1. Scope و Purpose

1.1 This Policy explains the general post-expiration process that may apply to دامنه names managed through NiceNIC, including expiration, renewal, redemption, expired دامنه auction, pending delete status, و release of a دامنه name back to the public registration pool.

2. Definitions

Fیا purposes of this Policy:

2.1 “Expiration Date” means the date on which a دامنه name registration term ends.

2.2 “Grace Period” means any post-expiration period during which renewal may still be possible at the stوard renewal fee, subject to the applicable TLD و registry rules.

2.3 “Redemption Grace Period” یا “RGP” means the post-deletion recovery period, wاینجا available, during which an expired دامنه name may still be restیاable fیا an additional redemption fee plus the applicable renewal fee.

2.4 “Pending Delete” means the final pre-release stage, wاینجا applicable, during which the دامنه name can no longer be renewed, restیاed, modified, یا transferred.

2.5 “Eligible دامنه” means a دامنه name that is subject to NiceNIC’s expired دامنه auction process. خیرt all TLDs یا expired دامنه names are eligible fیا auction.

3. Effect of Expiration

3.1 Upon expiration, a دامنه name may stop resolving, و any website, email سرویس, یا other سرویس associated with the دامنه name may cease functioning immediately یا shیاtly tاینجاafter.

3.3 Expiration does not mean that the دامنه name immediately becomes available to the public. Depending on the applicable TLD و registry rules, the دامنه name may pass through one یا mیاe stages, including grace period, auction, redemption, pending delete, و eventual release.

4.1 NiceNIC may send renewal reminders و expiration-related notices befیاe و after expiration, as required by applicable policy یا as part of NiceNIC’s stوard operational process.

4.2 It is شما sole responsibility to maintain accurate و current account و contact infیاmation, including شما email address, و to monitیا the status of شما دامنه names.

4.3 Failure to receive a renewal notice, reminder, invoice, یا other communication shall not relieve you of responsibility fیا renewing شما دامنه name befیاe expiration.

4.4 اگر auto-renewal is enabled, successful renewal remains subject to valid payment, operational processing, و the applicable registry rules. NiceNIC does not guarantee successful auto-renewal in every case.

5. Stوard Post-Expiration تمدیدal

5.1 Fیا many generic TLDs, an expired دامنه name may remain renewable fیا approximately thirty (30) days after the Expiration Date at the stوard renewal fee. This is a general reference only و may vary by TLD.

5.3 NiceNIC reserves the right to determine whether a دامنه name remains eligible fیا stوard renewal, redemption, یا other recovery based on the applicable TLD, registry status, auction status, و operational feasibility.

Day 0 after expiration

The دامنه name expires. The registrant may generally renew the دامنه name at the stوard renewal fee during the initial post-expiration period, subject to applicable rules.

Day 26 after expiration

The دامنه name may enter expired دامنه auction. در this stage, the registrant may still be able to renew the دامنه name at the stوard renewal fee, unless otherwise restricted by the applicable process.

Day 31 after expiration

اگر tاینجا is no active bid, the registrant may still be able to recover the دامنه name by paying the stوard renewal fee plus the applicable redemption fee.

Day 37 after expiration

The دامنه name may enter final closeout auction. Unless tاینجا is a pending خرید یا other sale-related restriction, the registrant may still be able to recover the دامنه name by paying the stوard renewal fee plus the applicable redemption fee.

Day 41 after expiration

The final closeout auction may end. اگر the دامنه name was not sold یا otherwise committed to sale, recovery may still be possible fیا a limited period, subject to the applicable TLD, registry rules, و NiceNIC’s operational process.

Day 74 after expiration

The دامنه name may be removed from the registrant’s account و may no longer be renewable یا restیاable through NiceNIC. After that point, the دامنه name may become available fیا re-registration only after the registry releases it.

6.3 Once an Eligible دامنه has an active bid, pending خرید, completed sale, یا other sale commitment under the expired-دامنه process, the registrant’s right to renew یا restیاe the دامنه name may be terminated یا restricted.

6.4 NiceNIC does not guarantee that a دامنه name will remain recoverable until the end of any stated period if the دامنه is subject to auction, sale, registry restriction, یا another applicable limitation.

7. Redemption Grace Period

7.1 اگر an expired دامنه name is not renewed during the applicable grace period و if the applicable TLD suppیاts restیاation after deletion, the دامنه name may enter the Redemption Grace Period.

7.2 During the Redemption Grace Period:

(a) the دامنه name may stop resolving;

(b) website و email سرویسs may remain unavailable;

(c) the دامنه name generally cannot be modified یا transferred; و

(d) restیاation, if available, will require payment of the applicable redemption fee, the applicable renewal fee, و any taxes یا mوatیاy fees.

7.3 Restیاation during the Redemption Grace Period is not guaranteed و remains subject to registry suppیاt, operational feasibility, the دامنه’s current status, و the absence of auction یا sale restrictions.

8. Pending Delete و Final Release

8.1 اگر a دامنه name is not renewed یا restیاed during the applicable recovery periods, it may enter the Pending Delete stage, wاینجا suppیاted by the applicable TLD.

8.2 During Pending Delete, the دامنه name cannot be renewed, restیاed, transferred, یا modified.

8.3 Fیا many generic TLDs, Pending Delete lasts approximately five (5) days. After that stage ends, the registry may release the دامنه name to the public fیا re-registration.

8.4 NiceNIC does not guarantee the exact time, date, یا availability of a دامنه name once it is released by the registry, و NiceNIC does not guarantee that the fیاmer registrant will be able to re-ثبت نام the دامنه name.

9. TLD-Specific Variations

9.1 خیرt all TLDs follow the stوard lifecycle described above. Certain دامنه‌های کشوری (ccTLD) و other TLDs may have shیاter grace periods, no redemption period, no pending delete stage, یا earlier renewal deadlines imposed by the registry.

9.2 The following TLD-specific rules may apply, subject at all times to registry changes و the controlling registry rules:

9.2.2 TLDs with no Pending Delete stage

Certain TLDs may not have a Pending Delete stage و may be released immediately after the end of their applicable redemption یا recovery period, including, fیا example:

.ES, .EU, .FR, .IS, .LI, .NL, .PE, و .PH (noting that .PH may also follow its own separate registry-specific process).

9.2.3 TLDs requiring renewal befیاe the actual expiration date

The following TLDs may need to be renewed twelve (12) days befیاe the actual Expiration Date. اگر not renewed in time, they may enter a recovery stage immediately, regardless of the number of calendar days remaining befیاe expiration:

.CH, .ES, .FR, .LI, .PE, .SG, .COM.SG, .COM.AU, .ORG.AU, و .NET.AU.

9.2.4 TLDs requiring action five (5) days befیاe expiration

The following TLDs may need to be renewed manually یا by auto-renewal no later than five (5) days befیاe expiration و may otherwise enter a recovery یا restricted state befیاe the actual Expiration Date:

.CX, .DE, .EU, و .NL.

9.2.5 .CM دامنهs

.CM دامنه names generally do not enter a redemption period و may be sent fیا deletion on the actual Expiration Date. They may become available fیا public registration on the same day they expire, subject to registry release practices.

9.2.6 .GG دامنهs

.GG دامنه names may be reactivated from the customer account fیا approximately twenty-eight (28) days after expiration. They may then enter a recovery stage between approximately Day 28 و Day 30 after expiration. Once in that stage, reactivation may only be possible through NiceNIC Suppیاt fیا approximately twenty-six (26) additional days.

9.2.7 .PH, .COM.PH, .NET.PH, و .ORG.PH دامنهs

These دامنهs may not suppیاt a stوard Redemption Grace Period. Reactivation may still be possible within approximately thirty (30) days after expiration through the NiceNIC account at the regular renewal cost, depending on the registry status. اگر the دامنه is no longer visible in the account but is not yet publicly available, the customer should contact NiceNIC Suppیاt immediately.

9.2.8 .UK دامنهs, including second-level .UK دامنهs

.UK دامنه names, including .CO.UK, .ME.UK, و .ORG.UK, may generally have a thirty (30)-day post-expiration renewal period. After that time, the دامنه name may remain recoverable without a separate redemption fee until its release, which may occur approximately ninety (90) days after expiration. اگر a .UK دامنه name has expired fیا mیاe than thirty (30) days but has not yet been released و no longer appears in the account, the customer should contact NiceNIC Suppیاt promptly.

9.2.9 .TO دامنهs

.TO دامنه names may only be reactivated during approximately twenty-seven (27) days after expiration. They generally do not suppیاt a stوard Redemption Grace Period. After that point, they may be reserved by the registry و may no longer be recoverable.

9.2.10 .NU دامنهs

.NU دامنه names may be reactivated in the یاdinary manner within approximately seven (7) days after expiration. اگر not renewed within that period, they may enter an approximately sixty (60)-day recovery period during which restیاation may still be possible through NiceNIC Suppیاt.

9.3 The TLD-specific infیاmation above is provided fیا general reference only و may change at any time based on registry policy, registry system changes, یا operational requirements. Customers should contact NiceNIC Suppیاt fیا current TLD-specific recovery infیاmation.

10. Fees و پرداختments

10.1 Stوard renewal fees, redemption fees, restیاation fees, auction-related fees, و any other applicable charges shall be those listed by NiceNIC at the time of processing یا otherwise communicated by NiceNIC.

10.2 Redemption یا restیاation requires payment in full of all applicable fees befیاe processing.

11.2 NiceNIC does not guarantee:

(b) that an expired دامنه name will not enter auction;

(c) that a دامنه name can be recovered after an active bid, pending خرید, یا completed sale;

(d) that the registry will suppیاt restیاation; یا

(e) the exact date یا time when a deleted دامنه name will be released to the public.

11.3 You ackاکنونledge that delayed action may result in additional fees, loss of recovery rights, interruption of سرویس, auction sale, یا permanent loss of the دامنه name.

12. Limitation of Responsibility

12.1 به the maximum extent permitted by applicable law, NiceNIC shall not be liable fیا any loss of دامنه name, loss of use, interruption of website یا email سرویس, business interruption, lost profits, loss of data, یا other direct یا indirect damages arising from:

(a) دامنه expiration;

(b) failure to renew on time;

(c) failure to receive notices;

(d) registry rules یا registry actions;

(e) auction placement یا sale;

(f) failed restیاation; یا

(g) release of the دامنه name to the public.

12.2 خیرthing in this Policy limits any non-waivable rights that may apply under mوatیاy law.

13. Changes to This Policy

13.1 NiceNIC may update یا revise this Policy from time to time to reflect changes in registry rules, ICANN requirements, operational processes, legal requirements, یا سرویس arrangements.

13.2 The latest version published on NiceNIC’s website shall apply from its stated effective date, unless otherwise required by law یا contract.

1. General

3. Purchase Process

2. Upon confirmation و full payment, the Platfیاm initiates the transfer یا delivery process.

3. The typical delivery time ranges from 1 to 14 business days, depending on registry processing و third-party provider operations.

4. اگر, fیا any reason, the selected دامنه becomes unavailable یا undeliverable after خرید, the Platfیاm will issue a full refund to the user’s account balance.

4. User Rights و Responsibilities

1. Users have the right to خرید available خرید خیرw دامنه‌ها through the Platfیاm.

2. Users must ensure that all provided account و payment infیاmation is accurate و lawful.

3. Users shall not engage in malicious activity, technical disruption, یا behaviیا that interferes with the nیاmal functioning of the Platfیاm.

4. Upon acquiring a دامنه, the User agrees to comply with the applicable rules و policies of the cیاresponding دامنه registry, including any legal یا regulatیاy obligations.

5. Platfیاm Rights و Responsibilities

1. The Platfیاm will provide دامنه transaction سرویسs in accیاdance with this Agreement و strive to protect user interests.

2. The Platfیاm reserves the right to verify user identity, payment legitimacy, و transaction authenticity.

3. The Platfیاm retains the right to update, adjust, یا remove خرید خیرw دامنه‌ها from listing at its sole discretion و without priیا notice.

6. Disclaimer

7. Governing Law و Dispute Resolution

1. This Agreement shall be governed by و construed in accیاdance with the laws of هنگ‌کنگ.

2. Any dispute arising from the execution یا perfیاmance of this Agreement shall be resolved through amicable negotiation. اگر negotiation fails, either party may submit the dispute to the competent court located in the jurisdiction of the Platfیاm’s headquarters.

8. Miscellaneous

2. Your Representations

3. لغوlations, Transfers, و Changes

We will cancel, transfer یا otherwise make changes to دامنه name registrations under the following circumstances:

1. subject to the provisions of Paragraph 8, our receipt of written یا appropriate electronic instructions from you یا شما authیاized agent to take such action;

2. our receipt of an یاder from a court یا arبیتral tribunal, in each case of competent jurisdiction, requiring such action; و/یا

3. our receipt of a decision of an Administrative Panel requiring such action in any administrative proceeding to which you were a party و which was conducted under this Policy یا a later version of this Policy adopted by ICANN. (See Paragraph 4(i) و (k) below.)

4. We may also cancel, transfer یا otherwise make changes to a دامنه name registration in accیاdance with the terms of شما ثبت Agreement یا other legal requirements.

4. Mوatیاy Administrative Proceeding

This Paragraph sets fیاth the type of disputes fیا which you are required to submit to a mوatیاy administrative proceeding. These proceedings will be conducted befیاe one of the administrative-dispute-resolution سرویس providers listed اینجا (each, a "Provider").

1. Applicable Disputes. You are required to submit to a mوatیاy administrative proceeding in the event that a third party (a "complainant") asserts to the applicable Provider, in compliance with the Rules of Procedure, that

2. you have no rights یا legitimate interests in respect of the دامنه name; و

2. Evidence of ثبت و Use in بد Faith. Fیا the purposes of Paragraph 4(a)(iii), the following circumstances, in particular but without limitation, if found by the Panel to be present, shall be evidence of the registration و use of a دامنه name in bad faith:

1. circumstances indicating that you have ثبت نامed یا you have acquired the دامنه name primarily fیا the purpose of selling, renting, یا otherwise transferring the دامنه name registration to the complainant who is the owner of the trademark یا سرویس mark یا to a competitیا of that complainant, fیا valuable consideration in excess of شما documented out-of-pocket costs directly related to the دامنه name; یا

2. you have ثبت نامed the دامنه name in یاder to قبلیent the owner of the trademark یا سرویس mark from reflecting the mark in a cیاresponding دامنه name, provided that you have engaged in a pattern of such conduct; یا

3. you have ثبت نامed the دامنه name primarily fیا the purpose of disrupting the business of a competitیا; یا

4. by using the دامنه name, you have intentionally attempted to attract, fیا commercial gain, Internet users to شما web site یا other on-line location, by creating a likelihood of confusion with the complainant's mark as to the source, sponsیاship, affiliation, یا endیاsement of شما web site یا location یا of a product یا سرویس on شما web site یا location.

3. How to Demonstrate Your Rights to و Legitimate Interests in the نام دامنه in Responding to a Complaint. When you receive a complaint, you should refer to Paragraph 5 of the Rules of Procedure in determining how شما response should be prepared. Any of the following circumstances, in particular but without limitation, if found by the Panel to be proved based on its evaluation of all evidence presented, shall demonstrate شما rights یا legitimate interests to the دامنه name fیا purposes of Paragraph 4(a)(ii):

1. befیاe any notice to you of the dispute, شما use of, یا demonstrable preparations to use, the دامنه name یا a name cیاresponding to the دامنه name in connection with a bona fide offering of goods یا سرویسs; یا

2. you (as an individual, business, یا other یاganization) have been commonly kاکنونn by the دامنه name, even if you have acquired no trademark یا سرویس mark rights; یا

3. you are making a legitimate noncommercial یا fair use of the دامنه name, without intent fیا commercial gain to misleadingly divert consumers یا to tarnish the trademark یا سرویس mark at issue.

4. Selection of Provider. The complainant shall select the Provider from among those approved by ICANN by submitting the complaint to that Provider. The selected Provider will administer the proceeding, except in cases of consolidation as described in Paragraph 4(f).

5. Initiation of Proceeding و Process و Appointment of Administrative Panel. The Rules of Procedure state the process fیا initiating و conducting a proceeding و fیا appointing the panel that will decide the dispute (the "Administrative Panel").

6. Consolidation. In the event of multiple disputes between you و a complainant, either you یا the complainant may petition to consolidate the disputes befیاe a single Administrative Panel. This petition shall be made to the first Administrative Panel appointed to hear a pending dispute between the parties. This Administrative Panel may consolidate befیاe it any یا all such disputes in its sole discretion, provided that the disputes being consolidated are governed by this Policy یا a later version of this Policy adopted by ICANN.

7. Fees. همه fees charged by a Provider in connection with any dispute befیاe an Administrative Panel pursuant to this Policy shall be paid by the complainant, except in cases wاینجا you elect to expو the Administrative Panel from one to three panelists as provided in Paragraph 5(b)(iv) of the Rules of Procedure, in which case all fees will be split evenly by you و the complainant.

8. ما Involvement in Administrative Proceedings. We do not, و will not, participate in the administration یا conduct of any proceeding befیاe an Administrative Panel. In addition, we will not be liable as a result of any decisions rendered by the Administrative Panel.

9. Remedies. The remedies available to a complainant pursuant to any proceeding befیاe an Administrative Panel shall be limited to requiring the cancellation of شما دامنه name یا the transfer of شما دامنه name registration to the complainant.

The Provider shall notify us of any decision made by an Administrative Panel with respect to a دامنه name you have ثبت نامed with us. همه decisions under this Policy will be published in full over the Internet, except when an Administrative Panel determines in an exceptional case to redact pیاtions of its decision.

11. Availability of Court Proceedings. The mوatیاy administrative proceeding requirements set fیاth in Paragraph 4 shall not قبلیent either you یا the complainant from submitting the dispute to a court of competent jurisdiction fیا independent resolution befیاe such mوatیاy administrative proceeding is commenced یا after such proceeding is concluded. اگر an Administrative Panel decides that شما دامنه name registration should be canceled یا transferred, we will wait ten (10) business days (as observed in the location of our principal office) after we are infیاmed by the applicable Provider of the Administrative Panel's decision befیاe implementing that decision. We will then implement the decision unless we have received from you during that ten (10) business day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that you have commenced a lawsuit against the complainant in a jurisdiction to which the complainant has submitted under Paragraph 3(b)(xiii) of the Rules of Procedure. (In general, that jurisdiction is either the location of our principal office یا of شما address as shown in our Whois database. 1. Definitions

1.1 Dispute Resolution Panel

     The Dispute Resolution Panel shall mean an administrative panel appointed by a Dispute Resolution Provider ("Provider") to decide a Request fیا Enfیاcement concerning a dispute under this Dispute Resolution Policy.

1.2 Dispute Resolution Provider

1.7 Registrant

     The Registrant is the individual یا یاganization that ثبت نامs a specific دامنه name. This individual یا یاganization holds the right to use that specific دامنه name fیا a specified period of time, provided certain conditions are met و the registration fees are paid. This person یا یاganization is the "legal entity" bound by the terms of the relevant سرویس agreement with the Registry operatیا fیا the TLD in question.

1.8 Registry (Registry Operatیا)

1.9 Supplemental Rules

2.2 Second-سطح - Dispute Resolution Panel

     The primary intent of this step is to provide a means fیا registrars to appeal decisions made by the Registry at the first level of the dispute resolution process, but it may also be used as the first step if a registrar so elects. The decision of the Dispute Resolution Panel is final, except as it may be appealed to a court of competent jurisdiction.

2.3 Statute of Limitations

     A dispute must be filed no later than six (6) months after the alleged violation of the Transfer Policy. In the case wاینجا a ثبت‌کننده of Recیاd alleges that a transfer was in violation of this Policy, the date the transfer was completed shall be deemed the date in which the "alleged violation" took place. In the case wاینجا a Gaining ثبت‌کننده alleges that a transfer should have taken place, the date in which the NACK (as defined below) was received by the Registry, shall be deemed the date in which the "alleged violation" took place.

3. Dispute Procedures at the First سطح (Registry)

3.1 ثبت‌کننده files a Request fیا Enfیاcement with the applicable Registry Operatیا

     3.1.1 Either the Gaining یا ثبت‌کننده of Recیاd ("Filing ثبت‌کننده") may submit a Request fیا Enfیاcement. This must be done in accیاdance with the Supplemental Rules adopted by the applicable Registry Operatیا.

     3.1.2 The Request fیا Enfیاcement shall be submitted to the Registry و to the Respondent (the خیرn-filing ثبت‌کننده) in electronic fیاm و shall:
     (i) Request that the Request fیا Enfیاcement be submitted fیا decision in accیاdance with the ثبت‌کننده Transfer و Dispute Resolution Policy و the applicable Supplemental Rules;
     (ii) Provide the name, postal و e-mail addresses, و the telephone و fax numbers of the Filing ثبت‌کننده و those representatives authیاized by the Filing ثبت‌کننده to act on behalf of the Filing ثبت‌کننده in the administrative proceeding;
     (iii) Provide the name of the Respondent و all infیاmation (including any postal و e-mail addresses و telephone و fax numbers) kاکنونn to Filing ثبت‌کننده regarding how to contact Respondent یا any representative of Respondent, including contact infیاmation based on pre-complaint dealings;
     (iv) Specify the دامنه name(s) that is/are the subject of the Request fیا Enfیاcement;
     (v) Specify the incident(s) that gave rise to the dispute;
     (vi) Describe, in accیاdance with the Policy, the grounds on which the Request fیا Enfیاcement is based;
     (vii) State the specific remedy being sought (either approval یا denial of the transfer);
     (viii) Identify any other legal proceedings that have been commenced یا terminated in connection with یا relating to any of the دامنه name(s) that are the subject of the complaint;
     (ix) Certify that a copy of the Request fیا Enfیاcement, together with the cover sheet as prescribed by the Provider's Supplemental Rules, has been sent یا transmitted to the Respondent; و
     (x) Conclude with the following statement followed by the signature of the Complainant یا its authیاized representative:
           "<insert name of Filing ثبت‌کننده> agrees that its claims و remedies concerning the registration of the دامنه name, the dispute, یا the dispute's resolution shall be solely against the Respondent و waives all such claims و remedies against the Registry Operatیا as well as its directیاs, officers, employees, و agents, except in the case of deliberate wrongdoing یا gross negligence."
           "<insert name of Filing ثبت‌کننده> certifies that the infیاmation contained in this Request fیا Enfیاcement is to the best of Filing ثبت‌کننده's kاکنونledge complete و accurate, that this Request fیا Enfیاcement is not being presented fیا any improper purpose, such as to harass, و that the assertions in this Request fیا Enfیاcement are warranted under this Policy و under applicable law, as it اکنون exists یا as it may be extended by a good-faith و reasonable argument."3.1.3 The Request fیا Enfیاcement may relate to mیاe than one دامنه name, provided that the دامنه names involve the same Filing ثبت‌کننده و Respondent و that the claims arise out of the same یا similar factual circumstances.

3.1.4 The Request fیا Enfیاcement shall annex the following documentary evidence (as applicable و available) in electronic fیاm if possible, together with a schedule indexing such evidence:
  (i) Fیا the Gaining ثبت‌کننده:
      a. Completed Fیاm of Authیاization ("FOA")
      b. Copy of the Whois output fیا the date transfer was initiated, which was used to identify the authیاized Transfer تماسs
      c. Copy of evidence of identity used
      d. Copy of a bilateral agreement, final determination of a dispute resolution body یا court یاder in cases when the Registrant of Recیاd is being changed simultaneously with a ثبت‌کننده Transfer
      e. Copies of all communications made to the ثبت‌کننده of Recیاd with regard to the applicable transfer request along with any responses from the ثبت‌کننده of Recیاd
  (ii) Fیا the ثبت‌کننده of Recیاd:
      a. Completed FOA from ثبت‌کننده of Recیاd if applicable
      b. Copy of the Whois output fیا the date the transfer was initiated
      c. Relevant histیاy of Whois modifications made to the applicable registration
      d. Evidence of one of the following if a transfer was denied:

• fraud;
• UDRP action;
• court یاder;
• Registrant یا administrative contact identity dispute in accیاdance with Section 4 [ثبت‌کننده of Recیاd Requirements]
• applicable payment dispute along with evidence that the registration was put on HOLD status;
• express written objection from the ثبت نامed نام Holder یا Administrative تماس;
• LOCK status along with proof of a reasonable means fیا the registrant to remove LOCK status as per Section __of Exhiبیت __ to this Agreement;
• دامنه name within 60 days of initial registration; یا
• دامنه name within 60 days of a priیا transfer.

      e. Copies of all communications made to the Gaining ثبت‌کننده with regard to the applicable transfer request along with any responses from the Gaining ثبت‌کننده.

3.2 The خیرn-Filing ثبت‌کننده ("Respondent") shall have seven (7) calendar days from receipt of the Request fیا Enfیاcement to prepare a Response to the Request fیا Enfیاcement ("Response").

3.2.1 The Response shall be submitted in electronic fیاm to both the Registry و Filing ثبت‌کننده و shall:
      (i) Respond specifically to the statements و allegations contained in the Request fیا Enfیاcement (This pیاtion of the response shall comply with any wیاd یا page limit set fیاth in the Dispute Resolution Provider's Supplemental Rules.);
      (ii) Provide the name, postal و e-mail addresses, و the telephone و fax numbers of the Respondent (non-filing ثبت‌کننده);
      (iii) Identify any other legal proceedings that have been commenced یا terminated in connection with یا relating to any of the دامنه name(s) that are the subject of the Request fیا Enfیاcement;
      (iv) State that a copy of the Response has been sent یا transmitted to the Filing ثبت‌کننده;
      (v) Conclude with the following statement followed by the signature of the Respondent یا its authیاized representative:
   "Respondent certifies that the infیاmation contained in this Response is to the best of Respondent's kاکنونledge complete و accurate, that this Response is not being presented fیا any improper purpose, such as to harass, و that the assertions in this Response are warranted under these Rules و under applicable law, as it اکنون exists یا as it may be extended by a good-faith و reasonable argument."; و
     (vi) Annex any documentary یا other evidence upon which the Respondent relies, together with a schedule indexing such documents.

3.2.2 در the request of the Respondent, the Registry Operatیا may, in exceptional cases, extend the period of time fیا the filing of the response, but in no case may the extension be mیاe than an additional five (5) calendar days. The period may also be extended by written stipulation between the Parties, provided the stipulation is approved by the Registry Operatیا.

3.2.3 اگر a Respondent does not submit a response, in the absence of exceptional circumstances, the Registry Operatیا shall decide the dispute based upon the Request fیا Enfیاcement.

3.3 Registry Operatیا must review all applicable documentation و compare registrant/contact data with that contained within the authیاitative Whois database و reach a conclusion not later than 14 days after receipt of the Response.

3.3.1 اگر the data included in the Request fیا Enfیاcement does not match the data listed in the authیاitative Whois, the Registry Operatیا must contact each ثبت‌کننده و require additional documentation.

3.3.2 اگر the Gaining ثبت‌کننده cannot provide a complete FOA with data matching that contained within the authیاitative Whois database, then the Registry Operatیا shall find that the transfer should be reversed. In the case of a thick Registry, if the ثبت‌کننده of Recیاd's Whois is not accessible یا invalid, the Registry Operatیا's Whois should be used. In the case of a thin Registry, if the ثبت‌کننده of Recیاd's Whois is not accessible یا is invalid, the Registry Operatیا must notify ICANN و place the dispute on hold until such time as the specific problem is resolved by ICANN.

3.3.3 In the case wاینجا a ثبت‌کننده of Recیاd denies a request fیا a دامنه name transfer ("NACKs"), the ثبت‌کننده of Recیاd must provide evidence of one of the factیاs fیا which it is allowed to NACK. اگر the ثبت‌کننده of Recیاd cannot provide evidence that demonstrates any of the factیاs, و the Gaining ثبت‌کننده provides to the Registry a complete FOA with data matching that contained within the authیاitative Whois database, then the transfer must be approved to be processed.

3.3.4 اگر the data provided by neither ثبت‌کننده appears to be conclusive, then the Registry shall issue a finding of "no decision." اگر the data provided to the Registry is complete و provides sufficient basis fیا a determination based on the Policy, the Registry may not issue a finding of "no decision." Either ثبت‌کننده shall be able to appeal such issue to a Second-سطح Dispute Resolution Provider in accیاdance with the provisions set fیاth below.

3.4 Fees fیا First-سطح Dispute Resolution Service

3.4.1 Tاینجا is no filing fee assessed to the Filing ثبت‌کننده at the time the Request fیا Enfیاcement is submitted to the Registry Operatیا.

3.4.2 The ثبت‌کننده that does not قبلیail in the dispute will be assessed a fee to be set by the Registry Operatیا. Such fee shall be set fیاth in the Registry's Supplemental Rules that are in effect at the time that the Request fیا Enfیاcement was filed.

3.4.3 This fee shall not be passed on to the Registrant.

3.4.4 This fee will be charged after a final decision is rendered by the Registry. In the case that the Registry issues a finding of "no decision," the Registry Operatیا shall collect the applicable fees from the Filing ثبت‌کننده.

3.5 Availability of Court Proceedings

      The procedures set fیاth above shall not قبلیent a ثبت‌کننده from submitting a dispute to a court of competent jurisdiction fیا independent resolution befیاe such an administrative proceeding is commenced یا after such proceeding is concluded. اگر a Registry Operatیا decides a دامنه name registration should be transferred (either to the Gaining ثبت‌کننده, یا alternatively, back from the Gaining ثبت‌کننده to the ثبت‌کننده of Recیاd), the Registry will wait fourteen (14) calendar days after it is infیاmed of the decision befیاe implementing that decision. The Registry will then implement the decision unless it has received during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted دامنه name(s). اگر such documentation is received by the Registry Operatیا within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented to the Registry Operatیا that the parties have resolved such dispute; (ii) evidence is presented to the Registry Operatیا that the lawsuit has been dismissed یا withdrawn; یا (iii) the Registry Operatیا receives a copy of an یاder from such court.

4. Dispute Procedures at the Second سطح with a Dispute Resolution Provider

4.1 The سرویسs of the Dispute Resolution Panel may be invoked in any of the following two situations:

      (i) A Filing ثبت‌کننده may elect to skip the First-سطح dispute process at Registry level و submit a Request fیا Enfیاcement directly with a Dispute Resolution Provider;
      (ii) The non-قبلیailing ثبت‌کننده in a First-سطح dispute proceeding may submit an appeal of the applicable Registry Operatیا's decision to the Dispute Resolution Provider. افزودنitionally, in the case wاینجا the result in the First-سطح dispute process is a "no-decision," either ثبت‌کننده may file an Appeal of such decision to a Dispute Resolution Provider.

4.2 Initial Request fیا Enfیاcement

4.2.1 In the event that the Filing ثبت‌کننده elects to submit a Request fیا Enfیاcement to the Dispute Resolution Provider in lieu of submitting a Request fیا Enfیاcement to the applicable Registry Operatیا, the obligations و responsibilities set fیاth in Sections 3.1 through 3.2 above shall apply.

4.2.2 The Dispute Resolution Panel appointed by the Dispute Resolution Provider must review all applicable documentation و compare registrant/contact data with that contained within the authیاitative Whois database و reach a conclusion not later than thirty (30) days after receipt of Response from the Respondent.
     (i) اگر the data does not match the data listed in authیاitative Whois, the Dispute Resolution Panel should contact each ثبت‌کننده و require additional documentation.
     (ii) اگر the Gaining ثبت‌کننده is unable to provide a complete FOA with data matching that contained within the authیاitative Whois database at the time of the transfer request, then the Dispute Resolution Panel shall find that the transfer should be reversed. In the case of a thick Registry, if the ثبت‌کننده of Recیاd's Whois is not accessible یا invalid, the applicable Registry Operatیا's Whois should be used. In the case of a thin Registry, if the ثبت‌کننده of Recیاd's Whois is not accessible یا is invalid, the Dispute Resolution Provider may place the dispute on hold until such time as the problem is resolved.
     (iii) In the case wاینجا a ثبت‌کننده of Recیاd NACKs a transfer, the ثبت‌کننده of Recیاd must provide evidence of one of the factیاs fیا which it is allowed to NACK as set fیاth in Section 3.1.4 (ii) of this Dispute Resolution Policy. اگر the ثبت‌کننده of Recیاd cannot provide evidence that demonstrates any of the factیاs, و the Gaining ثبت‌کننده provides to the Dispute Resolution Provider a complete FOA with data matching that contained within the authیاitative Whois database at the time of the transfer request, then the transfer should be approved.
     (iv) Unlike under the First-سطح dispute process, the Dispute Resolution Panel may not issue a finding of "no decision." It must weigh the applicable evidence in light of the Transfer policies و determine, based on a preponderance of the evidence, which ثبت‌کننده should قبلیail in the dispute و what resolution to the Request fیا Enfیاcement will appropriately redress the issues set fیاth in the Request fیا Enfیاcement.
     (v) Resolution options fیا the Dispute Resolution Panel are limited to the following:
  a. Approve Transfer
  b. Deny the Transfer (یا یاdering the دامنه name be returned to the ثبت‌کننده of Recیاd in cases wاینجا a Transfer has already occurred)

4.3 Appeal of First سطح Dispute Decision یا Registry Operatیا Finding of "خیر-Decision."

4.3.1 In the event that the ثبت‌کننده which does not قبلیail in the First-سطح dispute is dissatisfied by the Registry-Operatیا's decision, such ثبت‌کننده may file an appeal with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-سطح decision was issued.

4.3.2 In the event that the Registry Operatیا issues a finding of "no-decision" in accیاdance with Section 3.3.4 above, either ثبت‌کننده may file an appeal of such decision with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-سطح decision was issued.

4.3.3 In either case, the document submitted by the ثبت‌کننده to the Dispute Resolution Provider shall be referred to as an "Appeal."

4.3.4 The Appellant shall submit the Appeal in electronic fیاm و shall:
     (i) Request that the Appeal be submitted fیا decision in accیاdance with the Policy و these Rules;
     (ii) Provide the name, postal و e-mail addresses, و the telephone و telefax numbers of the Appellant و of any representative authیاized by the Appellant to act on behalf of the Appellant in the administrative proceeding;
     (iii) Provide the name of the Appellee و all infیاmation (including any postal و e-mail addresses و telephone و telefax numbers) kاکنونn to Appellee regarding how to contact Appellee یا any representative of Appellee, including contact infیاmation based on pre-Request fیا Enfیاcement و pre-Appeal dealings;
     (iv) Specify the دامنه name(s) that is/are the subject of the Appeal;
     (v) Specify the incident(s) which gave rise to the dispute;
     (vi) State the basis fیا such appeal, including specific responses to the findings of the Registry Operatیا in the First-سطح Dispute process. (This pیاtion of the response shall comply with any wیاd یا page limit set fیاth in the Dispute Resolution Provider's Supplemental Rules);
     (vii) Specify, in accیاdance with the Policy, the remedies sought;
     (viii) Identify any other related legal proceedings kاکنونn to the Appellant that have been commenced یا terminated in connection with یا relating to any of the دامنه name(s) that are the subject of the complaint;
      (ix) State that a copy of the Appeal, together with the cover sheet as prescribed by the Dispute Resolution Provider's Supplemental Rules, has been sent یا transmitted to the Appellee; و
      (x) Conclude with the following statement followed by the signature of the Appellant یا its authیاized representative:
  "Appellant agrees that its claims و remedies concerning the registration of the دامنه name, the dispute, یا the dispute's resolution shall be solely against the Appellee و waives all such claims و remedies against the Dispute Resolution Provider و the Registry Operatیا as well as their directیاs, officers, employees, و agents, except in the case of deliberate wrongdoing یا gross negligence."
  "Appellant certifies that the infیاmation contained in this Appeal is to the best of Appellant's kاکنونledge complete و accurate, that this Appeal is not being presented fیا any improper purpose, such as to harass, و that the assertions in this Appeal are warranted under this Policy و under applicable law, as it اکنون exists یا as it may be extended by a good-faith و reasonable argument."

4.3.5 The Appeal may relate to mیاe than one دامنه name, provided that the دامنه names involve the same decision issued by the Registry Operatیا fیا the First-سطح Dispute.4.3.6 The Appeal shall annex any documentary evidence that was not already submitted to the Registry Operatیا during the First-سطح Dispute.

4.3.7 A Dispute Resolution Provider must request all documentation relating to the First-سطح Dispute from the applicable Registry Operatیا no later than seven (7) calendar days of receipt of the appeal. The Registry Operatیا shall submit such documentation to the Dispute Resolution Provider within seven (7) days of such request.

4.3.8 The Dispute Resolution Panel must review all applicable documentation و reach a conclusion not later than 30 calendar days after receipt of the Appeal.
     (i) The Dispute Resolution Panel may submit questions to the Registry, the Appellant یا Appellee.
     (ii) Responses to all such questions must be received by the Dispute Resolution Panel within 7 days.
     (iii) The Dispute Resolution Panel shall review each Appeal on a De خیرvo basis. Although the Dispute Resolution Panel is not bound by the findings of the Registry Operatیا in an Appeal, it shall have the discretion to consider such findings in reaching its own conclusions. The purpose of the Dispute Resolution Panel should be to make a determination as to whether the Appeal has merit based solely on the requirements of the current Transfer policy و determine the appropriate resolution to the issues presented.

• Approval of a Transfer
• Denial of the Transfer (یا یاdering the دامنه name be returned to the ثبت‌کننده of Recیاd in cases wاینجا a Transfer has already occurred)

4.4 Fees fیا Second-سطح Dispute Resolution Service

4.4.1 In the case of either a Request fیا Enfیاcement یا an Appeal filed at the Second سطح, the applicable Dispute Resolution Provider shall determine the applicable filing fee ("Filing Fee"). The specific fees along with the terms و conditions governing the actual payment of such fees shall be included in the Dispute Resolution Provider's Supplemental Rules.

4.4.2 In the event that the Filing ثبت‌کننده یا Appellant, whichever applicable, does not قبلیail in a Second-سطح dispute, the Filing Fees shall be retained by the Dispute Resolution Provider.

4.4.3 In the event that the Filing ثبت‌کننده یا Appellant, whichever applicable, قبلیails in a Second-سطح dispute, the Respondent یا Appellee, whichever applicable, must submit to the Dispute Resolution Provider, the Filing Fees within fourteen (14) calendar days after such decision. In such an event, the Dispute Resolution Provider shall refund to the Filing ثبت‌کننده یا Appellant, whichever applicable, the Filing Fees, no later than fourteen (14) calendar days after it receives the Filing Fees from the Respondent یا Appellee. Such fees must be paid regardless of whether a Court Proceeding is commenced in accیاdance with Section 4.5 below. Failure to pay Filing Fees to the Dispute Resolution Provider may result in the loss of accreditation by ICANN.

4.5 Availability of Court Proceedings

     The procedures set fیاth above shall not قبلیent a ثبت‌کننده from submitting a dispute to a court of competent jurisdiction fیا independent resolution befیاe such administrative proceeding is commenced یا after such proceeding is concluded. اگر a Dispute Resolution Panel decides a دامنه name registration should be transferred (either to the Gaining ثبت‌کننده, یا alternatively, back from the Gaining ثبت‌کننده to the ثبت‌کننده of Recیاd), such ثبت‌کننده will wait fourteen (14) calendar days after it is infیاmed of the decision befیاe implementing that decision. The Registry will then implement the decision unless it has received from either of the parties to the dispute during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted دامنه name(s). اگر such documentation is received by the Registry, as applicable, within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented that the parties have resolved such dispute; (ii) evidence is presented that the lawsuit has been dismissed یا withdrawn; یا (iii) a copy of an یاder from such court dismissing the lawsuit یا یاdering certain actions with respect to the دامنه name.

1. ثبت‌کننده Requirements

     ثبت نامed نام Holders must be able to transfer their دامنه name registrations between ثبت‌کنندهs provided that the Gaining ثبت‌کننده's transfer process meets the minimum stوards of this policy و that such transfer is not prohiبیتed by ICANN یا Registry policies. Inter-ثبت‌کننده دامنه name transfer processes must be clear و concise in یاder to avoid confusion. Further, ثبت‌کنندهs should make reasonable effیاts to infیاm ثبت نامed نام Holders of, و provide access to, the published documentation of the specific transfer process employed by the ثبت‌کنندهs.

1.1 Transfer Authیاities

     The Administrative تماس و the ثبت نامed نام Holder, as listed in the Losing ثبت‌کننده's یا applicable Registry's (wاینجا available) publicly accessible WHOIS سرویس are the only parties that have the authیاity to approve یا deny a transfer request to the Gaining ثبت‌کننده. In the event of a dispute, the ثبت نامed نام Holder's authیاity supersedes that of the Administrative تماس.
ثبت‌کنندهs may use Whois data from either the ثبت‌کننده of Recیاd یا the relevant Registry fیا the purpose of verifying the authenticity of a transfer request; یا from another data source as determined by a consensus policy.

2. Gaining ثبت‌کننده Requirements

Fیا each instance wاینجا a ثبت نامed نام Holder requests to transfer a دامنه name registration to a different ثبت‌کننده, the Gaining ثبت‌کننده shall:
      2.1 Obtain express authیاization from either the ثبت نامed نام Holder یا the Administrative تماس (اینجاafter, "Transfer تماس"). Hence, a transfer may only proceed if confirmation of the transfer is received by the Gaining ثبت‌کننده from the Transfer تماس.

     2.1.1 The authیاization must be made via a valid Stوardized Fیاm of Authیاization (FOA). Tاینجا are two different FOA's available at the ICANN website. The FOA labeled "Initial Authیاization fیا ثبت‌کننده Transfer" must be used by the Gaining ثبت‌کننده to request an authیاization fیا a registrar transfer from the Transfer تماس. The FOA labeled "تأییدation of ثبت‌کننده Transfer Request" may be used by the ثبت‌کننده of Recیاd to request confirmation of the transfer from the Transfer تماس.
The FOA shall be communicated in English, و any dispute arising out of a transfer request shall be conducted in the English language. ثبت‌کنندهs may choose to communicate with the Transfer تماس in additional languages. However, ثبت‌کنندهs choosing to exercise such option are responsible fیا the accuracy و completeness of the translation into such additional non-English version of the FOA.

     2.1.2 In the event that the Gaining ثبت‌کننده relies on a physical process to obtain this authیاization, a paper copy of the FOA will suffice insofar as it has been signed by the Transfer تماس و further that it is accompanied by a physical copy of the ثبت‌کننده of Recیاd's Whois output fیا the دامنه name in question.

     2.1.2.1 اگر the Gaining ثبت‌کننده relies on a physical authیاization process, then the Gaining ثبت‌کننده assumes the burden of obtaining reliable evidence of the identity of the Transfer تماس و maintaining appropriate recیاds proving that such evidence was obtained. Further the Gaining ثبت‌کننده also assumes the burden fیا ensuring that the entity making the request is indeed authیاized to do so. The acceptable fیاms of physical identity are:

• خیرtarized statement
• Valid Drivers license
• گذرنامه
• Article of Incیاpیاation
• Military ID
• State/Government issued ID
• Birth Certificate

     2.1.3 In the event that the Gaining ثبت‌کننده relies on an electronic process to obtain this authیاization the acceptable fیاms of identity would include:

• Electronic signature in confیاmance with national legislation, in the location of the Gaining ثبت‌کننده (if such legislation exists).
• Consent from an individual یا entity that has an email address matching the Transfer تماس email address. 

     The ثبت‌کننده of Recیاd may not deny a transfer request solely because it believes that the Gaining ثبت‌کننده has not received the confirmation set fیاth above.
A transfer must not be allowed to proceed if no confirmation is received by the Gaining ثبت‌کننده. The presumption in all cases will be that the Gaining ثبت‌کننده has received و authenticated the transfer request made by a Transfer تماس.

     2.2 Request, by the transmission of a "transfer" commو as specified in the ثبت‌کننده بهol Kit, that the Registry Operatیا database be changed to reflect the new ثبت‌کننده.

     2.2.1 Transmission of a "transfer" commو constitutes a representation on the part of the Gaining ثبت‌کننده that the requisite authیاization has been obtained from the Transfer تماس listed in the authیاitative Whois database.

     2.2.2 The Gaining ثبت‌کننده is responsible fیا validating the ثبت نامed نام Holder requests to transfer دامنه names between ثبت‌کنندهs. However, this does not preclude the ثبت‌کننده of Recیاd from exercising its option to independently confirm the ثبت نامed نام Holder's intent to transfer its دامنه name to the Gaining ثبت‌کننده in accیاdance with Section 3 of this policy.

3. Obligations of the ثبت‌کننده of Recیاd

     A ثبت‌کننده of Recیاd can choose independently to confirm the intent of the ثبت نامed نام Holder when a notice of a pending transfer is received from the Registry. The ثبت‌کننده of Recیاd must do so in a manner consistent with the stوards set fیاth in this agreement pertaining to Gaining ثبت‌کنندهs. In یاder to ensure that the fیاm of the request employed by the ثبت‌کننده of Recیاd is substantially administrative و infیاmative in nature و clearly provided to the Transfer تماس fیا the purpose of verifying the intent of the Transfer تماس, the ثبت‌کننده of Recیاd must use the FOA.

     The FOA shall be communicated in English, و any dispute arising out of a transfer request, shall be conducted in the English language. ثبت‌کنندهs may choose to communicate with the Transfer تماس in additional languages. However, the ثبت‌کننده choosing to exercise such option is responsible fیا the accuracy و completeness of the translation into such additional non-English version of the FOA. Further, such non-English communications must follow the processes و procedures set fیاth in this policy. This includes but is not limited to the requirement that no ثبت‌کننده shall add any additional infیاmation to the FOA used to obtain the consent of the Transfer تماس in the case of a transfer request.
This requirement does not preclude the ثبت‌کننده of Recیاd from marketing to its existing customers through separate communications.
The FOA should be sent by the ثبت‌کننده of Recیاd to the Transfer تماس as soon as operationally possible, but must be sent not later than twenty-four (24) hours after receiving the transfer request from the Registry Operatیا.Failure by the ثبت‌کننده of Recیاd to respond within five (5) calendar days to a notification from the Registry regarding a transfer request will result in a default "approval" of the transfer.

     In the event that a Transfer تماس listed in the Whois has not confirmed their request to transfer with the ثبت‌کننده of Recیاd و the ثبت‌کننده of Recیاd has not explicitly denied the transfer request, the default action will be that the ثبت‌کننده of Recیاd must allow the transfer to proceed.
Upon denying a transfer request fیا any of the following reasons, the ثبت‌کننده of Recیاd must provide the ثبت نامed نام Holder و the potential Gaining ثبت‌کننده with the reason fیا denial. The ثبت‌کننده of Recیاd may deny a transfer request only in the following specific instances:

1. Evidence of fraud
2. UDRP action
3. Court یاder by a court of competent jurisdiction
4. Reasonable dispute over the identity of the ثبت نامed نام Holder یا Administrative تماس
5. خیر payment fیا قبلیious registration period (including credit card charge-backs) if the دامنه name is past its expiration date یا fیا قبلیious یا current registration periods if the دامنه name has not yet expired. In all such cases, however, the دامنه name must be put into "ثبت‌کننده Hold" status by the ثبت‌کننده of Recیاd priیا to the denial of transfer.
6. Express written objection to the transfer from the Transfer تماس. (e.g. - email, fax, paper document یا other processes by which the Transfer تماس has expressly و voluntarily objected through opt-in means)
7. A دامنه name was already in “lock status” provided that the ثبت‌کننده provides a readily accessible و reasonable means fیا the ثبت نامed نام Holder to remove the lock status.
8. A دامنه name is in the first 60 days of an initial registration period.
9. A دامنه name is within 60 days (یا a lesser period to be determined) after being transferred (apart from being transferred back to the یاiginal ثبت‌کننده in cases wاینجا both ثبت‌کنندهs so agree و/یا wاینجا a decision in the dispute resolution process so directs).

Instances when the requested change of ثبت‌کننده may not be denied include, but are not limited to:

• خیرnpayment fیا a pending یا future registration period
• خیر response from the ثبت نامed نام Holder یا Administrative تماس.
• دامنه name in ثبت‌کننده Lock وضعیت, unless the ثبت نامed نام Holder is provided with the reasonable oppیاtunity و ability to unlock the دامنه name priیا to the Transfer Request.
• دامنه name registration period time constraints, other than during the first 60 days of initial registration یا during the first 60 days after a registrar transfer.
• General payment defaults between ثبت‌کننده و business partners / affiliates in cases wاینجا the ثبت نامed نام Holder fیا the دامنه in question has paid fیا the registration.

     The ثبت‌کننده of Recیاd has other mechanisms available to collect payment from the ثبت نامed نام Holder that are independent from the Transfer process. Hence, in the event of a dispute over payment, the ثبت‌کننده of Recیاd must not employ transfer processes as a mechanism to secure payment fیا سرویسs from a ثبت نامed نام Holder. Exceptions to this requirement are as follows:
     (i) In the case of non-payment fیا قبلیious registration period(s) if the transfer is requested after the expiration date, یا
     (ii) In the case of non-payment of the current registration period, if transfer is requested befیاe the expiration date.

4. ثبت‌کننده Coیاdination

     Each ثبت‌کننده is responsible fیا keeping copies of documentation, including the FOA و the Transfer تماسs response tاینجاto, that may be required fیا filing و suppیاting a dispute under the dispute resolution policy. Gaining ثبت‌کنندهs must maintain copies of the FOA as received from the Transfer تماس as per the stوard document retention policies of the contracts. Copies of the reliable evidence of identity must be kept with the FOA.

     Both the Gaining ثبت‌کننده و the ثبت‌کننده of Recیاd must provide the evidence relied on fیا the transfer during و after the applicable inter-registrar دامنه name transaction(s). Such infیاmation must be provided when requested by, و only by, the other ثبت‌کننده that is party to the transfer transaction. افزودنitionally, ICANN, the Registry Operatیا, a court یا authیاity with jurisdiction over the matter یا a third party dispute resolution panel may also require such infیاmation within five (5) days of the request.

     The Gaining ثبت‌کننده must retain, و produce pursuant to a request by a Losing ثبت‌کننده, a written یا electronic copy of the FOA. In instances wاینجا the ثبت‌کننده of Recیاd has requested copies of the FOA, the Gaining ثبت‌کننده must fulfill the ثبت‌کننده of Recیاds request (including providing the attendant suppیاting documentation) within five (5) calendar days. Failure to provide this documentation within the time period specified is grounds fیا reversal by the Registry Operatیا یا the Dispute Resolution Panel in the event that a transfer complaint is filed in accیاdance with the requirements of this policy.

     اگر either a ثبت‌کننده of Recیاd یا a Gaining ثبت‌کننده does not believe that a transfer request was hوled in accیاdance with the provisions of this policy, then the ثبت‌کننده may initiate a dispute resolution procedure as set fیاth in Section C of this policy.

     Fیا purposes of facilitating transfer requests, ثبت‌کنندهs should provide و maintain a unique و private email address fیا use only by other ثبت‌کنندهs و the Registry:
     i. This email address is fیا issue related to transfer requests و the procedures set fیاth in this policy only.
     ii. The email address should be managed to ensure messages are received by someone who can respond to the transfer issue.
     iii. پیغامs received at such email address must be responded to within a commercial reasonable timeframe not to exceed seven (7) calendar days.

5. EPP - based Registry Requirements fیا ثبت‌کنندهs

     In EPP-based gTLD Registries, ثبت‌کنندهs must follow the requirements set fیاth below.
ثبت‌کنندهs must provide the ثبت نامed نام Holder with the unique "AuthInfo" code within five (5) calendar days of the ثبت نامed نام Holder's initial request if the ثبت‌کننده does not provide facilities fیا the ثبت نامed نام Holder to generate و manage their own unique "AuthInfo" code.

     ثبت‌کنندهs may not employ any mechanism fیا complying with a ثبت نامed نام Holder's request to obtain the applicable "AuthInfo Code" that is mیاe restrictive than the mechanisms used fیا changing any aspect of the ثبت نامed نام Holder's contact یا name server infیاmation.

     The ثبت‌کننده of Recیاd must not refuse to release an "AuthInfo Code" to the ثبت نامed نام Holder solely because tاینجا is a dispute between the ثبت نامed نام Holder و the ثبت‌کننده over payment.

ثبت‌کننده-generated "AuthInfo" codes must be unique on a per-دامنه basis.
     The "Auth-Info" codes must be used solely to identify a ثبت نامed نام Holder, wاینجاas the FOA's still need to be used fیا authیاization یا confirmation of a transfer request, as described in Section 2 و Section 4 of this policy.

6. Registry Requirements

     Upon receipt of the "transfer" commو from the Gaining ثبت‌کننده, Registry Operatیا will transmit an electronic notification to both ثبت‌کنندهs. In the case of those Registries that use electronic mail notifications, the response notification may be sent to the unique email address established by each ثبت‌کننده fیا the purpose of facilitating transfers.

     The Registry Operatیا shall complete the requested transfer unless, within five (5) calendar days, Registry Operatیا receives a NACK protocol commو from the ثبت‌کننده of Recیاd.
When the Registry's database has been updated to reflect the change to the Gaining ثبت‌کننده, Registry Operatیا will transmit an electronic notification to both ثبت‌کنندهs. The notification may be sent to       the unique email address established by each ثبت‌کننده fیا the purpose of facilitating transfers یا such other email address agreed to by the parties.
The Registry Operatیا shall undo a transfer if, after a transfer has occurred, the Registry Operatیا receives one of the notices as set fیاth below. In such case, the transfer will be reversed و the دامنه name reset to its یاiginal state. The Registry Operatیا must undo the transfer within five (5) calendar days of receipt of the notice except in the case of a Registry dispute decision, in which case the Registry Operatیا must undo the transfer within fourteen calendar days unless a court action is filed. The notice required shall be one of the following:
     i. Agreement of the ثبت‌کننده of Recیاd و the Gaining ثبت‌کننده sent by email, letter یا fax that the transfer was made by mistake یا was otherwise not in accیاdance with the procedures set fیاth in this policy;
     ii. The final determination of a dispute resolution body having jurisdiction over the transfer; یا
     iii. Order of a court having jurisdiction over the transfer.

7. Recیاds of ثبت

     Each ثبت‌کننده shall require its customer, the ثبت نامed نام Holder, to maintain its own recیاds appropriate to document و prove the initial دامنه name registration date.

8. Effect on مدت of ثبت

     The completion by Registry Operatیا of a holder-authیاized transfer under this Part A shall result in a one-سال extension of the existing registration, provided that in no event shall the total unexpired term of a registration exceed ten (10) سال‌ها.

B. ICANN-Approved Transfers

     Transfer of the sponsیاship of all the registrations sponsیاed by one ثبت‌کننده as the result of (i) acquisition of that ثبت‌کننده یا its assets by another ثبت‌کننده, یا (ii) lack of accreditation of that ثبت‌کننده یا lack of its authیاization with the Registry Operatیا, may be made accیاding to the following procedure:
     (a) The gaining ثبت‌کننده must be accredited by ICANN fیا the Registry TLD و must have in effect a Registry-ثبت‌کننده Agreement with Registry Operatیا fیا the Registry TLD.
     (b) ICANN must certify in writing to Registry Operatیا that the transfer would promote the community interest, such as the interest in stability that may be threatened by the actual یا imminent business failure of a ثبت‌کننده.
Upon satisfaction of these two conditions, Registry Operatیا will make the necessary one-time changes in the Registry database fیا no charge, fیا transfers involving 50,000 name registrations یا fewer. اگر the transfer involves registrations of mیاe than 50,000 names, Registry Operatیا will charge the gaining ثبت‌کننده a one-time flat fee of US$ 50,000.

C. Transfer Dispute Resolution Policy

     Procedures fیا hوling disputes concerning inter-registrar transfers are set fیاth in the Transfer Dispute Resolution Policy. Procedures in this policy must be followed by the applicable Registry Operatیاs و ICANN accredited ثبت‌کنندهs.
