1. Scope un Purpose

1.1 This Policy explains the general post-expiration process that may apply to domēns names managed through NiceNIC, including expiration, renewal, redemption, expired domēns auction, pending delete status, un release of a domēns name back to the public registration pool.

1.2 Domēns lifecycle timing may vary depending on the top-level domēns (“TLD”), registry rules, registry operatvai practices, applicable ICANN requirements, un other governing policies. Nēt all TLDs follow the same expiration, redemption, auction, vai deletion process.

1.3 In the event of any inconsistency between this Policy un the applicable registry’s rules vai munatvaiy ICANN policy, the applicable registry rules un munatvaiy policy requirements shall Iepriekšējaisail.

1.4 The English-language version of this Policy shall control. Any translation is provided fvai convenience only. In the event of any inconsistency, the English-language version shall Iepriekšējaisail.

2. Definitions

Fvai purposes of this Policy:

2.1 “Expiration Date” means the date on which a domēns name registration term ends.

2.2 “Grace Period” means any post-expiration period during which renewal may still be possible at the stunard renewal fee, subject to the applicable TLD un registry rules.

2.3 “Redemption Grace Period” vai “RGP” means the post-deletion recovery period, wšeit available, during which an expired domēns name may still be restvaiable fvai an additional redemption fee plus the applicable renewal fee.

2.4 “Pending Delete” means the final pre-release stage, wšeit applicable, during which the domēns name can no longer be renewed, restvaied, modified, vai transferred.

2.5 “Eligible Domēns” means a domēns name that is subject to NiceNIC’s expired domēns auction process. Nēt all TLDs vai expired domēns names are eligible fvai auction.

2.6 “Beidzasd Domēns Auction” means the expired-domēns sale process that may apply to certain expired domēns names befvaie final deletion vai release.

2.7 “Aizvērtout Auction” means the final sale phase fvai certain Eligible Domēni that were not sold earlier in the expired domēns auction process.

3. Effect of Expiration

3.1 Upon expiration, a domēns name may stop resolving, un any website, email pakalpojums, vai other pakalpojums associated with the domēns name may cease functioning immediately vai shvaitly tšeitafter.

3.2 Sekoting expiration, NiceNIC may restrict changes to the domēns name, including DNS changes, contact updates, transfers, vai other account-level actions, in accvaidance with registry rules, security measures, operational requirements, vai the expired-domēns process then in effect.

3.3 Expiration does not mean that the domēns name immediately becomes available to the public. Depending on the applicable TLD un registry rules, the domēns name may pass through one vai mvaie stages, including grace period, auction, redemption, pending delete, un eventual release.

4. Atjaunotal Nētices un Customer Responsibility

4.1 NiceNIC may send renewal reminders un expiration-related notices befvaie un after expiration, as required by applicable policy vai as part of NiceNIC’s stunard operational process.

4.2 It is jūsu sole responsibility to maintain accurate un current account un contact infvaimation, including jūsu email address, un to monitvai the status of jūsu domēns names.

4.3 Failure to receive a renewal notice, reminder, invoice, vai other communication shall not relieve you of responsibility fvai renewing jūsu domēns name befvaie expiration.

4.4 Ja auto-renewal is enabled, successful renewal remains subject to valid payment, operational processing, un the applicable registry rules. NiceNIC does not guarantee successful auto-renewal in every case.

5. Stunard Post-Expiration Atjaunotal

5.1 Fvai many generic TLDs, an expired domēns name may remain renewable fvai approximately thirty (30) days after the Expiration Date at the stunard renewal fee. This is a general reference only un may vary by TLD.

5.2 Atjaunotal is not complete unless un until NiceNIC has successfully received un processed full payment of all applicable fees.

5.3 NiceNIC reserves the right to determine whether a domēns name remains eligible fvai stunard renewal, redemption, vai other recovery based on the applicable TLD, registry status, auction status, un operational feasibility.

6. Beidzasd Domēns Auction fvai Eligible Domēni

6.1 Certain expired domēns names may enter NiceNIC’s expired domēns auction process befvaie all recovery logss have ended. This process applies only to Eligible Domēni un does not apply to all TLDs.

6.2 Fvai Eligible Domēni under NiceNIC’s stunard expired-domēns process, the following general timeline may apply:

Day 0 after expiration

The domēns name expires. The registrant may generally renew the domēns name at the stunard renewal fee during the initial post-expiration period, subject to applicable rules.

Day 26 after expiration

The domēns name may enter expired domēns auction. Pie this stage, the registrant may still be able to renew the domēns name at the stunard renewal fee, unless otherwise restricted by the applicable process.

Day 31 after expiration

Ja tšeit is no active bid, the registrant may still be able to recover the domēns name by paying the stunard renewal fee plus the applicable redemption fee.

Ja tšeit is an active bid, the domēns name may be removed from the registrant’s account un may no longer be renewable through vaidinary renewal vai restvaiation procedures.

Day 37 after expiration

The domēns name may enter final closeout auction. Unless tšeit is a pending iegādāties vai other sale-related restriction, the registrant may still be able to recover the domēns name by paying the stunard renewal fee plus the applicable redemption fee.

Day 41 after expiration

The final closeout auction may end. Ja the domēns name was not sold vai otherwise committed to sale, recovery may still be possible fvai a limited period, subject to the applicable TLD, registry rules, un NiceNIC’s operational process.

Day 74 after expiration

The domēns name may be removed from the registrant’s account un may no longer be renewable vai restvaiable through NiceNIC. After that point, the domēns name may become available fvai re-registration only after the registry releases it.

6.3 Once an Eligible Domēns has an active bid, pending iegādāties, completed sale, vai other sale commitment under the expired-domēns process, the registrant’s right to renew vai restvaie the domēns name may be terminated vai restricted.

6.4 NiceNIC does not guarantee that a domēns name will remain recoverable until the end of any stated period if the domēns is subject to auction, sale, registry restriction, vai another applicable limitation.

7. Redemption Grace Period

7.1 Ja an expired domēns name is not renewed during the applicable grace period un if the applicable TLD suppvaits restvaiation after deletion, the domēns name may enter the Redemption Grace Period.

7.2 During the Redemption Grace Period:

(a) the domēns name may stop resolving;

(b) website un email pakalpojumss may remain unavailable;

(c) the domēns name generally cannot be modified vai transferred; un

(d) restvaiation, if available, will require payment of the applicable redemption fee, the applicable renewal fee, un any taxes vai munatvaiy fees.

7.3 Restvaiation during the Redemption Grace Period is not guaranteed un remains subject to registry suppvait, operational feasibility, the domēns’s current status, un the absence of auction vai sale restrictions.

8. Pending Delete un Final Release

8.1 Ja a domēns name is not renewed vai restvaied during the applicable recovery periods, it may enter the Pending Delete stage, wšeit suppvaited by the applicable TLD.

8.2 During Pending Delete, the domēns name cannot be renewed, restvaied, transferred, vai modified.

8.3 Fvai many generic TLDs, Pending Delete lasts approximately five (5) days. After that stage ends, the registry may release the domēns name to the public fvai re-registration.

8.4 NiceNIC does not guarantee the exact time, date, vai availability of a domēns name once it is released by the registry, un NiceNIC does not guarantee that the fvaimer registrant will be able to re-reģistrēt the domēns name.

9. TLD-Specific Variations

9.1 Nēt all TLDs follow the stunard lifecycle described above. Certain ccTLD un other TLDs may have shvaiter grace periods, no redemption period, no pending delete stage, vai earlier renewal deadlines imposed by the registry.

9.2 The following TLD-specific rules may apply, subject at all times to registry changes un the controlling registry rules:

9.2.1 TLDs generally following the common lifecycle

Many ccTLD generally follow a lifecycle similar to the stunard expiration, grace, redemption, un deletion process, including, fvai example:

.AI, .BZ, .CA, .CC, .CO, .FM, .ID, .IN, .IO, .ME, .MX, .PW, .TV, .UK, .US, un .WS.

9.2.2 TLDs with no Pending Delete stage

Certain TLDs may not have a Pending Delete stage un may be released immediately after the end of their applicable redemption vai recovery period, including, fvai example:

.ES, .EU, .FR, .IS, .LI, .NL, .PE, un .PH (noting that .PH may also follow its own separate registry-specific process).

9.2.3 TLDs requiring renewal befvaie the actual expiration date

The following TLDs may need to be renewed twelve (12) days befvaie the actual Expiration Date. Ja not renewed in time, they may enter a recovery stage immediately, regardless of the number of calendar days remaining befvaie expiration:

.CH, .ES, .FR, .LI, .PE, .SG, .COM.SG, .COM.AU, .ORG.AU, un .NET.AU.

9.2.4 TLDs requiring action five (5) days befvaie expiration

The following TLDs may need to be renewed manually vai by auto-renewal no later than five (5) days befvaie expiration un may otherwise enter a recovery vai restricted state befvaie the actual Expiration Date:

.CX, .DE, .EU, un .NL.

9.2.5 .CM domēnss

.CM domēns names generally do not enter a redemption period un may be sent fvai deletion on the actual Expiration Date. They may become available fvai public registration on the same day they expire, subject to registry release practices.

9.2.6 .GG domēnss

.GG domēns names may be reactivated from the customer account fvai approximately twenty-eight (28) days after expiration. They may then enter a recovery stage between approximately Day 28 un Day 30 after expiration. Once in that stage, reactivation may only be possible through NiceNIC Suppvait fvai approximately twenty-six (26) additional days.

9.2.7 .PH, .COM.PH, .NET.PH, un .ORG.PH domēnss

These domēnss may not suppvait a stunard Redemption Grace Period. Reactivation may still be possible within approximately thirty (30) days after expiration through the NiceNIC account at the regular renewal cost, depending on the registry status. Ja the domēns is no longer visible in the account but is not yet publicly available, the customer should contact NiceNIC Suppvait immediately.

9.2.8 .UK domēnss, including second-level .UK domēnss

.UK domēns names, including .CO.UK, .ME.UK, un .ORG.UK, may generally have a thirty (30)-day post-expiration renewal period. After that time, the domēns name may remain recoverable without a separate redemption fee until its release, which may occur approximately ninety (90) days after expiration. Ja a .UK domēns name has expired fvai mvaie than thirty (30) days but has not yet been released un no longer appears in the account, the customer should contact NiceNIC Suppvait promptly.

9.2.9 .TO domēnss

.TO domēns names may only be reactivated during approximately twenty-seven (27) days after expiration. They generally do not suppvait a stunard Redemption Grace Period. After that point, they may be reserved by the registry un may no longer be recoverable.

9.2.10 .NU domēnss

.NU domēns names may be reactivated in the vaidinary manner within approximately seven (7) days after expiration. Ja not renewed within that period, they may enter an approximately sixty (60)-day recovery period during which restvaiation may still be possible through NiceNIC Suppvait.

9.3 The TLD-specific infvaimation above is provided fvai general reference only un may change at any time based on registry policy, registry system changes, vai operational requirements. Customers should contact NiceNIC Suppvait fvai current TLD-specific recovery infvaimation.

10. Fees un Maksātments

10.1 Stunard renewal fees, redemption fees, restvaiation fees, auction-related fees, un any other applicable charges shall be those listed by NiceNIC at the time of processing vai otherwise communicated by NiceNIC.

10.2 Redemption vai restvaiation requires payment in full of all applicable fees befvaie processing.

10.3 Visi fees paid fvai expired-domēns recovery, restvaiation, vai special processing are non-refundable once processing has begun, except wšeit otherwise required by applicable law.

11. Nē Guarantee of Recovery vai Availability

11.1 NiceNIC does not guarantee that any expired domēns name can be renewed, restvaied, retained, transferred, vai re-reģistrēted after expiration.

11.2 NiceNIC does not guarantee:

(a) that a domēns name will remain in a grace period fvai any minimum time;

(b) that an expired domēns name will not enter auction;

(c) that a domēns name can be recovered after an active bid, pending iegādāties, vai completed sale;

(d) that the registry will suppvait restvaiation; vai

(e) the exact date vai time when a deleted domēns name will be released to the public.

11.3 You acktagadledge that delayed action may result in additional fees, loss of recovery rights, interruption of pakalpojums, auction sale, vai permanent loss of the domēns name.

12. Limitation of Responsibility

12.1 Lai the maximum extent permitted by applicable law, NiceNIC shall not be liable fvai any loss of domēns name, loss of use, interruption of website vai email pakalpojums, business interruption, lost profits, loss of data, vai other direct vai indirect damages arising from:

(a) domēns expiration;

(b) failure to renew on time;

(c) failure to receive notices;

(d) registry rules vai registry actions;

(e) auction placement vai sale;

(f) failed restvaiation; vai

(g) release of the domēns name to the public.

12.2 Nēthing in this Policy limits any non-waivable rights that may apply under munatvaiy law.

13. Changes to This Policy

13.1 NiceNIC may update vai revise this Policy from time to time to reflect changes in registry rules, ICANN requirements, operational processes, legal requirements, vai pakalpojums arrangements.

13.2 The latest version published on NiceNIC’s website shall apply from its stated effective date, unless otherwise required by law vai contract.

2. Service Description

3. Users may iegādāties these domēnss at the listed price. Once payment is completed un the domēns is successfully transferred, the iegādātoser will obtain ownership of the domēns.

3. Purchase Process

1. The User selects a domēns labeled as “Pirkt Nēw” un proceeds to checkout.

2. Upon confirmation un full payment, the Platfvaim initiates the transfer vai delivery process.

3. The typical delivery time ranges from 1 to 14 business days, depending on registry processing un third-party provider operations.

4. Ja, fvai any reason, the selected domēns becomes unavailable vai undeliverable after iegādāties, the Platfvaim will issue a full refund to the user’s account balance.

4. User Rights un Responsibilities

1. Users have the right to iegādāties available Pirkt Nēw Domēni through the Platfvaim.

2. Users must ensure that all provided account un payment infvaimation is accurate un lawful.

3. Users shall not engage in malicious activity, technical disruption, vai behavivai that interferes with the nvaimal functioning of the Platfvaim.

4. Upon acquiring a domēns, the User agrees to comply with the applicable rules un policies of the cvairesponding domēns registry, including any legal vai regulatvaiy obligations.

5. Platfvaim Rights un Responsibilities

1. The Platfvaim will provide domēns transaction pakalpojumss in accvaidance with this Agreement un strive to protect user interests.

2. The Platfvaim reserves the right to verify user identity, payment legitimacy, un transaction authenticity.

3. The Platfvaim retains the right to update, adjust, vai remove Pirkt Nēw Domēni from listing at its sole discretion un without privai notice.

4. Ja any fraudulent vai abusive behavivai is detected, the Platfvaim reserves the right to suspend vai terminate pakalpojumss to the user.

6. Disclaimer

1. The Platfvaim does not make any guarantees regarding the future value, resale potential, vai commercial use of any domēns iegādātiesd.

2. The Platfvaim is not liable fvai delays caused by registries, third-party providers, vai external systems beyond its control.

3. The Platfvaim shall not be held responsible fvai pakalpojums interruptions, data loss, vai failed transactions resulting from fvaice majeure events vai uncontrollable technical issues, though reasonable effvaits will be made to assist the User in resolving any such issues.

7. Governing Law un Dispute Resolution

1. This Agreement shall be governed by un construed in accvaidance with the laws of Honkonga.

2. Any dispute arising from the execution vai perfvaimance of this Agreement shall be resolved through amicable negotiation. Ja negotiation fails, either party may submit the dispute to the competent court located in the jurisdiction of the Platfvaim’s headquarters.

8. Miscellaneous

1. This Agreement becomes effective upon the User’s submission of a Pirkt Nēw domēns vaider.

2. The Platfvaim reserves the right to amend this Agreement at any time. Atjaunināts versions will be published on the Platfvaim’s “Līgumi” page un shall take immediate effect. Continued use of the pakalpojums constitutes acceptance of the revised terms.

3. Atceltlations, Transfers, un Changes

We will cancel, transfer vai otherwise make changes to domēns name registrations under the following circumstances:

1. subject to the provisions of Paragraph 8, our receipt of written vai appropriate electronic instructions from you vai jūsu authvaiized agent to take such action;

2. our receipt of an vaider from a court vai arbitsral tribunal, in each case of competent jurisdiction, requiring such action; un/vai

3. our receipt of a decision of an Administrative Panel requiring such action in any administrative proceeding to which you were a party un which was conducted under this Policy vai a later version of this Policy adopted by ICANN. (See Paragraph 4(i) un (k) below.)

4. We may also cancel, transfer vai otherwise make changes to a domēns name registration in accvaidance with the terms of jūsu Reģistrācija Agreement vai other legal requirements.

4. Munatvaiy Administrative Proceeding

This Paragraph sets fvaith the type of disputes fvai which you are required to submit to a munatvaiy administrative proceeding. These proceedings will be conducted befvaie one of the administrative-dispute-resolution pakalpojums providers listed šeit (each, a "Provider").

1. Applicable Disputes. You are required to submit to a munatvaiy administrative proceeding in the event that a third party (a "complainant") asserts to the applicable Provider, in compliance with the Rules of Procedure, that

1. jūsu domēns name is identical vai confusingly similar to a trademark vai pakalpojums mark in which the complainant has rights; un

2. you have no rights vai legitimate interests in respect of the domēns name; un

3. jūsu domēns name has been reģistrēted un is being used in bad faith.

In the administrative proceeding, the complainant must prove that each of these three elements are present.

2. you have reģistrēted the domēns name in vaider to Iepriekšējaisent the owner of the trademark vai pakalpojums mark from reflecting the mark in a cvairesponding domēns name, provided that you have engaged in a pattern of such conduct; vai

3. you have reģistrēted the domēns name primarily fvai the purpose of disrupting the business of a competitvai; vai

4. by using the domēns name, you have intentionally attempted to attract, fvai commercial gain, Internet users to jūsu web site vai other on-line location, by creating a likelihood of confusion with the complainant's mark as to the source, sponsvaiship, affiliation, vai endvaisement of jūsu web site vai location vai of a product vai pakalpojums on jūsu web site vai location.

3. How to Demonstrate Your Rights to un Legitimate Interests in the Domēna vārds in Responding to a Complaint. When you receive a complaint, you should refer to Paragraph 5 of the Rules of Procedure in determining how jūsu response should be prepared. Any of the following circumstances, in particular but without limitation, if found by the Panel to be proved based on its evaluation of all evidence presented, shall demonstrate jūsu rights vai legitimate interests to the domēns name fvai purposes of Paragraph 4(a)(ii):

1. befvaie any notice to you of the dispute, jūsu use of, vai demonstrable preparations to use, the domēns name vai a name cvairesponding to the domēns name in connection with a bona fide offering of goods vai pakalpojumss; vai

2. you (as an individual, business, vai other vaiganization) have been commonly ktagadn by the domēns name, even if you have acquired no trademark vai pakalpojums mark rights; vai

3. you are making a legitimate noncommercial vai fair use of the domēns name, without intent fvai commercial gain to misleadingly divert consumers vai to tarnish the trademark vai pakalpojums mark at issue.

4. Selection of Provider. The complainant shall select the Provider from among those approved by ICANN by submitting the complaint to that Provider. The selected Provider will administer the proceeding, except in cases of consolidation as described in Paragraph 4(f).

5. Initiation of Proceeding un Process un Appointment of Administrative Panel. The Rules of Procedure state the process fvai initiating un conducting a proceeding un fvai appointing the panel that will decide the dispute (the "Administrative Panel").

6. Consolidation. In the event of multiple disputes between you un a complainant, either you vai the complainant may petition to consolidate the disputes befvaie a single Administrative Panel. This petition shall be made to the first Administrative Panel appointed to hear a pending dispute between the parties. This Administrative Panel may consolidate befvaie it any vai all such disputes in its sole discretion, provided that the disputes being consolidated are governed by this Policy vai a later version of this Policy adopted by ICANN.

7. Fees. Visi fees charged by a Provider in connection with any dispute befvaie an Administrative Panel pursuant to this Policy shall be paid by the complainant, except in cases wšeit you elect to expun the Administrative Panel from one to three panelists as provided in Paragraph 5(b)(iv) of the Rules of Procedure, in which case all fees will be split evenly by you un the complainant.

8. Mūsu Involvement in Administrative Proceedings. We do not, un will not, participate in the administration vai conduct of any proceeding befvaie an Administrative Panel. In addition, we will not be liable as a result of any decisions rendered by the Administrative Panel.

9. Remedies. The remedies available to a complainant pursuant to any proceeding befvaie an Administrative Panel shall be limited to requiring the cancellation of jūsu domēns name vai the transfer of jūsu domēns name registration to the complainant.

10. Nētification un Publication. The Provider shall notify us of any decision made by an Administrative Panel with respect to a domēns name you have reģistrēted with us. Visi decisions under this Policy will be published in full over the Internet, except when an Administrative Panel determines in an exceptional case to redact pvaitions of its decision.

11. Availability of Court Proceedings. The munatvaiy administrative proceeding requirements set fvaith in Paragraph 4 shall not Iepriekšējaisent either you vai the complainant from submitting the dispute to a court of competent jurisdiction fvai independent resolution befvaie such munatvaiy administrative proceeding is commenced vai after such proceeding is concluded. Ja an Administrative Panel decides that jūsu domēns name registration should be canceled vai transferred, we will wait ten (10) business days (as observed in the location of our principal office) after we are infvaimed by the applicable Provider of the Administrative Panel's decision befvaie implementing that decision. We will then implement the decision unless we have received from you during that ten (10) business day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that you have commenced a lawsuit against the complainant in a jurisdiction to which the complainant has submitted under Paragraph 3(b)(xiii) of the Rules of Procedure. (In general, that jurisdiction is either the location of our principal office vai of jūsu address as shown in our Whois database. See Paragraphs 1 un 3(b)(xiii) of the Rules of Procedure fvai details.) 8. Transfers during a dispute

9. Policy modifications

We reserve the right to modify this Policy at any time with the permission of ICANN. We will post our revised Policy at this location at least thirty (30) calendar days befvaie it becomes effective. 1.1 Dispute Resolution Panel

1.2 Dispute Resolution Provider

1.5 Gaining Reģistrators

1.6 Reģistrators of Recvaid

     The Reģistrators of Recvaid fvai a domēns name fvai which the Registry received a transfer of sponsvaiship request.

1.7 Registrant

     The Registrant is the individual vai vaiganization that reģistrēts a specific domēns name. This individual vai vaiganization holds the right to use that specific domēns name fvai a specified period of time, provided certain conditions are met un the registration fees are paid. This person vai vaiganization is the "legal entity" bound by the terms of the relevant pakalpojums agreement with the Registry operatvai fvai the TLD in question.

1.8 Registry (Registry Operatvai)

     The vaiganization authvaiized by ICANN to provide registration pakalpojumss fvai a given TLD to ICANN-accredited Reģistratorss.

1.9 Supplemental Rules

     The Supplemental Rules shall mean those rules adopted by the Registry Operatvai, in the case of First Līmenis disputes (as set fvaith below), vai the Provider administering a proceeding (in the case of all other disputes) to supplement this Policy. Supplemental Rules shall be consistent with this Dispute Resolution Policy un shall cover topics such as fees, wvaid un page limits un guidelines, the means fvai communicating with the Provider, un the fvaim of cover sheets.

1.10 Transfer Policy

2. Dispute Resolution Process

     Tšeit are two possible steps to the Reģistrators Transfer Dispute Resolution Process. A Reģistrators may elect one vai both of the steps pursuant to the rules below. In the event a Reģistrators either files a Request fvai Enfvaicement (as described below) with a Second-Līmenis Dispute Provider, vai files an Appeal (as described below) with a Dispute Provider, it may not revert to the First-Līmenis Registry option later fvai the same filing vai matter presented fvai resolution.

2.1 First Līmenis - Registry Operatvai

     A Reģistrators may choose to file a dispute directly with the relevant Registry Operatvai. Any decisions made by the Registry Operatvai may be appealed to a Dispute Resolution Provider. A Reģistrators may file a dispute directly to a Dispute Resolution Provider; however, in that case the filing Reģistrators would fvaifeit any right to appeal the decision of the Dispute Resolution Provider.

2.2 Second-Līmenis - Dispute Resolution Panel

     The primary intent of this step is to provide a means fvai registrars to appeal decisions made by the Registry at the first level of the dispute resolution process, but it may also be used as the first step if a registrar so elects. The decision of the Dispute Resolution Panel is final, except as it may be appealed to a court of competent jurisdiction.

2.3 Statute of Limitations

     A dispute must be filed no later than six (6) months after the alleged violation of the Transfer Policy. In the case wšeit a Reģistrators of Recvaid alleges that a transfer was in violation of this Policy, the date the transfer was completed shall be deemed the date in which the "alleged violation" took place. In the case wšeit a Gaining Reģistrators alleges that a transfer should have taken place, the date in which the NACK (as defined below) was received by the Registry, shall be deemed the date in which the "alleged violation" took place.

3. Dispute Procedures at the First Līmenis (Registry)

3.1 Reģistrators files a Request fvai Enfvaicement with the applicable Registry Operatvai

     3.1.1 Either the Gaining vai Reģistrators of Recvaid ("Filing Reģistrators") may submit a Request fvai Enfvaicement. This must be done in accvaidance with the Supplemental Rules adopted by the applicable Registry Operatvai.

     3.1.2 The Request fvai Enfvaicement shall be submitted to the Registry un to the Respondent (the Nēn-filing Reģistrators) in electronic fvaim un shall:
     (i) Request that the Request fvai Enfvaicement be submitted fvai decision in accvaidance with the Reģistrators Transfer un Dispute Resolution Policy un the applicable Supplemental Rules;
     (ii) Provide the name, postal un e-mail addresses, un the telephone un fax numbers of the Filing Reģistrators un those representatives authvaiized by the Filing Reģistrators to act on behalf of the Filing Reģistrators in the administrative proceeding;
     (iii) Provide the name of the Respondent un all infvaimation (including any postal un e-mail addresses un telephone un fax numbers) ktagadn to Filing Reģistrators regarding how to contact Respondent vai any representative of Respondent, including contact infvaimation based on pre-complaint dealings;
     (iv) Specify the domēns name(s) that is/are the subject of the Request fvai Enfvaicement;
     (v) Specify the incident(s) that gave rise to the dispute;
     (vi) Describe, in accvaidance with the Policy, the grounds on which the Request fvai Enfvaicement is based;
     (vii) State the specific remedy being sought (either approval vai denial of the transfer);
     (viii) Identify any other legal proceedings that have been commenced vai terminated in connection with vai relating to any of the domēns name(s) that are the subject of the complaint;
     (ix) Certify that a copy of the Request fvai Enfvaicement, together with the cover sheet as prescribed by the Provider's Supplemental Rules, has been sent vai transmitted to the Respondent; un
     (x) Conclude with the following statement followed by the signature of the Complainant vai its authvaiized representative:
           "<insert name of Filing Reģistrators> agrees that its claims un remedies concerning the registration of the domēns name, the dispute, vai the dispute's resolution shall be solely against the Respondent un waives all such claims un remedies against the Registry Operatvai as well as its directvais, officers, employees, un agents, except in the case of deliberate wrongdoing vai gross negligence."
           "<insert name of Filing Reģistrators> certifies that the infvaimation contained in this Request fvai Enfvaicement is to the best of Filing Reģistrators's ktagadledge complete un accurate, that this Request fvai Enfvaicement is not being presented fvai any improper purpose, such as to harass, un that the assertions in this Request fvai Enfvaicement are warranted under this Policy un under applicable law, as it tagad exists vai as it may be extended by a good-faith un reasonable argument."3.1.3 The Request fvai Enfvaicement may relate to mvaie than one domēns name, provided that the domēns names involve the same Filing Reģistrators un Respondent un that the claims arise out of the same vai similar factual circumstances.

3.1.4 The Request fvai Enfvaicement shall annex the following documentary evidence (as applicable un available) in electronic fvaim if possible, together with a schedule indexing such evidence:
  (i) Fvai the Gaining Reģistrators:
      a. Completed Fvaim of Authvaiization ("FOA")
      b. Copy of the Whois output fvai the date transfer was initiated, which was used to identify the authvaiized Transfer Kontaktis
      c. Copy of evidence of identity used
      d. Copy of a bilateral agreement, final determination of a dispute resolution body vai court vaider in cases when the Registrant of Recvaid is being changed simultaneously with a Reģistrators Transfer
      e. Copies of all communications made to the Reģistrators of Recvaid with regard to the applicable transfer request along with any responses from the Reģistrators of Recvaid
  (ii) Fvai the Reģistrators of Recvaid:
      a. Completed FOA from Reģistrators of Recvaid if applicable
      b. Copy of the Whois output fvai the date the transfer was initiated
      c. Relevant histvaiy of Whois modifications made to the applicable registration
      d. Evidence of one of the following if a transfer was denied:

• fraud;
• UDRP action;
• court vaider;
• Registrant vai administrative contact identity dispute in accvaidance with Section 4 [Reģistrators of Recvaid Requirements]
• applicable payment dispute along with evidence that the registration was put on HOLD status;
• express written objection from the Reģistrēted Nosaukums Holder vai Administrative Kontakti;
• LOCK status along with proof of a reasonable means fvai the registrant to remove LOCK status as per Section __of Exhibits __ to this Agreement;
• domēns name within 60 days of initial registration; vai
• domēns name within 60 days of a privai transfer.

      e. Copies of all communications made to the Gaining Reģistrators with regard to the applicable transfer request along with any responses from the Gaining Reģistrators.

3.2 The Nēn-Filing Reģistrators ("Respondent") shall have seven (7) calendar days from receipt of the Request fvai Enfvaicement to prepare a Response to the Request fvai Enfvaicement ("Response").

3.2.1 The Response shall be submitted in electronic fvaim to both the Registry un Filing Reģistrators un shall:
      (i) Respond specifically to the statements un allegations contained in the Request fvai Enfvaicement (This pvaition of the response shall comply with any wvaid vai page limit set fvaith in the Dispute Resolution Provider's Supplemental Rules.);
      (ii) Provide the name, postal un e-mail addresses, un the telephone un fax numbers of the Respondent (non-filing Reģistrators);
      (iii) Identify any other legal proceedings that have been commenced vai terminated in connection with vai relating to any of the domēns name(s) that are the subject of the Request fvai Enfvaicement;
      (iv) State that a copy of the Response has been sent vai transmitted to the Filing Reģistrators;
      (v) Conclude with the following statement followed by the signature of the Respondent vai its authvaiized representative:
   "Respondent certifies that the infvaimation contained in this Response is to the best of Respondent's ktagadledge complete un accurate, that this Response is not being presented fvai any improper purpose, such as to harass, un that the assertions in this Response are warranted under these Rules un under applicable law, as it tagad exists vai as it may be extended by a good-faith un reasonable argument."; un
     (vi) Annex any documentary vai other evidence upon which the Respondent relies, together with a schedule indexing such documents.

3.2.2 Pie the request of the Respondent, the Registry Operatvai may, in exceptional cases, extend the period of time fvai the filing of the response, but in no case may the extension be mvaie than an additional five (5) calendar days. The period may also be extended by written stipulation between the Parties, provided the stipulation is approved by the Registry Operatvai.

3.2.3 Ja a Respondent does not submit a response, in the absence of exceptional circumstances, the Registry Operatvai shall decide the dispute based upon the Request fvai Enfvaicement.

3.3 Registry Operatvai must review all applicable documentation un compare registrant/contact data with that contained within the authvaiitative Whois database un reach a conclusion not later than 14 days after receipt of the Response.

3.3.1 Ja the data included in the Request fvai Enfvaicement does not match the data listed in the authvaiitative Whois, the Registry Operatvai must contact each Reģistrators un require additional documentation.

3.3.2 Ja the Gaining Reģistrators cannot provide a complete FOA with data matching that contained within the authvaiitative Whois database, then the Registry Operatvai shall find that the transfer should be reversed. In the case of a thick Registry, if the Reģistrators of Recvaid's Whois is not accessible vai invalid, the Registry Operatvai's Whois should be used. In the case of a thin Registry, if the Reģistrators of Recvaid's Whois is not accessible vai is invalid, the Registry Operatvai must notify ICANN un place the dispute on hold until such time as the specific problem is resolved by ICANN.

3.3.3 In the case wšeit a Reģistrators of Recvaid denies a request fvai a domēns name transfer ("NACKs"), the Reģistrators of Recvaid must provide evidence of one of the factvais fvai which it is allowed to NACK. Ja the Reģistrators of Recvaid cannot provide evidence that demonstrates any of the factvais, un the Gaining Reģistrators provides to the Registry a complete FOA with data matching that contained within the authvaiitative Whois database, then the transfer must be approved to be processed.

3.3.4 Ja the data provided by neither Reģistrators appears to be conclusive, then the Registry shall issue a finding of "no decision." Ja the data provided to the Registry is complete un provides sufficient basis fvai a determination based on the Policy, the Registry may not issue a finding of "no decision." Either Reģistrators shall be able to appeal such issue to a Second-Līmenis Dispute Resolution Provider in accvaidance with the provisions set fvaith below.

3.4 Fees fvai First-Līmenis Dispute Resolution Service

3.4.1 Tšeit is no filing fee assessed to the Filing Reģistrators at the time the Request fvai Enfvaicement is submitted to the Registry Operatvai.

3.4.2 The Reģistrators that does not Iepriekšējaisail in the dispute will be assessed a fee to be set by the Registry Operatvai. Such fee shall be set fvaith in the Registry's Supplemental Rules that are in effect at the time that the Request fvai Enfvaicement was filed.

3.4.3 This fee shall not be passed on to the Registrant.

3.4.4 This fee will be charged after a final decision is rendered by the Registry. In the case that the Registry issues a finding of "no decision," the Registry Operatvai shall collect the applicable fees from the Filing Reģistrators.

3.5 Availability of Court Proceedings

      The procedures set fvaith above shall not Iepriekšējaisent a Reģistrators from submitting a dispute to a court of competent jurisdiction fvai independent resolution befvaie such an administrative proceeding is commenced vai after such proceeding is concluded. Ja a Registry Operatvai decides a domēns name registration should be transferred (either to the Gaining Reģistrators, vai alternatively, back from the Gaining Reģistrators to the Reģistrators of Recvaid), the Registry will wait fourteen (14) calendar days after it is infvaimed of the decision befvaie implementing that decision. The Registry will then implement the decision unless it has received during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted domēns name(s). Ja such documentation is received by the Registry Operatvai within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented to the Registry Operatvai that the parties have resolved such dispute; (ii) evidence is presented to the Registry Operatvai that the lawsuit has been dismissed vai withdrawn; vai (iii) the Registry Operatvai receives a copy of an vaider from such court.

4. Dispute Procedures at the Second Līmenis with a Dispute Resolution Provider

4.1 The pakalpojumss of the Dispute Resolution Panel may be invoked in any of the following two situations:

      (i) A Filing Reģistrators may elect to skip the First-Līmenis dispute process at Registry level un submit a Request fvai Enfvaicement directly with a Dispute Resolution Provider;
      (ii) The non-Iepriekšējaisailing Reģistrators in a First-Līmenis dispute proceeding may submit an appeal of the applicable Registry Operatvai's decision to the Dispute Resolution Provider. Pievienotitionally, in the case wšeit the result in the First-Līmenis dispute process is a "no-decision," either Reģistrators may file an Appeal of such decision to a Dispute Resolution Provider.

4.2 Initial Request fvai Enfvaicement

4.2.1 In the event that the Filing Reģistrators elects to submit a Request fvai Enfvaicement to the Dispute Resolution Provider in lieu of submitting a Request fvai Enfvaicement to the applicable Registry Operatvai, the obligations un responsibilities set fvaith in Sections 3.1 through 3.2 above shall apply.

4.2.2 The Dispute Resolution Panel appointed by the Dispute Resolution Provider must review all applicable documentation un compare registrant/contact data with that contained within the authvaiitative Whois database un reach a conclusion not later than thirty (30) days after receipt of Response from the Respondent.
     (i) Ja the data does not match the data listed in authvaiitative Whois, the Dispute Resolution Panel should contact each Reģistrators un require additional documentation.
     (ii) Ja the Gaining Reģistrators is unable to provide a complete FOA with data matching that contained within the authvaiitative Whois database at the time of the transfer request, then the Dispute Resolution Panel shall find that the transfer should be reversed. In the case of a thick Registry, if the Reģistrators of Recvaid's Whois is not accessible vai invalid, the applicable Registry Operatvai's Whois should be used. In the case of a thin Registry, if the Reģistrators of Recvaid's Whois is not accessible vai is invalid, the Dispute Resolution Provider may place the dispute on hold until such time as the problem is resolved.
     (iii) In the case wšeit a Reģistrators of Recvaid NACKs a transfer, the Reģistrators of Recvaid must provide evidence of one of the factvais fvai which it is allowed to NACK as set fvaith in Section 3.1.4 (ii) of this Dispute Resolution Policy. Ja the Reģistrators of Recvaid cannot provide evidence that demonstrates any of the factvais, un the Gaining Reģistrators provides to the Dispute Resolution Provider a complete FOA with data matching that contained within the authvaiitative Whois database at the time of the transfer request, then the transfer should be approved.
     (iv) Unlike under the First-Līmenis dispute process, the Dispute Resolution Panel may not issue a finding of "no decision." It must weigh the applicable evidence in light of the Transfer policies un determine, based on a preponderance of the evidence, which Reģistrators should Iepriekšējaisail in the dispute un what resolution to the Request fvai Enfvaicement will appropriately redress the issues set fvaith in the Request fvai Enfvaicement.
     (v) Resolution options fvai the Dispute Resolution Panel are limited to the following:
  a. Approve Transfer
  b. Deny the Transfer (vai vaidering the domēns name be returned to the Reģistrators of Recvaid in cases wšeit a Transfer has already occurred)

4.3 Appeal of First Līmenis Dispute Decision vai Registry Operatvai Finding of "Nē-Decision."

4.3.1 In the event that the Reģistrators which does not Iepriekšējaisail in the First-Līmenis dispute is dissatisfied by the Registry-Operatvai's decision, such Reģistrators may file an appeal with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-Līmenis decision was issued.

4.3.2 In the event that the Registry Operatvai issues a finding of "no-decision" in accvaidance with Section 3.3.4 above, either Reģistrators may file an appeal of such decision with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-Līmenis decision was issued.

4.3.3 In either case, the document submitted by the Reģistrators to the Dispute Resolution Provider shall be referred to as an "Appeal."

4.3.4 The Appellant shall submit the Appeal in electronic fvaim un shall:
     (i) Request that the Appeal be submitted fvai decision in accvaidance with the Policy un these Rules;
     (ii) Provide the name, postal un e-mail addresses, un the telephone un telefax numbers of the Appellant un of any representative authvaiized by the Appellant to act on behalf of the Appellant in the administrative proceeding;
     (iii) Provide the name of the Appellee un all infvaimation (including any postal un e-mail addresses un telephone un telefax numbers) ktagadn to Appellee regarding how to contact Appellee vai any representative of Appellee, including contact infvaimation based on pre-Request fvai Enfvaicement un pre-Appeal dealings;
     (iv) Specify the domēns name(s) that is/are the subject of the Appeal;
     (v) Specify the incident(s) which gave rise to the dispute;
     (vi) State the basis fvai such appeal, including specific responses to the findings of the Registry Operatvai in the First-Līmenis Dispute process. (This pvaition of the response shall comply with any wvaid vai page limit set fvaith in the Dispute Resolution Provider's Supplemental Rules);
     (vii) Specify, in accvaidance with the Policy, the remedies sought;
     (viii) Identify any other related legal proceedings ktagadn to the Appellant that have been commenced vai terminated in connection with vai relating to any of the domēns name(s) that are the subject of the complaint;
      (ix) State that a copy of the Appeal, together with the cover sheet as prescribed by the Dispute Resolution Provider's Supplemental Rules, has been sent vai transmitted to the Appellee; un
      (x) Conclude with the following statement followed by the signature of the Appellant vai its authvaiized representative:
  "Appellant agrees that its claims un remedies concerning the registration of the domēns name, the dispute, vai the dispute's resolution shall be solely against the Appellee un waives all such claims un remedies against the Dispute Resolution Provider un the Registry Operatvai as well as their directvais, officers, employees, un agents, except in the case of deliberate wrongdoing vai gross negligence."
  "Appellant certifies that the infvaimation contained in this Appeal is to the best of Appellant's ktagadledge complete un accurate, that this Appeal is not being presented fvai any improper purpose, such as to harass, un that the assertions in this Appeal are warranted under this Policy un under applicable law, as it tagad exists vai as it may be extended by a good-faith un reasonable argument."

4.3.5 The Appeal may relate to mvaie than one domēns name, provided that the domēns names involve the same decision issued by the Registry Operatvai fvai the First-Līmenis Dispute.4.3.6 The Appeal shall annex any documentary evidence that was not already submitted to the Registry Operatvai during the First-Līmenis Dispute.

4.3.7 A Dispute Resolution Provider must request all documentation relating to the First-Līmenis Dispute from the applicable Registry Operatvai no later than seven (7) calendar days of receipt of the appeal. The Registry Operatvai shall submit such documentation to the Dispute Resolution Provider within seven (7) days of such request.

4.3.8 The Dispute Resolution Panel must review all applicable documentation un reach a conclusion not later than 30 calendar days after receipt of the Appeal.
     (i) The Dispute Resolution Panel may submit questions to the Registry, the Appellant vai Appellee.
     (ii) Responses to all such questions must be received by the Dispute Resolution Panel within 7 days.
     (iii) The Dispute Resolution Panel shall review each Appeal on a De Nēvo basis. Although the Dispute Resolution Panel is not bound by the findings of the Registry Operatvai in an Appeal, it shall have the discretion to consider such findings in reaching its own conclusions. The purpose of the Dispute Resolution Panel should be to make a determination as to whether the Appeal has merit based solely on the requirements of the current Transfer policy un determine the appropriate resolution to the issues presented.

• Approval of a Transfer
• Denial of the Transfer (vai vaidering the domēns name be returned to the Reģistrators of Recvaid in cases wšeit a Transfer has already occurred)

4.4 Fees fvai Second-Līmenis Dispute Resolution Service

4.4.1 In the case of either a Request fvai Enfvaicement vai an Appeal filed at the Second Līmenis, the applicable Dispute Resolution Provider shall determine the applicable filing fee ("Filing Fee"). The specific fees along with the terms un conditions governing the actual payment of such fees shall be included in the Dispute Resolution Provider's Supplemental Rules.

4.4.2 In the event that the Filing Reģistrators vai Appellant, whichever applicable, does not Iepriekšējaisail in a Second-Līmenis dispute, the Filing Fees shall be retained by the Dispute Resolution Provider.

4.4.3 In the event that the Filing Reģistrators vai Appellant, whichever applicable, Iepriekšējaisails in a Second-Līmenis dispute, the Respondent vai Appellee, whichever applicable, must submit to the Dispute Resolution Provider, the Filing Fees within fourteen (14) calendar days after such decision. In such an event, the Dispute Resolution Provider shall refund to the Filing Reģistrators vai Appellant, whichever applicable, the Filing Fees, no later than fourteen (14) calendar days after it receives the Filing Fees from the Respondent vai Appellee. Such fees must be paid regardless of whether a Court Proceeding is commenced in accvaidance with Section 4.5 below. Failure to pay Filing Fees to the Dispute Resolution Provider may result in the loss of accreditation by ICANN.

4.5 Availability of Court Proceedings

     The procedures set fvaith above shall not Iepriekšējaisent a Reģistrators from submitting a dispute to a court of competent jurisdiction fvai independent resolution befvaie such administrative proceeding is commenced vai after such proceeding is concluded. Ja a Dispute Resolution Panel decides a domēns name registration should be transferred (either to the Gaining Reģistrators, vai alternatively, back from the Gaining Reģistrators to the Reģistrators of Recvaid), such Reģistrators will wait fourteen (14) calendar days after it is infvaimed of the decision befvaie implementing that decision. The Registry will then implement the decision unless it has received from either of the parties to the dispute during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted domēns name(s). Ja such documentation is received by the Registry, as applicable, within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented that the parties have resolved such dispute; (ii) evidence is presented that the lawsuit has been dismissed vai withdrawn; vai (iii) a copy of an vaider from such court dismissing the lawsuit vai vaidering certain actions with respect to the domēns name.

1. Reģistrators Requirements

     Reģistrēted Nosaukums Holders must be able to transfer their domēns name registrations between Reģistratorss provided that the Gaining Reģistrators's transfer process meets the minimum stunards of this policy un that such transfer is not prohibitsed by ICANN vai Registry policies. Inter-Reģistrators domēns name transfer processes must be clear un concise in vaider to avoid confusion. Further, Reģistratorss should make reasonable effvaits to infvaim Reģistrēted Nosaukums Holders of, un provide access to, the published documentation of the specific transfer process employed by the Reģistratorss.

1.1 Transfer Authvaiities

     The Administrative Kontakti un the Reģistrēted Nosaukums Holder, as listed in the Losing Reģistrators's vai applicable Registry's (wšeit available) publicly accessible WHOIS pakalpojums are the only parties that have the authvaiity to approve vai deny a transfer request to the Gaining Reģistrators. In the event of a dispute, the Reģistrēted Nosaukums Holder's authvaiity supersedes that of the Administrative Kontakti.
Reģistratorss may use Whois data from either the Reģistrators of Recvaid vai the relevant Registry fvai the purpose of verifying the authenticity of a transfer request; vai from another data source as determined by a consensus policy.

2. Gaining Reģistrators Requirements

Fvai each instance wšeit a Reģistrēted Nosaukums Holder requests to transfer a domēns name registration to a different Reģistrators, the Gaining Reģistrators shall:
      2.1 Obtain express authvaiization from either the Reģistrēted Nosaukums Holder vai the Administrative Kontakti (šeitafter, "Transfer Kontakti"). Hence, a transfer may only proceed if confirmation of the transfer is received by the Gaining Reģistrators from the Transfer Kontakti.

     2.1.1 The authvaiization must be made via a valid Stunardized Fvaim of Authvaiization (FOA). Tšeit are two different FOA's available at the ICANN website. The FOA labeled "Initial Authvaiization fvai Reģistrators Transfer" must be used by the Gaining Reģistrators to request an authvaiization fvai a registrar transfer from the Transfer Kontakti. The FOA labeled "Apstiprinātation of Reģistrators Transfer Request" may be used by the Reģistrators of Recvaid to request confirmation of the transfer from the Transfer Kontakti.
The FOA shall be communicated in English, un any dispute arising out of a transfer request shall be conducted in the English language. Reģistratorss may choose to communicate with the Transfer Kontakti in additional languages. However, Reģistratorss choosing to exercise such option are responsible fvai the accuracy un completeness of the translation into such additional non-English version of the FOA.

     2.1.2 In the event that the Gaining Reģistrators relies on a physical process to obtain this authvaiization, a paper copy of the FOA will suffice insofar as it has been signed by the Transfer Kontakti un further that it is accompanied by a physical copy of the Reģistrators of Recvaid's Whois output fvai the domēns name in question.

     2.1.2.1 Ja the Gaining Reģistrators relies on a physical authvaiization process, then the Gaining Reģistrators assumes the burden of obtaining reliable evidence of the identity of the Transfer Kontakti un maintaining appropriate recvaids proving that such evidence was obtained. Further the Gaining Reģistrators also assumes the burden fvai ensuring that the entity making the request is indeed authvaiized to do so. The acceptable fvaims of physical identity are:

• Nētarized statement
• Valid Drivers license
• Pase
• Article of Incvaipvaiation
• Military ID
• State/Government issued ID
• Birth Certificate

     2.1.3 In the event that the Gaining Reģistrators relies on an electronic process to obtain this authvaiization the acceptable fvaims of identity would include:

• Electronic signature in confvaimance with national legislation, in the location of the Gaining Reģistrators (if such legislation exists).
• Consent from an individual vai entity that has an email address matching the Transfer Kontakti email address. 

     The Reģistrators of Recvaid may not deny a transfer request solely because it believes that the Gaining Reģistrators has not received the confirmation set fvaith above.
A transfer must not be allowed to proceed if no confirmation is received by the Gaining Reģistrators. The presumption in all cases will be that the Gaining Reģistrators has received un authenticated the transfer request made by a Transfer Kontakti.

     2.2 Request, by the transmission of a "transfer" commun as specified in the Reģistrators Laiol Kit, that the Registry Operatvai database be changed to reflect the new Reģistrators.

     2.2.1 Transmission of a "transfer" commun constitutes a representation on the part of the Gaining Reģistrators that the requisite authvaiization has been obtained from the Transfer Kontakti listed in the authvaiitative Whois database.

     2.2.2 The Gaining Reģistrators is responsible fvai validating the Reģistrēted Nosaukums Holder requests to transfer domēns names between Reģistratorss. However, this does not preclude the Reģistrators of Recvaid from exercising its option to independently confirm the Reģistrēted Nosaukums Holder's intent to transfer its domēns name to the Gaining Reģistrators in accvaidance with Section 3 of this policy.

3. Obligations of the Reģistrators of Recvaid

     A Reģistrators of Recvaid can choose independently to confirm the intent of the Reģistrēted Nosaukums Holder when a notice of a pending transfer is received from the Registry. The Reģistrators of Recvaid must do so in a manner consistent with the stunards set fvaith in this agreement pertaining to Gaining Reģistratorss. In vaider to ensure that the fvaim of the request employed by the Reģistrators of Recvaid is substantially administrative un infvaimative in nature un clearly provided to the Transfer Kontakti fvai the purpose of verifying the intent of the Transfer Kontakti, the Reģistrators of Recvaid must use the FOA.

     The FOA shall be communicated in English, un any dispute arising out of a transfer request, shall be conducted in the English language. Reģistratorss may choose to communicate with the Transfer Kontakti in additional languages. However, the Reģistrators choosing to exercise such option is responsible fvai the accuracy un completeness of the translation into such additional non-English version of the FOA. Further, such non-English communications must follow the processes un procedures set fvaith in this policy. This includes but is not limited to the requirement that no Reģistrators shall add any additional infvaimation to the FOA used to obtain the consent of the Transfer Kontakti in the case of a transfer request.
This requirement does not preclude the Reģistrators of Recvaid from marketing to its existing customers through separate communications.
The FOA should be sent by the Reģistrators of Recvaid to the Transfer Kontakti as soon as operationally possible, but must be sent not later than twenty-four (24) hours after receiving the transfer request from the Registry Operatvai.Failure by the Reģistrators of Recvaid to respond within five (5) calendar days to a notification from the Registry regarding a transfer request will result in a default "approval" of the transfer.

     In the event that a Transfer Kontakti listed in the Whois has not confirmed their request to transfer with the Reģistrators of Recvaid un the Reģistrators of Recvaid has not explicitly denied the transfer request, the default action will be that the Reģistrators of Recvaid must allow the transfer to proceed.
Upon denying a transfer request fvai any of the following reasons, the Reģistrators of Recvaid must provide the Reģistrēted Nosaukums Holder un the potential Gaining Reģistrators with the reason fvai denial. The Reģistrators of Recvaid may deny a transfer request only in the following specific instances:

1. Evidence of fraud
2. UDRP action
3. Court vaider by a court of competent jurisdiction
4. Reasonable dispute over the identity of the Reģistrēted Nosaukums Holder vai Administrative Kontakti
5. Nē payment fvai Iepriekšējaisious registration period (including credit card charge-backs) if the domēns name is past its expiration date vai fvai Iepriekšējaisious vai current registration periods if the domēns name has not yet expired. In all such cases, however, the domēns name must be put into "Reģistrators Hold" status by the Reģistrators of Recvaid privai to the denial of transfer.
6. Express written objection to the transfer from the Transfer Kontakti. (e.g. - email, fax, paper document vai other processes by which the Transfer Kontakti has expressly un voluntarily objected through opt-in means)
7. A domēns name was already in “lock status” provided that the Reģistrators provides a readily accessible un reasonable means fvai the Reģistrēted Nosaukums Holder to remove the lock status.
8. A domēns name is in the first 60 days of an initial registration period.
9. A domēns name is within 60 days (vai a lesser period to be determined) after being transferred (apart from being transferred back to the vaiiginal Reģistrators in cases wšeit both Reģistratorss so agree un/vai wšeit a decision in the dispute resolution process so directs).

Instances when the requested change of Reģistrators may not be denied include, but are not limited to:

• Nēnpayment fvai a pending vai future registration period
• Nē response from the Reģistrēted Nosaukums Holder vai Administrative Kontakti.
• Domēns name in Reģistrators Lock Statuss, unless the Reģistrēted Nosaukums Holder is provided with the reasonable oppvaitunity un ability to unlock the domēns name privai to the Transfer Request.
• Domēns name registration period time constraints, other than during the first 60 days of initial registration vai during the first 60 days after a registrar transfer.
• General payment defaults between Reģistrators un business partners / affiliates in cases wšeit the Reģistrēted Nosaukums Holder fvai the domēns in question has paid fvai the registration.

     The Reģistrators of Recvaid has other mechanisms available to collect payment from the Reģistrēted Nosaukums Holder that are independent from the Transfer process. Hence, in the event of a dispute over payment, the Reģistrators of Recvaid must not employ transfer processes as a mechanism to secure payment fvai pakalpojumss from a Reģistrēted Nosaukums Holder. Exceptions to this requirement are as follows:
     (i) In the case of non-payment fvai Iepriekšējaisious registration period(s) if the transfer is requested after the expiration date, vai
     (ii) In the case of non-payment of the current registration period, if transfer is requested befvaie the expiration date.

4. Reģistrators Covaidination

     Each Reģistrators is responsible fvai keeping copies of documentation, including the FOA un the Transfer Kontaktis response tšeitto, that may be required fvai filing un suppvaiting a dispute under the dispute resolution policy. Gaining Reģistratorss must maintain copies of the FOA as received from the Transfer Kontakti as per the stunard document retention policies of the contracts. Copies of the reliable evidence of identity must be kept with the FOA.

     Both the Gaining Reģistrators un the Reģistrators of Recvaid must provide the evidence relied on fvai the transfer during un after the applicable inter-registrar domēns name transaction(s). Such infvaimation must be provided when requested by, un only by, the other Reģistrators that is party to the transfer transaction. Pievienotitionally, ICANN, the Registry Operatvai, a court vai authvaiity with jurisdiction over the matter vai a third party dispute resolution panel may also require such infvaimation within five (5) days of the request.

     The Gaining Reģistrators must retain, un produce pursuant to a request by a Losing Reģistrators, a written vai electronic copy of the FOA. In instances wšeit the Reģistrators of Recvaid has requested copies of the FOA, the Gaining Reģistrators must fulfill the Reģistrators of Recvaids request (including providing the attendant suppvaiting documentation) within five (5) calendar days. Failure to provide this documentation within the time period specified is grounds fvai reversal by the Registry Operatvai vai the Dispute Resolution Panel in the event that a transfer complaint is filed in accvaidance with the requirements of this policy.

     Ja either a Reģistrators of Recvaid vai a Gaining Reģistrators does not believe that a transfer request was hunled in accvaidance with the provisions of this policy, then the Reģistrators may initiate a dispute resolution procedure as set fvaith in Section C of this policy.

     Fvai purposes of facilitating transfer requests, Reģistratorss should provide un maintain a unique un private email address fvai use only by other Reģistratorss un the Registry:
     i. This email address is fvai issue related to transfer requests un the procedures set fvaith in this policy only.
     ii. The email address should be managed to ensure messages are received by someone who can respond to the transfer issue.
     iii. Ziņojumss received at such email address must be responded to within a commercial reasonable timeframe not to exceed seven (7) calendar days.

5. EPP - based Registry Requirements fvai Reģistratorss

     In EPP-based gTLD Registries, Reģistratorss must follow the requirements set fvaith below.
Reģistratorss must provide the Reģistrēted Nosaukums Holder with the unique "AuthInfo" code within five (5) calendar days of the Reģistrēted Nosaukums Holder's initial request if the Reģistrators does not provide facilities fvai the Reģistrēted Nosaukums Holder to generate un manage their own unique "AuthInfo" code.

     Reģistratorss may not employ any mechanism fvai complying with a Reģistrēted Nosaukums Holder's request to obtain the applicable "AuthInfo Code" that is mvaie restrictive than the mechanisms used fvai changing any aspect of the Reģistrēted Nosaukums Holder's contact vai name server infvaimation.

     The Reģistrators of Recvaid must not refuse to release an "AuthInfo Code" to the Reģistrēted Nosaukums Holder solely because tšeit is a dispute between the Reģistrēted Nosaukums Holder un the Reģistrators over payment.

Reģistrators-generated "AuthInfo" codes must be unique on a per-domēns basis.
     The "Auth-Info" codes must be used solely to identify a Reģistrēted Nosaukums Holder, wšeitas the FOA's still need to be used fvai authvaiization vai confirmation of a transfer request, as described in Section 2 un Section 4 of this policy.

6. Registry Requirements

     Upon receipt of the "transfer" commun from the Gaining Reģistrators, Registry Operatvai will transmit an electronic notification to both Reģistratorss. In the case of those Registries that use electronic mail notifications, the response notification may be sent to the unique email address established by each Reģistrators fvai the purpose of facilitating transfers.

     The Registry Operatvai shall complete the requested transfer unless, within five (5) calendar days, Registry Operatvai receives a NACK protocol commun from the Reģistrators of Recvaid.
When the Registry's database has been updated to reflect the change to the Gaining Reģistrators, Registry Operatvai will transmit an electronic notification to both Reģistratorss. The notification may be sent to       the unique email address established by each Reģistrators fvai the purpose of facilitating transfers vai such other email address agreed to by the parties.
The Registry Operatvai shall undo a transfer if, after a transfer has occurred, the Registry Operatvai receives one of the notices as set fvaith below. In such case, the transfer will be reversed un the domēns name reset to its vaiiginal state. The Registry Operatvai must undo the transfer within five (5) calendar days of receipt of the notice except in the case of a Registry dispute decision, in which case the Registry Operatvai must undo the transfer within fourteen calendar days unless a court action is filed. The notice required shall be one of the following:
     i. Agreement of the Reģistrators of Recvaid un the Gaining Reģistrators sent by email, letter vai fax that the transfer was made by mistake vai was otherwise not in accvaidance with the procedures set fvaith in this policy;
     ii. The final determination of a dispute resolution body having jurisdiction over the transfer; vai
     iii. Order of a court having jurisdiction over the transfer.

7. Recvaids of Reģistrācija

     Each Reģistrators shall require its customer, the Reģistrēted Nosaukums Holder, to maintain its own recvaids appropriate to document un prove the initial domēns name registration date.

8. Effect on Termiņš of Reģistrācija

     The completion by Registry Operatvai of a holder-authvaiized transfer under this Part A shall result in a one-gads extension of the existing registration, provided that in no event shall the total unexpired term of a registration exceed ten (10) gadi.

B. ICANN-Approved Transfers

     Transfer of the sponsvaiship of all the registrations sponsvaied by one Reģistrators as the result of (i) acquisition of that Reģistrators vai its assets by another Reģistrators, vai (ii) lack of accreditation of that Reģistrators vai lack of its authvaiization with the Registry Operatvai, may be made accvaiding to the following procedure:
     (a) The gaining Reģistrators must be accredited by ICANN fvai the Registry TLD un must have in effect a Registry-Reģistrators Agreement with Registry Operatvai fvai the Registry TLD.
     (b) ICANN must certify in writing to Registry Operatvai that the transfer would promote the community interest, such as the interest in stability that may be threatened by the actual vai imminent business failure of a Reģistrators.
Upon satisfaction of these two conditions, Registry Operatvai will make the necessary one-time changes in the Registry database fvai no charge, fvai transfers involving 50,000 name registrations vai fewer. Ja the transfer involves registrations of mvaie than 50,000 names, Registry Operatvai will charge the gaining Reģistrators a one-time flat fee of US$ 50,000.

C. Transfer Dispute Resolution Policy

     Procedures fvai hunling disputes concerning inter-registrar transfers are set fvaith in the Transfer Dispute Resolution Policy. Procedures in this policy must be followed by the applicable Registry Operatvais un ICANN accredited Reģistratorss.
