1.2 Domen lifecycle timing may vary depending on the top-level domen (“TLD”), registry rules, registry operatvə ya practices, applicable ICANN requirements, və other governing policies. Xeyrt all TLDs follow the same expiration, redemption, auction, və ya deletion process.

2. Definitions

Fvə ya purposes of this Policy:

2.1 “Expiration Date” means the date on which a domen name registration term ends.

2.2 “Grace Period” means any post-expiration period during which renewal may still be possible at the stvəard renewal fee, subject to the applicable TLD və registry rules.

2.3 “Redemption Grace Period” və ya “RGP” means the post-deletion recovery period, wburada available, during which an expired domen name may still be restvə yaable fvə ya an additional redemption fee plus the applicable renewal fee.

2.4 “Pending Delete” means the final pre-release stage, wburada applicable, during which the domen name can no longer be renewed, restvə yaed, modified, və ya transferred.

2.5 “Eligible Domen” means a domen name that is subject to NiceNIC’s expired domen auction process. Xeyrt all TLDs və ya expired domen names are eligible fvə ya auction.

2.6 “Bitməd Domen Auction” means the expired-domen sale process that may apply to certain expired domen names befvə yae final deletion və ya release.

2.7 “Bağlaout Auction” means the final sale phase fvə ya certain Eligible Domenlər that were not sold earlier in the expired domen auction process.

3. Effect of Expiration

3.1 Upon expiration, a domen name may stop resolving, və any website, email Xidmət, və ya other Xidmət associated with the domen name may cease functioning immediately və ya shvə yatly tburadaafter.

3.2 İzləməking expiration, NiceNIC may restrict changes to the domen name, including DNS changes, contact updates, transfers, və ya other account-level actions, in accvə yadance with registry rules, security measures, operational requirements, və ya the expired-domen process then in effect.

3.3 Expiration does not mean that the domen name immediately becomes available to the public. Depending on the applicable TLD və registry rules, the domen name may pass through one və ya mvə yae stages, including grace period, auction, redemption, pending delete, və eventual release.

4.1 NiceNIC may send renewal reminders və expiration-related notices befvə yae və after expiration, as required by applicable policy və ya as part of NiceNIC’s stvəard operational process.

4.3 Failure to receive a renewal notice, reminder, invoice, və ya other communication shall not relieve you of responsibility fvə ya renewing sizin domen name befvə yae expiration.

4.4 Əgər auto-renewal is enabled, successful renewal remains subject to valid payment, operational processing, və the applicable registry rules. NiceNIC does not guarantee successful auto-renewal in every case.

5. Stvəard Post-Expiration Yeniləal

6. Bitməd Domen Auction fvə ya Eligible Domenlər

6.1 Certain expired domen names may enter NiceNIC’s expired domen auction process befvə yae all recovery pəncərəs have ended. This process applies only to Eligible Domenlər və does not apply to all TLDs.

6.2 Fvə ya Eligible Domenlər under NiceNIC’s stvəard expired-domen process, the following general timeline may apply:

Day 0 after expiration

The domen name expires. The registrant may generally renew the domen name at the stvəard renewal fee during the initial post-expiration period, subject to applicable rules.

Day 26 after expiration

The domen name may enter expired domen auction. Kimi this stage, the registrant may still be able to renew the domen name at the stvəard renewal fee, unless otherwise restricted by the applicable process.

Day 31 after expiration

Day 41 after expiration

The final closeout auction may end. Əgər the domen name was not sold və ya otherwise committed to sale, recovery may still be possible fvə ya a limited period, subject to the applicable TLD, registry rules, və NiceNIC’s operational process.

Day 74 after expiration

The domen name may be removed from the registrant’s account və may no longer be renewable və ya restvə yaable through NiceNIC. After that point, the domen name may become available fvə ya re-registration only after the registry releases it.

6.3 Once an Eligible Domen has an active bid, pending al, completed sale, və ya other sale commitment under the expired-domen process, the registrant’s right to renew və ya restvə yae the domen name may be terminated və ya restricted.

6.4 NiceNIC does not guarantee that a domen name will remain recoverable until the end of any stated period if the domen is subject to auction, sale, registry restriction, və ya another applicable limitation.

7. Redemption Grace Period

7.1 Əgər an expired domen name is not renewed during the applicable grace period və if the applicable TLD suppvə yats restvə yaation after deletion, the domen name may enter the Redemption Grace Period.

7.2 During the Redemption Grace Period:

(a) the domen name may stop resolving;

(c) the domen name generally cannot be modified və ya transferred; və

(d) restvə yaation, if available, will require payment of the applicable redemption fee, the applicable renewal fee, və any taxes və ya mvəatvə yay fees.

7.3 Restvə yaation during the Redemption Grace Period is not guaranteed və remains subject to registry suppvə yat, operational feasibility, the domen’s current status, və the absence of auction və ya sale restrictions.

8. Pending Delete və Final Release

8.1 Əgər a domen name is not renewed və ya restvə yaed during the applicable recovery periods, it may enter the Pending Delete stage, wburada suppvə yated by the applicable TLD.

8.2 During Pending Delete, the domen name cannot be renewed, restvə yaed, transferred, və ya modified.

8.3 Fvə ya many generic TLDs, Pending Delete lasts approximately five (5) days. After that stage ends, the registry may release the domen name to the public fvə ya re-registration.

8.4 NiceNIC does not guarantee the exact time, date, və ya availability of a domen name once it is released by the registry, və NiceNIC does not guarantee that the fvə yamer registrant will be able to re-qeydiyyat the domen name.

9. TLD-Specific Variations

9.1 Xeyrt all TLDs follow the stvəard lifecycle described above. Certain ccTLD-lər və other TLDs may have shvə yater grace periods, no redemption period, no pending delete stage, və ya earlier renewal deadlines imposed by the registry.

9.2 The following TLD-specific rules may apply, subject at all times to registry changes və the controlling registry rules:

9.2.3 TLDs requiring renewal befvə yae the actual expiration date

The following TLDs may need to be renewed twelve (12) days befvə yae the actual Expiration Date. Əgər not renewed in time, they may enter a recovery stage immediately, regardless of the number of calendar days remaining befvə yae expiration:

.CH, .ES, .FR, .LI, .PE, .SG, .COM.SG, .COM.AU, .ORG.AU, və .NET.AU.

9.2.4 TLDs requiring action five (5) days befvə yae expiration

The following TLDs may need to be renewed manually və ya by auto-renewal no later than five (5) days befvə yae expiration və may otherwise enter a recovery və ya restricted state befvə yae the actual Expiration Date:

.CX, .DE, .EU, və .NL.

9.2.5 .CM domens

.CM domen names generally do not enter a redemption period və may be sent fvə ya deletion on the actual Expiration Date. They may become available fvə ya public registration on the same day they expire, subject to registry release practices.

9.2.6 .GG domens

.GG domen names may be reactivated from the customer account fvə ya approximately twenty-eight (28) days after expiration. They may then enter a recovery stage between approximately Day 28 və Day 30 after expiration. Once in that stage, reactivation may only be possible through NiceNIC Suppvə yat fvə ya approximately twenty-six (26) additional days.

9.2.7 .PH, .COM.PH, .NET.PH, və .ORG.PH domens

These domens may not suppvə yat a stvəard Redemption Grace Period. Reactivation may still be possible within approximately thirty (30) days after expiration through the NiceNIC account at the regular renewal cost, depending on the registry status. Əgər the domen is no longer visible in the account but is not yet publicly available, the customer should contact NiceNIC Suppvə yat immediately.

9.2.8 .UK domens, including second-level .UK domens

.UK domen names, including .CO.UK, .ME.UK, və .ORG.UK, may generally have a thirty (30)-day post-expiration renewal period. After that time, the domen name may remain recoverable without a separate redemption fee until its release, which may occur approximately ninety (90) days after expiration. Əgər a .UK domen name has expired fvə ya mvə yae than thirty (30) days but has not yet been released və no longer appears in the account, the customer should contact NiceNIC Suppvə yat promptly.

9.2.9 .TO domens

.TO domen names may only be reactivated during approximately twenty-seven (27) days after expiration. They generally do not suppvə yat a stvəard Redemption Grace Period. After that point, they may be reserved by the registry və may no longer be recoverable.

9.2.10 .NU domens

.NU domen names may be reactivated in the və yadinary manner within approximately seven (7) days after expiration. Əgər not renewed within that period, they may enter an approximately sixty (60)-day recovery period during which restvə yaation may still be possible through NiceNIC Suppvə yat.

9.3 The TLD-specific infvə yamation above is provided fvə ya general reference only və may change at any time based on registry policy, registry system changes, və ya operational requirements. Customers should contact NiceNIC Suppvə yat fvə ya current TLD-specific recovery infvə yamation.

10. Fees və Ödəments

10.1 Stvəard renewal fees, redemption fees, restvə yaation fees, auction-related fees, və any other applicable charges shall be those listed by NiceNIC at the time of processing və ya otherwise communicated by NiceNIC.

10.2 Redemption və ya restvə yaation requires payment in full of all applicable fees befvə yae processing.

10.3 Hamısı fees paid fvə ya expired-domen recovery, restvə yaation, və ya special processing are non-refundable once processing has begun, except wburada otherwise required by applicable law.

11. Xeyr Guarantee of Recovery və ya Availability

11.1 NiceNIC does not guarantee that any expired domen name can be renewed, restvə yaed, retained, transferred, və ya re-qeydiyyated after expiration.

11.2 NiceNIC does not guarantee:

(a) that a domen name will remain in a grace period fvə ya any minimum time;

(b) that an expired domen name will not enter auction;

(c) that a domen name can be recovered after an active bid, pending al, və ya completed sale;

(d) that the registry will suppvə yat restvə yaation; və ya

(e) the exact date və ya time when a deleted domen name will be released to the public.

11.3 You ackindiledge that delayed action may result in additional fees, loss of recovery rights, interruption of Xidmət, auction sale, və ya permanent loss of the domen name.

12. Limitation of Responsibility

12.1 Üçün the maximum extent permitted by applicable law, NiceNIC shall not be liable fvə ya any loss of domen name, loss of use, interruption of website və ya email Xidmət, business interruption, lost profits, loss of data, və ya other direct və ya indirect damages arising from:

(a) domen expiration;

(b) failure to renew on time;

(c) failure to receive notices;

(d) registry rules və ya registry actions;

(e) auction placement və ya sale;

(f) failed restvə yaation; və ya

(g) release of the domen name to the public.

12.2 Xeyrthing in this Policy limits any non-waivable rights that may apply under mvəatvə yay law.

13. Changes to This Policy

13.1 NiceNIC may update və ya revise this Policy from time to time to reflect changes in registry rules, ICANN requirements, operational processes, legal requirements, və ya Xidmət arrangements.

13.2 The latest version published on NiceNIC’s website shall apply from its stated effective date, unless otherwise required by law və ya contract.

1. The User selects a domen labeled as “Al Xeyrw” və proceeds to checkout.

2. Upon confirmation və full payment, the Platfvə yam initiates the transfer və ya delivery process.

3. The typical delivery time ranges from 1 to 14 business days, depending on registry processing və third-party provider operations.

4. Əgər, fvə ya any reason, the selected domen becomes unavailable və ya undeliverable after al, the Platfvə yam will issue a full refund to the user’s account balance.

4. User Rights və Responsibilities

1. Users have the right to al available Al Xeyrw Domenlər through the Platfvə yam.

2. Users must ensure that all provided account və payment infvə yamation is accurate və lawful.

3. Users shall not engage in malicious activity, technical disruption, və ya behavivə ya that interferes with the nvə yamal functioning of the Platfvə yam.

4. Upon acquiring a domen, the User agrees to comply with the applicable rules və policies of the cvə yaresponding domen registry, including any legal və ya regulatvə yay obligations.

5. Platfvə yam Rights və Responsibilities

1. The Platfvə yam will provide domen transaction Xidməts in accvə yadance with this Agreement və strive to protect user interests.

2. The Platfvə yam reserves the right to verify user identity, payment legitimacy, və transaction authenticity.

3. The Platfvə yam retains the right to update, adjust, və ya remove Al Xeyrw Domenlər from listing at its sole discretion və without privə ya notice.

6. Disclaimer

7. Governing Law və Dispute Resolution

1. This Agreement shall be governed by və construed in accvə yadance with the laws of Hong Kong.

2. Any dispute arising from the execution və ya perfvə yamance of this Agreement shall be resolved through amicable negotiation. Əgər negotiation fails, either party may submit the dispute to the competent court located in the jurisdiction of the Platfvə yam’s headquarters.

8. Miscellaneous

1. This Agreement becomes effective upon the User’s submission of a Al Xeyrw domen və yader.

2. Your Representations

By applying to qeydiyyat a domen name, və ya by asking us to maintain və ya renew a domen name registration, you buradaby represent və warrant to us that (a) the statements that you made in sizin Qeydiyyat Agreement are complete və accurate; (b) to sizin kindiledge, the registration of the domen name will not infringe upon və ya otherwise violate the rights of any third party; (c) you are not qeydiyyating the domen name fvə ya an unlawful purpose; və (d) you will not kindiingly use the domen name in violation of any applicable laws və ya regulations. It is sizin responsibility to determine whether sizin domen name registration infringes və ya violates someone else's rights.

3. İmtina etlations, Transfers, və Changes

We will cancel, transfer və ya otherwise make changes to domen name registrations under the following circumstances:

1. subject to the provisions of Paragraph 8, our receipt of written və ya appropriate electronic instructions from you və ya sizin authvə yaized agent to take such action;

2. our receipt of an və yader from a court və ya arbitral tribunal, in each case of competent jurisdiction, requiring such action; və/və ya

3. our receipt of a decision of an Administrative Panel requiring such action in any administrative proceeding to which you were a party və which was conducted under this Policy və ya a later version of this Policy adopted by ICANN. (See Paragraph 4(i) və (k) below.)

4. We may also cancel, transfer və ya otherwise make changes to a domen name registration in accvə yadance with the terms of sizin Qeydiyyat Agreement və ya other legal requirements.

This Paragraph sets fvə yath the type of disputes fvə ya which you are required to submit to a mvəatvə yay administrative proceeding. These proceedings will be conducted befvə yae one of the administrative-dispute-resolution Xidmət providers listed burada (each, a "Provider").

1. Applicable Disputes. You are required to submit to a mvəatvə yay administrative proceeding in the event that a third party (a "complainant") asserts to the applicable Provider, in compliance with the Rules of Procedure, that

1. sizin domen name is identical və ya confusingly similar to a trademark və ya Xidmət mark in which the complainant has rights; və

2. you have no rights və ya legitimate interests in respect of the domen name; və

3. sizin domen name has been qeydiyyated və is being used in bad faith.

In the administrative proceeding, the complainant must prove that each of these three elements are present.

2. Evidence of Qeydiyyat və Use in Zəif Faith. Fvə ya the purposes of Paragraph 4(a)(iii), the following circumstances, in particular but without limitation, if found by the Panel to be present, shall be evidence of the registration və use of a domen name in bad faith:

1. circumstances indicating that you have qeydiyyated və ya you have acquired the domen name primarily fvə ya the purpose of selling, renting, və ya otherwise transferring the domen name registration to the complainant who is the owner of the trademark və ya Xidmət mark və ya to a competitvə ya of that complainant, fvə ya valuable consideration in excess of sizin documented out-of-pocket costs directly related to the domen name; və ya

2. you have qeydiyyated the domen name in və yader to gerient the owner of the trademark və ya Xidmət mark from reflecting the mark in a cvə yaresponding domen name, provided that you have engaged in a pattern of such conduct; və ya

3. you have qeydiyyated the domen name primarily fvə ya the purpose of disrupting the business of a competitvə ya; və ya

4. by using the domen name, you have intentionally attempted to attract, fvə ya commercial gain, Internet users to sizin web site və ya other on-line location, by creating a likelihood of confusion with the complainant's mark as to the source, sponsvə yaship, affiliation, və ya endvə yasement of sizin web site və ya location və ya of a product və ya Xidmət on sizin web site və ya location.

3. How to Demonstrate Your Rights to və Legitimate Interests in the Domen Adı in Responding to a Complaint. When you receive a complaint, you should refer to Paragraph 5 of the Rules of Procedure in determining how sizin response should be prepared. Any of the following circumstances, in particular but without limitation, if found by the Panel to be proved based on its evaluation of all evidence presented, shall demonstrate sizin rights və ya legitimate interests to the domen name fvə ya purposes of Paragraph 4(a)(ii):

1. befvə yae any notice to you of the dispute, sizin use of, və ya demonstrable preparations to use, the domen name və ya a name cvə yaresponding to the domen name in connection with a bona fide offering of goods və ya Xidməts; və ya

2. you (as an individual, business, və ya other və yaganization) have been commonly kindin by the domen name, even if you have acquired no trademark və ya Xidmət mark rights; və ya

3. you are making a legitimate noncommercial və ya fair use of the domen name, without intent fvə ya commercial gain to misleadingly divert consumers və ya to tarnish the trademark və ya Xidmət mark at issue.

4. Selection of Provider. The complainant shall select the Provider from among those approved by ICANN by submitting the complaint to that Provider. The selected Provider will administer the proceeding, except in cases of consolidation as described in Paragraph 4(f).

5. Initiation of Proceeding və Process və Appointment of Administrative Panel. The Rules of Procedure state the process fvə ya initiating və conducting a proceeding və fvə ya appointing the panel that will decide the dispute (the "Administrative Panel").

6. Consolidation. In the event of multiple disputes between you və a complainant, either you və ya the complainant may petition to consolidate the disputes befvə yae a single Administrative Panel. This petition shall be made to the first Administrative Panel appointed to hear a pending dispute between the parties. This Administrative Panel may consolidate befvə yae it any və ya all such disputes in its sole discretion, provided that the disputes being consolidated are governed by this Policy və ya a later version of this Policy adopted by ICANN.

7. Fees. Hamısı fees charged by a Provider in connection with any dispute befvə yae an Administrative Panel pursuant to this Policy shall be paid by the complainant, except in cases wburada you elect to expvə the Administrative Panel from one to three panelists as provided in Paragraph 5(b)(iv) of the Rules of Procedure, in which case all fees will be split evenly by you və the complainant.

8. Bizim Involvement in Administrative Proceedings. We do not, və will not, participate in the administration və ya conduct of any proceeding befvə yae an Administrative Panel. In addition, we will not be liable as a result of any decisions rendered by the Administrative Panel.

9. Remedies. The remedies available to a complainant pursuant to any proceeding befvə yae an Administrative Panel shall be limited to requiring the cancellation of sizin domen name və ya the transfer of sizin domen name registration to the complainant.

10. Xeyrtification və Publication. The Provider shall notify us of any decision made by an Administrative Panel with respect to a domen name you have qeydiyyated with us. Hamısı decisions under this Policy will be published in full over the Internet, except when an Administrative Panel determines in an exceptional case to redact pvə yations of its decision.

11. Availability of Court Proceedings. The mvəatvə yay administrative proceeding requirements set fvə yath in Paragraph 4 shall not gerient either you və ya the complainant from submitting the dispute to a court of competent jurisdiction fvə ya independent resolution befvə yae such mvəatvə yay administrative proceeding is commenced və ya after such proceeding is concluded. Əgər an Administrative Panel decides that sizin domen name registration should be canceled və ya transferred, we will wait ten (10) business days (as observed in the location of our principal office) after we are infvə yamed by the applicable Provider of the Administrative Panel's decision befvə yae implementing that decision. We will then implement the decision unless we have received from you during that ten (10) business day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that you have commenced a lawsuit against the complainant in a jurisdiction to which the complainant has submitted under Paragraph 3(b)(xiii) of the Rules of Procedure. (In general, that jurisdiction is either the location of our principal office və ya of sizin address as shown in our Whois database. 9. Policy modifications

We reserve the right to modify this Policy at any time with the permission of ICANN. We will post our revised Policy at this location at least thirty (30) calendar days befvə yae it becomes effective.      The Policy on Transfer of Sponsvə yaship of Qeydiyyats between Qeydiyyatçıs which is in fvə yace as part of the Registry-Qeydiyyatçı Agreement executed between a Qeydiyyatçı və the Registry, as well as the Qeydiyyatçı Akkreditasiya Agreement which is executed between ICANN və all ICANN- accredited registrars.

2. Dispute Resolution Process

     Tburada are two possible steps to the Qeydiyyatçı Transfer Dispute Resolution Process. A Qeydiyyatçı may elect one və ya both of the steps pursuant to the rules below. In the event a Qeydiyyatçı either files a Request fvə ya Enfvə yacement (as described below) with a Second-Səviyyə Dispute Provider, və ya files an Appeal (as described below) with a Dispute Provider, it may not revert to the First-Səviyyə Registry option later fvə ya the same filing və ya matter presented fvə ya resolution.

2.1 First Səviyyə - Registry Operatvə ya

     A Qeydiyyatçı may choose to file a dispute directly with the relevant Registry Operatvə ya. Any decisions made by the Registry Operatvə ya may be appealed to a Dispute Resolution Provider. A Qeydiyyatçı may file a dispute directly to a Dispute Resolution Provider; however, in that case the filing Qeydiyyatçı would fvə yafeit any right to appeal the decision of the Dispute Resolution Provider.

2.2 Second-Səviyyə - Dispute Resolution Panel

     The primary intent of this step is to provide a means fvə ya registrars to appeal decisions made by the Registry at the first level of the dispute resolution process, but it may also be used as the first step if a registrar so elects. The decision of the Dispute Resolution Panel is final, except as it may be appealed to a court of competent jurisdiction.

2.3 Statute of Limitations

     A dispute must be filed no later than six (6) months after the alleged violation of the Transfer Policy. In the case wburada a Qeydiyyatçı of Recvə yad alleges that a transfer was in violation of this Policy, the date the transfer was completed shall be deemed the date in which the "alleged violation" took place. In the case wburada a Gaining Qeydiyyatçı alleges that a transfer should have taken place, the date in which the NACK (as defined below) was received by the Registry, shall be deemed the date in which the "alleged violation" took place.

3. Dispute Procedures at the First Səviyyə (Registry)

3.1 Qeydiyyatçı files a Request fvə ya Enfvə yacement with the applicable Registry Operatvə ya

     3.1.1 Either the Gaining və ya Qeydiyyatçı of Recvə yad ("Filing Qeydiyyatçı") may submit a Request fvə ya Enfvə yacement. This must be done in accvə yadance with the Supplemental Rules adopted by the applicable Registry Operatvə ya.

     3.1.2 The Request fvə ya Enfvə yacement shall be submitted to the Registry və to the Respondent (the Xeyrn-filing Qeydiyyatçı) in electronic fvə yam və shall:
     (i) Request that the Request fvə ya Enfvə yacement be submitted fvə ya decision in accvə yadance with the Qeydiyyatçı Transfer və Dispute Resolution Policy və the applicable Supplemental Rules;
     (ii) Provide the name, postal və e-mail addresses, və the telephone və fax numbers of the Filing Qeydiyyatçı və those representatives authvə yaized by the Filing Qeydiyyatçı to act on behalf of the Filing Qeydiyyatçı in the administrative proceeding;
     (iii) Provide the name of the Respondent və all infvə yamation (including any postal və e-mail addresses və telephone və fax numbers) kindin to Filing Qeydiyyatçı regarding how to contact Respondent və ya any representative of Respondent, including contact infvə yamation based on pre-complaint dealings;
     (iv) Specify the domen name(s) that is/are the subject of the Request fvə ya Enfvə yacement;
     (v) Specify the incident(s) that gave rise to the dispute;
     (vi) Describe, in accvə yadance with the Policy, the grounds on which the Request fvə ya Enfvə yacement is based;
     (vii) State the specific remedy being sought (either approval və ya denial of the transfer);
     (viii) Identify any other legal proceedings that have been commenced və ya terminated in connection with və ya relating to any of the domen name(s) that are the subject of the complaint;
     (ix) Certify that a copy of the Request fvə ya Enfvə yacement, together with the cover sheet as prescribed by the Provider's Supplemental Rules, has been sent və ya transmitted to the Respondent; və
     (x) Conclude with the following statement followed by the signature of the Complainant və ya its authvə yaized representative:
           "<insert name of Filing Qeydiyyatçı> agrees that its claims və remedies concerning the registration of the domen name, the dispute, və ya the dispute's resolution shall be solely against the Respondent və waives all such claims və remedies against the Registry Operatvə ya as well as its directvə yas, officers, employees, və agents, except in the case of deliberate wrongdoing və ya gross negligence."
           "<insert name of Filing Qeydiyyatçı> certifies that the infvə yamation contained in this Request fvə ya Enfvə yacement is to the best of Filing Qeydiyyatçı's kindiledge complete və accurate, that this Request fvə ya Enfvə yacement is not being presented fvə ya any improper purpose, such as to harass, və that the assertions in this Request fvə ya Enfvə yacement are warranted under this Policy və under applicable law, as it indi exists və ya as it may be extended by a good-faith və reasonable argument."3.1.3 The Request fvə ya Enfvə yacement may relate to mvə yae than one domen name, provided that the domen names involve the same Filing Qeydiyyatçı və Respondent və that the claims arise out of the same və ya similar factual circumstances.

3.1.4 The Request fvə ya Enfvə yacement shall annex the following documentary evidence (as applicable və available) in electronic fvə yam if possible, together with a schedule indexing such evidence:
  (i) Fvə ya the Gaining Qeydiyyatçı:
      a. Completed Fvə yam of Authvə yaization ("FOA")
      b. Copy of the Whois output fvə ya the date transfer was initiated, which was used to identify the authvə yaized Transfer Əlaqəs
      c. Copy of evidence of identity used
      d. Copy of a bilateral agreement, final determination of a dispute resolution body və ya court və yader in cases when the Registrant of Recvə yad is being changed simultaneously with a Qeydiyyatçı Transfer
      e. Copies of all communications made to the Qeydiyyatçı of Recvə yad with regard to the applicable transfer request along with any responses from the Qeydiyyatçı of Recvə yad
  (ii) Fvə ya the Qeydiyyatçı of Recvə yad:
      a. Completed FOA from Qeydiyyatçı of Recvə yad if applicable
      b. Copy of the Whois output fvə ya the date the transfer was initiated
      c. Relevant histvə yay of Whois modifications made to the applicable registration
      d. Evidence of one of the following if a transfer was denied:

• fraud;
• UDRP action;
• court və yader;
• Registrant və ya administrative contact identity dispute in accvə yadance with Section 4 [Qeydiyyatçı of Recvə yad Requirements]
• applicable payment dispute along with evidence that the registration was put on HOLD status;
• express written objection from the Qeydiyyated Ad Holder və ya Administrative Əlaqə;
• LOCK status along with proof of a reasonable means fvə ya the registrant to remove LOCK status as per Section __of Exhibit __ to this Agreement;
• domen name within 60 days of initial registration; və ya
• domen name within 60 days of a privə ya transfer.

      e. Copies of all communications made to the Gaining Qeydiyyatçı with regard to the applicable transfer request along with any responses from the Gaining Qeydiyyatçı.

3.2 The Xeyrn-Filing Qeydiyyatçı ("Respondent") shall have seven (7) calendar days from receipt of the Request fvə ya Enfvə yacement to prepare a Response to the Request fvə ya Enfvə yacement ("Response").

3.2.1 The Response shall be submitted in electronic fvə yam to both the Registry və Filing Qeydiyyatçı və shall:
      (i) Respond specifically to the statements və allegations contained in the Request fvə ya Enfvə yacement (This pvə yation of the response shall comply with any wvə yad və ya page limit set fvə yath in the Dispute Resolution Provider's Supplemental Rules.);
      (ii) Provide the name, postal və e-mail addresses, və the telephone və fax numbers of the Respondent (non-filing Qeydiyyatçı);
      (iii) Identify any other legal proceedings that have been commenced və ya terminated in connection with və ya relating to any of the domen name(s) that are the subject of the Request fvə ya Enfvə yacement;
      (iv) State that a copy of the Response has been sent və ya transmitted to the Filing Qeydiyyatçı;
      (v) Conclude with the following statement followed by the signature of the Respondent və ya its authvə yaized representative:
   "Respondent certifies that the infvə yamation contained in this Response is to the best of Respondent's kindiledge complete və accurate, that this Response is not being presented fvə ya any improper purpose, such as to harass, və that the assertions in this Response are warranted under these Rules və under applicable law, as it indi exists və ya as it may be extended by a good-faith və reasonable argument."; və
     (vi) Annex any documentary və ya other evidence upon which the Respondent relies, together with a schedule indexing such documents.

3.2.2 Kimi the request of the Respondent, the Registry Operatvə ya may, in exceptional cases, extend the period of time fvə ya the filing of the response, but in no case may the extension be mvə yae than an additional five (5) calendar days. The period may also be extended by written stipulation between the Parties, provided the stipulation is approved by the Registry Operatvə ya.

3.2.3 Əgər a Respondent does not submit a response, in the absence of exceptional circumstances, the Registry Operatvə ya shall decide the dispute based upon the Request fvə ya Enfvə yacement.

3.3 Registry Operatvə ya must review all applicable documentation və compare registrant/contact data with that contained within the authvə yaitative Whois database və reach a conclusion not later than 14 days after receipt of the Response.

3.3.1 Əgər the data included in the Request fvə ya Enfvə yacement does not match the data listed in the authvə yaitative Whois, the Registry Operatvə ya must contact each Qeydiyyatçı və require additional documentation.

3.3.2 Əgər the Gaining Qeydiyyatçı cannot provide a complete FOA with data matching that contained within the authvə yaitative Whois database, then the Registry Operatvə ya shall find that the transfer should be reversed. In the case of a thick Registry, if the Qeydiyyatçı of Recvə yad's Whois is not accessible və ya invalid, the Registry Operatvə ya's Whois should be used. In the case of a thin Registry, if the Qeydiyyatçı of Recvə yad's Whois is not accessible və ya is invalid, the Registry Operatvə ya must notify ICANN və place the dispute on hold until such time as the specific problem is resolved by ICANN.

3.3.3 In the case wburada a Qeydiyyatçı of Recvə yad denies a request fvə ya a domen name transfer ("NACKs"), the Qeydiyyatçı of Recvə yad must provide evidence of one of the factvə yas fvə ya which it is allowed to NACK. Əgər the Qeydiyyatçı of Recvə yad cannot provide evidence that demonstrates any of the factvə yas, və the Gaining Qeydiyyatçı provides to the Registry a complete FOA with data matching that contained within the authvə yaitative Whois database, then the transfer must be approved to be processed.

3.3.4 Əgər the data provided by neither Qeydiyyatçı appears to be conclusive, then the Registry shall issue a finding of "no decision." Əgər the data provided to the Registry is complete və provides sufficient basis fvə ya a determination based on the Policy, the Registry may not issue a finding of "no decision." Either Qeydiyyatçı shall be able to appeal such issue to a Second-Səviyyə Dispute Resolution Provider in accvə yadance with the provisions set fvə yath below.

3.4 Fees fvə ya First-Səviyyə Dispute Resolution Service

3.4.1 Tburada is no filing fee assessed to the Filing Qeydiyyatçı at the time the Request fvə ya Enfvə yacement is submitted to the Registry Operatvə ya.

3.4.2 The Qeydiyyatçı that does not geriail in the dispute will be assessed a fee to be set by the Registry Operatvə ya. Such fee shall be set fvə yath in the Registry's Supplemental Rules that are in effect at the time that the Request fvə ya Enfvə yacement was filed.

3.4.3 This fee shall not be passed on to the Registrant.

3.4.4 This fee will be charged after a final decision is rendered by the Registry. In the case that the Registry issues a finding of "no decision," the Registry Operatvə ya shall collect the applicable fees from the Filing Qeydiyyatçı.

3.5 Availability of Court Proceedings

      The procedures set fvə yath above shall not gerient a Qeydiyyatçı from submitting a dispute to a court of competent jurisdiction fvə ya independent resolution befvə yae such an administrative proceeding is commenced və ya after such proceeding is concluded. Əgər a Registry Operatvə ya decides a domen name registration should be transferred (either to the Gaining Qeydiyyatçı, və ya alternatively, back from the Gaining Qeydiyyatçı to the Qeydiyyatçı of Recvə yad), the Registry will wait fourteen (14) calendar days after it is infvə yamed of the decision befvə yae implementing that decision. The Registry will then implement the decision unless it has received during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted domen name(s). Əgər such documentation is received by the Registry Operatvə ya within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented to the Registry Operatvə ya that the parties have resolved such dispute; (ii) evidence is presented to the Registry Operatvə ya that the lawsuit has been dismissed və ya withdrawn; və ya (iii) the Registry Operatvə ya receives a copy of an və yader from such court.

4. Dispute Procedures at the Second Səviyyə with a Dispute Resolution Provider

4.1 The Xidməts of the Dispute Resolution Panel may be invoked in any of the following two situations:

      (i) A Filing Qeydiyyatçı may elect to skip the First-Səviyyə dispute process at Registry level və submit a Request fvə ya Enfvə yacement directly with a Dispute Resolution Provider;
      (ii) The non-geriailing Qeydiyyatçı in a First-Səviyyə dispute proceeding may submit an appeal of the applicable Registry Operatvə ya's decision to the Dispute Resolution Provider. Əlavə etitionally, in the case wburada the result in the First-Səviyyə dispute process is a "no-decision," either Qeydiyyatçı may file an Appeal of such decision to a Dispute Resolution Provider.

4.2 Initial Request fvə ya Enfvə yacement

4.2.1 In the event that the Filing Qeydiyyatçı elects to submit a Request fvə ya Enfvə yacement to the Dispute Resolution Provider in lieu of submitting a Request fvə ya Enfvə yacement to the applicable Registry Operatvə ya, the obligations və responsibilities set fvə yath in Sections 3.1 through 3.2 above shall apply.

4.2.2 The Dispute Resolution Panel appointed by the Dispute Resolution Provider must review all applicable documentation və compare registrant/contact data with that contained within the authvə yaitative Whois database və reach a conclusion not later than thirty (30) days after receipt of Response from the Respondent.
     (i) Əgər the data does not match the data listed in authvə yaitative Whois, the Dispute Resolution Panel should contact each Qeydiyyatçı və require additional documentation.
     (ii) Əgər the Gaining Qeydiyyatçı is unable to provide a complete FOA with data matching that contained within the authvə yaitative Whois database at the time of the transfer request, then the Dispute Resolution Panel shall find that the transfer should be reversed. In the case of a thick Registry, if the Qeydiyyatçı of Recvə yad's Whois is not accessible və ya invalid, the applicable Registry Operatvə ya's Whois should be used. In the case of a thin Registry, if the Qeydiyyatçı of Recvə yad's Whois is not accessible və ya is invalid, the Dispute Resolution Provider may place the dispute on hold until such time as the problem is resolved.
     (iii) In the case wburada a Qeydiyyatçı of Recvə yad NACKs a transfer, the Qeydiyyatçı of Recvə yad must provide evidence of one of the factvə yas fvə ya which it is allowed to NACK as set fvə yath in Section 3.1.4 (ii) of this Dispute Resolution Policy. Əgər the Qeydiyyatçı of Recvə yad cannot provide evidence that demonstrates any of the factvə yas, və the Gaining Qeydiyyatçı provides to the Dispute Resolution Provider a complete FOA with data matching that contained within the authvə yaitative Whois database at the time of the transfer request, then the transfer should be approved.
     (iv) Unlike under the First-Səviyyə dispute process, the Dispute Resolution Panel may not issue a finding of "no decision." It must weigh the applicable evidence in light of the Transfer policies və determine, based on a preponderance of the evidence, which Qeydiyyatçı should geriail in the dispute və what resolution to the Request fvə ya Enfvə yacement will appropriately redress the issues set fvə yath in the Request fvə ya Enfvə yacement.
     (v) Resolution options fvə ya the Dispute Resolution Panel are limited to the following:
  a. Approve Transfer
  b. Deny the Transfer (və ya və yadering the domen name be returned to the Qeydiyyatçı of Recvə yad in cases wburada a Transfer has already occurred)

4.3 Appeal of First Səviyyə Dispute Decision və ya Registry Operatvə ya Finding of "Xeyr-Decision."

4.3.1 In the event that the Qeydiyyatçı which does not geriail in the First-Səviyyə dispute is dissatisfied by the Registry-Operatvə ya's decision, such Qeydiyyatçı may file an appeal with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-Səviyyə decision was issued.

4.3.2 In the event that the Registry Operatvə ya issues a finding of "no-decision" in accvə yadance with Section 3.3.4 above, either Qeydiyyatçı may file an appeal of such decision with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-Səviyyə decision was issued.

4.3.3 In either case, the document submitted by the Qeydiyyatçı to the Dispute Resolution Provider shall be referred to as an "Appeal."

4.3.4 The Appellant shall submit the Appeal in electronic fvə yam və shall:
     (i) Request that the Appeal be submitted fvə ya decision in accvə yadance with the Policy və these Rules;
     (ii) Provide the name, postal və e-mail addresses, və the telephone və telefax numbers of the Appellant və of any representative authvə yaized by the Appellant to act on behalf of the Appellant in the administrative proceeding;
     (iii) Provide the name of the Appellee və all infvə yamation (including any postal və e-mail addresses və telephone və telefax numbers) kindin to Appellee regarding how to contact Appellee və ya any representative of Appellee, including contact infvə yamation based on pre-Request fvə ya Enfvə yacement və pre-Appeal dealings;
     (iv) Specify the domen name(s) that is/are the subject of the Appeal;
     (v) Specify the incident(s) which gave rise to the dispute;
     (vi) State the basis fvə ya such appeal, including specific responses to the findings of the Registry Operatvə ya in the First-Səviyyə Dispute process. (This pvə yation of the response shall comply with any wvə yad və ya page limit set fvə yath in the Dispute Resolution Provider's Supplemental Rules);
     (vii) Specify, in accvə yadance with the Policy, the remedies sought;
     (viii) Identify any other related legal proceedings kindin to the Appellant that have been commenced və ya terminated in connection with və ya relating to any of the domen name(s) that are the subject of the complaint;
      (ix) State that a copy of the Appeal, together with the cover sheet as prescribed by the Dispute Resolution Provider's Supplemental Rules, has been sent və ya transmitted to the Appellee; və
      (x) Conclude with the following statement followed by the signature of the Appellant və ya its authvə yaized representative:
  "Appellant agrees that its claims və remedies concerning the registration of the domen name, the dispute, və ya the dispute's resolution shall be solely against the Appellee və waives all such claims və remedies against the Dispute Resolution Provider və the Registry Operatvə ya as well as their directvə yas, officers, employees, və agents, except in the case of deliberate wrongdoing və ya gross negligence."
  "Appellant certifies that the infvə yamation contained in this Appeal is to the best of Appellant's kindiledge complete və accurate, that this Appeal is not being presented fvə ya any improper purpose, such as to harass, və that the assertions in this Appeal are warranted under this Policy və under applicable law, as it indi exists və ya as it may be extended by a good-faith və reasonable argument."

4.3.5 The Appeal may relate to mvə yae than one domen name, provided that the domen names involve the same decision issued by the Registry Operatvə ya fvə ya the First-Səviyyə Dispute.4.3.6 The Appeal shall annex any documentary evidence that was not already submitted to the Registry Operatvə ya during the First-Səviyyə Dispute.

4.3.7 A Dispute Resolution Provider must request all documentation relating to the First-Səviyyə Dispute from the applicable Registry Operatvə ya no later than seven (7) calendar days of receipt of the appeal. The Registry Operatvə ya shall submit such documentation to the Dispute Resolution Provider within seven (7) days of such request.

4.3.8 The Dispute Resolution Panel must review all applicable documentation və reach a conclusion not later than 30 calendar days after receipt of the Appeal.
     (i) The Dispute Resolution Panel may submit questions to the Registry, the Appellant və ya Appellee.
     (ii) Responses to all such questions must be received by the Dispute Resolution Panel within 7 days.
     (iii) The Dispute Resolution Panel shall review each Appeal on a De Xeyrvo basis. Although the Dispute Resolution Panel is not bound by the findings of the Registry Operatvə ya in an Appeal, it shall have the discretion to consider such findings in reaching its own conclusions. The purpose of the Dispute Resolution Panel should be to make a determination as to whether the Appeal has merit based solely on the requirements of the current Transfer policy və determine the appropriate resolution to the issues presented.

• Approval of a Transfer
• Denial of the Transfer (və ya və yadering the domen name be returned to the Qeydiyyatçı of Recvə yad in cases wburada a Transfer has already occurred)

4.4 Fees fvə ya Second-Səviyyə Dispute Resolution Service

4.4.1 In the case of either a Request fvə ya Enfvə yacement və ya an Appeal filed at the Second Səviyyə, the applicable Dispute Resolution Provider shall determine the applicable filing fee ("Filing Fee"). The specific fees along with the terms və conditions governing the actual payment of such fees shall be included in the Dispute Resolution Provider's Supplemental Rules.

4.4.2 In the event that the Filing Qeydiyyatçı və ya Appellant, whichever applicable, does not geriail in a Second-Səviyyə dispute, the Filing Fees shall be retained by the Dispute Resolution Provider.

4.4.3 In the event that the Filing Qeydiyyatçı və ya Appellant, whichever applicable, geriails in a Second-Səviyyə dispute, the Respondent və ya Appellee, whichever applicable, must submit to the Dispute Resolution Provider, the Filing Fees within fourteen (14) calendar days after such decision. In such an event, the Dispute Resolution Provider shall refund to the Filing Qeydiyyatçı və ya Appellant, whichever applicable, the Filing Fees, no later than fourteen (14) calendar days after it receives the Filing Fees from the Respondent və ya Appellee. Such fees must be paid regardless of whether a Court Proceeding is commenced in accvə yadance with Section 4.5 below. Failure to pay Filing Fees to the Dispute Resolution Provider may result in the loss of accreditation by ICANN.

4.5 Availability of Court Proceedings

     The procedures set fvə yath above shall not gerient a Qeydiyyatçı from submitting a dispute to a court of competent jurisdiction fvə ya independent resolution befvə yae such administrative proceeding is commenced və ya after such proceeding is concluded. Əgər a Dispute Resolution Panel decides a domen name registration should be transferred (either to the Gaining Qeydiyyatçı, və ya alternatively, back from the Gaining Qeydiyyatçı to the Qeydiyyatçı of Recvə yad), such Qeydiyyatçı will wait fourteen (14) calendar days after it is infvə yamed of the decision befvə yae implementing that decision. The Registry will then implement the decision unless it has received from either of the parties to the dispute during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted domen name(s). Əgər such documentation is received by the Registry, as applicable, within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented that the parties have resolved such dispute; (ii) evidence is presented that the lawsuit has been dismissed və ya withdrawn; və ya (iii) a copy of an və yader from such court dismissing the lawsuit və ya və yadering certain actions with respect to the domen name.

1. Qeydiyyatçı Requirements

     Qeydiyyated Ad Holders must be able to transfer their domen name registrations between Qeydiyyatçıs provided that the Gaining Qeydiyyatçı's transfer process meets the minimum stvəards of this policy və that such transfer is not prohibited by ICANN və ya Registry policies. Inter-Qeydiyyatçı domen name transfer processes must be clear və concise in və yader to avoid confusion. Further, Qeydiyyatçıs should make reasonable effvə yats to infvə yam Qeydiyyated Ad Holders of, və provide access to, the published documentation of the specific transfer process employed by the Qeydiyyatçıs.

1.1 Transfer Authvə yaities

     The Administrative Əlaqə və the Qeydiyyated Ad Holder, as listed in the Losing Qeydiyyatçı's və ya applicable Registry's (wburada available) publicly accessible WHOIS Xidmət are the only parties that have the authvə yaity to approve və ya deny a transfer request to the Gaining Qeydiyyatçı. In the event of a dispute, the Qeydiyyated Ad Holder's authvə yaity supersedes that of the Administrative Əlaqə.
Qeydiyyatçıs may use Whois data from either the Qeydiyyatçı of Recvə yad və ya the relevant Registry fvə ya the purpose of verifying the authenticity of a transfer request; və ya from another data source as determined by a consensus policy.

2. Gaining Qeydiyyatçı Requirements

Fvə ya each instance wburada a Qeydiyyated Ad Holder requests to transfer a domen name registration to a different Qeydiyyatçı, the Gaining Qeydiyyatçı shall:
      2.1 Obtain express authvə yaization from either the Qeydiyyated Ad Holder və ya the Administrative Əlaqə (buradaafter, "Transfer Əlaqə"). Hence, a transfer may only proceed if confirmation of the transfer is received by the Gaining Qeydiyyatçı from the Transfer Əlaqə.

     2.1.1 The authvə yaization must be made via a valid Stvəardized Fvə yam of Authvə yaization (FOA). Tburada are two different FOA's available at the ICANN website. The FOA labeled "Initial Authvə yaization fvə ya Qeydiyyatçı Transfer" must be used by the Gaining Qeydiyyatçı to request an authvə yaization fvə ya a registrar transfer from the Transfer Əlaqə. The FOA labeled "Təsdiq etation of Qeydiyyatçı Transfer Request" may be used by the Qeydiyyatçı of Recvə yad to request confirmation of the transfer from the Transfer Əlaqə.
The FOA shall be communicated in English, və any dispute arising out of a transfer request shall be conducted in the English language. Qeydiyyatçıs may choose to communicate with the Transfer Əlaqə in additional languages. However, Qeydiyyatçıs choosing to exercise such option are responsible fvə ya the accuracy və completeness of the translation into such additional non-English version of the FOA.

     2.1.2 In the event that the Gaining Qeydiyyatçı relies on a physical process to obtain this authvə yaization, a paper copy of the FOA will suffice insofar as it has been signed by the Transfer Əlaqə və further that it is accompanied by a physical copy of the Qeydiyyatçı of Recvə yad's Whois output fvə ya the domen name in question.

     2.1.2.1 Əgər the Gaining Qeydiyyatçı relies on a physical authvə yaization process, then the Gaining Qeydiyyatçı assumes the burden of obtaining reliable evidence of the identity of the Transfer Əlaqə və maintaining appropriate recvə yads proving that such evidence was obtained. Further the Gaining Qeydiyyatçı also assumes the burden fvə ya ensuring that the entity making the request is indeed authvə yaized to do so. The acceptable fvə yams of physical identity are:

• Xeyrtarized statement
• Valid Drivers license
• Pasport
• Article of Incvə yapvə yaation
• Military ID
• State/Government issued ID
• Birth Certificate

     2.1.3 In the event that the Gaining Qeydiyyatçı relies on an electronic process to obtain this authvə yaization the acceptable fvə yams of identity would include:

• Electronic signature in confvə yamance with national legislation, in the location of the Gaining Qeydiyyatçı (if such legislation exists).
• Consent from an individual və ya entity that has an email address matching the Transfer Əlaqə email address. 

     The Qeydiyyatçı of Recvə yad may not deny a transfer request solely because it believes that the Gaining Qeydiyyatçı has not received the confirmation set fvə yath above.
A transfer must not be allowed to proceed if no confirmation is received by the Gaining Qeydiyyatçı. The presumption in all cases will be that the Gaining Qeydiyyatçı has received və authenticated the transfer request made by a Transfer Əlaqə.

     2.2 Request, by the transmission of a "transfer" commvə as specified in the Qeydiyyatçı Üçünol Kit, that the Registry Operatvə ya database be changed to reflect the new Qeydiyyatçı.

     2.2.1 Transmission of a "transfer" commvə constitutes a representation on the part of the Gaining Qeydiyyatçı that the requisite authvə yaization has been obtained from the Transfer Əlaqə listed in the authvə yaitative Whois database.

     2.2.2 The Gaining Qeydiyyatçı is responsible fvə ya validating the Qeydiyyated Ad Holder requests to transfer domen names between Qeydiyyatçıs. However, this does not preclude the Qeydiyyatçı of Recvə yad from exercising its option to independently confirm the Qeydiyyated Ad Holder's intent to transfer its domen name to the Gaining Qeydiyyatçı in accvə yadance with Section 3 of this policy.

3. Obligations of the Qeydiyyatçı of Recvə yad

     A Qeydiyyatçı of Recvə yad can choose independently to confirm the intent of the Qeydiyyated Ad Holder when a notice of a pending transfer is received from the Registry. The Qeydiyyatçı of Recvə yad must do so in a manner consistent with the stvəards set fvə yath in this agreement pertaining to Gaining Qeydiyyatçıs. In və yader to ensure that the fvə yam of the request employed by the Qeydiyyatçı of Recvə yad is substantially administrative və infvə yamative in nature və clearly provided to the Transfer Əlaqə fvə ya the purpose of verifying the intent of the Transfer Əlaqə, the Qeydiyyatçı of Recvə yad must use the FOA.

     The FOA shall be communicated in English, və any dispute arising out of a transfer request, shall be conducted in the English language. Qeydiyyatçıs may choose to communicate with the Transfer Əlaqə in additional languages. However, the Qeydiyyatçı choosing to exercise such option is responsible fvə ya the accuracy və completeness of the translation into such additional non-English version of the FOA. Further, such non-English communications must follow the processes və procedures set fvə yath in this policy. This includes but is not limited to the requirement that no Qeydiyyatçı shall add any additional infvə yamation to the FOA used to obtain the consent of the Transfer Əlaqə in the case of a transfer request.
This requirement does not preclude the Qeydiyyatçı of Recvə yad from marketing to its existing customers through separate communications.
The FOA should be sent by the Qeydiyyatçı of Recvə yad to the Transfer Əlaqə as soon as operationally possible, but must be sent not later than twenty-four (24) hours after receiving the transfer request from the Registry Operatvə ya.Failure by the Qeydiyyatçı of Recvə yad to respond within five (5) calendar days to a notification from the Registry regarding a transfer request will result in a default "approval" of the transfer.

     In the event that a Transfer Əlaqə listed in the Whois has not confirmed their request to transfer with the Qeydiyyatçı of Recvə yad və the Qeydiyyatçı of Recvə yad has not explicitly denied the transfer request, the default action will be that the Qeydiyyatçı of Recvə yad must allow the transfer to proceed.
Upon denying a transfer request fvə ya any of the following reasons, the Qeydiyyatçı of Recvə yad must provide the Qeydiyyated Ad Holder və the potential Gaining Qeydiyyatçı with the reason fvə ya denial. The Qeydiyyatçı of Recvə yad may deny a transfer request only in the following specific instances:

1. Evidence of fraud
2. UDRP action
3. Court və yader by a court of competent jurisdiction
4. Reasonable dispute over the identity of the Qeydiyyated Ad Holder və ya Administrative Əlaqə
5. Xeyr payment fvə ya geriious registration period (including credit card charge-backs) if the domen name is past its expiration date və ya fvə ya geriious və ya current registration periods if the domen name has not yet expired. In all such cases, however, the domen name must be put into "Qeydiyyatçı Hold" status by the Qeydiyyatçı of Recvə yad privə ya to the denial of transfer.
6. Express written objection to the transfer from the Transfer Əlaqə. (e.g. - email, fax, paper document və ya other processes by which the Transfer Əlaqə has expressly və voluntarily objected through opt-in means)
7. A domen name was already in “lock status” provided that the Qeydiyyatçı provides a readily accessible və reasonable means fvə ya the Qeydiyyated Ad Holder to remove the lock status.
8. A domen name is in the first 60 days of an initial registration period.
9. A domen name is within 60 days (və ya a lesser period to be determined) after being transferred (apart from being transferred back to the və yaiginal Qeydiyyatçı in cases wburada both Qeydiyyatçıs so agree və/və ya wburada a decision in the dispute resolution process so directs).

Instances when the requested change of Qeydiyyatçı may not be denied include, but are not limited to:

• Xeyrnpayment fvə ya a pending və ya future registration period
• Xeyr response from the Qeydiyyated Ad Holder və ya Administrative Əlaqə.
• Domen name in Qeydiyyatçı Lock Status, unless the Qeydiyyated Ad Holder is provided with the reasonable oppvə yatunity və ability to unlock the domen name privə ya to the Transfer Request.
• Domen name registration period time constraints, other than during the first 60 days of initial registration və ya during the first 60 days after a registrar transfer.
• General payment defaults between Qeydiyyatçı və business partners / affiliates in cases wburada the Qeydiyyated Ad Holder fvə ya the domen in question has paid fvə ya the registration.

     The Qeydiyyatçı of Recvə yad has other mechanisms available to collect payment from the Qeydiyyated Ad Holder that are independent from the Transfer process. Hence, in the event of a dispute over payment, the Qeydiyyatçı of Recvə yad must not employ transfer processes as a mechanism to secure payment fvə ya Xidməts from a Qeydiyyated Ad Holder. Exceptions to this requirement are as follows:
     (i) In the case of non-payment fvə ya geriious registration period(s) if the transfer is requested after the expiration date, və ya
     (ii) In the case of non-payment of the current registration period, if transfer is requested befvə yae the expiration date.

4. Qeydiyyatçı Covə yadination

     Each Qeydiyyatçı is responsible fvə ya keeping copies of documentation, including the FOA və the Transfer Əlaqəs response tburadato, that may be required fvə ya filing və suppvə yating a dispute under the dispute resolution policy. Gaining Qeydiyyatçıs must maintain copies of the FOA as received from the Transfer Əlaqə as per the stvəard document retention policies of the contracts. Copies of the reliable evidence of identity must be kept with the FOA.

     Both the Gaining Qeydiyyatçı və the Qeydiyyatçı of Recvə yad must provide the evidence relied on fvə ya the transfer during və after the applicable inter-registrar domen name transaction(s). Such infvə yamation must be provided when requested by, və only by, the other Qeydiyyatçı that is party to the transfer transaction. Əlavə etitionally, ICANN, the Registry Operatvə ya, a court və ya authvə yaity with jurisdiction over the matter və ya a third party dispute resolution panel may also require such infvə yamation within five (5) days of the request.

     The Gaining Qeydiyyatçı must retain, və produce pursuant to a request by a Losing Qeydiyyatçı, a written və ya electronic copy of the FOA. In instances wburada the Qeydiyyatçı of Recvə yad has requested copies of the FOA, the Gaining Qeydiyyatçı must fulfill the Qeydiyyatçı of Recvə yads request (including providing the attendant suppvə yating documentation) within five (5) calendar days. Failure to provide this documentation within the time period specified is grounds fvə ya reversal by the Registry Operatvə ya və ya the Dispute Resolution Panel in the event that a transfer complaint is filed in accvə yadance with the requirements of this policy.

     Əgər either a Qeydiyyatçı of Recvə yad və ya a Gaining Qeydiyyatçı does not believe that a transfer request was hvəled in accvə yadance with the provisions of this policy, then the Qeydiyyatçı may initiate a dispute resolution procedure as set fvə yath in Section C of this policy.

     Fvə ya purposes of facilitating transfer requests, Qeydiyyatçıs should provide və maintain a unique və private email address fvə ya use only by other Qeydiyyatçıs və the Registry:
     i. This email address is fvə ya issue related to transfer requests və the procedures set fvə yath in this policy only.
     ii. The email address should be managed to ensure messages are received by someone who can respond to the transfer issue.
     iii. Mesajs received at such email address must be responded to within a commercial reasonable timeframe not to exceed seven (7) calendar days.

5. EPP - based Registry Requirements fvə ya Qeydiyyatçıs

     In EPP-based gTLD Registries, Qeydiyyatçıs must follow the requirements set fvə yath below.
Qeydiyyatçıs must provide the Qeydiyyated Ad Holder with the unique "AuthInfo" code within five (5) calendar days of the Qeydiyyated Ad Holder's initial request if the Qeydiyyatçı does not provide facilities fvə ya the Qeydiyyated Ad Holder to generate və manage their own unique "AuthInfo" code.

     Qeydiyyatçıs may not employ any mechanism fvə ya complying with a Qeydiyyated Ad Holder's request to obtain the applicable "AuthInfo Code" that is mvə yae restrictive than the mechanisms used fvə ya changing any aspect of the Qeydiyyated Ad Holder's contact və ya name server infvə yamation.

     The Qeydiyyatçı of Recvə yad must not refuse to release an "AuthInfo Code" to the Qeydiyyated Ad Holder solely because tburada is a dispute between the Qeydiyyated Ad Holder və the Qeydiyyatçı over payment.

Qeydiyyatçı-generated "AuthInfo" codes must be unique on a per-domen basis.
     The "Auth-Info" codes must be used solely to identify a Qeydiyyated Ad Holder, wburadaas the FOA's still need to be used fvə ya authvə yaization və ya confirmation of a transfer request, as described in Section 2 və Section 4 of this policy.

6. Registry Requirements

     Upon receipt of the "transfer" commvə from the Gaining Qeydiyyatçı, Registry Operatvə ya will transmit an electronic notification to both Qeydiyyatçıs. In the case of those Registries that use electronic mail notifications, the response notification may be sent to the unique email address established by each Qeydiyyatçı fvə ya the purpose of facilitating transfers.

     The Registry Operatvə ya shall complete the requested transfer unless, within five (5) calendar days, Registry Operatvə ya receives a NACK protocol commvə from the Qeydiyyatçı of Recvə yad.
When the Registry's database has been updated to reflect the change to the Gaining Qeydiyyatçı, Registry Operatvə ya will transmit an electronic notification to both Qeydiyyatçıs. The notification may be sent to       the unique email address established by each Qeydiyyatçı fvə ya the purpose of facilitating transfers və ya such other email address agreed to by the parties.
The Registry Operatvə ya shall undo a transfer if, after a transfer has occurred, the Registry Operatvə ya receives one of the notices as set fvə yath below. In such case, the transfer will be reversed və the domen name reset to its və yaiginal state. The Registry Operatvə ya must undo the transfer within five (5) calendar days of receipt of the notice except in the case of a Registry dispute decision, in which case the Registry Operatvə ya must undo the transfer within fourteen calendar days unless a court action is filed. The notice required shall be one of the following:
     i. Agreement of the Qeydiyyatçı of Recvə yad və the Gaining Qeydiyyatçı sent by email, letter və ya fax that the transfer was made by mistake və ya was otherwise not in accvə yadance with the procedures set fvə yath in this policy;
     ii. The final determination of a dispute resolution body having jurisdiction over the transfer; və ya
     iii. Order of a court having jurisdiction over the transfer.

7. Recvə yads of Qeydiyyat

     Each Qeydiyyatçı shall require its customer, the Qeydiyyated Ad Holder, to maintain its own recvə yads appropriate to document və prove the initial domen name registration date.

8. Effect on Müddət of Qeydiyyat

     The completion by Registry Operatvə ya of a holder-authvə yaized transfer under this Part A shall result in a one-il extension of the existing registration, provided that in no event shall the total unexpired term of a registration exceed ten (10) il.

B. ICANN-Approved Transfers

     Transfer of the sponsvə yaship of all the registrations sponsvə yaed by one Qeydiyyatçı as the result of (i) acquisition of that Qeydiyyatçı və ya its assets by another Qeydiyyatçı, və ya (ii) lack of accreditation of that Qeydiyyatçı və ya lack of its authvə yaization with the Registry Operatvə ya, may be made accvə yading to the following procedure:
     (a) The gaining Qeydiyyatçı must be accredited by ICANN fvə ya the Registry TLD və must have in effect a Registry-Qeydiyyatçı Agreement with Registry Operatvə ya fvə ya the Registry TLD.
     (b) ICANN must certify in writing to Registry Operatvə ya that the transfer would promote the community interest, such as the interest in stability that may be threatened by the actual və ya imminent business failure of a Qeydiyyatçı.
Upon satisfaction of these two conditions, Registry Operatvə ya will make the necessary one-time changes in the Registry database fvə ya no charge, fvə ya transfers involving 50,000 name registrations və ya fewer. Əgər the transfer involves registrations of mvə yae than 50,000 names, Registry Operatvə ya will charge the gaining Qeydiyyatçı a one-time flat fee of US$ 50,000.

C. Transfer Dispute Resolution Policy

     Procedures fvə ya hvəling disputes concerning inter-registrar transfers are set fvə yath in the Transfer Dispute Resolution Policy. Procedures in this policy must be followed by the applicable Registry Operatvə yas və ICANN accredited Qeydiyyatçıs.
