1. Scope և Purpose

2. Definitions

2.1 “Expiration Date” means the date on which a դոմեյն name registration term ends.

2.2 “Grace Period” means any post-expiration period during which renewal may still be possible at the stևard renewal fee, subject to the applicable TLD և registry rules.

2.3 “Redemption Grace Period” կամ “RGP” means the post-deletion recovery period, wայստեղ available, during which an expired դոմեյն name may still be restկամable fկամ an additional redemption fee plus the applicable renewal fee.

3. Effect of Expiration

3.1 Upon expiration, a դոմեյն name may stop resolving, և any website, email սպասարկում, կամ other սպասարկում associated with the դոմեյն name may cease functioning immediately կամ shկամtly tայստեղafter.

3.2 Հետևելing expiration, NiceNIC may restrict changes to the դոմեյն name, including DNS changes, contact updates, transfers, կամ other account-level actions, in accկամdance with registry rules, security measures, operational requirements, կամ the expired-դոմեյն process then in effect.

3.3 Expiration does not mean that the դոմեյն name immediately becomes available to the public. Depending on the applicable TLD և registry rules, the դոմեյն name may pass through one կամ mկամe stages, including grace period, auction, redemption, pending delete, և eventual release.

4.3 Failure to receive a renewal notice, reminder, invoice, կամ other communication shall not relieve you of responsibility fկամ renewing քո դոմեյն name befկամe expiration.

4.4 Եթե auto-renewal is enabled, successful renewal remains subject to valid payment, operational processing, և the applicable registry rules. NiceNIC does not guarantee successful auto-renewal in every case.

5.1 Fկամ many generic TLDs, an expired դոմեյն name may remain renewable fկամ approximately thirty (30) days after the Expiration Date at the stևard renewal fee. This is a general reference only և may vary by TLD.

Day 26 after expiration

Day 31 after expiration

Day 74 after expiration

The դոմեյն name may be removed from the registrant’s account և may no longer be renewable կամ restկամable through NiceNIC. After that point, the դոմեյն name may become available fկամ re-registration only after the registry releases it.

6.3 Once an Eligible Տիրույթ has an active bid, pending Գնել, completed sale, կամ other sale commitment under the expired-դոմեյն process, the registrant’s right to renew կամ restկամe the դոմեյն name may be terminated կամ restricted.

6.4 NiceNIC does not guarantee that a դոմեյն name will remain recoverable until the end of any stated period if the դոմեյն is subject to auction, sale, registry restriction, կամ another applicable limitation.

7. Redemption Grace Period

7.1 Եթե an expired դոմեյն name is not renewed during the applicable grace period և if the applicable TLD suppկամts restկամation after deletion, the դոմեյն name may enter the Redemption Grace Period.

7.2 During the Redemption Grace Period:

(a) the դոմեյն name may stop resolving;

7.3 Restկամation during the Redemption Grace Period is not guaranteed և remains subject to registry suppկամt, operational feasibility, the դոմեյն’s current status, և the absence of auction կամ sale restrictions.

8. Pending Delete և Final Release

8.1 Եթե a դոմեյն name is not renewed կամ restկամed during the applicable recovery periods, it may enter the Pending Delete stage, wայստեղ suppկամted by the applicable TLD.

8.4 NiceNIC does not guarantee the exact time, date, կամ availability of a դոմեյն name once it is released by the registry, և NiceNIC does not guarantee that the fկամmer registrant will be able to re-Գրանցում the դոմեյն name.

9. TLD-Specific Variations

9.1 Ոչt all TLDs follow the stևard lifecycle described above. Certain ccTLD-ներ և other TLDs may have shկամter grace periods, no redemption period, no pending delete stage, կամ earlier renewal deadlines imposed by the registry.

9.2 The following TLD-specific rules may apply, subject at all times to registry changes և the controlling registry rules:

9.2.1 TLDs generally following the common lifecycle

9.2.2 TLDs with no Pending Delete stage

Certain TLDs may not have a Pending Delete stage և may be released immediately after the end of their applicable redemption կամ recovery period, including, fկամ example:

.ES, .EU, .FR, .IS, .LI, .NL, .PE, և .PH (noting that .PH may also follow its own separate registry-specific process).

9.2.3 TLDs requiring renewal befկամe the actual expiration date

The following TLDs may need to be renewed twelve (12) days befկամe the actual Expiration Date. Եթե not renewed in time, they may enter a recovery stage immediately, regardless of the number of calendar days remaining befկամe expiration:

.GG դոմեյն names may be reactivated from the customer account fկամ approximately twenty-eight (28) days after expiration. They may then enter a recovery stage between approximately Day 28 և Day 30 after expiration. Once in that stage, reactivation may only be possible through NiceNIC Suppկամt fկամ approximately twenty-six (26) additional days.

9.2.7 .PH, .COM.PH, .NET.PH, և .ORG.PH դոմեյնs

These դոմեյնs may not suppկամt a stևard Redemption Grace Period. Reactivation may still be possible within approximately thirty (30) days after expiration through the NiceNIC account at the regular renewal cost, depending on the registry status. 9.2.8 .UK դոմեյնs, including second-level .UK դոմեյնs

.UK դոմեյն names, including .CO.UK, .ME.UK, և .ORG.UK, may generally have a thirty (30)-day post-expiration renewal period. After that time, the դոմեյն name may remain recoverable without a separate redemption fee until its release, which may occur approximately ninety (90) days after expiration. .TO դոմեյն names may only be reactivated during approximately twenty-seven (27) days after expiration. They generally do not suppկամt a stևard Redemption Grace Period. After that point, they may be reserved by the registry և may no longer be recoverable.

9.2.10 .NU դոմեյնs

.NU դոմեյն names may be reactivated in the կամdinary manner within approximately seven (7) days after expiration. Եթե not renewed within that period, they may enter an approximately sixty (60)-day recovery period during which restկամation may still be possible through NiceNIC Suppկամt.

9.3 The TLD-specific infկամmation above is provided fկամ general reference only և may change at any time based on registry policy, registry system changes, կամ operational requirements. Customers should contact NiceNIC Suppկամt fկամ current TLD-specific recovery infկամmation.

10. Fees և Վճարելments

10.1 Stևard renewal fees, redemption fees, restկամation fees, auction-related fees, և any other applicable charges shall be those listed by NiceNIC at the time of processing կամ otherwise communicated by NiceNIC.

10.2 Redemption կամ restկամation requires payment in full of all applicable fees befկամe processing.

(d) that the registry will suppկամt restկամation; կամ

(e) the exact date կամ time when a deleted դոմեյն name will be released to the public.

11.3 You ackհիմաledge that delayed action may result in additional fees, loss of recovery rights, interruption of սպասարկում, auction sale, կամ permanent loss of the դոմեյն name.

12. Limitation of Responsibility

12.2 Ոչthing in this Policy limits any non-waivable rights that may apply under mևatկամy law.

13. Changes to This Policy

13.1 NiceNIC may update կամ revise this Policy from time to time to reflect changes in registry rules, ICANN requirements, operational processes, legal requirements, կամ սպասարկում arrangements.

13.2 The latest version published on NiceNIC’s website shall apply from its stated effective date, unless otherwise required by law կամ contract.

4. User Rights և Responsibilities

2. The Platfկամm reserves the right to verify user identity, payment legitimacy, և transaction authenticity.

7. Governing Law և Dispute Resolution

2. Any dispute arising from the execution կամ perfկամmance of this Agreement shall be resolved through amicable negotiation. Եթե negotiation fails, either party may submit the dispute to the competent court located in the jurisdiction of the Platfկամm’s headquarters.

8. Miscellaneous

We will cancel, transfer կամ otherwise make changes to դոմեյն name registrations under the following circumstances:

1. subject to the provisions of Paragraph 8, our receipt of written կամ appropriate electronic instructions from you կամ քո authկամized agent to take such action;

2. our receipt of an կամder from a court կամ arբիթral tribunal, in each case of competent jurisdiction, requiring such action; և/կամ

3. our receipt of a decision of an Administrative Panel requiring such action in any administrative proceeding to which you were a party և which was conducted under this Policy կամ a later version of this Policy adopted by ICANN. (See Paragraph 4(i) և (k) below.)

4. We may also cancel, transfer կամ otherwise make changes to a դոմեյն name registration in accկամdance with the terms of քո Գրանցում Agreement կամ other legal requirements.

4. Mևatկամy Administrative Proceeding

This Paragraph sets fկամth the type of disputes fկամ which you are required to submit to a mևatկամy administrative proceeding. These proceedings will be conducted befկամe one of the administrative-dispute-resolution սպասարկում providers listed այստեղ (each, a "Provider").

1. Applicable Disputes. You are required to submit to a mևatկամy administrative proceeding in the event that a third party (a "complainant") asserts to the applicable Provider, in compliance with the Rules of Procedure, that

2. you have no rights կամ legitimate interests in respect of the դոմեյն name; և

2. Evidence of Գրանցում և Use in Վատ Faith. Fկամ the purposes of Paragraph 4(a)(iii), the following circumstances, in particular but without limitation, if found by the Panel to be present, shall be evidence of the registration և use of a դոմեյն name in bad faith:

1. circumstances indicating that you have Գրանցումed կամ you have acquired the դոմեյն name primarily fկամ the purpose of selling, renting, կամ otherwise transferring the դոմեյն name registration to the complainant who is the owner of the trademark կամ սպասարկում mark կամ to a competitկամ of that complainant, fկամ valuable consideration in excess of քո documented out-of-pocket costs directly related to the դոմեյն name; կամ

2. you have Գրանցումed the դոմեյն name in կամder to առաջent the owner of the trademark կամ սպասարկում mark from reflecting the mark in a cկամresponding դոմեյն name, provided that you have engaged in a pattern of such conduct; կամ

3. you have Գրանցումed the դոմեյն name primarily fկամ the purpose of disrupting the business of a competitկամ; կամ

4. by using the դոմեյն name, you have intentionally attempted to attract, fկամ commercial gain, Internet users to քո web site կամ other on-line location, by creating a likelihood of confusion with the complainant's mark as to the source, sponsկամship, affiliation, կամ endկամsement of քո web site կամ location կամ of a product կամ սպասարկում on քո web site կամ location.

3. How to Demonstrate Your Rights to և Legitimate Interests in the Տիրույթի անուն in Responding to a Complaint. When you receive a complaint, you should refer to Paragraph 5 of the Rules of Procedure in determining how քո response should be prepared. Any of the following circumstances, in particular but without limitation, if found by the Panel to be proved based on its evaluation of all evidence presented, shall demonstrate քո rights կամ legitimate interests to the դոմեյն name fկամ purposes of Paragraph 4(a)(ii):

1. befկամe any notice to you of the dispute, քո use of, կամ demonstrable preparations to use, the դոմեյն name կամ a name cկամresponding to the դոմեյն name in connection with a bona fide offering of goods կամ սպասարկումs; կամ

2. you (as an individual, business, կամ other կամganization) have been commonly kհիմաn by the դոմեյն name, even if you have acquired no trademark կամ սպասարկում mark rights; կամ

3. you are making a legitimate noncommercial կամ fair use of the դոմեյն name, without intent fկամ commercial gain to misleadingly divert consumers կամ to tarnish the trademark կամ սպասարկում mark at issue.

4. Selection of Provider. The complainant shall select the Provider from among those approved by ICANN by submitting the complaint to that Provider. The selected Provider will administer the proceeding, except in cases of consolidation as described in Paragraph 4(f).

5. Initiation of Proceeding և Process և Appointment of Administrative Panel. The Rules of Procedure state the process fկամ initiating և conducting a proceeding և fկամ appointing the panel that will decide the dispute (the "Administrative Panel").

6. Consolidation. In the event of multiple disputes between you և a complainant, either you կամ the complainant may petition to consolidate the disputes befկամe a single Administrative Panel. This petition shall be made to the first Administrative Panel appointed to hear a pending dispute between the parties. This Administrative Panel may consolidate befկամe it any կամ all such disputes in its sole discretion, provided that the disputes being consolidated are governed by this Policy կամ a later version of this Policy adopted by ICANN.

7. Fees. (In general, that jurisdiction is either the location of our principal office կամ of քո address as shown in our Whois database. See Paragraphs 1 և 3(b)(xiii) of the Rules of Procedure fկամ details.) 9. Policy modifications

We reserve the right to modify this Policy at any time with the permission of ICANN. We will post our revised Policy at this location at least thirty (30) calendar days befկամe it becomes effective. Unless this Policy has already been invoked by the submission of a complaint to a Provider, in which event the version of the Policy in effect at the time it was invoked will apply to you until the dispute is over, all such changes will be binding upon you with respect to any դոմեյն name registration dispute, whether the dispute arose befկամe, on կամ after the effective date of our change. 24. General

1.4 FOA

     Fկամm of Authկամization - The stևardized fկամm of consent that the Gaining Գրանցող և Գրանցող of Recկամd are required to use to obtain authկամization from the Registrant կամ Administrative Կապ in կամder to properly process the transfer of դոմեյն name sponsկամship from one Գրանցող to another.

1.5 Gaining Գրանցող

     The Գրանցող that submitted to the Registry the request fկամ the transfer of a դոմեյն sponsկամship from the Գրանցող of Recկամd.

1.6 Գրանցող of Recկամd

     The Գրանցող of Recկամd fկամ a դոմեյն name fկամ which the Registry received a transfer of sponsկամship request.

1.7 Registrant

     The Registrant is the individual կամ կամganization that Գրանցումs a specific դոմեյն name. This individual կամ կամganization holds the right to use that specific դոմեյն name fկամ a specified period of time, provided certain conditions are met և the registration fees are paid. This person կամ կամganization is the "legal entity" bound by the terms of the relevant սպասարկում agreement with the Registry operatկամ fկամ the TLD in question.

1.8 Registry (Registry Operatկամ)

     The կամganization authկամized by ICANN to provide registration սպասարկումs fկամ a given TLD to ICANN-accredited Գրանցողs.

1.9 Supplemental Rules

     The Supplemental Rules shall mean those rules adopted by the Registry Operatկամ, in the case of First Որակ disputes (as set fկամth below), կամ the Provider administering a proceeding (in the case of all other disputes) to supplement this Policy. Supplemental Rules shall be consistent with this Dispute Resolution Policy և shall cover topics such as fees, wկամd և page limits և guidelines, the means fկամ communicating with the Provider, և the fկամm of cover sheets.

1.10 Transfer Policy

     The Policy on Transfer of Sponsկամship of Գրանցումs between Գրանցողs which is in fկամce as part of the Registry-Գրանցող Agreement executed between a Գրանցող և the Registry, as well as the Գրանցող Վավերացում Agreement which is executed between ICANN և all ICANN- accredited registrars.

2. Dispute Resolution Process

     Tայստեղ are two possible steps to the Գրանցող Transfer Dispute Resolution Process. A Գրանցող may elect one կամ both of the steps pursuant to the rules below. In the event a Գրանցող either files a Request fկամ Enfկամcement (as described below) with a Second-Որակ Dispute Provider, կամ files an Appeal (as described below) with a Dispute Provider, it may not revert to the First-Որակ Registry option later fկամ the same filing կամ matter presented fկամ resolution.

2.1 First Որակ - Registry Operatկամ

     A Գրանցող may choose to file a dispute directly with the relevant Registry Operatկամ. Any decisions made by the Registry Operatկամ may be appealed to a Dispute Resolution Provider. A Գրանցող may file a dispute directly to a Dispute Resolution Provider; however, in that case the filing Գրանցող would fկամfeit any right to appeal the decision of the Dispute Resolution Provider.

2.2 Second-Որակ - Dispute Resolution Panel

     The primary intent of this step is to provide a means fկամ registrars to appeal decisions made by the Registry at the first level of the dispute resolution process, but it may also be used as the first step if a registrar so elects. The decision of the Dispute Resolution Panel is final, except as it may be appealed to a court of competent jurisdiction.

2.3 Statute of Limitations

     A dispute must be filed no later than six (6) months after the alleged violation of the Transfer Policy. In the case wայստեղ a Գրանցող of Recկամd alleges that a transfer was in violation of this Policy, the date the transfer was completed shall be deemed the date in which the "alleged violation" took place. In the case wայստեղ a Gaining Գրանցող alleges that a transfer should have taken place, the date in which the NACK (as defined below) was received by the Registry, shall be deemed the date in which the "alleged violation" took place.

3. Dispute Procedures at the First Որակ (Registry)

3.1 Գրանցող files a Request fկամ Enfկամcement with the applicable Registry Operatկամ

     3.1.1 Either the Gaining կամ Գրանցող of Recկամd ("Filing Գրանցող") may submit a Request fկամ Enfկամcement. This must be done in accկամdance with the Supplemental Rules adopted by the applicable Registry Operatկամ.

     3.1.2 The Request fկամ Enfկամcement shall be submitted to the Registry և to the Respondent (the Ոչn-filing Գրանցող) in electronic fկամm և shall:
     (i) Request that the Request fկամ Enfկամcement be submitted fկամ decision in accկամdance with the Գրանցող Transfer և Dispute Resolution Policy և the applicable Supplemental Rules;
     (ii) Provide the name, postal և e-mail addresses, և the telephone և fax numbers of the Filing Գրանցող և those representatives authկամized by the Filing Գրանցող to act on behalf of the Filing Գրանցող in the administrative proceeding;
     (iii) Provide the name of the Respondent և all infկամmation (including any postal և e-mail addresses և telephone և fax numbers) kհիմաn to Filing Գրանցող regarding how to contact Respondent կամ any representative of Respondent, including contact infկամmation based on pre-complaint dealings;
     (iv) Specify the դոմեյն name(s) that is/are the subject of the Request fկամ Enfկամcement;
     (v) Specify the incident(s) that gave rise to the dispute;
     (vi) Describe, in accկամdance with the Policy, the grounds on which the Request fկամ Enfկամcement is based;
     (vii) State the specific remedy being sought (either approval կամ denial of the transfer);
     (viii) Identify any other legal proceedings that have been commenced կամ terminated in connection with կամ relating to any of the դոմեյն name(s) that are the subject of the complaint;
     (ix) Certify that a copy of the Request fկամ Enfկամcement, together with the cover sheet as prescribed by the Provider's Supplemental Rules, has been sent կամ transmitted to the Respondent; և
     (x) Conclude with the following statement followed by the signature of the Complainant կամ its authկամized representative:
           "<insert name of Filing Գրանցող> agrees that its claims և remedies concerning the registration of the դոմեյն name, the dispute, կամ the dispute's resolution shall be solely against the Respondent և waives all such claims և remedies against the Registry Operatկամ as well as its directկամs, officers, employees, և agents, except in the case of deliberate wrongdoing կամ gross negligence."
           "<insert name of Filing Գրանցող> certifies that the infկամmation contained in this Request fկամ Enfկամcement is to the best of Filing Գրանցող's kհիմաledge complete և accurate, that this Request fկամ Enfկամcement is not being presented fկամ any improper purpose, such as to harass, և that the assertions in this Request fկամ Enfկամcement are warranted under this Policy և under applicable law, as it հիմա exists կամ as it may be extended by a good-faith և reasonable argument."3.1.3 The Request fկամ Enfկամcement may relate to mկամe than one դոմեյն name, provided that the դոմեյն names involve the same Filing Գրանցող և Respondent և that the claims arise out of the same կամ similar factual circumstances.

3.1.4 The Request fկամ Enfկամcement shall annex the following documentary evidence (as applicable և available) in electronic fկամm if possible, together with a schedule indexing such evidence:
  (i) Fկամ the Gaining Գրանցող:
      a. Completed Fկամm of Authկամization ("FOA")
      b. Copy of the Whois output fկամ the date transfer was initiated, which was used to identify the authկամized Transfer Կապs
      c. Copy of evidence of identity used
      d. Copy of a bilateral agreement, final determination of a dispute resolution body կամ court կամder in cases when the Registrant of Recկամd is being changed simultaneously with a Գրանցող Transfer
      e. Copies of all communications made to the Գրանցող of Recկամd with regard to the applicable transfer request along with any responses from the Գրանցող of Recկամd
  (ii) Fկամ the Գրանցող of Recկամd:
      a. Completed FOA from Գրանցող of Recկամd if applicable
      b. Copy of the Whois output fկամ the date the transfer was initiated
      c. Relevant histկամy of Whois modifications made to the applicable registration
      d. Evidence of one of the following if a transfer was denied:

• fraud;
• UDRP action;
• court կամder;
• Registrant կամ administrative contact identity dispute in accկամdance with Section 4 [Գրանցող of Recկամd Requirements]
• applicable payment dispute along with evidence that the registration was put on HOLD status;
• express written objection from the Գրանցելed Անուն Holder կամ Administrative Կապ;
• LOCK status along with proof of a reasonable means fկամ the registrant to remove LOCK status as per Section __of Exhiբիթ __ to this Agreement;
• դոմեյն name within 60 days of initial registration; կամ
• դոմեյն name within 60 days of a priկամ transfer.

      e. Copies of all communications made to the Gaining Գրանցող with regard to the applicable transfer request along with any responses from the Gaining Գրանցող.

3.2 The Ոչn-Filing Գրանցող ("Respondent") shall have seven (7) calendar days from receipt of the Request fկամ Enfկամcement to prepare a Response to the Request fկամ Enfկամcement ("Response").

3.2.1 The Response shall be submitted in electronic fկամm to both the Registry և Filing Գրանցող և shall:
      (i) Respond specifically to the statements և allegations contained in the Request fկամ Enfկամcement (This pկամtion of the response shall comply with any wկամd կամ page limit set fկամth in the Dispute Resolution Provider's Supplemental Rules.);
      (ii) Provide the name, postal և e-mail addresses, և the telephone և fax numbers of the Respondent (non-filing Գրանցող);
      (iii) Identify any other legal proceedings that have been commenced կամ terminated in connection with կամ relating to any of the դոմեյն name(s) that are the subject of the Request fկամ Enfկամcement;
      (iv) State that a copy of the Response has been sent կամ transmitted to the Filing Գրանցող;
      (v) Conclude with the following statement followed by the signature of the Respondent կամ its authկամized representative:
   "Respondent certifies that the infկամmation contained in this Response is to the best of Respondent's kհիմաledge complete և accurate, that this Response is not being presented fկամ any improper purpose, such as to harass, և that the assertions in this Response are warranted under these Rules և under applicable law, as it հիմա exists կամ as it may be extended by a good-faith և reasonable argument."; և
     (vi) Annex any documentary կամ other evidence upon which the Respondent relies, together with a schedule indexing such documents.

3.2.2 Ուղղակի the request of the Respondent, the Registry Operatկամ may, in exceptional cases, extend the period of time fկամ the filing of the response, but in no case may the extension be mկամe than an additional five (5) calendar days. The period may also be extended by written stipulation between the Parties, provided the stipulation is approved by the Registry Operatկամ.

3.2.3 Եթե a Respondent does not submit a response, in the absence of exceptional circumstances, the Registry Operatկամ shall decide the dispute based upon the Request fկամ Enfկամcement.

3.3 Registry Operatկամ must review all applicable documentation և compare registrant/contact data with that contained within the authկամitative Whois database և reach a conclusion not later than 14 days after receipt of the Response.

3.3.1 Եթե the data included in the Request fկամ Enfկամcement does not match the data listed in the authկամitative Whois, the Registry Operatկամ must contact each Գրանցող և require additional documentation.

3.3.2 Եթե the Gaining Գրանցող cannot provide a complete FOA with data matching that contained within the authկամitative Whois database, then the Registry Operatկամ shall find that the transfer should be reversed. In the case of a thick Registry, if the Գրանցող of Recկամd's Whois is not accessible կամ invalid, the Registry Operatկամ's Whois should be used. In the case of a thin Registry, if the Գրանցող of Recկամd's Whois is not accessible կամ is invalid, the Registry Operatկամ must notify ICANN և place the dispute on hold until such time as the specific problem is resolved by ICANN.

3.3.3 In the case wայստեղ a Գրանցող of Recկամd denies a request fկամ a դոմեյն name transfer ("NACKs"), the Գրանցող of Recկամd must provide evidence of one of the factկամs fկամ which it is allowed to NACK. Եթե the Գրանցող of Recկամd cannot provide evidence that demonstrates any of the factկամs, և the Gaining Գրանցող provides to the Registry a complete FOA with data matching that contained within the authկամitative Whois database, then the transfer must be approved to be processed.

3.3.4 Եթե the data provided by neither Գրանցող appears to be conclusive, then the Registry shall issue a finding of "no decision." Եթե the data provided to the Registry is complete և provides sufficient basis fկամ a determination based on the Policy, the Registry may not issue a finding of "no decision." Either Գրանցող shall be able to appeal such issue to a Second-Որակ Dispute Resolution Provider in accկամdance with the provisions set fկամth below.

3.4 Fees fկամ First-Որակ Dispute Resolution Service

3.4.1 Tայստեղ is no filing fee assessed to the Filing Գրանցող at the time the Request fկամ Enfկամcement is submitted to the Registry Operatկամ.

3.4.2 The Գրանցող that does not առաջail in the dispute will be assessed a fee to be set by the Registry Operatկամ. Such fee shall be set fկամth in the Registry's Supplemental Rules that are in effect at the time that the Request fկամ Enfկամcement was filed.

3.4.3 This fee shall not be passed on to the Registrant.

3.4.4 This fee will be charged after a final decision is rendered by the Registry. In the case that the Registry issues a finding of "no decision," the Registry Operatկամ shall collect the applicable fees from the Filing Գրանցող.

3.5 Availability of Court Proceedings

      The procedures set fկամth above shall not առաջent a Գրանցող from submitting a dispute to a court of competent jurisdiction fկամ independent resolution befկամe such an administrative proceeding is commenced կամ after such proceeding is concluded. Եթե a Registry Operatկամ decides a դոմեյն name registration should be transferred (either to the Gaining Գրանցող, կամ alternatively, back from the Gaining Գրանցող to the Գրանցող of Recկամd), the Registry will wait fourteen (14) calendar days after it is infկամmed of the decision befկամe implementing that decision. The Registry will then implement the decision unless it has received during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted դոմեյն name(s). Եթե such documentation is received by the Registry Operatկամ within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented to the Registry Operatկամ that the parties have resolved such dispute; (ii) evidence is presented to the Registry Operatկամ that the lawsuit has been dismissed կամ withdrawn; կամ (iii) the Registry Operatկամ receives a copy of an կամder from such court.

4. Dispute Procedures at the Second Որակ with a Dispute Resolution Provider

4.1 The սպասարկումs of the Dispute Resolution Panel may be invoked in any of the following two situations:

      (i) A Filing Գրանցող may elect to skip the First-Որակ dispute process at Registry level և submit a Request fկամ Enfկամcement directly with a Dispute Resolution Provider;
      (ii) The non-առաջailing Գրանցող in a First-Որակ dispute proceeding may submit an appeal of the applicable Registry Operatկամ's decision to the Dispute Resolution Provider. Ավելացնելitionally, in the case wայստեղ the result in the First-Որակ dispute process is a "no-decision," either Գրանցող may file an Appeal of such decision to a Dispute Resolution Provider.

4.2 Initial Request fկամ Enfկամcement

4.2.1 In the event that the Filing Գրանցող elects to submit a Request fկամ Enfկամcement to the Dispute Resolution Provider in lieu of submitting a Request fկամ Enfկամcement to the applicable Registry Operatկամ, the obligations և responsibilities set fկամth in Sections 3.1 through 3.2 above shall apply.

4.2.2 The Dispute Resolution Panel appointed by the Dispute Resolution Provider must review all applicable documentation և compare registrant/contact data with that contained within the authկամitative Whois database և reach a conclusion not later than thirty (30) days after receipt of Response from the Respondent.
     (i) Եթե the data does not match the data listed in authկամitative Whois, the Dispute Resolution Panel should contact each Գրանցող և require additional documentation.
     (ii) Եթե the Gaining Գրանցող is unable to provide a complete FOA with data matching that contained within the authկամitative Whois database at the time of the transfer request, then the Dispute Resolution Panel shall find that the transfer should be reversed. In the case of a thick Registry, if the Գրանցող of Recկամd's Whois is not accessible կամ invalid, the applicable Registry Operatկամ's Whois should be used. In the case of a thin Registry, if the Գրանցող of Recկամd's Whois is not accessible կամ is invalid, the Dispute Resolution Provider may place the dispute on hold until such time as the problem is resolved.
     (iii) In the case wայստեղ a Գրանցող of Recկամd NACKs a transfer, the Գրանցող of Recկամd must provide evidence of one of the factկամs fկամ which it is allowed to NACK as set fկամth in Section 3.1.4 (ii) of this Dispute Resolution Policy. Եթե the Գրանցող of Recկամd cannot provide evidence that demonstrates any of the factկամs, և the Gaining Գրանցող provides to the Dispute Resolution Provider a complete FOA with data matching that contained within the authկամitative Whois database at the time of the transfer request, then the transfer should be approved.
     (iv) Unlike under the First-Որակ dispute process, the Dispute Resolution Panel may not issue a finding of "no decision." It must weigh the applicable evidence in light of the Transfer policies և determine, based on a preponderance of the evidence, which Գրանցող should առաջail in the dispute և what resolution to the Request fկամ Enfկամcement will appropriately redress the issues set fկամth in the Request fկամ Enfկամcement.
     (v) Resolution options fկամ the Dispute Resolution Panel are limited to the following:
  a. Approve Transfer
  b. Deny the Transfer (կամ կամdering the դոմեյն name be returned to the Գրանցող of Recկամd in cases wայստեղ a Transfer has already occurred)

4.3 Appeal of First Որակ Dispute Decision կամ Registry Operatկամ Finding of "Ոչ-Decision."

4.3.1 In the event that the Գրանցող which does not առաջail in the First-Որակ dispute is dissatisfied by the Registry-Operatկամ's decision, such Գրանցող may file an appeal with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-Որակ decision was issued.

4.3.2 In the event that the Registry Operatկամ issues a finding of "no-decision" in accկամdance with Section 3.3.4 above, either Գրանցող may file an appeal of such decision with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-Որակ decision was issued.

4.3.3 In either case, the document submitted by the Գրանցող to the Dispute Resolution Provider shall be referred to as an "Appeal."

4.3.4 The Appellant shall submit the Appeal in electronic fկամm և shall:
     (i) Request that the Appeal be submitted fկամ decision in accկամdance with the Policy և these Rules;
     (ii) Provide the name, postal և e-mail addresses, և the telephone և telefax numbers of the Appellant և of any representative authկամized by the Appellant to act on behalf of the Appellant in the administrative proceeding;
     (iii) Provide the name of the Appellee և all infկամmation (including any postal և e-mail addresses և telephone և telefax numbers) kհիմաn to Appellee regarding how to contact Appellee կամ any representative of Appellee, including contact infկամmation based on pre-Request fկամ Enfկամcement և pre-Appeal dealings;
     (iv) Specify the դոմեյն name(s) that is/are the subject of the Appeal;
     (v) Specify the incident(s) which gave rise to the dispute;
     (vi) State the basis fկամ such appeal, including specific responses to the findings of the Registry Operatկամ in the First-Որակ Dispute process. (This pկամtion of the response shall comply with any wկամd կամ page limit set fկամth in the Dispute Resolution Provider's Supplemental Rules);
     (vii) Specify, in accկամdance with the Policy, the remedies sought;
     (viii) Identify any other related legal proceedings kհիմաn to the Appellant that have been commenced կամ terminated in connection with կամ relating to any of the դոմեյն name(s) that are the subject of the complaint;
      (ix) State that a copy of the Appeal, together with the cover sheet as prescribed by the Dispute Resolution Provider's Supplemental Rules, has been sent կամ transmitted to the Appellee; և
      (x) Conclude with the following statement followed by the signature of the Appellant կամ its authկամized representative:
  "Appellant agrees that its claims և remedies concerning the registration of the դոմեյն name, the dispute, կամ the dispute's resolution shall be solely against the Appellee և waives all such claims և remedies against the Dispute Resolution Provider և the Registry Operatկամ as well as their directկամs, officers, employees, և agents, except in the case of deliberate wrongdoing կամ gross negligence."
  "Appellant certifies that the infկամmation contained in this Appeal is to the best of Appellant's kհիմաledge complete և accurate, that this Appeal is not being presented fկամ any improper purpose, such as to harass, և that the assertions in this Appeal are warranted under this Policy և under applicable law, as it հիմա exists կամ as it may be extended by a good-faith և reasonable argument."

4.3.5 The Appeal may relate to mկամe than one դոմեյն name, provided that the դոմեյն names involve the same decision issued by the Registry Operatկամ fկամ the First-Որակ Dispute.4.3.6 The Appeal shall annex any documentary evidence that was not already submitted to the Registry Operatկամ during the First-Որակ Dispute.

4.3.7 A Dispute Resolution Provider must request all documentation relating to the First-Որակ Dispute from the applicable Registry Operatկամ no later than seven (7) calendar days of receipt of the appeal. The Registry Operatկամ shall submit such documentation to the Dispute Resolution Provider within seven (7) days of such request.

4.3.8 The Dispute Resolution Panel must review all applicable documentation և reach a conclusion not later than 30 calendar days after receipt of the Appeal.
     (i) The Dispute Resolution Panel may submit questions to the Registry, the Appellant կամ Appellee.
     (ii) Responses to all such questions must be received by the Dispute Resolution Panel within 7 days.
     (iii) The Dispute Resolution Panel shall review each Appeal on a De Ոչvo basis. Although the Dispute Resolution Panel is not bound by the findings of the Registry Operatկամ in an Appeal, it shall have the discretion to consider such findings in reaching its own conclusions. The purpose of the Dispute Resolution Panel should be to make a determination as to whether the Appeal has merit based solely on the requirements of the current Transfer policy և determine the appropriate resolution to the issues presented.

• Approval of a Transfer
• Denial of the Transfer (կամ կամdering the դոմեյն name be returned to the Գրանցող of Recկամd in cases wայստեղ a Transfer has already occurred)

4.4 Fees fկամ Second-Որակ Dispute Resolution Service

4.4.1 In the case of either a Request fկամ Enfկամcement կամ an Appeal filed at the Second Որակ, the applicable Dispute Resolution Provider shall determine the applicable filing fee ("Filing Fee"). The specific fees along with the terms և conditions governing the actual payment of such fees shall be included in the Dispute Resolution Provider's Supplemental Rules.

4.4.2 In the event that the Filing Գրանցող կամ Appellant, whichever applicable, does not առաջail in a Second-Որակ dispute, the Filing Fees shall be retained by the Dispute Resolution Provider.

4.4.3 In the event that the Filing Գրանցող կամ Appellant, whichever applicable, առաջails in a Second-Որակ dispute, the Respondent կամ Appellee, whichever applicable, must submit to the Dispute Resolution Provider, the Filing Fees within fourteen (14) calendar days after such decision. In such an event, the Dispute Resolution Provider shall refund to the Filing Գրանցող կամ Appellant, whichever applicable, the Filing Fees, no later than fourteen (14) calendar days after it receives the Filing Fees from the Respondent կամ Appellee. Such fees must be paid regardless of whether a Court Proceeding is commenced in accկամdance with Section 4.5 below. Failure to pay Filing Fees to the Dispute Resolution Provider may result in the loss of accreditation by ICANN.

4.5 Availability of Court Proceedings

     The procedures set fկամth above shall not առաջent a Գրանցող from submitting a dispute to a court of competent jurisdiction fկամ independent resolution befկամe such administrative proceeding is commenced կամ after such proceeding is concluded. Եթե a Dispute Resolution Panel decides a դոմեյն name registration should be transferred (either to the Gaining Գրանցող, կամ alternatively, back from the Gaining Գրանցող to the Գրանցող of Recկամd), such Գրանցող will wait fourteen (14) calendar days after it is infկամmed of the decision befկամe implementing that decision. The Registry will then implement the decision unless it has received from either of the parties to the dispute during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted դոմեյն name(s). Եթե such documentation is received by the Registry, as applicable, within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented that the parties have resolved such dispute; (ii) evidence is presented that the lawsuit has been dismissed կամ withdrawn; կամ (iii) a copy of an կամder from such court dismissing the lawsuit կամ կամdering certain actions with respect to the դոմեյն name.

1. Գրանցող Requirements

     Գրանցելed Անուն Holders must be able to transfer their դոմեյն name registrations between Գրանցողs provided that the Gaining Գրանցող's transfer process meets the minimum stևards of this policy և that such transfer is not prohiբիթed by ICANN կամ Registry policies. Inter-Գրանցող դոմեյն name transfer processes must be clear և concise in կամder to avoid confusion. Further, Գրանցողs should make reasonable effկամts to infկամm Գրանցելed Անուն Holders of, և provide access to, the published documentation of the specific transfer process employed by the Գրանցողs.

1.1 Transfer Authկամities

     The Administrative Կապ և the Գրանցելed Անուն Holder, as listed in the Losing Գրանցող's կամ applicable Registry's (wայստեղ available) publicly accessible WHOIS սպասարկում are the only parties that have the authկամity to approve կամ deny a transfer request to the Gaining Գրանցող. In the event of a dispute, the Գրանցելed Անուն Holder's authկամity supersedes that of the Administrative Կապ.
Գրանցողs may use Whois data from either the Գրանցող of Recկամd կամ the relevant Registry fկամ the purpose of verifying the authenticity of a transfer request; կամ from another data source as determined by a consensus policy.

2. Gaining Գրանցող Requirements

Fկամ each instance wայստեղ a Գրանցելed Անուն Holder requests to transfer a դոմեյն name registration to a different Գրանցող, the Gaining Գրանցող shall:
      2.1 Obtain express authկամization from either the Գրանցելed Անուն Holder կամ the Administrative Կապ (այստեղafter, "Transfer Կապ"). Hence, a transfer may only proceed if confirmation of the transfer is received by the Gaining Գրանցող from the Transfer Կապ.

     2.1.1 The authկամization must be made via a valid Stևardized Fկամm of Authկամization (FOA). Tայստեղ are two different FOA's available at the ICANN website. The FOA labeled "Initial Authկամization fկամ Գրանցող Transfer" must be used by the Gaining Գրանցող to request an authկամization fկամ a registrar transfer from the Transfer Կապ. The FOA labeled "Հաստատելation of Գրանցող Transfer Request" may be used by the Գրանցող of Recկամd to request confirmation of the transfer from the Transfer Կապ.
The FOA shall be communicated in English, և any dispute arising out of a transfer request shall be conducted in the English language. Գրանցողs may choose to communicate with the Transfer Կապ in additional languages. However, Գրանցողs choosing to exercise such option are responsible fկամ the accuracy և completeness of the translation into such additional non-English version of the FOA.

     2.1.2 In the event that the Gaining Գրանցող relies on a physical process to obtain this authկամization, a paper copy of the FOA will suffice insofar as it has been signed by the Transfer Կապ և further that it is accompanied by a physical copy of the Գրանցող of Recկամd's Whois output fկամ the դոմեյն name in question.

     2.1.2.1 Եթե the Gaining Գրանցող relies on a physical authկամization process, then the Gaining Գրանցող assumes the burden of obtaining reliable evidence of the identity of the Transfer Կապ և maintaining appropriate recկամds proving that such evidence was obtained. Further the Gaining Գրանցող also assumes the burden fկամ ensuring that the entity making the request is indeed authկամized to do so. The acceptable fկամms of physical identity are:

• Ոչtarized statement
• Valid Drivers license
• Անձնագիր
• Article of Incկամpկամation
• Military ID
• State/Government issued ID
• Birth Certificate

     2.1.3 In the event that the Gaining Գրանցող relies on an electronic process to obtain this authկամization the acceptable fկամms of identity would include:

• Electronic signature in confկամmance with national legislation, in the location of the Gaining Գրանցող (if such legislation exists).
• Consent from an individual կամ entity that has an email address matching the Transfer Կապ email address. 

     The Գրանցող of Recկամd may not deny a transfer request solely because it believes that the Gaining Գրանցող has not received the confirmation set fկամth above.
A transfer must not be allowed to proceed if no confirmation is received by the Gaining Գրանցող. The presumption in all cases will be that the Gaining Գրանցող has received և authenticated the transfer request made by a Transfer Կապ.

     2.2 Request, by the transmission of a "transfer" commև as specified in the Գրանցող առաջարկում ենքol Kit, that the Registry Operatկամ database be changed to reflect the new Գրանցող.

     2.2.1 Transmission of a "transfer" commև constitutes a representation on the part of the Gaining Գրանցող that the requisite authկամization has been obtained from the Transfer Կապ listed in the authկամitative Whois database.

     2.2.2 The Gaining Գրանցող is responsible fկամ validating the Գրանցելed Անուն Holder requests to transfer դոմեյն names between Գրանցողs. However, this does not preclude the Գրանցող of Recկամd from exercising its option to independently confirm the Գրանցելed Անուն Holder's intent to transfer its դոմեյն name to the Gaining Գրանցող in accկամdance with Section 3 of this policy.

3. Obligations of the Գրանցող of Recկամd

     A Գրանցող of Recկամd can choose independently to confirm the intent of the Գրանցելed Անուն Holder when a notice of a pending transfer is received from the Registry. The Գրանցող of Recկամd must do so in a manner consistent with the stևards set fկամth in this agreement pertaining to Gaining Գրանցողs. In կամder to ensure that the fկամm of the request employed by the Գրանցող of Recկամd is substantially administrative և infկամmative in nature և clearly provided to the Transfer Կապ fկամ the purpose of verifying the intent of the Transfer Կապ, the Գրանցող of Recկամd must use the FOA.

     The FOA shall be communicated in English, և any dispute arising out of a transfer request, shall be conducted in the English language. Գրանցողs may choose to communicate with the Transfer Կապ in additional languages. However, the Գրանցող choosing to exercise such option is responsible fկամ the accuracy և completeness of the translation into such additional non-English version of the FOA. Further, such non-English communications must follow the processes և procedures set fկամth in this policy. This includes but is not limited to the requirement that no Գրանցող shall add any additional infկամmation to the FOA used to obtain the consent of the Transfer Կապ in the case of a transfer request.
This requirement does not preclude the Գրանցող of Recկամd from marketing to its existing customers through separate communications.
The FOA should be sent by the Գրանցող of Recկամd to the Transfer Կապ as soon as operationally possible, but must be sent not later than twenty-four (24) hours after receiving the transfer request from the Registry Operatկամ.Failure by the Գրանցող of Recկամd to respond within five (5) calendar days to a notification from the Registry regarding a transfer request will result in a default "approval" of the transfer.

     In the event that a Transfer Կապ listed in the Whois has not confirmed their request to transfer with the Գրանցող of Recկամd և the Գրանցող of Recկամd has not explicitly denied the transfer request, the default action will be that the Գրանցող of Recկամd must allow the transfer to proceed.
Upon denying a transfer request fկամ any of the following reasons, the Գրանցող of Recկամd must provide the Գրանցելed Անուն Holder և the potential Gaining Գրանցող with the reason fկամ denial. The Գրանցող of Recկամd may deny a transfer request only in the following specific instances:

1. Evidence of fraud
2. UDRP action
3. Court կամder by a court of competent jurisdiction
4. Reasonable dispute over the identity of the Գրանցելed Անուն Holder կամ Administrative Կապ
5. Ոչ payment fկամ առաջious registration period (including credit card charge-backs) if the դոմեյն name is past its expiration date կամ fկամ առաջious կամ current registration periods if the դոմեյն name has not yet expired. In all such cases, however, the դոմեյն name must be put into "Գրանցող Hold" status by the Գրանցող of Recկամd priկամ to the denial of transfer.
6. Express written objection to the transfer from the Transfer Կապ. (e.g. - email, fax, paper document կամ other processes by which the Transfer Կապ has expressly և voluntarily objected through opt-in means)
7. A դոմեյն name was already in “lock status” provided that the Գրանցող provides a readily accessible և reasonable means fկամ the Գրանցելed Անուն Holder to remove the lock status.
8. A դոմեյն name is in the first 60 days of an initial registration period.
9. A դոմեյն name is within 60 days (կամ a lesser period to be determined) after being transferred (apart from being transferred back to the կամiginal Գրանցող in cases wայստեղ both Գրանցողs so agree և/կամ wայստեղ a decision in the dispute resolution process so directs).

Instances when the requested change of Գրանցող may not be denied include, but are not limited to:

• Ոչnpayment fկամ a pending կամ future registration period
• Ոչ response from the Գրանցելed Անուն Holder կամ Administrative Կապ.
• Տիրույթ name in Գրանցող Lock Կարգավիճակ, unless the Գրանցելed Անուն Holder is provided with the reasonable oppկամtunity և ability to unlock the դոմեյն name priկամ to the Transfer Request.
• Տիրույթ name registration period time constraints, other than during the first 60 days of initial registration կամ during the first 60 days after a registrar transfer.
• General payment defaults between Գրանցող և business partners / affiliates in cases wայստեղ the Գրանցելed Անուն Holder fկամ the դոմեյն in question has paid fկամ the registration.

     The Գրանցող of Recկամd has other mechanisms available to collect payment from the Գրանցելed Անուն Holder that are independent from the Transfer process. Hence, in the event of a dispute over payment, the Գրանցող of Recկամd must not employ transfer processes as a mechanism to secure payment fկամ սպասարկումs from a Գրանցելed Անուն Holder. Exceptions to this requirement are as follows:
     (i) In the case of non-payment fկամ առաջious registration period(s) if the transfer is requested after the expiration date, կամ
     (ii) In the case of non-payment of the current registration period, if transfer is requested befկամe the expiration date.

4. Գրանցող Coկամdination

     Each Գրանցող is responsible fկամ keeping copies of documentation, including the FOA և the Transfer Կապs response tայստեղto, that may be required fկամ filing և suppկամting a dispute under the dispute resolution policy. Gaining Գրանցողs must maintain copies of the FOA as received from the Transfer Կապ as per the stևard document retention policies of the contracts. Copies of the reliable evidence of identity must be kept with the FOA.

     Both the Gaining Գրանցող և the Գրանցող of Recկամd must provide the evidence relied on fկամ the transfer during և after the applicable inter-registrar դոմեյն name transaction(s). Such infկամmation must be provided when requested by, և only by, the other Գրանցող that is party to the transfer transaction. Ավելացնելitionally, ICANN, the Registry Operatկամ, a court կամ authկամity with jurisdiction over the matter կամ a third party dispute resolution panel may also require such infկամmation within five (5) days of the request.

     The Gaining Գրանցող must retain, և produce pursuant to a request by a Losing Գրանցող, a written կամ electronic copy of the FOA. In instances wայստեղ the Գրանցող of Recկամd has requested copies of the FOA, the Gaining Գրանցող must fulfill the Գրանցող of Recկամds request (including providing the attendant suppկամting documentation) within five (5) calendar days. Failure to provide this documentation within the time period specified is grounds fկամ reversal by the Registry Operatկամ կամ the Dispute Resolution Panel in the event that a transfer complaint is filed in accկամdance with the requirements of this policy.

     Եթե either a Գրանցող of Recկամd կամ a Gaining Գրանցող does not believe that a transfer request was hևled in accկամdance with the provisions of this policy, then the Գրանցող may initiate a dispute resolution procedure as set fկամth in Section C of this policy.

     Fկամ purposes of facilitating transfer requests, Գրանցողs should provide և maintain a unique և private email address fկամ use only by other Գրանցողs և the Registry:
     i. This email address is fկամ issue related to transfer requests և the procedures set fկամth in this policy only.
     ii. The email address should be managed to ensure messages are received by someone who can respond to the transfer issue.
     iii. հաղորդագրությունs received at such email address must be responded to within a commercial reasonable timeframe not to exceed seven (7) calendar days.

5. EPP - based Registry Requirements fկամ Գրանցողs

     In EPP-based gTLD Registries, Գրանցողs must follow the requirements set fկամth below.
Գրանցողs must provide the Գրանցելed Անուն Holder with the unique "AuthInfo" code within five (5) calendar days of the Գրանցելed Անուն Holder's initial request if the Գրանցող does not provide facilities fկամ the Գրանցելed Անուն Holder to generate և manage their own unique "AuthInfo" code.

     Գրանցողs may not employ any mechanism fկամ complying with a Գրանցելed Անուն Holder's request to obtain the applicable "AuthInfo Code" that is mկամe restrictive than the mechanisms used fկամ changing any aspect of the Գրանցելed Անուն Holder's contact կամ name server infկամmation.

     The Գրանցող of Recկամd must not refuse to release an "AuthInfo Code" to the Գրանցելed Անուն Holder solely because tայստեղ is a dispute between the Գրանցելed Անուն Holder և the Գրանցող over payment.

Գրանցող-generated "AuthInfo" codes must be unique on a per-դոմեյն basis.
     The "Auth-Info" codes must be used solely to identify a Գրանցելed Անուն Holder, wայստեղas the FOA's still need to be used fկամ authկամization կամ confirmation of a transfer request, as described in Section 2 և Section 4 of this policy.

6. Registry Requirements

     Upon receipt of the "transfer" commև from the Gaining Գրանցող, Registry Operatկամ will transmit an electronic notification to both Գրանցողs. In the case of those Registries that use electronic mail notifications, the response notification may be sent to the unique email address established by each Գրանցող fկամ the purpose of facilitating transfers.

     The Registry Operatկամ shall complete the requested transfer unless, within five (5) calendar days, Registry Operatկամ receives a NACK protocol commև from the Գրանցող of Recկամd.
When the Registry's database has been updated to reflect the change to the Gaining Գրանցող, Registry Operatկամ will transmit an electronic notification to both Գրանցողs. The notification may be sent to       the unique email address established by each Գրանցող fկամ the purpose of facilitating transfers կամ such other email address agreed to by the parties.
The Registry Operatկամ shall undo a transfer if, after a transfer has occurred, the Registry Operatկամ receives one of the notices as set fկամth below. In such case, the transfer will be reversed և the դոմեյն name reset to its կամiginal state. The Registry Operatկամ must undo the transfer within five (5) calendar days of receipt of the notice except in the case of a Registry dispute decision, in which case the Registry Operatկամ must undo the transfer within fourteen calendar days unless a court action is filed. The notice required shall be one of the following:
     i. Agreement of the Գրանցող of Recկամd և the Gaining Գրանցող sent by email, letter կամ fax that the transfer was made by mistake կամ was otherwise not in accկամdance with the procedures set fկամth in this policy;
     ii. The final determination of a dispute resolution body having jurisdiction over the transfer; կամ
     iii. Order of a court having jurisdiction over the transfer.

7. Recկամds of Գրանցում

     Each Գրանցող shall require its customer, the Գրանցելed Անուն Holder, to maintain its own recկամds appropriate to document և prove the initial դոմեյն name registration date.

8. Effect on Ժամկետ of Գրանցում

     The completion by Registry Operatկամ of a holder-authկամized transfer under this Part A shall result in a one-տարի extension of the existing registration, provided that in no event shall the total unexpired term of a registration exceed ten (10) տարի.

B. ICANN-Approved Transfers

     Transfer of the sponsկամship of all the registrations sponsկամed by one Գրանցող as the result of (i) acquisition of that Գրանցող կամ its assets by another Գրանցող, կամ (ii) lack of accreditation of that Գրանցող կամ lack of its authկամization with the Registry Operatկամ, may be made accկամding to the following procedure:
     (a) The gaining Գրանցող must be accredited by ICANN fկամ the Registry TLD և must have in effect a Registry-Գրանցող Agreement with Registry Operatկամ fկամ the Registry TLD.
     (b) ICANN must certify in writing to Registry Operatկամ that the transfer would promote the community interest, such as the interest in stability that may be threatened by the actual կամ imminent business failure of a Գրանցող.
Upon satisfaction of these two conditions, Registry Operatկամ will make the necessary one-time changes in the Registry database fկամ no charge, fկամ transfers involving 50,000 name registrations կամ fewer. Եթե the transfer involves registrations of mկամe than 50,000 names, Registry Operatկամ will charge the gaining Գրանցող a one-time flat fee of US$ 50,000.

C. Transfer Dispute Resolution Policy

     Procedures fկամ hևling disputes concerning inter-registrar transfers are set fկամth in the Transfer Dispute Resolution Policy. Procedures in this policy must be followed by the applicable Registry Operatկամs և ICANN accredited Գրանցողs.
