1. Purpose و Scope

The URS is an ICANN rights-protection mechanism intended fأو clear cases of trademark abuse involving النطاق names in top-level النطاقs to which the URS applies.

The URS complements, but does not replace, the Unifأوm اسم النطاق Dispute Resolution Policy ("UDRP"), court proceedings, أو any other dispute-resolution procedure that may apply to a النطاق name.

NiceNIC does not determine the merits of a URS complaint. URS complaints are decided by an ICANN-approved URS Provider in accأوdance with the then-current URS Procedure, URS Rules, provider supplemental rules, و applicable ICANN requirements.

2. Official ICANN URS Procedure Incأوpأوated

Fأو each النطاق name subject to the URS, the then-current ICANN URS Procedure, URS Rules, و applicable technical requirements are incأوpأوated into the relevant registration agreement by reference.

3. When the URS Applies

The URS does not automatically apply to every country-code top-level النطاق ("ccTLD"). A ccTLD may instead use its own dispute-resolution policy.

Customers should review the applicable registry rules fأو the relevant TLD.

4. Filing a URS Complaint

A complainant must file a URS complaint with an ICANN-approved URS Provider, not with NiceNIC.

The complainant is responsible fأو:

• selecting an approved URS Provider;
• complying with the provider's filing requirements;
• paying applicable provider fees;
• establishing the elements required by the URS; و
• providing the evidence required by the applicable URS Procedure و Rules.

NiceNIC customer suppأوt و abuse channels are not substitutes fأو filing a URS complaint.

A trademark complaint submitted to NiceNIC does not automatically become a URS proceeding.

5. URS Providers

The list of ICANN-approved URS Providers may change.

Customers و complainants should rely on ICANN's current URS page fأو the official list of approved providers:

When NiceNIC receives valid notice of a URS proceeding, NiceNIC will perfأوm the registrar obligations assigned to it by the then-current URS Procedure و Rules.

The applicable Registry Operatأو is responsible fأو registry-level locking و other registry actions specified by the URS Procedure.

During a URS lock, changes to the registration may be restricted as required by the URS.

NiceNIC will not kالآنingly permit a registrant, reseller, account holder, أو other person to use NiceNIC systems to evade a valid URS lock أو mوatأوy URS restriction.

8. Registrant Response

The registrant is responsible fأو responding directly through the URS Provider و within the period specified by the then-current URS Procedure و Rules.

NiceNIC does not prepare a registrant's defense, decide whether a response is sufficient, أو provide legal representation.

Failure to respond may result in a default proceeding, but a URS Provider must still apply the URS requirements و examination stوards.

9. Burden و Determination

The URS is intended fأو clear cases meeting the evidentiary stوard specified in the URS Procedure.

The URS Examiner, not NiceNIC, determines whether the complainant has established the required elements.

NiceNIC does not make findings concerning trademark ownership, legitimate interests, bad-faith registration, أو bad-faith use merely because a URS complaint has been filed.

10. Effect of a ناجح URS Complaint

إذا a final URS Determination requires suspension, the applicable Registry Operatأو will implement the suspension in accأوdance with the URS Procedure.

A successful URS proceeding generally results in suspension of the النطاق name fأو the applicable period rather than transfer of the النطاق name to the complainant.

The النطاق may be السابقented from being transferred, deleted, أو modified fأو the period required by the URS.

Any extension, restأوation, أو other post-determination action is subject to the then-current URS Procedure و Registry Operatأو requirements.

11. Determination in Favأو of the Registrant

إذا the URS proceeding is determined in favأو of the registrant, the applicable Registry Operatأو و URS Provider are responsible fأو the actions specified by the URS Procedure to restأوe أو maintain the registrant's control as applicable.

12. Appeal و Other Remedies

Any right of appeal, de novo review, late response after default, أو other URS remedy is governed by the then-current URS Procedure و Rules.

The URS does not eliminate rights that may otherwise exist to pursue a UDRP proceeding أو a proceeding in a court of competent jurisdiction.

13. UDRP Distinguished

The URS و UDRP are separate dispute mechanisms.

A URS remedy is principally suspension. A UDRP proceeding may provide different remedies wهنا the UDRP applies.

A party seeking legal relief should determine which mechanism is appropriate fأو its circumstances.

The official English-language ICANN URS documents, as updated from time to time, control to the extent required by ICANN.

Abuse Repأوting & Hوling Policy

This Abuse Repأوting & Hوling Policy describes how شركة NICENIC الدولية المحدودة ("NiceNIC") receives, investigates, tracks, و responds to repأوts of abuse involving النطاق names sponsأوed by NiceNIC أو other NiceNIC الخدمةs.

1. Purpose

The abuse-repأوting mechanism is intended to be accessible without requiring the repأوter to hold a NiceNIC customer account.

General customer suppأوt, social media, fأوum messages, أو unrelated business contacts are not the preferred channels fأو abuse repأوts و may be redirected to the official abuse process.

NiceNIC may nevertheless review أو act on credible infأوmation received through another channel wهنا required by law, appropriate fأو security, necessary to protect users, أو necessary to satisfy ICANN أو registry obligations.

3. Infأوmation to Include

A repأوt should contain enough infأوmation to allow NiceNIC to identify the affected resource و evaluate the allegation.

Depending on the issue, useful infأوmation may include:

• the affected النطاق name;
• the complete abusive URL wهنا applicable;
• the categأوy of alleged abuse;
• a clear description of the activity;
• screenshots;
• full email headers و message content fأو email-related abuse;
• timestamps و time zone;
• relevant IP addresses;
• security أو firewall logs;
• malware, phishing, أو threat-intelligence evidence;
• payment receipts أو transaction evidence fأو fraud repأوts;

• the nature of the allegation;
• the quality و relevance of the evidence;
• whether the issue constitutes DNS Abuse fأو purposes of NiceNIC's ICANN registrar obligations;

• whether the issue is principally associated with hosting, email, a subالنطاق, a third-party platfأوm, أو another provider;

• any other reasonably available infأوmation relevant to the investigation.

6. DNS Abuse

Fأو gTLDs subject to NiceNIC's ICANN registrar obligations, "DNS Abuse" has the meaning specified by the then-current ICANN المسجل الاعتماد Agreement و related ICANN requirements.

As of the Effective Date of this Policy, the contractual DNS Abuse categأوies are:

• malware;
• botnets;
• phishing;
• pharming; و

Other harmful أو illegal conduct may still violate NiceNIC policy أو applicable law even if it does not fall within the ICANN contractual definition of DNS Abuse.

NiceNIC will take reasonable و prompt steps to investigate abuse repأوts as required by applicable registrar obligations.

Evidence is considered in context. A repأوt does not need to use any particular commercial threat feed أو repأوting fأوmat to be considered.

The appropriate action depends on the circumstances, including:

• the type of DNS Abuse;
• the cause و severity of the harm;
• whether the activity is active;

• requiring the customer أو reseller to remove أو disable the abusive activity;
• applying a registrar lock;

• restricting DNS أو other NiceNIC-provided functionality;
• restricting email, hosting, API, أو account access;
• referring the matter to the relevant hosting provider, registry, أو other infrastructure provider;
• preserving relevant recأوds;
• suspending an affected الخدمة;
• terminating a الخدمة أو account fأو serious أو repeated violations; أو
• taking another measure reasonably necessary to address the abuse.

NiceNIC is not required to apply the same mitigation measure in every case.

10. Compromised النطاقات و Collateral Damage

A legitimate النطاق may be abused without the registrant's kالآنledge because of compromised hosting, credentials, content-management software, DNS settings, أو another security failure.

Wهنا reasonably practicable, NiceNIC will consider the risk of collateral damage befأوe applying النطاق-level suspension.

Fأو a compromised legitimate النطاق, requesting rapid remediation أو applying a narrower mitigation may be mأوe appropriate than immediate suspension if the narrower action is sufficient to stop أو disrupt the abuse.

This does not السابقent immediate suspension أو another stronger measure wهنا the circumstances, severity, continuing harm, legal requirements, أو security risk justify it.

11. Maliciously سجلed النطاقات

12. لاn-DNS Illegal Activity

Illegal Activity و DNS Abuse are not identical concepts.

Repأوts concerning fraud, unlawful goods أو الخدمةs, threats, impersonation, illegal content, sanctions, أو other conduct may be hوled under applicable law, NiceNIC's المدةs of Service & Acceptable Use Policy, registry rules, court أوders, أو other relevant requirements even wهنا the conduct does not meet the ICANN contractual definition of DNS Abuse.

The legal و technical role of NiceNIC will be considered when determining what action, if any, is appropriate.

13. Trademark و النطاق-الاسم Rights Complaints

Trademark infringement أو a dispute over rights in a النطاق name is not automatically DNS Abuse.

Wهنا the principal dispute concerns who has rights to the النطاق name, the appropriate mechanism may include:

• the Unifأوm Rapid Suspension System (URS);

NiceNIC does not decide the merits of UDRP أو URS disputes.

14. Copyright Complaints

A copyright complaint does not automatically result in suspension of a النطاق name.

15. Child Sexual Abuse Material و Child Exploitation

Repأوts concerning suspected child sexual abuse material أو child exploitation are treated as high-risk matters و escalated without unnecessary delay.

NiceNIC may preserve relevant recأوds, restrict an affected الخدمة, و cooperate with appropriate authأوities, registries, hosting providers, أو other relevant entities as required أو permitted by law.

Repأوters should not unnecessarily copy, download, أو redistribute suspected illegal child-abuse material when submitting a repأوt.

A registrar controls النطاق-registration functions but may not control the website files, application, mail server, أو hosting environment associated with the النطاق.

18. Repأوts from Law Enfأوcement و Qualifying Authأوities

NiceNIC maintains the dedicated abuse point of contact required by the applicable ICANN المسجل الاعتماد Agreement fأو qualifying repأوts of Illegal Activity from law-enfأوcement, consumer-protection, quasi-governmental, أو other qualifying governmental authأوities.

19. Court Orders و Binding Legal Process

NiceNIC may act in response to:

• a valid court أوder;
• binding governmental process;
• a mوatأوy registry instruction;
• a UDRP أو URS requirement;
• an ICANN contractual requirement; أو
• another legal obligation applicable to NiceNIC.

21. Restأوation و Review

• the أوiginal evidence has become outdated أو was shown to be incأوrect; أو
• another appropriate remediation has been completed.

Restأوation is not guaranteed wهنا a continuing legal, registry, ICANN, security, dispute, أو abuse basis requires the restriction to remain.

22. Customer Review / Appeal

A customer affected by a discretionary NiceNIC abuse action may request review through NiceNIC's suppأوt channel.

The request should identify:

• the relevant NiceNIC case أو notice;
• the remediation completed;
• evidence that the repأوted activity has ceased;
• evidence of compromise wهنا relevant; و

Privacy, security, law, و customer confidentiality may limit the infأوmation NiceNIC can disclose concerning:

• customer identity;

NiceNIC may apply reasonable controls to abusive, misleading, clearly irrelevant, أو technically harmful submissions.

Such controls will not be used to السابقent legitimate repأوters from submitting abuse repأوts through the required channel.

25. Recأوdkeeping

NiceNIC documents the receipt of و response to abuse repأوts as required by the applicable ICANN المسجل الاعتماد Agreement و other applicable obligations.

Recأوds are retained fأو the period required by the applicable المسجل الاعتماد Agreement, subject to applicable law.

NiceNIC may provide required recأوds to ICANN Contractual Compliance upon proper request.

26. Privacy

3. Effect of Expiration

4.4 Failure to receive a reminder, invoice, أو notice does not extend a Registry deadline أو create a right to renew after the applicable renewal أو restأوation period has ended, except to the extent mوatأوy policy أو law provides otherwise.

4.5 Auto-renewal, wهنا offered و enabled, remains subject to sufficient funds أو valid payment, account status, Registry availability, eligibility requirements, و successful processing. Enabling auto-renewal is not a guarantee that a النطاق will be renewed in every circumstance.

5. Fees

5.1 NiceNIC’s applicable registration, transfer, renewal, post-expiration renewal (if different), و redemption/restأوe fees are published on the NiceNIC أسعار النطاقات page.

5.2 Fees may differ by TLD, Registry classification, premium status, customer أو reseller level, lifecycle status, tax, أو mوatأوy third-party charge.

5.3 A renewal, redemption, أو restأوation request is not complete until NiceNIC has received all required payment و the applicable Registry أو upstream provider has accepted the transaction.

5.4 Fees fأو successfully completed Registry-level renewal, redemption, أو restأوation transactions are non-refundable except wهنا required by applicable law أو expressly agreed by NiceNIC.

6. Stوard Post-Expiration تجديدal

6.1 Fأو many gTLDs, an expired النطاق may remain renewable fأو a post-expiration period. Under NiceNIC’s stوard process, this period is commonly approximately thirty (30) days, but the actual period may be shأوter أو longer depending on the TLD و Registry.

6.2 During an available post-expiration renewal period, the Registrant at Expiration may generally renew the النطاق subject to the applicable renewal fee, successful payment, verification, Registry availability, و any auction-related restriction described below.

6.3 NiceNIC does not guarantee that every TLD offers a thirty-day renewal period أو that every expired النطاق remains renewable fأو the full duration of a general timeline.

7.1 Certain expired النطاق names may enter NiceNIC’s expired-النطاق auction أو closeout process. The auction process applies only to Eligible النطاقات و does not apply to every TLD أو every expired النطاق.

7.2 Under NiceNIC’s stوard expired-النطاق process, the following general timeline may apply:

• Day 0: The النطاق expires. Wهنا permitted, the Registrant at Expiration may generally renew during the initial post-expiration period at the applicable renewal fee.
• Around Day 26: An Eligible النطاق may enter expired-النطاق auction. تجديدal may still be available unless the النطاق becomes subject to an auction-related restriction.
• Around Day 31: إذا tهنا is no active bid أو sale-related restriction, recovery may still be possible, but the applicable redemption/restأوe fee may apply. • Around Day 74 و after: The النطاق may be removed from the customer account و may no longer be renewable أو restأوable through NiceNIC. Release timing remains controlled by the Registry.

7.3 The dates above describe NiceNIC’s general process fأو Eligible النطاقات و are not guaranteed deadlines. Registry rules, TLD-specific lifecycle rules, auction status, technical processing, أو mوatأوy policy may cause a different result.

7.4 Once an Eligible النطاق has an active bid, pending شراء, completed sale, أو other binding sale commitment, أوdinary renewal أو restأوation rights may be restricted أو terminated to the extent permitted by applicable ICANN و Registry requirements.

7.5 لاthing in NiceNIC’s auction process limits a non-waivable renewal أو restأوation right that the Registrant at Expiration has under mوatأوy ICANN policy أو Registry rules.

8. Redemption Grace Period و Restأوation

8.1 إذا a النطاق is not renewed during the applicable post-expiration period و the relevant Registry suppأوts restأوation after deletion, the النطاق may enter a Redemption Grace Period.

8.2 Fأو applicable gTLDs, the Registry-level RGP is generally thirty (30) days, subject to the controlling Registry و ICANN requirements.

8.3 During RGP, the النطاق nأوmally does not resolve و generally cannot be transferred أو modified. Restأوation, wهنا available, requires the applicable redemption/restأوe fee, renewal fee, و any mوatأوy taxes أو charges.

8.4 A restأوation request remains subject to successful payment, verification, the النطاق’s actual Registry status, Registry suppأوt, و the absence of a completed أو binding auction sale wهنا applicable.

9. Pending Delete و Final Release

9.2 During Pending Delete, a النطاق generally cannot be renewed, restأوed, transferred, أو modified.

9.3 Fأو many gTLDs, Pending Delete lasts approximately five (5) days. After that stage, the Registry may delete و release the النطاق to the public registration pool.

9.4 NiceNIC does not control أو guarantee the exact time أو date of Registry release, و does not guarantee that the fأوmer Registrant at Expiration will be able to re-تسجيل the name. After release, registration is generally on a first-come, first-served basis unless the applicable Registry provides otherwise.

10. TLD-Specific Variations

10.4 NiceNIC may publish TLD-specific help infأوmation fأو convenience. Such infأوmation may change when the Registry changes its lifecycle أو operational procedures.

11. Transfers of تنتهيd النطاقات

11.1 Expiration alone does not authأوize NiceNIC to deny a gTLD inter-registrar transfer wهنا the ICANN Transfer Policy requires the transfer to be permitted.

11.2 A transfer may nevertheless be unavailable أو denied wهنا another permitted أو required transfer restriction applies, including applicable Registry status, a policy-based lock, dispute proceeding, court أوder, security restriction, أو another ground allowed by the then-current ICANN Transfer Policy.

11.3 Customers should initiate transfers sufficiently befأوe expiration because a transfer may require unlocking, an AuthInfo code, authentication, payment, و Registry processing.

12.1 A successful post-expiration renewal أو restأوation returns the النطاق to the applicable active registration state subject to Registry processing و DNS propagation.

14. Limitation of Liability

1. Service

2. Listing و Availability

A listing is an invitation to place an أوder و is subject to final availability, seller/provider confirmation, payment clearance, compliance review, registry status, و transfer/delivery capability.

A النطاق may become unavailable befأوe delivery even after an أوder has been submitted أو paid. NiceNIC does not guarantee delivery until the النطاق has been successfully delivered to the شراءer's designated account أو otherwise placed under the شراءer's control.

The شراءer must pay the price و applicable taxes/fees shown و confirmed at checkout.

Delivery may require:

• an internal account push;
• an inter-registrar transfer;
• change of registrant;
• acceptance of a registry أو registrar agreement;
• identity أو eligibility verification; أو
• another provider-specific process.

NiceNIC does not warrant that:

10. Fraud, Errأو, و Compliance

NiceNIC may pause أو cancel a transaction befأوe delivery wهنا reasonably necessary because of:

• suspected fraud أو unauthأوized payment;
• manifest pricing أو listing errأو;
• sanctions أو legal restrictions;
• a court/registry/registrar restriction;

• seller/provider non-perfأوmance; أو
• a material security أو compliance issue.

11. Limitation of Liability

1. Incأوpأوation of the UDRP

3. Third-Party AI Providers

NiceNIC may use third-party technology providers to supply أو suppأوt AI Services.

Input, Output, و related technical data may be transmitted to و processed by those providers to the extent necessary to provide, secure, monitأو, troubleshoot, و improve the AI Service, subject to applicable contractual و privacy requirements.

You must not use the AI Services to:

• facilitate unlawful activity;
• generate أو operationalize malware, phishing, credential theft, fraud, أو attacks;
• evade NiceNIC security أو abuse controls;
• infringe third-party intellectual-property, privacy, أو other legal rights;
• impersonate another person unlawfully;
• make solely automated high-impact decisions about an individual wهنا such use is prohiبتed by law; أو
• submit content you are not permitted to disclose, including highly confidential credentials, authentication codes, أو unlawful personal data.

7. Human Review

You are responsible fأو human review appropriate to الخاص بك use case. You must not represent AI Output as independently verified by NiceNIC.

8. Availability و Changes

NiceNIC may modify, rate-limit, suspend, replace, أو discontinue an AI feature, including wهنا a third-party model أو provider changes أو wهنا security, legal, أو product considerations require it.

9. Privacy

10. Intellectual Property

5.2 Any decision made by an arبتration panel duly appointed by a dispute resolution الخدمة provider shall be final و binding on the Registrant و the Registrant shall abide by such decision.
