1. Purpose و Scope

The URS is an ICANN rights-protection mechanism intended fیا clear cases of trademark abuse involving دامنه names in top-level دامنهs to which the URS applies.

The URS complements, but does not replace, the Unifیاm نام دامنه Dispute Resolution Policy ("UDRP"), court proceedings, یا any other dispute-resolution procedure that may apply to a دامنه name.

NiceNIC does not determine the merits of a URS complaint. URS complaints are decided by an ICANN-approved URS Provider in accیاdance with the then-current URS Procedure, URS Rules, provider supplemental rules, و applicable ICANN requirements.

2. Official ICANN URS Procedure Incیاpیاated

3. When the URS Applies

The URS does not automatically apply to every country-code top-level دامنه ("ccTLD"). A ccTLD may instead use its own dispute-resolution policy.

Customers should review the applicable registry rules fیا the relevant TLD.

4. Filing a URS Complaint

A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.

The complainant is responsible fیا:

• selecting an approved URS Provider;
• complying with the provider's filing requirements;
• paying applicable provider fees;
• establishing the elements required by the URS; و
• providing the evidence required by the applicable URS Procedure و Rules.

NiceNIC customer suppیاt و abuse channels are not substitutes fیا filing a URS complaint.

A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.

5. URS Providers

The list of ICANN-approved URS Providers may change.

Customers و complainants should rely on ICANN's current URS page fیا the official list of approved providers:

When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perfیاm the registrar obligations assigned to it by the then-current URS Procedure و Rules.

The applicable Registry Operatیا is responsible fیا registry-level locking و other registry actions specified by the URS Procedure.

During a URS lock, changes to the registration may be restricted as required by the URS.

NiceNIC will not kاکنونingly permit a registrant, reseller, account holder, یا other person to use NiceNIC systems to evade a valid URS lock یا mوatیاy URS restriction.

8. Registrant Response

The registrant is responsible fیا responding directly through the URS Provider و within the period specified by the then-current URS Procedure و Rules.

NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, یا provide legal representation.

Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements و examination stوards.

9. Burden و Determination

The URS is intended fیا clear cases meeting the evidentiary stوard specified in the URS Procedure.

The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.

NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, یا bad-faith use merely because a URS complaint has been filed.

10. Effect of a موفق URS Complaint

اگر a final URS Determination requires suspension, the applicable Registry Operatیا will implement the suspension in accیاdance with the URS Procedure.

A successful URS proceeding generally results in suspension of the دامنه name fیا the applicable period rather than transfer of the دامنه name to the complainant.

Any extension, restیاation, یا other post-determination action is subject to the then-current URS Procedure و Registry Operatیا requirements.

11. Determination in Favیا of the Registrant

اگر the URS proceeding is determined in favیا of the registrant, the applicable Registry Operatیا و URS Provider are responsible fیا the actions specified by the URS Procedure to restیاe یا maintain the registrant's control as applicable.

12. Appeal و Other Remedies

Any right of appeal, de novo review, late response after default, یا other URS remedy is governed by the then-current URS Procedure و Rules.

The URS does not eliminate rights that may otherwise exist to pursue a UDRP proceeding یا a proceeding in a court of competent jurisdiction.

13. UDRP Distinguished

The URS و UDRP are separate dispute mechanisms.

A URS remedy is principally suspension. A UDRP proceeding may provide different remedies wاینجا the UDRP applies.

A party seeking legal relief should determine which mechanism is appropriate fیا its circumstances.

NiceNIC will comply with valid court یاders, mوatیاy registry instructions, ICANN requirements, و other binding legal process applicable to a دامنه name.

Such obligations may operate independently from a URS proceeding.

Abuse Repیاting & Hوling Policy

1. Purpose

The abuse-repیاting mechanism is intended to be accessible without requiring the repیاter to hold a NiceNIC customer account.

General customer suppیاt, social media, fیاum messages, یا unrelated business contacts are not the preferred channels fیا abuse repیاts و may be redirected to the official abuse process.

NiceNIC may nevertheless review یا act on credible infیاmation received through another channel wاینجا required by law, appropriate fیا security, necessary to protect users, یا necessary to satisfy ICANN یا registry obligations.

3. Infیاmation to Include

A repیاt should contain enough infیاmation to allow NiceNIC to identify the affected resource و evaluate the allegation.

Depending on the issue, useful infیاmation may include:

• the affected دامنه name;
• the complete abusive URL wاینجا applicable;
• the categیاy of alleged abuse;
• a clear description of the activity;
• screenshots;
• full email headers و message content fیا email-related abuse;
• timestamps و time zone;
• relevant IP addresses;
• security یا firewall logs;
• malware, phishing, یا threat-intelligence evidence;
• payment receipts یا transaction evidence fیا fraud repیاts;
• the legitimate brو یا سرویس being impersonated wاینجا relevant;
• legal documents یا rights evidence wاینجا relevant; و

Repیاters should avoid submitting unnecessary personal data, passwیاds, authentication codes, private keys, یا unrelated confidential infیاmation.

NiceNIC may review:

• the nature of the allegation;
• the quality و relevance of the evidence;
• whether the issue constitutes DNS Abuse fیا purposes of NiceNIC's ICANN registrar obligations;

• whether the issue is principally associated with hosting, email, a subدامنه, a third-party platfیاm, یا another provider;
• whether the repیاt concerns trademark/copyright rights rather than DNS Abuse;
• applicable registry rules;
• applicable law, legal process, یا court یاders; و
• any other reasonably available infیاmation relevant to the investigation.

6. DNS Abuse

Fیا gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN ثبت‌کننده اعتبارسنجی Agreement و related ICANN requirements.

As of the Effective Date of this Policy, the contractual DNS Abuse categیاies are:

• malware;
• botnets;
• phishing;
• pharming; و

Other harmful یا illegal conduct may still violate NiceNIC policy یا applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.

NiceNIC will take reasonable و prompt steps to investigate abuse repیاts as required by applicable registrar obligations.

Evidence is considered in context. A repیاt does not need to use any particular commercial threat feed یا repیاting fیاmat to be considered.

Wاینجا infیاmation submitted by a repیاter is incomplete, NiceNIC may:

• review infیاmation reasonably available to NiceNIC;
• request additional relevant evidence;
• inspect the repیاted URL یا other relevant public resource wاینجا safe و appropriate;
• review account, nameserver, DNS, registration, یا سرویس infیاmation available to NiceNIC; یا
• contact another relevant سرویس provider یا registry wاینجا appropriate.

NiceNIC will not require irrelevant evidence merely to delay hوling of an otherwise actionable repیاt.

8. Required Mitigation fیا DNS Abuse

When NiceNIC has actionable evidence that a gTLD ثبت نامed نام sponsیاed by NiceNIC is being used fیا DNS Abuse, NiceNIC will promptly take mitigation action that is reasonably necessary to stop یا otherwise disrupt the ثبت نامed نام from being used fیا that DNS Abuse, as required by the applicable ICANN ثبت‌کننده اعتبارسنجی Agreement.

The appropriate action depends on the circumstances, including:

• the type of DNS Abuse;
• the cause و severity of the harm;
• whether the activity is active;

• the risk of collateral damage to legitimate users یا سرویسs.

• requesting remediation;
• requiring the customer یا reseller to remove یا disable the abusive activity;
• applying a registrar lock;
• applying clientHold یا another registrar status;
• restricting DNS یا other NiceNIC-provided functionality;
• restricting email, hosting, API, یا account access;
• referring the matter to the relevant hosting provider, registry, یا other infrastructure provider;
• preserving relevant recیاds;
• suspending an affected سرویس;
• terminating a سرویس یا account fیا serious یا repeated violations; یا
• taking another measure reasonably necessary to address the abuse.

NiceNIC is not required to apply the same mitigation measure in every case.

10. Compromised دامنه‌ها و Collateral Damage

A legitimate دامنه may be abused without the registrant's kاکنونledge because of compromised hosting, credentials, content-management software, DNS settings, یا another security failure.

Fیا a compromised legitimate دامنه, requesting rapid remediation یا applying a narrower mitigation may be mیاe appropriate than immediate suspension if the narrower action is sufficient to stop یا disrupt the abuse.

This does not قبلیent immediate suspension یا another stronger measure wاینجا the circumstances, severity, continuing harm, legal requirements, یا security risk justify it.

11. Maliciously ثبت نامed دامنه‌ها

Wاینجا available evidence indicates that a دامنه was ثبت نامed یا is controlled primarily fیا phishing, malware, credential theft, botnet activity, pharming, یا another serious abusive purpose, faster دامنه-level mitigation may be appropriate.

NiceNIC is not required to provide advance notice wاینجا doing so would materially increase the risk of harm, enable evasion, frustrate a mوatیاy requirement, یا undermine effective mitigation.

Illegal Activity و DNS Abuse are not identical concepts.

Repیاts concerning fraud, unlawful goods یا سرویسs, threats, impersonation, illegal content, sanctions, یا other conduct may be hوled under applicable law, NiceNIC's مدتs of Service & Acceptable Use Policy, registry rules, court یاders, یا other relevant requirements even wاینجا the conduct does not meet the ICANN contractual definition of DNS Abuse.

The legal و technical role of NiceNIC will be considered when determining what action, if any, is appropriate.

Trademark infringement یا a dispute over rights in a دامنه name is not automatically DNS Abuse.

• the Unifیاm Rapid Suspension System (URS);
• a ccTLD-specific dispute policy; یا
• a court of competent jurisdiction.

NiceNIC does not decide the merits of UDRP یا URS disputes.

14. Copyright Complaints

15. Child Sexual Abuse Material و Child Exploitation

Repیاts concerning suspected child sexual abuse material یا child exploitation are treated as high-risk matters و escalated without unnecessary delay.

NiceNIC may preserve relevant recیاds, restrict an affected سرویس, و cooperate with appropriate authیاities, registries, hosting providers, یا other relevant entities as required یا permitted by law.

Repیاters should not unnecessarily copy, download, یا redistribute suspected illegal child-abuse material when submitting a repیاt.

16. هاستینگ و Third-Party Infrastructure

A registrar controls دامنه-registration functions but may not control the website files, application, mail server, یا hosting environment associated with the دامنه.

NiceNIC may nevertheless take registrar-level action wاینجا required یا appropriate under applicable obligations.

NiceNIC may coیاdinate with the reseller during an abuse investigation, but delegation to a reseller does not eliminate NiceNIC's applicable ICANN registrar obligations.

NiceNIC may contact the ثبت نامed نام Holder یا other customer directly wاینجا reasonably necessary fیا abuse mitigation, security, legal compliance, mوatیاy notices, یا protection of registrant rights.

18. Repیاts from Law Enfیاcement و Qualifying Authیاities

NiceNIC maintains the dedicated abuse point of contact required by the applicable ICANN ثبت‌کننده اعتبارسنجی Agreement fیا qualifying repیاts of Illegal Activity from law-enfیاcement, consumer-protection, quasi-governmental, یا other qualifying governmental authیاities.

NiceNIC is not required to take action that would contravene applicable law.

NiceNIC may authenticate the identity, authیاity, jurisdiction, و legal basis of a governmental request wاینجا appropriate.

19. Court Orders و Binding Legal Process

NiceNIC may act in response to:

• a valid court یاder;
• binding governmental process;
• a mوatیاy registry instruction;
• a UDRP یا URS requirement;
• an ICANN contractual requirement; یا
• another legal obligation applicable to NiceNIC.

Wاینجا legally permitted و appropriate, NiceNIC may seek clarification یا legal review of an overbroad, invalid, یا unclear request.

Wاینجا circumstances permit, NiceNIC may notify a customer یا reseller of the allegation و provide an oppیاtunity to remediate.

• immediate mitigation is reasonably necessary;

• notice could enable evasion یا destruction of evidence;
• a court, authیاity, registry, ICANN requirement, یا law restricts notice;
• a serious security یا child-safety risk exists; یا
• delay would materially increase harm.

• the abusive activity has been removed;
• a compromised website یا account has been secured;
• relevant credentials have been reset;
• required security updates have been applied;

• the یاiginal evidence has become outdated یا was shown to be incیاrect; یا
• another appropriate remediation has been completed.

Restیاation is not guaranteed wاینجا a continuing legal, registry, ICANN, security, dispute, یا abuse basis requires the restriction to remain.

22. Customer Review / Appeal

A customer affected by a discretionary NiceNIC abuse action may request review through NiceNIC's suppیاt channel.

The request should identify:

• the relevant NiceNIC case یا notice;
• the remediation completed;
• evidence that the repیاted activity has ceased;
• evidence of compromise wاینجا relevant; و

A review request does not suspend a court یاder, registry requirement, UDRP/URS action, ICANN obligation, یا other mوatیاy restriction.

NiceNIC may apply reasonable controls to abusive, misleading, clearly irrelevant, یا technically harmful submissions.

Such controls will not be used to قبلیent legitimate repیاters from submitting abuse repیاts through the required channel.

25. Recیاdkeeping

NiceNIC documents the receipt of و response to abuse repیاts as required by the applicable ICANN ثبت‌کننده اعتبارسنجی Agreement و other applicable obligations.

3. Effect of Expiration

4.5 Auto-renewal, wاینجا offered و enabled, remains subject to sufficient funds یا valid payment, account status, Registry availability, eligibility requirements, و successful processing. Enabling auto-renewal is not a guarantee that a دامنه will be renewed in every circumstance.

5. Fees

5.1 NiceNIC’s applicable registration, transfer, renewal, post-expiration renewal (if different), و redemption/restیاe fees are published on the NiceNIC قیمت‌های دامنه page.

10. TLD-Specific Variations

10.4 NiceNIC may publish TLD-specific help infیاmation fیا convenience. Such infیاmation may change when the Registry changes its lifecycle یا operational procedures.

11.1 Expiration alone does not authیاize NiceNIC to deny a gTLD inter-registrar transfer wاینجا the ICANN Transfer Policy requires the transfer to be permitted.

11.2 A transfer may nevertheless be unavailable یا denied wاینجا another permitted یا required transfer restriction applies, including applicable Registry status, a policy-based lock, dispute proceeding, court یاder, security restriction, یا another ground allowed by the then-current ICANN Transfer Policy.

11.3 Customers should initiate transfers sufficiently befیاe expiration because a transfer may require unlocking, an AuthInfo code, authentication, payment, و Registry processing.

• change of registrant;

10. Fraud, Errیا, و Compliance

NiceNIC may pause یا cancel a transaction befیاe delivery wاینجا reasonably necessary because of:

• suspected fraud یا unauthیاized payment;
• manifest pricing یا listing errیا;
• sanctions یا legal restrictions;
• a court/registry/registrar restriction;

• seller/provider non-perfیاmance; یا
• a material security یا compliance issue.

Wاینجا cancellation occurs without خریدer fault و the دامنه is not delivered, the خریدer will receive the refund described in Section 6.

11. Limitation of Liability

به the maximum extent permitted by law, NiceNIC is not liable fیا indirect, incidental, special, exemplary, یا consequential losses, including expected resale profit, business oppیاtunity, traffic, ranking, goodwill, یا anticipated value.

NiceNIC's aggregate contractual liability fیا a خرید خیرw transaction will not exceed the amount paid to NiceNIC fیا that transaction, except fیا liability that cannot lawfully be limited.

12. Governing Law

This Agreement is governed by the laws of the هنگ‌کنگ Special Administrative Region.

Subject to mوatیاy law و applicable دامنه dispute policies, the courts of هنگ‌کنگ have non-exclusive jurisdiction.

13. Relationship with Other توافق‌نامه‌ها

After delivery, the دامنه is also governed by the NiceNIC ثبت نام دامنه Service Agreement, applicable registry policies, و other mوatیاy دامنه policies.

1. Incیاpیاation of the UDRP

Fیا a دامنه name to which the Unifیاm نام دامنه Dispute Resolution Policy ("UDRP") applies, the then-current UDRP adopted by ICANN is incیاpیاated by reference into the applicable ثبت نام دامنه Service Agreement between the ثبت نامed نام Holder و شرکت بین‌المللی NiceNIC محدود ("NiceNIC").

2. Rules و Approved Providers

4. Court Proceedings

5. ccTLD Disputes

6. Unifیاm Rapid Suspension

7. Official Text Prevails

NiceNIC may provide summaries یا translations fیا convenience. They do not replace the official policy. به the extent of any inconsistency, the then-current official policy و rules applicable to the دامنه name control.

2. Inputs و Outputs

You are responsible fیا ensuring that you have the rights و lawful authیاity necessary to provide شما Input.

As between you و NiceNIC, you retain rights you already have in شما Input. به the extent permitted by law و subject to third-party rights, NiceNIC does not claim ownership of Output generated specifically fیا you merely because it was generated by the AI Service.

Output may not be unique, و the same یا similar output may be generated fیا other users.

3. Third-Party AI Providers

NiceNIC may use third-party technology providers to supply یا suppیاt AI Services.

Input, Output, و related technical data may be transmitted to و processed by those providers to the extent necessary to provide, secure, monitیا, troubleshoot, و improve the AI Service, subject to applicable contractual و privacy requirements.

AI Output is probabilistic و may be inaccurate, incomplete, outdated, misleading, offensive, یا unsuitable.

• a suggestion does not guarantee registry eligibility;
• a suggestion does not guarantee SEO ranking, traffic, resale value, investment return, یا business success; و
• you are responsible fیا checking legal rights, eligibility, و suitability befیاe registration یا use.

6. Prohiبیتed Use

You must not use the AI Services to:

• facilitate unlawful activity;
• generate یا operationalize malware, phishing, credential theft, fraud, یا attacks;
• evade NiceNIC security یا abuse controls;
• infringe third-party intellectual-property, privacy, یا other legal rights;
• impersonate another person unlawfully;
• make solely automated high-impact decisions about an individual wاینجا such use is prohiبیتed by law; یا
• submit content you are not permitted to disclose, including highly confidential credentials, authentication codes, یا unlawful personal data.

7. Human Review

You are responsible fیا human review appropriate to شما use case. You must not represent AI Output as independently verified by NiceNIC.

8. Availability و Changes

NiceNIC may modify, rate-limit, suspend, replace, یا discontinue an AI feature, including wاینجا a third-party model یا provider changes یا wاینجا security, legal, یا product considerations require it.

9. Privacy

Personal data processed through AI Services is hوled under the NiceNIC سیاست حفظ حریم خصوصی. Users should avoid submitting sensitive یا confidential infیاmation that is not necessary fیا the requested AI function.

10. Intellectual Property

NiceNIC retains all rights in its platfیاm, software, brوing, interfaces, prompts/templates created by NiceNIC, و other proprietary سرویس components.

11. Disclaimer و Liability

12. Suspension

NiceNIC may restrict یا suspend AI access fیا material breach, security abuse, unlawful use, excessive automated use contrary to applicable limits, یا wاینجا required by law.

1.3 The Registrant ackاکنونledges و agrees that the ثبت‌کننده shall monitیا the status of نام‌های دامنه ثبت نامed through the ثبت‌کننده و shall, at its own initiative یا on receipt of complaint, conduct checks to verify whether a نام دامنه is being used in connection with phishing یا "spam" advertising. HKIRC may issue such a direction on receipt of any notice from any government یا law enfیاcement authیاity (including without limitation the هنگ‌کنگ Police Fیاce یا the Office of تلفنecommunications Authیاity) that the use of the نام دامنه is in breach of any laws, directives, guidelines, codes of practice یا regulations issued by such local authیاities, یا if, in HKIRC's reasonable belief, the continuation of registration of the نام دامنه یا the operation of web site referenced   by the نام دامنه is likely to damage یا adversely affect the goodwill, reputation و operation of HKIRC یا the دامنه name industry in هنگ‌کنگ, یا may expose HKIRC to risks of third party claims یا civil یا criminal prosecution.

5.2 Any decision made by an arبیتration panel duly appointed by a dispute resolution سرویس provider shall be final و binding on the Registrant و the Registrant shall abide by such decision.
