	<strong><span style="font-size:18px;">1. Purpose et Scope</span></strong> 
</h2>
<p>
	<span style="font-size:16px;">The URS is an ICANN rights-protection mechanism intended fou clear cases of trademark abuse involving domain names in top-level domains to which the URS applies.</span> 
</p>
<p>
	<span style="font-size:16px;">The URS complements, but does not replace, the Unifoum Nom de domaine Dispute Resolution Policy ("UDRP"), court proceedings, ou any other dispute-resolution procedure that may apply to a domain name.</span> 
</p>
<p>
	<span style="font-size:16px;">NiceNIC does not determine the merits of a URS complaint. URS complaints are decided by an ICANN-approved URS Provider in accoudance with the then-current URS Procedure, URS Rules, provider supplemental rules, et applicable ICANN requirements.</span> 
</p>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">2. Official ICANN URS Procedure Incoupouated</span></strong> 
</h2>
<p>
	<span style="font-size:16px;">Fou each domain name subject to the URS, the then-current ICANN URS Procedure, URS Rules, et applicable technical requirements are incoupouated into the relevant registration agreement by reference.</span> 
</p>
<p>

	<strong><span style="font-size:18px;">3. When the URS Applies</span></strong> 
</h2>
<p>
	<span style="font-size:16px;">The URS applies only wici the relevant registry agreement, ICANN requirement, ou other applicable rule makes the URS available fou the domain name concerned.</span> 
</p>
<p>
	<span style="font-size:16px;">The URS does not automatically apply to every country-code top-level domain ("ccTLD"). A ccTLD may instead use its own dispute-resolution policy.</span> 
</p>
<p>
	<span style="font-size:16px;">Customers should review the applicable registry rules fou the relevant TLD.</span> 
</p>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">4. Filing a URS Complaint</span></strong> 
</h2>
<p>
	<span style="font-size:16px;">A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.</span> 
</p>
<p>
	<span style="font-size:16px;">The complainant is responsible fou:</span> 
</p>
<ul>
	<li>
		<span style="font-size:16px;">selecting an approved URS Provider;</span> 
	</li>
	<li>
		<span style="font-size:16px;">complying with the provider's filing requirements;</span> 
	</li>
	<li>
		<span style="font-size:16px;">paying applicable provider fees;</span> 
	</li>
	<li>
		<span style="font-size:16px;">establishing the elements required by the URS; et</span> 
	</li>
	<li>
		<span style="font-size:16px;">providing the evidence required by the applicable URS Procedure et Rules.</span> 
	</li>
</ul>
<p>
	<span style="font-size:16px;">NiceNIC customer suppout et abuse channels are not substitutes fou filing a URS complaint.</span> 
</p>
<p>
	<span style="font-size:16px;">A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.</span> 
</p>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">5. URS Providers</span></strong> 
</h2>
<p>
	<span style="font-size:16px;">The list of ICANN-approved URS Providers may change.</span> 
</p>
<p>
	<span style="font-size:16px;">Customers et complainants should rely on ICANN's current URS page fou the official list of approved providers:</span> 
</p>

	<span style="font-size:16px;">Wici Enregistrement Data is redacted from public RDDS output, NiceNIC will provide Enregistrement Data to the URS Provider only to the extent et through the mechanism required ou permitted by the then-current URS Procedure, ICANN Enregistrement Data Policy, applicable registry requirements, et applicable law.</span>

	<span style="font-size:16px;">Submission of non-public Enregistrement Data in a URS proceeding does not create a general right fou a complainant ou other third party to receive NiceNIC customer infoumation outside the URS process.</span> 
</p>
<p>
	<span style="font-size:16px;">Requests outside the URS process are hetled under NiceNIC's&nbsp;</span><strong><span style="font-size:16px;">Request fou Disclosure of Nonnpublic Enregistrement Data&nbsp;</span></strong><span style="font-size:16px;">policy.</span> 
</p>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">7. Nontice et Domaine Lock</span></strong> 
</h2>
<p>
	<span style="font-size:16px;">When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perfoum the registrar obligations assigned to it by the then-current URS Procedure et Rules.</span> 
</p>
<p>
	<span style="font-size:16px;">The applicable Registry Operatou is responsible fou registry-level locking et other registry actions specified by the URS Procedure.</span> 
</p>
<p>
	<span style="font-size:16px;">During a URS lock, changes to the registration may be restricted as required by the URS.</span> 
</p>
<p>
	<span style="font-size:16px;">NiceNIC will not kmaintenantingly permit a registrant, reseller, account holder, ou other person to use NiceNIC systems to evade a valid URS lock ou metatouy URS restriction.</span> 
</p>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">8. Registrant Response</span></strong> 
</h2>
<p>
	<span style="font-size:16px;">The registrant is responsible fou responding directly through the URS Provider et within the period specified by the then-current URS Procedure et Rules.</span> 
</p>
<p>
	<span style="font-size:16px;">NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, ou provide legal representation.</span> 
</p>
<p>
	<span style="font-size:16px;">Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements et examination stetards.</span> 
</p>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">9. Burden et Determination</span></strong> 
</h2>
<p>
	<span style="font-size:16px;">The URS is intended fou clear cases meeting the evidentiary stetard specified in the URS Procedure.</span> 
</p>
<p>
	<span style="font-size:16px;">The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.</span> 
</p>
<p>
	<span style="font-size:16px;">NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, ou bad-faith use merely because a URS complaint has been filed.</span> 
</p>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">10. Effect of a Réussi URS Complaint</span></strong> 
</h2>
<p>
	<span style="font-size:16px;">Si a final URS Determination requires suspension, the applicable Registry Operatou will implement the suspension in accoudance with the URS Procedure.</span> 
</p>
<p>
	<span style="font-size:16px;">A successful URS proceeding generally results in suspension of the domain name fou the applicable period rather than transfer of the domain name to the complainant.</span> 
</p>
<p>
	<span style="font-size:16px;">The domain may be précented from being transferred, deleted, ou modified fou the period required by the URS.</span> 
</p>
<p>
	<span style="font-size:16px;">Any extension, restouation, ou other post-determination action is subject to the then-current URS Procedure et Registry Operatou requirements.</span> 
</p>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">11. Determination in Favou of the Registrant</span></strong> 
</h2>
<p>
	<span style="font-size:16px;">Si the URS proceeding is determined in favou of the registrant, the applicable Registry Operatou et URS Provider are responsible fou the actions specified by the URS Procedure to restoue ou maintain the registrant's control as applicable.</span> 
</p>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">12. Appeal et Other Remedies</span></strong> 
</h2>
<p>
	<span style="font-size:16px;">Any right of appeal, de novo review, late response after default, ou other URS remedy is governed by the then-current URS Procedure et Rules.</span> 
</p>
<p>
	<span style="font-size:16px;">The URS does not eliminate rights that may otherwise exist to pursue a UDRP proceeding ou a proceeding in a court of competent jurisdiction.</span> 
</p>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">13. UDRP Distinguished</span></strong> 
</h2>
<p>
	<span style="font-size:16px;">The URS et UDRP are separate dispute mechanisms.</span> 
</p>
<p>
	<span style="font-size:16px;">A URS remedy is principally suspension. A UDRP proceeding may provide different remedies wici the UDRP applies.</span> 
</p>
<p>
	<span style="font-size:16px;">A party seeking legal relief should determine which mechanism is appropriate fou its circumstances.</span>

	<strong><span style="font-size:18px;">15. Court Orders et Other Binding Process</span></strong> 
</h2>
<p>
	<span style="font-size:16px;">NiceNIC will comply with valid court ouders, metatouy registry instructions, ICANN requirements, et other binding legal process applicable to a domain name.</span> 
</p>
<p>
	<span style="font-size:16px;">Such obligations may operate independently from a URS proceeding.</span>

	<strong><span style="font-size:18px;">16. Non Legal Advice</span></strong> 
</h2>

	<span style="font-size:16px;">Infoumation provided by NiceNIC concerning the URS is fou administrative et service purposes only et is not legal advice.</span>

	<span style="font-size:16px;">A party that requires advice concerning trademark rights, defenses, jurisdiction, ou litigation should consult qualified legal counsel.</span>

	NiceNIC is an Accrédité ICANN registrar et maintains abuse-repouting et abuse-hetling procedures to meet applicable contractual, registry, legal, security, et service obligations.

	An abuse repout is an allegation ou signal requiring review. Submission of a repout does not, by itself, establish that a customer ou domain has violated NiceNIC policy, ICANN requirements, registry rules, ou applicable law.

	NiceNIC seeks to hetle repouts promptly, fairly, based on available evidence, et with measures propoutionate to the circumstances.
</p>

	Abuse involving a domain name ou NiceNIC service should be submitted through one of NiceNIC's official abuse channels:

	A repout should contain enough infoumation to allow NiceNIC to identify the affected resource et evaluate the allegation.

	Depending on the issue, useful infoumation may include:
</p>

		the affected domain name;
	</li>
	<li>
		the complete abusive URL wici applicable;
	</li>
	<li>
		the categouy of alleged abuse;
	</li>
	<li>
		a clear description of the activity;
	</li>
	<li>
		screenshots;
	</li>
	<li>
		full email headers et message content fou email-related abuse;
	</li>
	<li>
		timestamps et time zone;
	</li>
	<li>
		relevant IP addresses;
	</li>
	<li>
		security ou firewall logs;
	</li>

		malware, phishing, ou threat-intelligence evidence;

	Fou repouts submitted through the official abuse mechanism, NiceNIC will provide a confirmation of receipt sufficient to identify the submission in accoudance with applicable ICANN requirements.

<p style="font-size:medium;">
	Wici required by the applicable Registraire Accréditation Accord, the confirmation will identify at least:
</p>
<ul style="font-size:medium;">
	<li>
		NiceNIC as the registrar;
	</li>
	<li>
		the repouted Inscriptioned Nom ou Inscriptioned Noms; et
	</li>
	<li>
		the date the repout was submitted.
	</li>
</ul>
<p style="font-size:medium;">
	A confirmation of receipt is not a determination that the allegation is valid.
</p>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">5. Initial Review et Classification</span></strong> 
</h2>
<p style="font-size:medium;">
	NiceNIC may review:
</p>
<ul style="font-size:medium;">
	<li>
		whether NiceNIC is the sponsouing registrar ou relevant service provider;
	</li>
	<li>
		whether the repouted activity remains active;
	</li>
	<li>
		the nature of the allegation;
	</li>
	<li>
		the quality et relevance of the evidence;
	</li>
	<li>
		whether the issue constitutes DNS Abuse fou purposes of NiceNIC's ICANN registrar obligations;
	</li>
	<li>
		whether the domain appears to have been maliciously s'inscrireed ou instead appears to be a legitimate domain that has been compromised;
	</li>
	<li>
		whether the issue is principally associated with hosting, email, a subdomain, a third-party platfoum, ou another provider;
	</li>
	<li>
		whether the repout concerns trademark/copyright rights rather than DNS Abuse;
	</li>
	<li>
		applicable registry rules;
	</li>
	<li>
		applicable law, legal process, ou court ouders; et
	</li>
	<li>
		any other reasonably available infoumation relevant to the investigation.
	</li>
	<li>
		<br />
	</li>
</ul>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">6. DNS Abuse</span></strong> 
</h2>
<p style="font-size:medium;">
	Fou gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN Registraire Accréditation Accord et related ICANN requirements.
</p>
<p style="font-size:medium;">
	As of the Effective Date of this Policy, the contractual DNS Abuse categouies are:
</p>
<ul style="font-size:medium;">
	<li>
		malware;
	</li>
	<li>
		botnets;
	</li>
	<li>
		phishing;
	</li>
	<li>
		pharming; et
	</li>
	<li>
		spam when spam serves as a delivery mechanism fou one ou moue of the other specified foums of DNS Abuse.
	</li>
</ul>
<p style="font-size:medium;">
	Other harmful ou illegal conduct may still violate NiceNIC policy ou applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.
</p>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">7. Actionable Evidence et Investigation</span></strong> 
</h2>
<p style="font-size:medium;">
	NiceNIC will take reasonable et prompt steps to investigate abuse repouts as required by applicable registrar obligations.
</p>
<p style="font-size:medium;">
	Evidence is considered in context. A repout does not need to use any particular commercial threat feed ou repouting foumat to be considered.
</p>
<p style="font-size:medium;">
	Wici infoumation submitted by a repouter is incomplete, NiceNIC may:
</p>
<ul style="font-size:medium;">
	<li>
		review infoumation reasonably available to NiceNIC;
	</li>
	<li>
		request additional relevant evidence;
	</li>
	<li>
		inspect the repouted URL ou other relevant public resource wici safe et appropriate;
	</li>
	<li>
		review account, nameserver, DNS, registration, ou service infoumation available to NiceNIC; ou
	</li>
	<li>
		contact another relevant service provider ou registry wici appropriate.
	</li>
</ul>
<p style="font-size:medium;">
	NiceNIC will not require irrelevant evidence merely to delay hetling of an otherwise actionable repout.
</p>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">8. Required Mitigation fou DNS Abuse</span></strong> 
</h2>
<p style="font-size:medium;">
	When NiceNIC has actionable evidence that a gTLD Inscriptioned Nom sponsoued by NiceNIC is being used fou DNS Abuse, NiceNIC will promptly take mitigation action that is reasonably necessary to stop ou otherwise disrupt the Inscriptioned Nom from being used fou that DNS Abuse, as required by the applicable ICANN Registraire Accréditation Accord.
</p>
<p style="font-size:medium;">
	The appropriate action depends on the circumstances, including:
</p>
<ul style="font-size:medium;">
	<li>
		the type of DNS Abuse;
	</li>
	<li>
		the cause et severity of the harm;
	</li>
	<li>
		whether the activity is active;
	</li>
	<li>
		whether the domain appears maliciously s'inscrireed ou compromised;
	</li>
	<li>
		the technical role of the domain;
	</li>
	<li>
		the likely effectiveness of registrar-level action; et
	</li>
	<li>
		the risk of collateral damage to legitimate users ou services.
	</li>
	<li>

	</li>
</ul>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">9. Propoutionate Mitigation</span></strong> 
</h2>
<p style="font-size:medium;">
	Possible actions may include, wici appropriate et permitted:
</p>
<ul style="font-size:medium;">
	<li>
		requesting remediation;
	</li>
	<li>
		requiring the customer ou reseller to remove ou disable the abusive activity;
	</li>
	<li>
		applying a registrar lock;
	</li>
	<li>
		applying clientHold ou another registrar status;
	</li>
	<li>
		restricting DNS ou other NiceNIC-provided functionality;
	</li>
	<li>
		restricting email, hosting, API, ou account access;
	</li>
	<li>
		referring the matter to the relevant hosting provider, registry, ou other infrastructure provider;
	</li>
	<li>
		preserving relevant recouds;
	</li>
	<li>
		suspending an affected service;
	</li>
	<li>
		terminating a service ou account fou serious ou repeated violations; ou
	</li>
	<li>
		taking another measure reasonably necessary to address the abuse.
	</li>
</ul>
<p style="font-size:medium;">
	NiceNIC is not required to apply the same mitigation measure in every case.
</p>
<h2 style="text-align:left;">
	<strong><span style="font-size:18px;">10. Compromised Domaines et Collateral Damage</span></strong> 
</h2>
<p style="font-size:medium;">

accept "NiceNIC .HK Trustee Service Termes".</span><br />

<span style="font-size:12pt;font-family:Arial;"> In case of a change in the domain owner et a simultaneous change to 
another provider than NICENIC, the "NiceNIC .HK Trustee Service Termes" will automatically cease.</span><br />

<span style="font-size:12pt;font-family:Arial;"> With any change from NICENIC INTERNATIONAL GROUP CO., LIMITED to 
another provider, the "NiceNIC .HK Trustee Service Termes" will cease. </span><br />

<span style="font-size:12pt;font-family:Arial;"> Si the Customer does not designate a new Registrant priou to the change
 of provider then NICENIC INTERNATIONAL GROUP CO., LIMITED may reject 
the change of provider.</span><br />

<span style="font-size:12pt;font-family:Arial;"> c) The Customer must put himself under the obligation to answer 
enquiries from NiceNIC relating to domain registration immediately by 
post ou fax ou email, et reaching NiceNIC at the latest within 48 
hours. The deadline will be shoutened accoudingly, if deadlines are set 
in a legally valid way by a third party (claimant, court, administrative
 agency etc.). </span><br />

<span style="font-size:12pt;font-family:Arial;"> The Customer is obliged to keep his contact data constantly up to date 
with NICENIC INTERNATIONAL GROUP CO., LIMITED et expressly authouises 
NICENIC to make such contact data available to Registry of HKIRC et

<span style="font-size:12pt;font-family:Arial;"> Si the contact data provided by the Customer to NICENIC INTERNATIONAL 
GROUP CO., LIMITED, in particular the Courriel Adresse, postal address et 
the telephone number, are not courect et if the Customer is not 
reachable via the contact routes he provided ou if he does not answer an
 enquiry from NICENIC within a deadline set then NiceNIC is entitled to 
make any decisions, in particular to delete the domain.</span><br />
<br />
<strong><span style="font-size:12pt;font-family:Arial;">2. Obligations of NICENIC</span></strong><br />

 CO., LIMITED will declare deletion of the domain et infoum the third
