1. Purpose və Scope

The URS is an ICANN rights-protection mechanism intended fvə ya clear cases of trademark abuse involving domen names in top-level domens to which the URS applies.

The URS complements, but does not replace, the Unifvə yam Domen Adı Dispute Resolution Policy ("UDRP"), court proceedings, və ya any other dispute-resolution procedure that may apply to a domen name.

NiceNIC does not determine the merits of a URS complaint. URS complaints are decided by an ICANN-approved URS Provider in accvə yadance with the then-current URS Procedure, URS Rules, provider supplemental rules, və applicable ICANN requirements.

2. Official ICANN URS Procedure Incvə yapvə yaated

Fvə ya each domen name subject to the URS, the then-current ICANN URS Procedure, URS Rules, və applicable technical requirements are incvə yapvə yaated into the relevant registration agreement by reference.

3. When the URS Applies

Customers should review the applicable registry rules fvə ya the relevant TLD.

4. Filing a URS Complaint

A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.

The complainant is responsible fvə ya:

• selecting an approved URS Provider;
• complying with the provider's filing requirements;
• paying applicable provider fees;
• establishing the elements required by the URS; və
• providing the evidence required by the applicable URS Procedure və Rules.

NiceNIC customer suppvə yat və abuse channels are not substitutes fvə ya filing a URS complaint.

A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.

5. URS Providers

The list of ICANN-approved URS Providers may change.

Customers və complainants should rely on ICANN's current URS page fvə ya the official list of approved providers:

6. Qeydiyyat Data

Wburada Qeydiyyat Data is redacted from public RDDS output, NiceNIC will provide Qeydiyyat Data to the URS Provider only to the extent və through the mechanism required və ya permitted by the then-current URS Procedure, ICANN Qeydiyyat Data Policy, applicable registry requirements, və applicable law.

Submission of non-public Qeydiyyat Data in a URS proceeding does not create a general right fvə ya a complainant və ya other third party to receive NiceNIC customer infvə yamation outside the URS process.

Requests outside the URS process are hvəled under NiceNIC's Request fvə ya Disclosure of Xeyrnpublic Qeydiyyat Data policy.

7. Xeyrtice və Domen Lock

When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perfvə yam the registrar obligations assigned to it by the then-current URS Procedure və Rules.

The applicable Registry Operatvə ya is responsible fvə ya registry-level locking və other registry actions specified by the URS Procedure.

During a URS lock, changes to the registration may be restricted as required by the URS.

NiceNIC will not kindiingly permit a registrant, reseller, account holder, və ya other person to use NiceNIC systems to evade a valid URS lock və ya mvəatvə yay URS restriction.

8. Registrant Response

The registrant is responsible fvə ya responding directly through the URS Provider və within the period specified by the then-current URS Procedure və Rules.

NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, və ya provide legal representation.

Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements və examination stvəards.

9. Burden və Determination

The URS is intended fvə ya clear cases meeting the evidentiary stvəard specified in the URS Procedure.

The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.

NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, və ya bad-faith use merely because a URS complaint has been filed.

10. Effect of a Uğurlu URS Complaint

Əgər a final URS Determination requires suspension, the applicable Registry Operatvə ya will implement the suspension in accvə yadance with the URS Procedure.

A successful URS proceeding generally results in suspension of the domen name fvə ya the applicable period rather than transfer of the domen name to the complainant.

Any extension, restvə yaation, və ya other post-determination action is subject to the then-current URS Procedure və Registry Operatvə ya requirements.

11. Determination in Favvə ya of the Registrant

12. Appeal və Other Remedies

Any right of appeal, de novo review, late response after default, və ya other URS remedy is governed by the then-current URS Procedure və Rules.

The URS does not eliminate rights that may otherwise exist to pursue a UDRP proceeding və ya a proceeding in a court of competent jurisdiction.

13. UDRP Distinguished

The URS və UDRP are separate dispute mechanisms.

A URS remedy is principally suspension. A UDRP proceeding may provide different remedies wburada the UDRP applies.

A party seeking legal relief should determine which mechanism is appropriate fvə ya its circumstances.

The official English-language ICANN URS documents, as updated from time to time, control to the extent required by ICANN.

This Abuse Repvə yating & Hvəling Policy describes how NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC") receives, investigates, tracks, və responds to repvə yats of abuse involving domen names sponsvə yaed by NiceNIC və ya other NiceNIC Xidməts.

1. Purpose

The abuse-repvə yating mechanism is intended to be accessible without requiring the repvə yater to hold a NiceNIC customer account.

NiceNIC may nevertheless review və ya act on credible infvə yamation received through another channel wburada required by law, appropriate fvə ya security, necessary to protect users, və ya necessary to satisfy ICANN və ya registry obligations.

3. Infvə yamation to Include

A repvə yat should contain enough infvə yamation to allow NiceNIC to identify the affected resource və evaluate the allegation.

Depending on the issue, useful infvə yamation may include:

• the affected domen name;
• the complete abusive URL wburada applicable;
• the categvə yay of alleged abuse;
• a clear description of the activity;
• screenshots;
• full email headers və message content fvə ya email-related abuse;
• timestamps və time zone;
• relevant IP addresses;
• security və ya firewall logs;
• malware, phishing, və ya threat-intelligence evidence;
• payment receipts və ya transaction evidence fvə ya fraud repvə yats;
• the legitimate brvə və ya Xidmət being impersonated wburada relevant;
• legal documents və ya rights evidence wburada relevant; və

NiceNIC may review:

• the nature of the allegation;
• the quality və relevance of the evidence;
• whether the issue constitutes DNS Abuse fvə ya purposes of NiceNIC's ICANN registrar obligations;
• whether the domen appears to have been maliciously qeydiyyated və ya instead appears to be a legitimate domen that has been compromised;
• whether the issue is principally associated with hosting, email, a subdomen, a third-party platfvə yam, və ya another provider;
• whether the repvə yat concerns trademark/copyright rights rather than DNS Abuse;
• applicable registry rules;
• applicable law, legal process, və ya court və yaders; və
• any other reasonably available infvə yamation relevant to the investigation.

6. DNS Abuse

Fvə ya gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN Qeydiyyatçı Akkreditasiya Agreement və related ICANN requirements.

As of the Effective Date of this Policy, the contractual DNS Abuse categvə yaies are:

• malware;
• botnets;
• phishing;
• pharming; və
• spam when spam serves as a delivery mechanism fvə ya one və ya mvə yae of the other specified fvə yams of DNS Abuse.

Other harmful və ya illegal conduct may still violate NiceNIC policy və ya applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.

NiceNIC will take reasonable və prompt steps to investigate abuse repvə yats as required by applicable registrar obligations.

• review account, nameserver, DNS, registration, və ya Xidmət infvə yamation available to NiceNIC; və ya
• contact another relevant Xidmət provider və ya registry wburada appropriate.

NiceNIC will not require irrelevant evidence merely to delay hvəling of an otherwise actionable repvə yat.

8. Required Mitigation fvə ya DNS Abuse

When NiceNIC has actionable evidence that a gTLD Qeydiyyated Ad sponsvə yaed by NiceNIC is being used fvə ya DNS Abuse, NiceNIC will promptly take mitigation action that is reasonably necessary to stop və ya otherwise disrupt the Qeydiyyated Ad from being used fvə ya that DNS Abuse, as required by the applicable ICANN Qeydiyyatçı Akkreditasiya Agreement.

The appropriate action depends on the circumstances, including:

• the type of DNS Abuse;
• the cause və severity of the harm;
• whether the activity is active;
• whether the domen appears maliciously qeydiyyated və ya compromised;
• the technical role of the domen;
• the likely effectiveness of registrar-level action; və
• the risk of collateral damage to legitimate users və ya Xidməts.

9. Propvə yationate Mitigation

Possible actions may include, wburada appropriate və permitted:

• requesting remediation;
• requiring the customer və ya reseller to remove və ya disable the abusive activity;
• applying a registrar lock;
• applying clientHold və ya another registrar status;
• restricting DNS və ya other NiceNIC-provided functionality;
• restricting email, hosting, API, və ya account access;
• referring the matter to the relevant hosting provider, registry, və ya other infrastructure provider;
• preserving relevant recvə yads;
• suspending an affected Xidmət;
• terminating a Xidmət və ya account fvə ya serious və ya repeated violations; və ya
• taking another measure reasonably necessary to address the abuse.

NiceNIC is not required to apply the same mitigation measure in every case.

10. Compromised Domenlər və Collateral Damage

A legitimate domen may be abused without the registrant's kindiledge because of compromised hosting, credentials, content-management software, DNS settings, və ya another security failure.

Wburada reasonably practicable, NiceNIC will consider the risk of collateral damage befvə yae applying domen-level suspension.

Fvə ya a compromised legitimate domen, requesting rapid remediation və ya applying a narrower mitigation may be mvə yae appropriate than immediate suspension if the narrower action is sufficient to stop və ya disrupt the abuse.

This does not gerient immediate suspension və ya another stronger measure wburada the circumstances, severity, continuing harm, legal requirements, və ya security risk justify it.

11. Maliciously Qeydiyyated Domenlər

Wburada available evidence indicates that a domen was qeydiyyated və ya is controlled primarily fvə ya phishing, malware, credential theft, botnet activity, pharming, və ya another serious abusive purpose, faster domen-level mitigation may be appropriate.

NiceNIC is not required to provide advance notice wburada doing so would materially increase the risk of harm, enable evasion, frustrate a mvəatvə yay requirement, və ya undermine effective mitigation.

12. Xeyrn-DNS Illegal Activity

Illegal Activity və DNS Abuse are not identical concepts.

Repvə yats concerning fraud, unlawful goods və ya Xidməts, threats, impersonation, illegal content, sanctions, və ya other conduct may be hvəled under applicable law, NiceNIC's Müddəts of Service & Acceptable Use Policy, registry rules, court və yaders, və ya other relevant requirements even wburada the conduct does not meet the ICANN contractual definition of DNS Abuse.

The legal və technical role of NiceNIC will be considered when determining what action, if any, is appropriate.

13. Trademark və Domen-Ad Rights Complaints

Trademark infringement və ya a dispute over rights in a domen name is not automatically DNS Abuse.

Wburada the principal dispute concerns who has rights to the domen name, the appropriate mechanism may include:

• the Unifvə yam Domen Adı Dispute Resolution Policy (UDRP);
• the Unifvə yam Rapid Suspension System (URS);
• a ccTLD-specific dispute policy; və ya
• a court of competent jurisdiction.

NiceNIC does not decide the merits of UDRP və ya URS disputes.

14. Copyright Complaints

NiceNIC may preserve relevant recvə yads, restrict an affected Xidmət, və cooperate with appropriate authvə yaities, registries, hosting providers, və ya other relevant entities as required və ya permitted by law.

Repvə yaters should not unnecessarily copy, download, və ya redistribute suspected illegal child-abuse material when submitting a repvə yat.

16. Hostinq və Third-Party Infrastructure

A registrar controls domen-registration functions but may not control the website files, application, mail server, və ya hosting environment associated with the domen.

Wburada abusive content is hosted by a third party, repvə yating the activity to the hosting provider və ya other infrastructure provider may allow mvə yae targeted removal.

NiceNIC may nevertheless take registrar-level action wburada required və ya appropriate under applicable obligations.

17. Distribyutor-Sponsvə yaed Customers

A domen may have been ald through a NiceNIC reseller while NiceNIC remains the sponsvə yaing registrar.

NiceNIC may covə yadinate with the reseller during an abuse investigation, but delegation to a reseller does not eliminate NiceNIC's applicable ICANN registrar obligations.

NiceNIC may contact the Qeydiyyated Ad Holder və ya other customer directly wburada reasonably necessary fvə ya abuse mitigation, security, legal compliance, mvəatvə yay notices, və ya protection of registrant rights.

18. Repvə yats from Law Enfvə yacement və Qualifying Authvə yaities

NiceNIC maintains the dedicated abuse point of contact required by the applicable ICANN Qeydiyyatçı Akkreditasiya Agreement fvə ya qualifying repvə yats of Illegal Activity from law-enfvə yacement, consumer-protection, quasi-governmental, və ya other qualifying governmental authvə yaities.

Wburada the applicable Qeydiyyatçı Akkreditasiya Agreement requires it, a well-founded repvə yat submitted through the dedicated authvə yaity contact will be reviewed within twenty-four (24) hours by a person empowered to take necessary və appropriate action.

NiceNIC is not required to take action that would contravene applicable law.

NiceNIC may authenticate the identity, authvə yaity, jurisdiction, və legal basis of a governmental request wburada appropriate.

19. Court Orders və Binding Legal Process

NiceNIC may act in response to:

• a valid court və yader;
• binding governmental process;
• a mvəatvə yay registry instruction;
• a UDRP və ya URS requirement;
• an ICANN contractual requirement; və ya
• another legal obligation applicable to NiceNIC.

Wburada legally permitted və appropriate, NiceNIC may seek clarification və ya legal review of an overbroad, invalid, və ya unclear request.

20. Xeyrtice to the Customer

Wburada circumstances permit, NiceNIC may notify a customer və ya reseller of the allegation və provide an oppvə yatunity to remediate.

Advance notice may be omitted wburada:

• immediate mitigation is reasonably necessary;
• evidence indicates an intentionally malicious registration;
• notice could enable evasion və ya destruction of evidence;
• a court, authvə yaity, registry, ICANN requirement, və ya law restricts notice;
• a serious security və ya child-safety risk exists; və ya
• delay would materially increase harm.

21. Restvə yaation və Review

Wburada a domen və ya Xidmət was restricted because of abuse və ya security concerns, NiceNIC may review a request fvə ya restvə yaation after:

• the abusive activity has been removed;
• a compromised website və ya account has been secured;
• relevant credentials have been reset;
• required security updates have been applied;
• cvə yarected technical infvə yamation has been provided;
• the və yaiginal evidence has become outdated və ya was shown to be incvə yarect; və ya
• another appropriate remediation has been completed.

Restvə yaation is not guaranteed wburada a continuing legal, registry, ICANN, security, dispute, və ya abuse basis requires the restriction to remain.

22. Customer Review / Appeal

A customer affected by a discretionary NiceNIC abuse action may request review through NiceNIC's suppvə yat channel.

The request should identify:

• the affected domen və ya Xidmət;
• the relevant NiceNIC case və ya notice;
• the remediation completed;
• evidence that the repvə yated activity has ceased;
• evidence of compromise wburada relevant; və
• any infvə yamation showing that the və yaiginal repvə yat was inaccurate, outdated, və ya misclassified.

A review request does not suspend a court və yader, registry requirement, UDRP/URS action, ICANN obligation, və ya other mvəatvə yay restriction.

• security controls; və ya
• specific internal actions.

Absence of detailed disclosure to a repvə yater does not mean a repvə yat was ignvə yaed.

24. Duplicate, Automated, və ya Abusive Repvə yats

NiceNIC may consolidate duplicate repvə yats concerning the same issue.

NiceNIC may apply reasonable controls to abusive, misleading, clearly irrelevant, və ya technically harmful submissions.

Such controls will not be used to gerient legitimate repvə yaters from submitting abuse repvə yats through the required channel.

25. Recvə yadkeeping

NiceNIC documents the receipt of və response to abuse repvə yats as required by the applicable ICANN Qeydiyyatçı Akkreditasiya Agreement və other applicable obligations.

Recvə yads are retained fvə ya the period required by the applicable Qeydiyyatçı Akkreditasiya Agreement, subject to applicable law.

NiceNIC may provide required recvə yads to ICANN Contractual Compliance upon proper request.

26. Privacy

NiceNIC may take precautionary və ya contractual action based on the evidence və obligations applicable at the time.

This Policy should be read with:

• the NiceNIC Müddəts of Service & Acceptable Use Policy;

The almaqer must:

NiceNIC does not warrant that:

• a domen does not infringe a trademark və ya other third-party right;
• a domen is suitable fvə ya a particular business;
• a domen will generate traffic, ranking, revenue, resale value, və ya investment return; və ya
• a privə ya use of the domen is free from reputation, search-engine, email-reputation, security, və ya histvə yaical issues.

The almaqer should perfvə yam appropriate due diligence.

10. Fraud, Errvə ya, və Compliance

NiceNIC may pause və ya cancel a transaction befvə yae delivery wburada reasonably necessary because of:

• suspected fraud və ya unauthvə yaized payment;
• manifest pricing və ya listing errvə ya;
• sanctions və ya legal restrictions;
• a court/registry/registrar restriction;
• a domen dispute;
• seller/provider non-perfvə yamance; və ya
• a material security və ya compliance issue.

Wburada cancellation occurs without almaqer fault və the domen is not delivered, the almaqer will receive the refund described in Section 6.

11. Limitation of Liability

• impersonate another person unlawfully;
• make solely automated high-impact decisions about an individual wburada such use is prohibited by law; və ya

9. Privacy
