account eller otherwise placed under the kjøper's control.
