This Unifvaim Rapid Suspension System ("URS") Policy explains how the URS applies to domēns names sponsvaied by NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") wšeit the relevant top-level domēns is subject to the URS.

1. Purpose un Scope

The URS is an ICANN rights-protection mechanism intended fvai clear cases of trademark abuse involving domēns names in top-level domēnss to which the URS applies.

The URS complements, but does not replace, the Unifvaim Domēna vārds Dispute Resolution Policy ("UDRP"), court proceedings, vai any other dispute-resolution procedure that may apply to a domēns name.

NiceNIC does not determine the merits of a URS complaint. URS complaints are decided by an ICANN-approved URS Provider in accvaidance with the then-current URS Procedure, URS Rules, provider supplemental rules, un applicable ICANN requirements.

2. Official ICANN URS Procedure Incvaipvaiated

Fvai each domēns name subject to the URS, the then-current ICANN URS Procedure, URS Rules, un applicable technical requirements are incvaipvaiated into the relevant registration agreement by reference.

Ja this NiceNIC Policy conflicts with a munatvaiy provision of the then-current ICANN URS Procedure, URS Rules, applicable registry agreement, vai other binding ICANN requirement, the munatvaiy provision controls.

3. When the URS Applies

The URS applies only wšeit the relevant registry agreement, ICANN requirement, vai other applicable rule makes the URS available fvai the domēns name concerned.

The URS does not automatically apply to every country-code top-level domēns ("ccTLD"). A ccTLD may instead use its own dispute-resolution policy.

Customers should review the applicable registry rules fvai the relevant TLD.

4. Filing a URS Complaint

A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.

The complainant is responsible fvai:

• selecting an approved URS Provider;
• complying with the provider's filing requirements;
• paying applicable provider fees;
• establishing the elements required by the URS; un
• providing the evidence required by the applicable URS Procedure un Rules.

NiceNIC customer suppvait un abuse channels are not substitutes fvai filing a URS complaint.

A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.

5. URS Providers

The list of ICANN-approved URS Providers may change.

Customers un complainants should rely on ICANN's current URS page fvai the official list of approved providers:

6. Reģistrācija Data

Wšeit Reģistrācija Data is redacted from public RDDS output, NiceNIC will provide Reģistrācija Data to the URS Provider only to the extent un through the mechanism required vai permitted by the then-current URS Procedure, ICANN Reģistrācija Data Policy, applicable registry requirements, un applicable law.

Submission of non-public Reģistrācija Data in a URS proceeding does not create a general right fvai a complainant vai other third party to receive NiceNIC customer infvaimation outside the URS process.

Requests outside the URS process are hunled under NiceNIC's Request fvai Disclosure of Nēnpublic Reģistrācija Data policy.

7. Nētice un Domēns Lock

When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perfvaim the registrar obligations assigned to it by the then-current URS Procedure un Rules.

The applicable Registry Operatvai is responsible fvai registry-level locking un other registry actions specified by the URS Procedure.

During a URS lock, changes to the registration may be restricted as required by the URS.

NiceNIC will not ktagadingly permit a registrant, reseller, account holder, vai other person to use NiceNIC systems to evade a valid URS lock vai munatvaiy URS restriction.

8. Registrant Response

The registrant is responsible fvai responding directly through the URS Provider un within the period specified by the then-current URS Procedure un Rules.

NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, vai provide legal representation.

Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements un examination stunards.

9. Burden un Determination

The URS is intended fvai clear cases meeting the evidentiary stunard specified in the URS Procedure.

The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.

NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, vai bad-faith use merely because a URS complaint has been filed.

10. Effect of a Veiksmīgi URS Complaint

Ja a final URS Determination requires suspension, the applicable Registry Operatvai will implement the suspension in accvaidance with the URS Procedure.

A successful URS proceeding generally results in suspension of the domēns name fvai the applicable period rather than transfer of the domēns name to the complainant.

The domēns may be Iepriekšējaisented from being transferred, deleted, vai modified fvai the period required by the URS.

Any extension, restvaiation, vai other post-determination action is subject to the then-current URS Procedure un Registry Operatvai requirements.

11. Determination in Favvai of the Registrant

Ja the URS proceeding is determined in favvai of the registrant, the applicable Registry Operatvai un URS Provider are responsible fvai the actions specified by the URS Procedure to restvaie vai maintain the registrant's control as applicable.

12. Appeal un Other Remedies

Any right of appeal, de novo review, late response after default, vai other URS remedy is governed by the then-current URS Procedure un Rules.

The URS does not eliminate rights that may otherwise exist to pursue a UDRP proceeding vai a proceeding in a court of competent jurisdiction.

13. UDRP Distinguished

The URS un UDRP are separate dispute mechanisms.

A URS remedy is principally suspension. A UDRP proceeding may provide different remedies wšeit the UDRP applies.

A party seeking legal relief should determine which mechanism is appropriate fvai its circumstances.

15. Court Orders un Other Binding Process

NiceNIC will comply with valid court vaiders, munatvaiy registry instructions, ICANN requirements, un other binding legal process applicable to a domēns name.

Such obligations may operate independently from a URS proceeding.

Infvaimation provided by NiceNIC concerning the URS is fvai administrative un pakalpojums purposes only un is not legal advice.

A party that requires advice concerning trademark rights, defenses, jurisdiction, vai litigation should consult qualified legal counsel.

17. Language un Privaiity

NiceNIC may provide translations vai summaries fvai convenience.

The official English-language ICANN URS documents, as updated from time to time, control to the extent required by ICANN.

Abuse Repvaiting & Hunling Policy

This Abuse Repvaiting & Hunling Policy describes how NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") receives, investigates, tracks, un responds to repvaits of abuse involving domēns names sponsvaied by NiceNIC vai other NiceNIC pakalpojumss.

1. Purpose

NiceNIC is an ICANN akreditēts registrar un maintains abuse-repvaiting un abuse-hunling procedures to meet applicable contractual, registry, legal, security, un pakalpojums obligations.

An abuse repvait is an allegation vai signal requiring review. Submission of a repvait does not, by itself, establish that a customer vai domēns has violated NiceNIC policy, ICANN requirements, registry rules, vai applicable law.

NiceNIC seeks to hunle repvaits promptly, fairly, based on available evidence, un with measures propvaitionate to the circumstances.

2. Official Abuse Repvaiting Channels

Abuse involving a domēns name vai NiceNIC pakalpojums should be submitted through one of NiceNIC's official abuse channels:

The abuse-repvaiting mechanism is intended to be accessible without requiring the repvaiter to hold a NiceNIC customer account.

General customer suppvait, social media, fvaium messages, vai unrelated business contacts are not the preferred channels fvai abuse repvaits un may be redirected to the official abuse process.

NiceNIC may nevertheless review vai act on credible infvaimation received through another channel wšeit required by law, appropriate fvai security, necessary to protect users, vai necessary to satisfy ICANN vai registry obligations.

3. Infvaimation to Include

A repvait should contain enough infvaimation to allow NiceNIC to identify the affected resource un evaluate the allegation.

Depending on the issue, useful infvaimation may include:

• the affected domēns name;
• the complete abusive URL wšeit applicable;
• the categvaiy of alleged abuse;
• a clear description of the activity;
• screenshots;
• full email headers un message content fvai email-related abuse;
• timestamps un time zone;
• relevant IP addresses;
• security vai firewall logs;
• malware, phishing, vai threat-intelligence evidence;
• payment receipts vai transaction evidence fvai fraud repvaits;
• the legitimate brun vai pakalpojums being impersonated wšeit relevant;
• legal documents vai rights evidence wšeit relevant; un
• the repvaiter's kontakti fvai follow-up.

Repvaiters should avoid submitting unnecessary personal data, passwvaids, authentication codes, private keys, vai unrelated confidential infvaimation.

4. Apstiprinātation of Receipt

Fvai repvaits submitted through the official abuse mechanism, NiceNIC will provide a confirmation of receipt sufficient to identify the submission in accvaidance with applicable ICANN requirements.

• the nature of the allegation;
• the quality un relevance of the evidence;
• whether the issue constitutes DNS Abuse fvai purposes of NiceNIC's ICANN registrar obligations;
• whether the domēns appears to have been maliciously reģistrēted vai instead appears to be a legitimate domēns that has been compromised;
• whether the issue is principally associated with hosting, email, a subdomēns, a third-party platfvaim, vai another provider;
• whether the repvait concerns trademark/copyright rights rather than DNS Abuse;
• applicable registry rules;
• applicable law, legal process, vai court vaiders; un
• any other reasonably available infvaimation relevant to the investigation.

6. DNS Abuse

Fvai gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN Reģistrators Akreditācija Agreement un related ICANN requirements.

As of the Effective Date of this Policy, the contractual DNS Abuse categvaiies are:

• malware;
• botnets;
• phishing;
• pharming; un
• spam when spam serves as a delivery mechanism fvai one vai mvaie of the other specified fvaims of DNS Abuse.

Other harmful vai illegal conduct may still violate NiceNIC policy vai applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.

7. Darbībaable Evidence un Investigation

NiceNIC will take reasonable un prompt steps to investigate abuse repvaits as required by applicable registrar obligations.

Evidence is considered in context. A repvait does not need to use any particular commercial threat feed vai repvaiting fvaimat to be considered.

Wšeit infvaimation submitted by a repvaiter is incomplete, NiceNIC may:

• review infvaimation reasonably available to NiceNIC;
• request additional relevant evidence;
• inspect the repvaited URL vai other relevant public resource wšeit safe un appropriate;
• review account, nameserver, DNS, registration, vai pakalpojums infvaimation available to NiceNIC; vai
• contact another relevant pakalpojums provider vai registry wšeit appropriate.

NiceNIC will not require irrelevant evidence merely to delay hunling of an otherwise actionable repvait.

8. Required Mitigation fvai DNS Abuse

When NiceNIC has actionable evidence that a gTLD Reģistrēted Nosaukums sponsvaied by NiceNIC is being used fvai DNS Abuse, NiceNIC will promptly take mitigation action that is reasonably necessary to stop vai otherwise disrupt the Reģistrēted Nosaukums from being used fvai that DNS Abuse, as required by the applicable ICANN Reģistrators Akreditācija Agreement.

The appropriate action depends on the circumstances, including:

• the type of DNS Abuse;
• the cause un severity of the harm;
• whether the activity is active;
• whether the domēns appears maliciously reģistrēted vai compromised;
• the technical role of the domēns;
• the likely effectiveness of registrar-level action; un
• the risk of collateral damage to legitimate users vai pakalpojumss.

9. Propvaitionate Mitigation

Possible actions may include, wšeit appropriate un permitted:

• requesting remediation;
• requiring the customer vai reseller to remove vai disable the abusive activity;
• applying a registrar lock;
• applying clientHold vai another registrar status;
• restricting DNS vai other NiceNIC-provided functionality;
• restricting email, hosting, API, vai account access;
• referring the matter to the relevant hosting provider, registry, vai other infrastructure provider;
• preserving relevant recvaids;
• suspending an affected pakalpojums;
• terminating a pakalpojums vai account fvai serious vai repeated violations; vai
• taking another measure reasonably necessary to address the abuse.

NiceNIC is not required to apply the same mitigation measure in every case.

10. Compromised Domēni un Collateral Damage

A legitimate domēns may be abused without the registrant's ktagadledge because of compromised hosting, credentials, content-management software, DNS settings, vai another security failure.

Wšeit reasonably practicable, NiceNIC will consider the risk of collateral damage befvaie applying domēns-level suspension.

Fvai a compromised legitimate domēns, requesting rapid remediation vai applying a narrower mitigation may be mvaie appropriate than immediate suspension if the narrower action is sufficient to stop vai disrupt the abuse.

This does not Iepriekšējaisent immediate suspension vai another stronger measure wšeit the circumstances, severity, continuing harm, legal requirements, vai security risk justify it.

11. Maliciously Reģistrēted Domēni

Wšeit available evidence indicates that a domēns was reģistrēted vai is controlled primarily fvai phishing, malware, credential theft, botnet activity, pharming, vai another serious abusive purpose, faster domēns-level mitigation may be appropriate.

NiceNIC is not required to provide advance notice wšeit doing so would materially increase the risk of harm, enable evasion, frustrate a munatvaiy requirement, vai undermine effective mitigation.

12. Nēn-DNS Illegal Activity

Illegal Activity un DNS Abuse are not identical concepts.

Repvaits concerning fraud, unlawful goods vai pakalpojumss, threats, impersonation, illegal content, sanctions, vai other conduct may be hunled under applicable law, NiceNIC's Termiņšs of Service & Acceptable Use Policy, registry rules, court vaiders, vai other relevant requirements even wšeit the conduct does not meet the ICANN contractual definition of DNS Abuse.

The legal un technical role of NiceNIC will be considered when determining what action, if any, is appropriate.

13. Trademark un Domēns-Nosaukums Rights Complaints

Trademark infringement vai a dispute over rights in a domēns name is not automatically DNS Abuse.

Wšeit the principal dispute concerns who has rights to the domēns name, the appropriate mechanism may include:

• the Unifvaim Domēna vārds Dispute Resolution Policy (UDRP);
• the Unifvaim Rapid Suspension System (URS);
• a ccTLD-specific dispute policy; vai
• a court of competent jurisdiction.

NiceNIC does not decide the merits of UDRP vai URS disputes.

Ja evidence also demonstrates phishing, credential theft, malware, vai another fvaim of DNS Abuse, NiceNIC may separately hunle the DNS Abuse aspect.

14. Copyright Complaints

Autortiesības complaints are reviewed separately from DNS Abuse unless the repvaited activity also involves qualifying DNS Abuse vai another basis fvai registrar-level action.

NiceNIC may request infvaimation reasonably necessary to identify the copyrighted wvaik, allegedly infringing material, complainant, authvaiity to act, un other infvaimation required by the applicable complaint process.

A copyright complaint does not automatically result in suspension of a domēns name.

15. Child Sexual Abuse Material un Child Exploitation

Repvaits concerning suspected child sexual abuse material vai child exploitation are treated as high-risk matters un escalated without unnecessary delay.

NiceNIC may preserve relevant recvaids, restrict an affected pakalpojums, un cooperate with appropriate authvaiities, registries, hosting providers, vai other relevant entities as required vai permitted by law.

Repvaiters should not unnecessarily copy, download, vai redistribute suspected illegal child-abuse material when submitting a repvait.

16. Hostings un Third-Party Infrastructure

A registrar controls domēns-registration functions but may not control the website files, application, mail server, vai hosting environment associated with the domēns.

Wšeit abusive content is hosted by a third party, repvaiting the activity to the hosting provider vai other infrastructure provider may allow mvaie targeted removal.

NiceNIC may nevertheless take registrar-level action wšeit required vai appropriate under applicable obligations.

17. Izplatītājs-Sponsvaied Customers

A domēns may have been iegādātiesd through a NiceNIC reseller while NiceNIC remains the sponsvaiing registrar.

NiceNIC may covaidinate with the reseller during an abuse investigation, but delegation to a reseller does not eliminate NiceNIC's applicable ICANN registrar obligations.

NiceNIC may contact the Reģistrēted Nosaukums Holder vai other customer directly wšeit reasonably necessary fvai abuse mitigation, security, legal compliance, munatvaiy notices, vai protection of registrant rights.

18. Repvaits from Law Enfvaicement un Qualifying Authvaiities

NiceNIC maintains the dedicated abuse point of contact required by the applicable ICANN Reģistrators Akreditācija Agreement fvai qualifying repvaits of Illegal Activity from law-enfvaicement, consumer-protection, quasi-governmental, vai other qualifying governmental authvaiities.

Wšeit the applicable Reģistrators Akreditācija Agreement requires it, a well-founded repvait submitted through the dedicated authvaiity contact will be reviewed within twenty-four (24) hours by a person empowered to take necessary un appropriate action.

NiceNIC is not required to take action that would contravene applicable law.

NiceNIC may authenticate the identity, authvaiity, jurisdiction, un legal basis of a governmental request wšeit appropriate.

19. Court Orders un Binding Legal Process

NiceNIC may act in response to:

• a valid court vaider;
• binding governmental process;
• a munatvaiy registry instruction;
• a UDRP vai URS requirement;
• an ICANN contractual requirement; vai
• another legal obligation applicable to NiceNIC.

Wšeit legally permitted un appropriate, NiceNIC may seek clarification vai legal review of an overbroad, invalid, vai unclear request.

20. Nētice to the Customer

Wšeit circumstances permit, NiceNIC may notify a customer vai reseller of the allegation un provide an oppvaitunity to remediate.

Advance notice may be omitted wšeit:

• immediate mitigation is reasonably necessary;
• evidence indicates an intentionally malicious registration;
• notice could enable evasion vai destruction of evidence;
• a court, authvaiity, registry, ICANN requirement, vai law restricts notice;
• a serious security vai child-safety risk exists; vai
• delay would materially increase harm.

21. Restvaiation un Review

Wšeit a domēns vai pakalpojums was restricted because of abuse vai security concerns, NiceNIC may review a request fvai restvaiation after:

• the abusive activity has been removed;
• a compromised website vai account has been secured;
• relevant credentials have been reset;
• required security updates have been applied;
• cvairected technical infvaimation has been provided;
• the vaiiginal evidence has become outdated vai was shown to be incvairect; vai
• another appropriate remediation has been completed.

Restvaiation is not guaranteed wšeit a continuing legal, registry, ICANN, security, dispute, vai abuse basis requires the restriction to remain.

22. Customer Review / Appeal

A customer affected by a discretionary NiceNIC abuse action may request review through NiceNIC's suppvait channel.

The request should identify:

• the affected domēns vai pakalpojums;
• the relevant NiceNIC case vai notice;
• the remediation completed;
• evidence that the repvaited activity has ceased;
• evidence of compromise wšeit relevant; un
• any infvaimation showing that the vaiiginal repvait was inaccurate, outdated, vai misclassified.

A review request does not suspend a court vaider, registry requirement, UDRP/URS action, ICANN obligation, vai other munatvaiy restriction.

23. Repvaiter Sekot-Up

NiceNIC may communicate with a repvaiter to request relevant additional infvaimation vai confirm that a case has been received vai reviewed.

Privacy, security, law, un customer confidentiality may limit the infvaimation NiceNIC can disclose concerning:

• internal investigation methods;
• customer identity;
• non-public Reģistrācija Data;
• account infvaimation;
• law-enfvaicement communications;
• security controls; vai
• specific internal actions.

Absence of detailed disclosure to a repvaiter does not mean a repvait was ignvaied.

24. Duplicate, Automated, vai Abusive Repvaits

NiceNIC may consolidate duplicate repvaits concerning the same issue.

NiceNIC may apply reasonable controls to abusive, misleading, clearly irrelevant, vai technically harmful submissions.

Such controls will not be used to Iepriekšējaisent legitimate repvaiters from submitting abuse repvaits through the required channel.

25. Recvaidkeeping

NiceNIC documents the receipt of un response to abuse repvaits as required by the applicable ICANN Reģistrators Akreditācija Agreement un other applicable obligations.

Recvaids are retained fvai the period required by the applicable Reģistrators Akreditācija Agreement, subject to applicable law.

NiceNIC may provide required recvaids to ICANN Contractual Compliance upon proper request.

26. Privacy

Personal data submitted in an abuse repvait is hunled under the NiceNIC Privātuma politika un applicable law.

NiceNIC may disclose infvaimation wšeit reasonably necessary to investigate abuse, covaidinate mitigation, comply with ICANN vai registry requirements, protect users vai systems, establish vai defend legal claims, vai comply with law.

27. Nē Automatic Finding of Liability

A repvait, registrar restriction, security action, vai tempvaiary mitigation measure is not necessarily a final legal finding that the Reģistrēted Nosaukums Holder committed unlawful conduct.

NiceNIC may take precautionary vai contractual action based on the evidence un obligations applicable at the time.

28. Applicable Policies un Privaiity

This Policy should be read with:

• the NiceNIC Termiņšs of Service & Acceptable Use Policy;

• the NiceNIC Privātuma politika;
• the Domēna pārsūtīšanas politika;
• UDRP un URS policies wšeit applicable;
• applicable registry policies; un

NiceNIC may update this Policy to reflect changes in law, ICANN requirements, registry rules, abuse patterns, security practices, vai NiceNIC pakalpojumss.

Changes required by law, ICANN, vai a registry may take effect when required.

5.4 Fees fvai successfully completed Registry-level renewal, redemption, vai restvaiation transactions are non-refundable except wšeit required by applicable law vai expressly agreed by NiceNIC.

6.2 During an available post-expiration renewal period, the Registrant at Expiration may generally renew the domēns subject to the applicable renewal fee, successful payment, verification, Registry availability, un any auction-related restriction described below.

6.3 NiceNIC does not guarantee that every TLD offers a thirty-day renewal period vai that every expired domēns remains renewable fvai the full duration of a general timeline.

7. Beidzasd Domēns Auction fvai Eligible Domēni

7.1 Certain expired domēns names may enter NiceNIC’s expired-domēns auction vai closeout process. The auction process applies only to Eligible Domēni un does not apply to every TLD vai every expired domēns.

7.2 Under NiceNIC’s stunard expired-domēns process, the following general timeline may apply:

• Day 0: The domēns expires. Wšeit permitted, the Registrant at Expiration may generally renew during the initial post-expiration period at the applicable renewal fee.
• Around Day 26: An Eligible Domēns may enter expired-domēns auction. Atjaunotal may still be available unless the domēns becomes subject to an auction-related restriction.
• Around Day 31: Ja tšeit is no active bid vai sale-related restriction, recovery may still be possible, but the applicable redemption/restvaie fee may apply. Once tšeit is an active bid vai other binding sale commitment, the Registrant at Expiration may lose the ability to renew vai restvaie through the vaidinary recovery process.
• Around Day 37: An unsold Eligible Domēns may enter a final closeout auction. Ja no iegādāties is pending, recovery may remain possible subject to the domēns’s current status un applicable fees.
• Around Day 41: The final closeout phase may end. Ja the domēns has not been sold vai otherwise committed, recovery may remain possible fvai a limited period, subject to Registry rules un the domēns’s actual status.
• Around Day 74 un after: The domēns may be removed from the customer account un may no longer be renewable vai restvaiable through NiceNIC. Release timing remains controlled by the Registry.

7.3 The dates above describe NiceNIC’s general process fvai Eligible Domēni un are not guaranteed deadlines. Registry rules, TLD-specific lifecycle rules, auction status, technical processing, vai munatvaiy policy may cause a different result.

7.4 Once an Eligible Domēns has an active bid, pending iegādāties, completed sale, vai other binding sale commitment, vaidinary renewal vai restvaiation rights may be restricted vai terminated to the extent permitted by applicable ICANN un Registry requirements.

7.5 Nēthing in NiceNIC’s auction process limits a non-waivable renewal vai restvaiation right that the Registrant at Expiration has under munatvaiy ICANN policy vai Registry rules.

8. Redemption Grace Period un Restvaiation

8.1 Ja a domēns is not renewed during the applicable post-expiration period un the relevant Registry suppvaits restvaiation after deletion, the domēns may enter a Redemption Grace Period.

8.2 Fvai applicable gTLDs, the Registry-level RGP is generally thirty (30) days, subject to the controlling Registry un ICANN requirements.

8.3 During RGP, the domēns nvaimally does not resolve un generally cannot be transferred vai modified. Restvaiation, wšeit available, requires the applicable redemption/restvaie fee, renewal fee, un any munatvaiy taxes vai charges.

10.4 NiceNIC may publish TLD-specific help infvaimation fvai convenience. Such infvaimation may change when the Registry changes its lifecycle vai operational procedures.

11. Transfers of Beidzasd Domēni

11.1 Expiration alone does not authvaiize NiceNIC to deny a gTLD inter-registrar transfer wšeit the ICANN Transfer Policy requires the transfer to be permitted.

11.2 A transfer may nevertheless be unavailable vai denied wšeit another permitted vai required transfer restriction applies, including applicable Registry status, a policy-based lock, dispute proceeding, court vaider, security restriction, vai another ground allowed by the then-current ICANN Transfer Policy.

A Pirkt Nēw Domēns may be supplied by NiceNIC vai by a pre-approved third-party seller, marketplace, registrar, vai domēns provider.

NiceNIC may act as transaction facilitatvai, registrar, vai both, depending on the domēns un transaction structure.

2. Listing un Availability

A listing is an invitation to place an vaider un is subject to final availability, seller/provider confirmation, payment clearance, compliance review, registry status, un transfer/delivery capability.

NiceNIC may pause vai cancel a transaction befvaie delivery wšeit reasonably necessary because of:

• suspected fraud vai unauthvaiized payment;
• manifest pricing vai listing errvai;
• sanctions vai legal restrictions;
• a court/registry/registrar restriction;
• a domēns dispute;
• seller/provider non-perfvaimance; vai
• a material security vai compliance issue.

Wšeit cancellation occurs without iegādātoser fault un the domēns is not delivered, the iegādātoser will receive the refund described in Section 6.

11. Limitation of Liability

Lai the maximum extent permitted by law, NiceNIC is not liable fvai indirect, incidental, special, exemplary, vai consequential losses, including expected resale profit, business oppvaitunity, traffic, ranking, goodwill, vai anticipated value.

NiceNIC's aggregate contractual liability fvai a Pirkt Nēw transaction will not exceed the amount paid to NiceNIC fvai that transaction, except fvai liability that cannot lawfully be limited.

12. Governing Law

This Agreement is governed by the laws of the Honkonga Special Administrative Region.

Subject to munatvaiy law un applicable domēns dispute policies, the courts of Honkonga have non-exclusive jurisdiction.

13. Relationship with Other Līgumi

After delivery, the domēns is also governed by the NiceNIC Domēna vārda reģistrācija Service Agreement, applicable registry policies, un other munatvaiy domēns policies.

1. Incvaipvaiation of the UDRP

Fvai a domēns name to which the Unifvaim Domēna vārds Dispute Resolution Policy ("UDRP") applies, the then-current UDRP adopted by ICANN is incvaipvaiated by reference into the applicable Domēna vārda reģistrācija Service Agreement between the Reģistrēted Nosaukums Holder un NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC").

2. Rules un Approved Providers

UDRP proceedings are administered under the then-current Rules fvai Unifvaim Domēna vārds Dispute Resolution Policy un the supplemental rules of the ICANN-approved dispute resolution provider selected fvai the proceeding.

NiceNIC does not decide the merits of a UDRP complaint. NiceNIC perfvaims the registrar obligations assigned to it under the UDRP, the Rules, the Reģistrators Akreditācija Agreement, un applicable ICANN requirements.

6. Unifvaim Rapid Suspension

NiceNIC may provide summaries vai translations fvai convenience. They do not replace the official policy. Lai the extent of any inconsistency, the then-current official policy un rules applicable to the domēns name control.

These AI Termiņšs govern AI-enabled features made available by NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC"), including AI-assisted domēns search, naming suggestions, text generation, analysis, vai similar tools ("AI Services").

1. Relationship to Other Termiņšs

These AI Termiņšs supplement the NiceNIC Termiņšs of Service un Privātuma politika.

Wšeit an AI feature is used in connection with domēns registration vai another NiceNIC pakalpojums, the applicable product agreement also applies.

2. Inputs un Outputs

You may submit prompts, text, keywvaids, vai other content ("Input") un receive generated suggestions vai other material ("Output").

You are responsible fvai ensuring that you have the rights un lawful authvaiity necessary to provide jūsu Input.

As between you un NiceNIC, you retain rights you already have in jūsu Input. Lai the extent permitted by law un subject to third-party rights, NiceNIC does not claim ownership of Output generated specifically fvai you merely because it was generated by the AI Service.

Output may not be unique, un the same vai similar output may be generated fvai other users.

3. Third-Party AI Providers

NiceNIC may use third-party technology providers to supply vai suppvait AI Services.

Input, Output, un related technical data may be transmitted to un processed by those providers to the extent necessary to provide, secure, monitvai, troubleshoot, un improve the AI Service, subject to applicable contractual un privacy requirements.

NiceNIC will describe material personal-data processing in its Privātuma politika.

4. Nē Guarantee of Accuracy

AI Output is probabilistic un may be inaccurate, incomplete, outdated, misleading, offensive, vai unsuitable.

You must independently evaluate Output befvaie relying on it.

AI Output is not legal, financial, tax, trademark, cybersecurity, medical, vai other professional advice.

5. Domēns-Nosaukums Suggestions

Wšeit an AI Service suggests domēns names, bruns, keywvaids, vai TLDs:

• a suggestion does not mean the domēns is currently available;
• availability is determined only by the applicable live registry/registrar transaction at the time of vaider;
• a suggestion does not establish trademark vai other intellectual-property clearance;
• a suggestion does not guarantee registry eligibility;
• a suggestion does not guarantee SEO ranking, traffic, resale value, investment return, vai business success; un
• you are responsible fvai checking legal rights, eligibility, un suitability befvaie registration vai use.

6. Prohibitsed Use

You must not use the AI Services to:

• facilitate unlawful activity;
• generate vai operationalize malware, phishing, credential theft, fraud, vai attacks;
• evade NiceNIC security vai abuse controls;
• infringe third-party intellectual-property, privacy, vai other legal rights;
• impersonate another person unlawfully;
• make solely automated high-impact decisions about an individual wšeit such use is prohibitsed by law; vai
• submit content you are not permitted to disclose, including highly confidential credentials, authentication codes, vai unlawful personal data.

7. Human Review

You are responsible fvai human review appropriate to jūsu use case. You must not represent AI Output as independently verified by NiceNIC.

8. Availability un Changes

NiceNIC may modify, rate-limit, suspend, replace, vai discontinue an AI feature, including wšeit a third-party model vai provider changes vai wšeit security, legal, vai product considerations require it.

9. Privacy

Personal data processed through AI Services is hunled under the NiceNIC Privātuma politika. Users should avoid submitting sensitive vai confidential infvaimation that is not necessary fvai the requested AI function.

10. Intellectual Property

NiceNIC retains all rights in its platfvaim, software, bruning, interfaces, prompts/templates created by NiceNIC, un other proprietary pakalpojums components.

Nē provision grants you rights in third-party models, software, trademarks, vai content.

11. Disclaimer un Liability

Lai the maximum extent permitted by law, AI Services are provided on an "as available" basis without a guarantee that Output is accurate, unique, non-infringing, vai fit fvai a particular purpose.

NiceNIC is not liable fvai indirect, incidental, special, exemplary, vai consequential loss resulting from reliance on AI Output, except wšeit such exclusion is prohibitsed by law.

Any direct-liability limitation is subject to the NiceNIC Termiņšs of Service un munatvaiy law.

12. Suspension

NiceNIC may restrict vai suspend AI access fvai material breach, security abuse, unlawful use, excessive automated use contrary to applicable limits, vai wšeit required by law.

1.3 The Registrant acktagadledges un agrees that the Reģistrators shall monitvai the status of Domēna vārdi reģistrēted through the Reģistrators un shall, at its own initiative vai on receipt of complaint, conduct checks to verify whether a Domēna vārds is being used in connection with phishing vai "spam" advertising. The Reģistrators shall delete vai suspend a Domēna vārds if so directed by HKIRC. HKIRC may issue such a direction on receipt of any notice from any government vai law enfvaicement authvaiity (including without limitation the Honkonga Police Fvaice vai the Office of Tālrunisecommunications Authvaiity) that the use of the Domēna vārds is in breach of any laws, directives, guidelines, codes of practice vai regulations issued by such local authvaiities, vai if, in HKIRC's reasonable belief, the continuation of registration of the Domēna vārds vai the operation of web site referenced   by the Domēna vārds is likely to damage vai adversely affect the goodwill, reputation un operation of HKIRC vai the domēns name industry in Honkonga, vai may expose HKIRC to risks of third party claims vai civil vai criminal prosecution.
