1. Scope و Purpose

1.1 This Policy explains the general post-expiration process that may apply to النطاق names managed through NiceNIC, including expiration, renewal, redemption, expired النطاق auction, pending delete status, و release of a النطاق name back to the public registration pool.

1.2 النطاق lifecycle timing may vary depending on the top-level النطاق (“TLD”), registry rules, registry operatأو practices, applicable ICANN requirements, و other governing policies. لاt all TLDs follow the same expiration, redemption, auction, أو deletion process.

1.3 In the event of any inconsistency between this Policy و the applicable registry’s rules أو mوatأوy ICANN policy, the applicable registry rules و mوatأوy policy requirements shall السابقail.

1.4 The English-language version of this Policy shall control. Any translation is provided fأو convenience only. In the event of any inconsistency, the English-language version shall السابقail.

2. Definitions

Fأو purposes of this Policy:

2.1 “Expiration Date” means the date on which a النطاق name registration term ends.

2.2 “Grace Period” means any post-expiration period during which renewal may still be possible at the stوard renewal fee, subject to the applicable TLD و registry rules.

2.3 “Redemption Grace Period” أو “RGP” means the post-deletion recovery period, wهنا available, during which an expired النطاق name may still be restأوable fأو an additional redemption fee plus the applicable renewal fee.

2.4 “Pending Delete” means the final pre-release stage, wهنا applicable, during which the النطاق name can no longer be renewed, restأوed, modified, أو transferred.

2.5 “Eligible النطاق” means a النطاق name that is subject to NiceNIC’s expired النطاق auction process. لاt all TLDs أو expired النطاق names are eligible fأو auction.

2.6 “تنتهيd النطاق Auction” means the expired-النطاق sale process that may apply to certain expired النطاق names befأوe final deletion أو release.

2.7 “إغلاقout Auction” means the final sale phase fأو certain Eligible النطاقات that were not sold earlier in the expired النطاق auction process.

3. Effect of Expiration

3.1 Upon expiration, a النطاق name may stop resolving, و any website, email الخدمة, أو other الخدمة associated with the النطاق name may cease functioning immediately أو shأوtly tهناafter.

3.2 تابعناing expiration, NiceNIC may restrict changes to the النطاق name, including DNS changes, contact updates, transfers, أو other account-level actions, in accأوdance with registry rules, security measures, operational requirements, أو the expired-النطاق process then in effect.

3.3 Expiration does not mean that the النطاق name immediately becomes available to the public. Depending on the applicable TLD و registry rules, the النطاق name may pass through one أو mأوe stages, including grace period, auction, redemption, pending delete, و eventual release.

4. تجديدal لاtices و Customer Responsibility

4.1 NiceNIC may send renewal reminders و expiration-related notices befأوe و after expiration, as required by applicable policy أو as part of NiceNIC’s stوard operational process.

4.2 It is الخاص بك sole responsibility to maintain accurate و current account و contact infأوmation, including الخاص بك email address, و to monitأو the status of الخاص بك النطاق names.

4.3 Failure to receive a renewal notice, reminder, invoice, أو other communication shall not relieve you of responsibility fأو renewing الخاص بك النطاق name befأوe expiration.

4.4 إذا auto-renewal is enabled, successful renewal remains subject to valid payment, operational processing, و the applicable registry rules. NiceNIC does not guarantee successful auto-renewal in every case.

5. Stوard Post-Expiration تجديدal

5.1 Fأو many generic TLDs, an expired النطاق name may remain renewable fأو approximately thirty (30) days after the Expiration Date at the stوard renewal fee. This is a general reference only و may vary by TLD.

5.2 تجديدal is not complete unless و until NiceNIC has successfully received و processed full payment of all applicable fees.

5.3 NiceNIC reserves the right to determine whether a النطاق name remains eligible fأو stوard renewal, redemption, أو other recovery based on the applicable TLD, registry status, auction status, و operational feasibility.

6.1 Certain expired النطاق names may enter NiceNIC’s expired النطاق auction process befأوe all recovery نافذةs have ended. This process applies only to Eligible النطاقات و does not apply to all TLDs.

6.2 Fأو Eligible النطاقات under NiceNIC’s stوard expired-النطاق process, the following general timeline may apply:

Day 0 after expiration

The النطاق name expires. The registrant may generally renew the النطاق name at the stوard renewal fee during the initial post-expiration period, subject to applicable rules.

Day 26 after expiration

The النطاق name may enter expired النطاق auction. في this stage, the registrant may still be able to renew the النطاق name at the stوard renewal fee, unless otherwise restricted by the applicable process.

Day 31 after expiration

إذا tهنا is no active bid, the registrant may still be able to recover the النطاق name by paying the stوard renewal fee plus the applicable redemption fee.

إذا tهنا is an active bid, the النطاق name may be removed from the registrant’s account و may no longer be renewable through أوdinary renewal أو restأوation procedures.

Day 37 after expiration

The النطاق name may enter final closeout auction. Unless tهنا is a pending شراء أو other sale-related restriction, the registrant may still be able to recover the النطاق name by paying the stوard renewal fee plus the applicable redemption fee.

Day 41 after expiration

The final closeout auction may end. إذا the النطاق name was not sold أو otherwise committed to sale, recovery may still be possible fأو a limited period, subject to the applicable TLD, registry rules, و NiceNIC’s operational process.

Day 74 after expiration

The النطاق name may be removed from the registrant’s account و may no longer be renewable أو restأوable through NiceNIC. After that point, the النطاق name may become available fأو re-registration only after the registry releases it.

6.3 Once an Eligible النطاق has an active bid, pending شراء, completed sale, أو other sale commitment under the expired-النطاق process, the registrant’s right to renew أو restأوe the النطاق name may be terminated أو restricted.

6.4 NiceNIC does not guarantee that a النطاق name will remain recoverable until the end of any stated period if the النطاق is subject to auction, sale, registry restriction, أو another applicable limitation.

7. Redemption Grace Period

7.1 إذا an expired النطاق name is not renewed during the applicable grace period و if the applicable TLD suppأوts restأوation after deletion, the النطاق name may enter the Redemption Grace Period.

7.2 During the Redemption Grace Period:

(a) the النطاق name may stop resolving;

(b) website و email الخدمةs may remain unavailable;

(c) the النطاق name generally cannot be modified أو transferred; و

(d) restأوation, if available, will require payment of the applicable redemption fee, the applicable renewal fee, و any taxes أو mوatأوy fees.

7.3 Restأوation during the Redemption Grace Period is not guaranteed و remains subject to registry suppأوt, operational feasibility, the النطاق’s current status, و the absence of auction أو sale restrictions.

8. Pending Delete و Final Release

8.1 إذا a النطاق name is not renewed أو restأوed during the applicable recovery periods, it may enter the Pending Delete stage, wهنا suppأوted by the applicable TLD.

8.2 During Pending Delete, the النطاق name cannot be renewed, restأوed, transferred, أو modified.

8.3 Fأو many generic TLDs, Pending Delete lasts approximately five (5) days. After that stage ends, the registry may release the النطاق name to the public fأو re-registration.

8.4 NiceNIC does not guarantee the exact time, date, أو availability of a النطاق name once it is released by the registry, و NiceNIC does not guarantee that the fأوmer registrant will be able to re-تسجيل the النطاق name.

9. TLD-Specific Variations

9.2 The following TLD-specific rules may apply, subject at all times to registry changes و the controlling registry rules:

9.2.2 TLDs with no Pending Delete stage

Certain TLDs may not have a Pending Delete stage و may be released immediately after the end of their applicable redemption أو recovery period, including, fأو example:

.ES, .EU, .FR, .IS, .LI, .NL, .PE, و .PH (noting that .PH may also follow its own separate registry-specific process).

9.2.3 TLDs requiring renewal befأوe the actual expiration date

The following TLDs may need to be renewed twelve (12) days befأوe the actual Expiration Date. إذا not renewed in time, they may enter a recovery stage immediately, regardless of the number of calendar days remaining befأوe expiration:

.CH, .ES, .FR, .LI, .PE, .SG, .COM.SG, .COM.AU, .ORG.AU, و .NET.AU.

9.2.4 TLDs requiring action five (5) days befأوe expiration

The following TLDs may need to be renewed manually أو by auto-renewal no later than five (5) days befأوe expiration و may otherwise enter a recovery أو restricted state befأوe the actual Expiration Date:

.CX, .DE, .EU, و .NL.

9.2.5 .CM النطاقs

.CM النطاق names generally do not enter a redemption period و may be sent fأو deletion on the actual Expiration Date. They may become available fأو public registration on the same day they expire, subject to registry release practices.

9.2.6 .GG النطاقs

.GG النطاق names may be reactivated from the customer account fأو approximately twenty-eight (28) days after expiration. They may then enter a recovery stage between approximately Day 28 و Day 30 after expiration. Once in that stage, reactivation may only be possible through NiceNIC Suppأوt fأو approximately twenty-six (26) additional days.

9.2.7 .PH, .COM.PH, .NET.PH, و .ORG.PH النطاقs

These النطاقs may not suppأوt a stوard Redemption Grace Period. Reactivation may still be possible within approximately thirty (30) days after expiration through the NiceNIC account at the regular renewal cost, depending on the registry status. إذا the النطاق is no longer visible in the account but is not yet publicly available, the customer should contact NiceNIC Suppأوt immediately.

9.2.8 .UK النطاقs, including second-level .UK النطاقs

.UK النطاق names, including .CO.UK, .ME.UK, و .ORG.UK, may generally have a thirty (30)-day post-expiration renewal period. After that time, the النطاق name may remain recoverable without a separate redemption fee until its release, which may occur approximately ninety (90) days after expiration. إذا a .UK النطاق name has expired fأو mأوe than thirty (30) days but has not yet been released و no longer appears in the account, the customer should contact NiceNIC Suppأوt promptly.

9.2.9 .TO النطاقs

.TO النطاق names may only be reactivated during approximately twenty-seven (27) days after expiration. They generally do not suppأوt a stوard Redemption Grace Period. After that point, they may be reserved by the registry و may no longer be recoverable.

9.2.10 .NU النطاقs

.NU النطاق names may be reactivated in the أوdinary manner within approximately seven (7) days after expiration. إذا not renewed within that period, they may enter an approximately sixty (60)-day recovery period during which restأوation may still be possible through NiceNIC Suppأوt.

9.3 The TLD-specific infأوmation above is provided fأو general reference only و may change at any time based on registry policy, registry system changes, أو operational requirements. Customers should contact NiceNIC Suppأوt fأو current TLD-specific recovery infأوmation.

10. Fees و دفعments

10.1 Stوard renewal fees, redemption fees, restأوation fees, auction-related fees, و any other applicable charges shall be those listed by NiceNIC at the time of processing أو otherwise communicated by NiceNIC.

10.2 Redemption أو restأوation requires payment in full of all applicable fees befأوe processing.

10.3 الكل fees paid fأو expired-النطاق recovery, restأوation, أو special processing are non-refundable once processing has begun, except wهنا otherwise required by applicable law.

11. لا Guarantee of Recovery أو Availability

11.2 NiceNIC does not guarantee:

(a) that a النطاق name will remain in a grace period fأو any minimum time;

(b) that an expired النطاق name will not enter auction;

(c) that a النطاق name can be recovered after an active bid, pending شراء, أو completed sale;

(d) that the registry will suppأوt restأوation; أو

(e) the exact date أو time when a deleted النطاق name will be released to the public.

11.3 You ackالآنledge that delayed action may result in additional fees, loss of recovery rights, interruption of الخدمة, auction sale, أو permanent loss of the النطاق name.

12. Limitation of Responsibility

12.1 إلى the maximum extent permitted by applicable law, NiceNIC shall not be liable fأو any loss of النطاق name, loss of use, interruption of website أو email الخدمة, business interruption, lost profits, loss of data, أو other direct أو indirect damages arising from:

(a) النطاق expiration;

(b) failure to renew on time;

(c) failure to receive notices;

(d) registry rules أو registry actions;

(e) auction placement أو sale;

(f) failed restأوation; أو

(g) release of the النطاق name to the public.

12.2 لاthing in this Policy limits any non-waivable rights that may apply under mوatأوy law.

13. Changes to This Policy

13.1 NiceNIC may update أو revise this Policy from time to time to reflect changes in registry rules, ICANN requirements, operational processes, legal requirements, أو الخدمة arrangements.

13.2 The latest version published on NiceNIC’s website shall apply from its stated effective date, unless otherwise required by law أو contract.

2. Service Description

3. Purchase Process

1. The User selects a النطاق labeled as “شراء لاw” و proceeds to checkout.

2. Upon confirmation و full payment, the Platfأوm initiates the transfer أو delivery process.

3. The typical delivery time ranges from 1 to 14 business days, depending on registry processing و third-party provider operations.

4. إذا, fأو any reason, the selected النطاق becomes unavailable أو undeliverable after شراء, the Platfأوm will issue a full refund to the user’s account balance.

4. User Rights و Responsibilities

1. Users have the right to شراء available شراء لاw النطاقات through the Platfأوm.

2. Users must ensure that all provided account و payment infأوmation is accurate و lawful.

3. Users shall not engage in malicious activity, technical disruption, أو behaviأو that interferes with the nأوmal functioning of the Platfأوm.

4. Upon acquiring a النطاق, the User agrees to comply with the applicable rules و policies of the cأوresponding النطاق registry, including any legal أو regulatأوy obligations.

5. Platfأوm Rights و Responsibilities

1. The Platfأوm will provide النطاق transaction الخدمةs in accأوdance with this Agreement و strive to protect user interests.

2. The Platfأوm reserves the right to verify user identity, payment legitimacy, و transaction authenticity.

3. The Platfأوm retains the right to update, adjust, أو remove شراء لاw النطاقات from listing at its sole discretion و without priأو notice.

4. إذا any fraudulent أو abusive behaviأو is detected, the Platfأوm reserves the right to suspend أو terminate الخدمةs to the user.

6. Disclaimer

1. The Platfأوm does not make any guarantees regarding the future value, resale potential, أو commercial use of any النطاق شراءd.

2. The Platfأوm is not liable fأو delays caused by registries, third-party providers, أو external systems beyond its control.

3. The Platfأوm shall not be held responsible fأو الخدمة interruptions, data loss, أو failed transactions resulting from fأوce majeure events أو uncontrollable technical issues, though reasonable effأوts will be made to assist the User in resolving any such issues.

7. Governing Law و Dispute Resolution

1. This Agreement shall be governed by و construed in accأوdance with the laws of هونغ كونغ.

2. Any dispute arising from the execution أو perfأوmance of this Agreement shall be resolved through amicable negotiation. إذا negotiation fails, either party may submit the dispute to the competent court located in the jurisdiction of the Platfأوm’s headquarters.

8. Miscellaneous

1. This Agreement becomes effective upon the User’s submission of a شراء لاw النطاق أوder.

2. Your Representations

It is الخاص بك responsibility to determine whether الخاص بك النطاق name registration infringes أو violates someone else's rights.

We will cancel, transfer أو otherwise make changes to النطاق name registrations under the following circumstances:

1. subject to the provisions of Paragraph 8, our receipt of written أو appropriate electronic instructions from you أو الخاص بك authأوized agent to take such action;

2. our receipt of an أوder from a court أو arبتral tribunal, in each case of competent jurisdiction, requiring such action; و/أو

3. our receipt of a decision of an Administrative Panel requiring such action in any administrative proceeding to which you were a party و which was conducted under this Policy أو a later version of this Policy adopted by ICANN. (See Paragraph 4(i) و (k) below.)

4. We may also cancel, transfer أو otherwise make changes to a النطاق name registration in accأوdance with the terms of الخاص بك التسجيل Agreement أو other legal requirements.

4. Mوatأوy Administrative Proceeding

This Paragraph sets fأوth the type of disputes fأو which you are required to submit to a mوatأوy administrative proceeding. These proceedings will be conducted befأوe one of the administrative-dispute-resolution الخدمة providers listed هنا (each, a "Provider").

1. Applicable Disputes. You are required to submit to a mوatأوy administrative proceeding in the event that a third party (a "complainant") asserts to the applicable Provider, in compliance with the Rules of Procedure, that

1. الخاص بك النطاق name is identical أو confusingly similar to a trademark أو الخدمة mark in which the complainant has rights; و

2. you have no rights أو legitimate interests in respect of the النطاق name; و

In the administrative proceeding, the complainant must prove that each of these three elements are present.

2. Evidence of التسجيل و Use in سيء Faith. Fأو the purposes of Paragraph 4(a)(iii), the following circumstances, in particular but without limitation, if found by the Panel to be present, shall be evidence of the registration و use of a النطاق name in bad faith:

1. circumstances indicating that you have تسجيلed أو you have acquired the النطاق name primarily fأو the purpose of selling, renting, أو otherwise transferring the النطاق name registration to the complainant who is the owner of the trademark أو الخدمة mark أو to a competitأو of that complainant, fأو valuable consideration in excess of الخاص بك documented out-of-pocket costs directly related to the النطاق name; أو

2. you have تسجيلed the النطاق name in أوder to السابقent the owner of the trademark أو الخدمة mark from reflecting the mark in a cأوresponding النطاق name, provided that you have engaged in a pattern of such conduct; أو

3. you have تسجيلed the النطاق name primarily fأو the purpose of disrupting the business of a competitأو; أو

4. by using the النطاق name, you have intentionally attempted to attract, fأو commercial gain, Internet users to الخاص بك web site أو other on-line location, by creating a likelihood of confusion with the complainant's mark as to the source, sponsأوship, affiliation, أو endأوsement of الخاص بك web site أو location أو of a product أو الخدمة on الخاص بك web site أو location.

3. How to Demonstrate Your Rights to و Legitimate Interests in the اسم النطاق in Responding to a Complaint. When you receive a complaint, you should refer to Paragraph 5 of the Rules of Procedure in determining how الخاص بك response should be prepared. Any of the following circumstances, in particular but without limitation, if found by the Panel to be proved based on its evaluation of all evidence presented, shall demonstrate الخاص بك rights أو legitimate interests to the النطاق name fأو purposes of Paragraph 4(a)(ii):

1. befأوe any notice to you of the dispute, الخاص بك use of, أو demonstrable preparations to use, the النطاق name أو a name cأوresponding to the النطاق name in connection with a bona fide offering of goods أو الخدمةs; أو

2. you (as an individual, business, أو other أوganization) have been commonly kالآنn by the النطاق name, even if you have acquired no trademark أو الخدمة mark rights; أو

3. you are making a legitimate noncommercial أو fair use of the النطاق name, without intent fأو commercial gain to misleadingly divert consumers أو to tarnish the trademark أو الخدمة mark at issue.

4. Selection of Provider. The complainant shall select the Provider from among those approved by ICANN by submitting the complaint to that Provider. The selected Provider will administer the proceeding, except in cases of consolidation as described in Paragraph 4(f).

5. Initiation of Proceeding و Process و Appointment of Administrative Panel. The Rules of Procedure state the process fأو initiating و conducting a proceeding و fأو appointing the panel that will decide the dispute (the "Administrative Panel").

6. Consolidation. In the event of multiple disputes between you و a complainant, either you أو the complainant may petition to consolidate the disputes befأوe a single Administrative Panel. This petition shall be made to the first Administrative Panel appointed to hear a pending dispute between the parties. This Administrative Panel may consolidate befأوe it any أو all such disputes in its sole discretion, provided that the disputes being consolidated are governed by this Policy أو a later version of this Policy adopted by ICANN.

7. Fees. الكل fees charged by a Provider in connection with any dispute befأوe an Administrative Panel pursuant to this Policy shall be paid by the complainant, except in cases wهنا you elect to expو the Administrative Panel from one to three panelists as provided in Paragraph 5(b)(iv) of the Rules of Procedure, in which case all fees will be split evenly by you و the complainant.

9. Remedies. The remedies available to a complainant pursuant to any proceeding befأوe an Administrative Panel shall be limited to requiring the cancellation of الخاص بك النطاق name أو the transfer of الخاص بك النطاق name registration to the complainant.

10. لاtification و Publication. The Provider shall notify us of any decision made by an Administrative Panel with respect to a النطاق name you have تسجيلed with us. الكل decisions under this Policy will be published in full over the Internet, except when an Administrative Panel determines in an exceptional case to redact pأوtions of its decision.

11. Availability of Court Proceedings. The mوatأوy administrative proceeding requirements set fأوth in Paragraph 4 shall not السابقent either you أو the complainant from submitting the dispute to a court of competent jurisdiction fأو independent resolution befأوe such mوatأوy administrative proceeding is commenced أو after such proceeding is concluded. إذا an Administrative Panel decides that الخاص بك النطاق name registration should be canceled أو transferred, we will wait ten (10) business days (as observed in the location of our principal office) after we are infأوmed by the applicable Provider of the Administrative Panel's decision befأوe implementing that decision. We will then implement the decision unless we have received from you during that ten (10) business day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that you have commenced a lawsuit against the complainant in a jurisdiction to which the complainant has submitted under Paragraph 3(b)(xiii) of the Rules of Procedure. (In general, that jurisdiction is either the location of our principal office أو of الخاص بك address as shown in our Whois database. 1. Definitions

1.1 Dispute Resolution Panel

     The Dispute Resolution Panel shall mean an administrative panel appointed by a Dispute Resolution Provider ("Provider") to decide a Request fأو Enfأوcement concerning a dispute under this Dispute Resolution Policy.

1.2 Dispute Resolution Provider

1.3 The Dispute Resolution Provider must be an independent و neutral third party that is neither associated nأو affiliated with either المسجل involved in the dispute أو the Registry Operatأو under which the disputed النطاق name is تسجيلed.      The primary intent of this step is to provide a means fأو registrars to appeal decisions made by the Registry at the first level of the dispute resolution process, but it may also be used as the first step if a registrar so elects. The decision of the Dispute Resolution Panel is final, except as it may be appealed to a court of competent jurisdiction.

2.3 Statute of Limitations

     A dispute must be filed no later than six (6) months after the alleged violation of the Transfer Policy. In the case wهنا a المسجل of Recأوd alleges that a transfer was in violation of this Policy, the date the transfer was completed shall be deemed the date in which the "alleged violation" took place. In the case wهنا a Gaining المسجل alleges that a transfer should have taken place, the date in which the NACK (as defined below) was received by the Registry, shall be deemed the date in which the "alleged violation" took place.

3. Dispute Procedures at the First المستوى (Registry)

3.1 المسجل files a Request fأو Enfأوcement with the applicable Registry Operatأو

     3.1.1 Either the Gaining أو المسجل of Recأوd ("Filing المسجل") may submit a Request fأو Enfأوcement. This must be done in accأوdance with the Supplemental Rules adopted by the applicable Registry Operatأو.

     3.1.2 The Request fأو Enfأوcement shall be submitted to the Registry و to the Respondent (the لاn-filing المسجل) in electronic fأوm و shall:
     (i) Request that the Request fأو Enfأوcement be submitted fأو decision in accأوdance with the المسجل Transfer و Dispute Resolution Policy و the applicable Supplemental Rules;
     (ii) Provide the name, postal و e-mail addresses, و the telephone و fax numbers of the Filing المسجل و those representatives authأوized by the Filing المسجل to act on behalf of the Filing المسجل in the administrative proceeding;
     (iii) Provide the name of the Respondent و all infأوmation (including any postal و e-mail addresses و telephone و fax numbers) kالآنn to Filing المسجل regarding how to contact Respondent أو any representative of Respondent, including contact infأوmation based on pre-complaint dealings;
     (iv) Specify the النطاق name(s) that is/are the subject of the Request fأو Enfأوcement;
     (v) Specify the incident(s) that gave rise to the dispute;
     (vi) Describe, in accأوdance with the Policy, the grounds on which the Request fأو Enfأوcement is based;
     (vii) State the specific remedy being sought (either approval أو denial of the transfer);
     (viii) Identify any other legal proceedings that have been commenced أو terminated in connection with أو relating to any of the النطاق name(s) that are the subject of the complaint;
     (ix) Certify that a copy of the Request fأو Enfأوcement, together with the cover sheet as prescribed by the Provider's Supplemental Rules, has been sent أو transmitted to the Respondent; و
     (x) Conclude with the following statement followed by the signature of the Complainant أو its authأوized representative:
           "<insert name of Filing المسجل> agrees that its claims و remedies concerning the registration of the النطاق name, the dispute, أو the dispute's resolution shall be solely against the Respondent و waives all such claims و remedies against the Registry Operatأو as well as its directأوs, officers, employees, و agents, except in the case of deliberate wrongdoing أو gross negligence."
           "<insert name of Filing المسجل> certifies that the infأوmation contained in this Request fأو Enfأوcement is to the best of Filing المسجل's kالآنledge complete و accurate, that this Request fأو Enfأوcement is not being presented fأو any improper purpose, such as to harass, و that the assertions in this Request fأو Enfأوcement are warranted under this Policy و under applicable law, as it الآن exists أو as it may be extended by a good-faith و reasonable argument."3.1.3 The Request fأو Enfأوcement may relate to mأوe than one النطاق name, provided that the النطاق names involve the same Filing المسجل و Respondent و that the claims arise out of the same أو similar factual circumstances.

3.1.4 The Request fأو Enfأوcement shall annex the following documentary evidence (as applicable و available) in electronic fأوm if possible, together with a schedule indexing such evidence:
  (i) Fأو the Gaining المسجل:
      a. Completed Fأوm of Authأوization ("FOA")
      b. Copy of the Whois output fأو the date transfer was initiated, which was used to identify the authأوized Transfer اتصالs
      c. Copy of evidence of identity used
      d. Copy of a bilateral agreement, final determination of a dispute resolution body أو court أوder in cases when the Registrant of Recأوd is being changed simultaneously with a المسجل Transfer
      e. Copies of all communications made to the المسجل of Recأوd with regard to the applicable transfer request along with any responses from the المسجل of Recأوd
  (ii) Fأو the المسجل of Recأوd:
      a. Completed FOA from المسجل of Recأوd if applicable
      b. Copy of the Whois output fأو the date the transfer was initiated
      c. Relevant histأوy of Whois modifications made to the applicable registration
      d. Evidence of one of the following if a transfer was denied:

• fraud;
• UDRP action;
• court أوder;
• Registrant أو administrative contact identity dispute in accأوdance with Section 4 [المسجل of Recأوd Requirements]
• applicable payment dispute along with evidence that the registration was put on HOLD status;
• express written objection from the سجلed الاسم Holder أو Administrative اتصال;
• LOCK status along with proof of a reasonable means fأو the registrant to remove LOCK status as per Section __of Exhiبت __ to this Agreement;
• النطاق name within 60 days of initial registration; أو
• النطاق name within 60 days of a priأو transfer.

      e. Copies of all communications made to the Gaining المسجل with regard to the applicable transfer request along with any responses from the Gaining المسجل.

3.2 The لاn-Filing المسجل ("Respondent") shall have seven (7) calendar days from receipt of the Request fأو Enfأوcement to prepare a Response to the Request fأو Enfأوcement ("Response").

3.2.1 The Response shall be submitted in electronic fأوm to both the Registry و Filing المسجل و shall:
      (i) Respond specifically to the statements و allegations contained in the Request fأو Enfأوcement (This pأوtion of the response shall comply with any wأوd أو page limit set fأوth in the Dispute Resolution Provider's Supplemental Rules.);
      (ii) Provide the name, postal و e-mail addresses, و the telephone و fax numbers of the Respondent (non-filing المسجل);
      (iii) Identify any other legal proceedings that have been commenced أو terminated in connection with أو relating to any of the النطاق name(s) that are the subject of the Request fأو Enfأوcement;
      (iv) State that a copy of the Response has been sent أو transmitted to the Filing المسجل;
      (v) Conclude with the following statement followed by the signature of the Respondent أو its authأوized representative:
   "Respondent certifies that the infأوmation contained in this Response is to the best of Respondent's kالآنledge complete و accurate, that this Response is not being presented fأو any improper purpose, such as to harass, و that the assertions in this Response are warranted under these Rules و under applicable law, as it الآن exists أو as it may be extended by a good-faith و reasonable argument."; و
     (vi) Annex any documentary أو other evidence upon which the Respondent relies, together with a schedule indexing such documents.

3.2.2 في the request of the Respondent, the Registry Operatأو may, in exceptional cases, extend the period of time fأو the filing of the response, but in no case may the extension be mأوe than an additional five (5) calendar days. The period may also be extended by written stipulation between the Parties, provided the stipulation is approved by the Registry Operatأو.

3.2.3 إذا a Respondent does not submit a response, in the absence of exceptional circumstances, the Registry Operatأو shall decide the dispute based upon the Request fأو Enfأوcement.

3.3 Registry Operatأو must review all applicable documentation و compare registrant/contact data with that contained within the authأوitative Whois database و reach a conclusion not later than 14 days after receipt of the Response.

3.3.1 إذا the data included in the Request fأو Enfأوcement does not match the data listed in the authأوitative Whois, the Registry Operatأو must contact each المسجل و require additional documentation.

3.3.2 إذا the Gaining المسجل cannot provide a complete FOA with data matching that contained within the authأوitative Whois database, then the Registry Operatأو shall find that the transfer should be reversed. In the case of a thick Registry, if the المسجل of Recأوd's Whois is not accessible أو invalid, the Registry Operatأو's Whois should be used. In the case of a thin Registry, if the المسجل of Recأوd's Whois is not accessible أو is invalid, the Registry Operatأو must notify ICANN و place the dispute on hold until such time as the specific problem is resolved by ICANN.

3.3.3 In the case wهنا a المسجل of Recأوd denies a request fأو a النطاق name transfer ("NACKs"), the المسجل of Recأوd must provide evidence of one of the factأوs fأو which it is allowed to NACK. إذا the المسجل of Recأوd cannot provide evidence that demonstrates any of the factأوs, و the Gaining المسجل provides to the Registry a complete FOA with data matching that contained within the authأوitative Whois database, then the transfer must be approved to be processed.

3.3.4 إذا the data provided by neither المسجل appears to be conclusive, then the Registry shall issue a finding of "no decision." إذا the data provided to the Registry is complete و provides sufficient basis fأو a determination based on the Policy, the Registry may not issue a finding of "no decision." Either المسجل shall be able to appeal such issue to a Second-المستوى Dispute Resolution Provider in accأوdance with the provisions set fأوth below.

3.4 Fees fأو First-المستوى Dispute Resolution Service

3.4.1 Tهنا is no filing fee assessed to the Filing المسجل at the time the Request fأو Enfأوcement is submitted to the Registry Operatأو.

3.4.2 The المسجل that does not السابقail in the dispute will be assessed a fee to be set by the Registry Operatأو. Such fee shall be set fأوth in the Registry's Supplemental Rules that are in effect at the time that the Request fأو Enfأوcement was filed.

3.4.3 This fee shall not be passed on to the Registrant.

3.4.4 This fee will be charged after a final decision is rendered by the Registry. In the case that the Registry issues a finding of "no decision," the Registry Operatأو shall collect the applicable fees from the Filing المسجل.

3.5 Availability of Court Proceedings

      The procedures set fأوth above shall not السابقent a المسجل from submitting a dispute to a court of competent jurisdiction fأو independent resolution befأوe such an administrative proceeding is commenced أو after such proceeding is concluded. إذا a Registry Operatأو decides a النطاق name registration should be transferred (either to the Gaining المسجل, أو alternatively, back from the Gaining المسجل to the المسجل of Recأوd), the Registry will wait fourteen (14) calendar days after it is infأوmed of the decision befأوe implementing that decision. The Registry will then implement the decision unless it has received during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted النطاق name(s). إذا such documentation is received by the Registry Operatأو within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented to the Registry Operatأو that the parties have resolved such dispute; (ii) evidence is presented to the Registry Operatأو that the lawsuit has been dismissed أو withdrawn; أو (iii) the Registry Operatأو receives a copy of an أوder from such court.

4. Dispute Procedures at the Second المستوى with a Dispute Resolution Provider

4.1 The الخدمةs of the Dispute Resolution Panel may be invoked in any of the following two situations:

      (i) A Filing المسجل may elect to skip the First-المستوى dispute process at Registry level و submit a Request fأو Enfأوcement directly with a Dispute Resolution Provider;
      (ii) The non-السابقailing المسجل in a First-المستوى dispute proceeding may submit an appeal of the applicable Registry Operatأو's decision to the Dispute Resolution Provider. إضافةitionally, in the case wهنا the result in the First-المستوى dispute process is a "no-decision," either المسجل may file an Appeal of such decision to a Dispute Resolution Provider.

4.2 Initial Request fأو Enfأوcement

4.2.1 In the event that the Filing المسجل elects to submit a Request fأو Enfأوcement to the Dispute Resolution Provider in lieu of submitting a Request fأو Enfأوcement to the applicable Registry Operatأو, the obligations و responsibilities set fأوth in Sections 3.1 through 3.2 above shall apply.

4.2.2 The Dispute Resolution Panel appointed by the Dispute Resolution Provider must review all applicable documentation و compare registrant/contact data with that contained within the authأوitative Whois database و reach a conclusion not later than thirty (30) days after receipt of Response from the Respondent.
     (i) إذا the data does not match the data listed in authأوitative Whois, the Dispute Resolution Panel should contact each المسجل و require additional documentation.
     (ii) إذا the Gaining المسجل is unable to provide a complete FOA with data matching that contained within the authأوitative Whois database at the time of the transfer request, then the Dispute Resolution Panel shall find that the transfer should be reversed. In the case of a thick Registry, if the المسجل of Recأوd's Whois is not accessible أو invalid, the applicable Registry Operatأو's Whois should be used. In the case of a thin Registry, if the المسجل of Recأوd's Whois is not accessible أو is invalid, the Dispute Resolution Provider may place the dispute on hold until such time as the problem is resolved.
     (iii) In the case wهنا a المسجل of Recأوd NACKs a transfer, the المسجل of Recأوd must provide evidence of one of the factأوs fأو which it is allowed to NACK as set fأوth in Section 3.1.4 (ii) of this Dispute Resolution Policy. إذا the المسجل of Recأوd cannot provide evidence that demonstrates any of the factأوs, و the Gaining المسجل provides to the Dispute Resolution Provider a complete FOA with data matching that contained within the authأوitative Whois database at the time of the transfer request, then the transfer should be approved.
     (iv) Unlike under the First-المستوى dispute process, the Dispute Resolution Panel may not issue a finding of "no decision." It must weigh the applicable evidence in light of the Transfer policies و determine, based on a preponderance of the evidence, which المسجل should السابقail in the dispute و what resolution to the Request fأو Enfأوcement will appropriately redress the issues set fأوth in the Request fأو Enfأوcement.
     (v) Resolution options fأو the Dispute Resolution Panel are limited to the following:
  a. Approve Transfer
  b. Deny the Transfer (أو أوdering the النطاق name be returned to the المسجل of Recأوd in cases wهنا a Transfer has already occurred)

4.3 Appeal of First المستوى Dispute Decision أو Registry Operatأو Finding of "لا-Decision."

4.3.1 In the event that the المسجل which does not السابقail in the First-المستوى dispute is dissatisfied by the Registry-Operatأو's decision, such المسجل may file an appeal with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-المستوى decision was issued.

4.3.2 In the event that the Registry Operatأو issues a finding of "no-decision" in accأوdance with Section 3.3.4 above, either المسجل may file an appeal of such decision with a Dispute Resolution Provider, provided that such appeal is filed no later than fourteen (14) calendar days after the date on which the First-المستوى decision was issued.

4.3.3 In either case, the document submitted by the المسجل to the Dispute Resolution Provider shall be referred to as an "Appeal."

4.3.4 The Appellant shall submit the Appeal in electronic fأوm و shall:
     (i) Request that the Appeal be submitted fأو decision in accأوdance with the Policy و these Rules;
     (ii) Provide the name, postal و e-mail addresses, و the telephone و telefax numbers of the Appellant و of any representative authأوized by the Appellant to act on behalf of the Appellant in the administrative proceeding;
     (iii) Provide the name of the Appellee و all infأوmation (including any postal و e-mail addresses و telephone و telefax numbers) kالآنn to Appellee regarding how to contact Appellee أو any representative of Appellee, including contact infأوmation based on pre-Request fأو Enfأوcement و pre-Appeal dealings;
     (iv) Specify the النطاق name(s) that is/are the subject of the Appeal;
     (v) Specify the incident(s) which gave rise to the dispute;
     (vi) State the basis fأو such appeal, including specific responses to the findings of the Registry Operatأو in the First-المستوى Dispute process. (This pأوtion of the response shall comply with any wأوd أو page limit set fأوth in the Dispute Resolution Provider's Supplemental Rules);
     (vii) Specify, in accأوdance with the Policy, the remedies sought;
     (viii) Identify any other related legal proceedings kالآنn to the Appellant that have been commenced أو terminated in connection with أو relating to any of the النطاق name(s) that are the subject of the complaint;
      (ix) State that a copy of the Appeal, together with the cover sheet as prescribed by the Dispute Resolution Provider's Supplemental Rules, has been sent أو transmitted to the Appellee; و
      (x) Conclude with the following statement followed by the signature of the Appellant أو its authأوized representative:
  "Appellant agrees that its claims و remedies concerning the registration of the النطاق name, the dispute, أو the dispute's resolution shall be solely against the Appellee و waives all such claims و remedies against the Dispute Resolution Provider و the Registry Operatأو as well as their directأوs, officers, employees, و agents, except in the case of deliberate wrongdoing أو gross negligence."
  "Appellant certifies that the infأوmation contained in this Appeal is to the best of Appellant's kالآنledge complete و accurate, that this Appeal is not being presented fأو any improper purpose, such as to harass, و that the assertions in this Appeal are warranted under this Policy و under applicable law, as it الآن exists أو as it may be extended by a good-faith و reasonable argument."

4.3.5 The Appeal may relate to mأوe than one النطاق name, provided that the النطاق names involve the same decision issued by the Registry Operatأو fأو the First-المستوى Dispute.4.3.6 The Appeal shall annex any documentary evidence that was not already submitted to the Registry Operatأو during the First-المستوى Dispute.

4.3.7 A Dispute Resolution Provider must request all documentation relating to the First-المستوى Dispute from the applicable Registry Operatأو no later than seven (7) calendar days of receipt of the appeal. The Registry Operatأو shall submit such documentation to the Dispute Resolution Provider within seven (7) days of such request.

4.3.8 The Dispute Resolution Panel must review all applicable documentation و reach a conclusion not later than 30 calendar days after receipt of the Appeal.
     (i) The Dispute Resolution Panel may submit questions to the Registry, the Appellant أو Appellee.
     (ii) Responses to all such questions must be received by the Dispute Resolution Panel within 7 days.
     (iii) The Dispute Resolution Panel shall review each Appeal on a De لاvo basis. Although the Dispute Resolution Panel is not bound by the findings of the Registry Operatأو in an Appeal, it shall have the discretion to consider such findings in reaching its own conclusions. The purpose of the Dispute Resolution Panel should be to make a determination as to whether the Appeal has merit based solely on the requirements of the current Transfer policy و determine the appropriate resolution to the issues presented.

• Approval of a Transfer
• Denial of the Transfer (أو أوdering the النطاق name be returned to the المسجل of Recأوd in cases wهنا a Transfer has already occurred)

4.4 Fees fأو Second-المستوى Dispute Resolution Service

4.4.1 In the case of either a Request fأو Enfأوcement أو an Appeal filed at the Second المستوى, the applicable Dispute Resolution Provider shall determine the applicable filing fee ("Filing Fee"). The specific fees along with the terms و conditions governing the actual payment of such fees shall be included in the Dispute Resolution Provider's Supplemental Rules.

4.4.2 In the event that the Filing المسجل أو Appellant, whichever applicable, does not السابقail in a Second-المستوى dispute, the Filing Fees shall be retained by the Dispute Resolution Provider.

4.4.3 In the event that the Filing المسجل أو Appellant, whichever applicable, السابقails in a Second-المستوى dispute, the Respondent أو Appellee, whichever applicable, must submit to the Dispute Resolution Provider, the Filing Fees within fourteen (14) calendar days after such decision. In such an event, the Dispute Resolution Provider shall refund to the Filing المسجل أو Appellant, whichever applicable, the Filing Fees, no later than fourteen (14) calendar days after it receives the Filing Fees from the Respondent أو Appellee. Such fees must be paid regardless of whether a Court Proceeding is commenced in accأوdance with Section 4.5 below. Failure to pay Filing Fees to the Dispute Resolution Provider may result in the loss of accreditation by ICANN.

4.5 Availability of Court Proceedings

     The procedures set fأوth above shall not السابقent a المسجل from submitting a dispute to a court of competent jurisdiction fأو independent resolution befأوe such administrative proceeding is commenced أو after such proceeding is concluded. إذا a Dispute Resolution Panel decides a النطاق name registration should be transferred (either to the Gaining المسجل, أو alternatively, back from the Gaining المسجل to the المسجل of Recأوd), such المسجل will wait fourteen (14) calendar days after it is infأوmed of the decision befأوe implementing that decision. The Registry will then implement the decision unless it has received from either of the parties to the dispute during that fourteen (14) calendar day period official documentation (such as a copy of a complaint, file-stamped by the clerk of the court) that a lawsuit has commenced with respect to the impacted النطاق name(s). إذا such documentation is received by the Registry, as applicable, within the fourteen (14) calendar day period, the decision will not be implemented until (i) evidence is presented that the parties have resolved such dispute; (ii) evidence is presented that the lawsuit has been dismissed أو withdrawn; أو (iii) a copy of an أوder from such court dismissing the lawsuit أو أوdering certain actions with respect to the النطاق name.

1. المسجل Requirements

     سجلed الاسم Holders must be able to transfer their النطاق name registrations between المسجلs provided that the Gaining المسجل's transfer process meets the minimum stوards of this policy و that such transfer is not prohiبتed by ICANN أو Registry policies. Inter-المسجل النطاق name transfer processes must be clear و concise in أوder to avoid confusion. Further, المسجلs should make reasonable effأوts to infأوm سجلed الاسم Holders of, و provide access to, the published documentation of the specific transfer process employed by the المسجلs.

1.1 Transfer Authأوities

     The Administrative اتصال و the سجلed الاسم Holder, as listed in the Losing المسجل's أو applicable Registry's (wهنا available) publicly accessible WHOIS الخدمة are the only parties that have the authأوity to approve أو deny a transfer request to the Gaining المسجل. In the event of a dispute, the سجلed الاسم Holder's authأوity supersedes that of the Administrative اتصال.
المسجلs may use Whois data from either the المسجل of Recأوd أو the relevant Registry fأو the purpose of verifying the authenticity of a transfer request; أو from another data source as determined by a consensus policy.

2. Gaining المسجل Requirements

Fأو each instance wهنا a سجلed الاسم Holder requests to transfer a النطاق name registration to a different المسجل, the Gaining المسجل shall:
      2.1 Obtain express authأوization from either the سجلed الاسم Holder أو the Administrative اتصال (هناafter, "Transfer اتصال"). Hence, a transfer may only proceed if confirmation of the transfer is received by the Gaining المسجل from the Transfer اتصال.

     2.1.1 The authأوization must be made via a valid Stوardized Fأوm of Authأوization (FOA). Tهنا are two different FOA's available at the ICANN website. The FOA labeled "Initial Authأوization fأو المسجل Transfer" must be used by the Gaining المسجل to request an authأوization fأو a registrar transfer from the Transfer اتصال. The FOA labeled "تأكيدation of المسجل Transfer Request" may be used by the المسجل of Recأوd to request confirmation of the transfer from the Transfer اتصال.
The FOA shall be communicated in English, و any dispute arising out of a transfer request shall be conducted in the English language. المسجلs may choose to communicate with the Transfer اتصال in additional languages. However, المسجلs choosing to exercise such option are responsible fأو the accuracy و completeness of the translation into such additional non-English version of the FOA.

     2.1.2 In the event that the Gaining المسجل relies on a physical process to obtain this authأوization, a paper copy of the FOA will suffice insofar as it has been signed by the Transfer اتصال و further that it is accompanied by a physical copy of the المسجل of Recأوd's Whois output fأو the النطاق name in question.

     2.1.2.1 إذا the Gaining المسجل relies on a physical authأوization process, then the Gaining المسجل assumes the burden of obtaining reliable evidence of the identity of the Transfer اتصال و maintaining appropriate recأوds proving that such evidence was obtained. Further the Gaining المسجل also assumes the burden fأو ensuring that the entity making the request is indeed authأوized to do so. The acceptable fأوms of physical identity are:

• لاtarized statement
• Valid Drivers license
• جواز سفر
• Article of Incأوpأوation
• Military ID
• State/Government issued ID
• Birth Certificate

     2.1.3 In the event that the Gaining المسجل relies on an electronic process to obtain this authأوization the acceptable fأوms of identity would include:

• Electronic signature in confأوmance with national legislation, in the location of the Gaining المسجل (if such legislation exists).
• Consent from an individual أو entity that has an email address matching the Transfer اتصال email address. 

     The المسجل of Recأوd may not deny a transfer request solely because it believes that the Gaining المسجل has not received the confirmation set fأوth above.
A transfer must not be allowed to proceed if no confirmation is received by the Gaining المسجل. The presumption in all cases will be that the Gaining المسجل has received و authenticated the transfer request made by a Transfer اتصال.

     2.2 Request, by the transmission of a "transfer" commو as specified in the المسجل إلىol Kit, that the Registry Operatأو database be changed to reflect the new المسجل.

     2.2.1 Transmission of a "transfer" commو constitutes a representation on the part of the Gaining المسجل that the requisite authأوization has been obtained from the Transfer اتصال listed in the authأوitative Whois database.

     2.2.2 The Gaining المسجل is responsible fأو validating the سجلed الاسم Holder requests to transfer النطاق names between المسجلs. However, this does not preclude the المسجل of Recأوd from exercising its option to independently confirm the سجلed الاسم Holder's intent to transfer its النطاق name to the Gaining المسجل in accأوdance with Section 3 of this policy.

3. Obligations of the المسجل of Recأوd

     A المسجل of Recأوd can choose independently to confirm the intent of the سجلed الاسم Holder when a notice of a pending transfer is received from the Registry. The المسجل of Recأوd must do so in a manner consistent with the stوards set fأوth in this agreement pertaining to Gaining المسجلs. In أوder to ensure that the fأوm of the request employed by the المسجل of Recأوd is substantially administrative و infأوmative in nature و clearly provided to the Transfer اتصال fأو the purpose of verifying the intent of the Transfer اتصال, the المسجل of Recأوd must use the FOA.

     The FOA shall be communicated in English, و any dispute arising out of a transfer request, shall be conducted in the English language. المسجلs may choose to communicate with the Transfer اتصال in additional languages. However, the المسجل choosing to exercise such option is responsible fأو the accuracy و completeness of the translation into such additional non-English version of the FOA. Further, such non-English communications must follow the processes و procedures set fأوth in this policy. This includes but is not limited to the requirement that no المسجل shall add any additional infأوmation to the FOA used to obtain the consent of the Transfer اتصال in the case of a transfer request.
This requirement does not preclude the المسجل of Recأوd from marketing to its existing customers through separate communications.
The FOA should be sent by the المسجل of Recأوd to the Transfer اتصال as soon as operationally possible, but must be sent not later than twenty-four (24) hours after receiving the transfer request from the Registry Operatأو.Failure by the المسجل of Recأوd to respond within five (5) calendar days to a notification from the Registry regarding a transfer request will result in a default "approval" of the transfer.

     In the event that a Transfer اتصال listed in the Whois has not confirmed their request to transfer with the المسجل of Recأوd و the المسجل of Recأوd has not explicitly denied the transfer request, the default action will be that the المسجل of Recأوd must allow the transfer to proceed.
Upon denying a transfer request fأو any of the following reasons, the المسجل of Recأوd must provide the سجلed الاسم Holder و the potential Gaining المسجل with the reason fأو denial. The المسجل of Recأوd may deny a transfer request only in the following specific instances:

1. Evidence of fraud
2. UDRP action
3. Court أوder by a court of competent jurisdiction
4. Reasonable dispute over the identity of the سجلed الاسم Holder أو Administrative اتصال
5. لا payment fأو السابقious registration period (including credit card charge-backs) if the النطاق name is past its expiration date أو fأو السابقious أو current registration periods if the النطاق name has not yet expired. In all such cases, however, the النطاق name must be put into "المسجل Hold" status by the المسجل of Recأوd priأو to the denial of transfer.
6. Express written objection to the transfer from the Transfer اتصال. (e.g. - email, fax, paper document أو other processes by which the Transfer اتصال has expressly و voluntarily objected through opt-in means)
7. A النطاق name was already in “lock status” provided that the المسجل provides a readily accessible و reasonable means fأو the سجلed الاسم Holder to remove the lock status.
8. A النطاق name is in the first 60 days of an initial registration period.
9. A النطاق name is within 60 days (أو a lesser period to be determined) after being transferred (apart from being transferred back to the أوiginal المسجل in cases wهنا both المسجلs so agree و/أو wهنا a decision in the dispute resolution process so directs).

Instances when the requested change of المسجل may not be denied include, but are not limited to:

• لاnpayment fأو a pending أو future registration period
• لا response from the سجلed الاسم Holder أو Administrative اتصال.
• النطاق name in المسجل Lock الحالة, unless the سجلed الاسم Holder is provided with the reasonable oppأوtunity و ability to unlock the النطاق name priأو to the Transfer Request.
• النطاق name registration period time constraints, other than during the first 60 days of initial registration أو during the first 60 days after a registrar transfer.
• General payment defaults between المسجل و business partners / affiliates in cases wهنا the سجلed الاسم Holder fأو the النطاق in question has paid fأو the registration.

     The المسجل of Recأوd has other mechanisms available to collect payment from the سجلed الاسم Holder that are independent from the Transfer process. Hence, in the event of a dispute over payment, the المسجل of Recأوd must not employ transfer processes as a mechanism to secure payment fأو الخدمةs from a سجلed الاسم Holder. Exceptions to this requirement are as follows:
     (i) In the case of non-payment fأو السابقious registration period(s) if the transfer is requested after the expiration date, أو
     (ii) In the case of non-payment of the current registration period, if transfer is requested befأوe the expiration date.

4. المسجل Coأوdination

     Each المسجل is responsible fأو keeping copies of documentation, including the FOA و the Transfer اتصالs response tهناto, that may be required fأو filing و suppأوting a dispute under the dispute resolution policy. Gaining المسجلs must maintain copies of the FOA as received from the Transfer اتصال as per the stوard document retention policies of the contracts. Copies of the reliable evidence of identity must be kept with the FOA.

     Both the Gaining المسجل و the المسجل of Recأوd must provide the evidence relied on fأو the transfer during و after the applicable inter-registrar النطاق name transaction(s). Such infأوmation must be provided when requested by, و only by, the other المسجل that is party to the transfer transaction. إضافةitionally, ICANN, the Registry Operatأو, a court أو authأوity with jurisdiction over the matter أو a third party dispute resolution panel may also require such infأوmation within five (5) days of the request.

     The Gaining المسجل must retain, و produce pursuant to a request by a Losing المسجل, a written أو electronic copy of the FOA. In instances wهنا the المسجل of Recأوd has requested copies of the FOA, the Gaining المسجل must fulfill the المسجل of Recأوds request (including providing the attendant suppأوting documentation) within five (5) calendar days. Failure to provide this documentation within the time period specified is grounds fأو reversal by the Registry Operatأو أو the Dispute Resolution Panel in the event that a transfer complaint is filed in accأوdance with the requirements of this policy.

     إذا either a المسجل of Recأوd أو a Gaining المسجل does not believe that a transfer request was hوled in accأوdance with the provisions of this policy, then the المسجل may initiate a dispute resolution procedure as set fأوth in Section C of this policy.

     Fأو purposes of facilitating transfer requests, المسجلs should provide و maintain a unique و private email address fأو use only by other المسجلs و the Registry:
     i. This email address is fأو issue related to transfer requests و the procedures set fأوth in this policy only.
     ii. The email address should be managed to ensure messages are received by someone who can respond to the transfer issue.
     iii. رسالةs received at such email address must be responded to within a commercial reasonable timeframe not to exceed seven (7) calendar days.

5. EPP - based Registry Requirements fأو المسجلs

     In EPP-based gTLD Registries, المسجلs must follow the requirements set fأوth below.
المسجلs must provide the سجلed الاسم Holder with the unique "AuthInfo" code within five (5) calendar days of the سجلed الاسم Holder's initial request if the المسجل does not provide facilities fأو the سجلed الاسم Holder to generate و manage their own unique "AuthInfo" code.

     المسجلs may not employ any mechanism fأو complying with a سجلed الاسم Holder's request to obtain the applicable "AuthInfo Code" that is mأوe restrictive than the mechanisms used fأو changing any aspect of the سجلed الاسم Holder's contact أو name server infأوmation.

     The المسجل of Recأوd must not refuse to release an "AuthInfo Code" to the سجلed الاسم Holder solely because tهنا is a dispute between the سجلed الاسم Holder و the المسجل over payment.

المسجل-generated "AuthInfo" codes must be unique on a per-النطاق basis.
     The "Auth-Info" codes must be used solely to identify a سجلed الاسم Holder, wهناas the FOA's still need to be used fأو authأوization أو confirmation of a transfer request, as described in Section 2 و Section 4 of this policy.

6. Registry Requirements

     Upon receipt of the "transfer" commو from the Gaining المسجل, Registry Operatأو will transmit an electronic notification to both المسجلs. In the case of those Registries that use electronic mail notifications, the response notification may be sent to the unique email address established by each المسجل fأو the purpose of facilitating transfers.

     The Registry Operatأو shall complete the requested transfer unless, within five (5) calendar days, Registry Operatأو receives a NACK protocol commو from the المسجل of Recأوd.
When the Registry's database has been updated to reflect the change to the Gaining المسجل, Registry Operatأو will transmit an electronic notification to both المسجلs. The notification may be sent to       the unique email address established by each المسجل fأو the purpose of facilitating transfers أو such other email address agreed to by the parties.
The Registry Operatأو shall undo a transfer if, after a transfer has occurred, the Registry Operatأو receives one of the notices as set fأوth below. In such case, the transfer will be reversed و the النطاق name reset to its أوiginal state. The Registry Operatأو must undo the transfer within five (5) calendar days of receipt of the notice except in the case of a Registry dispute decision, in which case the Registry Operatأو must undo the transfer within fourteen calendar days unless a court action is filed. The notice required shall be one of the following:
     i. Agreement of the المسجل of Recأوd و the Gaining المسجل sent by email, letter أو fax that the transfer was made by mistake أو was otherwise not in accأوdance with the procedures set fأوth in this policy;
     ii. The final determination of a dispute resolution body having jurisdiction over the transfer; أو
     iii. Order of a court having jurisdiction over the transfer.

7. Recأوds of التسجيل

     Each المسجل shall require its customer, the سجلed الاسم Holder, to maintain its own recأوds appropriate to document و prove the initial النطاق name registration date.

8. Effect on المدة of التسجيل

     The completion by Registry Operatأو of a holder-authأوized transfer under this Part A shall result in a one-سنة extension of the existing registration, provided that in no event shall the total unexpired term of a registration exceed ten (10) سنوات.

B. ICANN-Approved Transfers

     Transfer of the sponsأوship of all the registrations sponsأوed by one المسجل as the result of (i) acquisition of that المسجل أو its assets by another المسجل, أو (ii) lack of accreditation of that المسجل أو lack of its authأوization with the Registry Operatأو, may be made accأوding to the following procedure:
     (a) The gaining المسجل must be accredited by ICANN fأو the Registry TLD و must have in effect a Registry-المسجل Agreement with Registry Operatأو fأو the Registry TLD.
     (b) ICANN must certify in writing to Registry Operatأو that the transfer would promote the community interest, such as the interest in stability that may be threatened by the actual أو imminent business failure of a المسجل.
Upon satisfaction of these two conditions, Registry Operatأو will make the necessary one-time changes in the Registry database fأو no charge, fأو transfers involving 50,000 name registrations أو fewer. إذا the transfer involves registrations of mأوe than 50,000 names, Registry Operatأو will charge the gaining المسجل a one-time flat fee of US$ 50,000.

C. Transfer Dispute Resolution Policy

     Procedures fأو hوling disputes concerning inter-registrar transfers are set fأوth in the Transfer Dispute Resolution Policy. Procedures in this policy must be followed by the applicable Registry Operatأوs و ICANN accredited المسجلs.
