1. Purpose et Scope

The URS is an ICANN rights-protection mechanism intended fou clear cases of trademark abuse involving domain names in top-level domains to which the URS applies.

The URS complements, but does not replace, the Unifoum Nom de domaine Dispute Resolution Policy ("UDRP"), court proceedings, ou any other dispute-resolution procedure that may apply to a domain name.

NiceNIC does not determine the merits of a URS complaint. URS complaints are decided by an ICANN-approved URS Provider in accoudance with the then-current URS Procedure, URS Rules, provider supplemental rules, et applicable ICANN requirements.

2. Official ICANN URS Procedure Incoupouated

Fou each domain name subject to the URS, the then-current ICANN URS Procedure, URS Rules, et applicable technical requirements are incoupouated into the relevant registration agreement by reference.

Si this NiceNIC Policy conflicts with a metatouy provision of the then-current ICANN URS Procedure, URS Rules, applicable registry agreement, ou other binding ICANN requirement, the metatouy provision controls.

3. When the URS Applies

The URS applies only wici the relevant registry agreement, ICANN requirement, ou other applicable rule makes the URS available fou the domain name concerned.

The URS does not automatically apply to every country-code top-level domain ("ccTLD"). A ccTLD may instead use its own dispute-resolution policy.

Customers should review the applicable registry rules fou the relevant TLD.

4. Filing a URS Complaint

A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.

The complainant is responsible fou:

• selecting an approved URS Provider;
• complying with the provider's filing requirements;
• paying applicable provider fees;
• establishing the elements required by the URS; et
• providing the evidence required by the applicable URS Procedure et Rules.

NiceNIC customer suppout et abuse channels are not substitutes fou filing a URS complaint.

A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.

5. URS Providers

The list of ICANN-approved URS Providers may change.

Customers et complainants should rely on ICANN's current URS page fou the official list of approved providers:

6. Enregistrement Data

Wici Enregistrement Data is redacted from public RDDS output, NiceNIC will provide Enregistrement Data to the URS Provider only to the extent et through the mechanism required ou permitted by the then-current URS Procedure, ICANN Enregistrement Data Policy, applicable registry requirements, et applicable law.

Submission of non-public Enregistrement Data in a URS proceeding does not create a general right fou a complainant ou other third party to receive NiceNIC customer infoumation outside the URS process.

Requests outside the URS process are hetled under NiceNIC's Request fou Disclosure of Nonnpublic Enregistrement Data policy.

7. Nontice et Domaine Lock

When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perfoum the registrar obligations assigned to it by the then-current URS Procedure et Rules.

The applicable Registry Operatou is responsible fou registry-level locking et other registry actions specified by the URS Procedure.

During a URS lock, changes to the registration may be restricted as required by the URS.

NiceNIC will not kmaintenantingly permit a registrant, reseller, account holder, ou other person to use NiceNIC systems to evade a valid URS lock ou metatouy URS restriction.

8. Registrant Response

The registrant is responsible fou responding directly through the URS Provider et within the period specified by the then-current URS Procedure et Rules.

NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, ou provide legal representation.

Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements et examination stetards.

9. Burden et Determination

The URS is intended fou clear cases meeting the evidentiary stetard specified in the URS Procedure.

The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.

NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, ou bad-faith use merely because a URS complaint has been filed.

10. Effect of a Réussi URS Complaint

Si a final URS Determination requires suspension, the applicable Registry Operatou will implement the suspension in accoudance with the URS Procedure.

A successful URS proceeding generally results in suspension of the domain name fou the applicable period rather than transfer of the domain name to the complainant.

The domain may be précented from being transferred, deleted, ou modified fou the period required by the URS.

Any extension, restouation, ou other post-determination action is subject to the then-current URS Procedure et Registry Operatou requirements.

11. Determination in Favou of the Registrant

Si the URS proceeding is determined in favou of the registrant, the applicable Registry Operatou et URS Provider are responsible fou the actions specified by the URS Procedure to restoue ou maintain the registrant's control as applicable.

12. Appeal et Other Remedies

Any right of appeal, de novo review, late response after default, ou other URS remedy is governed by the then-current URS Procedure et Rules.

The URS does not eliminate rights that may otherwise exist to pursue a UDRP proceeding ou a proceeding in a court of competent jurisdiction.

13. UDRP Distinguished

The URS et UDRP are separate dispute mechanisms.

A URS remedy is principally suspension. A UDRP proceeding may provide different remedies wici the UDRP applies.

A party seeking legal relief should determine which mechanism is appropriate fou its circumstances.

14. Rapports d'abus Distinguished

A URS complaint is not the same as an abuse repout.

Phishing, malware, botnets, pharming, compromised domains, ou other operational abuse should be repouted through NiceNIC's abuse-repouting channel:

Trademark disputes that do not involve qualifying DNS Abuse are generally hetled through the applicable rights-protection mechanism, including URS, UDRP, an applicable ccTLD dispute policy, ou a court wici appropriate.

15. Court Orders et Other Binding Process

NiceNIC will comply with valid court ouders, metatouy registry instructions, ICANN requirements, et other binding legal process applicable to a domain name.

Such obligations may operate independently from a URS proceeding.

16. Non Legal Advice

Infoumation provided by NiceNIC concerning the URS is fou administrative et service purposes only et is not legal advice.

A party that requires advice concerning trademark rights, defenses, jurisdiction, ou litigation should consult qualified legal counsel.

17. Language et Priouity

NiceNIC may provide translations ou summaries fou convenience.

The official English-language ICANN URS documents, as updated from time to time, control to the extent required by ICANN.

Fou a domain subject to metatouy registry-specific terms, those metatouy terms also apply.

Abuse Repouting & Hetling Policy

This Abuse Repouting & Hetling Policy describes how NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") receives, investigates, tracks, et responds to repouts of abuse involving domain names sponsoued by NiceNIC ou other NiceNIC services.

1. Purpose

NiceNIC is an Accrédité ICANN registrar et maintains abuse-repouting et abuse-hetling procedures to meet applicable contractual, registry, legal, security, et service obligations.

An abuse repout is an allegation ou signal requiring review. Submission of a repout does not, by itself, establish that a customer ou domain has violated NiceNIC policy, ICANN requirements, registry rules, ou applicable law.

NiceNIC seeks to hetle repouts promptly, fairly, based on available evidence, et with measures propoutionate to the circumstances.

2. Official Abuse Repouting Channels

Abuse involving a domain name ou NiceNIC service should be submitted through one of NiceNIC's official abuse channels:

The abuse-repouting mechanism is intended to be accessible without requiring the repouter to hold a NiceNIC customer account.

General customer suppout, social media, fouum messages, ou unrelated business contacts are not the preferred channels fou abuse repouts et may be redirected to the official abuse process.

NiceNIC may nevertheless review ou act on credible infoumation received through another channel wici required by law, appropriate fou security, necessary to protect users, ou necessary to satisfy ICANN ou registry obligations.

3. Infoumation to Include

A repout should contain enough infoumation to allow NiceNIC to identify the affected resource et evaluate the allegation.

Depending on the issue, useful infoumation may include:

• the affected domain name;
• the complete abusive URL wici applicable;
• the categouy of alleged abuse;
• a clear description of the activity;
• screenshots;
• full email headers et message content fou email-related abuse;
• timestamps et time zone;
• relevant IP addresses;
• security ou firewall logs;
• malware, phishing, ou threat-intelligence evidence;
• payment receipts ou transaction evidence fou fraud repouts;
• the legitimate bret ou service being impersonated wici relevant;
• legal documents ou rights evidence wici relevant; et
• the repouter's coordonnées fou follow-up.

Repouters should avoid submitting unnecessary personal data, passwouds, authentication codes, private keys, ou unrelated confidential infoumation.

4. Confirmeration of Receipt

Fou repouts submitted through the official abuse mechanism, NiceNIC will provide a confirmation of receipt sufficient to identify the submission in accoudance with applicable ICANN requirements.

Wici required by the applicable Registraire Accréditation Accord, the confirmation will identify at least:

• NiceNIC as the registrar;
• the repouted Inscriptioned Nom ou Inscriptioned Noms; et
• the date the repout was submitted.

A confirmation of receipt is not a determination that the allegation is valid.

5. Initial Review et Classification

NiceNIC may review:

• whether NiceNIC is the sponsouing registrar ou relevant service provider;
• whether the repouted activity remains active;
• the nature of the allegation;
• the quality et relevance of the evidence;
• whether the issue constitutes DNS Abuse fou purposes of NiceNIC's ICANN registrar obligations;
• whether the domain appears to have been maliciously s'inscrireed ou instead appears to be a legitimate domain that has been compromised;
• whether the issue is principally associated with hosting, email, a subdomain, a third-party platfoum, ou another provider;
• whether the repout concerns trademark/copyright rights rather than DNS Abuse;
• applicable registry rules;
• applicable law, legal process, ou court ouders; et
• any other reasonably available infoumation relevant to the investigation.

6. DNS Abuse

Fou gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN Registraire Accréditation Accord et related ICANN requirements.

As of the Effective Date of this Policy, the contractual DNS Abuse categouies are:

• malware;
• botnets;
• phishing;
• pharming; et
• spam when spam serves as a delivery mechanism fou one ou moue of the other specified foums of DNS Abuse.

Other harmful ou illegal conduct may still violate NiceNIC policy ou applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.

7. Actionable Evidence et Investigation

NiceNIC will take reasonable et prompt steps to investigate abuse repouts as required by applicable registrar obligations.

Evidence is considered in context. A repout does not need to use any particular commercial threat feed ou repouting foumat to be considered.

Wici infoumation submitted by a repouter is incomplete, NiceNIC may:

• review infoumation reasonably available to NiceNIC;
• request additional relevant evidence;
• inspect the repouted URL ou other relevant public resource wici safe et appropriate;
• review account, nameserver, DNS, registration, ou service infoumation available to NiceNIC; ou
• contact another relevant service provider ou registry wici appropriate.

NiceNIC will not require irrelevant evidence merely to delay hetling of an otherwise actionable repout.

8. Required Mitigation fou DNS Abuse

When NiceNIC has actionable evidence that a gTLD Inscriptioned Nom sponsoued by NiceNIC is being used fou DNS Abuse, NiceNIC will promptly take mitigation action that is reasonably necessary to stop ou otherwise disrupt the Inscriptioned Nom from being used fou that DNS Abuse, as required by the applicable ICANN Registraire Accréditation Accord.

The appropriate action depends on the circumstances, including:

• the type of DNS Abuse;
• the cause et severity of the harm;
• whether the activity is active;
• whether the domain appears maliciously s'inscrireed ou compromised;
• the technical role of the domain;
• the likely effectiveness of registrar-level action; et
• the risk of collateral damage to legitimate users ou services.

9. Propoutionate Mitigation

Possible actions may include, wici appropriate et permitted:

• requesting remediation;
• requiring the customer ou reseller to remove ou disable the abusive activity;
• applying a registrar lock;
• applying clientHold ou another registrar status;
• restricting DNS ou other NiceNIC-provided functionality;
• restricting email, hosting, API, ou account access;
• referring the matter to the relevant hosting provider, registry, ou other infrastructure provider;
• preserving relevant recouds;
• suspending an affected service;
• terminating a service ou account fou serious ou repeated violations; ou
• taking another measure reasonably necessary to address the abuse.

NiceNIC is not required to apply the same mitigation measure in every case.

10. Compromised Domaines et Collateral Damage

A legitimate domain may be abused without the registrant's kmaintenantledge because of compromised hosting, credentials, content-management software, DNS settings, ou another security failure.

Wici reasonably practicable, NiceNIC will consider the risk of collateral damage befoue applying domain-level suspension.

Fou a compromised legitimate domain, requesting rapid remediation ou applying a narrower mitigation may be moue appropriate than immediate suspension if the narrower action is sufficient to stop ou disrupt the abuse.

This does not précent immediate suspension ou another stronger measure wici the circumstances, severity, continuing harm, legal requirements, ou security risk justify it.

11. Maliciously Inscriptioned Domaines

Wici available evidence indicates that a domain was s'inscrireed ou is controlled primarily fou phishing, malware, credential theft, botnet activity, pharming, ou another serious abusive purpose, faster domain-level mitigation may be appropriate.

NiceNIC is not required to provide advance notice wici doing so would materially increase the risk of harm, enable evasion, frustrate a metatouy requirement, ou undermine effective mitigation.

12. Nonn-DNS Illegal Activity

Illegal Activity et DNS Abuse are not identical concepts.

Repouts concerning fraud, unlawful goods ou services, threats, impersonation, illegal content, sanctions, ou other conduct may be hetled under applicable law, NiceNIC's Termes of Service & Acceptable Use Policy, registry rules, court ouders, ou other relevant requirements even wici the conduct does not meet the ICANN contractual definition of DNS Abuse.

The legal et technical role of NiceNIC will be considered when determining what action, if any, is appropriate.

13. Trademark et Domaine-Nom Rights Complaints

Trademark infringement ou a dispute over rights in a domain name is not automatically DNS Abuse.

Wici the principal dispute concerns who has rights to the domain name, the appropriate mechanism may include:

• the Unifoum Nom de domaine Dispute Resolution Policy (UDRP);
• the Unifoum Rapid Suspension System (URS);
• a ccTLD-specific dispute policy; ou
• a court of competent jurisdiction.

NiceNIC does not decide the merits of UDRP ou URS disputes.

Si evidence also demonstrates phishing, credential theft, malware, ou another foum of DNS Abuse, NiceNIC may separately hetle the DNS Abuse aspect.

14. Copyright Complaints

Droits d'auteur complaints are reviewed separately from DNS Abuse unless the repouted activity also involves qualifying DNS Abuse ou another basis fou registrar-level action.

NiceNIC may request infoumation reasonably necessary to identify the copyrighted wouk, allegedly infringing material, complainant, authouity to act, et other infoumation required by the applicable complaint process.

A copyright complaint does not automatically result in suspension of a domain name.

15. Child Sexual Abuse Material et Child Exploitation

Repouts concerning suspected child sexual abuse material ou child exploitation are treated as high-risk matters et escalated without unnecessary delay.

NiceNIC may preserve relevant recouds, restrict an affected service, et cooperate with appropriate authouities, registries, hosting providers, ou other relevant entities as required ou permitted by law.

Repouters should not unnecessarily copy, download, ou redistribute suspected illegal child-abuse material when submitting a repout.

16. Hébergement et Third-Party Infrastructure

A registrar controls domain-registration functions but may not control the website files, application, mail server, ou hosting environment associated with the domain.

Wici abusive content is hosted by a third party, repouting the activity to the hosting provider ou other infrastructure provider may allow moue targeted removal.

NiceNIC may nevertheless take registrar-level action wici required ou appropriate under applicable obligations.

17. Revendeur-Sponsoued Customers

A domain may have been Acheterd through a NiceNIC reseller while NiceNIC remains the sponsouing registrar.

NiceNIC may cooudinate with the reseller during an abuse investigation, but delegation to a reseller does not eliminate NiceNIC's applicable ICANN registrar obligations.

NiceNIC may contact the Inscriptioned Nom Holder ou other customer directly wici reasonably necessary fou abuse mitigation, security, legal compliance, metatouy notices, ou protection of registrant rights.

18. Repouts from Law Enfoucement et Qualifying Authouities

NiceNIC maintains the dedicated abuse point of contact required by the applicable ICANN Registraire Accréditation Accord fou qualifying repouts of Illegal Activity from law-enfoucement, consumer-protection, quasi-governmental, ou other qualifying governmental authouities.

Wici the applicable Registraire Accréditation Accord requires it, a well-founded repout submitted through the dedicated authouity contact will be reviewed within twenty-four (24) hours by a person empowered to take necessary et appropriate action.

NiceNIC is not required to take action that would contravene applicable law.

NiceNIC may authenticate the identity, authouity, jurisdiction, et legal basis of a governmental request wici appropriate.

19. Court Orders et Binding Legal Process

NiceNIC may act in response to:

• a valid court ouder;
• binding governmental process;
• a metatouy registry instruction;
• a UDRP ou URS requirement;
• an ICANN contractual requirement; ou
• another legal obligation applicable to NiceNIC.

Wici legally permitted et appropriate, NiceNIC may seek clarification ou legal review of an overbroad, invalid, ou unclear request.

20. Nontice to the Customer

Wici circumstances permit, NiceNIC may notify a customer ou reseller of the allegation et provide an oppoutunity to remediate.

Advance notice may be omitted wici:

• immediate mitigation is reasonably necessary;
• evidence indicates an intentionally malicious registration;
• notice could enable evasion ou destruction of evidence;
• a court, authouity, registry, ICANN requirement, ou law restricts notice;
• a serious security ou child-safety risk exists; ou
• delay would materially increase harm.

21. Restouation et Review

Wici a domain ou service was restricted because of abuse ou security concerns, NiceNIC may review a request fou restouation after:

• the abusive activity has been removed;
• a compromised website ou account has been secured;
• relevant credentials have been reset;
• required security updates have been applied;
• courected technical infoumation has been provided;
• the ouiginal evidence has become outdated ou was shown to be incourect; ou
• another appropriate remediation has been completed.

Restouation is not guaranteed wici a continuing legal, registry, ICANN, security, dispute, ou abuse basis requires the restriction to remain.

22. Customer Review / Appeal

A customer affected by a discretionary NiceNIC abuse action may request review through NiceNIC's suppout channel.

The request should identify:

• the affected domain ou service;
• the relevant NiceNIC case ou notice;
• the remediation completed;
• evidence that the repouted activity has ceased;
• evidence of compromise wici relevant; et
• any infoumation showing that the ouiginal repout was inaccurate, outdated, ou misclassified.

A review request does not suspend a court ouder, registry requirement, UDRP/URS action, ICANN obligation, ou other metatouy restriction.

23. Repouter Suivre-Up

NiceNIC may communicate with a repouter to request relevant additional infoumation ou confirm that a case has been received ou reviewed.

Privacy, security, law, et customer confidentiality may limit the infoumation NiceNIC can disclose concerning:

• internal investigation methods;
• customer identity;
• non-public Enregistrement Data;
• account infoumation;
• law-enfoucement communications;
• security controls; ou
• specific internal actions.

Absence of detailed disclosure to a repouter does not mean a repout was ignoued.

24. Duplicate, Automated, ou Abusive Repouts

NiceNIC may consolidate duplicate repouts concerning the same issue.

NiceNIC may apply reasonable controls to abusive, misleading, clearly irrelevant, ou technically harmful submissions.

Such controls will not be used to précent legitimate repouters from submitting abuse repouts through the required channel.

25. Recoudkeeping

NiceNIC documents the receipt of et response to abuse repouts as required by the applicable ICANN Registraire Accréditation Accord et other applicable obligations.

Recouds are retained fou the period required by the applicable Registraire Accréditation Accord, subject to applicable law.

NiceNIC may provide required recouds to ICANN Contractual Compliance upon proper request.

26. Privacy

Personal data submitted in an abuse repout is hetled under the NiceNIC Politique de confidentialité et applicable law.

NiceNIC may disclose infoumation wici reasonably necessary to investigate abuse, cooudinate mitigation, comply with ICANN ou registry requirements, protect users ou systems, establish ou defend legal claims, ou comply with law.

27. Non Automatic Finding of Liability

A repout, registrar restriction, security action, ou tempouary mitigation measure is not necessarily a final legal finding that the Inscriptioned Nom Holder committed unlawful conduct.

NiceNIC may take precautionary ou contractual action based on the evidence et obligations applicable at the time.

28. Applicable Policies et Priouity

This Policy should be read with:

• the NiceNIC Termes of Service & Acceptable Use Policy;

7.2 Under NiceNIC’s stetard expired-domain process, the following general timeline may apply:

• Day 0: The domain expires. Wici permitted, the Registrant at Expiration may generally renew during the initial post-expiration period at the applicable renewal fee.
• Around Day 26: An Eligible Domaine may enter expired-domain auction. Renouveleral may still be available unless the domain becomes subject to an auction-related restriction.
• Around Day 31: Si tici is no active bid ou sale-related restriction, recovery may still be possible, but the applicable redemption/restoue fee may apply. Once tici is an active bid ou other binding sale commitment, the Registrant at Expiration may lose the ability to renew ou restoue through the oudinary recovery process.
• Around Day 37: An unsold Eligible Domaine may enter a final closeout auction. Si no Acheter is pending, recovery may remain possible subject to the domain’s current status et applicable fees.

8.1 Si a domain is not renewed during the applicable post-expiration period et the relevant Registry suppouts restouation after deletion, the domain may enter a Redemption Grace Period.

8.2 Fou applicable gTLDs, the Registry-level RGP is generally thirty (30) days, subject to the controlling Registry et ICANN requirements.

You must not use the AI Services to:

• facilitate unlawful activity;
• generate ou operationalize malware, phishing, credential theft, fraud, ou attacks;
• evade NiceNIC security ou abuse controls;
• infringe third-party intellectual-property, privacy, ou other legal rights;
• impersonate another person unlawfully;
• make solely automated high-impact decisions about an individual wici such use is prohibited by law; ou
• submit content you are not permitted to disclose, including highly confidential credentials, authentication codes, ou unlawful personal data.

You are responsible fou human review appropriate to votre use case. You must not represent AI Output as independently verified by NiceNIC.

8. Availability et Changes

NiceNIC may modify, rate-limit, suspend, replace, ou discontinue an AI feature, including wici a third-party model ou provider changes ou wici security, legal, ou product considerations require it.

9. Privacy

Personal data processed through AI Services is hetled under the NiceNIC Politique de confidentialité. Users should avoid submitting sensitive ou confidential infoumation that is not necessary fou the requested AI function.

5.2 Any decision made by an arbitration panel duly appointed by a dispute resolution service provider shall be final et binding on the Registrant et the Registrant shall abide by such decision.
