2. Definitions

F또는 purposes of this Policy:

2.1 “Expiration Date” means the date on which a 도메인 name registration term ends.

2.2 “Grace Period” means any post-expiration period during which renewal may still be possible at the st및ard renewal fee, subject to the applicable TLD 및 registry rules.

2.3 “Redemption Grace Period” 또는 “RGP” means the post-deletion recovery period, w여기 available, during which an expired 도메인 name may still be rest또는able f또는 an additional redemption fee plus the applicable renewal fee.

2.4 “Pending Delete” means the final pre-release stage, w여기 applicable, during which the 도메인 name can no longer be renewed, rest또는ed, modified, 또는 transferred.

2.5 “Eligible 도메인” means a 도메인 name that is subject to NiceNIC’s expired 도메인 auction process. 아니요t all TLDs 또는 expired 도메인 names are eligible f또는 auction.

3. Effect of Expiration

3.1 Upon expiration, a 도메인 name may stop resolving, 및 any website, email 서비스, 또는 other 서비스 associated with the 도메인 name may cease functioning immediately 또는 sh또는tly t여기after.

3.2 팔로우ing expiration, NiceNIC may restrict changes to the 도메인 name, including DNS changes, contact updates, transfers, 또는 other account-level actions, in acc또는dance with registry rules, security measures, operational requirements, 또는 the expired-도메인 process then in effect.

3.3 Expiration does not mean that the 도메인 name immediately becomes available to the public. Depending on the applicable TLD 및 registry rules, the 도메인 name may pass through one 또는 m또는e stages, including grace period, auction, redemption, pending delete, 및 eventual release.

4. 갱신al 아니요tices 및 Customer Responsibility

4.1 NiceNIC may send renewal reminders 및 expiration-related notices bef또는e 및 after expiration, as required by applicable policy 또는 as part of NiceNIC’s st및ard operational process.

4.3 Failure to receive a renewal notice, reminder, invoice, 또는 other communication shall not relieve you of responsibility f또는 renewing 귀하의 도메인 name bef또는e expiration.

4.4 만약 auto-renewal is enabled, successful renewal remains subject to valid payment, operational processing, 및 the applicable registry rules. NiceNIC does not guarantee successful auto-renewal in every case.

5. St및ard Post-Expiration 갱신al

5.1 F또는 many generic TLDs, an expired 도메인 name may remain renewable f또는 approximately thirty (30) days after the Expiration Date at the st및ard renewal fee. This is a general reference only 및 may vary by TLD.

5.2 갱신al is not complete unless 및 until NiceNIC has successfully received 및 processed full payment of all applicable fees.

5.3 NiceNIC reserves the right to determine whether a 도메인 name remains eligible f또는 st및ard renewal, redemption, 또는 other recovery based on the applicable TLD, registry status, auction status, 및 operational feasibility.

6.1 Certain expired 도메인 names may enter NiceNIC’s expired 도메인 auction process bef또는e all recovery 창s have ended. This process applies only to Eligible 도메인 및 does not apply to all TLDs.

6.2 F또는 Eligible 도메인 under NiceNIC’s st및ard expired-도메인 process, the following general timeline may apply:

Day 0 after expiration

The 도메인 name expires. The registrant may generally renew the 도메인 name at the st및ard renewal fee during the initial post-expiration period, subject to applicable rules.

Day 26 after expiration

The 도메인 name may enter expired 도메인 auction. 에서 this stage, the registrant may still be able to renew the 도메인 name at the st및ard renewal fee, unless otherwise restricted by the applicable process.

Day 31 after expiration

만약 t여기 is no active bid, the registrant may still be able to recover the 도메인 name by paying the st및ard renewal fee plus the applicable redemption fee.

Day 37 after expiration

The 도메인 name may enter final closeout auction. Unless t여기 is a pending 구매 또는 other sale-related restriction, the registrant may still be able to recover the 도메인 name by paying the st및ard renewal fee plus the applicable redemption fee.

Day 41 after expiration

The final closeout auction may end. 만약 the 도메인 name was not sold 또는 otherwise committed to sale, recovery may still be possible f또는 a limited period, subject to the applicable TLD, registry rules, 및 NiceNIC’s operational process.

Day 74 after expiration

The 도메인 name may be removed from the registrant’s account 및 may no longer be renewable 또는 rest또는able through NiceNIC. After that point, the 도메인 name may become available f또는 re-registration only after the registry releases it.

6.3 Once an Eligible 도메인 has an active bid, pending 구매, completed sale, 또는 other sale commitment under the expired-도메인 process, the registrant’s right to renew 또는 rest또는e the 도메인 name may be terminated 또는 restricted.

6.4 NiceNIC does not guarantee that a 도메인 name will remain recoverable until the end of any stated period if the 도메인 is subject to auction, sale, registry restriction, 또는 another applicable limitation.

7. Redemption Grace Period

7.1 만약 an expired 도메인 name is not renewed during the applicable grace period 및 if the applicable TLD supp또는ts rest또는ation after deletion, the 도메인 name may enter the Redemption Grace Period.

7.2 During the Redemption Grace Period:

(a) the 도메인 name may stop resolving;

(c) the 도메인 name generally cannot be modified 또는 transferred; 및

(d) rest또는ation, if available, will require payment of the applicable redemption fee, the applicable renewal fee, 및 any taxes 또는 m및at또는y fees.

7.3 Rest또는ation during the Redemption Grace Period is not guaranteed 및 remains subject to registry supp또는t, operational feasibility, the 도메인’s current status, 및 the absence of auction 또는 sale restrictions.

8. Pending Delete 및 Final Release

8.1 만약 a 도메인 name is not renewed 또는 rest또는ed during the applicable recovery periods, it may enter the Pending Delete stage, w여기 supp또는ted by the applicable TLD.

8.2 During Pending Delete, the 도메인 name cannot be renewed, rest또는ed, transferred, 또는 modified.

8.3 F또는 many generic TLDs, Pending Delete lasts approximately five (5) days. After that stage ends, the registry may release the 도메인 name to the public f또는 re-registration.

8.4 NiceNIC does not guarantee the exact time, date, 또는 availability of a 도메인 name once it is released by the registry, 및 NiceNIC does not guarantee that the f또는mer registrant will be able to re-등록 the 도메인 name.

9. TLD-Specific Variations

9.1 아니요t all TLDs follow the st및ard lifecycle described above. Certain ccTLD 및 other TLDs may have sh또는ter grace periods, no redemption period, no pending delete stage, 또는 earlier renewal deadlines imposed by the registry.

9.2 The following TLD-specific rules may apply, subject at all times to registry changes 및 the controlling registry rules:

9.2.1 TLDs generally following the common lifecycle

Many ccTLD generally follow a lifecycle similar to the st및ard expiration, grace, redemption, 및 deletion process, including, f또는 example:

.AI, .BZ, .CA, .CC, .CO, .FM, .ID, .IN, .IO, .ME, .MX, .PW, .TV, .UK, .US, 및 .WS.

9.2.2 TLDs with no Pending Delete stage

Certain TLDs may not have a Pending Delete stage 및 may be released immediately after the end of their applicable redemption 또는 recovery period, including, f또는 example:

.ES, .EU, .FR, .IS, .LI, .NL, .PE, 및 .PH (noting that .PH may also follow its own separate registry-specific process).

9.2.3 TLDs requiring renewal bef또는e the actual expiration date

The following TLDs may need to be renewed twelve (12) days bef또는e the actual Expiration Date. 만약 not renewed in time, they may enter a recovery stage immediately, regardless of the number of calendar days remaining bef또는e expiration:

.CM 도메인 names generally do not enter a redemption period 및 may be sent f또는 deletion on the actual Expiration Date. They may become available f또는 public registration on the same day they expire, subject to registry release practices.

9.2.6 .GG 도메인s

.GG 도메인 names may be reactivated from the customer account f또는 approximately twenty-eight (28) days after expiration. They may then enter a recovery stage between approximately Day 28 및 Day 30 after expiration. Once in that stage, reactivation may only be possible through NiceNIC Supp또는t f또는 approximately twenty-six (26) additional days.

9.2.7 .PH, .COM.PH, .NET.PH, 및 .ORG.PH 도메인s

These 도메인s may not supp또는t a st및ard Redemption Grace Period. Reactivation may still be possible within approximately thirty (30) days after expiration through the NiceNIC account at the regular renewal cost, depending on the registry status. 만약 the 도메인 is no longer visible in the account but is not yet publicly available, the customer should contact NiceNIC Supp또는t immediately.

9.2.8 .UK 도메인s, including second-level .UK 도메인s

.UK 도메인 names, including .CO.UK, .ME.UK, 및 .ORG.UK, may generally have a thirty (30)-day post-expiration renewal period. After that time, the 도메인 name may remain recoverable without a separate redemption fee until its release, which may occur approximately ninety (90) days after expiration. 만약 a .UK 도메인 name has expired f또는 m또는e than thirty (30) days but has not yet been released 및 no longer appears in the account, the customer should contact NiceNIC Supp또는t promptly.

.TO 도메인 names may only be reactivated during approximately twenty-seven (27) days after expiration. They generally do not supp또는t a st및ard Redemption Grace Period. After that point, they may be reserved by the registry 및 may no longer be recoverable.

9.2.10 .NU 도메인s

.NU 도메인 names may be reactivated in the 또는dinary manner within approximately seven (7) days after expiration. 만약 not renewed within that period, they may enter an approximately sixty (60)-day recovery period during which rest또는ation may still be possible through NiceNIC Supp또는t.

9.3 The TLD-specific inf또는mation above is provided f또는 general reference only 및 may change at any time based on registry policy, registry system changes, 또는 operational requirements. Customers should contact NiceNIC Supp또는t f또는 current TLD-specific recovery inf또는mation.

10. Fees 및 결제ments

10.1 St및ard renewal fees, redemption fees, rest또는ation fees, auction-related fees, 및 any other applicable charges shall be those listed by NiceNIC at the time of processing 또는 otherwise communicated by NiceNIC.

10.2 Redemption 또는 rest또는ation requires payment in full of all applicable fees bef또는e processing.

10.3 전체 fees paid f또는 expired-도메인 recovery, rest또는ation, 또는 special processing are non-refundable once processing has begun, except w여기 otherwise required by applicable law.

(b) that an expired 도메인 name will not enter auction;

(c) that a 도메인 name can be recovered after an active bid, pending 구매, 또는 completed sale;

(d) that the registry will supp또는t rest또는ation; 또는

(e) the exact date 또는 time when a deleted 도메인 name will be released to the public.

11.3 You ack지금ledge that delayed action may result in additional fees, loss of recovery rights, interruption of 서비스, auction sale, 또는 permanent loss of the 도메인 name.

12. Limitation of Responsibility

(c) failure to receive notices;

13. Changes to This Policy

2. Your Representations

We will cancel, transfer 또는 otherwise make changes to 도메인 name registrations under the following circumstances:

2. our receipt of an 또는der from a court 또는 arbitral tribunal, in each case of competent jurisdiction, requiring such action; 및/또는

3. our receipt of a decision of an Administrative Panel requiring such action in any administrative proceeding to which you were a party 및 which was conducted under this Policy 또는 a later version of this Policy adopted by ICANN. (See Paragraph 4(i) 및 (k) below.)

This Paragraph sets f또는th the type of disputes f또는 which you are required to submit to a m및at또는y administrative proceeding. These proceedings will be conducted bef또는e one of the administrative-dispute-resolution 서비스 providers listed 여기 (each, a "Provider").

1. Applicable Disputes. You are required to submit to a m및at또는y administrative proceeding in the event that a third party (a "complainant") asserts to the applicable Provider, in compliance with the Rules of Procedure, that

1. 귀하의 도메인 name is identical 또는 confusingly similar to a trademark 또는 서비스 mark in which the complainant has rights; 및

2. you have no rights 또는 legitimate interests in respect of the 도메인 name; 및

In the administrative proceeding, the complainant must prove that each of these three elements are present.

2. Evidence of 등록 및 Use in 나쁨 Faith. F또는 the purposes of Paragraph 4(a)(iii), the following circumstances, in particular but without limitation, if found by the Panel to be present, shall be evidence of the registration 및 use of a 도메인 name in bad faith:

1. circumstances indicating that you have 등록ed 또는 you have acquired the 도메인 name primarily f또는 the purpose of selling, renting, 또는 otherwise transferring the 도메인 name registration to the complainant who is the owner of the trademark 또는 서비스 mark 또는 to a competit또는 of that complainant, f또는 valuable consideration in excess of 귀하의 documented out-of-pocket costs directly related to the 도메인 name; 또는

4. by using the 도메인 name, you have intentionally attempted to attract, f또는 commercial gain, Internet users to 귀하의 web site 또는 other on-line location, by creating a likelihood of confusion with the complainant's mark as to the source, spons또는ship, affiliation, 또는 end또는sement of 귀하의 web site 또는 location 또는 of a product 또는 서비스 on 귀하의 web site 또는 location.

3. How to Demonstrate Your Rights to 및 Legitimate Interests in the 도메인 이름 in Responding to a Complaint. When you receive a complaint, you should refer to Paragraph 5 of the Rules of Procedure in determining how 귀하의 response should be prepared. Any of the following circumstances, in particular but without limitation, if found by the Panel to be proved based on its evaluation of all evidence presented, shall demonstrate 귀하의 rights 또는 legitimate interests to the 도메인 name f또는 purposes of Paragraph 4(a)(ii):

4. Selection of Provider. The complainant shall select the Provider from among those approved by ICANN by submitting the complaint to that Provider. The selected Provider will administer the proceeding, except in cases of consolidation as described in Paragraph 4(f).

5. Initiation of Proceeding 및 Process 및 Appointment of Administrative Panel. The Rules of Procedure state the process f또는 initiating 및 conducting a proceeding 및 f또는 appointing the panel that will decide the dispute (the "Administrative Panel").

6. Consolidation. In the event of multiple disputes between you 및 a complainant, either you 또는 the complainant may petition to consolidate the disputes bef또는e a single Administrative Panel. This petition shall be made to the first Administrative Panel appointed to hear a pending dispute between the parties. This Administrative Panel may consolidate bef또는e it any 또는 all such disputes in its sole discretion, provided that the disputes being consolidated are governed by this Policy 또는 a later version of this Policy adopted by ICANN.

7. Fees. 전체 fees charged by a Provider in connection with any dispute bef또는e an Administrative Panel pursuant to this Policy shall be paid by the complainant, except in cases w여기 you elect to exp및 the Administrative Panel from one to three panelists as provided in Paragraph 5(b)(iv) of the Rules of Procedure, in which case all fees will be split evenly by you 및 the complainant.

1.5 Gaining 등록기관

     The 등록기관 that submitted to the Registry the request f또는 the transfer of a 도메인 spons또는ship from the 등록기관 of Rec또는d.

1.6 등록기관 of Rec또는d

     The 등록기관 of Rec또는d f또는 a 도메인 name f또는 which the Registry received a transfer of spons또는ship request.

1.7 Registrant

     The Registrant is the individual 또는 또는ganization that 등록s a specific 도메인 name. This individual 또는 또는ganization holds the right to use that specific 도메인 name f또는 a specified period of time, provided certain conditions are met 및 the registration fees are paid. This person 또는 또는ganization is the "legal entity" bound by the terms of the relevant 서비스 agreement with the Registry operat또는 f또는 the TLD in question.

1.8 Registry (Registry Operat또는)

     The 또는ganization auth또는ized by ICANN to provide registration 서비스s f또는 a given TLD to ICANN-accredited 등록기관s.

1.9 Supplemental Rules

     The Supplemental Rules shall mean those rules adopted by the Registry Operat또는, in the case of First 레벨 disputes (as set f또는th below), 또는 the Provider administering a proceeding (in the case of all other disputes) to supplement this Policy. Supplemental Rules shall be consistent with this Dispute Resolution Policy 및 shall cover topics such as fees, w또는d 및 page limits 및 guidelines, the means f또는 communicating with the Provider, 및 the f또는m of cover sheets.

1.10 Transfer Policy

     The Policy on Transfer of Spons또는ship of 등록s between 등록기관s which is in f또는ce as part of the Registry-등록기관 Agreement executed between a 등록기관 및 the Registry, as well as the 등록기관 인증 Agreement which is executed between ICANN 및 all ICANN- accredited registrars.

2. Dispute Resolution Process

     T여기 are two possible steps to the 등록기관 Transfer Dispute Resolution Process. A 등록기관 may elect one 또는 both of the steps pursuant to the rules below. In the event a 등록기관 either files a Request f또는 Enf또는cement (as described below) with a Second-레벨 Dispute Provider, 또는 files an Appeal (as described below) with a Dispute Provider, it may not revert to the First-레벨 Registry option later f또는 the same filing 또는 matter presented f또는 resolution.

2.1 First 레벨 - Registry Operat또는

     A 등록기관 may choose to file a dispute directly with the relevant Registry Operat또는. Any decisions made by the Registry Operat또는 may be appealed to a Dispute Resolution Provider. A 등록기관 may file a dispute directly to a Dispute Resolution Provider; however, in that case the filing 등록기관 would f또는feit any right to appeal the decision of the Dispute Resolution Provider.

2.2 Second-레벨 - Dispute Resolution Panel

     The primary intent of this step is to provide a means f또는 registrars to appeal decisions made by the Registry at the first level of the dispute resolution process, but it may also be used as the first step if a registrar so elects. The decision of the Dispute Resolution Panel is final, except as it may be appealed to a court of competent jurisdiction.

2.3 Statute of Limitations

     A dispute must be filed no later than six (6) months after the alleged violation of the Transfer Policy. In the case w여기 a 등록기관 of Rec또는d alleges that a transfer was in violation of this Policy, the date the transfer was completed shall be deemed the date in which the "alleged violation" took place. In the case w여기 a Gaining 등록기관 alleges that a transfer should have taken place, the date in which the NACK (as defined below) was received by the Registry, shall be deemed the date in which the "alleged violation" took place.

3. Dispute Procedures at the First 레벨 (Registry)

3.1 등록기관 files a Request f또는 Enf또는cement with the applicable Registry Operat또는

     3.1.1 Either the Gaining 또는 등록기관 of Rec또는d ("Filing 등록기관") may submit a Request f또는 Enf또는cement. This must be done in acc또는dance with the Supplemental Rules adopted by the applicable Registry Operat또는.

     3.1.2 The Request f또는 Enf또는cement shall be submitted to the Registry 및 to the Respondent (the 아니요n-filing 등록기관) in electronic f또는m 및 shall:
     (i) Request that the Request f또는 Enf또는cement be submitted f또는 decision in acc또는dance with the 등록기관 Transfer 및 Dispute Resolution Policy 및 the applicable Supplemental Rules;
     (ii) Provide the name, postal 및 e-mail addresses, 및 the telephone 및 fax numbers of the Filing 등록기관 및 those representatives auth또는ized by the Filing 등록기관 to act on behalf of the Filing 등록기관 in the administrative proceeding;
     (iii) Provide the name of the Respondent 및 all inf또는mation (including any postal 및 e-mail addresses 및 telephone 및 fax numbers) k지금n to Filing 등록기관 regarding how to contact Respondent 또는 any representative of Respondent, including contact inf또는mation based on pre-complaint dealings;
     (iv) Specify the 도메인 name(s) that is/are the subject of the Request f또는 Enf또는cement;
     (v) Specify the incident(s) that gave rise to the dispute;
     (vi) Describe, in acc또는dance with the Policy, the grounds on which the Request f또는 Enf또는cement is based;
     (vii) State the specific remedy being sought (either approval 또는 denial of the transfer);
     (viii) Identify any other legal proceedings that have been commenced 또는 terminated in connection with 또는 relating to any of the 도메인 name(s) that are the subject of the complaint;
     (ix) Certify that a copy of the Request f또는 Enf또는cement, together with the cover sheet as prescribed by the Provider's Supplemental Rules, has been sent 또는 transmitted to the Respondent; 및
     (x) Conclude with the following statement followed by the signature of the Complainant 또는 its auth또는ized representative:
           "<insert name of Filing 등록기관> agrees that its claims 및 remedies concerning the registration of the 도메인 name, the dispute, 또는 the dispute's resolution shall be solely against the Respondent 및 waives all such claims 및 remedies against the Registry Operat또는 as well as its direct또는s, officers, employees, 및 agents, except in the case of deliberate wrongdoing 또는 gross negligence."
           "<insert name of Filing 등록기관> certifies that the inf또는mation contained in this Request f또는 Enf또는cement is to the best of Filing 등록기관's k지금ledge complete 및 accurate, that this Request f또는 Enf또는cement is not being presented f또는 any improper purpose, such as to harass, 및 that the assertions in this Request f또는 Enf또는cement are warranted under this Policy 및 under applicable law, as it 지금 exists 또는 as it may be extended by a good-faith 및 reasonable argument."3.1.3 The Request f또는 Enf또는cement may relate to m또는e than one 도메인 name, provided that the 도메인 names involve the same Filing 등록기관 및 Respondent 및 that the claims arise out of the same 또는 similar factual circumstances.

3.1.4 The Request f또는 Enf또는cement shall annex the following documentary evidence (as applicable 및 available) in electronic f또는m if possible, together with a schedule indexing such evidence:
  (i) F또는 the Gaining 등록기관:
      a. Completed F또는m of Auth또는ization ("FOA")
      b. Copy of the WHOIS output f또는 the date transfer was initiated, which was used to identify the auth또는ized Transfer 연락처s
      c. Copy of evidence of identity used
      d. Copy of a bilateral agreement, final determination of a dispute resolution body 또는 court 또는der in cases when the Registrant of Rec또는d is being changed simultaneously with a 등록기관 Transfer
      e. Copies of all communications made to the 등록기관 of Rec또는d with regard to the applicable transfer request along with any responses from the 등록기관 of Rec또는d
  (ii) F또는 the 등록기관 of Rec또는d:
      a. Completed FOA from 등록기관 of Rec또는d if applicable
      b. Copy of the WHOIS output f또는 the date the transfer was initiated
      c. Relevant hist또는y of WHOIS modifications made to the applicable registration
      d. Evidence of one of the following if a transfer was denied:

• fraud;
• UDRP action;
• court 또는der;
• Registrant 또는 administrative contact identity dispute in acc또는dance with Section 4 [등록기관 of Rec또는d Requirements]
• applicable payment dispute along with evidence that the registration was put on HOLD status;
• express written objection from the 등록ed 이름 Holder 또는 Administrative 연락처;
• LOCK status along with proof of a reasonable means f또는 the registrant to remove LOCK status as per Section __of Exhibit __ to this Agreement;
• 도메인 name within 60 days of initial registration; 또는

      e. Copies of all communications made to the Gaining 등록기관 with regard to the applicable transfer request along with any responses from the Gaining 등록기관.

3.2 The 아니요n-Filing 등록기관 ("Respondent") shall have seven (7) calendar days from receipt of the Request f또는 Enf또는cement to prepare a Response to the Request f또는 Enf또는cement ("Response").

3.2.1 The Response shall be submitted in electronic f또는m to both the Registry 및 Filing 등록기관 및 shall:
      (i) Respond specifically to the statements 및 allegations contained in the Request f또는 Enf또는cement (This p또는tion of the response shall comply with any w또는d 또는 page limit set f또는th in the Dispute Resolution Provider's Supplemental Rules.);
      (ii) Provide the name, postal 및 e-mail addresses, 및 the telephone 및 fax numbers of the Respondent (non-filing 등록기관);
      (iii) Identify any other legal proceedings that have been commenced 또는 terminated in connection with 또는 relating to any of the 도메인 name(s) that are the subject of the Request f또는 Enf또는cement;
      (iv) State that a copy of the Response has been sent 또는 transmitted to the Filing 등록기관;
      (v) Conclude with the following statement followed by the signature of the Respondent 또는 its auth또는ized representative:
   "Respondent certifies that the inf또는mation contained in this Response is to the best of Respondent's k지금ledge complete 및 accurate, that this Response is not being presented f또는 any improper purpose, such as to harass, 및 that the assertions in this Response are warranted under these Rules 및 under applicable law, as it 지금 exists 또는 as it may be extended by a good-faith 및 reasonable argument."; 및
     (vi) Annex any documentary 또는 other evidence upon which the Respondent relies, together with a schedule indexing such documents.

3.2.2 에서 the request of the Respondent, the Registry Operat또는 may, in exceptional cases, extend the period of time f또는 the filing of the response, but in no case may the extension be m또는e than an additional five (5) calendar days. The period may also be extended by written stipulation between the Parties, provided the stipulation is approved by the Registry Operat또는.

3.2.3 만약 a Respondent does not submit a response, in the absence of exceptional circumstances, the Registry Operat또는 shall decide the dispute based upon the Request f또는 Enf또는cement.

3.3 Registry Operat또는 must review all applicable documentation 및 compare registrant/contact data with that contained within the auth또는itative WHOIS database 및 reach a conclusion not later than 14 days after receipt of the Response.

In the case of a thin Registry, if the 등록기관 of Rec또는d's WHOIS is not accessible 또는 is invalid, the Registry Operat또는 must notify ICANN 및 place the dispute on hold until such time as the specific problem is resolved by ICANN.

3.3.3 In the case w여기 a 등록기관 of Rec또는d denies a request f또는 a 도메인 name transfer ("NACKs"), the 등록기관 of Rec또는d must provide evidence of one of the fact또는s f또는 which it is allowed to NACK. 만약 the 등록기관 of Rec또는d cannot provide evidence that demonstrates any of the fact또는s, 및 the Gaining 등록기관 provides to the Registry a complete FOA with data matching that contained within the auth또는itative WHOIS database, then the transfer must be approved to be processed.

3.3.4 만약 the data provided by neither 등록기관 appears to be conclusive, then the Registry shall issue a finding of "no decision." 만약 the data provided to the Registry is complete 및 provides sufficient basis f또는 a determination based on the Policy, the Registry may not issue a finding of "no decision." 3.4 Fees f또는 First-레벨 Dispute Resolution Service

3.4.1 T여기 is no filing fee assessed to the Filing 등록기관 at the time the Request f또는 Enf또는cement is submitted to the Registry Operat또는.

3.4.2 The 등록기관 that does not 이전ail in the dispute will be assessed a fee to be set by the Registry Operat또는. Such fee shall be set f또는th in the Registry's Supplemental Rules that are in effect at the time that the Request f또는 Enf또는cement was filed.

3.4.3 This fee shall not be passed on to the Registrant.

3.4.4 This fee will be charged after a final decision is rendered by the Registry. In the case that the Registry issues a finding of "no decision," the Registry Operat또는 shall collect the applicable fees from the Filing 등록기관.

3.5 Availability of Court Proceedings

      The procedures set f또는th above shall not 이전ent a 등록기관 from submitting a dispute to a court of competent jurisdiction f또는 independent resolution bef또는e such an administrative proceeding is commenced 또는 after such proceeding is concluded. 만약 a Registry Operat또는 decides a 도메인 name registration should be transferred (either to the Gaining 등록기관, 또는 alternatively, back from the Gaining 등록기관 to the 등록기관 of Rec또는d), the Registry will wait fourteen (14) calendar days after it is inf또는med of the decision bef또는e implementing that decision. The Registry will then implement the decision unless it has received during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted 도메인 name(s). 만약 such documentation is received by the Registry Operat또는 within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented to the Registry Operat또는 that the parties have resolved such dispute; (ii) evidence is presented to the Registry Operat또는 that the lawsuit has been dismissed 또는 withdrawn; 또는 (iii) the Registry Operat또는 receives a copy of an 또는der from such court.

4. Dispute Procedures at the Second 레벨 with a Dispute Resolution Provider

4.1 The 서비스s of the Dispute Resolution Panel may be invoked in any of the following two situations:

      (i) A Filing 등록기관 may elect to skip the First-레벨 dispute process at Registry level 및 submit a Request f또는 Enf또는cement directly with a Dispute Resolution Provider;
      (ii) The non-이전ailing 등록기관 in a First-레벨 dispute proceeding may submit an appeal of the applicable Registry Operat또는's decision to the Dispute Resolution Provider. 추가itionally, in the case w여기 the result in the First-레벨 dispute process is a "no-decision," either 등록기관 may file an Appeal of such decision to a Dispute Resolution Provider.

4.2 Initial Request f또는 Enf또는cement

4.2.1 In the event that the Filing 등록기관 elects to submit a Request f또는 Enf또는cement to the Dispute Resolution Provider in lieu of submitting a Request f또는 Enf또는cement to the applicable Registry Operat또는, the obligations 및 responsibilities set f또는th in Sections 3.1 through 3.2 above shall apply.

4.2.2 The Dispute Resolution Panel appointed by the Dispute Resolution Provider must review all applicable documentation 및 compare registrant/contact data with that contained within the auth또는itative WHOIS database 및 reach a conclusion not later than thirty (30) days after receipt of Response from the Respondent.
     (i) 만약 the data does not match the data listed in auth또는itative WHOIS, the Dispute Resolution Panel should contact each 등록기관 및 require additional documentation.
     (ii) 만약 the Gaining 등록기관 is unable to provide a complete FOA with data matching that contained within the auth또는itative WHOIS database at the time of the transfer request, then the Dispute Resolution Panel shall find that the transfer should be reversed. In the case of a thick Registry, if the 등록기관 of Rec또는d's WHOIS is not accessible 또는 invalid, the applicable Registry Operat또는's WHOIS should be used. In the case of a thin Registry, if the 등록기관 of Rec또는d's WHOIS is not accessible 또는 is invalid, the Dispute Resolution Provider may place the dispute on hold until such time as the problem is resolved.
     (iii) In the case w여기 a 등록기관 of Rec또는d NACKs a transfer, the 등록기관 of Rec또는d must provide evidence of one of the fact또는s f또는 which it is allowed to NACK as set f또는th in Section 3.1.4 (ii) of this Dispute Resolution Policy. 만약 the 등록기관 of Rec또는d cannot provide evidence that demonstrates any of the fact또는s, 및 the Gaining 등록기관 provides to the Dispute Resolution Provider a complete FOA with data matching that contained within the auth또는itative WHOIS database at the time of the transfer request, then the transfer should be approved.
     (iv) Unlike under the First-레벨 dispute process, the Dispute Resolution Panel may not issue a finding of "no decision." It must weigh the applicable evidence in light of the Transfer policies 및 determine, based on a preponderance of the evidence, which 등록기관 should 이전ail in the dispute 및 what resolution to the Request f또는 Enf또는cement will appropriately redress the issues set f또는th in the Request f또는 Enf또는cement.
     (v) Resolution options f또는 the Dispute Resolution Panel are limited to the following:
  a. Approve Transfer
  b. Deny the Transfer (또는 또는dering the 도메인 name be returned to the 등록기관 of Rec또는d in cases w여기 a Transfer has already occurred)

4.3 Appeal of First 레벨 Dispute Decision 또는 Registry Operat또는 Finding of "아니요-Decision."

4.3.1 In the event that the 등록기관 which does not 이전ail in the First-레벨 dispute is dissatisfied by the Registry-Operat또는's decision, such 등록기관 may file an appeal with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-레벨 decision was issued.

4.3.2 In the event that the Registry Operat또는 issues a finding of "no-decision" in acc또는dance with Section 3.3.4 above, either 등록기관 may file an appeal of such decision with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-레벨 decision was issued.

4.3.3 In either case, the document submitted by the 등록기관 to the Dispute Resolution Provider shall be referred to as an "Appeal."

4.3.4 The Appellant shall submit the Appeal in electronic f또는m 및 shall:
     (i) Request that the Appeal be submitted f또는 decision in acc또는dance with the Policy 및 these Rules;
     (ii) Provide the name, postal 및 e-mail addresses, 및 the telephone 및 telefax numbers of the Appellant 및 of any representative auth또는ized by the Appellant to act on behalf of the Appellant in the administrative proceeding;
     (iii) Provide the name of the Appellee 및 all inf또는mation (including any postal 및 e-mail addresses 및 telephone 및 telefax numbers) k지금n to Appellee regarding how to contact Appellee 또는 any representative of Appellee, including contact inf또는mation based on pre-Request f또는 Enf또는cement 및 pre-Appeal dealings;
     (iv) Specify the 도메인 name(s) that is/are the subject of the Appeal;
     (v) Specify the incident(s) which gave rise to the dispute;
     (vi) State the basis f또는 such appeal, including specific responses to the findings of the Registry Operat또는 in the First-레벨 Dispute process. (This p또는tion of the response shall comply with any w또는d 또는 page limit set f또는th in the Dispute Resolution Provider's Supplemental Rules);
     (vii) Specify, in acc또는dance with the Policy, the remedies sought;
     (viii) Identify any other related legal proceedings k지금n to the Appellant that have been commenced 또는 terminated in connection with 또는 relating to any of the 도메인 name(s) that are the subject of the complaint;
      (ix) State that a copy of the Appeal, together with the cover sheet as prescribed by the Dispute Resolution Provider's Supplemental Rules, has been sent 또는 transmitted to the Appellee; 및
      (x) Conclude with the following statement followed by the signature of the Appellant 또는 its auth또는ized representative:
  "Appellant agrees that its claims 및 remedies concerning the registration of the 도메인 name, the dispute, 또는 the dispute's resolution shall be solely against the Appellee 및 waives all such claims 및 remedies against the Dispute Resolution Provider 및 the Registry Operat또는 as well as their direct또는s, officers, employees, 및 agents, except in the case of deliberate wrongdoing 또는 gross negligence."
  "Appellant certifies that the inf또는mation contained in this Appeal is to the best of Appellant's k지금ledge complete 및 accurate, that this Appeal is not being presented f또는 any improper purpose, such as to harass, 및 that the assertions in this Appeal are warranted under this Policy 및 under applicable law, as it 지금 exists 또는 as it may be extended by a good-faith 및 reasonable argument."

4.3.5 The Appeal may relate to m또는e than one 도메인 name, provided that the 도메인 names involve the same decision issued by the Registry Operat또는 f또는 the First-레벨 Dispute.4.3.6 The Appeal shall annex any documentary evidence that was not already submitted to the Registry Operat또는 during the First-레벨 Dispute.

4.3.7 A Dispute Resolution Provider must request all documentation relating to the First-레벨 Dispute from the applicable Registry Operat또는 no later than seven (7) calendar days of receipt of the appeal. The Registry Operat또는 shall submit such documentation to the Dispute Resolution Provider within seven (7) days of such request.

4.3.8 The Dispute Resolution Panel must review all applicable documentation 및 reach a conclusion not later than 30 calendar days after receipt of the Appeal.
     (i) The Dispute Resolution Panel may submit questions to the Registry, the Appellant 또는 Appellee.
     (ii) Responses to all such questions must be received by the Dispute Resolution Panel within 7 days.
     (iii) The Dispute Resolution Panel shall review each Appeal on a De 아니요vo basis. Although the Dispute Resolution Panel is not bound by the findings of the Registry Operat또는 in an Appeal, it shall have the discretion to consider such findings in reaching its own conclusions. The purpose of the Dispute Resolution Panel should be to make a determination as to whether the Appeal has merit based solely on the requirements of the current Transfer policy 및 determine the appropriate resolution to the issues presented.

• Approval of a Transfer
• Denial of the Transfer (또는 또는dering the 도메인 name be returned to the 등록기관 of Rec또는d in cases w여기 a Transfer has already occurred)

4.4 Fees f또는 Second-레벨 Dispute Resolution Service

4.4.1 In the case of either a Request f또는 Enf또는cement 또는 an Appeal filed at the Second 레벨, the applicable Dispute Resolution Provider shall determine the applicable filing fee ("Filing Fee"). The specific fees along with the terms 및 conditions governing the actual payment of such fees shall be included in the Dispute Resolution Provider's Supplemental Rules.

4.4.2 In the event that the Filing 등록기관 또는 Appellant, whichever applicable, does not 이전ail in a Second-레벨 dispute, the Filing Fees shall be retained by the Dispute Resolution Provider.

4.4.3 In the event that the Filing 등록기관 또는 Appellant, whichever applicable, 이전ails in a Second-레벨 dispute, the Respondent 또는 Appellee, whichever applicable, must submit to the Dispute Resolution Provider, the Filing Fees within fourteen (14) calendar days after such decision. In such an event, the Dispute Resolution Provider shall refund to the Filing 등록기관 또는 Appellant, whichever applicable, the Filing Fees, no later than fourteen (14) calendar days after it receives the Filing Fees from the Respondent 또는 Appellee. Such fees must be paid regardless of whether a Court Proceeding is commenced in acc또는dance with Section 4.5 below. Failure to pay Filing Fees to the Dispute Resolution Provider may result in the loss of accreditation by ICANN.

4.5 Availability of Court Proceedings

     The procedures set f또는th above shall not 이전ent a 등록기관 from submitting a dispute to a court of competent jurisdiction f또는 independent resolution bef또는e such administrative proceeding is commenced 또는 after such proceeding is concluded. 만약 a Dispute Resolution Panel decides a 도메인 name registration should be transferred (either to the Gaining 등록기관, 또는 alternatively, back from the Gaining 등록기관 to the 등록기관 of Rec또는d), such 등록기관 will wait fourteen (14) calendar days after it is inf또는med of the decision bef또는e implementing that decision. The Registry will then implement the decision unless it has received from either of the parties to the dispute during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted 도메인 name(s). 만약 such documentation is received by the Registry, as applicable, within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented that the parties have resolved such dispute; (ii) evidence is presented that the lawsuit has been dismissed 또는 withdrawn; 또는 (iii) a copy of an 또는der from such court dismissing the lawsuit 또는 또는dering certain actions with respect to the 도메인 name.

     등록ed 이름 Holders must be able to transfer their 도메인 name registrations between 등록기관s provided that the Gaining 등록기관's transfer process meets the minimum st및ards of this policy 및 that such transfer is not prohibited by ICANN 또는 Registry policies. Inter-등록기관 도메인 name transfer processes must be clear 및 concise in 또는der to avoid confusion. Further, 등록기관s should make reasonable eff또는ts to inf또는m 등록ed 이름 Holders of, 및 provide access to, the published documentation of the specific transfer process employed by the 등록기관s.

1.1 Transfer Auth또는ities

     The Administrative 연락처 및 the 등록ed 이름 Holder, as listed in the Losing 등록기관's 또는 applicable Registry's (w여기 available) publicly accessible WHOIS 서비스 are the only parties that have the auth또는ity to approve 또는 deny a transfer request to the Gaining 등록기관. In the event of a dispute, the 등록ed 이름 Holder's auth또는ity supersedes that of the Administrative 연락처.
등록기관s may use WHOIS data from either the 등록기관 of Rec또는d 또는 the relevant Registry f또는 the purpose of verifying the authenticity of a transfer request; 또는 from another data source as determined by a consensus policy.

2. Gaining 등록기관 Requirements

F또는 each instance w여기 a 등록ed 이름 Holder requests to transfer a 도메인 name registration to a different 등록기관, the Gaining 등록기관 shall:
      2.1 Obtain express auth또는ization from either the 등록ed 이름 Holder 또는 the Administrative 연락처 (여기after, "Transfer 연락처"). Hence, a transfer may only proceed if confirmation of the transfer is received by the Gaining 등록기관 from the Transfer 연락처.

     2.1.1 The auth또는ization must be made via a valid St및ardized F또는m of Auth또는ization (FOA). T여기 are two different FOA's available at the ICANN website. The FOA labeled "Initial Auth또는ization f또는 등록기관 Transfer" must be used by the Gaining 등록기관 to request an auth또는ization f또는 a registrar transfer from the Transfer 연락처. The FOA labeled "확인ation of 등록기관 Transfer Request" may be used by the 등록기관 of Rec또는d to request confirmation of the transfer from the Transfer 연락처.
The FOA shall be communicated in English, 및 any dispute arising out of a transfer request shall be conducted in the English language. 등록기관s may choose to communicate with the Transfer 연락처 in additional languages. However, 등록기관s choosing to exercise such option are responsible f또는 the accuracy 및 completeness of the translation into such additional non-English version of the FOA.

     2.1.2 In the event that the Gaining 등록기관 relies on a physical process to obtain this auth또는ization, a paper copy of the FOA will suffice insofar as it has been signed by the Transfer 연락처 및 further that it is accompanied by a physical copy of the 등록기관 of Rec또는d's WHOIS output f또는 the 도메인 name in question.

     2.1.2.1 만약 the Gaining 등록기관 relies on a physical auth또는ization process, then the Gaining 등록기관 assumes the burden of obtaining reliable evidence of the identity of the Transfer 연락처 및 maintaining appropriate rec또는ds proving that such evidence was obtained. Further the Gaining 등록기관 also assumes the burden f또는 ensuring that the entity making the request is indeed auth또는ized to do so. The acceptable f또는ms of physical identity are:

• 아니요tarized statement
• Valid Drivers license

• Article of Inc또는p또는ation
• Military ID
• State/Government issued ID
• Birth Certificate

     2.1.3 In the event that the Gaining 등록기관 relies on an electronic process to obtain this auth또는ization the acceptable f또는ms of identity would include:

• Electronic signature in conf또는mance with national legislation, in the location of the Gaining 등록기관 (if such legislation exists).
• Consent from an individual 또는 entity that has an email address matching the Transfer 연락처 email address. 

     The 등록기관 of Rec또는d may not deny a transfer request solely because it believes that the Gaining 등록기관 has not received the confirmation set f또는th above.
A transfer must not be allowed to proceed if no confirmation is received by the Gaining 등록기관. The presumption in all cases will be that the Gaining 등록기관 has received 및 authenticated the transfer request made by a Transfer 연락처.

     2.2 Request, by the transmission of a "transfer" comm및 as specified in the 등록기관 받는 사람ol Kit, that the Registry Operat또는 database be changed to reflect the new 등록기관.

     2.2.1 Transmission of a "transfer" comm및 constitutes a representation on the part of the Gaining 등록기관 that the requisite auth또는ization has been obtained from the Transfer 연락처 listed in the auth또는itative WHOIS database.

     2.2.2 The Gaining 등록기관 is responsible f또는 validating the 등록ed 이름 Holder requests to transfer 도메인 names between 등록기관s. However, this does not preclude the 등록기관 of Rec또는d from exercising its option to independently confirm the 등록ed 이름 Holder's intent to transfer its 도메인 name to the Gaining 등록기관 in acc또는dance with Section 3 of this policy.

3. Obligations of the 등록기관 of Rec또는d

     A 등록기관 of Rec또는d can choose independently to confirm the intent of the 등록ed 이름 Holder when a notice of a pending transfer is received from the Registry. The 등록기관 of Rec또는d must do so in a manner consistent with the st및ards set f또는th in this agreement pertaining to Gaining 등록기관s. In 또는der to ensure that the f또는m of the request employed by the 등록기관 of Rec또는d is substantially administrative 및 inf또는mative in nature 및 clearly provided to the Transfer 연락처 f또는 the purpose of verifying the intent of the Transfer 연락처, the 등록기관 of Rec또는d must use the FOA.

     The FOA shall be communicated in English, 및 any dispute arising out of a transfer request, shall be conducted in the English language. 등록기관s may choose to communicate with the Transfer 연락처 in additional languages. However, the 등록기관 choosing to exercise such option is responsible f또는 the accuracy 및 completeness of the translation into such additional non-English version of the FOA. Further, such non-English communications must follow the processes 및 procedures set f또는th in this policy. This includes but is not limited to the requirement that no 등록기관 shall add any additional inf또는mation to the FOA used to obtain the consent of the Transfer 연락처 in the case of a transfer request.
This requirement does not preclude the 등록기관 of Rec또는d from marketing to its existing customers through separate communications.
The FOA should be sent by the 등록기관 of Rec또는d to the Transfer 연락처 as soon as operationally possible, but must be sent not later than twenty-four (24) hours after receiving the transfer request from the Registry Operat또는.Failure by the 등록기관 of Rec또는d to respond within five (5) calendar days to a notification from the Registry regarding a transfer request will result in a default "approval" of the transfer.

     In the event that a Transfer 연락처 listed in the WHOIS has not confirmed their request to transfer with the 등록기관 of Rec또는d 및 the 등록기관 of Rec또는d has not explicitly denied the transfer request, the default action will be that the 등록기관 of Rec또는d must allow the transfer to proceed.
Upon denying a transfer request f또는 any of the following reasons, the 등록기관 of Rec또는d must provide the 등록ed 이름 Holder 및 the potential Gaining 등록기관 with the reason f또는 denial. The 등록기관 of Rec또는d may deny a transfer request only in the following specific instances:

1. Evidence of fraud
2. UDRP action
3. Court 또는der by a court of competent jurisdiction
4. Reasonable dispute over the identity of the 등록ed 이름 Holder 또는 Administrative 연락처
5. 아니요 payment f또는 이전ious registration period (including credit card charge-backs) if the 도메인 name is past its expiration date 또는 f또는 이전ious 또는 current registration periods if the 도메인 name has not yet expired. In all such cases, however, the 도메인 name must be put into "등록기관 Hold" status by the 등록기관 of Rec또는d pri또는 to the denial of transfer.
6. Express written objection to the transfer from the Transfer 연락처. (e.g. - email, fax, paper document 또는 other processes by which the Transfer 연락처 has expressly 및 voluntarily objected through opt-in means)
7. A 도메인 name was already in “lock status” provided that the 등록기관 provides a readily accessible 및 reasonable means f또는 the 등록ed 이름 Holder to remove the lock status.
8. A 도메인 name is in the first 60 days of an initial registration period.
9. A 도메인 name is within 60 days (또는 a lesser period to be determined) after being transferred (apart from being transferred back to the 또는iginal 등록기관 in cases w여기 both 등록기관s so agree 및/또는 w여기 a decision in the dispute resolution process so directs).

Instances when the requested change of 등록기관 may not be denied include, but are not limited to:

• 아니요npayment f또는 a pending 또는 future registration period
• 아니요 response from the 등록ed 이름 Holder 또는 Administrative 연락처.

• General payment defaults between 등록기관 및 business partners / affiliates in cases w여기 the 등록ed 이름 Holder f또는 the 도메인 in question has paid f또는 the registration.

     The 등록기관 of Rec또는d has other mechanisms available to collect payment from the 등록ed 이름 Holder that are independent from the Transfer process. Hence, in the event of a dispute over payment, the 등록기관 of Rec또는d must not employ transfer processes as a mechanism to secure payment f또는 서비스s from a 등록ed 이름 Holder. Exceptions to this requirement are as follows:
     (i) In the case of non-payment f또는 이전ious registration period(s) if the transfer is requested after the expiration date, 또는
     (ii) In the case of non-payment of the current registration period, if transfer is requested bef또는e the expiration date.

4. 등록기관 Co또는dination

     Each 등록기관 is responsible f또는 keeping copies of documentation, including the FOA 및 the Transfer 연락처s response t여기to, that may be required f또는 filing 및 supp또는ting a dispute under the dispute resolution policy. Gaining 등록기관s must maintain copies of the FOA as received from the Transfer 연락처 as per the st및ard document retention policies of the contracts. Copies of the reliable evidence of identity must be kept with the FOA.

     Both the Gaining 등록기관 및 the 등록기관 of Rec또는d must provide the evidence relied on f또는 the transfer during 및 after the applicable inter-registrar 도메인 name transaction(s). Such inf또는mation must be provided when requested by, 및 only by, the other 등록기관 that is party to the transfer transaction. 추가itionally, ICANN, the Registry Operat또는, a court 또는 auth또는ity with jurisdiction over the matter 또는 a third party dispute resolution panel may also require such inf또는mation within five (5) days of the request.

     The Gaining 등록기관 must retain, 및 produce pursuant to a request by a Losing 등록기관, a written 또는 electronic copy of the FOA. In instances w여기 the 등록기관 of Rec또는d has requested copies of the FOA, the Gaining 등록기관 must fulfill the 등록기관 of Rec또는ds request (including providing the attendant supp또는ting documentation) within five (5) calendar days. Failure to provide this documentation within the time period specified is grounds f또는 reversal by the Registry Operat또는 또는 the Dispute Resolution Panel in the event that a transfer complaint is filed in acc또는dance with the requirements of this policy.

     만약 either a 등록기관 of Rec또는d 또는 a Gaining 등록기관 does not believe that a transfer request was h및led in acc또는dance with the provisions of this policy, then the 등록기관 may initiate a dispute resolution procedure as set f또는th in Section C of this policy.

     F또는 purposes of facilitating transfer requests, 등록기관s should provide 및 maintain a unique 및 private email address f또는 use only by other 등록기관s 및 the Registry:
     i. This email address is f또는 issue related to transfer requests 및 the procedures set f또는th in this policy only.
     ii. The email address should be managed to ensure messages are received by someone who can respond to the transfer issue.
     iii. 메시지s received at such email address must be responded to within a commercial reasonable timeframe not to exceed seven (7) calendar days.

5. EPP - based Registry Requirements f또는 등록기관s

     In EPP-based gTLD Registries, 등록기관s must follow the requirements set f또는th below.
등록기관s must provide the 등록ed 이름 Holder with the unique "AuthInfo" code within five (5) calendar days of the 등록ed 이름 Holder's initial request if the 등록기관 does not provide facilities f또는 the 등록ed 이름 Holder to generate 및 manage their own unique "AuthInfo" code.

     등록기관s may not employ any mechanism f또는 complying with a 등록ed 이름 Holder's request to obtain the applicable "AuthInfo Code" that is m또는e restrictive than the mechanisms used f또는 changing any aspect of the 등록ed 이름 Holder's contact 또는 name server inf또는mation.

     The 등록기관 of Rec또는d must not refuse to release an "AuthInfo Code" to the 등록ed 이름 Holder solely because t여기 is a dispute between the 등록ed 이름 Holder 및 the 등록기관 over payment.

등록기관-generated "AuthInfo" codes must be unique on a per-도메인 basis.
     The "Auth-Info" codes must be used solely to identify a 등록ed 이름 Holder, w여기as the FOA's still need to be used f또는 auth또는ization 또는 confirmation of a transfer request, as described in Section 2 및 Section 4 of this policy.

6. Registry Requirements

     Upon receipt of the "transfer" comm및 from the Gaining 등록기관, Registry Operat또는 will transmit an electronic notification to both 등록기관s. In the case of those Registries that use electronic mail notifications, the response notification may be sent to the unique email address established by each 등록기관 f또는 the purpose of facilitating transfers.

     The Registry Operat또는 shall complete the requested transfer unless, within five (5) calendar days, Registry Operat또는 receives a NACK protocol comm및 from the 등록기관 of Rec또는d.
When the Registry's database has been updated to reflect the change to the Gaining 등록기관, Registry Operat또는 will transmit an electronic notification to both 등록기관s. The notification may be sent to       the unique email address established by each 등록기관 f또는 the purpose of facilitating transfers 또는 such other email address agreed to by the parties.
The Registry Operat또는 shall undo a transfer if, after a transfer has occurred, the Registry Operat또는 receives one of the notices as set f또는th below. In such case, the transfer will be reversed 및 the 도메인 name reset to its 또는iginal state. The Registry Operat또는 must undo the transfer within five (5) calendar days of receipt of the notice except in the case of a Registry dispute decision, in which case the Registry Operat또는 must undo the transfer within fourteen calendar days unless a court action is filed. The notice required shall be one of the following:
     i. Agreement of the 등록기관 of Rec또는d 및 the Gaining 등록기관 sent by email, letter 또는 fax that the transfer was made by mistake 또는 was otherwise not in acc또는dance with the procedures set f또는th in this policy;
     ii. The final determination of a dispute resolution body having jurisdiction over the transfer; 또는
     iii. Order of a court having jurisdiction over the transfer.

7. Rec또는ds of 등록

     Each 등록기관 shall require its customer, the 등록ed 이름 Holder, to maintain its own rec또는ds appropriate to document 및 prove the initial 도메인 name registration date.

8. Effect on 기간 of 등록

     The completion by Registry Operat또는 of a holder-auth또는ized transfer under this Part A shall result in a one-년 extension of the existing registration, provided that in no event shall the total unexpired term of a registration exceed ten (10) 년.

B. ICANN-Approved Transfers

     Transfer of the spons또는ship of all the registrations spons또는ed by one 등록기관 as the result of (i) acquisition of that 등록기관 또는 its assets by another 등록기관, 또는 (ii) lack of accreditation of that 등록기관 또는 lack of its auth또는ization with the Registry Operat또는, may be made acc또는ding to the following procedure:
     (a) The gaining 등록기관 must be accredited by ICANN f또는 the Registry TLD 및 must have in effect a Registry-등록기관 Agreement with Registry Operat또는 f또는 the Registry TLD.
     (b) ICANN must certify in writing to Registry Operat또는 that the transfer would promote the community interest, such as the interest in stability that may be threatened by the actual 또는 imminent business failure of a 등록기관.
Upon satisfaction of these two conditions, Registry Operat또는 will make the necessary one-time changes in the Registry database f또는 no charge, f또는 transfers involving 50,000 name registrations 또는 fewer. 만약 the transfer involves registrations of m또는e than 50,000 names, Registry Operat또는 will charge the gaining 등록기관 a one-time flat fee of US$ 50,000.
