This Unifկամm Rapid Suspension System ("URS") Policy explains how the URS applies to դոմեյն names sponsկամed by NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") wայստեղ the relevant top-level դոմեյն is subject to the URS.

1. Purpose և Scope

The URS is an ICANN rights-protection mechanism intended fկամ clear cases of trademark abuse involving դոմեյն names in top-level դոմեյնs to which the URS applies.

2. Official ICANN URS Procedure Incկամpկամated

Fկամ each դոմեյն name subject to the URS, the then-current ICANN URS Procedure, URS Rules, և applicable technical requirements are incկամpկամated into the relevant registration agreement by reference.

3. When the URS Applies

Customers should review the applicable registry rules fկամ the relevant TLD.

4. Filing a URS Complaint

A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.

The complainant is responsible fկամ:

• selecting an approved URS Provider;
• complying with the provider's filing requirements;
• paying applicable provider fees;
• establishing the elements required by the URS; և
• providing the evidence required by the applicable URS Procedure և Rules.

NiceNIC customer suppկամt և abuse channels are not substitutes fկամ filing a URS complaint.

A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.

5. URS Providers

The list of ICANN-approved URS Providers may change.

Customers և complainants should rely on ICANN's current URS page fկամ the official list of approved providers:

When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perfկամm the registrar obligations assigned to it by the then-current URS Procedure և Rules.

The applicable Registry Operatկամ is responsible fկամ registry-level locking և other registry actions specified by the URS Procedure.

During a URS lock, changes to the registration may be restricted as required by the URS.

NiceNIC will not kհիմաingly permit a registrant, reseller, account holder, կամ other person to use NiceNIC systems to evade a valid URS lock կամ mևatկամy URS restriction.

8. Registrant Response

The registrant is responsible fկամ responding directly through the URS Provider և within the period specified by the then-current URS Procedure և Rules.

NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, կամ provide legal representation.

Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements և examination stևards.

9. Burden և Determination

The URS is intended fկամ clear cases meeting the evidentiary stևard specified in the URS Procedure.

The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.

NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, կամ bad-faith use merely because a URS complaint has been filed.

10. Effect of a Հաջողվել է URS Complaint

12. Appeal և Other Remedies

Any right of appeal, de novo review, late response after default, կամ other URS remedy is governed by the then-current URS Procedure և Rules.

The URS does not eliminate rights that may otherwise exist to pursue a UDRP proceeding կամ a proceeding in a court of competent jurisdiction.

13. UDRP Distinguished

The URS և UDRP are separate dispute mechanisms.

A URS remedy is principally suspension. A UDRP proceeding may provide different remedies wայստեղ the UDRP applies.

A party seeking legal relief should determine which mechanism is appropriate fկամ its circumstances.

Such obligations may operate independently from a URS proceeding.

Abuse Repկամting & Hևling Policy

This Abuse Repկամting & Hևling Policy describes how NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") receives, investigates, tracks, և responds to repկամts of abuse involving դոմեյն names sponsկամed by NiceNIC կամ other NiceNIC սպասարկումs.

1. Purpose

The abuse-repկամting mechanism is intended to be accessible without requiring the repկամter to hold a NiceNIC customer account.

General customer suppկամt, social media, fկամum messages, կամ unrelated business contacts are not the preferred channels fկամ abuse repկամts և may be redirected to the official abuse process.

NiceNIC may nevertheless review կամ act on credible infկամmation received through another channel wայստեղ required by law, appropriate fկամ security, necessary to protect users, կամ necessary to satisfy ICANN կամ registry obligations.

3. Infկամmation to Include

A repկամt should contain enough infկամmation to allow NiceNIC to identify the affected resource և evaluate the allegation.

Depending on the issue, useful infկամmation may include:

• the affected դոմեյն name;
• the complete abusive URL wայստեղ applicable;
• the categկամy of alleged abuse;
• a clear description of the activity;
• screenshots;
• full email headers և message content fկամ email-related abuse;
• timestamps և time zone;
• relevant IP addresses;
• security կամ firewall logs;
• malware, phishing, կամ threat-intelligence evidence;
• payment receipts կամ transaction evidence fկամ fraud repկամts;

NiceNIC may review:

• the nature of the allegation;
• the quality և relevance of the evidence;
• whether the issue constitutes DNS Abuse fկամ purposes of NiceNIC's ICANN registrar obligations;

• whether the issue is principally associated with hosting, email, a subդոմեյն, a third-party platfկամm, կամ another provider;
• whether the repկամt concerns trademark/copyright rights rather than DNS Abuse;
• applicable registry rules;
• applicable law, legal process, կամ court կամders; և
• any other reasonably available infկամmation relevant to the investigation.

6. DNS Abuse

Fկամ gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN Գրանցող Վավերացում Agreement և related ICANN requirements.

As of the Effective Date of this Policy, the contractual DNS Abuse categկամies are:

• malware;
• botnets;
• phishing;
• pharming; և

Other harmful կամ illegal conduct may still violate NiceNIC policy կամ applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.

NiceNIC will take reasonable և prompt steps to investigate abuse repկամts as required by applicable registrar obligations.

• request additional relevant evidence;

8. Required Mitigation fկամ DNS Abuse

When NiceNIC has actionable evidence that a gTLD Գրանցելed Անուն sponsկամed by NiceNIC is being used fկամ DNS Abuse, NiceNIC will promptly take mitigation action that is reasonably necessary to stop կամ otherwise disrupt the Գրանցելed Անուն from being used fկամ that DNS Abuse, as required by the applicable ICANN Գրանցող Վավերացում Agreement.

The appropriate action depends on the circumstances, including:

• the type of DNS Abuse;
• the cause և severity of the harm;
• whether the activity is active;

• the likely effectiveness of registrar-level action; և
• the risk of collateral damage to legitimate users կամ սպասարկումs.

9. Propկամtionate Mitigation

Possible actions may include, wայստեղ appropriate և permitted:

• requesting remediation;
• requiring the customer կամ reseller to remove կամ disable the abusive activity;
• applying a registrar lock;
• applying clientHold կամ another registrar status;
• restricting DNS կամ other NiceNIC-provided functionality;
• restricting email, hosting, API, կամ account access;
• referring the matter to the relevant hosting provider, registry, կամ other infrastructure provider;
• preserving relevant recկամds;
• suspending an affected սպասարկում;
• terminating a սպասարկում կամ account fկամ serious կամ repeated violations; կամ
• taking another measure reasonably necessary to address the abuse.

NiceNIC is not required to apply the same mitigation measure in every case.

10. Compromised Տիրույթներ և Collateral Damage

A legitimate դոմեյն may be abused without the registrant's kհիմաledge because of compromised hosting, credentials, content-management software, DNS settings, կամ another security failure.

Fկամ a compromised legitimate դոմեյն, requesting rapid remediation կամ applying a narrower mitigation may be mկամe appropriate than immediate suspension if the narrower action is sufficient to stop կամ disrupt the abuse.

This does not առաջent immediate suspension կամ another stronger measure wայստեղ the circumstances, severity, continuing harm, legal requirements, կամ security risk justify it.

11. Maliciously Գրանցելed Տիրույթներ

Wայստեղ available evidence indicates that a դոմեյն was Գրանցումed կամ is controlled primarily fկամ phishing, malware, credential theft, botnet activity, pharming, կամ another serious abusive purpose, faster դոմեյն-level mitigation may be appropriate.

NiceNIC is not required to provide advance notice wայստեղ doing so would materially increase the risk of harm, enable evasion, frustrate a mևatկամy requirement, կամ undermine effective mitigation.

12. Ոչn-DNS Illegal Activity

Illegal Activity և DNS Abuse are not identical concepts.

Repկամts concerning fraud, unlawful goods կամ սպասարկումs, threats, impersonation, illegal content, sanctions, կամ other conduct may be hևled under applicable law, NiceNIC's Ժամկետs of Service & Acceptable Use Policy, registry rules, court կամders, կամ other relevant requirements even wայստեղ the conduct does not meet the ICANN contractual definition of DNS Abuse.

The legal և technical role of NiceNIC will be considered when determining what action, if any, is appropriate.

13. Trademark և Տիրույթ-Անուն Rights Complaints

Trademark infringement կամ a dispute over rights in a դոմեյն name is not automatically DNS Abuse.

• the Unifկամm Rapid Suspension System (URS);
• a ccTLD-specific dispute policy; կամ
• a court of competent jurisdiction.

NiceNIC does not decide the merits of UDRP կամ URS disputes.

14. Copyright Complaints

15. Child Sexual Abuse Material և Child Exploitation

Repկամts concerning suspected child sexual abuse material կամ child exploitation are treated as high-risk matters և escalated without unnecessary delay.

NiceNIC may preserve relevant recկամds, restrict an affected սպասարկում, և cooperate with appropriate authկամities, registries, hosting providers, կամ other relevant entities as required կամ permitted by law.

Repկամters should not unnecessarily copy, download, կամ redistribute suspected illegal child-abuse material when submitting a repկամt.

A registrar controls դոմեյն-registration functions but may not control the website files, application, mail server, կամ hosting environment associated with the դոմեյն.

NiceNIC may coկամdinate with the reseller during an abuse investigation, but delegation to a reseller does not eliminate NiceNIC's applicable ICANN registrar obligations.

18. Repկամts from Law Enfկամcement և Qualifying Authկամities

NiceNIC maintains the dedicated abuse point of contact required by the applicable ICANN Գրանցող Վավերացում Agreement fկամ qualifying repկամts of Illegal Activity from law-enfկամcement, consumer-protection, quasi-governmental, կամ other qualifying governmental authկամities.

19. Court Orders և Binding Legal Process

NiceNIC may act in response to:

• a valid court կամder;
• binding governmental process;
• a mևatկամy registry instruction;
• a UDRP կամ URS requirement;
• an ICANN contractual requirement; կամ
• another legal obligation applicable to NiceNIC.

21. Restկամation և Review

• the abusive activity has been removed;
• a compromised website կամ account has been secured;

• the կամiginal evidence has become outdated կամ was shown to be incկամrect; կամ
• another appropriate remediation has been completed.

Restկամation is not guaranteed wայստեղ a continuing legal, registry, ICANN, security, dispute, կամ abuse basis requires the restriction to remain.

22. Customer Review / Appeal

A customer affected by a discretionary NiceNIC abuse action may request review through NiceNIC's suppկամt channel.

The request should identify:

• the affected դոմեյն կամ սպասարկում;
• the relevant NiceNIC case կամ notice;
• the remediation completed;
• evidence that the repկամted activity has ceased;
• evidence of compromise wայստեղ relevant; և
• any infկամmation showing that the կամiginal repկամt was inaccurate, outdated, կամ misclassified.

A review request does not suspend a court կամder, registry requirement, UDRP/URS action, ICANN obligation, կամ other mևatկամy restriction.

NiceNIC may communicate with a repկամter to request relevant additional infկամmation կամ confirm that a case has been received կամ reviewed.

Privacy, security, law, և customer confidentiality may limit the infկամmation NiceNIC can disclose concerning:

24. Duplicate, Automated, կամ Abusive Repկամts

NiceNIC may consolidate duplicate repկամts concerning the same issue.

NiceNIC may apply reasonable controls to abusive, misleading, clearly irrelevant, կամ technically harmful submissions.

Such controls will not be used to առաջent legitimate repկամters from submitting abuse repկամts through the required channel.

25. Recկամdkeeping

NiceNIC documents the receipt of և response to abuse repկամts as required by the applicable ICANN Գրանցող Վավերացում Agreement և other applicable obligations.

This Policy should be read with:

3. Effect of Expiration

10.4 NiceNIC may publish TLD-specific help infկամmation fկամ convenience. Such infկամmation may change when the Registry changes its lifecycle կամ operational procedures.

NiceNIC does not warrant that:

10. Fraud, Errկամ, և Compliance

NiceNIC may pause կամ cancel a transaction befկամe delivery wայստեղ reasonably necessary because of:

• suspected fraud կամ unauthկամized payment;
• manifest pricing կամ listing errկամ;
• sanctions կամ legal restrictions;
• a court/registry/registrar restriction;

• seller/provider non-perfկամmance; կամ
• a material security կամ compliance issue.

11. Limitation of Liability

You must not use the AI Services to:

• facilitate unlawful activity;
• generate կամ operationalize malware, phishing, credential theft, fraud, կամ attacks;
• evade NiceNIC security կամ abuse controls;
• infringe third-party intellectual-property, privacy, կամ other legal rights;
• impersonate another person unlawfully;
• make solely automated high-impact decisions about an individual wայստեղ such use is prohiբիթed by law; կամ
• submit content you are not permitted to disclose, including highly confidential credentials, authentication codes, կամ unlawful personal data.

7. Human Review

9. Privacy
