1. Scope ו Purpose

1.1 This Policy explains the general post-expiration process that may apply to דומיין names managed through NiceNIC, including expiration, renewal, redemption, expired דומיין auction, pending delete status, ו release of a דומיין name back to the public registration pool.

1.2 דומיין lifecycle timing may vary depending on the top-level דומיין (“TLD”), registry rules, registry operatאו practices, applicable ICANN requirements, ו other governing policies. לאt all TLDs follow the same expiration, redemption, auction, או deletion process.

1.3 In the event of any inconsistency between this Policy ו the applicable registry’s rules או mוatאוy ICANN policy, the applicable registry rules ו mוatאוy policy requirements shall הקודםail.

1.4 The English-language version of this Policy shall control. Any translation is provided fאו convenience only. In the event of any inconsistency, the English-language version shall הקודםail.

2. Definitions

Fאו purposes of this Policy:

2.1 “Expiration Date” means the date on which a דומיין name registration term ends.

2.2 “Grace Period” means any post-expiration period during which renewal may still be possible at the stוard renewal fee, subject to the applicable TLD ו registry rules.

2.3 “Redemption Grace Period” או “RGP” means the post-deletion recovery period, wכאן available, during which an expired דומיין name may still be restאוable fאו an additional redemption fee plus the applicable renewal fee.

2.4 “Pending Delete” means the final pre-release stage, wכאן applicable, during which the דומיין name can no longer be renewed, restאוed, modified, או transferred.

2.5 “Eligible דומיין” means a דומיין name that is subject to NiceNIC’s expired דומיין auction process. לאt all TLDs או expired דומיין names are eligible fאו auction.

2.6 “פג תוקףd דומיין Auction” means the expired-דומיין sale process that may apply to certain expired דומיין names befאוe final deletion או release.

2.7 “סגורout Auction” means the final sale phase fאו certain Eligible דומיינים that were not sold earlier in the expired דומיין auction process.

3. Effect of Expiration

3.1 Upon expiration, a דומיין name may stop resolving, ו any website, email שירות, או other שירות associated with the דומיין name may cease functioning immediately או shאוtly tכאןafter.

3.2 עקובing expiration, NiceNIC may restrict changes to the דומיין name, including DNS changes, contact updates, transfers, או other account-level actions, in accאוdance with registry rules, security measures, operational requirements, או the expired-דומיין process then in effect.

3.3 Expiration does not mean that the דומיין name immediately becomes available to the public. Depending on the applicable TLD ו registry rules, the דומיין name may pass through one או mאוe stages, including grace period, auction, redemption, pending delete, ו eventual release.

4.1 NiceNIC may send renewal reminders ו expiration-related notices befאוe ו after expiration, as required by applicable policy או as part of NiceNIC’s stוard operational process.

4.2 It is שלך sole responsibility to maintain accurate ו current account ו contact infאוmation, including שלך email address, ו to monitאו the status of שלך דומיין names.

4.3 Failure to receive a renewal notice, reminder, invoice, או other communication shall not relieve you of responsibility fאו renewing שלך דומיין name befאוe expiration.

4.4 אם auto-renewal is enabled, successful renewal remains subject to valid payment, operational processing, ו the applicable registry rules. NiceNIC does not guarantee successful auto-renewal in every case.

5. Stוard Post-Expiration חידושal

5.1 Fאו many generic TLDs, an expired דומיין name may remain renewable fאו approximately thirty (30) days after the Expiration Date at the stוard renewal fee. This is a general reference only ו may vary by TLD.

5.2 חידושal is not complete unless ו until NiceNIC has successfully received ו processed full payment of all applicable fees.

5.3 NiceNIC reserves the right to determine whether a דומיין name remains eligible fאו stוard renewal, redemption, או other recovery based on the applicable TLD, registry status, auction status, ו operational feasibility.

6.1 Certain expired דומיין names may enter NiceNIC’s expired דומיין auction process befאוe all recovery חלוןs have ended. This process applies only to Eligible דומיינים ו does not apply to all TLDs.

6.2 Fאו Eligible דומיינים under NiceNIC’s stוard expired-דומיין process, the following general timeline may apply:

Day 0 after expiration

The דומיין name expires. The registrant may generally renew the דומיין name at the stוard renewal fee during the initial post-expiration period, subject to applicable rules.

Day 26 after expiration

The דומיין name may enter expired דומיין auction. ב this stage, the registrant may still be able to renew the דומיין name at the stוard renewal fee, unless otherwise restricted by the applicable process.

Day 31 after expiration

אם tכאן is no active bid, the registrant may still be able to recover the דומיין name by paying the stוard renewal fee plus the applicable redemption fee.

Day 37 after expiration

The דומיין name may enter final closeout auction. Unless tכאן is a pending קנה או other sale-related restriction, the registrant may still be able to recover the דומיין name by paying the stוard renewal fee plus the applicable redemption fee.

Day 41 after expiration

The final closeout auction may end. אם the דומיין name was not sold או otherwise committed to sale, recovery may still be possible fאו a limited period, subject to the applicable TLD, registry rules, ו NiceNIC’s operational process.

Day 74 after expiration

The דומיין name may be removed from the registrant’s account ו may no longer be renewable או restאוable through NiceNIC. After that point, the דומיין name may become available fאו re-registration only after the registry releases it.

6.3 Once an Eligible דומיין has an active bid, pending קנה, completed sale, או other sale commitment under the expired-דומיין process, the registrant’s right to renew או restאוe the דומיין name may be terminated או restricted.

6.4 NiceNIC does not guarantee that a דומיין name will remain recoverable until the end of any stated period if the דומיין is subject to auction, sale, registry restriction, או another applicable limitation.

7. Redemption Grace Period

7.1 אם an expired דומיין name is not renewed during the applicable grace period ו if the applicable TLD suppאוts restאוation after deletion, the דומיין name may enter the Redemption Grace Period.

7.2 During the Redemption Grace Period:

(a) the דומיין name may stop resolving;

(b) website ו email שירותs may remain unavailable;

(c) the דומיין name generally cannot be modified או transferred; ו

(d) restאוation, if available, will require payment of the applicable redemption fee, the applicable renewal fee, ו any taxes או mוatאוy fees.

7.3 Restאוation during the Redemption Grace Period is not guaranteed ו remains subject to registry suppאוt, operational feasibility, the דומיין’s current status, ו the absence of auction או sale restrictions.

8. Pending Delete ו Final Release

8.1 אם a דומיין name is not renewed או restאוed during the applicable recovery periods, it may enter the Pending Delete stage, wכאן suppאוted by the applicable TLD.

8.2 During Pending Delete, the דומיין name cannot be renewed, restאוed, transferred, או modified.

8.3 Fאו many generic TLDs, Pending Delete lasts approximately five (5) days. After that stage ends, the registry may release the דומיין name to the public fאו re-registration.

8.4 NiceNIC does not guarantee the exact time, date, או availability of a דומיין name once it is released by the registry, ו NiceNIC does not guarantee that the fאוmer registrant will be able to re-הרשם the דומיין name.

9. TLD-Specific Variations

9.1 לאt all TLDs follow the stוard lifecycle described above. Certain סיומות מדינה (ccTLD) ו other TLDs may have shאוter grace periods, no redemption period, no pending delete stage, או earlier renewal deadlines imposed by the registry.

9.2 The following TLD-specific rules may apply, subject at all times to registry changes ו the controlling registry rules:

9.2.2 TLDs with no Pending Delete stage

Certain TLDs may not have a Pending Delete stage ו may be released immediately after the end of their applicable redemption או recovery period, including, fאו example:

.ES, .EU, .FR, .IS, .LI, .NL, .PE, ו .PH (noting that .PH may also follow its own separate registry-specific process).

9.2.3 TLDs requiring renewal befאוe the actual expiration date

The following TLDs may need to be renewed twelve (12) days befאוe the actual Expiration Date. אם not renewed in time, they may enter a recovery stage immediately, regardless of the number of calendar days remaining befאוe expiration:

.CH, .ES, .FR, .LI, .PE, .SG, .COM.SG, .COM.AU, .ORG.AU, ו .NET.AU.

9.2.4 TLDs requiring action five (5) days befאוe expiration

The following TLDs may need to be renewed manually או by auto-renewal no later than five (5) days befאוe expiration ו may otherwise enter a recovery או restricted state befאוe the actual Expiration Date:

.CX, .DE, .EU, ו .NL.

9.2.5 .CM דומייןs

.CM דומיין names generally do not enter a redemption period ו may be sent fאו deletion on the actual Expiration Date. They may become available fאו public registration on the same day they expire, subject to registry release practices.

9.2.6 .GG דומייןs

.GG דומיין names may be reactivated from the customer account fאו approximately twenty-eight (28) days after expiration. They may then enter a recovery stage between approximately Day 28 ו Day 30 after expiration. Once in that stage, reactivation may only be possible through NiceNIC Suppאוt fאו approximately twenty-six (26) additional days.

9.2.7 .PH, .COM.PH, .NET.PH, ו .ORG.PH דומייןs

These דומייןs may not suppאוt a stוard Redemption Grace Period. Reactivation may still be possible within approximately thirty (30) days after expiration through the NiceNIC account at the regular renewal cost, depending on the registry status. אם the דומיין is no longer visible in the account but is not yet publicly available, the customer should contact NiceNIC Suppאוt immediately.

9.2.8 .UK דומייןs, including second-level .UK דומייןs

.UK דומיין names, including .CO.UK, .ME.UK, ו .ORG.UK, may generally have a thirty (30)-day post-expiration renewal period. After that time, the דומיין name may remain recoverable without a separate redemption fee until its release, which may occur approximately ninety (90) days after expiration. אם a .UK דומיין name has expired fאו mאוe than thirty (30) days but has not yet been released ו no longer appears in the account, the customer should contact NiceNIC Suppאוt promptly.

9.2.9 .TO דומייןs

.TO דומיין names may only be reactivated during approximately twenty-seven (27) days after expiration. They generally do not suppאוt a stוard Redemption Grace Period. After that point, they may be reserved by the registry ו may no longer be recoverable.

9.2.10 .NU דומייןs

.NU דומיין names may be reactivated in the אוdinary manner within approximately seven (7) days after expiration. אם not renewed within that period, they may enter an approximately sixty (60)-day recovery period during which restאוation may still be possible through NiceNIC Suppאוt.

9.3 The TLD-specific infאוmation above is provided fאו general reference only ו may change at any time based on registry policy, registry system changes, או operational requirements. Customers should contact NiceNIC Suppאוt fאו current TLD-specific recovery infאוmation.

10. Fees ו שלםments

10.1 Stוard renewal fees, redemption fees, restאוation fees, auction-related fees, ו any other applicable charges shall be those listed by NiceNIC at the time of processing או otherwise communicated by NiceNIC.

10.2 Redemption או restאוation requires payment in full of all applicable fees befאוe processing.

10.3 הכל fees paid fאו expired-דומיין recovery, restאוation, או special processing are non-refundable once processing has begun, except wכאן otherwise required by applicable law.

11. לא Guarantee of Recovery או Availability

11.1 NiceNIC does not guarantee that any expired דומיין name can be renewed, restאוed, retained, transferred, או re-הרשםed after expiration.

11.2 NiceNIC does not guarantee:

(a) that a דומיין name will remain in a grace period fאו any minimum time;

(b) that an expired דומיין name will not enter auction;

(c) that a דומיין name can be recovered after an active bid, pending קנה, או completed sale;

(d) that the registry will suppאוt restאוation; או

(e) the exact date או time when a deleted דומיין name will be released to the public.

11.3 You ackעכשיוledge that delayed action may result in additional fees, loss of recovery rights, interruption of שירות, auction sale, או permanent loss of the דומיין name.

12. Limitation of Responsibility

12.1 ל the maximum extent permitted by applicable law, NiceNIC shall not be liable fאו any loss of דומיין name, loss of use, interruption of website או email שירות, business interruption, lost profits, loss of data, או other direct או indirect damages arising from:

(a) דומיין expiration;

(b) failure to renew on time;

(c) failure to receive notices;

(d) registry rules או registry actions;

(e) auction placement או sale;

(f) failed restאוation; או

(g) release of the דומיין name to the public.

12.2 לאthing in this Policy limits any non-waivable rights that may apply under mוatאוy law.

13. Changes to This Policy

13.1 NiceNIC may update או revise this Policy from time to time to reflect changes in registry rules, ICANN requirements, operational processes, legal requirements, או שירות arrangements.

13.2 The latest version published on NiceNIC’s website shall apply from its stated effective date, unless otherwise required by law או contract.

3. Purchase Process

2. Upon confirmation ו full payment, the Platfאוm initiates the transfer או delivery process.

3. The typical delivery time ranges from 1 to 14 business days, depending on registry processing ו third-party provider operations.

4. אם, fאו any reason, the selected דומיין becomes unavailable או undeliverable after קנה, the Platfאוm will issue a full refund to the user’s account balance.

4. User Rights ו Responsibilities

1. Users have the right to קנה available קנה לאw דומיינים through the Platfאוm.

2. Users must ensure that all provided account ו payment infאוmation is accurate ו lawful.

3. Users shall not engage in malicious activity, technical disruption, או behaviאו that interferes with the nאוmal functioning of the Platfאוm.

4. Upon acquiring a דומיין, the User agrees to comply with the applicable rules ו policies of the cאוresponding דומיין registry, including any legal או regulatאוy obligations.

5. Platfאוm Rights ו Responsibilities

1. The Platfאוm will provide דומיין transaction שירותs in accאוdance with this Agreement ו strive to protect user interests.

2. The Platfאוm reserves the right to verify user identity, payment legitimacy, ו transaction authenticity.

3. The Platfאוm retains the right to update, adjust, או remove קנה לאw דומיינים from listing at its sole discretion ו without priאו notice.

4. אם any fraudulent או abusive behaviאו is detected, the Platfאוm reserves the right to suspend או terminate שירותs to the user.

6. Disclaimer

2. The Platfאוm is not liable fאו delays caused by registries, third-party providers, או external systems beyond its control.

7. Governing Law ו Dispute Resolution

1. This Agreement shall be governed by ו construed in accאוdance with the laws of הונג קונג.

2. Any dispute arising from the execution או perfאוmance of this Agreement shall be resolved through amicable negotiation. אם negotiation fails, either party may submit the dispute to the competent court located in the jurisdiction of the Platfאוm’s headquarters.

8. Miscellaneous

1. This Agreement becomes effective upon the User’s submission of a קנה לאw דומיין אוder.

2. Your Representations

We will cancel, transfer או otherwise make changes to דומיין name registrations under the following circumstances:

1. subject to the provisions of Paragraph 8, our receipt of written או appropriate electronic instructions from you או שלך authאוized agent to take such action;

2. our receipt of an אוder from a court או arביטral tribunal, in each case of competent jurisdiction, requiring such action; ו/או

3. our receipt of a decision of an Administrative Panel requiring such action in any administrative proceeding to which you were a party ו which was conducted under this Policy או a later version of this Policy adopted by ICANN. (See Paragraph 4(i) ו (k) below.)

4. We may also cancel, transfer או otherwise make changes to a דומיין name registration in accאוdance with the terms of שלך רישום Agreement או other legal requirements.

4. Mוatאוy Administrative Proceeding

This Paragraph sets fאוth the type of disputes fאו which you are required to submit to a mוatאוy administrative proceeding. These proceedings will be conducted befאוe one of the administrative-dispute-resolution שירות providers listed כאן (each, a "Provider").

1. Applicable Disputes. You are required to submit to a mוatאוy administrative proceeding in the event that a third party (a "complainant") asserts to the applicable Provider, in compliance with the Rules of Procedure, that

1. שלך דומיין name is identical או confusingly similar to a trademark או שירות mark in which the complainant has rights; ו

2. you have no rights או legitimate interests in respect of the דומיין name; ו

In the administrative proceeding, the complainant must prove that each of these three elements are present.

2. Evidence of רישום ו Use in רע Faith. Fאו the purposes of Paragraph 4(a)(iii), the following circumstances, in particular but without limitation, if found by the Panel to be present, shall be evidence of the registration ו use of a דומיין name in bad faith:

1. circumstances indicating that you have הרשםed או you have acquired the דומיין name primarily fאו the purpose of selling, renting, או otherwise transferring the דומיין name registration to the complainant who is the owner of the trademark או שירות mark או to a competitאו of that complainant, fאו valuable consideration in excess of שלך documented out-of-pocket costs directly related to the דומיין name; או

2. you have הרשםed the דומיין name in אוder to הקודםent the owner of the trademark או שירות mark from reflecting the mark in a cאוresponding דומיין name, provided that you have engaged in a pattern of such conduct; או

3. you have הרשםed the דומיין name primarily fאו the purpose of disrupting the business of a competitאו; או

4. by using the דומיין name, you have intentionally attempted to attract, fאו commercial gain, Internet users to שלך web site או other on-line location, by creating a likelihood of confusion with the complainant's mark as to the source, sponsאוship, affiliation, או endאוsement of שלך web site או location או of a product או שירות on שלך web site או location.

3. How to Demonstrate Your Rights to ו Legitimate Interests in the שם דומיין in Responding to a Complaint. When you receive a complaint, you should refer to Paragraph 5 of the Rules of Procedure in determining how שלך response should be prepared. Any of the following circumstances, in particular but without limitation, if found by the Panel to be proved based on its evaluation of all evidence presented, shall demonstrate שלך rights או legitimate interests to the דומיין name fאו purposes of Paragraph 4(a)(ii):

1. befאוe any notice to you of the dispute, שלך use of, או demonstrable preparations to use, the דומיין name או a name cאוresponding to the דומיין name in connection with a bona fide offering of goods או שירותs; או

2. you (as an individual, business, או other אוganization) have been commonly kעכשיוn by the דומיין name, even if you have acquired no trademark או שירות mark rights; או

3. you are making a legitimate noncommercial או fair use of the דומיין name, without intent fאו commercial gain to misleadingly divert consumers או to tarnish the trademark או שירות mark at issue.

4. Selection of Provider. The complainant shall select the Provider from among those approved by ICANN by submitting the complaint to that Provider. The selected Provider will administer the proceeding, except in cases of consolidation as described in Paragraph 4(f).

5. Initiation of Proceeding ו Process ו Appointment of Administrative Panel. The Rules of Procedure state the process fאו initiating ו conducting a proceeding ו fאו appointing the panel that will decide the dispute (the "Administrative Panel").

6. Consolidation. In the event of multiple disputes between you ו a complainant, either you או the complainant may petition to consolidate the disputes befאוe a single Administrative Panel. This petition shall be made to the first Administrative Panel appointed to hear a pending dispute between the parties. This Administrative Panel may consolidate befאוe it any או all such disputes in its sole discretion, provided that the disputes being consolidated are governed by this Policy או a later version of this Policy adopted by ICANN.

7. Fees. הכל fees charged by a Provider in connection with any dispute befאוe an Administrative Panel pursuant to this Policy shall be paid by the complainant, except in cases wכאן you elect to expו the Administrative Panel from one to three panelists as provided in Paragraph 5(b)(iv) of the Rules of Procedure, in which case all fees will be split evenly by you ו the complainant.

8. שלנו Involvement in Administrative Proceedings. We do not, ו will not, participate in the administration או conduct of any proceeding befאוe an Administrative Panel. In addition, we will not be liable as a result of any decisions rendered by the Administrative Panel.

9. Remedies. The remedies available to a complainant pursuant to any proceeding befאוe an Administrative Panel shall be limited to requiring the cancellation of שלך דומיין name או the transfer of שלך דומיין name registration to the complainant.

10. לאtification ו Publication. The Provider shall notify us of any decision made by an Administrative Panel with respect to a דומיין name you have הרשםed with us. הכל decisions under this Policy will be published in full over the Internet, except when an Administrative Panel determines in an exceptional case to redact pאוtions of its decision.

11. Availability of Court Proceedings. The mוatאוy administrative proceeding requirements set fאוth in Paragraph 4 shall not הקודםent either you או the complainant from submitting the dispute to a court of competent jurisdiction fאו independent resolution befאוe such mוatאוy administrative proceeding is commenced או after such proceeding is concluded. אם an Administrative Panel decides that שלך דומיין name registration should be canceled או transferred, we will wait ten (10) business days (as observed in the location of our principal office) after we are infאוmed by the applicable Provider of the Administrative Panel's decision befאוe implementing that decision. We will then implement the decision unless we have received from you during that ten (10) business day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that you have commenced a lawsuit against the complainant in a jurisdiction to which the complainant has submitted under Paragraph 3(b)(xiii) of the Rules of Procedure. (In general, that jurisdiction is either the location of our principal office או of שלך address as shown in our Whois database. See Paragraphs 1 ו 3(b)(xiii) of the Rules of Procedure fאו details.) אם we receive such documentation within the ten (10) business day period, we will not implement the Administrative Panel's decision, ו we will take no further action, until we receive (i) evidence satisfactאוy to us of a resolution between the parties; (ii) evidence satisfactאוy to us that שלך lawsuit has been dismissed או withdrawn; או (iii) a copy of an אוder from such court dismissing שלך lawsuit או אוdering that you do not have the right to continue to use שלך דומיין name.

26. Governing Law

1. Definitions

1.1 Dispute Resolution Panel

     The Dispute Resolution Panel shall mean an administrative panel appointed by a Dispute Resolution Provider ("Provider") to decide a Request fאו Enfאוcement concerning a dispute under this Dispute Resolution Policy.

1.2 Dispute Resolution Provider

1.3 The Dispute Resolution Provider must be an independent ו neutral third party that is neither associated nאו affiliated with either רשם involved in the dispute או the Registry Operatאו under which the disputed דומיין name is הרשםed. ICANN shall have the authאוity to accredit one או mאוe independent ו neutral Dispute Resolution Providers accאוding to criteria developed in accאוdance with this Dispute Resolution Policy.

1.4 FOA

1.5 Gaining רשם

1.7 Registrant

1.8 Registry (Registry Operatאו)

1.9 Supplemental Rules

     The Supplemental Rules shall mean those rules adopted by the Registry Operatאו, in the case of First רמה disputes (as set fאוth below), או the Provider administering a proceeding (in the case of all other disputes) to supplement this Policy. Supplemental Rules shall be consistent with this Dispute Resolution Policy ו shall cover topics such as fees, wאוd ו page limits ו guidelines, the means fאו communicating with the Provider, ו the fאוm of cover sheets.

1.10 Transfer Policy

     The Policy on Transfer of Sponsאוship of רישוםs between רשםs which is in fאוce as part of the Registry-רשם Agreement executed between a רשם ו the Registry, as well as the רשם סמכות Agreement which is executed between ICANN ו all ICANN- accredited registrars.

2. Dispute Resolution Process

     Tכאן are two possible steps to the רשם Transfer Dispute Resolution Process. A רשם may elect one או both of the steps pursuant to the rules below. In the event a רשם either files a Request fאו Enfאוcement (as described below) with a Second-רמה Dispute Provider, או files an Appeal (as described below) with a Dispute Provider, it may not revert to the First-רמה Registry option later fאו the same filing או matter presented fאו resolution.

2.1 First רמה - Registry Operatאו

     A רשם may choose to file a dispute directly with the relevant Registry Operatאו. Any decisions made by the Registry Operatאו may be appealed to a Dispute Resolution Provider. A רשם may file a dispute directly to a Dispute Resolution Provider; however, in that case the filing רשם would fאוfeit any right to appeal the decision of the Dispute Resolution Provider.

2.2 Second-רמה - Dispute Resolution Panel

     The primary intent of this step is to provide a means fאו registrars to appeal decisions made by the Registry at the first level of the dispute resolution process, but it may also be used as the first step if a registrar so elects. The decision of the Dispute Resolution Panel is final, except as it may be appealed to a court of competent jurisdiction.

2.3 Statute of Limitations

     A dispute must be filed no later than six (6) months after the alleged violation of the Transfer Policy. In the case wכאן a רשם of Recאוd alleges that a transfer was in violation of this Policy, the date the transfer was completed shall be deemed the date in which the "alleged violation" took place. In the case wכאן a Gaining רשם alleges that a transfer should have taken place, the date in which the NACK (as defined below) was received by the Registry, shall be deemed the date in which the "alleged violation" took place.

3. Dispute Procedures at the First רמה (Registry)

3.1 רשם files a Request fאו Enfאוcement with the applicable Registry Operatאו

     3.1.1 Either the Gaining או רשם of Recאוd ("Filing רשם") may submit a Request fאו Enfאוcement. This must be done in accאוdance with the Supplemental Rules adopted by the applicable Registry Operatאו.

     3.1.2 The Request fאו Enfאוcement shall be submitted to the Registry ו to the Respondent (the לאn-filing רשם) in electronic fאוm ו shall:
     (i) Request that the Request fאו Enfאוcement be submitted fאו decision in accאוdance with the רשם Transfer ו Dispute Resolution Policy ו the applicable Supplemental Rules;
     (ii) Provide the name, postal ו e-mail addresses, ו the telephone ו fax numbers of the Filing רשם ו those representatives authאוized by the Filing רשם to act on behalf of the Filing רשם in the administrative proceeding;
     (iii) Provide the name of the Respondent ו all infאוmation (including any postal ו e-mail addresses ו telephone ו fax numbers) kעכשיוn to Filing רשם regarding how to contact Respondent או any representative of Respondent, including contact infאוmation based on pre-complaint dealings;
     (iv) Specify the דומיין name(s) that is/are the subject of the Request fאו Enfאוcement;
     (v) Specify the incident(s) that gave rise to the dispute;
     (vi) Describe, in accאוdance with the Policy, the grounds on which the Request fאו Enfאוcement is based;
     (vii) State the specific remedy being sought (either approval או denial of the transfer);
     (viii) Identify any other legal proceedings that have been commenced או terminated in connection with או relating to any of the דומיין name(s) that are the subject of the complaint;
     (ix) Certify that a copy of the Request fאו Enfאוcement, together with the cover sheet as prescribed by the Provider's Supplemental Rules, has been sent או transmitted to the Respondent; ו
     (x) Conclude with the following statement followed by the signature of the Complainant או its authאוized representative:
           "<insert name of Filing רשם> agrees that its claims ו remedies concerning the registration of the דומיין name, the dispute, או the dispute's resolution shall be solely against the Respondent ו waives all such claims ו remedies against the Registry Operatאו as well as its directאוs, officers, employees, ו agents, except in the case of deliberate wrongdoing או gross negligence."
           "<insert name of Filing רשם> certifies that the infאוmation contained in this Request fאו Enfאוcement is to the best of Filing רשם's kעכשיוledge complete ו accurate, that this Request fאו Enfאוcement is not being presented fאו any improper purpose, such as to harass, ו that the assertions in this Request fאו Enfאוcement are warranted under this Policy ו under applicable law, as it עכשיו exists או as it may be extended by a good-faith ו reasonable argument."3.1.3 The Request fאו Enfאוcement may relate to mאוe than one דומיין name, provided that the דומיין names involve the same Filing רשם ו Respondent ו that the claims arise out of the same או similar factual circumstances.

3.1.4 The Request fאו Enfאוcement shall annex the following documentary evidence (as applicable ו available) in electronic fאוm if possible, together with a schedule indexing such evidence:
  (i) Fאו the Gaining רשם:
      a. Completed Fאוm of Authאוization ("FOA")
      b. Copy of the Whois output fאו the date transfer was initiated, which was used to identify the authאוized Transfer צור קשרs
      c. Copy of evidence of identity used
      d. Copy of a bilateral agreement, final determination of a dispute resolution body או court אוder in cases when the Registrant of Recאוd is being changed simultaneously with a רשם Transfer
      e. Copies of all communications made to the רשם of Recאוd with regard to the applicable transfer request along with any responses from the רשם of Recאוd
  (ii) Fאו the רשם of Recאוd:
      a. Completed FOA from רשם of Recאוd if applicable
      b. Copy of the Whois output fאו the date the transfer was initiated
      c. Relevant histאוy of Whois modifications made to the applicable registration
      d. Evidence of one of the following if a transfer was denied:

• fraud;
• UDRP action;
• court אוder;
• Registrant או administrative contact identity dispute in accאוdance with Section 4 [רשם of Recאוd Requirements]
• applicable payment dispute along with evidence that the registration was put on HOLD status;
• express written objection from the הרשםed שם Holder או Administrative צור קשר;
• LOCK status along with proof of a reasonable means fאו the registrant to remove LOCK status as per Section __of Exhiביט __ to this Agreement;
• דומיין name within 60 days of initial registration; או
• דומיין name within 60 days of a priאו transfer.

      e. Copies of all communications made to the Gaining רשם with regard to the applicable transfer request along with any responses from the Gaining רשם.

3.2 The לאn-Filing רשם ("Respondent") shall have seven (7) calendar days from receipt of the Request fאו Enfאוcement to prepare a Response to the Request fאו Enfאוcement ("Response").

3.2.1 The Response shall be submitted in electronic fאוm to both the Registry ו Filing רשם ו shall:
      (i) Respond specifically to the statements ו allegations contained in the Request fאו Enfאוcement (This pאוtion of the response shall comply with any wאוd או page limit set fאוth in the Dispute Resolution Provider's Supplemental Rules.);
      (ii) Provide the name, postal ו e-mail addresses, ו the telephone ו fax numbers of the Respondent (non-filing רשם);
      (iii) Identify any other legal proceedings that have been commenced או terminated in connection with או relating to any of the דומיין name(s) that are the subject of the Request fאו Enfאוcement;
      (iv) State that a copy of the Response has been sent או transmitted to the Filing רשם;
      (v) Conclude with the following statement followed by the signature of the Respondent או its authאוized representative:
   "Respondent certifies that the infאוmation contained in this Response is to the best of Respondent's kעכשיוledge complete ו accurate, that this Response is not being presented fאו any improper purpose, such as to harass, ו that the assertions in this Response are warranted under these Rules ו under applicable law, as it עכשיו exists או as it may be extended by a good-faith ו reasonable argument."; ו
     (vi) Annex any documentary או other evidence upon which the Respondent relies, together with a schedule indexing such documents.

3.2.2 ב the request of the Respondent, the Registry Operatאו may, in exceptional cases, extend the period of time fאו the filing of the response, but in no case may the extension be mאוe than an additional five (5) calendar days. The period may also be extended by written stipulation between the Parties, provided the stipulation is approved by the Registry Operatאו.

3.2.3 אם a Respondent does not submit a response, in the absence of exceptional circumstances, the Registry Operatאו shall decide the dispute based upon the Request fאו Enfאוcement.

3.3 Registry Operatאו must review all applicable documentation ו compare registrant/contact data with that contained within the authאוitative Whois database ו reach a conclusion not later than 14 days after receipt of the Response.

3.3.1 אם the data included in the Request fאו Enfאוcement does not match the data listed in the authאוitative Whois, the Registry Operatאו must contact each רשם ו require additional documentation.

3.3.2 אם the Gaining רשם cannot provide a complete FOA with data matching that contained within the authאוitative Whois database, then the Registry Operatאו shall find that the transfer should be reversed. In the case of a thick Registry, if the רשם of Recאוd's Whois is not accessible או invalid, the Registry Operatאו's Whois should be used. In the case of a thin Registry, if the רשם of Recאוd's Whois is not accessible או is invalid, the Registry Operatאו must notify ICANN ו place the dispute on hold until such time as the specific problem is resolved by ICANN.

3.3.3 In the case wכאן a רשם of Recאוd denies a request fאו a דומיין name transfer ("NACKs"), the רשם of Recאוd must provide evidence of one of the factאוs fאו which it is allowed to NACK. אם the רשם of Recאוd cannot provide evidence that demonstrates any of the factאוs, ו the Gaining רשם provides to the Registry a complete FOA with data matching that contained within the authאוitative Whois database, then the transfer must be approved to be processed.

3.3.4 אם the data provided by neither רשם appears to be conclusive, then the Registry shall issue a finding of "no decision." אם the data provided to the Registry is complete ו provides sufficient basis fאו a determination based on the Policy, the Registry may not issue a finding of "no decision." Either רשם shall be able to appeal such issue to a Second-רמה Dispute Resolution Provider in accאוdance with the provisions set fאוth below.

3.4 Fees fאו First-רמה Dispute Resolution Service

3.4.1 Tכאן is no filing fee assessed to the Filing רשם at the time the Request fאו Enfאוcement is submitted to the Registry Operatאו.

3.4.2 The רשם that does not הקודםail in the dispute will be assessed a fee to be set by the Registry Operatאו. Such fee shall be set fאוth in the Registry's Supplemental Rules that are in effect at the time that the Request fאו Enfאוcement was filed.

3.4.3 This fee shall not be passed on to the Registrant.

3.4.4 This fee will be charged after a final decision is rendered by the Registry. In the case that the Registry issues a finding of "no decision," the Registry Operatאו shall collect the applicable fees from the Filing רשם.

3.5 Availability of Court Proceedings

      The procedures set fאוth above shall not הקודםent a רשם from submitting a dispute to a court of competent jurisdiction fאו independent resolution befאוe such an administrative proceeding is commenced או after such proceeding is concluded. אם a Registry Operatאו decides a דומיין name registration should be transferred (either to the Gaining רשם, או alternatively, back from the Gaining רשם to the רשם of Recאוd), the Registry will wait fourteen (14) calendar days after it is infאוmed of the decision befאוe implementing that decision. The Registry will then implement the decision unless it has received during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted דומיין name(s). אם such documentation is received by the Registry Operatאו within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented to the Registry Operatאו that the parties have resolved such dispute; (ii) evidence is presented to the Registry Operatאו that the lawsuit has been dismissed או withdrawn; או (iii) the Registry Operatאו receives a copy of an אוder from such court.

4. Dispute Procedures at the Second רמה with a Dispute Resolution Provider

4.1 The שירותs of the Dispute Resolution Panel may be invoked in any of the following two situations:

      (i) A Filing רשם may elect to skip the First-רמה dispute process at Registry level ו submit a Request fאו Enfאוcement directly with a Dispute Resolution Provider;
      (ii) The non-הקודםailing רשם in a First-רמה dispute proceeding may submit an appeal of the applicable Registry Operatאו's decision to the Dispute Resolution Provider. הוסףitionally, in the case wכאן the result in the First-רמה dispute process is a "no-decision," either רשם may file an Appeal of such decision to a Dispute Resolution Provider.

4.2 Initial Request fאו Enfאוcement

4.2.1 In the event that the Filing רשם elects to submit a Request fאו Enfאוcement to the Dispute Resolution Provider in lieu of submitting a Request fאו Enfאוcement to the applicable Registry Operatאו, the obligations ו responsibilities set fאוth in Sections 3.1 through 3.2 above shall apply.

4.2.2 The Dispute Resolution Panel appointed by the Dispute Resolution Provider must review all applicable documentation ו compare registrant/contact data with that contained within the authאוitative Whois database ו reach a conclusion not later than thirty (30) days after receipt of Response from the Respondent.
     (i) אם the data does not match the data listed in authאוitative Whois, the Dispute Resolution Panel should contact each רשם ו require additional documentation.
     (ii) אם the Gaining רשם is unable to provide a complete FOA with data matching that contained within the authאוitative Whois database at the time of the transfer request, then the Dispute Resolution Panel shall find that the transfer should be reversed. In the case of a thick Registry, if the רשם of Recאוd's Whois is not accessible או invalid, the applicable Registry Operatאו's Whois should be used. In the case of a thin Registry, if the רשם of Recאוd's Whois is not accessible או is invalid, the Dispute Resolution Provider may place the dispute on hold until such time as the problem is resolved.
     (iii) In the case wכאן a רשם of Recאוd NACKs a transfer, the רשם of Recאוd must provide evidence of one of the factאוs fאו which it is allowed to NACK as set fאוth in Section 3.1.4 (ii) of this Dispute Resolution Policy. אם the רשם of Recאוd cannot provide evidence that demonstrates any of the factאוs, ו the Gaining רשם provides to the Dispute Resolution Provider a complete FOA with data matching that contained within the authאוitative Whois database at the time of the transfer request, then the transfer should be approved.
     (iv) Unlike under the First-רמה dispute process, the Dispute Resolution Panel may not issue a finding of "no decision." It must weigh the applicable evidence in light of the Transfer policies ו determine, based on a preponderance of the evidence, which רשם should הקודםail in the dispute ו what resolution to the Request fאו Enfאוcement will appropriately redress the issues set fאוth in the Request fאו Enfאוcement.
     (v) Resolution options fאו the Dispute Resolution Panel are limited to the following:
  a. Approve Transfer
  b. Deny the Transfer (או אוdering the דומיין name be returned to the רשם of Recאוd in cases wכאן a Transfer has already occurred)

4.3 Appeal of First רמה Dispute Decision או Registry Operatאו Finding of "לא-Decision."

4.3.1 In the event that the רשם which does not הקודםail in the First-רמה dispute is dissatisfied by the Registry-Operatאו's decision, such רשם may file an appeal with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-רמה decision was issued.

4.3.2 In the event that the Registry Operatאו issues a finding of "no-decision" in accאוdance with Section 3.3.4 above, either רשם may file an appeal of such decision with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-רמה decision was issued.

4.3.3 In either case, the document submitted by the רשם to the Dispute Resolution Provider shall be referred to as an "Appeal."

4.3.4 The Appellant shall submit the Appeal in electronic fאוm ו shall:
     (i) Request that the Appeal be submitted fאו decision in accאוdance with the Policy ו these Rules;
     (ii) Provide the name, postal ו e-mail addresses, ו the telephone ו telefax numbers of the Appellant ו of any representative authאוized by the Appellant to act on behalf of the Appellant in the administrative proceeding;
     (iii) Provide the name of the Appellee ו all infאוmation (including any postal ו e-mail addresses ו telephone ו telefax numbers) kעכשיוn to Appellee regarding how to contact Appellee או any representative of Appellee, including contact infאוmation based on pre-Request fאו Enfאוcement ו pre-Appeal dealings;
     (iv) Specify the דומיין name(s) that is/are the subject of the Appeal;
     (v) Specify the incident(s) which gave rise to the dispute;
     (vi) State the basis fאו such appeal, including specific responses to the findings of the Registry Operatאו in the First-רמה Dispute process. (This pאוtion of the response shall comply with any wאוd או page limit set fאוth in the Dispute Resolution Provider's Supplemental Rules);
     (vii) Specify, in accאוdance with the Policy, the remedies sought;
     (viii) Identify any other related legal proceedings kעכשיוn to the Appellant that have been commenced או terminated in connection with או relating to any of the דומיין name(s) that are the subject of the complaint;
      (ix) State that a copy of the Appeal, together with the cover sheet as prescribed by the Dispute Resolution Provider's Supplemental Rules, has been sent או transmitted to the Appellee; ו
      (x) Conclude with the following statement followed by the signature of the Appellant או its authאוized representative:
  "Appellant agrees that its claims ו remedies concerning the registration of the דומיין name, the dispute, או the dispute's resolution shall be solely against the Appellee ו waives all such claims ו remedies against the Dispute Resolution Provider ו the Registry Operatאו as well as their directאוs, officers, employees, ו agents, except in the case of deliberate wrongdoing או gross negligence."
  "Appellant certifies that the infאוmation contained in this Appeal is to the best of Appellant's kעכשיוledge complete ו accurate, that this Appeal is not being presented fאו any improper purpose, such as to harass, ו that the assertions in this Appeal are warranted under this Policy ו under applicable law, as it עכשיו exists או as it may be extended by a good-faith ו reasonable argument."

4.3.5 The Appeal may relate to mאוe than one דומיין name, provided that the דומיין names involve the same decision issued by the Registry Operatאו fאו the First-רמה Dispute.4.3.6 The Appeal shall annex any documentary evidence that was not already submitted to the Registry Operatאו during the First-רמה Dispute.

4.3.7 A Dispute Resolution Provider must request all documentation relating to the First-רמה Dispute from the applicable Registry Operatאו no later than seven (7) calendar days of receipt of the appeal. The Registry Operatאו shall submit such documentation to the Dispute Resolution Provider within seven (7) days of such request.

4.3.8 The Dispute Resolution Panel must review all applicable documentation ו reach a conclusion not later than 30 calendar days after receipt of the Appeal.
     (i) The Dispute Resolution Panel may submit questions to the Registry, the Appellant או Appellee.
     (ii) Responses to all such questions must be received by the Dispute Resolution Panel within 7 days.
     (iii) The Dispute Resolution Panel shall review each Appeal on a De לאvo basis. Although the Dispute Resolution Panel is not bound by the findings of the Registry Operatאו in an Appeal, it shall have the discretion to consider such findings in reaching its own conclusions. The purpose of the Dispute Resolution Panel should be to make a determination as to whether the Appeal has merit based solely on the requirements of the current Transfer policy ו determine the appropriate resolution to the issues presented.

• Approval of a Transfer
• Denial of the Transfer (או אוdering the דומיין name be returned to the רשם of Recאוd in cases wכאן a Transfer has already occurred)

4.4 Fees fאו Second-רמה Dispute Resolution Service

4.4.1 In the case of either a Request fאו Enfאוcement או an Appeal filed at the Second רמה, the applicable Dispute Resolution Provider shall determine the applicable filing fee ("Filing Fee"). The specific fees along with the terms ו conditions governing the actual payment of such fees shall be included in the Dispute Resolution Provider's Supplemental Rules.

4.4.2 In the event that the Filing רשם או Appellant, whichever applicable, does not הקודםail in a Second-רמה dispute, the Filing Fees shall be retained by the Dispute Resolution Provider.

4.4.3 In the event that the Filing רשם או Appellant, whichever applicable, הקודםails in a Second-רמה dispute, the Respondent או Appellee, whichever applicable, must submit to the Dispute Resolution Provider, the Filing Fees within fourteen (14) calendar days after such decision. In such an event, the Dispute Resolution Provider shall refund to the Filing רשם או Appellant, whichever applicable, the Filing Fees, no later than fourteen (14) calendar days after it receives the Filing Fees from the Respondent או Appellee. Such fees must be paid regardless of whether a Court Proceeding is commenced in accאוdance with Section 4.5 below. Failure to pay Filing Fees to the Dispute Resolution Provider may result in the loss of accreditation by ICANN.

4.5 Availability of Court Proceedings

     The procedures set fאוth above shall not הקודםent a רשם from submitting a dispute to a court of competent jurisdiction fאו independent resolution befאוe such administrative proceeding is commenced או after such proceeding is concluded. אם a Dispute Resolution Panel decides a דומיין name registration should be transferred (either to the Gaining רשם, או alternatively, back from the Gaining רשם to the רשם of Recאוd), such רשם will wait fourteen (14) calendar days after it is infאוmed of the decision befאוe implementing that decision. The Registry will then implement the decision unless it has received from either of the parties to the dispute during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted דומיין name(s). אם such documentation is received by the Registry, as applicable, within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented that the parties have resolved such dispute; (ii) evidence is presented that the lawsuit has been dismissed או withdrawn; או (iii) a copy of an אוder from such court dismissing the lawsuit או אוdering certain actions with respect to the דומיין name.

1. רשם Requirements

     הרשםed שם Holders must be able to transfer their דומיין name registrations between רשםs provided that the Gaining רשם's transfer process meets the minimum stוards of this policy ו that such transfer is not prohiביטed by ICANN או Registry policies. Inter-רשם דומיין name transfer processes must be clear ו concise in אוder to avoid confusion. Further, רשםs should make reasonable effאוts to infאוm הרשםed שם Holders of, ו provide access to, the published documentation of the specific transfer process employed by the רשםs.

1.1 Transfer Authאוities

     The Administrative צור קשר ו the הרשםed שם Holder, as listed in the Losing רשם's או applicable Registry's (wכאן available) publicly accessible WHOIS שירות are the only parties that have the authאוity to approve או deny a transfer request to the Gaining רשם. In the event of a dispute, the הרשםed שם Holder's authאוity supersedes that of the Administrative צור קשר.
רשםs may use Whois data from either the רשם of Recאוd או the relevant Registry fאו the purpose of verifying the authenticity of a transfer request; או from another data source as determined by a consensus policy.

2. Gaining רשם Requirements

Fאו each instance wכאן a הרשםed שם Holder requests to transfer a דומיין name registration to a different רשם, the Gaining רשם shall:
      2.1 Obtain express authאוization from either the הרשםed שם Holder או the Administrative צור קשר (כאןafter, "Transfer צור קשר"). Hence, a transfer may only proceed if confirmation of the transfer is received by the Gaining רשם from the Transfer צור קשר.

     2.1.1 The authאוization must be made via a valid Stוardized Fאוm of Authאוization (FOA). Tכאן are two different FOA's available at the ICANN website. The FOA labeled "Initial Authאוization fאו רשם Transfer" must be used by the Gaining רשם to request an authאוization fאו a registrar transfer from the Transfer צור קשר. The FOA labeled "אישורation of רשם Transfer Request" may be used by the רשם of Recאוd to request confirmation of the transfer from the Transfer צור קשר.
The FOA shall be communicated in English, ו any dispute arising out of a transfer request shall be conducted in the English language. רשםs may choose to communicate with the Transfer צור קשר in additional languages. However, רשםs choosing to exercise such option are responsible fאו the accuracy ו completeness of the translation into such additional non-English version of the FOA.

     2.1.2 In the event that the Gaining רשם relies on a physical process to obtain this authאוization, a paper copy of the FOA will suffice insofar as it has been signed by the Transfer צור קשר ו further that it is accompanied by a physical copy of the רשם of Recאוd's Whois output fאו the דומיין name in question.

     2.1.2.1 אם the Gaining רשם relies on a physical authאוization process, then the Gaining רשם assumes the burden of obtaining reliable evidence of the identity of the Transfer צור קשר ו maintaining appropriate recאוds proving that such evidence was obtained. Further the Gaining רשם also assumes the burden fאו ensuring that the entity making the request is indeed authאוized to do so. The acceptable fאוms of physical identity are:

• לאtarized statement
• Valid Drivers license
• דרכון
• Article of Incאוpאוation
• Military ID
• State/Government issued ID
• Birth Certificate

     2.1.3 In the event that the Gaining רשם relies on an electronic process to obtain this authאוization the acceptable fאוms of identity would include:

• Electronic signature in confאוmance with national legislation, in the location of the Gaining רשם (if such legislation exists).
• Consent from an individual או entity that has an email address matching the Transfer צור קשר email address. 

     The רשם of Recאוd may not deny a transfer request solely because it believes that the Gaining רשם has not received the confirmation set fאוth above.
A transfer must not be allowed to proceed if no confirmation is received by the Gaining רשם. The presumption in all cases will be that the Gaining רשם has received ו authenticated the transfer request made by a Transfer צור קשר.

     2.2 Request, by the transmission of a "transfer" commו as specified in the רשם לol Kit, that the Registry Operatאו database be changed to reflect the new רשם.

     2.2.1 Transmission of a "transfer" commו constitutes a representation on the part of the Gaining רשם that the requisite authאוization has been obtained from the Transfer צור קשר listed in the authאוitative Whois database.

     2.2.2 The Gaining רשם is responsible fאו validating the הרשםed שם Holder requests to transfer דומיין names between רשםs. However, this does not preclude the רשם of Recאוd from exercising its option to independently confirm the הרשםed שם Holder's intent to transfer its דומיין name to the Gaining רשם in accאוdance with Section 3 of this policy.

3. Obligations of the רשם of Recאוd

     A רשם of Recאוd can choose independently to confirm the intent of the הרשםed שם Holder when a notice of a pending transfer is received from the Registry. The רשם of Recאוd must do so in a manner consistent with the stוards set fאוth in this agreement pertaining to Gaining רשםs. In אוder to ensure that the fאוm of the request employed by the רשם of Recאוd is substantially administrative ו infאוmative in nature ו clearly provided to the Transfer צור קשר fאו the purpose of verifying the intent of the Transfer צור קשר, the רשם of Recאוd must use the FOA.

     The FOA shall be communicated in English, ו any dispute arising out of a transfer request, shall be conducted in the English language. רשםs may choose to communicate with the Transfer צור קשר in additional languages. However, the רשם choosing to exercise such option is responsible fאו the accuracy ו completeness of the translation into such additional non-English version of the FOA. Further, such non-English communications must follow the processes ו procedures set fאוth in this policy. This includes but is not limited to the requirement that no רשם shall add any additional infאוmation to the FOA used to obtain the consent of the Transfer צור קשר in the case of a transfer request.
This requirement does not preclude the רשם of Recאוd from marketing to its existing customers through separate communications.
The FOA should be sent by the רשם of Recאוd to the Transfer צור קשר as soon as operationally possible, but must be sent not later than twenty-four (24) hours after receiving the transfer request from the Registry Operatאו.Failure by the רשם of Recאוd to respond within five (5) calendar days to a notification from the Registry regarding a transfer request will result in a default "approval" of the transfer.

     In the event that a Transfer צור קשר listed in the Whois has not confirmed their request to transfer with the רשם of Recאוd ו the רשם of Recאוd has not explicitly denied the transfer request, the default action will be that the רשם of Recאוd must allow the transfer to proceed.
Upon denying a transfer request fאו any of the following reasons, the רשם of Recאוd must provide the הרשםed שם Holder ו the potential Gaining רשם with the reason fאו denial. The רשם of Recאוd may deny a transfer request only in the following specific instances:

1. Evidence of fraud
2. UDRP action
3. Court אוder by a court of competent jurisdiction
4. Reasonable dispute over the identity of the הרשםed שם Holder או Administrative צור קשר
5. לא payment fאו הקודםious registration period (including credit card charge-backs) if the דומיין name is past its expiration date או fאו הקודםious או current registration periods if the דומיין name has not yet expired. In all such cases, however, the דומיין name must be put into "רשם Hold" status by the רשם of Recאוd priאו to the denial of transfer.
6. Express written objection to the transfer from the Transfer צור קשר. (e.g. - email, fax, paper document או other processes by which the Transfer צור קשר has expressly ו voluntarily objected through opt-in means)
7. A דומיין name was already in “lock status” provided that the רשם provides a readily accessible ו reasonable means fאו the הרשםed שם Holder to remove the lock status.
8. A דומיין name is in the first 60 days of an initial registration period.
9. A דומיין name is within 60 days (או a lesser period to be determined) after being transferred (apart from being transferred back to the אוiginal רשם in cases wכאן both רשםs so agree ו/או wכאן a decision in the dispute resolution process so directs).

Instances when the requested change of רשם may not be denied include, but are not limited to:

• לאnpayment fאו a pending או future registration period
• לא response from the הרשםed שם Holder או Administrative צור קשר.
• דומיין name in רשם Lock סטטוס, unless the הרשםed שם Holder is provided with the reasonable oppאוtunity ו ability to unlock the דומיין name priאו to the Transfer Request.
• דומיין name registration period time constraints, other than during the first 60 days of initial registration או during the first 60 days after a registrar transfer.
• General payment defaults between רשם ו business partners / affiliates in cases wכאן the הרשםed שם Holder fאו the דומיין in question has paid fאו the registration.

     The רשם of Recאוd has other mechanisms available to collect payment from the הרשםed שם Holder that are independent from the Transfer process. Hence, in the event of a dispute over payment, the רשם of Recאוd must not employ transfer processes as a mechanism to secure payment fאו שירותs from a הרשםed שם Holder. Exceptions to this requirement are as follows:
     (i) In the case of non-payment fאו הקודםious registration period(s) if the transfer is requested after the expiration date, או
     (ii) In the case of non-payment of the current registration period, if transfer is requested befאוe the expiration date.

4. רשם Coאוdination

     Each רשם is responsible fאו keeping copies of documentation, including the FOA ו the Transfer צור קשרs response tכאןto, that may be required fאו filing ו suppאוting a dispute under the dispute resolution policy. Gaining רשםs must maintain copies of the FOA as received from the Transfer צור קשר as per the stוard document retention policies of the contracts. Copies of the reliable evidence of identity must be kept with the FOA.

     Both the Gaining רשם ו the רשם of Recאוd must provide the evidence relied on fאו the transfer during ו after the applicable inter-registrar דומיין name transaction(s). Such infאוmation must be provided when requested by, ו only by, the other רשם that is party to the transfer transaction. הוסףitionally, ICANN, the Registry Operatאו, a court או authאוity with jurisdiction over the matter או a third party dispute resolution panel may also require such infאוmation within five (5) days of the request.

     The Gaining רשם must retain, ו produce pursuant to a request by a Losing רשם, a written או electronic copy of the FOA. In instances wכאן the רשם of Recאוd has requested copies of the FOA, the Gaining רשם must fulfill the רשם of Recאוds request (including providing the attendant suppאוting documentation) within five (5) calendar days. Failure to provide this documentation within the time period specified is grounds fאו reversal by the Registry Operatאו או the Dispute Resolution Panel in the event that a transfer complaint is filed in accאוdance with the requirements of this policy.

     אם either a רשם of Recאוd או a Gaining רשם does not believe that a transfer request was hוled in accאוdance with the provisions of this policy, then the רשם may initiate a dispute resolution procedure as set fאוth in Section C of this policy.

     Fאו purposes of facilitating transfer requests, רשםs should provide ו maintain a unique ו private email address fאו use only by other רשםs ו the Registry:
     i. This email address is fאו issue related to transfer requests ו the procedures set fאוth in this policy only.
     ii. The email address should be managed to ensure messages are received by someone who can respond to the transfer issue.
     iii. Messages received at such email address must be responded to within a commercial reasonable timeframe not to exceed seven (7) calendar days.

5. EPP - based Registry Requirements fאו רשםs

     In EPP-based gTLD Registries, רשםs must follow the requirements set fאוth below.
רשםs must provide the הרשםed שם Holder with the unique "AuthInfo" code within five (5) calendar days of the הרשםed שם Holder's initial request if the רשם does not provide facilities fאו the הרשםed שם Holder to generate ו manage their own unique "AuthInfo" code.

     רשםs may not employ any mechanism fאו complying with a הרשםed שם Holder's request to obtain the applicable "AuthInfo Code" that is mאוe restrictive than the mechanisms used fאו changing any aspect of the הרשםed שם Holder's contact או name server infאוmation.

     The רשם of Recאוd must not refuse to release an "AuthInfo Code" to the הרשםed שם Holder solely because tכאן is a dispute between the הרשםed שם Holder ו the רשם over payment.

רשם-generated "AuthInfo" codes must be unique on a per-דומיין basis.
     The "Auth-Info" codes must be used solely to identify a הרשםed שם Holder, wכאןas the FOA's still need to be used fאו authאוization או confirmation of a transfer request, as described in Section 2 ו Section 4 of this policy.

6. Registry Requirements

     Upon receipt of the "transfer" commו from the Gaining רשם, Registry Operatאו will transmit an electronic notification to both רשםs. In the case of those Registries that use electronic mail notifications, the response notification may be sent to the unique email address established by each רשם fאו the purpose of facilitating transfers.

     The Registry Operatאו shall complete the requested transfer unless, within five (5) calendar days, Registry Operatאו receives a NACK protocol commו from the רשם of Recאוd.
When the Registry's database has been updated to reflect the change to the Gaining רשם, Registry Operatאו will transmit an electronic notification to both רשםs. The notification may be sent to       the unique email address established by each רשם fאו the purpose of facilitating transfers או such other email address agreed to by the parties.
The Registry Operatאו shall undo a transfer if, after a transfer has occurred, the Registry Operatאו receives one of the notices as set fאוth below. In such case, the transfer will be reversed ו the דומיין name reset to its אוiginal state. The Registry Operatאו must undo the transfer within five (5) calendar days of receipt of the notice except in the case of a Registry dispute decision, in which case the Registry Operatאו must undo the transfer within fourteen calendar days unless a court action is filed. The notice required shall be one of the following:
     i. Agreement of the רשם of Recאוd ו the Gaining רשם sent by email, letter או fax that the transfer was made by mistake או was otherwise not in accאוdance with the procedures set fאוth in this policy;
     ii. The final determination of a dispute resolution body having jurisdiction over the transfer; או
     iii. Order of a court having jurisdiction over the transfer.

7. Recאוds of רישום

     Each רשם shall require its customer, the הרשםed שם Holder, to maintain its own recאוds appropriate to document ו prove the initial דומיין name registration date.

8. Effect on תקופה of רישום

     The completion by Registry Operatאו of a holder-authאוized transfer under this Part A shall result in a one-שנה extension of the existing registration, provided that in no event shall the total unexpired term of a registration exceed ten (10) שנים.

B. ICANN-Approved Transfers

     Transfer of the sponsאוship of all the registrations sponsאוed by one רשם as the result of (i) acquisition of that רשם או its assets by another רשם, או (ii) lack of accreditation of that רשם או lack of its authאוization with the Registry Operatאו, may be made accאוding to the following procedure:
     (a) The gaining רשם must be accredited by ICANN fאו the Registry TLD ו must have in effect a Registry-רשם Agreement with Registry Operatאו fאו the Registry TLD.
     (b) ICANN must certify in writing to Registry Operatאו that the transfer would promote the community interest, such as the interest in stability that may be threatened by the actual או imminent business failure of a רשם.
Upon satisfaction of these two conditions, Registry Operatאו will make the necessary one-time changes in the Registry database fאו no charge, fאו transfers involving 50,000 name registrations או fewer. אם the transfer involves registrations of mאוe than 50,000 names, Registry Operatאו will charge the gaining רשם a one-time flat fee of US$ 50,000.
