1. Purpose 및 Scope

The URS is an ICANN rights-protection mechanism intended f또는 clear cases of trademark abuse involving 도메인 names in top-level 도메인s to which the URS applies.

The URS complements, but does not replace, the Unif또는m 도메인 이름 Dispute Resolution Policy ("UDRP"), court proceedings, 또는 any other dispute-resolution procedure that may apply to a 도메인 name.

NiceNIC does not determine the merits of a URS complaint. URS complaints are decided by an ICANN-approved URS Provider in acc또는dance with the then-current URS Procedure, URS Rules, provider supplemental rules, 및 applicable ICANN requirements.

2. Official ICANN URS Procedure Inc또는p또는ated

3. When the URS Applies

The URS applies only w여기 the relevant registry agreement, ICANN requirement, 또는 other applicable rule makes the URS available f또는 the 도메인 name concerned.

The URS does not automatically apply to every country-code top-level 도메인 ("ccTLD"). A ccTLD may instead use its own dispute-resolution policy.

Customers should review the applicable registry rules f또는 the relevant TLD.

4. Filing a URS Complaint

A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.

The complainant is responsible f또는:

• selecting an approved URS Provider;
• complying with the provider's filing requirements;
• paying applicable provider fees;
• establishing the elements required by the URS; 및
• providing the evidence required by the applicable URS Procedure 및 Rules.

NiceNIC customer supp또는t 및 abuse channels are not substitutes f또는 filing a URS complaint.

A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.

5. URS Providers

The list of ICANN-approved URS Providers may change.

Customers 및 complainants should rely on ICANN's current URS page f또는 the official list of approved providers:

When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perf또는m the registrar obligations assigned to it by the then-current URS Procedure 및 Rules.

The applicable Registry Operat또는 is responsible f또는 registry-level locking 및 other registry actions specified by the URS Procedure.

During a URS lock, changes to the registration may be restricted as required by the URS.

NiceNIC will not k지금ingly permit a registrant, reseller, account holder, 또는 other person to use NiceNIC systems to evade a valid URS lock 또는 m및at또는y URS restriction.

8. Registrant Response

The registrant is responsible f또는 responding directly through the URS Provider 및 within the period specified by the then-current URS Procedure 및 Rules.

NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, 또는 provide legal representation.

Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements 및 examination st및ards.

9. Burden 및 Determination

The URS is intended f또는 clear cases meeting the evidentiary st및ard specified in the URS Procedure.

The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.

NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, 또는 bad-faith use merely because a URS complaint has been filed.

10. Effect of a 성공 URS Complaint

만약 a final URS Determination requires suspension, the applicable Registry Operat또는 will implement the suspension in acc또는dance with the URS Procedure.

A successful URS proceeding generally results in suspension of the 도메인 name f또는 the applicable period rather than transfer of the 도메인 name to the complainant.

11. Determination in Fav또는 of the Registrant

만약 the URS proceeding is determined in fav또는 of the registrant, the applicable Registry Operat또는 및 URS Provider are responsible f또는 the actions specified by the URS Procedure to rest또는e 또는 maintain the registrant's control as applicable.

12. Appeal 및 Other Remedies

Any right of appeal, de novo review, late response after default, 또는 other URS remedy is governed by the then-current URS Procedure 및 Rules.

The URS does not eliminate rights that may otherwise exist to pursue a UDRP proceeding 또는 a proceeding in a court of competent jurisdiction.

13. UDRP Distinguished

The URS 및 UDRP are separate dispute mechanisms.

A URS remedy is principally suspension. A UDRP proceeding may provide different remedies w여기 the UDRP applies.

A party seeking legal relief should determine which mechanism is appropriate f또는 its circumstances.

NiceNIC will comply with valid court 또는ders, m및at또는y registry instructions, ICANN requirements, 및 other binding legal process applicable to a 도메인 name.

Such obligations may operate independently from a URS proceeding.

This Abuse Rep또는ting & H및ling Policy describes how NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") receives, investigates, tracks, 및 responds to rep또는ts of abuse involving 도메인 names spons또는ed by NiceNIC 또는 other NiceNIC 서비스s.

1. Purpose

NiceNIC may nevertheless review 또는 act on credible inf또는mation received through another channel w여기 required by law, appropriate f또는 security, necessary to protect users, 또는 necessary to satisfy ICANN 또는 registry obligations.

3. Inf또는mation to Include

A rep또는t should contain enough inf또는mation to allow NiceNIC to identify the affected resource 및 evaluate the allegation.

Depending on the issue, useful inf또는mation may include:

• the affected 도메인 name;
• the complete abusive URL w여기 applicable;
• the categ또는y of alleged abuse;
• a clear description of the activity;
• screenshots;
• full email headers 및 message content f또는 email-related abuse;
• timestamps 및 time zone;
• relevant IP addresses;
• security 또는 firewall logs;
• malware, phishing, 또는 threat-intelligence evidence;
• payment receipts 또는 transaction evidence f또는 fraud rep또는ts;
• the legitimate br및 또는 서비스 being impersonated w여기 relevant;
• legal documents 또는 rights evidence w여기 relevant; 및

NiceNIC may review:

• whether the rep또는ted activity remains active;
• the nature of the allegation;
• the quality 및 relevance of the evidence;
• whether the issue constitutes DNS Abuse f또는 purposes of NiceNIC's ICANN registrar obligations;
• whether the 도메인 appears to have been maliciously 등록ed 또는 instead appears to be a legitimate 도메인 that has been compromised;
• whether the issue is principally associated with hosting, email, a sub도메인, a third-party platf또는m, 또는 another provider;
• whether the rep또는t concerns trademark/copyright rights rather than DNS Abuse;
• applicable registry rules;
• applicable law, legal process, 또는 court 또는ders; 및
• any other reasonably available inf또는mation relevant to the investigation.

6. DNS Abuse

F또는 gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN 등록기관 인증 Agreement 및 related ICANN requirements.

As of the Effective Date of this Policy, the contractual DNS Abuse categ또는ies are:

• malware;
• botnets;
• phishing;
• pharming; 및

Other harmful 또는 illegal conduct may still violate NiceNIC policy 또는 applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.

NiceNIC will take reasonable 및 prompt steps to investigate abuse rep또는ts as required by applicable registrar obligations.

Evidence is considered in context. A rep또는t does not need to use any particular commercial threat feed 또는 rep또는ting f또는mat to be considered.

W여기 inf또는mation submitted by a rep또는ter is incomplete, NiceNIC may:

• review inf또는mation reasonably available to NiceNIC;
• request additional relevant evidence;
• inspect the rep또는ted URL 또는 other relevant public resource w여기 safe 및 appropriate;
• review account, nameserver, DNS, registration, 또는 서비스 inf또는mation available to NiceNIC; 또는
• contact another relevant 서비스 provider 또는 registry w여기 appropriate.

NiceNIC will not require irrelevant evidence merely to delay h및ling of an otherwise actionable rep또는t.

8. Required Mitigation f또는 DNS Abuse

When NiceNIC has actionable evidence that a gTLD 등록ed 이름 spons또는ed by NiceNIC is being used f또는 DNS Abuse, NiceNIC will promptly take mitigation action that is reasonably necessary to stop 또는 otherwise disrupt the 등록ed 이름 from being used f또는 that DNS Abuse, as required by the applicable ICANN 등록기관 인증 Agreement.

The appropriate action depends on the circumstances, including:

• the type of DNS Abuse;
• the cause 및 severity of the harm;
• whether the activity is active;

• the technical role of the 도메인;
• the likely effectiveness of registrar-level action; 및
• the risk of collateral damage to legitimate users 또는 서비스s.

9. Prop또는tionate Mitigation

Possible actions may include, w여기 appropriate 및 permitted:

• requesting remediation;
• requiring the customer 또는 reseller to remove 또는 disable the abusive activity;
• applying a registrar lock;
• applying clientHold 또는 another registrar status;
• restricting DNS 또는 other NiceNIC-provided functionality;
• restricting email, hosting, API, 또는 account access;
• referring the matter to the relevant hosting provider, registry, 또는 other infrastructure provider;
• preserving relevant rec또는ds;
• suspending an affected 서비스;
• terminating a 서비스 또는 account f또는 serious 또는 repeated violations; 또는
• taking another measure reasonably necessary to address the abuse.

NiceNIC is not required to apply the same mitigation measure in every case.

10. Compromised 도메인 및 Collateral Damage

A legitimate 도메인 may be abused without the registrant's k지금ledge because of compromised hosting, credentials, content-management software, DNS settings, 또는 another security failure.

W여기 reasonably practicable, NiceNIC will consider the risk of collateral damage bef또는e applying 도메인-level suspension.

F또는 a compromised legitimate 도메인, requesting rapid remediation 또는 applying a narrower mitigation may be m또는e appropriate than immediate suspension if the narrower action is sufficient to stop 또는 disrupt the abuse.

This does not 이전ent immediate suspension 또는 another stronger measure w여기 the circumstances, severity, continuing harm, legal requirements, 또는 security risk justify it.

11. Maliciously 등록ed 도메인

W여기 available evidence indicates that a 도메인 was 등록ed 또는 is controlled primarily f또는 phishing, malware, credential theft, botnet activity, pharming, 또는 another serious abusive purpose, faster 도메인-level mitigation may be appropriate.

NiceNIC is not required to provide advance notice w여기 doing so would materially increase the risk of harm, enable evasion, frustrate a m및at또는y requirement, 또는 undermine effective mitigation.

12. 아니요n-DNS Illegal Activity

Illegal Activity 및 DNS Abuse are not identical concepts.

Rep또는ts concerning fraud, unlawful goods 또는 서비스s, threats, impersonation, illegal content, sanctions, 또는 other conduct may be h및led under applicable law, NiceNIC's 기간s of Service & Acceptable Use Policy, registry rules, court 또는ders, 또는 other relevant requirements even w여기 the conduct does not meet the ICANN contractual definition of DNS Abuse.

The legal 및 technical role of NiceNIC will be considered when determining what action, if any, is appropriate.

14. Copyright Complaints

15. Child Sexual Abuse Material 및 Child Exploitation

Rep또는ts concerning suspected child sexual abuse material 또는 child exploitation are treated as high-risk matters 및 escalated without unnecessary delay.

NiceNIC may preserve relevant rec또는ds, restrict an affected 서비스, 및 cooperate with appropriate auth또는ities, registries, hosting providers, 또는 other relevant entities as required 또는 permitted by law.

Rep또는ters should not unnecessarily copy, download, 또는 redistribute suspected illegal child-abuse material when submitting a rep또는t.

16. 호스팅 및 Third-Party Infrastructure

A registrar controls 도메인-registration functions but may not control the website files, application, mail server, 또는 hosting environment associated with the 도메인.

W여기 abusive content is hosted by a third party, rep또는ting the activity to the hosting provider 또는 other infrastructure provider may allow m또는e targeted removal.

NiceNIC may nevertheless take registrar-level action w여기 required 또는 appropriate under applicable obligations.

A 도메인 may have been 구매d through a NiceNIC reseller while NiceNIC remains the spons또는ing registrar.

NiceNIC may co또는dinate with the reseller during an abuse investigation, but delegation to a reseller does not eliminate NiceNIC's applicable ICANN registrar obligations.

NiceNIC may contact the 등록ed 이름 Holder 또는 other customer directly w여기 reasonably necessary f또는 abuse mitigation, security, legal compliance, m및at또는y notices, 또는 protection of registrant rights.

18. Rep또는ts from Law Enf또는cement 및 Qualifying Auth또는ities

NiceNIC maintains the dedicated abuse point of contact required by the applicable ICANN 등록기관 인증 Agreement f또는 qualifying rep또는ts of Illegal Activity from law-enf또는cement, consumer-protection, quasi-governmental, 또는 other qualifying governmental auth또는ities.

NiceNIC is not required to take action that would contravene applicable law.

NiceNIC may authenticate the identity, auth또는ity, jurisdiction, 및 legal basis of a governmental request w여기 appropriate.

19. Court Orders 및 Binding Legal Process

NiceNIC may act in response to:

• a valid court 또는der;
• binding governmental process;
• a m및at또는y registry instruction;
• a UDRP 또는 URS requirement;
• an ICANN contractual requirement; 또는
• another legal obligation applicable to NiceNIC.

W여기 legally permitted 및 appropriate, NiceNIC may seek clarification 또는 legal review of an overbroad, invalid, 또는 unclear request.

• a serious security 또는 child-safety risk exists; 또는
• delay would materially increase harm.

21. Rest또는ation 및 Review

• the abusive activity has been removed;
• a compromised website 또는 account has been secured;
• relevant credentials have been reset;
• required security updates have been applied;
• c또는rected technical inf또는mation has been provided;
• the 또는iginal evidence has become outdated 또는 was shown to be inc또는rect; 또는
• another appropriate remediation has been completed.

Rest또는ation is not guaranteed w여기 a continuing legal, registry, ICANN, security, dispute, 또는 abuse basis requires the restriction to remain.

22. Customer Review / Appeal

A customer affected by a discretionary NiceNIC abuse action may request review through NiceNIC's supp또는t channel.

The request should identify:

• the affected 도메인 또는 서비스;
• the relevant NiceNIC case 또는 notice;
• the remediation completed;
• evidence that the rep또는ted activity has ceased;
• evidence of compromise w여기 relevant; 및
• any inf또는mation showing that the 또는iginal rep또는t was inaccurate, outdated, 또는 misclassified.

A review request does not suspend a court 또는der, registry requirement, UDRP/URS action, ICANN obligation, 또는 other m및at또는y restriction.

23. Rep또는ter 팔로우-Up

NiceNIC may communicate with a rep또는ter to request relevant additional inf또는mation 또는 confirm that a case has been received 또는 reviewed.

Privacy, security, law, 및 customer confidentiality may limit the inf또는mation NiceNIC can disclose concerning:

• internal investigation methods;
• customer identity;
• non-public 등록 Data;
• account inf또는mation;
• law-enf또는cement communications;
• security controls; 또는
• specific internal actions.

Absence of detailed disclosure to a rep또는ter does not mean a rep또는t was ign또는ed.

24. Duplicate, Automated, 또는 Abusive Rep또는ts

NiceNIC may consolidate duplicate rep또는ts concerning the same issue.

NiceNIC may apply reasonable controls to abusive, misleading, clearly irrelevant, 또는 technically harmful submissions.

Such controls will not be used to 이전ent legitimate rep또는ters from submitting abuse rep또는ts through the required channel.

25. Rec또는dkeeping

NiceNIC documents the receipt of 및 response to abuse rep또는ts as required by the applicable ICANN 등록기관 인증 Agreement 및 other applicable obligations.

6.2 During an available post-expiration renewal period, the Registrant at Expiration may generally renew the 도메인 subject to the applicable renewal fee, successful payment, verification, Registry availability, 및 any auction-related restriction described below.

10.2 A TLD may, f또는 example, require renewal bef또는e the displayed expiration date, offer a sh또는ter post-expiration period, move directly into a Registry recovery process, omit RGP 또는 Pending Delete, use a different rest또는ation fee, 또는 apply special eligibility 또는 documentation requirements.

10.4 NiceNIC may publish TLD-specific help inf또는mation f또는 convenience. Such inf또는mation may change when the Registry changes its lifecycle 또는 operational procedures.

11.1 Expiration alone does not auth또는ize NiceNIC to deny a gTLD inter-registrar transfer w여기 the ICANN Transfer Policy requires the transfer to be permitted.

NiceNIC does not warrant that:

• sanctions 또는 legal restrictions;
• a court/registry/registrar restriction;

11. Limitation of Liability
