Business Email Service Terms

These Terms govern business-email and related mailbox services ("Email Service") supplied by NICENIC INTERNATIONAL GROUP CO., LIMITED ("NiceNIC").

1. Eligibility and Agreement
You must have legal capacity to enter into this Agreement. If you use the Email Service for an organization, you represent that you are authorized to bind that organization.

By ordering, activating, renewing, or using the Email Service, you agree to these Terms, the NiceNIC Terms of Service & Acceptable Use Policy, and the NiceNIC Privacy Policy.

2. Service
The features, storage, mailbox count, sending limits, retention features, and other specifications of your Email Service are those stated in the applicable order, plan, or control panel.

NiceNIC may use third-party infrastructure or service providers to deliver all or part of the Email Service.

No email service can guarantee uninterrupted delivery, universal deliverability, or acceptance by every recipient system.

3. Account and Credential Security
You are responsible for:

maintaining accurate account information;
keeping passwords, 2FA credentials, recovery information, and administrator access secure;
configuring mail clients and DNS records correctly where required;
promptly changing compromised credentials; and
notifying NiceNIC promptly if you reasonably suspect unauthorized use.
You are responsible for activity carried out through credentials under your control, subject to applicable law and circumstances demonstrating unauthorized access.

4. Authorized Use
You may use paid business-email services for legitimate personal or business communications consistent with applicable law and these Terms.

You must not use the Email Service to:

send spam or unsolicited bulk or commercial email in violation of applicable law or industry rules;
operate phishing, credential theft, fraud, impersonation, malware, ransomware, botnet, or other malicious campaigns;
forge or materially falsify message-source information;
harvest addresses unlawfully;
distribute unlawful content;
infringe intellectual-property, privacy, or other legal rights;
evade sending limits, anti-abuse controls, or blocklists;
compromise other systems or accounts; or
interfere with the security or operation of NiceNIC or third-party networks.
5. Anti-Spam and Deliverability Controls
NiceNIC may apply reasonable sending limits, rate limits, reputation controls, malware filtering, spam filtering, quarantine, temporary deferrals, or other measures intended to protect customers and network reputation.

Where NiceNIC has reasonable evidence that an account is sending spam, phishing, malware, or other prohibited traffic, NiceNIC may restrict outbound sending, suspend affected mailboxes, require remediation, or terminate the affected service as reasonably appropriate.

6. Customer Content
You retain your rights in email messages, files, and other content you lawfully provide to the Email Service.

You grant NiceNIC and its service providers a limited license to store, transmit, copy, process, scan, and otherwise handle that content only as reasonably necessary to:

provide and secure the Email Service;
filter spam, malware, or abuse;
troubleshoot or support the service;
comply with law or valid legal process; and
enforce applicable terms.


7. Privacy
Personal data and service logs are processed under the NiceNIC Privacy Policy and applicable law.

NiceNIC does not claim a general right to read customer email for unrelated purposes. Automated or human access may occur where reasonably necessary for security, abuse prevention, technical support, service delivery, legal compliance, or where the customer authorizes such access.

8. Storage, Retention, and Backup
Mailbox storage and retention are limited by the applicable plan.

Unless a specific backup or archival feature is expressly included in the purchased plan, the Email Service is not a substitute for an independent backup or records-retention system. You are responsible for maintaining copies of important business records where appropriate.

Upon expiration or termination, data may be deleted after the applicable retention/grace period. Customers should export required data before cancellation or expiry.

9. Fees, Renewal, and Refunds
Fees and renewal terms are shown at checkout, in the account, or on the applicable product page.

Email-service fees are not refundable merely because a customer elects not to use an activated service, except where NiceNIC's published refund terms or mandatory law require otherwise.

Nothing in these Terms limits a refund or consumer right that cannot lawfully be excluded.

10. Suspension and Termination
NiceNIC may suspend or restrict the Email Service where reasonably necessary because of:

non-payment;
material breach;
security compromise;
spam, phishing, malware, fraud, or other prohibited use;
legal or regulatory requirement;
material risk to service reputation or other users; or
excessive or abusive resource use contrary to the plan.
Where circumstances permit, NiceNIC will provide notice and a reasonable opportunity to cure. Immediate action may be taken where delay would create a material security, legal, abuse, or operational risk.

11. Service Availability
NiceNIC will use commercially reasonable efforts to provide the Email Service but does not guarantee continuous, error-free, or loss-free operation.

Maintenance, upstream-provider failures, internet routing, recipient-server policies, DNS errors, blocklists, force majeure, and customer configuration may affect service.

12. Disclaimer and Liability
To the maximum extent permitted by law, the Email Service is provided on an "as available" basis. NiceNIC does not guarantee that every message will be delivered, accepted, retained, or free from filtering.

NiceNIC will not be liable for indirect, incidental, special, exemplary, or consequential loss, or loss of profit, revenue, business opportunity, or goodwill, except where such exclusion is prohibited by law.

For direct contractual loss, NiceNIC's aggregate liability relating to the affected Email Service will not exceed the amount paid for that affected service during the twelve months preceding the event giving rise to the claim, except for liability that cannot lawfully be limited.

13. Indemnity
To the extent permitted by law, you will indemnify NiceNIC against third-party claims and reasonable costs arising from your unlawful use of the Email Service, content you send, or your material breach of these Terms, except to the extent caused by NiceNIC's own fraud or wilful misconduct.

14. Changes
NiceNIC may update these Terms for changes in law, security, infrastructure, service features, or business requirements.

Mandatory changes may take effect when required. Other material changes will be notified reasonably in advance where practicable.

15. Governing Law
These Terms are governed by the laws of the Hong Kong Special Administrative Region. Subject to mandatory law, the courts of Hong Kong have non-exclusive jurisdiction.
