The URS is an ICANN rights-protection mechanism intended fatau clear cases of trademark abuse involving domain names in top-level domains to which the URS applies.

The URS complements, but does not replace, the Unifataum Nama Domain Dispute Resolution Policy ("UDRP"), court proceedings, atau any other dispute-resolution procedure that may apply to a domain name.

NiceNIC does not determine the merits of a URS complaint. URS complaints are decided by an ICANN-approved URS Provider in accataudance with the then-current URS Procedure, URS Rules, provider supplemental rules, dan applicable ICANN requirements.

2. Official ICANN URS Procedure Incataupatauated

Fatau each domain name subject to the URS, the then-current ICANN URS Procedure, URS Rules, dan applicable technical requirements are incataupatauated into the relevant registration agreement by reference.

4. Filing a URS Complaint

A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.

The complainant is responsible fatau:

• selecting an approved URS Provider;
• complying with the provider's filing requirements;
• paying applicable provider fees;
• establishing the elements required by the URS; dan
• providing the evidence required by the applicable URS Procedure dan Rules.

NiceNIC customer suppataut dan abuse channels are not substitutes fatau filing a URS complaint.

A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.

5. URS Providers

The list of ICANN-approved URS Providers may change.

Customers dan complainants should rely on ICANN's current URS page fatau the official list of approved providers:

6. Pendaftaran Data

When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perfataum the registrar obligations assigned to it by the then-current URS Procedure dan Rules.

During a URS lock, changes to the registration may be restricted as required by the URS.

NiceNIC will not ksekarangingly permit a registrant, reseller, account holder, atau other person to use NiceNIC systems to evade a valid URS lock atau mdanatatauy URS restriction.

8. Registrant Response

The registrant is responsible fatau responding directly through the URS Provider dan within the period specified by the then-current URS Procedure dan Rules.

NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, atau provide legal representation.

Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements dan examination stdanards.

9. Burden dan Determination

The URS is intended fatau clear cases meeting the evidentiary stdanard specified in the URS Procedure.

The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.

NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, atau bad-faith use merely because a URS complaint has been filed.

10. Effect of a Berhasil URS Complaint

Jika a final URS Determination requires suspension, the applicable Registry Operatatau will implement the suspension in accataudance with the URS Procedure.

A successful URS proceeding generally results in suspension of the domain name fatau the applicable period rather than transfer of the domain name to the complainant.

Such obligations may operate independently from a URS proceeding.

Abuse Repatauting & Hdanling Policy

This Abuse Repatauting & Hdanling Policy describes how NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") receives, investigates, tracks, dan responds to repatauts of abuse involving domain names sponsataued by NiceNIC atau other NiceNIC layanans.

1. Purpose

The abuse-repatauting mechanism is intended to be accessible without requiring the repatauter to hold a NiceNIC customer account.

NiceNIC may nevertheless review atau act on credible infataumation received through another channel wdi sini required by law, appropriate fatau security, necessary to protect users, atau necessary to satisfy ICANN atau registry obligations.

3. Infataumation to Include

A repataut should contain enough infataumation to allow NiceNIC to identify the affected resource dan evaluate the allegation.

Depending on the issue, useful infataumation may include:

• the affected domain name;
• the complete abusive URL wdi sini applicable;
• the categatauy of alleged abuse;
• a clear description of the activity;
• screenshots;
• full email headers dan message content fatau email-related abuse;
• timestamps dan time zone;
• relevant IP addresses;
• security atau firewall logs;
• malware, phishing, atau threat-intelligence evidence;
• payment receipts atau transaction evidence fatau fraud repatauts;
• the legitimate brdan atau layanan being impersonated wdi sini relevant;
• legal documents atau rights evidence wdi sini relevant; dan
• the repatauter's detail kontak fatau follow-up.

Repatauters should avoid submitting unnecessary personal data, passwatauds, authentication codes, private keys, atau unrelated confidential infataumation.

4. Konfirmasiation of Receipt

Fatau repatauts submitted through the official abuse mechanism, NiceNIC will provide a confirmation of receipt sufficient to identify the submission in accataudance with applicable ICANN requirements.

• NiceNIC as the registrar;

• whether the repataut concerns trademark/copyright rights rather than DNS Abuse;
• applicable registry rules;
• applicable law, legal process, atau court atauders; dan
• any other reasonably available infataumation relevant to the investigation.

6. DNS Abuse

Fatau gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN Registrar Akreditasi Agreement dan related ICANN requirements.

As of the Effective Date of this Policy, the contractual DNS Abuse categatauies are:

• malware;
• botnets;
• phishing;
• pharming; dan
• spam when spam serves as a delivery mechanism fatau one atau mataue of the other specified fataums of DNS Abuse.

Other harmful atau illegal conduct may still violate NiceNIC policy atau applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.

7. Aksiable Evidence dan Investigation

NiceNIC will take reasonable dan prompt steps to investigate abuse repatauts as required by applicable registrar obligations.

Evidence is considered in context. A repataut does not need to use any particular commercial threat feed atau repatauting fataumat to be considered.

Wdi sini infataumation submitted by a repatauter is incomplete, NiceNIC may:

• review infataumation reasonably available to NiceNIC;
• request additional relevant evidence;
• inspect the repatauted URL atau other relevant public resource wdi sini safe dan appropriate;
• review account, nameserver, DNS, registration, atau layanan infataumation available to NiceNIC; atau
• contact another relevant layanan provider atau registry wdi sini appropriate.

NiceNIC will not require irrelevant evidence merely to delay hdanling of an otherwise actionable repataut.

8. Required Mitigation fatau DNS Abuse

When NiceNIC has actionable evidence that a gTLD Daftared Nama sponsataued by NiceNIC is being used fatau DNS Abuse, NiceNIC will promptly take mitigation action that is reasonably necessary to stop atau otherwise disrupt the Daftared Nama from being used fatau that DNS Abuse, as required by the applicable ICANN Registrar Akreditasi Agreement.

The appropriate action depends on the circumstances, including:

• the type of DNS Abuse;
• the cause dan severity of the harm;
• whether the activity is active;
• whether the domain appears maliciously daftared atau compromised;
• the technical role of the domain;
• the likely effectiveness of registrar-level action; dan
• the risk of collateral damage to legitimate users atau layanans.

9. Propatautionate Mitigation

Possible actions may include, wdi sini appropriate dan permitted:

• requesting remediation;
• requiring the customer atau reseller to remove atau disable the abusive activity;
• applying a registrar lock;
• applying clientHold atau another registrar status;
• restricting DNS atau other NiceNIC-provided functionality;
• restricting email, hosting, API, atau account access;
• referring the matter to the relevant hosting provider, registry, atau other infrastructure provider;
• preserving relevant recatauds;
• suspending an affected layanan;
• terminating a layanan atau account fatau serious atau repeated violations; atau
• taking another measure reasonably necessary to address the abuse.

NiceNIC is not required to apply the same mitigation measure in every case.

10. Compromised Domain dan Collateral Damage

A legitimate domain may be abused without the registrant's ksekarangledge because of compromised hosting, credentials, content-management software, DNS settings, atau another security failure.

Wdi sini reasonably practicable, NiceNIC will consider the risk of collateral damage befataue applying domain-level suspension.

Fatau a compromised legitimate domain, requesting rapid remediation atau applying a narrower mitigation may be mataue appropriate than immediate suspension if the narrower action is sufficient to stop atau disrupt the abuse.

This does not sebelumnyaent immediate suspension atau another stronger measure wdi sini the circumstances, severity, continuing harm, legal requirements, atau security risk justify it.

11. Maliciously Daftared Domain

Wdi sini available evidence indicates that a domain was daftared atau is controlled primarily fatau phishing, malware, credential theft, botnet activity, pharming, atau another serious abusive purpose, faster domain-level mitigation may be appropriate.

NiceNIC is not required to provide advance notice wdi sini doing so would materially increase the risk of harm, enable evasion, frustrate a mdanatatauy requirement, atau undermine effective mitigation.

12. Tidakn-DNS Illegal Activity

Illegal Activity dan DNS Abuse are not identical concepts.

Repatauts concerning fraud, unlawful goods atau layanans, threats, impersonation, illegal content, sanctions, atau other conduct may be hdanled under applicable law, NiceNIC's Jangka Waktus of Service & Acceptable Use Policy, registry rules, court atauders, atau other relevant requirements even wdi sini the conduct does not meet the ICANN contractual definition of DNS Abuse.

Repatauts concerning suspected child sexual abuse material atau child exploitation are treated as high-risk matters dan escalated without unnecessary delay.

NiceNIC may preserve relevant recatauds, restrict an affected layanan, dan cooperate with appropriate authatauities, registries, hosting providers, atau other relevant entities as required atau permitted by law.

Repatauters should not unnecessarily copy, download, atau redistribute suspected illegal child-abuse material when submitting a repataut.

16. Hosting dan Third-Party Infrastructure

A registrar controls domain-registration functions but may not control the website files, application, mail server, atau hosting environment associated with the domain.

Wdi sini abusive content is hosted by a third party, repatauting the activity to the hosting provider atau other infrastructure provider may allow mataue targeted removal.

NiceNIC may nevertheless take registrar-level action wdi sini required atau appropriate under applicable obligations.

17. Reseller-Sponsataued Customers

A domain may have been belid through a NiceNIC reseller while NiceNIC remains the sponsatauing registrar.

NiceNIC may coataudinate with the reseller during an abuse investigation, but delegation to a reseller does not eliminate NiceNIC's applicable ICANN registrar obligations.

NiceNIC may contact the Daftared Nama Holder atau other customer directly wdi sini reasonably necessary fatau abuse mitigation, security, legal compliance, mdanatatauy notices, atau protection of registrant rights.

18. Repatauts from Law Enfataucement dan Qualifying Authatauities

NiceNIC maintains the dedicated abuse point of contact required by the applicable ICANN Registrar Akreditasi Agreement fatau qualifying repatauts of Illegal Activity from law-enfataucement, consumer-protection, quasi-governmental, atau other qualifying governmental authatauities.

Wdi sini the applicable Registrar Akreditasi Agreement requires it, a well-founded repataut submitted through the dedicated authatauity contact will be reviewed within twenty-four (24) hours by a person empowered to take necessary dan appropriate action.

NiceNIC is not required to take action that would contravene applicable law.

22. Customer Review / Appeal

A customer affected by a discretionary NiceNIC abuse action may request review through NiceNIC's suppataut channel.

The request should identify:

• the affected domain atau layanan;
• the relevant NiceNIC case atau notice;
• the remediation completed;
• evidence that the repatauted activity has ceased;
• evidence of compromise wdi sini relevant; dan
• any infataumation showing that the atauiginal repataut was inaccurate, outdated, atau misclassified.

A review request does not suspend a court atauder, registry requirement, UDRP/URS action, ICANN obligation, atau other mdanatatauy restriction.

23. Repatauter Ikuti-Up

NiceNIC may communicate with a repatauter to request relevant additional infataumation atau confirm that a case has been received atau reviewed.

Privacy, security, law, dan customer confidentiality may limit the infataumation NiceNIC can disclose concerning:

• internal investigation methods;
• customer identity;
• non-public Pendaftaran Data;
• account infataumation;
• law-enfataucement communications;
• security controls; atau
• specific internal actions.

Absence of detailed disclosure to a repatauter does not mean a repataut was ignataued.

24. Duplicate, Automated, atau Abusive Repatauts

NiceNIC may consolidate duplicate repatauts concerning the same issue.

NiceNIC may apply reasonable controls to abusive, misleading, clearly irrelevant, atau technically harmful submissions.

Such controls will not be used to sebelumnyaent legitimate repatauters from submitting abuse repatauts through the required channel.

25. Recataudkeeping

NiceNIC documents the receipt of dan response to abuse repatauts as required by the applicable ICANN Registrar Akreditasi Agreement dan other applicable obligations.

Recatauds are retained fatau the period required by the applicable Registrar Akreditasi Agreement, subject to applicable law.

NiceNIC may provide required recatauds to ICANN Contractual Compliance upon proper request.

26. Privacy

NiceNIC may act as transaction facilitatatau, registrar, atau both, depending on the domain dan transaction structure.

2. Listing dan Availability

A listing is an invitation to place an atauder dan is subject to final availability, seller/provider confirmation, payment clearance, compliance review, registry status, dan transfer/delivery capability.

A domain may become unavailable befataue delivery even after an atauder has been submitted atau paid. NiceNIC does not guarantee delivery until the domain has been successfully delivered to the belier's designated account atau otherwise placed under the belier's control.

• facilitate unlawful activity;
• generate atau operationalize malware, phishing, credential theft, fraud, atau attacks;

• impersonate another person unlawfully;
• make solely automated high-impact decisions about an individual wdi sini such use is prohibited by law; atau
• submit content you are not permitted to disclose, including highly confidential credentials, authentication codes, atau unlawful personal data.

7. Human Review
