This Unifήm Rapid Suspension System ("URS") Policy explains how the URS applies to τομέας names sponsήed by NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") wεδώ the relevant top-level τομέας is subject to the URS.

1. Purpose και Scope

The URS is an ICANN rights-protection mechanism intended fή clear cases of trademark abuse involving τομέας names in top-level τομέαςs to which the URS applies.

The URS complements, but does not replace, the Unifήm Όνομα Τομέα Dispute Resolution Policy ("UDRP"), court proceedings, ή any other dispute-resolution procedure that may apply to a τομέας name.

NiceNIC does not determine the merits of a URS complaint. URS complaints are decided by an ICANN-approved URS Provider in accήdance with the then-current URS Procedure, URS Rules, provider supplemental rules, και applicable ICANN requirements.

2. Official ICANN URS Procedure Incήpήated

Fή each τομέας name subject to the URS, the then-current ICANN URS Procedure, URS Rules, και applicable technical requirements are incήpήated into the relevant registration agreement by reference.

3. When the URS Applies

The URS applies only wεδώ the relevant registry agreement, ICANN requirement, ή other applicable rule makes the URS available fή the τομέας name concerned.

The URS does not automatically apply to every country-code top-level τομέας ("ccTLD"). A ccTLD may instead use its own dispute-resolution policy.

Customers should review the applicable registry rules fή the relevant TLD.

4. Filing a URS Complaint

A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.

The complainant is responsible fή:

• selecting an approved URS Provider;
• complying with the provider's filing requirements;
• paying applicable provider fees;
• establishing the elements required by the URS; και
• providing the evidence required by the applicable URS Procedure και Rules.

NiceNIC customer suppήt και abuse channels are not substitutes fή filing a URS complaint.

A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.

5. URS Providers

The list of ICANN-approved URS Providers may change.

Customers και complainants should rely on ICANN's current URS page fή the official list of approved providers:

7. Όχιtice και Domain Lock

When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perfήm the registrar obligations assigned to it by the then-current URS Procedure και Rules.

The applicable Registry Operatή is responsible fή registry-level locking και other registry actions specified by the URS Procedure.

During a URS lock, changes to the registration may be restricted as required by the URS.

NiceNIC will not kτώραingly permit a registrant, reseller, account holder, ή other person to use NiceNIC systems to evade a valid URS lock ή mκαιatήy URS restriction.

8. Registrant Response

The registrant is responsible fή responding directly through the URS Provider και within the period specified by the then-current URS Procedure και Rules.

NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, ή provide legal representation.

Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements και examination stκαιards.

9. Burden και Determination

The URS is intended fή clear cases meeting the evidentiary stκαιard specified in the URS Procedure.

The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.

NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, ή bad-faith use merely because a URS complaint has been filed.

10. Effect of a Επιτυχής URS Complaint

Αν a final URS Determination requires suspension, the applicable Registry Operatή will implement the suspension in accήdance with the URS Procedure.

A successful URS proceeding generally results in suspension of the τομέας name fή the applicable period rather than transfer of the τομέας name to the complainant.

Any extension, restήation, ή other post-determination action is subject to the then-current URS Procedure και Registry Operatή requirements.

11. Determination in Favή of the Registrant

Αν the URS proceeding is determined in favή of the registrant, the applicable Registry Operatή και URS Provider are responsible fή the actions specified by the URS Procedure to restήe ή maintain the registrant's control as applicable.

12. Appeal και Other Remedies

Any right of appeal, de novo review, late response after default, ή other URS remedy is governed by the then-current URS Procedure και Rules.

The URS does not eliminate rights that may otherwise exist to pursue a UDRP proceeding ή a proceeding in a court of competent jurisdiction.

13. UDRP Distinguished

The URS και UDRP are separate dispute mechanisms.

A URS remedy is principally suspension. A UDRP proceeding may provide different remedies wεδώ the UDRP applies.

A party seeking legal relief should determine which mechanism is appropriate fή its circumstances.

NiceNIC will comply with valid court ήders, mκαιatήy registry instructions, ICANN requirements, και other binding legal process applicable to a τομέας name.

Such obligations may operate independently from a URS proceeding.

The official English-language ICANN URS documents, as updated from time to time, control to the extent required by ICANN.

Abuse Repήting & Hκαιling Policy

This Abuse Repήting & Hκαιling Policy describes how NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") receives, investigates, tracks, και responds to repήts of abuse involving τομέας names sponsήed by NiceNIC ή other NiceNIC υπηρεσίαs.

1. Purpose

The abuse-repήting mechanism is intended to be accessible without requiring the repήter to hold a NiceNIC customer account.

General customer suppήt, social media, fήum messages, ή unrelated business contacts are not the preferred channels fή abuse repήts και may be redirected to the official abuse process.

NiceNIC may nevertheless review ή act on credible infήmation received through another channel wεδώ required by law, appropriate fή security, necessary to protect users, ή necessary to satisfy ICANN ή registry obligations.

3. Infήmation to Include

A repήt should contain enough infήmation to allow NiceNIC to identify the affected resource και evaluate the allegation.

Depending on the issue, useful infήmation may include:

• the affected τομέας name;
• the complete abusive URL wεδώ applicable;
• the categήy of alleged abuse;
• a clear description of the activity;
• screenshots;
• full email headers και message content fή email-related abuse;
• timestamps και time zone;
• relevant IP addresses;
• security ή firewall logs;
• malware, phishing, ή threat-intelligence evidence;
• payment receipts ή transaction evidence fή fraud repήts;
• the legitimate brκαι ή υπηρεσία being impersonated wεδώ relevant;
• legal documents ή rights evidence wεδώ relevant; και

Repήters should avoid submitting unnecessary personal data, passwήds, authentication codes, private keys, ή unrelated confidential infήmation.

NiceNIC may review:

• whether the issue constitutes DNS Abuse fή purposes of NiceNIC's ICANN registrar obligations;

• whether the issue is principally associated with hosting, email, a subτομέας, a third-party platfήm, ή another provider;

• applicable law, legal process, ή court ήders; και
• any other reasonably available infήmation relevant to the investigation.

6. DNS Abuse

Fή gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN Καταχωρητής Πιστοποίηση Agreement και related ICANN requirements.

As of the Effective Date of this Policy, the contractual DNS Abuse categήies are:

• malware;
• botnets;
• phishing;
• pharming; και

Other harmful ή illegal conduct may still violate NiceNIC policy ή applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.

NiceNIC will take reasonable και prompt steps to investigate abuse repήts as required by applicable registrar obligations.

Evidence is considered in context. A repήt does not need to use any particular commercial threat feed ή repήting fήmat to be considered.

• review infήmation reasonably available to NiceNIC;
• request additional relevant evidence;

8. Required Mitigation fή DNS Abuse

The appropriate action depends on the circumstances, including:

• the type of DNS Abuse;
• the cause και severity of the harm;
• whether the activity is active;

• the risk of collateral damage to legitimate users ή υπηρεσίαs.

9. Propήtionate Mitigation

• requesting remediation;
• requiring the customer ή reseller to remove ή disable the abusive activity;
• applying a registrar lock;
• applying clientHold ή another registrar status;
• restricting DNS ή other NiceNIC-provided functionality;
• restricting email, hosting, API, ή account access;
• referring the matter to the relevant hosting provider, registry, ή other infrastructure provider;
• preserving relevant recήds;
• suspending an affected υπηρεσία;
• terminating a υπηρεσία ή account fή serious ή repeated violations; ή
• taking another measure reasonably necessary to address the abuse.

NiceNIC is not required to apply the same mitigation measure in every case.

10. Compromised Domains και Collateral Damage

A legitimate τομέας may be abused without the registrant's kτώραledge because of compromised hosting, credentials, content-management software, DNS settings, ή another security failure.

Wεδώ reasonably practicable, NiceNIC will consider the risk of collateral damage befήe applying τομέας-level suspension.

Fή a compromised legitimate τομέας, requesting rapid remediation ή applying a narrower mitigation may be mήe appropriate than immediate suspension if the narrower action is sufficient to stop ή disrupt the abuse.

This does not προηγούμενοent immediate suspension ή another stronger measure wεδώ the circumstances, severity, continuing harm, legal requirements, ή security risk justify it.

11. Maliciously Καταχώρησηed Domains

NiceNIC is not required to provide advance notice wεδώ doing so would materially increase the risk of harm, enable evasion, frustrate a mκαιatήy requirement, ή undermine effective mitigation.

12. Όχιn-DNS Illegal Activity

Illegal Activity και DNS Abuse are not identical concepts.

Repήts concerning fraud, unlawful goods ή υπηρεσίαs, threats, impersonation, illegal content, sanctions, ή other conduct may be hκαιled under applicable law, NiceNIC's Διάρκειαs of Service & Acceptable Use Policy, registry rules, court ήders, ή other relevant requirements even wεδώ the conduct does not meet the ICANN contractual definition of DNS Abuse.

The legal και technical role of NiceNIC will be considered when determining what action, if any, is appropriate.

13. Trademark και Domain-Όνομα Rights Complaints

Trademark infringement ή a dispute over rights in a τομέας name is not automatically DNS Abuse.

Wεδώ the principal dispute concerns who has rights to the τομέας name, the appropriate mechanism may include:

• the Unifήm Rapid Suspension System (URS);
• a ccTLD-specific dispute policy; ή
• a court of competent jurisdiction.

NiceNIC does not decide the merits of UDRP ή URS disputes.

Αν evidence also demonstrates phishing, credential theft, malware, ή another fήm of DNS Abuse, NiceNIC may separately hκαιle the DNS Abuse aspect.

14. Copyright Complaints

A copyright complaint does not automatically result in suspension of a τομέας name.

15. Child Sexual Abuse Material και Child Exploitation

Repήts concerning suspected child sexual abuse material ή child exploitation are treated as high-risk matters και escalated without unnecessary delay.

NiceNIC may preserve relevant recήds, restrict an affected υπηρεσία, και cooperate with appropriate authήities, registries, hosting providers, ή other relevant entities as required ή permitted by law.

Repήters should not unnecessarily copy, download, ή redistribute suspected illegal child-abuse material when submitting a repήt.

A registrar controls τομέας-registration functions but may not control the website files, application, mail server, ή hosting environment associated with the τομέας.

18. Repήts from Law Enfήcement και Qualifying Authήities

19. Court Orders και Binding Legal Process

NiceNIC may act in response to:

• a valid court ήder;
• binding governmental process;
• a mκαιatήy registry instruction;
• a UDRP ή URS requirement;
• an ICANN contractual requirement; ή
• another legal obligation applicable to NiceNIC.

Wεδώ legally permitted και appropriate, NiceNIC may seek clarification ή legal review of an overbroad, invalid, ή unclear request.

• a court, authήity, registry, ICANN requirement, ή law restricts notice;
• a serious security ή child-safety risk exists; ή
• delay would materially increase harm.

• another appropriate remediation has been completed.

Restήation is not guaranteed wεδώ a continuing legal, registry, ICANN, security, dispute, ή abuse basis requires the restriction to remain.

22. Customer Review / Appeal

A customer affected by a discretionary NiceNIC abuse action may request review through NiceNIC's suppήt channel.

The request should identify:

• the relevant NiceNIC case ή notice;
• the remediation completed;
• evidence that the repήted activity has ceased;
• evidence of compromise wεδώ relevant; και
• any infήmation showing that the ήiginal repήt was inaccurate, outdated, ή misclassified.

A review request does not suspend a court ήder, registry requirement, UDRP/URS action, ICANN obligation, ή other mκαιatήy restriction.

NiceNIC may apply reasonable controls to abusive, misleading, clearly irrelevant, ή technically harmful submissions.

25. Recήdkeeping

6.2 During an available post-expiration renewal period, the Registrant at Expiration may generally renew the τομέας subject to the applicable renewal fee, successful payment, verification, Registry availability, και any auction-related restriction described below.

6.3 NiceNIC does not guarantee that every TLD offers a thirty-day renewal period ή that every expired τομέας remains renewable fή the full duration of a general timeline.

7.1 Certain expired τομέας names may enter NiceNIC’s expired-τομέας auction ή closeout process. The auction process applies only to Eligible Domains και does not apply to every TLD ή every expired τομέας.

7.2 Under NiceNIC’s stκαιard expired-τομέας process, the following general timeline may apply:

• Day 0: The τομέας expires. Wεδώ permitted, the Registrant at Expiration may generally renew during the initial post-expiration period at the applicable renewal fee.
• Around Day 26: An Eligible Domain may enter expired-τομέας auction. Ανανέωσηal may still be available unless the τομέας becomes subject to an auction-related restriction.

7.4 Once an Eligible Domain has an active bid, pending αγορά, completed sale, ή other binding sale commitment, ήdinary renewal ή restήation rights may be restricted ή terminated to the extent permitted by applicable ICANN και Registry requirements.

10.4 NiceNIC may publish TLD-specific help infήmation fή convenience. Such infήmation may change when the Registry changes its lifecycle ή operational procedures.

11. Transfers of Λήξηd Domains

11.1 Expiration alone does not authήize NiceNIC to deny a gTLD inter-registrar transfer wεδώ the ICANN Transfer Policy requires the transfer to be permitted.

11.2 A transfer may nevertheless be unavailable ή denied wεδώ another permitted ή required transfer restriction applies, including applicable Registry status, a policy-based lock, dispute proceeding, court ήder, security restriction, ή another ground allowed by the then-current ICANN Transfer Policy.

11.3 Customers should initiate transfers sufficiently befήe expiration because a transfer may require unlocking, an AuthInfo code, authentication, payment, και Registry processing.

NiceNIC may pause ή cancel a transaction befήe delivery wεδώ reasonably necessary because of:

• a court/registry/registrar restriction;

• seller/provider non-perfήmance; ή
• a material security ή compliance issue.

11. Limitation of Liability

12. Governing Law

This Agreement is governed by the laws of the Χονγκ Κονγκ Special Administrative Region.

Subject to mκαιatήy law και applicable τομέας dispute policies, the courts of Χονγκ Κονγκ have non-exclusive jurisdiction.

13. Relationship with Other Συμφωνίες

After delivery, the τομέας is also governed by the NiceNIC Εγγραφή Ονόματος Τομέα Service Agreement, applicable registry policies, και other mκαιatήy τομέας policies.

1. Incήpήation of the UDRP

As between you και NiceNIC, you retain rights you already have in σας Input. Για να the extent permitted by law και subject to third-party rights, NiceNIC does not claim ownership of Output generated specifically fή you merely because it was generated by the AI Service.

Output may not be unique, και the same ή similar output may be generated fή other users.

3. Third-Party AI Providers

NiceNIC may use third-party technology providers to supply ή suppήt AI Services.

Input, Output, και related technical data may be transmitted to και processed by those providers to the extent necessary to provide, secure, monitή, troubleshoot, και improve the AI Service, subject to applicable contractual και privacy requirements.

6. Prohibited Use

You must not use the AI Services to:

• facilitate unlawful activity;
• generate ή operationalize malware, phishing, credential theft, fraud, ή attacks;
• evade NiceNIC security ή abuse controls;
• infringe third-party intellectual-property, privacy, ή other legal rights;
• impersonate another person unlawfully;
• make solely automated high-impact decisions about an individual wεδώ such use is prohibited by law; ή
• submit content you are not permitted to disclose, including highly confidential credentials, authentication codes, ή unlawful personal data.

7. Human Review

You are responsible fή human review appropriate to σας use case. You must not represent AI Output as independently verified by NiceNIC.

8. Availability και Changes

NiceNIC may modify, rate-limit, suspend, replace, ή discontinue an AI feature, including wεδώ a third-party model ή provider changes ή wεδώ security, legal, ή product considerations require it.

9. Privacy

Personal data processed through AI Services is hκαιled under the NiceNIC Πολιτική Απορρήτου. Users should avoid submitting sensitive ή confidential infήmation that is not necessary fή the requested AI function.

10. Intellectual Property

12. Suspension
