1. Scope এবং Purpose

2. Definitions

3. Effect of Expiration

Day 0 after expiration

Day 26 after expiration

The ডোমেইন name may enter expired ডোমেইন auction. এ this stage, the registrant may still be able to renew the ডোমেইন name at the stএবংard renewal fee, unless otherwise restricted by the applicable process.

Day 31 after expiration

6.4 NiceNIC does not guarantee that a ডোমেইন name will remain recoverable until the end of any stated period if the ডোমেইন is subject to auction, sale, registry restriction, অথবা another applicable limitation.

7. Redemption Grace Period

7.2 During the Redemption Grace Period:

9. TLD-Specific Variations

9.2 The following TLD-specific rules may apply, subject at all times to registry changes এবং the controlling registry rules:

9.2.2 TLDs with no Pending Delete stage

9.2.3 TLDs requiring renewal befঅথবাe the actual expiration date

The following TLDs may need to be renewed twelve (12) days befঅথবাe the actual Expiration Date. যদি not renewed in time, they may enter a recovery stage immediately, regardless of the number of calendar days remaining befঅথবাe expiration:

.GG ডোমেইন names may be reactivated from the customer account fঅথবা approximately twenty-eight (28) days after expiration. They may then enter a recovery stage between approximately Day 28 এবং Day 30 after expiration. Once in that stage, reactivation may only be possible through NiceNIC Suppঅথবাt fঅথবা approximately twenty-six (26) additional days.

9.2.7 .PH, .COM.PH, .NET.PH, এবং .ORG.PH ডোমেইনs

9.2.8 .UK ডোমেইনs, including second-level .UK ডোমেইনs

12. Limitation of Responsibility

1. General

7. Governing Law এবং Dispute Resolution

8. Miscellaneous

1. Applicable Disputes. You are required to submit to a mএবংatঅথবাy administrative proceeding in the event that a third party (a "complainant") asserts to the applicable Provider, in compliance with the Rules of Procedure, that

3. How to Demonstrate Your Rights to এবং Legitimate Interests in the ডোমেইন নাম in Responding to a Complaint. When you receive a complaint, you should refer to Paragraph 5 of the Rules of Procedure in determining how আপনার response should be prepared. Any of the following circumstances, in particular but without limitation, if found by the Panel to be proved based on its evaluation of all evidence presented, shall demonstrate আপনার rights অথবা legitimate interests to the ডোমেইন name fঅথবা purposes of Paragraph 4(a)(ii):

4. Selection of Provider. The complainant shall select the Provider from among those approved by ICANN by submitting the complaint to that Provider. The selected Provider will administer the proceeding, except in cases of consolidation as described in Paragraph 4(f).

We reserve the right to modify this Policy at any time with the permission of ICANN. We will post our revised Policy at this location at least thirty (30) calendar days befঅথবাe it becomes effective. Unless this Policy has already been invoked by the submission of a complaint to a Provider, in which event the version of the Policy in effect at the time it was invoked will apply to you until the dispute is over, all such changes will be binding upon you with respect to any ডোমেইন name registration dispute, whether the dispute arose befঅথবাe, on অথবা after the effective date of our change. 1. Definitions

1.1 Dispute Resolution Panel

     The Dispute Resolution Panel shall mean an administrative panel appointed by a Dispute Resolution Provider ("Provider") to decide a Request fঅথবা Enfঅথবাcement concerning a dispute under this Dispute Resolution Policy.

1.2 Dispute Resolution Provider

1.3 The Dispute Resolution Provider must be an independent এবং neutral third party that is neither associated nঅথবা affiliated with either রেজিস্ট্রার involved in the dispute অথবা the Registry Operatঅথবা under which the disputed ডোমেইন name is নিবন্ধন করুনed. 1.6 রেজিস্ট্রার of Recঅথবাd

     The রেজিস্ট্রার of Recঅথবাd fঅথবা a ডোমেইন name fঅথবা which the Registry received a transfer of sponsঅথবাship request.

1.7 Registrant

     The Registrant is the individual অথবা অথবাganization that নিবন্ধন করুনs a specific ডোমেইন name. This individual অথবা অথবাganization holds the right to use that specific ডোমেইন name fঅথবা a specified period of time, provided certain conditions are met এবং the registration fees are paid. This person অথবা অথবাganization is the "legal entity" bound by the terms of the relevant সেবা agreement with the Registry operatঅথবা fঅথবা the TLD in question.

1.8 Registry (Registry Operatঅথবা)

     The অথবাganization authঅথবাized by ICANN to provide registration সেবাs fঅথবা a given TLD to ICANN-accredited রেজিস্ট্রারs.

1.9 Supplemental Rules

     The Supplemental Rules shall mean those rules adopted by the Registry Operatঅথবা, in the case of First স্তর disputes (as set fঅথবাth below), অথবা the Provider administering a proceeding (in the case of all other disputes) to supplement this Policy. Supplemental Rules shall be consistent with this Dispute Resolution Policy এবং shall cover topics such as fees, wঅথবাd এবং page limits এবং guidelines, the means fঅথবা communicating with the Provider, এবং the fঅথবাm of cover sheets.

1.10 Transfer Policy

2. Dispute Resolution Process

     Tএখানে are two possible steps to the রেজিস্ট্রার Transfer Dispute Resolution Process. A রেজিস্ট্রার may elect one অথবা both of the steps pursuant to the rules below.      A রেজিস্ট্রার may choose to file a dispute directly with the relevant Registry Operatঅথবা. Any decisions made by the Registry Operatঅথবা may be appealed to a Dispute Resolution Provider. A রেজিস্ট্রার may file a dispute directly to a Dispute Resolution Provider; however, in that case the filing রেজিস্ট্রার would fঅথবাfeit any right to appeal the decision of the Dispute Resolution Provider.

2.2 Second-স্তর - Dispute Resolution Panel

     The primary intent of this step is to provide a means fঅথবা registrars to appeal decisions made by the Registry at the first level of the dispute resolution process, but it may also be used as the first step if a registrar so elects. The decision of the Dispute Resolution Panel is final, except as it may be appealed to a court of competent jurisdiction.

2.3 Statute of Limitations

     A dispute must be filed no later than six (6) months after the alleged violation of the Transfer Policy. In the case wএখানে a রেজিস্ট্রার of Recঅথবাd alleges that a transfer was in violation of this Policy, the date the transfer was completed shall be deemed the date in which the "alleged violation" took place. 3. Dispute Procedures at the First স্তর (Registry)

     3.1.1 Either the Gaining অথবা রেজিস্ট্রার of Recঅথবাd ("Filing রেজিস্ট্রার") may submit a Request fঅথবা Enfঅথবাcement. This must be done in accঅথবাdance with the Supplemental Rules adopted by the applicable Registry Operatঅথবা.

     3.1.2 The Request fঅথবা Enfঅথবাcement shall be submitted to the Registry এবং to the Respondent (the নাn-filing রেজিস্ট্রার) in electronic fঅথবাm এবং shall:
     (i) Request that the Request fঅথবা Enfঅথবাcement be submitted fঅথবা decision in accঅথবাdance with the রেজিস্ট্রার Transfer এবং Dispute Resolution Policy এবং the applicable Supplemental Rules;
     (ii) Provide the name, postal এবং e-mail addresses, এবং the telephone এবং fax numbers of the Filing রেজিস্ট্রার এবং those representatives authঅথবাized by the Filing রেজিস্ট্রার to act on behalf of the Filing রেজিস্ট্রার in the administrative proceeding;
     (iii) Provide the name of the Respondent এবং all infঅথবাmation (including any postal এবং e-mail addresses এবং telephone এবং fax numbers) kএখনn to Filing রেজিস্ট্রার regarding how to contact Respondent অথবা any representative of Respondent, including contact infঅথবাmation based on pre-complaint dealings;

     (v) Specify the incident(s) that gave rise to the dispute;
     (vi) Describe, in accঅথবাdance with the Policy, the grounds on which the Request fঅথবা Enfঅথবাcement is based;
     (vii) State the specific remedy being sought (either approval অথবা denial of the transfer);
     (viii) Identify any other legal proceedings that have been commenced অথবা terminated in connection with অথবা relating to any of the ডোমেইন name(s) that are the subject of the complaint;
     (ix) Certify that a copy of the Request fঅথবা Enfঅথবাcement, together with the cover sheet as prescribed by the Provider's Supplemental Rules, has been sent অথবা transmitted to the Respondent; এবং
     (x) Conclude with the following statement followed by the signature of the Complainant অথবা its authঅথবাized representative:
           "<insert name of Filing রেজিস্ট্রার> agrees that its claims এবং remedies concerning the registration of the ডোমেইন name, the dispute, অথবা the dispute's resolution shall be solely against the Respondent এবং waives all such claims এবং remedies against the Registry Operatঅথবা as well as its directঅথবাs, officers, employees, এবং agents, except in the case of deliberate wrongdoing অথবা gross negligence."
           "<insert name of Filing রেজিস্ট্রার> certifies that the infঅথবাmation contained in this Request fঅথবা Enfঅথবাcement is to the best of Filing রেজিস্ট্রার's kএখনledge complete এবং accurate, that this Request fঅথবা Enfঅথবাcement is not being presented fঅথবা any improper purpose, such as to harass, এবং that the assertions in this Request fঅথবা Enfঅথবাcement are warranted under this Policy এবং under applicable law, as it এখন exists অথবা as it may be extended by a good-faith এবং reasonable argument."3.1.3 The Request fঅথবা Enfঅথবাcement may relate to mঅথবাe than one ডোমেইন name, provided that the ডোমেইন names involve the same Filing রেজিস্ট্রার এবং Respondent এবং that the claims arise out of the same অথবা similar factual circumstances.

3.1.4 The Request fঅথবা Enfঅথবাcement shall annex the following documentary evidence (as applicable এবং available) in electronic fঅথবাm if possible, together with a schedule indexing such evidence:
  (i) Fঅথবা the Gaining রেজিস্ট্রার:
      a. Completed Fঅথবাm of Authঅথবাization ("FOA")
      b. Copy of the Whois output fঅথবা the date transfer was initiated, which was used to identify the authঅথবাized Transfer যোগাযোগs
      c. Copy of evidence of identity used
      d. Copy of a bilateral agreement, final determination of a dispute resolution body অথবা court অথবাder in cases when the Registrant of Recঅথবাd is being changed simultaneously with a রেজিস্ট্রার Transfer
      e. Copies of all communications made to the রেজিস্ট্রার of Recঅথবাd with regard to the applicable transfer request along with any responses from the রেজিস্ট্রার of Recঅথবাd
  (ii) Fঅথবা the রেজিস্ট্রার of Recঅথবাd:
      a. Completed FOA from রেজিস্ট্রার of Recঅথবাd if applicable
      b. Copy of the Whois output fঅথবা the date the transfer was initiated
      c. Relevant histঅথবাy of Whois modifications made to the applicable registration
      d. Evidence of one of the following if a transfer was denied:

• fraud;
• UDRP action;
• court অথবাder;
• Registrant অথবা administrative contact identity dispute in accঅথবাdance with Section 4 [রেজিস্ট্রার of Recঅথবাd Requirements]
• applicable payment dispute along with evidence that the registration was put on HOLD status;
• express written objection from the নিবন্ধন করুনed নাম Holder অথবা Administrative যোগাযোগ;
• LOCK status along with proof of a reasonable means fঅথবা the registrant to remove LOCK status as per Section __of Exhiবিট __ to this Agreement;

      e. Copies of all communications made to the Gaining রেজিস্ট্রার with regard to the applicable transfer request along with any responses from the Gaining রেজিস্ট্রার.

3.2 The নাn-Filing রেজিস্ট্রার ("Respondent") shall have seven (7) calendar days from receipt of the Request fঅথবা Enfঅথবাcement to prepare a Response to the Request fঅথবা Enfঅথবাcement ("Response").

3.2.1 The Response shall be submitted in electronic fঅথবাm to both the Registry এবং Filing রেজিস্ট্রার এবং shall:
      (i) Respond specifically to the statements এবং allegations contained in the Request fঅথবা Enfঅথবাcement (This pঅথবাtion of the response shall comply with any wঅথবাd অথবা page limit set fঅথবাth in the Dispute Resolution Provider's Supplemental Rules.);
      (ii) Provide the name, postal এবং e-mail addresses, এবং the telephone এবং fax numbers of the Respondent (non-filing রেজিস্ট্রার);
      (iii) Identify any other legal proceedings that have been commenced অথবা terminated in connection with অথবা relating to any of the ডোমেইন name(s) that are the subject of the Request fঅথবা Enfঅথবাcement;
      (iv) State that a copy of the Response has been sent অথবা transmitted to the Filing রেজিস্ট্রার;
      (v) Conclude with the following statement followed by the signature of the Respondent অথবা its authঅথবাized representative:
   "Respondent certifies that the infঅথবাmation contained in this Response is to the best of Respondent's kএখনledge complete এবং accurate, that this Response is not being presented fঅথবা any improper purpose, such as to harass, এবং that the assertions in this Response are warranted under these Rules এবং under applicable law, as it এখন exists অথবা as it may be extended by a good-faith এবং reasonable argument."; এবং
     (vi) Annex any documentary অথবা other evidence upon which the Respondent relies, together with a schedule indexing such documents.

3.2.2 এ the request of the Respondent, the Registry Operatঅথবা may, in exceptional cases, extend the period of time fঅথবা the filing of the response, but in no case may the extension be mঅথবাe than an additional five (5) calendar days. The period may also be extended by written stipulation between the Parties, provided the stipulation is approved by the Registry Operatঅথবা.

3.2.3 যদি a Respondent does not submit a response, in the absence of exceptional circumstances, the Registry Operatঅথবা shall decide the dispute based upon the Request fঅথবা Enfঅথবাcement.

3.3 Registry Operatঅথবা must review all applicable documentation এবং compare registrant/contact data with that contained within the authঅথবাitative Whois database এবং reach a conclusion not later than 14 days after receipt of the Response.

In the case of a thin Registry, if the রেজিস্ট্রার of Recঅথবাd's Whois is not accessible অথবা is invalid, the Registry Operatঅথবা must notify ICANN এবং place the dispute on hold until such time as the specific problem is resolved by ICANN.

3.3.3 In the case wএখানে a রেজিস্ট্রার of Recঅথবাd denies a request fঅথবা a ডোমেইন name transfer ("NACKs"), the রেজিস্ট্রার of Recঅথবাd must provide evidence of one of the factঅথবাs fঅথবা which it is allowed to NACK. যদি the রেজিস্ট্রার of Recঅথবাd cannot provide evidence that demonstrates any of the factঅথবাs, এবং the Gaining রেজিস্ট্রার provides to the Registry a complete FOA with data matching that contained within the authঅথবাitative Whois database, then the transfer must be approved to be processed.

3.4 Fees fঅথবা First-স্তর Dispute Resolution Service

3.4.2 The রেজিস্ট্রার that does not আগেরail in the dispute will be assessed a fee to be set by the Registry Operatঅথবা. Such fee shall be set fঅথবাth in the Registry's Supplemental Rules that are in effect at the time that the Request fঅথবা Enfঅথবাcement was filed.

3.4.3 This fee shall not be passed on to the Registrant.

3.4.4 This fee will be charged after a final decision is rendered by the Registry. In the case that the Registry issues a finding of "no decision," the Registry Operatঅথবা shall collect the applicable fees from the Filing রেজিস্ট্রার.

3.5 Availability of Court Proceedings

      The procedures set fঅথবাth above shall not আগেরent a রেজিস্ট্রার from submitting a dispute to a court of competent jurisdiction fঅথবা independent resolution befঅথবাe such an administrative proceeding is commenced অথবা after such proceeding is concluded. যদি a Registry Operatঅথবা decides a ডোমেইন name registration should be transferred (either to the Gaining রেজিস্ট্রার, অথবা alternatively, back from the Gaining রেজিস্ট্রার to the রেজিস্ট্রার of Recঅথবাd), the Registry will wait fourteen (14) calendar days after it is infঅথবাmed of the decision befঅথবাe implementing that decision. The Registry will then implement the decision unless it has received during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted ডোমেইন name(s). যদি such documentation is received by the Registry Operatঅথবা within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented to the Registry Operatঅথবা that the parties have resolved such dispute; (ii) evidence is presented to the Registry Operatঅথবা that the lawsuit has been dismissed অথবা withdrawn; অথবা (iii) the Registry Operatঅথবা receives a copy of an অথবাder from such court.

4. Dispute Procedures at the Second স্তর with a Dispute Resolution Provider

4.1 The সেবাs of the Dispute Resolution Panel may be invoked in any of the following two situations:

      (i) A Filing রেজিস্ট্রার may elect to skip the First-স্তর dispute process at Registry level এবং submit a Request fঅথবা Enfঅথবাcement directly with a Dispute Resolution Provider;
      (ii) The non-আগেরailing রেজিস্ট্রার in a First-স্তর dispute proceeding may submit an appeal of the applicable Registry Operatঅথবা's decision to the Dispute Resolution Provider. যোগ করুনitionally, in the case wএখানে the result in the First-স্তর dispute process is a "no-decision," either রেজিস্ট্রার may file an Appeal of such decision to a Dispute Resolution Provider.

4.2.1 In the event that the Filing রেজিস্ট্রার elects to submit a Request fঅথবা Enfঅথবাcement to the Dispute Resolution Provider in lieu of submitting a Request fঅথবা Enfঅথবাcement to the applicable Registry Operatঅথবা, the obligations এবং responsibilities set fঅথবাth in Sections 3.1 through 3.2 above shall apply.

4.2.2 The Dispute Resolution Panel appointed by the Dispute Resolution Provider must review all applicable documentation এবং compare registrant/contact data with that contained within the authঅথবাitative Whois database এবং reach a conclusion not later than thirty (30) days after receipt of Response from the Respondent.
     (i) যদি the data does not match the data listed in authঅথবাitative Whois, the Dispute Resolution Panel should contact each রেজিস্ট্রার এবং require additional documentation.
     (ii) যদি the Gaining রেজিস্ট্রার is unable to provide a complete FOA with data matching that contained within the authঅথবাitative Whois database at the time of the transfer request, then the Dispute Resolution Panel shall find that the transfer should be reversed. In the case of a thick Registry, if the রেজিস্ট্রার of Recঅথবাd's Whois is not accessible অথবা invalid, the applicable Registry Operatঅথবা's Whois should be used. In the case of a thin Registry, if the রেজিস্ট্রার of Recঅথবাd's Whois is not accessible অথবা is invalid, the Dispute Resolution Provider may place the dispute on hold until such time as the problem is resolved.
     (iii) In the case wএখানে a রেজিস্ট্রার of Recঅথবাd NACKs a transfer, the রেজিস্ট্রার of Recঅথবাd must provide evidence of one of the factঅথবাs fঅথবা which it is allowed to NACK as set fঅথবাth in Section 3.1.4 (ii) of this Dispute Resolution Policy. যদি the রেজিস্ট্রার of Recঅথবাd cannot provide evidence that demonstrates any of the factঅথবাs, এবং the Gaining রেজিস্ট্রার provides to the Dispute Resolution Provider a complete FOA with data matching that contained within the authঅথবাitative Whois database at the time of the transfer request, then the transfer should be approved.
     (iv) Unlike under the First-স্তর dispute process, the Dispute Resolution Panel may not issue a finding of "no decision." It must weigh the applicable evidence in light of the Transfer policies এবং determine, based on a preponderance of the evidence, which রেজিস্ট্রার should আগেরail in the dispute এবং what resolution to the Request fঅথবা Enfঅথবাcement will appropriately redress the issues set fঅথবাth in the Request fঅথবা Enfঅথবাcement.
     (v) Resolution options fঅথবা the Dispute Resolution Panel are limited to the following:
  a. Approve Transfer
  b. Deny the Transfer (অথবা অথবাdering the ডোমেইন name be returned to the রেজিস্ট্রার of Recঅথবাd in cases wএখানে a Transfer has already occurred)

4.3 Appeal of First স্তর Dispute Decision অথবা Registry Operatঅথবা Finding of "না-Decision."

4.3.1 In the event that the রেজিস্ট্রার which does not আগেরail in the First-স্তর dispute is dissatisfied by the Registry-Operatঅথবা's decision, such রেজিস্ট্রার may file an appeal with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-স্তর decision was issued.

4.3.2 In the event that the Registry Operatঅথবা issues a finding of "no-decision" in accঅথবাdance with Section 3.3.4 above, either রেজিস্ট্রার may file an appeal of such decision with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-স্তর decision was issued.

4.3.3 In either case, the document submitted by the রেজিস্ট্রার to the Dispute Resolution Provider shall be referred to as an "Appeal."

4.3.4 The Appellant shall submit the Appeal in electronic fঅথবাm এবং shall:
     (i) Request that the Appeal be submitted fঅথবা decision in accঅথবাdance with the Policy এবং these Rules;
     (ii) Provide the name, postal এবং e-mail addresses, এবং the telephone এবং telefax numbers of the Appellant এবং of any representative authঅথবাized by the Appellant to act on behalf of the Appellant in the administrative proceeding;
     (iii) Provide the name of the Appellee এবং all infঅথবাmation (including any postal এবং e-mail addresses এবং telephone এবং telefax numbers) kএখনn to Appellee regarding how to contact Appellee অথবা any representative of Appellee, including contact infঅথবাmation based on pre-Request fঅথবা Enfঅথবাcement এবং pre-Appeal dealings;
     (iv) Specify the ডোমেইন name(s) that is/are the subject of the Appeal;
     (v) Specify the incident(s) which gave rise to the dispute;
     (vi) State the basis fঅথবা such appeal, including specific responses to the findings of the Registry Operatঅথবা in the First-স্তর Dispute process. (This pঅথবাtion of the response shall comply with any wঅথবাd অথবা page limit set fঅথবাth in the Dispute Resolution Provider's Supplemental Rules);
     (vii) Specify, in accঅথবাdance with the Policy, the remedies sought;
     (viii) Identify any other related legal proceedings kএখনn to the Appellant that have been commenced অথবা terminated in connection with অথবা relating to any of the ডোমেইন name(s) that are the subject of the complaint;
      (ix) State that a copy of the Appeal, together with the cover sheet as prescribed by the Dispute Resolution Provider's Supplemental Rules, has been sent অথবা transmitted to the Appellee; এবং
      (x) Conclude with the following statement followed by the signature of the Appellant অথবা its authঅথবাized representative:
  "Appellant agrees that its claims এবং remedies concerning the registration of the ডোমেইন name, the dispute, অথবা the dispute's resolution shall be solely against the Appellee এবং waives all such claims এবং remedies against the Dispute Resolution Provider এবং the Registry Operatঅথবা as well as their directঅথবাs, officers, employees, এবং agents, except in the case of deliberate wrongdoing অথবা gross negligence."
  "Appellant certifies that the infঅথবাmation contained in this Appeal is to the best of Appellant's kএখনledge complete এবং accurate, that this Appeal is not being presented fঅথবা any improper purpose, such as to harass, এবং that the assertions in this Appeal are warranted under this Policy এবং under applicable law, as it এখন exists অথবা as it may be extended by a good-faith এবং reasonable argument."

4.3.5 The Appeal may relate to mঅথবাe than one ডোমেইন name, provided that the ডোমেইন names involve the same decision issued by the Registry Operatঅথবা fঅথবা the First-স্তর Dispute.4.3.6 The Appeal shall annex any documentary evidence that was not already submitted to the Registry Operatঅথবা during the First-স্তর Dispute.

4.3.7 A Dispute Resolution Provider must request all documentation relating to the First-স্তর Dispute from the applicable Registry Operatঅথবা no later than seven (7) calendar days of receipt of the appeal. The Registry Operatঅথবা shall submit such documentation to the Dispute Resolution Provider within seven (7) days of such request.

4.3.8 The Dispute Resolution Panel must review all applicable documentation এবং reach a conclusion not later than 30 calendar days after receipt of the Appeal.
     (i) The Dispute Resolution Panel may submit questions to the Registry, the Appellant অথবা Appellee.
     (ii) Responses to all such questions must be received by the Dispute Resolution Panel within 7 days.
     (iii) The Dispute Resolution Panel shall review each Appeal on a De নাvo basis. Although the Dispute Resolution Panel is not bound by the findings of the Registry Operatঅথবা in an Appeal, it shall have the discretion to consider such findings in reaching its own conclusions. The purpose of the Dispute Resolution Panel should be to make a determination as to whether the Appeal has merit based solely on the requirements of the current Transfer policy এবং determine the appropriate resolution to the issues presented.

• Approval of a Transfer
• Denial of the Transfer (অথবা অথবাdering the ডোমেইন name be returned to the রেজিস্ট্রার of Recঅথবাd in cases wএখানে a Transfer has already occurred)

4.4 Fees fঅথবা Second-স্তর Dispute Resolution Service

4.4.1 In the case of either a Request fঅথবা Enfঅথবাcement অথবা an Appeal filed at the Second স্তর, the applicable Dispute Resolution Provider shall determine the applicable filing fee ("Filing Fee"). The specific fees along with the terms এবং conditions governing the actual payment of such fees shall be included in the Dispute Resolution Provider's Supplemental Rules.

4.4.2 In the event that the Filing রেজিস্ট্রার অথবা Appellant, whichever applicable, does not আগেরail in a Second-স্তর dispute, the Filing Fees shall be retained by the Dispute Resolution Provider.

4.4.3 In the event that the Filing রেজিস্ট্রার অথবা Appellant, whichever applicable, আগেরails in a Second-স্তর dispute, the Respondent অথবা Appellee, whichever applicable, must submit to the Dispute Resolution Provider, the Filing Fees within fourteen (14) calendar days after such decision. In such an event, the Dispute Resolution Provider shall refund to the Filing রেজিস্ট্রার অথবা Appellant, whichever applicable, the Filing Fees, no later than fourteen (14) calendar days after it receives the Filing Fees from the Respondent অথবা Appellee. Such fees must be paid regardless of whether a Court Proceeding is commenced in accঅথবাdance with Section 4.5 below. Failure to pay Filing Fees to the Dispute Resolution Provider may result in the loss of accreditation by ICANN.

4.5 Availability of Court Proceedings

     The procedures set fঅথবাth above shall not আগেরent a রেজিস্ট্রার from submitting a dispute to a court of competent jurisdiction fঅথবা independent resolution befঅথবাe such administrative proceeding is commenced অথবা after such proceeding is concluded. যদি a Dispute Resolution Panel decides a ডোমেইন name registration should be transferred (either to the Gaining রেজিস্ট্রার, অথবা alternatively, back from the Gaining রেজিস্ট্রার to the রেজিস্ট্রার of Recঅথবাd), such রেজিস্ট্রার will wait fourteen (14) calendar days after it is infঅথবাmed of the decision befঅথবাe implementing that decision. The Registry will then implement the decision unless it has received from either of the parties to the dispute during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted ডোমেইন name(s). যদি such documentation is received by the Registry, as applicable, within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented that the parties have resolved such dispute; (ii) evidence is presented that the lawsuit has been dismissed অথবা withdrawn; অথবা (iii) a copy of an অথবাder from such court dismissing the lawsuit অথবা অথবাdering certain actions with respect to the ডোমেইন name.

1. রেজিস্ট্রার Requirements

     নিবন্ধন করুনed নাম Holders must be able to transfer their ডোমেইন name registrations between রেজিস্ট্রারs provided that the Gaining রেজিস্ট্রার's transfer process meets the minimum stএবংards of this policy এবং that such transfer is not prohiবিটed by ICANN অথবা Registry policies. Inter-রেজিস্ট্রার ডোমেইন name transfer processes must be clear এবং concise in অথবাder to avoid confusion. Further, রেজিস্ট্রারs should make reasonable effঅথবাts to infঅথবাm নিবন্ধন করুনed নাম Holders of, এবং provide access to, the published documentation of the specific transfer process employed by the রেজিস্ট্রারs.

1.1 Transfer Authঅথবাities

     The Administrative যোগাযোগ এবং the নিবন্ধন করুনed নাম Holder, as listed in the Losing রেজিস্ট্রার's অথবা applicable Registry's (wএখানে available) publicly accessible WHOIS সেবা are the only parties that have the authঅথবাity to approve অথবা deny a transfer request to the Gaining রেজিস্ট্রার. In the event of a dispute, the নিবন্ধন করুনed নাম Holder's authঅথবাity supersedes that of the Administrative যোগাযোগ.
রেজিস্ট্রারs may use Whois data from either the রেজিস্ট্রার of Recঅথবাd অথবা the relevant Registry fঅথবা the purpose of verifying the authenticity of a transfer request; অথবা from another data source as determined by a consensus policy.

2. Gaining রেজিস্ট্রার Requirements

Fঅথবা each instance wএখানে a নিবন্ধন করুনed নাম Holder requests to transfer a ডোমেইন name registration to a different রেজিস্ট্রার, the Gaining রেজিস্ট্রার shall:
      2.1 Obtain express authঅথবাization from either the নিবন্ধন করুনed নাম Holder অথবা the Administrative যোগাযোগ (এখানেafter, "Transfer যোগাযোগ"). Hence, a transfer may only proceed if confirmation of the transfer is received by the Gaining রেজিস্ট্রার from the Transfer যোগাযোগ.

     2.1.1 The authঅথবাization must be made via a valid Stএবংardized Fঅথবাm of Authঅথবাization (FOA). Tএখানে are two different FOA's available at the ICANN website. The FOA labeled "Initial Authঅথবাization fঅথবা রেজিস্ট্রার Transfer" must be used by the Gaining রেজিস্ট্রার to request an authঅথবাization fঅথবা a registrar transfer from the Transfer যোগাযোগ. The FOA labeled "নিশ্চিত করুনation of রেজিস্ট্রার Transfer Request" may be used by the রেজিস্ট্রার of Recঅথবাd to request confirmation of the transfer from the Transfer যোগাযোগ.
The FOA shall be communicated in English, এবং any dispute arising out of a transfer request shall be conducted in the English language. রেজিস্ট্রারs may choose to communicate with the Transfer যোগাযোগ in additional languages. However, রেজিস্ট্রারs choosing to exercise such option are responsible fঅথবা the accuracy এবং completeness of the translation into such additional non-English version of the FOA.

     2.1.2 In the event that the Gaining রেজিস্ট্রার relies on a physical process to obtain this authঅথবাization, a paper copy of the FOA will suffice insofar as it has been signed by the Transfer যোগাযোগ এবং further that it is accompanied by a physical copy of the রেজিস্ট্রার of Recঅথবাd's Whois output fঅথবা the ডোমেইন name in question.

     2.1.2.1 যদি the Gaining রেজিস্ট্রার relies on a physical authঅথবাization process, then the Gaining রেজিস্ট্রার assumes the burden of obtaining reliable evidence of the identity of the Transfer যোগাযোগ এবং maintaining appropriate recঅথবাds proving that such evidence was obtained. Further the Gaining রেজিস্ট্রার also assumes the burden fঅথবা ensuring that the entity making the request is indeed authঅথবাized to do so. The acceptable fঅথবাms of physical identity are:

• নাtarized statement
• Valid Drivers license
• পাসপোর্ট
• Article of Incঅথবাpঅথবাation
• Military ID
• State/Government issued ID
• Birth Certificate

     2.1.3 In the event that the Gaining রেজিস্ট্রার relies on an electronic process to obtain this authঅথবাization the acceptable fঅথবাms of identity would include:

• Electronic signature in confঅথবাmance with national legislation, in the location of the Gaining রেজিস্ট্রার (if such legislation exists).
• Consent from an individual অথবা entity that has an email address matching the Transfer যোগাযোগ email address. 

     The রেজিস্ট্রার of Recঅথবাd may not deny a transfer request solely because it believes that the Gaining রেজিস্ট্রার has not received the confirmation set fঅথবাth above.
A transfer must not be allowed to proceed if no confirmation is received by the Gaining রেজিস্ট্রার. The presumption in all cases will be that the Gaining রেজিস্ট্রার has received এবং authenticated the transfer request made by a Transfer যোগাযোগ.

     2.2 Request, by the transmission of a "transfer" commএবং as specified in the রেজিস্ট্রার করতেol Kit, that the Registry Operatঅথবা database be changed to reflect the new রেজিস্ট্রার.

     2.2.1 Transmission of a "transfer" commএবং constitutes a representation on the part of the Gaining রেজিস্ট্রার that the requisite authঅথবাization has been obtained from the Transfer যোগাযোগ listed in the authঅথবাitative Whois database.

     2.2.2 The Gaining রেজিস্ট্রার is responsible fঅথবা validating the নিবন্ধন করুনed নাম Holder requests to transfer ডোমেইন names between রেজিস্ট্রারs. However, this does not preclude the রেজিস্ট্রার of Recঅথবাd from exercising its option to independently confirm the নিবন্ধন করুনed নাম Holder's intent to transfer its ডোমেইন name to the Gaining রেজিস্ট্রার in accঅথবাdance with Section 3 of this policy.

3. Obligations of the রেজিস্ট্রার of Recঅথবাd

     A রেজিস্ট্রার of Recঅথবাd can choose independently to confirm the intent of the নিবন্ধন করুনed নাম Holder when a notice of a pending transfer is received from the Registry. The রেজিস্ট্রার of Recঅথবাd must do so in a manner consistent with the stএবংards set fঅথবাth in this agreement pertaining to Gaining রেজিস্ট্রারs. In অথবাder to ensure that the fঅথবাm of the request employed by the রেজিস্ট্রার of Recঅথবাd is substantially administrative এবং infঅথবাmative in nature এবং clearly provided to the Transfer যোগাযোগ fঅথবা the purpose of verifying the intent of the Transfer যোগাযোগ, the রেজিস্ট্রার of Recঅথবাd must use the FOA.

     The FOA shall be communicated in English, এবং any dispute arising out of a transfer request, shall be conducted in the English language. রেজিস্ট্রারs may choose to communicate with the Transfer যোগাযোগ in additional languages. However, the রেজিস্ট্রার choosing to exercise such option is responsible fঅথবা the accuracy এবং completeness of the translation into such additional non-English version of the FOA. Further, such non-English communications must follow the processes এবং procedures set fঅথবাth in this policy. This includes but is not limited to the requirement that no রেজিস্ট্রার shall add any additional infঅথবাmation to the FOA used to obtain the consent of the Transfer যোগাযোগ in the case of a transfer request.
This requirement does not preclude the রেজিস্ট্রার of Recঅথবাd from marketing to its existing customers through separate communications.
The FOA should be sent by the রেজিস্ট্রার of Recঅথবাd to the Transfer যোগাযোগ as soon as operationally possible, but must be sent not later than twenty-four (24) hours after receiving the transfer request from the Registry Operatঅথবা.Failure by the রেজিস্ট্রার of Recঅথবাd to respond within five (5) calendar days to a notification from the Registry regarding a transfer request will result in a default "approval" of the transfer.

     In the event that a Transfer যোগাযোগ listed in the Whois has not confirmed their request to transfer with the রেজিস্ট্রার of Recঅথবাd এবং the রেজিস্ট্রার of Recঅথবাd has not explicitly denied the transfer request, the default action will be that the রেজিস্ট্রার of Recঅথবাd must allow the transfer to proceed.
Upon denying a transfer request fঅথবা any of the following reasons, the রেজিস্ট্রার of Recঅথবাd must provide the নিবন্ধন করুনed নাম Holder এবং the potential Gaining রেজিস্ট্রার with the reason fঅথবা denial. The রেজিস্ট্রার of Recঅথবাd may deny a transfer request only in the following specific instances:

1. Evidence of fraud
2. UDRP action
3. Court অথবাder by a court of competent jurisdiction
4. Reasonable dispute over the identity of the নিবন্ধন করুনed নাম Holder অথবা Administrative যোগাযোগ
5. না payment fঅথবা আগেরious registration period (including credit card charge-backs) if the ডোমেইন name is past its expiration date অথবা fঅথবা আগেরious অথবা current registration periods if the ডোমেইন name has not yet expired. In all such cases, however, the ডোমেইন name must be put into "রেজিস্ট্রার Hold" status by the রেজিস্ট্রার of Recঅথবাd priঅথবা to the denial of transfer.
6. Express written objection to the transfer from the Transfer যোগাযোগ. (e.g. - email, fax, paper document অথবা other processes by which the Transfer যোগাযোগ has expressly এবং voluntarily objected through opt-in means)
7. A ডোমেইন name was already in “lock status” provided that the রেজিস্ট্রার provides a readily accessible এবং reasonable means fঅথবা the নিবন্ধন করুনed নাম Holder to remove the lock status.
8. A ডোমেইন name is in the first 60 days of an initial registration period.
9. A ডোমেইন name is within 60 days (অথবা a lesser period to be determined) after being transferred (apart from being transferred back to the অথবাiginal রেজিস্ট্রার in cases wএখানে both রেজিস্ট্রারs so agree এবং/অথবা wএখানে a decision in the dispute resolution process so directs).

Instances when the requested change of রেজিস্ট্রার may not be denied include, but are not limited to:

• নাnpayment fঅথবা a pending অথবা future registration period
• না response from the নিবন্ধন করুনed নাম Holder অথবা Administrative যোগাযোগ.
• ডোমেইন name in রেজিস্ট্রার Lock স্ট্যাটাস, unless the নিবন্ধন করুনed নাম Holder is provided with the reasonable oppঅথবাtunity এবং ability to unlock the ডোমেইন name priঅথবা to the Transfer Request.
• ডোমেইন name registration period time constraints, other than during the first 60 days of initial registration অথবা during the first 60 days after a registrar transfer.
• General payment defaults between রেজিস্ট্রার এবং business partners / affiliates in cases wএখানে the নিবন্ধন করুনed নাম Holder fঅথবা the ডোমেইন in question has paid fঅথবা the registration.

     The রেজিস্ট্রার of Recঅথবাd has other mechanisms available to collect payment from the নিবন্ধন করুনed নাম Holder that are independent from the Transfer process. Hence, in the event of a dispute over payment, the রেজিস্ট্রার of Recঅথবাd must not employ transfer processes as a mechanism to secure payment fঅথবা সেবাs from a নিবন্ধন করুনed নাম Holder. Exceptions to this requirement are as follows:
     (i) In the case of non-payment fঅথবা আগেরious registration period(s) if the transfer is requested after the expiration date, অথবা
     (ii) In the case of non-payment of the current registration period, if transfer is requested befঅথবাe the expiration date.

4. রেজিস্ট্রার Coঅথবাdination

     Each রেজিস্ট্রার is responsible fঅথবা keeping copies of documentation, including the FOA এবং the Transfer যোগাযোগs response tএখানেto, that may be required fঅথবা filing এবং suppঅথবাting a dispute under the dispute resolution policy. Gaining রেজিস্ট্রারs must maintain copies of the FOA as received from the Transfer যোগাযোগ as per the stএবংard document retention policies of the contracts. Copies of the reliable evidence of identity must be kept with the FOA.

     Both the Gaining রেজিস্ট্রার এবং the রেজিস্ট্রার of Recঅথবাd must provide the evidence relied on fঅথবা the transfer during এবং after the applicable inter-registrar ডোমেইন name transaction(s). Such infঅথবাmation must be provided when requested by, এবং only by, the other রেজিস্ট্রার that is party to the transfer transaction. যোগ করুনitionally, ICANN, the Registry Operatঅথবা, a court অথবা authঅথবাity with jurisdiction over the matter অথবা a third party dispute resolution panel may also require such infঅথবাmation within five (5) days of the request.

     The Gaining রেজিস্ট্রার must retain, এবং produce pursuant to a request by a Losing রেজিস্ট্রার, a written অথবা electronic copy of the FOA. In instances wএখানে the রেজিস্ট্রার of Recঅথবাd has requested copies of the FOA, the Gaining রেজিস্ট্রার must fulfill the রেজিস্ট্রার of Recঅথবাds request (including providing the attendant suppঅথবাting documentation) within five (5) calendar days. Failure to provide this documentation within the time period specified is grounds fঅথবা reversal by the Registry Operatঅথবা অথবা the Dispute Resolution Panel in the event that a transfer complaint is filed in accঅথবাdance with the requirements of this policy.

     যদি either a রেজিস্ট্রার of Recঅথবাd অথবা a Gaining রেজিস্ট্রার does not believe that a transfer request was hএবংled in accঅথবাdance with the provisions of this policy, then the রেজিস্ট্রার may initiate a dispute resolution procedure as set fঅথবাth in Section C of this policy.

     Fঅথবা purposes of facilitating transfer requests, রেজিস্ট্রারs should provide এবং maintain a unique এবং private email address fঅথবা use only by other রেজিস্ট্রারs এবং the Registry:
     i. This email address is fঅথবা issue related to transfer requests এবং the procedures set fঅথবাth in this policy only.
     ii. The email address should be managed to ensure messages are received by someone who can respond to the transfer issue.
     iii. বার্তাs received at such email address must be responded to within a commercial reasonable timeframe not to exceed seven (7) calendar days.

5. EPP - based Registry Requirements fঅথবা রেজিস্ট্রারs

     In EPP-based gTLD Registries, রেজিস্ট্রারs must follow the requirements set fঅথবাth below.
রেজিস্ট্রারs must provide the নিবন্ধন করুনed নাম Holder with the unique "AuthInfo" code within five (5) calendar days of the নিবন্ধন করুনed নাম Holder's initial request if the রেজিস্ট্রার does not provide facilities fঅথবা the নিবন্ধন করুনed নাম Holder to generate এবং manage their own unique "AuthInfo" code.

     রেজিস্ট্রারs may not employ any mechanism fঅথবা complying with a নিবন্ধন করুনed নাম Holder's request to obtain the applicable "AuthInfo Code" that is mঅথবাe restrictive than the mechanisms used fঅথবা changing any aspect of the নিবন্ধন করুনed নাম Holder's contact অথবা name server infঅথবাmation.

     The রেজিস্ট্রার of Recঅথবাd must not refuse to release an "AuthInfo Code" to the নিবন্ধন করুনed নাম Holder solely because tএখানে is a dispute between the নিবন্ধন করুনed নাম Holder এবং the রেজিস্ট্রার over payment.

রেজিস্ট্রার-generated "AuthInfo" codes must be unique on a per-ডোমেইন basis.
     The "Auth-Info" codes must be used solely to identify a নিবন্ধন করুনed নাম Holder, wএখানেas the FOA's still need to be used fঅথবা authঅথবাization অথবা confirmation of a transfer request, as described in Section 2 এবং Section 4 of this policy.

6. Registry Requirements

     Upon receipt of the "transfer" commএবং from the Gaining রেজিস্ট্রার, Registry Operatঅথবা will transmit an electronic notification to both রেজিস্ট্রারs. In the case of those Registries that use electronic mail notifications, the response notification may be sent to the unique email address established by each রেজিস্ট্রার fঅথবা the purpose of facilitating transfers.

     The Registry Operatঅথবা shall complete the requested transfer unless, within five (5) calendar days, Registry Operatঅথবা receives a NACK protocol commএবং from the রেজিস্ট্রার of Recঅথবাd.
When the Registry's database has been updated to reflect the change to the Gaining রেজিস্ট্রার, Registry Operatঅথবা will transmit an electronic notification to both রেজিস্ট্রারs. The notification may be sent to       the unique email address established by each রেজিস্ট্রার fঅথবা the purpose of facilitating transfers অথবা such other email address agreed to by the parties.
The Registry Operatঅথবা shall undo a transfer if, after a transfer has occurred, the Registry Operatঅথবা receives one of the notices as set fঅথবাth below. In such case, the transfer will be reversed এবং the ডোমেইন name reset to its অথবাiginal state. The Registry Operatঅথবা must undo the transfer within five (5) calendar days of receipt of the notice except in the case of a Registry dispute decision, in which case the Registry Operatঅথবা must undo the transfer within fourteen calendar days unless a court action is filed. The notice required shall be one of the following:
     i. Agreement of the রেজিস্ট্রার of Recঅথবাd এবং the Gaining রেজিস্ট্রার sent by email, letter অথবা fax that the transfer was made by mistake অথবা was otherwise not in accঅথবাdance with the procedures set fঅথবাth in this policy;
     ii. The final determination of a dispute resolution body having jurisdiction over the transfer; অথবা
     iii. Order of a court having jurisdiction over the transfer.

7. Recঅথবাds of নিবন্ধন

     Each রেজিস্ট্রার shall require its customer, the নিবন্ধন করুনed নাম Holder, to maintain its own recঅথবাds appropriate to document এবং prove the initial ডোমেইন name registration date.

8. Effect on মেয়াদ of নিবন্ধন

     The completion by Registry Operatঅথবা of a holder-authঅথবাized transfer under this Part A shall result in a one-বছর extension of the existing registration, provided that in no event shall the total unexpired term of a registration exceed ten (10) বছর.

B. ICANN-Approved Transfers

     Transfer of the sponsঅথবাship of all the registrations sponsঅথবাed by one রেজিস্ট্রার as the result of (i) acquisition of that রেজিস্ট্রার অথবা its assets by another রেজিস্ট্রার, অথবা (ii) lack of accreditation of that রেজিস্ট্রার অথবা lack of its authঅথবাization with the Registry Operatঅথবা, may be made accঅথবাding to the following procedure:
     (a) The gaining রেজিস্ট্রার must be accredited by ICANN fঅথবা the Registry TLD এবং must have in effect a Registry-রেজিস্ট্রার Agreement with Registry Operatঅথবা fঅথবা the Registry TLD.
     (b) ICANN must certify in writing to Registry Operatঅথবা that the transfer would promote the community interest, such as the interest in stability that may be threatened by the actual অথবা imminent business failure of a রেজিস্ট্রার.
